L'arrêt de la CEDH du 18 juillet 2017 dans l'affaire "Roman (Rooman) c. Belgique" (requête n ° 18052/11).

En 2011, le requérant a été aidé dans la préparation de la requête. Par la suite, la requête a été communiquée à la Belgique.

Le requérant s'est plaint avec succès de ne pas avoir bénéficié d'une assistance psychiatrique en tant que prisonnier en raison du manque de personnel médical parlant la langue officielle de l'Etat défendeur. Il y a eu violation de l'article 3 de la Convention de sauvegarde des Droits de l'Homme et des Libertés fondamentales.

 

CIRCONSTANCES DE L'ESPÈCE


Le requérant, qui souffrait d'une maladie mentale grave, qui ne lui permettait pas de contrôler ses actions, détenues dans une institution où il n'y avait pas de personnel germanophone, alors que le requérant ne pouvait parler allemand (l'une des trois langues officielles de la Belgique) en 2004.

Conseil sur la santé mentale à plusieurs reprises reconnu qu'en raison des difficultés linguistiques, avec lesquels le demandeur a dû faire face en communication, il a été effectivement privé du traitement de sa maladie mentale (rendant impossible la libération), et les recommandations du Conseil ont été remplies par les autorités que dans une mesure limitée ou pas en temps opportun. L'autorité judiciaire compétente a abouti à une conclusion similaire en 2014.


QUESTIONS DE DROIT


Concernant le respect de l'article 3 de la convention. L'argument de l'absence d'un lien de causalité entre l'absence du personnel médical germanophone et la difficulté de traitement doit être rejeté, puisque tous les éléments de preuve, d'autre part, donne à penser que la principale raison de l'absence d'aide thérapeutique dans le traitement de la maladie mentale du requérant était l'impossibilité de communiquer avec le personnel médical.

Les mesures prises par les autorités de sécurité sociale pour trouver une solution au cas du requérant, amoindrissent l'inaction des autorités: seulement en 2014 avec l'avènement du psychologue germanophone (qui, apparemment, a arrêté à la fin de 2015) les mesures pratiques recommandées pendant des années, ont été exécutés. D'autres contacts du requérant avec un personnel germanophone qualifiés (experts, infirmière et travailleuse sociale) ne poursuivait pas un objectif thérapeutique.

En tenant compte du fait que l'allemand est une des langues officielles de la Belgique, ce manque devrait être considéré comme un écart par rapport à la prestation de soins adéquats à l'état du requérant. Quels que soient les obstacles que le requérant a créés par sa conduite, ils n'ont pas exempté l'État du respect de ses obligations.

La détention prolongée du requérant en l'absence d'un soutien médical adéquat pendant 13 ans, en plus de deux périodes où il avait accès au psychologue germanophone (de mai à Novembre 2010 et à partir de Juillet 2014 à la fin de 2015), et en l'absence de réelles perspectives de changement dépassé l'inévitable le niveau de souffrance inhérent à la détention, qui équivalait à un traitement dégradant.


DÉCISION


La violation des conditions de l'article 3 de la Convention (unanimité) a été commise dans l'affaire.

Concernant le respect du paragraphe 1 de l'article 5 de la Convention. Malgré le constat d'une violation de l'article 3 de la Convention en raison du fait que les soins appropriés requérant n'a pas été fourni, et la durée de cet état de choses (13 ans), sa privation de liberté était légale selon les critères établis dans le cas où la pratique de la Cour conformément à l'alinéa "e" de l'article 5 § 1 de la Convention:

- l'institution de protection sociale, en principe, être bien adapté à l'état de sa santé mentale et le degré de danger;

- il y a encore un lien entre les bases de la détention et de la santé mentale du demandeur (comme motif d'éviter l'assister le retrait opportun ne sont pas liés à la nature réelle de l'isolant, ce lien n'a pas été cassé).


DÉCISION


Dans le cas avait pas eu violation de l'article 5 de la Convention (adoptée par six voix « pour » un - « contre »).


INDEMNISATION


En application de l'article 41 de la Convention. La Cour alloue au requérant 15.000 euros en dommage moral, l'exigence d'un préjudice matériel a été rejetée.

Das Urteil des EGMR vom 18. Juli 2017 in der Rechtssache "Roman (Rooman) gegen Belgien" (Beschwerde Nr. 18052/11).

Im Jahr 2011 wurde der Klägerin bei der Vorbereitung der Beschwerde geholfen. Anschließend wurde die Beschwerde Belgien mitgeteilt.

Der Beschwerdeführer beschwerte sich erfolgreich darüber, dass ihm aufgrund des Mangels an medizinischem Personal, das die Amtssprache des belangten Staates sprach, keine psychiatrische Unterstützung als Gefangener gewährt wurde. Es hat einen Verstoß gegen Artikel 3 der Konvention zum Schutz der Menschenrechte und Grundfreiheiten gegeben.

 

UMSTÄNDE DES FALLES


Der Kläger, der wurde von einer schweren psychischen Erkrankung leidet, die ihn seine Handlungen nicht erlaubten, zu kontrollieren, in einer Institution festgehalten, wo es kein deutschsprachiges Personal, während die Klägerin nur Deutsch sprechen kann (eine der drei Amtssprachen von Belgien) im Jahr 2004.

Council on Mental Health mehrfach anerkannt, dass als Folge der sprachlichen Schwierigkeiten, mit denen der Antragsteller in der Kommunikation konfrontiert, er tatsächlich der Behandlung seiner psychischen Erkrankung entzogen wurde, und die Empfehlungen des Rates von den Behörden nur in begrenztem Umfang gefüllt waren (es unmöglich zu lösen machen) oder nicht zur rechten Zeit. Die zuständige Justizbehörde kam 2014 zu einem ähnlichen Ergebnis.


Fragen des Gesetzes


Zur Einhaltung von Artikel 3 des Übereinkommens. Das Argument, über das Fehlen eines Kausalzusammenhangs zwischen der Abwesenheit des deutschsprachigen medizinischen Personals und die Schwierigkeiten bei der Behandlung zurückzuweisen, da alle Beweise, auf der anderen Seite schon vermuten lässt, dass der Hauptgrund für die fehlende therapeutische Hilfe bei der Behandlung der Geisteskrankheit des Klägers war die Unmöglichkeit, mit dem medizinischen Personal zu kommunizieren.

Maßnahmen, die von den Sozialversicherungsbehörden, um eine Lösung zu Fall der Klägerin zu finden, beeinträchtigen die Untätigkeit der Behörden: nur im Jahr 2014 mit dem Aufkommen des deutschsprachigen Psychologen der praktischen Maßnahmen empfohlen Jahren (die offenbar am Ende des Jahres 2015 zum Stillstand gekommen ist), durchgeführt wurden. Andere Kontakte der Antragsteller mit einer qualifizierten deutschsprachigem Personal (Experten, Krankenschwester und Sozialarbeiterin) haben keinen therapeutischen Zweck verfolgen.

Unter Berücksichtigung der Tatsache, dass Deutsch eine der Amtssprachen von Belgien ist dieser Mangel sollte bei der Klägerin Zustand als Abweichung von der Bereitstellung angemessener Sorgfalt berücksichtigt werden. Welche Hindernisse auch immer der Kläger durch sein Verhalten geschaffen hat, er hat den Staat nicht von der Einhaltung seiner Verpflichtungen befreit.

Inhaftierung des Antragstellers in dem Fehlen einer angemessenen medizinischer Versorgung für 13 Jahre, zusätzlich zu dem zwei Perioden verlängert, wenn er den Zugang zum deutschsprachigen Psychologen hatte (von Mai bis November 2010 und von Juli 2014 bis Ende 2015), und in Abwesenheit von realen Aussichten auf Veränderung überschritt die unvermeidliche das Ausmaß des Leidens in der Haft, das zu einer erniedrigenden Behandlung führte.


ENTSCHEIDUNG


Die Verletzung der Anforderungen von Artikel 3 der Konvention (einstimmig) wurde in dem Fall begangen.

Zur Einhaltung von Artikel 5 Absatz 1 des Übereinkommens. Trotz der Feststellung einer Verletzung von Artikel 3 der Konvention aufgrund der Tatsache, dass die Klägerin der richtigen Pflege nicht zur Verfügung gestellt wurde, und die Dauer dieses Zustandes (13 Jahre), war seine Freiheitsentziehung rechtmäßig nach den Kriterien in der Entscheidungspraxis des Gerichtshofes, die in Übereinstimmung mit Absatz "e" von Artikel 5 § 1 des Übereinkommens:

- die Einrichtung des Sozialschutzes im Prinzip richtig mit dem Zustand seiner psychischen Gesundheit und dem Grad der Gefahr angepasst werden;

- gibt es noch eine Verbindung zwischen den Basen der Haft des Antragstellers und geistiger Gesundheit (als Grund für die Vermeidung unterstützt es zweckmäßig Rückzug wurden nicht zu dem tatsächlichen Gegebenheiten des Isolators bezogen, wurde diese Verbindung nicht gebrochen).


ENTSCHEIDUNG


Im Fall gewesen war kein Verstoß gegen Artikel 5 des Übereinkommens (angenommen mit sechs Stimmen „für“ ein - „gegen“).


Entschädigung


In der Anwendung von Artikel 41 des Übereinkommens. Das Gericht erteilte den Antragsteller 15.000 Euro in der immateriellen Schaden, die Voraussetzung für Vermögensschäden abgelehnt wurde.

CIRCUMSTANCES OF THE CASE


The applicant, suffering from a serious mental illness that did not allow him to control his actions, since 2004 was kept in a specialized institution where German-speaking personnel were absent, while the applicant himself could speak only German (in one of the three official languages ​​of Belgium).

The Council on Mental Health several times admitted that as a result of the language difficulties with which the complainant encountered in communication, he was in fact deprived of the treatment of his mental illnesses (making it impossible for him to be released), and the Council's recommendations were enforced by the authorities only in limited or out of time. The competent judicial authority reached a similar conclusion in 2014.


ISSUES OF LAW


Concerning compliance with Article 3 of the Convention. The argument that there is no causal link between the absence of German-speaking medical personnel and the difficulties in treatment should be rejected, since all evidence, on the contrary, indicates that the main reason for the lack of therapeutic assistance in the treatment of the applicant's mental illness was the impossibility of his communication with medical personnel.

The measures taken by the social protection bodies to find a solution in the applicant's case were diminished by the authorities' inactivity: only in 2014, with the appearance of a German-speaking psychologist (which seems to have ceased at the end of 2015), the practical measures recommended for years have been implemented. Other contacts of the applicant with qualified German-speaking personnel (experts, nurse and social worker) did not pursue a therapeutic purpose.

Taking into account the fact that German is one of the official languages ​​of Belgium, such a shortcoming should be seen as an avoidance of providing adequate care in the applicant's condition. Whatever obstacles the applicant created by his conduct, they did not exempt the state from compliance with its obligations.

The applicant's continued detention in the absence of adequate medical support for 13 years, in addition to two periods when he had access to a German-speaking psychologist (from May to November 2010 and from July 2014 to the end of 2015), and in the absence of a realistic prospect, changes exceeded the inevitable the level of suffering inherent in detention, which amounted to degrading treatment.


DECISION


The violation of the requirements of Article 3 of the Convention (unanimously) was committed in the case.

Concerning compliance with article 5, paragraph 1, of the Convention. Notwithstanding the conclusion of a violation of Article 3 of the Convention that the applicant was not provided with adequate care and the length of such a state of affairs (13 years), the deprivation of his liberty was lawful in the light of the criteria established in the Court's case-law in accordance with subparagraph "e" of Article 5 § 1 of the Convention:

- this institution of social protection was, in principle, appropriately adapted for the state of its mental health and degree of danger;

- there is still a connection between the grounds for the applicant's detention and his mental health (since the grounds for avoiding appropriate care were not related to the real nature of the detention facility, this connection was not violated).


DECISION


In the case, the requirements of Article 5 of the Convention were not violated (adopted by six votes "for" at one - "against").


COMPENSATION


In the application of Article 41 of the Convention. The Court awarded the applicant EUR 15,000 in respect of non-pecuniary damage, the claim for compensation for pecuniary damage was rejected.

CIRCUMSTANCES OF THE CASE

 


According to Article 4 (2) (b) of the Environmental Permits Act of December 15, 1996, industrial energy production, including thermal power plants, requires an environmental permit issued by the Ministry of the Environment on the basis of an environmental impact assessment and an environmental impact assessment. However, the law was applied only to industrial activities, which began after its implementation. For companies that started their industrial activities earlier, the deadline for the environmental impact assessment was set for January 1, 2009.

 

During the period relevant to the circumstances of the case, the applicants lived in an apartment building in the city center in close proximity (approximately 4 meters) from a thermal power plant that provided adjacent residential areas with electricity and heating. The station operated since 1939, but partially stopped generating energy in 2001 due to financial problems. According to the claimants, the hazardous activity of the station was not regulated, and as a result, the station released into the atmosphere various toxic substances that adversely affected their health.

 


ISSUES OF LAW

 


Concerning compliance with Article 8 of the Convention. Even assuming that air pollution did not cause any identifiable harm to the health of the applicants, it could make them more vulnerable to various diseases. In addition, there could be no doubt that it had a negative impact on the quality of their lives at home. Consequently, there has been an interference with the applicants' rights, which has reached a sufficient level of severity so that it can be attributed to the scope of Article 8 of the Convention.

 

The essence of the matter in the present case was the actual absence (until 2009) of the regulatory framework applicable to the hazardous activity of the plant and the avoidance of eliminating the air pollution that had adversely affected the rights of the claimants under Article 8 of the Convention.

 

In the context of implementing hazardous activities, States in particular have an obligation to create a regulatory framework adapted to the specific features of the activity, especially regarding the level of potentially affected risk. Such rules should regulate licensing, establishment, implementation and safety of activities, supervision of it, and also provide for mandatory for all stakeholders to ensure effective protection of citizens whose lives may be at risk of collateral risks. The actual absence of any legislative and administrative framework applicable to the potentially hazardous activities of the thermal power plant in the present case allowed it to function in close proximity to the applicants' housing in the absence of the necessary safeguards to avoid, or at least minimize, air pollution and its negative influence on the health and well-being of the applicants, which was confirmed by examinations appointed by the domestic courts.

 

The situation was exacerbated by the fact that, despite the responsibility for installing a filter and cleaning equipment at the thermal power plant to minimize the impact of toxic emissions on house occupants, the competent authorities did not take effective measures to implement this instruction. In such circumstances, the Government of the respondent State did not establish a fair balance between the public interest in the operation of a thermal power plant and the effective use of the applicants' right to respect for their home and personal life.

 


DECISION

 


The violation of the requirements of Article 8 of the Convention (unanimously) was committed.

 


COMPENSATION

 


In the application of Article 41 of the Convention. The Court awarded the applicants EUR 4,000 in respect of non-pecuniary damage.

Presuda Europskog suda od 11. srpnja 2017. godine u predmetu Oravec v. Hrvatska (zahtjeva br. 51249/11).

 

Tijekom 2011. godine, podnositelji zahtjeva bili su pomagali u pripremi pritužbe. Nakon toga, zahtjeva je priopćen Hrvatskoj.

OKOLNOSTI PREDMETA

 


U travnju 2011. godine podnositelj zahtjeva bio je pritvoren i zadržan zbog sumnje da je prodao narkotike. Nakon toga, pušten je po nalogu istražnog suca. Ova odluka je preokrenuta prosvjedom tužitelja, a 31. svibnja 2011. sudac je preispitao slučaj i potvrdio prethodnu odluku. Tužiteljstvo je podnijelo prezentaciju koje nije upozoreno podnositelja zahtjeva ili njegovog branitelja. Dana 10. lipnja 2011. godine, tročlana sudačka skupština održala je zatvoreni sastanak u odsutnosti stranaka. Ukinuo je odluku istražnog suca i naložio pritvor podnositelja zahtjeva. Dana 14. lipnja 2011. godine podnositelj zahtjeva ponovno je pritvoren. Njegove pritužbe Vrhovnom i Ustavnom sudu bile su neuspješne. Podnositelj zahtjeva prigovorio je Sudu, između ostalog, da je žalbeni postupak kršio načelo jednakosti oružja zajamčeno člankom 5. stavkom 4. Konvencije.

 


PITANJA PRAVA

 


Što se tiče poštivanja članka 5. stavka 4. Konvencije. Podnositelj zahtjeva pušten je iz pritvora u skladu s odlukom od 31. svibnja 2011. Međutim, odluka istražnog suca mogla bi se preispitati i stoga nije bila konačna. Doista, tužiteljstvo je podnijelo prosvjed protiv odluke istražnog suca. U zahtjevu za ukidanje odluke, tužiteljstvo je zatražilo da se u okviru žalbenog postupka usvoji početni nalog za određivanje pritvora. Ako je žalba tužitelja odbijena, odluka o puštanju podnositelja zahtjeva bi stupila na snagu, ali budući da je odobrena, podnositelj zahtjeva ponovno je bio u pritvoru. Tako je prosvjed bio produžetak postupka koji se odnosi na zakonitost pritvora podnositelja zahtjeva. U takvim okolnostima, ishod žalbenog postupka je odlučujući faktor za odluku o zakonitosti pritvora podnositelja zahtjeva, bez obzira u koje vrijeme je podnositelj zahtjeva bio u pritvoru ili ne u pritvoru. Slijedom toga, članak 5. stavak 4. Konvencije bio je primjenjiv na žalbeni postupak. Sud koji ocjenjuje pritužbu na odluku o pritvoru treba osigurati jamstva sudskog postupka. Postupak mora biti kontradiktoran i osigurati ravnopravnost stranaka. Uzimajući u obzir negativne učinke lišavanja slobode o temeljnim pravima osobe o kojoj se postupcima koji se vode u skladu sa stavkom 4. članka 5. Konvencije, u načelu, treba zadovoljiti što više u okolnostima u tijeku ispitivanja prema stupnju osnovnim zahtjevima poštenog suđenja, kao što je pravo na optužnog postupka. U svom prosvjedu protiv odluke istražnog suca da oslobodi podnositelja zahtjeva, tužiteljstvo je dalo brojne razloge zbog kojih je podnositelj zahtjeva bio u pritvoru. Ovaj prosvjed nije bio upozoren na obranu, tako da podnositelj zahtjeva nije imao priliku odgovoriti na argumente tužiteljstva. Sud se sastoji od tri suca, donio odluku o pritvoru podnositelja zahtjeva 10. lipnja 2011, napravio je zatvoreni sastanak bez informiranja, a kamoli obavijesti, podnositelj zahtjeva ili njegov predstavnik, koji je kao rezultat nije bio u mogućnosti iznijeti argumente u vezi sa sklapanjem u pritvoru. Budući da obrana nije mogla predstaviti argumente sudu u ovom postupku u pisanom ili usmenom obliku, podnositelj zahtjeva nije mogao učinkovito ostvarivati ​​svoja prava na obranu u postupku. Sukladno tome, nije poštivano načelo jednakosti stranaka.

 


ODLUKA

 


Povreda zahtjeva iz članka 6. Konvencije (jednoglasno) učinjena je.

 

Sud je također smatrao da je došlo do povrede članka 5., stavka 4. Konvencije, s obzirom na odluku Ustavnog suda, te da u slučaju zahtjeva iz stavka 1. članka 5. Konvencije nisu povrijeđena u odnosu na nemogućnost prepoznavanja razdoblje pritvora podnositelja zahtjeva.

The ECHR judgment of 11 July 2017 in the case of Oravec v. Croatia (application No. 51249/11).

 

In 2011, the applicants were assisted in preparing the application. Subsequently, the application was communicated to Croatia.

 

In the case, the applicant's complaint on the failure to secure the benefit of the prosecutor's office. There has been a violation of Article 5 § 4 and Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms. There has been a violation of Article 5 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

CIRCUMSTANCES OF THE CASE

 


In April 2011, the applicant was detained and detained on suspicion of selling narcotic substances. Subsequently, he was released by order of the investigating judge. This decision was overturned by the protest of the prosecution, and on May 31, 2011 the judge reviewed the case and confirmed the previous decision. The Prosecutor's Office made a presentation that was not brought to the attention of the applicant or his counsel. On June 10, 2011, a three-judge panel of judges held a closed meeting in the absence of the parties. He quashed the decision of the investigating judge and ordered the applicant's detention. On 14 June 2011 the applicant was again taken into custody. His complaints to the Supreme and Constitutional Courts were unsuccessful. The applicant complained to the Court, inter alia, that the appeal proceedings violated the principle of equality of arms guaranteed by Article 5 § 4 of the Convention.

 


ISSUES OF LAW

 


Concerning compliance with article 5, paragraph 4, of the Convention. The applicant was released from custody in accordance with the decision of 31 May 2011. However, the decision of the investigating judge could be reviewed and therefore was not final. Indeed, the prosecutor's office filed a protest against the decision of the investigating judge. In demanding the cancellation of the decision, the prosecutor's office requested that, in the framework of the appellate proceedings, the initial detention order be upheld. If the prosecutor's appeal had been rejected, the decision to release the applicant would have come into force, but since it was granted, the applicant was again placed in custody. Thus, the protest constituted an extension of the proceedings relating to the lawfulness of the applicant's detention. In such circumstances, the outcome of the appeal proceedings was decisive for a decision on the lawfulness of the applicant's detention, regardless of the time at which the applicant was detained or not held in custody. Consequently, Article 5 § 4 of the Convention was applicable to the appeal proceedings. A court that reviews a complaint about a decision on detention should provide guarantees of judicial procedure. Proceedings must be adversarial and ensure equality of the parties. Given the negative impact of deprivation of liberty on the fundamental rights of the person concerned, proceedings conducted in accordance with article 5, paragraph 4, of the Convention should, in principle, respond as much as possible in the circumstances of the ongoing investigation to the basic requirements of a fair trial, such as the right to an adversarial procedure. In his protest against the decision of the investigating judge to release the applicant, the prosecution put forward numerous grounds for bringing the applicant into custody. This protest was not brought to the attention of the defense, so the applicant did not have the opportunity to respond to the prosecution's arguments. A three-judge court that decided to detain the applicant on 10 June 2011 did so at a closed meeting, without informing, let alone notifying, the applicant or his representative, who as a result were unable to put forward arguments on the conclusion in custody. Since the defense could not present arguments to the court in this proceedings in writing or verbally, the applicant could not effectively exercise his rights of defense in the proceedings. Accordingly, the principle of equality of parties was not observed.

 


DECISION

 


The violation of the requirements of Article 6 of the Convention (unanimously) was committed.

 

The Court also held that there had been a violation of the requirements of Article 5 § 4 of the Convention in respect of the decision of the Constitutional Court and that the requirements of Article 5 § 1 of the Convention had not been violated in relation to the failure to establish the applicant's detention.
