Постановление ЕСПЧ от 23 октября 2018 года по делу "Бицаева и другие (Bitsayeva and Others) против Российской Федерации" (жалобы N 14196/08, 62409/10, 12868/11, 34290/11, 41877/11, 44311/11, 62172/11, 13843/12, 13909/12 и 32554/12).

По делу успешно рассмотрены жалобы заявителей на то, что их близкие родственники исчезли после того, как они предположительно были незаконно задержаны в ходе проведения специальной операции, на непроведение эффективного расследования этих обстоятельств. По делу допущено нарушение требований статей 2, 3, пункта 1 статьи 5, статьи 13 Конвенции о защите прав человека и основных свобод.

В 2008, 2010, 2011 и 2012 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

В своих жалобах Заявители (30 человек) жаловались на то, что их близкие родственники исчезли после того, как они предположительно были незаконно задержаны в ходе проведения специальной операции. Заявители также утверждали, что не было проведено эффективного расследования этих обстоятельств.

23 октября 2018 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 2 (право на жизнь) в ее материальном и процессуальном аспектах и 3 Конвенции (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) во взаимосвязи со статьей 2 Конвенции. Заявителям по каждой жалобе были присуждены 60 000 евро в качестве компенсации морального вреда (в одном случае - 120 000 евро), отдельным заявителям также была присуждена компенсация материального ущерба.

The case was a violation of the requirements of articles 2, 3, clause 1 of article 5, article 13 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2008, 2010, 2011 and 2012, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.

In their applications, the applicants (30 people) complained that their close relatives had disappeared after they were allegedly illegally detained during the special operation. The applicants also submitted that no effective investigation had been carried out into these circumstances.

On 23 October 2018, on applications filed by the applicants, the European Court unanimously decided that in the present case the authorities violated the requirements of articles 2 (right to life) in its substantive and procedural aspects and 3 of the Convention (prohibition of torture), article 5, paragraph 1 of the Convention (right to liberty and security of person), Article 13 of the Convention (right to an effective domestic remedy) in conjunction with Article 2 of the Convention. The applicants for each complaint were awarded 60,000 euros in respect of non-pecuniary damage (in one case 120,000 euros), individual applicants were also awarded compensation for pecuniary damage.

Постановление ЕСПЧ от 23 октября 2018 года по делу "Мананников (Manannikov) против Российской Федерации" (жалоба N 74253/17).

 

По делу успешно рассмотрена жалоба заявителя на то, что его принудительное помещение в больницу для проведения психиатрической экспертизы и запрет выезжать из города на все время уголовного производства по делу нарушало его права на свободу, а также на то, что изъятие его компьютера в рамках производства по делу и отклонение ходатайства сделать копии необходимых документов являлось нарушением статьи 1 Протокола N 1 к Конвенции о защите прав человека и основных свобод. По делу допущено нарушение требований пункта 1 статьи 5 Конвенции о защите прав человека и основных свобод, статьи 1 Протокола N 1 к Конвенции и статьи 2 Протокола N 4 к Конвенции.

 

В 2017 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

В своей жалобе Заявитель, обвинявшийся в совершении двух преступлений (в оскорблении представителя власти и неуважении к суду), жаловался на то, что его принудительное помещение в больницу для проведения психиатрической экспертизы и запрет выезжать из г. Новосибирска на все время уголовного производства по делу нарушали его права на свободу. Он также указывал на то, что изъятие его компьютера в рамках производства по делу и отклонение ходатайства сделать копии необходимых документов являлось нарушением статьи 1 Протокола N 1 к Конвенции.

 

23 октября 2018 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 1 Протокола N 1 к Конвенции (защита собственности), статьи 2 Протокола N 4 к Конвенции (право на свободу передвижения), и обязал государство-ответчика выплатить заявителю 10 000 евро в качестве компенсации морального вреда.

In 2017, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

 

In his application, the applicant, who was accused of having committed two crimes (insulting a representative of the authorities and contempt of court), complained that his compulsory placement in a hospital for a psychiatric examination and the prohibition to leave the city of Novosibirsk for the entire time of the criminal proceedings in the case his rights to freedom. He also pointed out that the removal of his computer in the framework of the proceedings and the rejection of the request to make copies of the necessary documents was a violation of Article 1 of Protocol No. 1 to the Convention.

 

On 23 October 2018, on the application filed by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirements of Article 5 § 1 (right to liberty and security of person), Article 1 of Protocol No. 1 to the Convention (protection of property), Article 2 of Protocol No. 4 to the Convention (the right to freedom of movement), and ordered the respondent State to pay the applicant 10,000 euros in compensation for non-pecuniary damage.

По делу успешно рассмотрены жалобы заявителей на то, что в случае их депортации в страны их происхождения они подвергнутся обращению, противоречащему статье 3 Конвенции о защите прав человека и основных свобод. По делу будет иметь место нарушение статьи 3 Конвенции о защите прав человека и основных свобод в случае высылки/экстрадиции троих заявителей.

 

В 2016 и 2017 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах Заявители (четыре человека, граждане Таджикистана или Узбекистана) жаловались на то, что в случае их депортации в страны их происхождения они подвергнутся обращению, противоречащему статьи 3 Конвенции.

 

23 октября 2018 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в случае высылки/экстрадиции троих заявителей будет иметь место нарушение статьи 3 Конвенции (запрещение пыток). Европейский Суд решил, что установление факта нарушения Конвенции само по себе является достаточной формой компенсации.

In their applications, the applicants (four people, citizens of Tajikistan or Uzbekistan) complained that if they were deported to their countries of origin, they would be subjected to treatment contrary to Article 3 of the Convention.

 

On 23 October 2018, on applications filed by the applicants, the European Court unanimously decided that in the event of the expulsion / extradition of the three applicants, there would be a violation of Article 3 of the Convention (prohibition of torture). The European Court decided that the finding of a violation of the Convention is in itself a sufficient form of compensation.

По делу успешно рассмотрены жалобы заявителей на то, что их близкие родственники исчезли после того, как они предположительно были незаконно задержаны в ходе проведения специальной операции, при этом эффективного расследования данных обстоятельств не было проведено. По делу допущены нарушения требований статей 2 и 3, пункта 1 статьи 5, статьи 13 во взаимосвязи со статьей 2 Конвенции о защите прав человека и основных свобод.

 

В 2008, 2009, 2010, 2011 и 2012 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах Заявители (35 человек) жаловались на то, что их близкие родственники исчезли после того, как они предположительно были незаконно задержаны в ходе проведения специальной операции. Заявители также утверждали, что не было проведено эффективного расследования этих обстоятельств.

 

23 октября 2018 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 2 (право на жизнь) в ее материальном и процессуальном аспекте и 3 Конвенции (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) во взаимосвязи со статьей 2 Конвенции. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод, статьи 1 Протокола N 1 к Конвенции о защите прав человека и основных свобод.

 

В 2006, 2008 и 2012 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах Заявители (три человека) жаловались на неисполнение судебных решений, вынесенных в их пользу, или на задержку в их исполнении, а также на отсутствие эффективных средств правовой защиты в связи с этими обстоятельствами.

 

18 октября 2018 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство), статьи 1 Протокола N 1 к Конвенции (защита собственности), и обязал государство-ответчика выплатить первому заявителю 6 000 евро в качестве компенсации морального вреда. Поскольку другие заявители не представили требований о выплате компенсации, Европейский Суд не присудил им каких-либо сумм по данному основанию.

The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms, Article 1 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In 2006, 2008 and 2012, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.

 

In their applications, the applicants (three people) complained about the failure to execute court decisions in their favor, or about the delay in their execution, as well as about the lack of effective remedies in connection with these circumstances.

 

On 18 October 2018, on applications filed by the applicants, the European Court unanimously decided that in the present case the authorities violated the requirements of Article 6 § 1 of the Convention (right to a fair trial), Article 1 of Protocol No. 1 to the Convention (protection of property), and ordered the respondent State to pay the first applicant EUR 6,000 in respect of non-pecuniary damage. As the other applicants did not submit any claims for compensation, the Court did not award them any amounts under this heading.
