Постановление ЕСПЧ от 25 мая 2018 года по делу "Лорен (Laurent) против Франции" (жалоба N 28798/13).

В 2013 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Франции.

По делу успешно рассмотрена жалоба заявителя на нарушение сотрудником полицейского конвоя тайны корреспонденции. По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

В ожидании оглашения решения судьи два клиента заявителя (который являлся адвокатом) должны были находиться под контролем сотрудников полиции (конвоя). Заявитель написал на листе бумаги свои рабочие контактные данные, сложил листок и открыто передал его одному из своих клиентов. Старший сотрудник полицейского конвоя попросил клиента заявителя показать ему бумагу. Полицейский открыл записку, прочитал ее и вернул клиенту заявителя. Заявитель сделал сотруднику полиции замечание за нарушение принципа уважения конфиденциальности общения адвоката с клиентом. Аналогичная ситуация повторилась и со вторым клиентом заявителя. Жалобы заявителя на нарушение тайны корреспонденции оказались безуспешными.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения подпункта "b" пункта 3 статьи 35 Конвенции (отсутствие значительного ущерба). Жалоба касалась способа обмена информацией, относительно которого Европейский Суд еще не выносил постановлений. Как следствие, возражение властей государства-ответчика относительно отсутствия значительного ущерба было отклонено.

По поводу соблюдения статьи 8 Конвенции. Перехват сотрудником полиции записок, написанных заявителем-адвокатом и переданных им своим клиентам, являлся вмешательством в право на уважение тайны переписки между заявителем и его или ее клиентами. Вмешательство преследовало законную цель предотвращения беспорядков и преступления.

На момент вмешательства клиенты заявителя содержались под стражей, и их сопровождал конвой сотрудников полиции. Следовательно, контроль за обменом сообщениями не мог быть совсем исключен, но он мог осуществляться только в том случае, если власти имели достоверные основания полагать, что в переписке адвоката с клиентами содержалась какая-либо противозаконная информация.

Старший сотрудник полицейского конвоя действовал с целью предотвращения совершения любых опасных или незаконных действий. Однако власти государства-ответчика не указали ни одной причины, связанной с сутью проблемы, которая могла бы обосновать контроль за обменом документами, и не настаивали на том, что документы могли бы служить основанием для каких-либо определенных подозрений. Кроме того, заявитель, действуя в качестве адвоката, написал и передал своим клиентам рассматриваемые письма, находясь полностью на виду старшего сотрудника полицейского конвоя, не пытаясь скрыть свои действия. В результате в отсутствие какого-либо подозрения в наличии незаконных действий перехват соответствующих документов не мог быть оправдан. Аналогичным образом содержание перехваченных сотрудником полиции документов не имело значения, учитывая, что независимо от ее цели переписка адвоката со своими клиентами касалась личных и конфиденциальных вопросов. На каждом этапе производства по делу внутригосударственные суды указывали, что, хотя события не обосновывали уголовного преследования, тем не менее действия старшего сотрудника полицейского конвоя являлись нарушением принципа беспрепятственного общения адвоката со своими клиентами.

Таким образом, перехват и тщательное исследование переписки заявителя со своими клиентами, когда заявитель выступал в качестве адвоката, не соответствовали настоятельной социальной необходимости и поэтому не являлись необходимыми в демократическом обществе.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Установление факта нарушения Конвенции само по себе является достаточной справедливой компенсацией любого морального вреда.

En 2013, le plaignant a été assisté dans la préparation d'une requête. La requête a ensuite été transmise à la France.

L'affaire a été examinée avec succès par la plainte du requérant concernant la violation du secret de la correspondance par un agent du convoi de police. L'affaire a violé les exigences de l'article 8 de la Convention de sauvegarde des droits de l'homme et des libertés fondamentales.


LES CIRCONSTANCES DE L'AFFAIRE

 

Dans l’attente de l’annonce de la décision du juge, les deux clients du requérant (qui était avocat) devaient être sous le contrôle des policiers (convoi). Le requérant écrivit ses coordonnées de travail sur une feuille de papier, la plia et la tendit à l'un de ses clients. Un officier supérieur du convoi de police a demandé au client du demandeur de lui montrer le papier. Le policier a ouvert la note, l'a lue et a renvoyé le demandeur au client. Le requérant a fait remarquer à l'agent de police qu'il avait violé le principe du respect de la confidentialité des communications entre l'avocat et le client. Une situation similaire a été répétée avec le deuxième client du demandeur. Les plaintes du plaignant concernant la violation du secret de la correspondance n’ont pas abouti.


QUESTIONS DE DROIT


Concernant le respect du paragraphe 3 b) de l’article 35 de la Convention (absence de dommage important). La plainte concernait une méthode d'échange d'informations sur laquelle la Cour européenne n'avait pas encore rendu ses arrêts. En conséquence, l'objection des autorités de l'Etat défendeur concernant l'absence de dommage significatif a été rejetée.

Concernant le respect de l’article 8 de la Convention. L'interception par l'agent de police de notes rédigées par l'avocat du plaignant et transmises à ses clients constituait une ingérence dans le droit de respecter le secret de la correspondance entre le demandeur et ses clients. L'intervention poursuivait l'objectif légitime de prévenir le désordre et le crime.

Au moment de l'intervention, les clients de la requérante étaient arrêtés et accompagnés par un convoi de policiers. Par conséquent, le contrôle de l’échange de messages ne pouvait être totalement exclu, mais il ne pouvait être exercé que si les autorités avaient des motifs crédibles de croire que la correspondance de l’avocat avec les clients contenait des informations illégales.

Un officier supérieur d'un convoi de police a agi pour empêcher la commission d'actes dangereux ou illicites. Toutefois, les autorités de l'État défendeur n'ont pas indiqué de raisons liées à l'essence du problème, qui pourraient justifier un contrôle de l'échange de documents, et n'ont pas insisté pour que les documents puissent servir de base à des soupçons spécifiques. En outre, le requérant, agissant en qualité d'avocat, a écrit et a remis à ses clients les lettres en question, tout à fait à la vue de l'agent supérieur du convoi de police, ne cherchant pas à dissimuler ses actes. En conséquence, en l’absence de soupçon d’actes illégaux, l’interception de documents pertinents ne pourrait être justifiée. De même, le contenu des documents interceptés par le policier importait peu, étant donné que la correspondance de l'avocat avec ses clients, indépendamment de son objet, concernait des questions personnelles et confidentielles. À chaque étape de la procédure, les juridictions nationales ont indiqué que, même si les faits n’étayaient pas les poursuites pénales, les agissements de l’officier supérieur du convoi de police violaient néanmoins le principe de la communication sans entrave de l’avocat avec ses clients.

Ainsi, l'interception et l'examen approfondi de la correspondance du requérant avec ses clients, alors que le requérant agissait en qualité d'avocat, ne répondaient pas à un besoin social impérieux et n'étaient donc pas nécessaires dans une société démocratique.


Résolution


L'affaire constituait une violation de l'article 8 de la Convention (adopté à l'unanimité).


PAIEMENT


En application de l'article 41 de la convention. Le constat de violation de la Convention constitue en soi une réparation juste et équitable du préjudice moral éventuel.

The ECHR judgment of May 25, 2018 in the case of Laurent (v. France) (application no. 28798/13).

In 2013, the complainant was assisted in preparing a application. Subsequently, the application was communicated to France.

The case was successfully considered the complaint of the applicant about the violation of correspondence secrecy by a police convoy officer. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.


THE CIRCUMSTANCES OF THE CASE


Pending the announcement of the judge’s decision, the two clients of the applicant (who was a lawyer) should have been under the control of the police officers (convoy). The applicant wrote his working contact details on a sheet of paper, folded the sheet and openly handed it to one of his clients. A senior officer of the police convoy asked the applicant's client to show him the paper. The policeman opened the note, read it and returned the applicant to the client. The applicant made a remark to the police officer for violating the principle of respecting the confidentiality of the communication between the lawyer and the client. A similar situation repeated with the second client of the applicant. The complainant’s complaints about the violation of correspondence secrecy were unsuccessful.


QUESTIONS OF LAW


Regarding the compliance with paragraph 3 (b) of Article 35 of the Convention (absence of significant damage). The complaint concerned a method of exchanging information on which the European Court had not yet passed judgments. As a consequence, the objection of the authorities of the respondent state regarding the absence of significant damage was dismissed.

Regarding compliance with Article 8 of the Convention. The interception by the police officer of notes written by the complainant-attorney and transmitted to them to his clients constituted an interference with the right to respect the secrecy of correspondence between the applicant and his or her clients. The intervention pursued the legitimate aim of preventing disorder and crime.

At the time of the intervention, the applicant's clients were detained and accompanied by a convoy of police officers. Consequently, control over the exchange of messages could not be completely excluded, but it could only be carried out if the authorities had credible grounds for believing that the attorney’s correspondence with clients contained any unlawful information.

A senior officer of a police convoy acted to prevent the commission of any dangerous or unlawful acts. However, the authorities of the respondent state did not indicate any reasons related to the essence of the problem, which could justify control over the exchange of documents, and did not insist that the documents could serve as the basis for any specific suspicions. In addition, the applicant, acting as a lawyer, wrote and handed over to his clients the letters in question, being completely in the sight of the senior officer of the police convoy, not trying to hide his actions. As a result, in the absence of any suspicion of illegal actions, the interception of relevant documents could not be justified. Similarly, the content of the documents intercepted by the police officer did not matter, given that regardless of its purpose, the correspondence of the attorney with his clients concerned personal and confidential matters. At each stage of the proceedings in the case, the domestic courts indicated that, although the events did not substantiate the criminal prosecution, the actions of the senior officer of the police convoy nevertheless violated the principle of the lawyer’s unhindered communication with his clients.

Thus, the interception and thorough examination of the applicant's correspondence with his clients, when the applicant acted as a lawyer, did not meet the pressing social need and therefore were not necessary in a democratic society.


RESOLUTION


The case was a violation of Article 8 of the Convention (adopted unanimously).


COMPENSATION


In application of Article 41 of the Convention. The finding of a violation of the Convention is in itself a fair enough compensation for any non-pecuniary damage.

Постановления ЕСПЧ от 31 мая 2018 года по делу "Абу Зубейда (Abu Zubaydah) против Литвы, Аль Нашири (Al Nashiri) против Румынии" (жалобы N 46454/11 и 33234/12).

 

В 2011 и 2012 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были коммуницированы Литве и Румынии соответственно.

 

По делу успешно рассмотрены заявителей на бесчеловечное обращение с ними во время содержания их под стражей, на применение к ним пыток, на тайное содержание их под стражей и изоляцию от внешнего мира. По делу допущены нарушения требований статей 2, 3, 5, пункта 1 статьи 6, статей 8, 13, 46 Конвенции о защите прав человека и основных свобод, статьи 1 Протокола N 1 к Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявителей задержали сотрудники Центрального разведывательного управления (далее - ЦРУ) Соединенных Штатов Америки в рамках "борьбы с терроризмом", начавшейся после атак 11 сентября 2001 г. После передачи заявителей в соответствии с процедурой "чрезвычайной выдачи" их содержали в засекреченных учреждениях ЦРУ в различных странах. Как "заключенных особой важности" (HVD), то есть террористов, подозреваемые в том, что они "могут сообщить информацию о возможных террористических угрозах в Соединенных Штатах Америки", заявителей подвергали "усиленным техникам допроса", к которым относились "пытка, имитирующая утопление", содержание в ящике, лишение сна и пищи, содержание при низких температурах, стояние у стены и содержание в других стрессовых ситуациях. Заявителя Аль Нашири также подвергали "несанкционированным" методам допроса, таким как имитация казни и подвешивание вниз головой.

 

Обстоятельства "чрезвычайной выдачи" заявителей стали предметом многочисленных сообщений и расследований, включая репортаж журналиста Дика Марти (Dick Marty), подготовленный им в связи с расследованием, проводившимся Парламентской Ассамблеей Совета Европы, и доклад Сената Соединенных Штатов Америки от 2014 года о применении пыток.

 

В своих Постановлениях от 24 июля 2014 г. Европейский Суд установил ряд нарушений Конвенции в связи с содержанием заявителей под стражей без права общения с внешним миром в период нахождения в Польше под юрисдикцией ЦРУ (жалобы N 7511/13 и 28761/11). Имеются в виду Постановление Европейского Суда по делу "Хусейн (Абу Зубейда) против Польши" (Husayn (Abu Zubaydah) v. Poland) от 24 июля 2014 г., жалоба N 7511/13, и Постановление Европейского Суда по делу "Аль Нашири против Польши" (Al Nashiri v. Poland) от 24 июля 2014 г., жалоба N 28761/11.

 

В настоящих жалобах заявители обжаловали тот факт, что власти государств-ответчиков позволили сотрудникам ЦРУ подвергать заявителей на своих территориях содержанию под стражей без права общения с внешним миром, а также пыткам и впоследствии разрешить перевозить заявителей в другие учреждения, находящиеся под юрисдикцией ЦРУ в других странах.

 

В настоящее время оба заявителя содержатся под стражей на военно-морской базе Соединенных Штатов Америки в Гуантанамо. Заявителю Хусейну, также известному как Абу Зубейда, так ни разу и не было предъявлено какое-либо обвинение. Аль Нашири было предъявлено обвинение, и он предстал перед военным судом Соединенных Штатов Америки по обвинению в преступлениях, наказуемых смертной казнью.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

Установление фактов и вопросы юрисдикции. Европейский Суд установил окончательно и вне всякого разумного сомнения, что власти Литвы и Румынии разрешили разместить на своих территориях учреждения для содержания лиц под стражей под юрисдикцией ЦРУ Соединенных Штатов Америки и что заявителей тайно содержали в этих учреждениях на протяжении более чем одного года, а также что власти государств-ответчиков знали о характере и целях действий ЦРУ в своих странах и сотрудничали с ним при осуществлении программы "заключенных особой важности", осознавая при этом, что, позволяя ЦРУ содержать на своих территориях лиц, подозреваемых в терроризме, они подвергали указанных подозреваемых серьезному риску обращения, противоречащего требованиям Конвенции.

 

Обжалуемые в настоящем деле вопросы относились к "юрисдикции" властей Литвы (в отношении заявителя Абу Зубейда) и Румынии (в отношении заявителя Аль Нашири) по смыслу статьи 1 Конвенции и могли повлечь ответственность указанных государств-ответчиков согласно Конвенции.

 

По поводу соблюдения статьи 5 Конвенции (материально-правовой аспект). Европейский Суд установил вне всякого разумного сомнения, что во время содержания заявителей под стражей в Литве и Румынии соответственно их содержали, как и других заключенных, находившихся под юрисдикцией ЦРУ, в условиях режима, включавшего (в качестве предсказуемой ежедневной рутины) завязывание глаз заключенным или надевание им мешка на голову, чтобы дезориентировать их и помешать им узнать местонахождение учреждения или его схему, бритье волос по прибытии в учреждение, содержание в одиночных камерах без возможности контакта с внешним миром, постоянное и умышленное использование в камерах шумов разных уровней высокой интенсивности, постоянное освещение в камерах такой же интенсивности, как в обычном офисе, использование ножных кандалов во всех случаях манипуляций с заключенными и их перемещения.

 

Хотя заявителей не допрашивали с использованием самых жестоких методов, они подверглись крайне строгому режиму содержания под стражей в Литве и Румынии, включая практически полную сенсорную изоляцию от окружающего мира, и страдали от постоянного эмоционального и психологического стресса и переживаний, вызванных перенесенными в прошлом жестокими пытками со стороны сотрудников ЦРУ, а также постоянно боялись за свое будущее. Следовательно, принимая во внимание режим содержания заявителей под стражей и его совокупное воздействие на заявителей, обжалуемое обращение должно было быть охарактеризовано как сильные физические и психологические страдания, попадающие под определение "бесчеловечное обращение". Таким образом, власти Литвы и Румынии в связи с их "согласием" с программой "заключенных особой важности" "и попустительством" этой программе должны считаться ответственными за нарушение гарантированных статьей 3 Конвенции прав заявителей, совершенное на территории указанных государств.

 

Позволив ЦРУ перевести заявителей из Литвы и Румынии соответственно в другие места содержания под стражей, власти государств-ответчиков подвергли заявителей предвидимому серьезному риску дальнейшего жестокого обращения и применения условий содержания под стражей, нарушающих статью 3 Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 3 Конвенции (принято единогласно).

 

Европейский Суд также единогласно установил нарушения:

 

(a) со стороны властей Румынии:

 

- статей 2 и 3 Конвенции в совокупности со статьей 1 Протокола N 1 к Конвенции;

 

- пункта 1 статьи 6 Конвенции в связи с переводом заявителя Аль Нашири с территории Румынии, несмотря на реальный и предвидимый риск того, что заявитель мог столкнуться с прямым отказом в правосудии и быть казнен после рассмотрения его дела военной комиссией в Соединенных Штатах Америки;

 

(b) со стороны властей Литвы и Румынии:

 

- процессуальной составляющей статьи 3 Конвенции в связи с неспособностью провести эффективное и тщательное расследование жалоб заявителей на жестокое обращение с ними во время содержания под стражей в учреждениях ЦРУ;

 

- статьи 5 Конвенции из-за тайного содержания заявителей под стражей на территории государств-ответчиков и их последующего перевода в другие учреждения ЦРУ в третьих государствах;

 

- статьи 8 Конвенции, поскольку вмешательство в право заявителей на уважение их частной и семейной жизни не соответствовало закону и не было обосновано, учитывая применение незаконного, засекреченного содержания под стражей;

 

- статьи 13 Конвенции в связи с отсутствием эффективного средства правовой защиты для обжалования нарушения прав заявителей.

 

По поводу соблюдения статьи 46 Конвенции. (a) Расследование. Власти обоих государств-ответчиков обязаны возобновить и рассмотреть по существу как можно скорее уголовные дела по жалобам на обстоятельства и условия, при которых заявителей доставили на территории государств-ответчиков и вывезли с них, а также в которых заявители находились на указанных территориях, с целью установления и, если это уместно, наказания виновных лиц.

 

(b) Дипломатические действия. Власти Литвы обязаны направить властям Соединенных Штатов Америки дальнейшие запросы об устранении или как минимум ограничении последствий нарушений прав заявителя Абу Зубейда. Поскольку итог судебного разбирательства по делу заявителя Аль Нашири все еще неясен, власти Румынии должны добиться от властей Соединенных Штатов Америки получения гарантий того, что заявитель не будет казнен.

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил каждому из заявителей по 100 000 евро в качестве компенсации морального вреда.

2018 m. Gegužės 31 d. EŽTT sprendimai Abu Zubaydah prieš Lietuvą, Al Nashiri prieš Rumuniją (pareiškimo Nr. 46454/11 ir 33234/12).

 

2011 m. Ir 2012 m. Skundų pateikėjams buvo padėta rengti skundus. Vėliau pareiškimo buvo perduoti atitinkamai Lietuvai ir Rumunijai.

 

Tokiu atveju pareiškėjai buvo sėkmingai apsvarstyti dėl nežmoniško elgesio sulaikymo, kankinimo prieš juos, slapto sulaikymo ir izoliavimo nuo išorinio pasaulio. Jei pažeidžiamos Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijos 2 straipsnio, 3 straipsnio 5 dalies, 6 straipsnio 1 dalies, 8 straipsnio, 13, 46 straipsnių, Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijos 1 protokolo 1 straipsnio reikalavimų.

 


BYLOS APLINKYBĖS

 


Pareiškėjus sulaikė Jungtinių Amerikos Valstijų Centrinės žvalgybos agentūros (toliau - CŽV) darbuotojai, dalyvaujantys „kovos su terorizmu“, kuris prasidėjo po 2001 m. Rugsėjo 11 d. Išpuolių. Kai pareiškėjai buvo perkelti pagal „ekstremalių ekstradicijos“ procedūrą, jie buvo laikomi slaptuose CŽV biuruose įvairiose šalyse. . Kaip „ypatingos svarbos kaliniai“ (HVD), ty teroristai, įtariami „informuojantys apie galimas terorizmo grėsmes Jungtinėse Amerikos Valstijose“, pareiškėjams buvo taikomi „patobulinti tardymo metodai“, įskaitant „skandinimo imitavimą“. ", turinys dėžutėje, miego ir maisto atėmimas, turinys žemoje temperatūroje, stovintis prieš sieną ir turinys kitose įtemptose situacijose. Skundo pateikėjas Al Nashiri taip pat buvo apklaustas „nesankcionuotai“, pavyzdžiui, imituoti vykdymą ir pakabinti aukštyn kojom.

Sprendimuose Europos Teismas nustatė keletą Konvencijos pažeidimų, susijusių su pareiškėjų sulaikymu be teisės bendrauti su išoriniu pasauliu, o Lenkijoje pagal CŽV jurisdikciją (skundai Nr. 7511/13 ir 28761/11). Tai reiškia, kad 2014 m. Liepos 24 d. Europos teismas Husseinas (Abu Zubeida) prieš Lenkiją (Husayn (Abu Zubaydah) prieš Lenkiją), skundas Nr. 7511/13 ir Europos Teisingumo Teismas byloje Al Nashiri Lenkijos "(Al Nashiri prieš Lenkiją) 2014 m. Liepos 24 d. Skundas Nr. 28761/11.

 

Šiuose skunduose skundo pateikėjai apskundė, kad atsakovų valstybių valdžios institucijos leido CŽV pareigūnams savo teritorijose taikyti pareiškėjams sulaikymo teisę be teisės bendrauti su išoriniu pasauliu, taip pat kankinti ir vėliau leisti pareiškėjams vežti į kitas CŽV jurisdikcijai priklausančias institucijas kitose šalyse.

 

Abi pareiškėjai šiuo metu yra sulaikyti Jungtinių Valstijų jūrų laivyno bazėje Gvantaname. Pareiškėjas Husseinas, taip pat žinomas kaip Abu Zubeid, niekada nebuvo apmokestintas. Al-Nashiri buvo apkaltintas ir pateiktas Jungtinių Valstijų karo teismui dėl kaltinimų nusikaltimais, už kuriuos baudžiama mirtimi.

Galiausiai Europos teismas, be jokios pagrįstos abejonės, nustatė, kad Lietuvos ir Rumunijos valdžios institucijos leido savo teritorijose įsteigti Jungtinių Valstijų CŽV jurisdikcijai priklausančias sulaikymo įstaigas ir kad pareiškėjai buvo slaptai laikomi šiose įstaigose ilgiau nei vienerius metus, ir kad respondentų šalių valdžios institucijos žinojo apie CŽV veiksmų pobūdį ir tikslus savo šalyse ir bendradarbiavo su juo įgyvendindamos „ypatingos svarbos kalinių“ programą, tuo pačiu metu suvokdamos, kad CŽV gali turėti ü terorizmu įtariamų asmenų teritorijose jie įtariamiesiems patyrė rimtą pavojų, kad jie prieštarautų Konvencijos reikalavimams.

 

Šioje byloje skundžiami klausimai susiję su Lietuvos valdžios institucijų „jurisdikcija“ (pareiškėjo Abu Zubeido) ir Rumunijos atžvilgiu (pareiškėjo Al Nashiri atžvilgiu), kaip apibrėžta Konvencijos 1 straipsnyje, ir gali būti susiję su Konvencijos šalių atsakymais.

 

Dėl Konvencijos 5 straipsnio laikymosi (esminis aspektas). Europos teismas neabejotinai nustatė, kad, nors pareiškėjai buvo sulaikyti Lietuvoje ir Rumunijoje, jie buvo sulaikyti, kaip ir kiti kaliniai, priklausantys CŽV jurisdikcijai, režimu, į kurį buvo įtraukta (kaip nuspėjama kasdienė rutina), siejanti kalinių akis ar prikabinti nuplėškite juos į galvą, kad juos išstumtumėte, ir neleiskite jiems žinoti įstaigos ar jos schemos buvimo vietos, plaukdami plaukus po atvykimo į įstaigą, laikydami juos vienišose ląstelėse be galimybės susisiekti su išoriniais jie pasaulis pastovus ir sąmoningas naudojimas rūmų skirtingų triukšmo lygių aukšto intensyvumo, nuolat apšvietimas to paties intensyvumo ląstelių kaip įprastą biurą, iš kojų pančiai naudojimas visais atvejais manipuliavimo kalinių ir perkelti juos.

 

Nors pareiškėjai nebuvo apklausti naudojant brutaliausius metodus, jie buvo labai griežtai sulaikyti Lietuvoje ir Rumunijoje, įskaitant beveik visišką sensorinę izoliaciją nuo išorinio pasaulio ir patyrė nuolatinį emocinį ir psichologinį stresą bei patirtį, sukeltą praeities žiauriais kankinimais CIA pusėje, taip pat nuolat bijojo savo ateities. Todėl, atsižvelgiant į pareiškėjų sulaikymo režimą ir jo bendrą poveikį pareiškėjams, skundžiamas skundas turėjo būti apibūdinamas kaip sunkios fizinės ir psichologinės kančios, priklausančios „nežmoniško elgesio“ apibrėžimui. Todėl Lietuvos ir Rumunijos valdžios institucijos, „priėmus“ šios programos „specialiųjų kalinių“ ir „prisirišimo“ programą, turėtų būti atsakingos už pareiškėjų teisių, garantuojamų šios Konvencijos 3 straipsnyje, pažeidimus, padarytus šių valstybių teritorijoje.

 

Leidžiant CŽV perduoti ieškovus iš Lietuvos ir Rumunijos atitinkamai į kitas sulaikymo vietas, respondentų valstybių valdžios institucijos atskleidė pareiškėjams didelę tolesnio netinkamo elgesio riziką ir sulaikymo sąlygas pažeidžiant Konvencijos 3 straipsnį.

 


REZOLIUCIJA

 


Ši byla buvo Konvencijos 3 straipsnio pažeidimas (priimtas vienbalsiai).

 

Europos teismas taip pat vienbalsiai nustatė pažeidimus:

 

a) Rumunijos valdžios institucijos: \ t

 

- Konvencijos 2 ir 3 straipsniai kartu su Konvencijos 1 protokolo 1 straipsniu;

 

- Konvencijos 6 straipsnio 1 dalis, susijusi su skundo pareiškėjo Al Nashiri perkėlimu iš Rumunijos teritorijos, nepaisant realios ir numatomos rizikos, kad pareiškėjas gali patirti tiesioginį teisingumo atsisakymą ir būti įvykdytas po to, kai jo bylą nagrinėjo karinė komisija Jungtinėse Amerikos Valstijose;

 

b) Lietuvos ir Rumunijos valdžios institucijos: \ t

 

- Konvencijos 3 straipsnio procedūrinė sudedamoji dalis, susijusi su negalėjimu veiksmingai ir išsamiai išnagrinėti pareiškėjų skundų dėl netinkamo elgesio sulaikymo CŽV institucijose metu;

 

- Konvencijos 5 straipsnis dėl slapto pareiškėjų sulaikymo respondentinių valstybių teritorijoje ir vėlesnio jų perkėlimo į kitas CŽV institucijas trečiosiose šalyse;

 

- Konvencijos 8 straipsnis, nes kišimasis į pareiškėjų teisę į privataus ir šeimos gyvenimo gerbimą neatitiko įstatymų ir nebuvo pagrįstas, atsižvelgiant į neteisėtą, slaptą sulaikymą;

 

- Konvencijos 13 straipsnis, jei nėra veiksmingos teisės gynimo priemonės, kuria galima apskųsti pareiškėjų teisių pažeidimą.

 

Dėl Konvencijos 46 straipsnio laikymosi. a) Tyrimas. Abiejų respondentinių valstybių valdžios institucijos privalo kuo greičiau atnaujinti ir ištirti baudžiamąsias bylas, susijusias su skundais dėl aplinkybių ir sąlygų, kuriomis pareiškėjai buvo nuvežti į respondentinių valstybių teritorijas ir iš jų išvežti, taip pat, kai pareiškėjai buvo minėtose teritorijose ir, jei reikia, bausti kaltu.

 

b) diplomatiniai veiksmai. Lietuvos valdžios institucijos privalo išsiųsti papildomus prašymus Jungtinių Valstijų valdžios institucijoms panaikinti ar bent jau apriboti pareiškėjo Abu Zubeid teisių pažeidimų pasekmes. Kadangi Al Nashiri bylos tyrimo rezultatas vis dar neaiškus, Rumunijos valdžios institucijos turėtų prašyti Jungtinių Amerikos Valstijų valdžios institucijų gauti garantijas, kad pareiškėjas nebus įvykdytas.

 


MOKĖJIMAS

 


Taikant Konvencijos 41 straipsnį. Teismas kiekvienam pareiškėjui skyrė 100 000 eurų neturtinei žalai atlyginti.

În 2011 și 2012, reclamanții au fost asistați în pregătirea plângerilor. Ulterior, plângerile au fost comunicate Lituaniei și, respectiv, României.

 

În acest caz, reclamanții au fost considerați cu succes pentru tratamentul inuman în timpul detenției lor, tortura împotriva lor, detenția lor secretă și izolarea din lumea exterioară. În cazul încălcării prevederilor articolelor 2, 3, 5, clauza 1 a articolului 6, articolelor 8, 13 și 46 din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale, articolul 1 din Protocolul nr. 1 la Convenția pentru apărarea drepturilor omului și a libertăților fundamentale.

 


CIRCUMSTANȚELE CAUZEI

 


Reclamanții au fost reținuți de către angajații Agenției Centrale de Informații (CIA) din Statele Unite ale Americii ca parte a "luptei împotriva terorismului", care a început după atacurile din 11 septembrie 2001. După ce reclamanții au fost transferați în conformitate cu procedura "extrădării de urgență" . Ca "deținuți de importanță deosebită" (HVD), adică teroriști suspectați de "raportarea informațiilor despre posibile amenințări teroriste în Statele Unite ale Americii", reclamanții au fost supuși "unor tehnici de interogare îmbunătățită", care includea "imitarea înecării" ", conținutul în cutie, privarea de somn și alimente, conținutul la temperaturi scăzute, în picioare pe perete și conținutul în alte situații stresante. Reclamantul Al Nashiri a fost, de asemenea, supus unor tehnici de interogare "neautorizate", cum ar fi imitarea executării și suspendarea cu susul în jos.

 

Circumstanțele "extrădării extraordinare" a reclamanților au făcut obiectul a numeroase rapoarte și investigații, inclusiv raportul jurnalistului Dick Marty, elaborat de el în legătură cu ancheta desfășurată de Adunarea Parlamentară a Consiliului Europei și raportul din 2014 al Senatului Statelor Unite privind tortura.

 

În hotărârile sale din 24 iulie 2014, Curtea Europeană a constatat o serie de încălcări ale Convenției în legătură cu detenția reclamanților fără dreptul de a comunica cu lumea exterioară, în timp ce în Polonia, sub jurisdicția CIA (plângerile nr. 7511/13 și 28761/11). Aceasta se referă la cazul din 24 iulie 2014, cererea nr. 7511/13 a Curții Europene de Hussein (Abu Zubeida) împotriva Poloniei (Husayn (Abu Zubaydah) împotriva Poloniei) și Curtea Europeană de Justiție în cazul lui Al Nashiri Din Polonia "(Al Nashiri v. Polonia) din 24 iulie 2014, plângerea nr. 28761/11.

 

În aceste plângeri, reclamanții au făcut apel la autoritățile autorităților statelor pârâte să permită ofițerilor CIA să supună solicitanții de pe teritoriul lor la detenție fără dreptul de a comunica cu lumea exterioară, precum și să tortureze și ulterior să permită solicitanților să fie transportați în alte instituții aflate sub jurisdicția CIA în alte țări.

 

Ambii solicitanți sunt în prezent deținuți la baza navală a Statelor Unite din Guantanamo. Reclamantul, Hussein, de asemenea cunoscut sub numele de Abu Zubeid, nu a fost niciodată acuzat. Al-Nashiri a fost inculpat și adus în fața unei instanțe militare a Statelor Unite, acuzându-se de crime care se pedepsește cu moartea.

 


ÎNTREBĂRI LEGATE

 


Stabilirea faptelor și a chestiunilor de competență. Curtea Europeană a stabilit în cele din urmă și fără îndoială că autoritățile Lituaniei și României au permis înființarea de centre de detenție sub jurisdicția CIA ale Statelor Unite ale Americii pe teritoriul lor și că reclamanții au fost păstrați în secret în aceste instituții timp de mai mult de un an, autoritățile țărilor respondente au fost conștiente de natura și obiectivele acțiunilor CIA în țările lor și au colaborat cu aceasta la implementarea programului "prizonierilor de importanță deosebită", realizând în același timp că, permițând CIA să conțină ü pe teritoriul lor persoanelor suspectate de terorism, au expus suspecții la un risc grav de tratament contrare cerințelor Convenției.

 

Chestiunile plânse în cazul de față au fost legate de "competența" autorităților lituaniene (în raport cu reclamantul Abu Zubeid) și România (în raport cu reclamantul Al Nashiri) în sensul articolului 1 din Convenție și ar putea implica responsabilitatea statelor pârâte ale Convenției.

 

În ceea ce privește respectarea articolului 5 al Convenției (aspecte de fond). Curtea Europeană a constatat dincolo de orice îndoială că, deși reclamanții au fost deținuți în Lituania și România, ei au fost deținuți, ca și alți prizonieri sub jurisdicția CIA, într-un regim care include (ca o rutină zilnică previzibilă) legarea ochilor de prizonieri pentru a le dezorienta și pentru a le împiedica să știe locul unde se află instituția sau schema acesteia, bărbierind părul la sosire la instituție, păstrându-le în celule solitare fără posibilitatea contactului cu instituțiile externe ei mondial utilizarea constantă și deliberată în camere de diferite niveluri de zgomot de intensitate mare, iluminat continuu în celulele de aceeași intensitate ca și în biroul obișnuit, utilizarea cătușele la picioare, în toate cazurile de manipulare a prizonierilor și mutați-le.

 

Deși reclamanții nu au fost interogați utilizând metodele cele mai brutale, au fost supuși unei detenții extrem de stricte în Lituania și România, inclusiv o izolare senzorială aproape completă față de lumea exterioară, și au suferit de stres emoțional și psihologic constant și de experiențe cauzate de tortura crudă din trecut parte a CIA, precum și în mod constant temut pentru viitorul lor. Prin urmare, luând în considerare regimul detenției reclamanților și efectul cumulativ asupra reclamanților, reclamația plângere ar fi trebuit să fie caracterizată ca o suferință fizică și psihică severă, care se încadrează în definiția "tratamentului inuman". Prin urmare, autoritățile Lituaniei și României, în legătură cu "acceptarea" programului "deținuților speciali" și "connivanța" acestui program, ar trebui să fie responsabili pentru încălcarea drepturilor reclamanților garantate în articolul 3 al Convenției comise pe teritoriul acestor state.

 

Permițând CIA să transfere solicitanții din Lituania și, respectiv, România, în alte locuri de detenție, autoritățile statelor respondente au expus reclamanții la un risc serios perceput de alte maltratări și condiții de detenție, încălcând articolul 3 al Convenției.

 


DECIZIE

 

 

 

Cazul a constituit o încălcare a articolului 3 al Convenției (adoptat în unanimitate).

 

Curtea Europeană a constatat, de asemenea, în unanimitate încălcări:

 

(a) de către autoritățile române:

 

- articolele 2 și 3 din Convenție, coroborate cu articolul 1 din Protocolul nr. 1 la Convenție;

 

- Articolul 6 § 1 al Convenției în legătură cu transferul reclamantului Al Nashiri de pe teritoriul României, în ciuda riscului real și previzibil în care reclamantul ar putea să se confrunte cu o negare directă a justiției și ar fi executat după examinarea cazului său de către o comisie militară din Statele Unite ale Americii;

 

(b) de către autoritățile din Lituania și România:

 

- componenta procedurală a articolului 3 din Convenție în legătură cu imposibilitatea efectuării unei investigații eficiente și aprofundate a reclamațiilor reclamanților privind maltratarea în timpul detenției lor în instituțiile CIA;

 

- Articolul 5 din Convenție ca urmare a detenției secrete a solicitanților pe teritoriul statelor pârâte și transferului lor ulterior către alte instituții ale CIA din state terțe;

 

- articolul 8 al Convenției, deoarece interferența cu dreptul reclamanților la respectarea vieții private și de familie nu a respectat legea și nu a fost justificată, având în vedere utilizarea unei detenții secrete ilegale;

 

- Articolul 13 al Convenției în lipsa unei căi de atac efective pentru a face apel împotriva încălcării drepturilor reclamanților.

 

În ceea ce privește respectarea articolului 46 al Convenției. (a) Investigarea. Autoritățile celor două state pârâte sunt obligate să reia și să investigheze cât mai curând posibil cauzele penale referitoare la plângerile privind circumstanțele și condițiile în care au fost luate pe teritoriile statelor pârâte și care au fost luate din acestea, precum și în care reclamanții s-au aflat pe teritoriile menționate și, dacă este cazul, să pedepsească vinovatul.

 

(b) Acțiuni diplomatice. Autoritățile lituaniene sunt obligate să trimită alte solicitări autorităților Statelor Unite pentru a elimina sau cel puțin să limiteze consecințele încălcării drepturilor solicitantului Abu Zubeid. Deoarece rezultatul procesului cu privire la cazul lui Al Nashiri este încă neclar, autoritățile române ar trebui să solicite autorităților Statelor Unite ale Americii să obțină asigurări că solicitantul nu va fi executat.

 


COMPENSARE

 


În aplicarea articolului 41 al Convenției. Curtea a acordat fiecăruia dintre reclamanți 100.000 de euro pentru prejudiciul moral.

ECHR judgments of May 31, 2018 in the case of Abu Zubaydah v. Lithuania, Al Nashiri v. Romania (applications No. 46454/11 and 33234/12).

 

In 2011 and 2012, complainants were assisted in preparing applications. Subsequently, the applications were communicated to Lithuania and Romania, respectively.

 

In the case, the applicants were successfully considered for inhuman treatment during their detention, torture against them, their secret detention and isolation from the outside world. In the case of violations of the requirements of articles 2, 3, 5, clause 1 of article 6, articles 8, 13, 46 of the Convention for the Protection of Human Rights and Fundamental Freedoms, article 1 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

THE CIRCUMSTANCES OF THE CASE

 


The applicants were detained by employees of the Central Intelligence Agency (hereinafter - the CIA) of the United States of America as part of the "fight against terrorism", which began after the attacks of September 11, 2001. After the applicants were transferred in accordance with the "emergency extradition" procedure, they were kept in secret CIA offices in various countries . As “prisoners of special importance” (HVD), that is, terrorists suspected of “reporting information about possible terrorist threats in the United States of America”, the applicants were subjected to “enhanced interrogation techniques”, which included “imitating drowning” ", the content in the box, deprivation of sleep and food, content at low temperatures, standing against the wall and content in other stressful situations. The complainant Al Nashiri was also subjected to “unauthorized” interrogation techniques, such as imitation of execution and hanging upside down.

 

The circumstances of the “extraordinary extradition” of the complainants have been the subject of numerous reports and investigations, including the report of journalist Dick Marty, prepared by him in connection with the investigation by the Parliamentary Assembly of the Council of Europe, and the 2014 report of the United States Senate on torture.

 

In its judgments of July 24, 2014, the European Court found a number of violations of the Convention in connection with the applicants' detention without the right to communicate with the outside world while in Poland under CIA jurisdiction (complaints No. 7511/13 and 28761/11). This refers to the European Court of Hussein (Abu Zubeida) v. Poland case (Husayn (Abu Zubaydah) v. Poland) of July 24, 2014, complaint No. 7511/13, and the European Court of Justice in the case of Al Nashiri Of Poland "(Al Nashiri v. Poland) of July 24, 2014, complaint No. 28761/11.

 

In these complaints, the complainants appealed that the authorities of the respondent states allowed the CIA officers to subject the applicants in their territories to detention without the right to communicate with the outside world, as well as to torture and subsequently allow the applicants to be transported to other institutions under CIA jurisdiction in other countries.

 

Both applicants are currently detained at the United States Naval Base in Guantanamo. The applicant, Hussein, also known as Abu Zubeid, was never charged. Al-Nashiri was indicted and brought before a United States military court on charges of crimes punishable by death.

 


QUESTIONS OF LAW

 


Establishment of facts and questions of jurisdiction. The European Court finally established, and without any reasonable doubt, that the authorities of Lithuania and Romania allowed the establishment of detention facilities under the jurisdiction of the United States CIA in their territories, and that the applicants were secretly kept in these institutions for more than one year, and that the authorities of the respondent countries were aware of the nature and objectives of the CIA’s actions in their countries and collaborated with it in the implementation of the program of “prisoners of special importance”, realizing at the same time that, allowing the CIA to contain ü in their territories of persons suspected of terrorism, they exposed the suspects to serious risk of treatment contrary to the requirements of the Convention.

 

The issues complained in the present case related to the “jurisdiction” of the Lithuanian authorities (in relation to the applicant Abu Zubeid) and Romania (in relation to the applicant Al Nashiri) within the meaning of Article 1 of the Convention and could entail the responsibility of the respondent states of the Convention.

 

Regarding compliance with Article 5 of the Convention (substantive aspect). The European Court found beyond reasonable doubt that, while the applicants were detained in Lithuania and Romania, they were respectively detained, like other prisoners under CIA jurisdiction, in a regime that included (as a predictable daily routine) tying up prisoners' eyes or donning bag them in the head to disorient them and prevent them from knowing the location of the institution or its scheme, shaving their hair upon arrival at the institution, keeping them in solitary cells without the possibility of contact with external they world constant and deliberate use in chambers of different noise levels of high intensity, continuous lighting in the cells of the same intensity as in the ordinary office, the use of the leg shackles in all cases manipulation of prisoners and move them.

 

Although the applicants were not interrogated using the most brutal methods, they were subjected to extremely strict detention in Lithuania and Romania, including almost complete sensory isolation from the outside world, and suffered from constant emotional and psychological stress and experiences caused by past cruel torture side of the CIA, as well as constantly feared for their future. Consequently, taking into account the regime of the applicants' detention and its cumulative effect on the applicants, the complained complaint should have been characterized as severe physical and psychological suffering, falling within the definition of “inhuman treatment”. Therefore, the authorities of Lithuania and Romania, in connection with their “acceptance” of the program of “special prisoners” and “connivance” of this program, should be held responsible for the violation of the applicants' rights guaranteed in Article 3 of the Convention committed in the territory of these states.

 

By allowing the CIA to transfer claimants from Lithuania and Romania respectively to other places of detention, the authorities of the respondent states exposed the applicants to a perceived serious risk of further ill-treatment and conditions of detention in violation of Article 3 of the Convention.

 


RESOLUTION

 


The case was a violation of Article 3 of the Convention (adopted unanimously).

 

The European Court also unanimously found violations:

 

(a) by the Romanian authorities:

 

- Articles 2 and 3 of the Convention in conjunction with Article 1 of Protocol No. 1 to the Convention;

 

- Article 6 § 1 of the Convention in connection with the transfer of the complainant Al Nashiri from the territory of Romania, despite the real and foreseeable risk that the applicant could face a direct denial of justice and be executed after his case was examined by a military commission in the United States of America;

 

(b) by the authorities of Lithuania and Romania:

 

- the procedural component of Article 3 of the Convention in connection with the inability to conduct an effective and thorough investigation of the applicants' complaints of ill-treatment during their detention in CIA institutions;

 

- Article 5 of the Convention due to the secret detention of the applicants in the territory of the respondent states and their subsequent transfer to other CIA institutions in third states;

 

- Article 8 of the Convention, since the interference with the applicants' right to respect for their private and family life did not comply with the law and was not justified, given the use of unlawful, secret detention;

 

- Article 13 of the Convention in connection with the absence of an effective legal remedy to appeal against the violation of the applicants' rights.

 

Regarding compliance with Article 46 of the Convention. (a) Investigation. The authorities of both respondent states are obliged to resume and investigate on the merits as soon as possible the criminal cases concerning complaints about the circumstances and conditions under which the applicants were taken to the territories of the respondent states and taken out of them, as well as in which the applicants were located in the said territories and, if appropriate, punish the guilty.

 

(b) Diplomatic actions. The Lithuanian authorities are obliged to send further requests to the United States authorities to eliminate or at least limit the consequences of violations of the rights of the applicant Abu Zubeid. Since the outcome of the trial of Al Nashiri’s case is still unclear, the Romanian authorities should request from the authorities of the United States of America to obtain assurances that the applicant will not be executed.

 


COMPENSATION

 


In application of Article 41 of the Convention. The Court awarded each of the applicants EUR 100,000 in respect of non-pecuniary damage.
