Sodba ESČP z dne 31. oktobra 2017 v zadevi Krajnc proti Sloveniji (pritožba št. 38775/14).

V obravnavanem primeru je pritožba uspešno obravnavala pritožbo o zmanjšanju zneska invalidske pokojnine, ki je bila predhodno dodeljena prosilcu, čigar delovna zmogljivost se je kasneje še zmanjšala. Primer je bil kršitev zahtev člena 1 Protokola št. 1 h Konvenciji o varstvu človekovih pravic in temeljnih svoboščin.

V letu 2014 je pritožniku pomagal pri pripravi pritožbe. Kasneje je bila pritožba posredovana Sloveniji.

 

OKOLIŠČINE DELA


Vložnik, ki je imel invalidnost, je prejel ugodnosti. Nekaj ​​let pozneje je prejel ramo poškodbe, in kot rezultat pregleda svoje invalidnosti je bilo ugotovljeno, da je njegova sposobnost za nadaljnje delo zmanjšalo.

VPRAŠANJA ZAKONA


V zvezi s spoštovanjem člena 1 Protokola št. 1 h Konvenciji. Če imajo organi države pogodbenice, je zakonodaja, ki določa plačilo, kot je pravica do socialnih prejemkov, mora zakonodaja šteti ustvarjati lastniški interes, ki spada na področje uporabe člena 1 Protokola N 1 Konvencije, da osebe, ki izpolnjujejo njegove zahteve. The ECHR judgment of 31 October 2017 in the case of Krajnc v. Slovenia (аpplication No. 38775/14).

In the case, the аpplication successfully addressed a аpplication about a reduction in the amount of the disability pension previously assigned to the applicant, whose work capacity subsequently decreased further. CIRCUMSTANCES OF THE CASE


The applicant, who had a disability, received benefits. A few years later, he suffered a shoulder injury, and as a result of a review of his work capacity, it was ascertained that his ability to work was further reduced.

Meanwhile, the relevant legislation was amended, and due to a change in the law, his disability benefit was reduced after reassessing to less than half the amount he had previously received. The applicant's аpplications about this decision did not yield results.

At the Court, the applicant complained that a decrease in the benefit in respect of his disability violated his rights under Article 1 of Protocol No. 1 to the Convention.

 

ISSUES OF LAW

Concerning compliance with Article 1 of Protocol No. 1 to the Convention. If the authorities of the State Party have existing legislation providing for payment as a right to social benefits, this legislation should be considered as generating property interest related to the scope of Article 1 of Protocol No. 1 to persons satisfying its requirements. If the amount of the benefit is reduced or canceled, this constitutes an interference with property that requires justification. Any intervention must be reasonably proportionate to the objective pursued. The required fair balance will not be established if the person concerned carries an individual or excessive burden. The new legislation provided that those persons who acquired rights under the former system continue to use them after its entry into force. This reinforced the applicant's legitimate expectation of continuing to receive benefits after the reform of the law. Only when his disability was found to be aggravated, a fact that he could hardly predict and prepare for it, he was affected by the new legislation.
The different treatment of two groups of unemployed disabled workers: those whose disability has remained unchanged and whose disability has deteriorated, which resulted in the applicant's sudden disqualification of his disability allowance and the simultaneous additional restriction of labor opportunities, attached great importance to the assessment of the issue of proportionality. Of significant importance is the fact that the applicant was an unemployed person and obviously had difficulties in obtaining paid work in connection with his disability. This vulnerability was exactly the one that this disability benefit should have eliminated. The reduction in disability benefits, which seriously affected his livelihood, was not mitigated by any transitional measure that allowed him to adapt to the new situation.

The reform of the legislation on pensions and disability insurance served a legitimate purpose and led to an increase in the employment of disabled people. However, despite the wide margin of appreciation of the state in this area, the applicant was forced to bear an excessive individual burden that undermined the fair balance that should be established between the protection of property and the requirements of common interest.

 

DECISION


There has been a violation of Article 1 of Protocol No. 1 (unanimously).


COMPENSATION


In the application of Article 41 of the Convention. The Court awarded the applicant EUR 10,000 in respect of pecuniary and non-pecuniary damage.

Sentenza della Corte EDU del 26 ottobre 2017 nel caso di Azzolina e altri c. Italia (reclami nn. 28923/09 e 67599/10).

 

Il caso ha esaminato con successo denunce di maltrattamenti di agenti di polizia con manifestanti che sono stati detenuti e messi in custodia durante il vertice del G8. C'è stata una violazione dell'articolo 3 della Convenzione per la protezione dei diritti umani e delle libertà fondamentali.

 

Nel 2009 e nel 2010, i richiedenti sono stati assistiti nella preparazione dei reclami. Successivamente, i reclami sono stati combinati e comunicati all'Italia.

 

 

 

CIRCOSTANZE DEL CASO

 


I ricorrenti sono stati detenuti in varie parti della città di Genova durante il summit del G-8 nel 2001, quando è stato organizzato un summit anti-globalizzazione e hanno avuto luogo varie dimostrazioni. I ricorrenti sono stati portati nelle caserme utilizzate come luoghi di detenzione temporanei. Lì furono sottoposti a atti di violenza, umiliazione e altre forme di maltrattamento.

 

Nella sentenza della Corte di giustizia europea "Chestaro contro l'Italia" (Cestaro c. Italia) (il 7 aprile 2015, la denuncia N 6884/11, "Notiziario della giurisprudenza della Corte europea dei diritti dell'uomo" N 184), che riguardava di più un episodio di atti di violenza commessi dalle forze di sicurezza durante lo stesso vertice, la Corte ha riscontrato una violazione degli aspetti sostanziali e procedurali dell'articolo 3 della Convenzione. È giunto alla conclusione che queste azioni equivalgono alla tortura e sottolineano le carenze della legislazione penale pertinente.

 


QUESTIONI DI LEGGE

 


Per quanto riguarda il rispetto dell'articolo 3 della Convenzione. (a) L'aspetto sostanziale. La Corte europea ha fatto riferimento ai fatti stabiliti dai tribunali nazionali, che non hanno contraddetto nessuno dei materiali del caso:

 

- all'arrivo presso la caserma dei ricorrenti era proibito guardare i funzionari li guardia, alcuni dei candidati scritto sulla sua guance lettera X. Tutti i ricorrenti sono stati ordinato di fermarsi, le braccia e le gambe, e guardando le recinzioni all'interno della caserma. Sono stati costretti a stare nella stessa posizione umiliante all'interno delle celle;

 

- all'interno della caserma, i ricorrenti sono stati costretti a camminare a capo chino verso il basso, in questa posizione, sono stati costretti a passare attraverso il "tunnel Dipendenti", vale a dire, attraverso un corridoio nella caserma dove i poliziotti stavano su entrambi i lati, minacciando e picchiarli, gridando abuso politico e sessuale in relazione a loro;

 

- Durante le visite mediche, i candidati sono stati costretti a sopportare insulti, umiliazioni e talvolta minacce da parte del personale medico e degli agenti di polizia presenti;

 

- gli oggetti personali dei richiedenti sono stati confiscati o distrutti;

 

- Dato che la caserma era un'area così piccola, e le azioni violente sono state commesse così spesso, tutti i poliziotti presenti erano a conoscenza delle violenze commesse dai loro colleghi e / o subordinati;

 

- hanno contestato i fatti non possono essere considerate come limitate nel tempo e ha avuto luogo in un momento in cui tale comportamento violento potrebbe essere causato da (anche se ingiustificatamente) forte stress e situazione tesa: gli eventi in questione hanno continuato per un lungo periodo, cioè tra il 20 di notte su 21 luglio e 23 luglio, il che significa che diverse squadre di poliziotti hanno costantemente prestato servizio in caserma in assenza di una riduzione significativa della frequenza o dell'intensità degli episodi di violenza.

 

I richiedenti, che non hanno fornito resistenza fisica, hanno subito una lunga e sistematica sequenza di atti di violenza che hanno causato gravi sofferenze fisiche e psicologiche. Non essendo fatti isolati, violenza fisica e psicologica era indiscriminata, permanente e, in una certa misura organizzata, che ha comportato "una sorta di processo disumanizzazione, che riduce l'individuo a un oggetto in relazione al quale la violenza."

 

Questi eventi si sono verificati in un ambiente deliberatamente teso, nervoso e rumoroso, mentre il personale ha urlato ai detenuti e talvolta ha cantato inni fascisti.

 

Gli agenti di polizia presenti, dal livello più basso al personale di comando, hanno gravemente violato il loro dovere etico primario di proteggere le persone inviate sotto la loro supervisione e che si trovavano in una posizione vulnerabile.
È impossibile ignorare i fatti secondo cui i ricorrenti non erano solo direttamente vittime di maltrattamenti, ma anche testimoni indifesi dell'uso incontrollato della violenza nei confronti di altri detenuti.

 

I ricorrenti, che furono trattati come oggetti, trascorsero l'intero periodo della loro detenzione in un'atmosfera di "illegalità", quando le garanzie più elementari furono sospese. La violenza di cui sopra è stata esacerbata da altre violazioni dei diritti dei ricorrenti:

 

- nessuno di loro potrebbe contattare un parente, un avvocato o, se necessario, un rappresentante consolare;

 

- i loro oggetti personali furono spezzati in loro presenza;

 

- non era consentito l'accesso alla toilette, in ogni caso, dai tentativi di accesso al bagno i richiedenti erano trattenuti dagli insulti, dalle violenze e dalle umiliazioni subite da coloro che richiedevano tale accesso;

 

- La mancanza di cibo e biancheria da letto, anche se ciò era dovuto a carenze di approvvigionamento, e non a una decisione deliberata, ha ulteriormente intensificato lo stress e la sofferenza.

 

Questi ripetuti atti di violenza, che riflettono il desiderio di punizione e vendetta, dovrebbero essere considerati atti di tortura.

 

 

 

DECISIONE

 


C'era stata una violazione dell'articolo 3 della Convenzione (all'unanimità).

 

(b) L'aspetto procedurale. Notando l'entrata in vigore nel 2017. COMPENSAZIONE

 


Nell'applicazione dell'articolo 41 della Convenzione. La Corte ha assegnato 85.000 euro al primo richiedente e di euro 80.000 per ciascuno degli altri candidati per il danno non patrimoniale, la somma accordata da parte dei giudici nazionali sono stati dedotti, quando sono già stati pagati. La richiesta di risarcimento del danno patrimoniale è stata respinta.

The case successfully examined аpplications of ill-treatment of police officers with demonstrators who were detained and placed in custody during the G8 summit. There has been a violation of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In 2009 and 2010, the applicants were assisted in the preparation of аpplications. Subsequently, the аpplications were combined and communicated to Italy.

 

 

 

CIRCUMSTANCES OF THE CASE

 


The applicants were detained in various parts of the city of Genoa during the G-8 summit in 2001, when an anti-globalization summit was organized and various demonstrations took place. The applicants were taken to the barracks used as temporary places of detention. There they were subjected to acts of violence, humiliation and other forms of ill-treatment.
In the Cestaro judgment of the European Court of Human Rights (Cestaro v. Italy) (of 7 April 2015, complaint No. 6884/11, "Fact sheet on the case-law of the European Court of Human Rights" No. 184), which concerned one episode of violent acts committed by security forces during the same summit, the Court found a violation of the substantive and procedural aspects of Article 3 of the Convention. He came to the conclusion that these actions amounted to torture, and stressed the shortcomings of the relevant criminal legislation.

 


ISSUES OF LAW

 


Concerning compliance with Article 3 of the Convention. (a) The substantive aspect. The European Court referred to the facts established by the domestic courts, which did not contradict any of the case materials:

 

- on arrival at the barracks the applicants were forbidden to look at the officers guarding them, some of the applicants wrote the letter X. All the applicants were ordered to stand still, arms and legs apart, and look at the fences inside the barracks. They were forced to stand in the same humiliating pose inside the cells;

 

- Inside the barracks the applicants were forced to walk with their heads down, in this position they were forced to pass through the "tunnel of employees", that is, through the corridor in the barracks, where police officers stood on both sides, threatening and beating them, shouting political and sexual insults in relation to them;

 

- During the medical examinations, the applicants were forced to endure insults, humiliation, and sometimes threats from medical personnel and the police officers present;

 

- the personal belongings of the applicants were confiscated or broken;

 

- Since the barracks were such a small area, and the violent actions were committed so often, all the police officers present knew about the violence committed by their colleagues and / or subordinates;

 

- the disputed facts can not be regarded as limited in time and occurred at a time when such violent behavior could be caused (albeit unjustifiably) by a strong tension and tense situation: the events in the case continued for a long period, that is, between night from 20 to July 21 and July 23, which means that several police teams consistently performed service in the barracks in the absence of a significant reduction in the frequency or intensity of episodes of violence.

 

The applicants, who did not provide physical resistance, suffered a lengthy and systematic sequence of acts of violence that caused severe physical and psychological suffering. Not being isolated facts, physical and psychological violence was indiscriminate, permanent and to some extent organized, which entailed "a kind of dehumanization process that reduced the individual to the object against which violence was committed."

 

These events occurred in a deliberately tense, nervous and noisy environment, while staff shouted at the detainees and sometimes sang fascist hymns.

 

Present police officers, from the lowest level to the command staff, severely violated their primary ethical duty to protect persons sent under their supervision and who were in a vulnerable position.

 

It is impossible to ignore the facts that the applicants were not only directly victims of ill-treatment, but also helpless witnesses to the uncontrolled use of violence against other detainees.

 

The applicants, who were treated as objects, spent the entire period of their detention in an atmosphere of "lawlessness", when the most basic guarantees were suspended. The above violence was exacerbated by other violations of the applicants' rights:

 

- none of them could contact a relative, a lawyer or, if necessary, a consular representative;

 

- their personal belongings were broken in their presence;

 

- no access to the toilet was allowed, in any case, from the attempts to access the toilet the applicants were held by the insults, violence and humiliation faced by those who requested such access;

 

- Lack of food and bedding, even if this was due to supply shortages, and not a deliberate decision, further intensified their stress and suffering.

 

These repeated acts of violence, reflecting the desire for punishment and revenge, should be regarded as acts of torture.

 

 

 

DECISION

 

 

 

There has been a violation of Article 3 of the Convention (unanimously).

 

(b) The procedural aspect. Noting the entry into force in 2017 of new legislation, which is not applicable to the facts of the present case, which provided for the specific composition of the crime, "the tortures", the Court found, on similar grounds with the Chestaro case, that the authorities of the respondent state did not provide an adequate criminal and disciplinary response to the acts torture. In particular, he took into account the fact that the persons involved in torture were not suspended from performing their duties during criminal proceedings.

COMPENSATION

 


In the application of Article 41 of the Convention. Hotărârea CtEDO din 24 octombrie 2017 în cauza Dickmann și Gion împotriva României (plângerile nr. 10346/03 și 10893/04).
Reclamanții s-au plâns cu succes de imposibilitatea restituirii proprietății naționalizate sau a despăgubirii pentru bunurile confiscate de stat. Cazul a implicat o încălcare a cerințelor articolului 1 din Protocolul nr. 1 la Convenția pentru apărarea drepturilor omului și a libertăților fundamentale.

 

În 2003 și 2004, reclamanții au fost asistați în pregătirea plângerilor. Ulterior, plângerile au fost combinate și comunicate României.

 

 

 

 

 

CIRCUMSTANȚELE CAUZEI

 


În hotărârea pilot a Curții Europene de Justiție în cazul „Maria Atanasiu și alții împotriva România“ (Maria Atanasiu și alții c. România) (la 12 octombrie 2010, plângerea N 30767/05 și 33800/06) au indicat faptul că este necesar măsuri generale pentru eliminarea deficiențelor mecanismului de restituire introdus în România după căderea regimului comunist. În mai 2013, a intrat în vigoare Legea nr. 165/2013, care stabilea diverse proceduri disponibile petiționarilor care solicită soluționarea cererilor lor de restituire. În hotărârea Preda și alții c. României din 29 aprilie 2014, plângerea nr. 9584/02 și alții, Curtea Europeană a examinat noua legislație și a constatat că mecanismul stabilit oferă o serie de mijloace eficiente remedii care trebuie să fie epuizate, în cazuri specifice, dar că legea nu conține dispoziții de natură procedurală sau de fond, oferă o rambursare privind existența unei hotărâri definitive de titluri legalizează potrivite la aceeași proprietate rezidențială. ASPECTE ALE LEGII

 


În ceea ce privește respectarea articolului 1 din Protocolul nr. 1 la Convenție. Reclamanții au obținut hotărâri definitive prin care recunoștea ilegalitatea confiscării proprietății de către stat. Instanțele românești și-au confirmat dreptul la măsuri de restituire, luând în considerare statutul de foști proprietari sau moștenitori ai titlurilor de foști proprietari.

 

După ce a stabilit că reclamantele au avut o „posesie“ în sensul articolului 1 din Protocolul nr 1 al Convenției, Curtea a avut, de asemenea, să ia în considerare dacă privarea de libertate contestată de proprietatea lor, ca urmare a vânzării proprietății de stat către terți, compensate în mod corespunzător și compensate prin intermediul mecanismului, creat în acest scop de către stat. CIRCUMSTANCES OF THE CASE

 


In the pilot judgment of the Court in the case of Maria Atanasiu and Others v. Romania (dated 12 October 2010, complaints No. 30767/05 and 33800/06), it is stated that general measures are required for elimination of the shortcomings of the restitution mechanism introduced in Romania after the fall of the communist regime. In May 2013, Law No. 165/2013 came into force, establishing various procedures available to petitioners requiring the settlement of their claims for restitution. In the Preda and Others v. Romania judgment of 29 April 2014, complaint No. 9584/02 and others, the European Court examined the new legislation and found that the established mechanism offers a number of effective means which require exhaustion in certain cases, but that the law does not contain procedural or substantive provisions that provide reimbursement for the existence of final decisions that legalize the coinciding titles for the same residential property. The applicants complained that their inability to obtain restitution of nationalized property or to obtain compensation amounted to a violation of Article 1 of Protocol No. 1 to the Convention.

 


ISSUES OF LAW

 


Concerning compliance with Article 1 of Protocol No. 1 to the Convention. The applicants obtained final decisions recognizing the illegality of the seizure of their property by the state. The Romanian courts confirmed their right to restitution measures, taking into account their status of former owners or heirs of the title of former owners.

 

Having established that the applicants had "property" within the meaning of Article 1 of Protocol No. 1, the Court also had to consider whether the impugned deprivation of their property as a result of the sale of property by a State to third parties was duly compensated and compensated through the mechanism, created for this purpose by the state. Although Act No. 165/2013 as a whole reformed the restitution mechanism by setting precise time limits for each administrative stage, as well as clear criteria for the functioning of the compensation mechanism, it did not change the administrative procedure to make it effective for participants such as applicants. It follows that the applicants, whose title to the apartment houses are recognized, and the right to restitution has been confirmed by the courts, but who could not use the property, because the state sold the property, did not use the mechanism to obtain adequate compensation for the deprivation of their property. This deprivation, combined with the total lack of compensation, placed the applicants on a disproportionate and excessive burden in violation of their right to respect for property.

 


DECISION

 


There has been a violation of Article 1 of Protocol No. 1 (unanimously).

 


COMPENSATION

 


In the application of Article 41 of the Convention. The European Court awarded € 96,000 to Dickman and € 60,000 to Gion and Gion in compensation for pecuniary and non-pecuniary damage.
