EGMR-Urteil vom 18. Oktober 2016 in der Rechtssache Vukota-Bojic gegen die Schweiz (Beschwerde Nr. 61838/10).

Im Jahr 2010 wurde der Klägerin bei der Vorbereitung der Beschwerde geholfen. Anschließend wurde die Beschwerde der Schweiz mitgeteilt.

In diesem Fall wurde eine Beschwerde zur geheimen Überwachung der täglichen Aktivitäten des Antragstellers, die von der Versicherungsgesellschaft bei der Beilegung des Streitfalls über den Versicherungsfall organisiert wurde, erfolgreich geprüft. Im Falle eines Verstoßes gegen die Anforderungen von Artikel 8 der Konvention zum Schutze der Menschenrechte und Grundfreiheiten.

 

UMSTÄNDE DES FALLES


Der Beschwerdeführer wurde bei einem Verkehrsunfall verletzt. Der Vorfall löste eine Reihe von Streitigkeiten mit seiner Versicherungsgesellschaft und der Dauer des Verfahrens in Bezug auf seine Fähigkeit, die Existenz eines Kausalzusammenhangs zwischen dem angeblichen Grad ihrer Behinderung und Unfall und der Zahlung der Höhe der Entschädigung an sie zu arbeiten. Die Klägerin unterzog sich mehreren ärztlichen Untersuchungen, und nachdem sie sich weigerte, sich einer zusätzlichen ärztlichen Untersuchung zu unterziehen, beschloss die Versicherungsgesellschaft, unter Anwendung der ihr im Rahmen der staatlichen Versicherung gewährten Befugnisse, sie unter Beobachtung zu stellen. Privatdetektive, die von der Versicherungsgesellschaft angezogen wurden, überwachten ihre Bewegungen an vier verschiedenen Daten während der 23-tägigen Periode. Die Versicherungsgesellschaft beabsichtigte, detaillierte Aufzeichnungen über die Beobachtung in der Studie zu verwenden, um die Arbeitsunfähigkeit, auf die die Klägerin bestand, und die Richtigkeit der medizinischen Berichte, auf die sie Bezug nahm, in Frage zu stellen. Die Beschwerdeführerin rügte, dass die geheime Überwachung ihrer täglichen Aktivitäten, die von ihrer Versicherungsgesellschaft organisiert worden sei, ihre Rechte gemäß Artikel 8 der Konvention verletzt habe. Sie beklagte insbesondere die mangelnde Klarheit und Vorhersehbarkeit der Bestimmungen des innerstaatlichen Rechts, die als Rechtsgrundlage für ihre Überwachung dienten.


Fragen des Gesetzes


Zur Einhaltung von Artikel 8 des Übereinkommens. Die angefochtene Aufsichtsmaßnahme wurde von einer privaten Versicherungsgesellschaft angewandt. Der Staat hat diesem Unternehmen jedoch das Recht eingeräumt, Leistungen bei der obligatorischen Krankenversicherung zu zahlen und Versicherungsprämien zu sammeln. Der Staat kann nicht von der Haftung auf der Grundlage des Übereinkommens entbunden werden, indem seine Zuständigkeiten an private Organisationen oder Bürger delegiert werden. Da die Versicherungsgesellschaft öffentlichen Versicherungssystem verwaltet und dass es durch das Rechtssystem der Schweiz als Körperschaft des öffentlichen Rechts in Betracht gezogen wurde, sollte das Unternehmen als Behörde angesehen werden, und Maßnahmen sie getroffen werden dem beklagten Staat zur Last gelegt werden.

Auf die Frage, ob es Eingriff in das Recht der Klägerin war für ihr Privatleben zu respektieren, stellte der Gerichtshof fest, dass Fachleute im Auftrag seiner Versicherungsgesellschaft tätig, systematisch und beobachtete, wie sie bewusst und es auf Video in vier verschiedenen Terminen während der 23 gefilmt Tagesperiode. Die erhaltenen Materialien wurden gespeichert und ausgewählt, und die aufgenommenen Bilder wurden als Grundlage für das Gutachten und letztlich für die Neubewertung der Zahlung der Versicherungsleistungen verwendet. Der Gerichtshof ist davon überzeugt, dass der dauerhafte Charakter des Videobands und seine anschließende Verwendung im Versicherungsstreit als Verarbeitung oder Sammlung personenbezogener Daten des Antragstellers angesehen werden können, die auf die Einmischung in sein Privatleben hinweisen.

Die Frage vor dem Gerichtshof war, ob die Bestimmungen des innerstaatlichen Rechts, die als Rechtsgrundlage für die Anordnung zur Kontrolle des Beschwerdeführers dienten, hinreichend klar und detailliert waren, um zu der Ansicht zu gelangen, dass der Eingriff "gesetzlich vorgeschrieben" sei. In diesem Zusammenhang stellte der Gerichtshof fest, dass, wenn auch nicht den Eindruck, dass alles auf die Bestimmungen des schweizerischen Rechts ausdrücklich vor oder implizieren keine Bilder oder Videos in der Anzahl von Ermittlungsmaßnahmen zu schaffen, die von den Versicherungsgesellschaften umgesetzt werden kann, schloß das Bundesgericht, dass die Bestimmungen über die Beobachtung der Umstände abdeckt ähnlich wie im Fall des Beschwerdeführers. Bei der Prüfung, ob eine angemessene und wirksame Garantien Recht des betroffenen Staates gegen die Willkür enthalten ist, stellte der Gerichtshof fest, dass es nicht für Verfahren lieferten, die bei der Genehmigung oder Überwachung der Durchführung von Maßnahmen der geheimen Überwachung im spezifischen Kontext der Versicherungsstreitigkeiten folgen würde. Darüber hinaus wurden in den einschlägigen Bestimmungen des Gesetzes keine Verfahren für die Speicherung, den Zugang, die Überprüfung, die Verwendung, die Kommunikation oder die Vernichtung von Daten festgelegt, die durch geheime Überwachungsmaßnahmen erhoben werden. Somit blieb unklar, wo und wie der Bericht, der Videoaufnahmen und Fotos enthält, auf denen der Antragsteller versiegelt ist, wer Zugang dazu hat und ob der Antragsteller rechtliche Mittel hat, die Manipulation des Berichts anzufechten. Das Gericht bestätigte, dass die Beobachtung im vorliegenden Fall sollte weniger Eingriff in das Privatleben einer Person im Vergleich zu zum Beispiel betrachtet werden, hören Gespräche zu telefonieren, ist es jedoch mit den allgemeinen Grundsätzen einer angemessenen Schutz gegen willkürliche Eingriffe in Rechte nach Artikel 8 der Konvention entsprechen.

Aus diesen Gründen und trotz der Tatsache, dass der Eingriff in die Rechte des Antragstellers gemäß Artikel 8 der Konvention, war es grundsätzlich unerheblich, das Gericht nicht der Auffassung, dass die Gesetzgebung in der Schweiz ausreichend Klarheit in Bezug auf den Umfang und die Art und Weise der Ausübung der Wertschätzung durch die genossen unter Beweis gestellt hat Versicherungsunternehmen, die als Behörden in Versicherungsstreitigkeiten auftreten, zur geheimen Überwachung von Versicherten. Insbesondere enthielt es keine ausreichenden Garantien gegen Willkür. Daher Eingriff in die Rechte des Antragstellers gemäß Artikel 8 der Konvention ist nicht gesetzlich vorgeschrieben ist.


ENTSCHEIDUNG


Es hatte eine Verletzung von Artikel 8 der Konvention Anforderungen gewesen (angenommen mit sechs Stimmen „für“ ein - „gegen“).

Der Gerichtshof stellt fest, dass die Verwendung in dem Verfahren mit der Beteiligung des Antragstellers heimlich aufgenommenen Materials nicht die Anforderungen der Fairness nach Artikel 6 § 1 der Konvention garantierten verstößt.


Entschädigung


In der Anwendung von Artikel 41 des Übereinkommens. Der Gerichtshof hat dem Beschwerdeführer einen immateriellen Schaden in Höhe von 8 000 Euro gewährt.

ECHR judgment of 18 October 2016 in the case of Vukota-Bojic v. Switzerland (application No. 61838/10).

In 2010, the applicant was assisted in the preparation of the application. Subsequently, the application was communicated to Switzerland.

In the case, a complaint was successfully considered for secret surveillance of the daily activities of the applicant, organized by the insurance company in the resolution of the dispute on the insured event. In the case there was a violation of the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

CIRCUMSTANCES OF THE CASE


The applicant was injured in a traffic accident. The incident caused a number of disputes with its insurance company and a lengthy investigation into its ability to work, the existence of a causal link between the estimated incidence of its incapacity for work and the incident and the payment of the compensation amount due to it. The applicant underwent several medical examinations, and after her refusal to undergo additional medical examination, the insurance company, using the powers granted to her under the scheme of state insurance, decided to put her under surveillance. Private detectives, attracted by the insurance company, monitored her movements on four different dates during the 23-day period. The insurance company intended to use detailed records of the observation in the trial to challenge the incapacity for work the applicant insisted on and the accuracy of the medical reports she referred to. The applicant complained that the secret surveillance of her daily activities, organized by her insurance company, violated her rights in accordance with Article 8 of the Convention. In particular, she complained about the lack of clarity and predictability of the provisions of domestic law, which served as a legal basis for monitoring her.


ISSUES OF LAW


Concerning compliance with Article 8 of the Convention. The appealed measure of supervision was applied by a private insurance company. However, the state gave this company the right to pay benefits on compulsory health insurance and collect insurance premiums. The state can not be released from liability on the basis of the Convention by delegating its responsibilities to private organizations or citizens. Given that the insurance company managed the scheme of state insurance and that it was considered within the legal system of Switzerland as a public authority, the company should be considered as a public authority, and the actions committed by it should be charged to the respondent State.

With regard to the question of whether there was an interference with the applicant's right to respect for her private life, the Court noted that professionals acting on behalf of her insurance company systematically and deliberately watched her and filmed her on video on four different dates within 23 day period. The received materials were stored and selected, and the captured images were used as a basis for the expert opinion and, ultimately, for the reassessment of the payment of its insurance benefits. The Court is convinced that the permanent nature of the videotape and its subsequent use in the insurance dispute could be considered as processing or collecting personal data of the applicant, indicating the interference in her personal life.

The question before the Court was whether the provisions of domestic law that served as the legal basis for the order to monitor the applicant were sufficiently clear and detailed to consider that the interference was "prescribed by law". In this regard, the Court observes that while it does not appear that the relevant provisions of Swiss law directly provide or imply the receipt of images or video recordings in the number of investigative measures that may be carried out by insurance companies, the Federal Court of Switzerland concluded that these provisions cover surveillance in circumstances , similar to the circumstances of the applicant's case. In considering whether the respondent State's legislation contained adequate and effective safeguards against arbitrariness, the Court noted that it did not provide for procedures to be followed when authorizing or supervising the implementation of measures for secret surveillance in the specific context of insurance disputes. In addition, the relevant provisions of the law did not establish procedures for the storage, access, review, use, communication or destruction of data collected through secret surveillance measures. Thus, it remained unclear where and how the report containing video recordings and photographs on which the applicant is sealed, who will have access to it, and whether the applicant has legal means to challenge the manipulation of the report will be kept. The European Court recognized that monitoring in the present case should be viewed as a lesser interference in a person's private life compared to, for example, wiretapping, but it must obey the general principles of adequate protection against arbitrary interference with the rights provided for in Article 8 of the Convention.

For these reasons, and despite the fact that the interference with the applicant's rights under Article 8 of the Convention was in principle insignificant, the Court does not consider that the Swiss legislation demonstrated sufficient clarity as to the limits and the manner in which the discretion exercised is exercised insurance companies acting as public authorities in insurance disputes, for conducting secret surveillance of insured persons. In particular, it did not contain sufficient guarantees against arbitrariness. Thus, interference with the applicant's rights under article 8 of the Convention was not provided for by law.


DECISION


The case involved a violation of the requirements of Article 8 of the Convention (adopted by six votes "for" with one - "against").

The Court also held that the use of secret material in the proceedings with the applicant's participation did not violate the requirements of fairness guaranteed by Article 6 § 1 of the Convention.


COMPENSATION


In the application of Article 41 of the Convention. The Court awarded the applicant EUR 8,000 in respect of non-pecuniary damage.

Постанова ЄСПЛ від 13 жовтня 2016 року по справі "Ірина Смирнова (Irina Smirnova) проти України" (заява N 1870/05).

 

У 2005 році заявниці було надано допомогу в підготовці заяви. Згодом заява була комунікувати Україні.

 

У справі успішно розглянута скарга на відсутність належної правової основи для захисту власника квартири від нападів на нього співвласників квартири. У справі допущено порушення вимог статті 8 Конвенції про захист прав людини і основних свобод.

 

 

 

ОБСТАВИНИ СПРАВИ

 


Заявниця, жінка похилого віку, жила в однокімнатній квартирі протягом багатьох років і нещодавно в порядку приватизації придбала її у власність у рівних частках з дорослим сином. Її син передав свою частку третій особі, V.S., яке спільно з A.N. початок ображати, залякувати і нападати на заявницю, псувати її майно в спробі змусити її продати свою частку в квартирі. Побоюючись за свою безпеку, заявниця в результаті виїхала з квартири.

 

Її спроби витребувати квартиру в судах по цивільних справах були безуспішними, оскільки відповідно до законодавства України її син не мав отримувати її згоду на укладення договору дарування на користь VS, і співвласник не міг бути позбавлений права власності на тій підставі, на яке посилалася заявниця (антигромадську поведінку, непридатність квартири для спільного користування та відмова в несенні витрат на утримання).

 

Заявниця також подала низку скарг до міліції. V.S. і A.N. були засуджені за вимагання і засуджені до позбавлення волі приблизно через 10 років після першої заяви.

 


ПИТАННЯ ПРАВА

 


З приводу виконання вимог статті 3 Конвенції. Систематичний і умисний характер словесних нападок, яким піддавалася заявниця, збільшувалися випадками фізичного насильства групою осіб проти самотньої літньої жінки, досяг порога суворості, необхідного для віднесення до сфери дії статті 3 Конвенції і виникнення позитивної обов'язки держави щодо приведення в дію захисного законодавчої та адміністративної основ.

 

Хоча основні правопорушники були притягнуті до відповідальності і засуджені до значних термінів позбавлення волі, проте державним органам потрібно більше 20 років для вирішення питання. З урахуванням виняткових затримок в порушення та проведення кримінального провадження влади держави-відповідача не виповнилося свого позитивного зобов'язання відповідно до статті 3 Конвенції.

 


ПОСТАНОВА

 


У справі допущено порушення вимог статті 3 Конвенції (прийнято одноголосно).

 

З приводу дотримання статті 8 Конвенції. Відповідно до цього положення Конвенції заявниця скаржилася на те, що вона була зобов'язана терпіти присутність в своїх оселях сторонніх своєму домогосподарству осіб і їх неприємне, хоча і в основному непреступное поведінку, включаючи безцеремонне використання квартири та майна заявниці, псування устаткування, шум та інші перешкоди.

 

Європейський Суд встановив що кримінальний розгляд, в якому на V.S. і A.N. було покладено обов'язок виплатити компенсацію і вони були позбавлені частки в квартирі, згодом усунуло деякі аспекти скарги заявниці. Однак через виняткових затримок розгляду права заявниці, гарантовані статтею 8 Конвенції, умалялись протягом досить значного періоду.

 

Що стосується того, чи мали влади держави-відповідача адекватну некримінальних-правову базу, що забезпечує заявниці прийнятний рівень захисту проти вторгнень в її приватне життя і користування житлом, Європейський Суд зазначив, що поділ житла з незнайомими людьми незалежно від того, як вони поводяться, створює дуже важливі наслідки для приватності особи та інших інтересів, що захищаються статтею 8 Конвенції. Відповідно, якщо держава-член приймає правову основу, що зобов'язує приватних осіб ділити житло з особами, далекими їх домогосподарству, воно повинно ввести чіткі правила і необхідні процесуальні гарантії, щоб дозволити зацікавленим особам захищати свої конвенційні інтереси.

 

Однак у цій справі законодавство України не надало заявниці значні повноваження (i) заперечувати проти співжиття з A.N., V.S. і їх знайомими на тій підставі, що дане співжиття створює непропорційні наслідки для їх прав, передбачених статтею 8 Конвенції, і (ii) отримати доцільну і невідкладну захист від непрошених вторгнень в її особистий простір і житло, включаючи при необхідності прийняття попередніх заходів.

 

У той час як Європейський Суд був готовий визнати, що цивільно-правові засоби правового захисту, такі як позов про відшкодування шкоди, вимога про припинення та утриманні від втручання у використання майна іншою особою або позов про встановлення порядку використання об'єкта часткової власності могли бути корисними в ситуації, де законні співмешканці потребують дозволу конкретних розбіжностей при користуванні загальним квартирою, в цій справі ситуація була значно менш стандартною. Заявниця скаржилася на те, що її квартира була непридатна для використання більш ніж однією сім'єю і що V.S. і A.N. вторглися в неї і заволоділи нею проти її волі. Влада держави-відповідача не продемонстрували, як вищезгадані кошти могли забезпечити розгляд цієї скарги і усунення її суті.

 


ПОСТАНОВА

 


У справі допущено порушення вимог статті 8 Конвенції (прийнято одноголосно).

 


КОМПЕНСАЦІЯ

 

 

 

В порядку застосування статті 41 Конвенції. Європейський Суд присудив заявниці 4 000 євро в якості компенсації моральної шкоди, вимога про компенсацію матеріальних збитків було відхилено.

In the case, the complaint on the lack of a proper legal basis for protecting the apartment owner from attacks on his co-owners of the apartment was successfully considered. In the case there was a violation of the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

CIRCUMSTANCES OF THE CASE

 


The applicant, an elderly woman, lived in a one-room apartment for many years and recently privatized it in ownership in equal shares with an adult son. Her son transferred his share to a third party, V.S., who, together with A.N. began to insult, intimidate and attack the applicant, to spoil her property in an attempt to force her to sell her share in the apartment. Fearing for her safety, the applicant eventually left the apartment.

 

Her attempts to claim an apartment in civil courts were unsuccessful, because according to the legislation of Ukraine her son was not supposed to receive her consent to conclude a gift agreement in favor of VS, and the co-owner could not be deprived of the property right on the grounds to which the applicant referred (antisocial behavior, unsuitability of an apartment for joint use and denial of maintenance costs).

 

The applicant also filed a number of complaints to the police. V.S. and A.N. were convicted of extortion and sentenced to imprisonment about 10 years after the first complaint.

 


ISSUES OF LAW

 


Concerning compliance with Article 3 of the Convention. The systematic and deliberate nature of the verbal attacks to which the applicant was subjected, exacerbated by cases of physical violence by a group of persons against a lone elderly woman, has reached the threshold of severity required for referring to the scope of Article 3 of the Convention and the emergence of a positive duty of the State to enact a protective legislative and administrative framework.

 

Although the main offenders were prosecuted and sentenced to significant prison terms, nevertheless, state authorities took more than 20 years to resolve the issue. In view of the exceptional delays in initiating and conducting criminal proceedings, the Government of the respondent State did not fulfill their positive obligation under Article 3 of the Convention.

 


DECISION

 


The violation of the requirements of Article 3 of the Convention (unanimously) was committed in the case.

 

Concerning compliance with Article 8 of the Convention. In accordance with this provision of the Convention, the applicant complained that she was obliged to tolerate the presence in her home of strangers to her household and their unpleasant, though mostly unreliable, behavior, including unceremonious use of the applicant's flat and property, equipment damage, noise and other disturbances.

 

The Court has established that the criminal proceedings in which V.S. and A.N. was charged with the obligation to pay compensation and they were deprived of a share in the apartment, subsequently removed some aspects of the applicant's complaint. However, owing to exceptional delays in the proceedings, the applicant's rights guaranteed by Article 8 of the Convention were diminished for a very significant period.

 

As to whether the respondent Government had an adequate non-criminal legal basis to provide the applicant with an acceptable level of protection against incursions into her privacy and the use of housing, the Court noted that the separation of a home from strangers, no matter how they behave, creates very important consequences for the privacy of the person and other interests protected by Article 8 of the Convention. Accordingly, if a Member State adopts the legal framework that obliges private individuals to share a home with persons who are alien to their household, it must introduce clear rules and necessary procedural safeguards to allow interested persons to protect their convention interests.

 

However, in the present case, the Ukrainian legislation did not provide the applicant with significant opportunities (i) to object to cohabitation with A.N., V.S. and their acquaintances on the grounds that this cohabitation creates disproportionate consequences for their rights under Article 8 of the Convention and (ii) to receive expedient and immediate protection against uninvited intrusions into her personal space and home, including, if necessary, taking preliminary measures.

 

While the European Court was prepared to recognize that civil remedies, such as a claim for damages, a request for termination and abstention from interference with the use of property by another person, or a claim for establishing the use of a shared property object, could be useful in situation where legal cohabitants need to resolve specific differences in the use of a common apartment, in the present case the situation was much less standard. The applicant complained that her apartment was unfit for use by more than one family and that V.S. and A.N. invaded her and took her against her will. The authorities of the respondent State did not demonstrate how the aforementioned means could ensure consideration of this complaint and the removal of its essence.

 


DECISION

 


The violation of the requirements of Article 8 of the Convention (unanimously) was committed.

 


COMPENSATION

 

 

 

In the application of Article 41 of the Convention. The Court awarded the applicant EUR 4,000 in respect of non-pecuniary damage, the claim for compensation for pecuniary damage was rejected.

Το 2015, ο αιτών επικουρήθηκε κατά την προετοιμασία της καταγγελίας. Στη συνέχεια, η καταγγελία κοινοποιήθηκε στην Ελλάδα.

 

Στη συγκεκριμένη περίπτωση, εξετάστηκε επιτυχώς μια καταγγελία για την αποφυγή εξουσιοδοτημένου προσώπου από τη λήψη απόφασης σχετικά με την αίτηση ασύλου του αιτούντος. Στην περίπτωση αυτή υπήρξε παραβίαση των όρων του άρθρου 8 της Σύμβασης για την Προστασία των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών.

 

 

 

Επί της περιπτώσεως

 


Ο αιτητής είναι Τούρκος πολίτης και φιλοκουρδικός μαχητής. Μετά την κράτηση και την κατηγορία στην Τουρκία για υπονόμευση της συνταγματικής τάξης του κράτους, έφυγε στην Ελλάδα και ζήτησε άσυλο εκεί το 2002. Το αίτημά του απορρίφθηκε απλοποιημένα από το διοικητικό όργανο πρωτοβάθμιου δικαστηρίου. Ο αιτητής υπέβαλε διοικητική καταγγελία στον Υπουργό Δημόσιας Τάξης. Σύμφωνα με τους νόμους της Ελλάδας, ο Υπουργός αποφάσισε εντός 90 ημερών από την παραλαβή των συμπερασμάτων της συμβουλευτικής επιτροπής για θέματα ασύλου. Το 2003, η Επιτροπή αμφισβήτησε τον αιτούντα και εξέφρασε την άποψή του υπέρ της αναγνώρισης του καθεστώτος του πρόσφυγα (τα έγγραφα που υποβάλλονται για την υποστήριξη αυτών των καταγγελιών για βασανιστήρια). Ωστόσο, δεν υπήρξε σαφής αντίδραση στην καταγγελία του αιτούντος.

 

Η Τουρκία υπέβαλε αίτηση έκδοσης του αιτούντος. Το 2013, τα δικαστήρια απέρριψαν το αίτημα με βάση την απειλή κακομεταχείρισης και τον ασαφή και αφηρημένο χαρακτήρα του φερόμενου εγκλήματος.

 

Από το 2003, ο αιτών κατοικεί στην Αθήνα, παρακολουθείται από την αστυνομία κάθε έξι μήνες για να ενημερώσει την κάρτα του αιτούντος άσυλο. Την ίδια χρονιά, η σύζυγός του ήρθε σε αυτόν, αλλά η παραμονή του ήταν νομιμοποιημένη μόνο το 2008, όταν συνήψε σύμβαση εργασίας.

 


ΖΗΤΗΜΑΤΑ ΤΟΥ ΝΟΜΟΥ

 


Όσον αφορά τη συμμόρφωση με το άρθρο 8 της Σύμβασης. Το πρόβλημα που ανακύπτει στην παρούσα υπόθεση δεν συνδέεται με τις εντολές απέλασης ή απέλασης, και με ασταθή και αβέβαιο περιστάσεις του αιτούντος για μεγάλο χρονικό διάστημα, δηλαδή από την ημερομηνία υποβολής της καταγγελίας του, η οποία δεν είχε λάβει απάντηση για περισσότερα από 12 χρόνια, απόρριψη της αίτησής του για άσυλο. Στο πλαίσιο αυτό, η αβεβαιότητα της προσφεύγουσας σχετικά με την κατάσταση του πήρε μια εντελώς διαφορετική διάσταση σε σχέση με τον αιτούντα άσυλο, που περιμένουν για ένα εύλογο χρονικό διάστημα η έκβαση της δίκης σχετικά με την εφαρμογή του. Πρέπει να σημειωθούν διάφορες πτυχές αυτών των ασταθών περιστάσεων:

 

- κατά τη διαδικασία αναμονής της απόφασης, ο αιτών εργάστηκε χωρίς άδεια εργασίας. Αν και οι αιτούντες άσυλο που επιθυμούν να αποκτήσουν μια τέτοια άδεια, υποβλήθηκαν σε περιοριστικούς όρους: πρέπει να έχουν, μεταξύ άλλων, να αποδείξει ότι το έργο ενός συγκεκριμένου επαγγέλματος ή σε έναν συγκεκριμένο τομέα δεν ενδιαφέρονται για άνεργους πολίτες, οι πολίτες των άλλων χωρών της Ευρωπαϊκής Ένωσης, ή οποιουδήποτε προσώπου το οποίο, έχει αποκτήσει το καθεστώς του πρόσφυγα, και εκτός από αυτό νομικά εμπόδια προκύπτουν πρακτικές δυσκολίες που συνδέονται με την οικονομική κρίση και τον υψηλό αριθμό των ανέργων που αναζητούν εργασία?

 

- ως κάτοχος της κάρτας του αιτούντος άσυλο, ο αιτών δεν μπορούσε να ανοίξει τραπεζικό λογαριασμό ούτε να αποκτήσει αριθμό φορολογικού μητρώου·

 

- Τα παραπάνω ήταν προαπαιτούμενο για την υλοποίηση επαγγελματικών δραστηριοτήτων ή ακόμη και για την απόκτηση άδειας οδήγησης ή εισαγωγής στο πανεπιστήμιο.

 

- Όσον αφορά την ιδιωτική ζωή της προσφεύγουσας, δεν είναι δυνατό ή νόμιμης διαμονής με τη σύζυγό του μέχρι το 2008 με τον ίδιο, όταν πήρε την άδεια να εργαστούν στην Ελλάδα για περιορισμένο χρονικό διάστημα, και όχι δυνάμει των διατάξεων που διέπουν την οικογενειακή επανένωση.

 

Θα πρέπει να συναχθεί το συμπέρασμα ότι η αποφυγή του Υπουργού Δημόσιας Τάξης σχετικά με την απόφαση για το αίτημα ασύλου του αιτητή ήταν αδικαιολόγητη και δεν έδωσε την εξήγηση για την κατάσταση αυτή, η οποία διήρκεσε περισσότερο από 12 χρόνια, παρά το γεγονός ότι οι ελληνικές αρχές έχουν αναγνωρίσει την ανάγκη να παρέχει στον αιτούντα άσυλο, και Επίσης, απέρριψαν το αίτημα των τουρκικών αρχών για την έκδοσή του.

 

Κατά συνέπεια, οι αρμόδιες αρχές δεν συμμορφώνονται με τη θετική υποχρέωσή τους να παρέχουν αποτελεσματικές και προσιτές διαδικασίες για την προστασία του δικαιώματος στην ιδιωτική ζωή εις βάρος των αποτελεσματικών κανόνων που εγγυώνται την αίτηση της προσφεύγουσας για άσυλο μέσα σε εύλογο χρονικό διάστημα, έτσι ώστε να παραμένει σε κατάσταση αβεβαιότητας για το συντομότερο δυνατό χρονικό διάστημα.

 


ΑΠΟΦΑΣΗ

 


Η παραβίαση των απαιτήσεων του άρθρου 8 της Σύμβασης (ομόφωνα) διαπράχθηκε.

 

Δείτε αντίθετο παράδειγμα στην περίπτωση της άρνησης της άδειας διαμονής τους αιτούντες οι οποίοι διαμένουν παράνομα στη χώρα υποδοχής και προσπάθησε να θέσει τις τοπικές αρχές με τετελεσμένα γεγονότα της οικογενειακής ζωής: αναφέρεται στην απόφαση του τμήματος μείζονος συνθέσεως του Δικαστηρίου των Ευρωπαϊκών Κοινοτήτων «Jeunesse κατά των Κάτω Χωρών» (ευρωπαϊκή νομολογία (Jeunesse κατά Ολλανδίας) της 3ης Οκτωβρίου 2014, καταγγελία αριθ. 12738/10.

 

Το Δικαστήριο διαπίστωσε επίσης ότι υπήρξε παραβίαση των όρων του άρθρου 13 της Σύμβασης σε συνδυασμό με το άρθρο 8 της Σύμβασης (ομόφωνα).

 

Άρθρο 3 της Σύμβασης, σε συνδυασμό με το άρθρο 13 της Σύμβασης. Το Δικαστήριο απέρριψε το επιχείρημα των αρχών του κράτους εναγόμενο ότι η απόφαση του δικαστηρίου να αρνηθεί να εκδώσει ο αιτών αποτρέψει την επιστροφή του στην Τουρκία, διαπιστώνοντας ότι οι αποφάσεις αυτές δεν ακυρώνει την προσωρινή διοικητική απόφαση με την οποία απορρίφθηκε η αίτησή του για άσυλο και, ως εκ τούτου, δεν μπορεί να θεωρηθεί ότι παρέχει τον διεθνή προστασία.

 

Στη βάση αυτή, το Δικαστήριο κατέληξε στο συμπέρασμα ότι η αίτηση του αιτούντος άσυλο εξακολουθούν διαρκείας, σημειώνοντας ότι η καθοδήγηση σχετικά με αυτό μπορούν να βρεθούν στην αστυνομία αλληλογραφία. Λόγω του νομικού καθεστώτος του παρέμεινε ασαφές, ο προσφεύγων υποβλήθηκε στην απειλή της ξαφνικής απέλασης στην Τουρκία με την απουσία της δυνατότητας του αποτελεσματικού ελέγχου του αιτήματος ασύλου του, αν και υπήρξαν ενδείξεις σημαντικής απειλής για τη θεραπεία αντίθετη προς το άρθρο 3 της Σύμβασης σε αυτή τη χώρα.

 


ΑΠΟΦΑΣΗ

 


Σε περίπτωση θα είναι μια παραβίαση του άρθρου 3 της Σύμβασης σε περίπτωση επιστροφής του καταγγέλλοντος στην Τουρκία, ελλείψει ex nunc αξιολόγησης των ελληνικών αρχών της προσωπικής του κατάστασης, υπό το πρίσμα των κριτηρίων που ορίζονται στη σχετική νομολογία του Ευρωπαϊκού Δικαστηρίου (ομόφωνα).

ΑΠΟΖΗΜΙΩΣΗ

 


Κατά την εφαρμογή του άρθρου 41 της Σύμβασης. Το Δικαστήριο χορήγησε στην προσφεύγουσα 4 000 ευρώ για ηθική βλάβη.

The ECHR judgment of 13 October 2016 in the case of B.A.C. (B.A.C.) v. Greece (application No. 11981/15).

 

In 2015, the applicant was assisted in preparing the application. Subsequently, the application was communicated to Greece.

 

In the case, a complaint was successfully considered for evading an authorized person from passing a decision on the applicant's application for asylum. In the case there was a violation of the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

CIRCUMSTANCES OF THE CASE

 


The applicant is a Turkish citizen and a pro-Kurdish militant. After the detention and accusation in Turkey of undermining the constitutional order of the state, he fled to Greece and requested asylum there in 2002. His request was rejected in a simplified form by the administrative body of first instance. The applicant filed an administrative complaint to the Minister of Public Order. In accordance with the laws of Greece, the Minister was to make a decision within 90 days after receiving the conclusion of the advisory committee on asylum issues. In 2003, the committee interviewed the applicant and expressed his opinion in favor of granting him refugee status (the documents submitted supported his allegations of torture). However, there was no clear reaction to the applicant's complaint.

 

Turkey has submitted a request for the extradition of the applicant. In 2013, the courts rejected the request on the basis of the threat of ill-treatment and the vague and abstract nature of the alleged crime.

 

Since 2003, the applicant has been living in Athens, is being monitored by the police every six months to update his asylum seeker card. In the same year, his wife came to him, but her stay was legalized only in 2008, when she entered into a labor contract.

 


ISSUES OF LAW

 


Concerning compliance with Article 8 of the Convention. The problem that arises in the present case is not connected with orders for expulsion or deportation, but with the unstable and uncertain circumstances of the applicant for a long period, namely from the time of filing his complaint, to which he has not received an answer for more than 12 years, on rejection of his application for asylum. In this context, the applicant's uncertainty about his status took a completely different dimension with respect to the asylum seeker who was simply waiting for a reasonable time for the outcome of the proceedings regarding his application. Several aspects of these unstable circumstances should be noted:

 

- in the process of waiting for the decision, the applicant worked in the absence of a work permit. At that time, asylum-seekers seeking to obtain such permission were subject to restrictive conditions: they had to prove, in particular, that unemployed citizens, citizens of other countries of the European Union or any person who did not show interest in work in a particular profession or in a particular sector has already acquired refugee status, and in addition to this legal obstacle, there has been a practical difficulty associated with the economic crisis and the high number of unemployed job seekers;

 

- as the holder of the asylum seeker's card, the applicant could not open a bank account or obtain a tax identification number;

 

- The above was a prerequisite for the implementation of professional activities or even obtaining a driver's license or admission to the university;

 

- Regarding the applicant's private life, it was not possible or legal for him to live with his wife until 2008, when she was granted a work permit in Greece for a limited period, and not because of regulations governing family reunification.

 

It should be concluded that the evasion of the Minister of Public Order from the decision on the applicant's application for asylum was unjustified and no explanation was given for this situation, which lasted more than 12 years, despite the fact that the Greek authorities recognized the need to grant the applicant asylum, and They also rejected the Turkish authorities' request for his extradition.

 

Accordingly, the competent authorities have not fulfilled their positive obligation to ensure an effective and accessible procedure for protecting the right to respect for private life through effective rules ensuring that the applicant's application for asylum is examined within a reasonable time so that he remains in a state of uncertainty within the shortest possible period.

 


DECISION

 


The violation of the requirements of Article 8 of the Convention (unanimously) was committed.

 

See the opposite example in the case of denial of residence to the applicants who illegally resided in the host country and tried to place the domestic authorities before the fait accompli of family life: the case law cited in the Judgment of the Grand Chamber of the European Court in the Jeunesse case v. Netherlands) of 3 October 2014, complaint No. 12738/10.

 

The Court also found that there had been a violation of the requirements of Article 13 of the Convention in conjunction with Article 8 of the Convention (unanimously).

 

Article 3 of the Convention, in conjunction with Article 13 of the Convention. The Court dismissed the Government's argument that the court's decision to refuse the extradition of the applicant hindered his return to Turkey, finding that these decisions do not invalidate the temporary administrative decision to reject his application for asylum and therefore can not be considered as providing him international protection.

 

On this basis, the Court concludes that the applicant's asylum applications continue to be permanent, noting that instructions on this can be found in police correspondence. As his legal status remained unclear, the applicant was threatened with a sudden deportation to Turkey in the absence of the possibility of effectively considering his application for asylum, although there were signs of a significant threat of treatment contrary to Article 3 of the Convention in that country.

 


DECISION

 


In the case of violation of the requirements of Article 3 of the Convention in the event of the applicant's return to Turkey in the absence of ex nunc assessment by the Greek authorities of his personal circumstances in the light of the criteria established in the relevant case-law of the European Court (unanimously).

COMPENSATION

 


In the application of Article 41 of the Convention. The Court awarded the applicant EUR 4,000 in respect of non-pecuniary damage.
