Hotărârea CtEDO din 03 octombrie 2017 în cauza "D.M.D. (D.M.D.) împotriva României" (plângerea nr. 23022/13).

În 2013, solicitantul a fost asistat la pregătirea plângerii. Ulterior, plângerea a fost comunicată României.
Cazul a fost considerat cu succes o plângere privind lungimea excesivă a anchetei și a procesului de violență în familie împotriva unui copil minor, alte deficiențe în cursul investigației și procesului. Cazul a implicat încălcarea cerințelor articolelor 3 și 6 din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale.

 

CIRCUMSTANȚELE CAUZEI


Reclamantul sa născut în 2001. În februarie 2004, mama sa a cerut agenției de protecție a copilului să notifice că fiul ei a fost supus violenței domestice de către soțul ei, tatăl copilului. Din martie până în iulie 2004, ea sa plâns de poliție încă cinci ori. După cea de-a cincea plângere, autoritățile au demarat un proces penal. ASPECTE ALE LEGII


Cu privire la respectarea articolului 3 al Convenției (aspect procedural). Curtea reamintește că statele ar trebui să depună eforturi pentru a proteja demnitatea copiilor în mod clar și cuprinzător. DECIZIE


A fost încălcat articolul 3 al Convenției (în unanimitate).

Curtea a luat în considerare faptul că în conformitate cu legea română (articolul 17 din Codul de procedură penală), instanțele naționale sunt obligate să ia în considerare problema de compensare, în cazurile în care victima este un minor, și, prin urmare, incapabile, chiar și în absența unor cerințe formale ale victimei. DECIZIE


A avut loc o violare a articolului 6 al Convenției (patru voturi pentru, trei contra).

De asemenea, Curtea în unanimitate, a constatat că, având în vedere concluzia că încălcarea procedurală a articolului 3 al Convenției, nu este necesar să se examineze separat plângerea reclamantului o încălcare a articolului 6 § 1 din Convenție.


COMPENSARE

The ECHR judgment of 03 October 2017 in the case "D.M.D. (D.M.D.) v. Romania" (аpplication No. 23022/13).

In 2013, the applicant was assisted in preparing the аpplication. Subsequently, the аpplication was communicated to Romania. The case was successfully considered a complaint about the excessive length of the investigation and trial of domestic violence against a minor child, other shortcomings in the course of the investigation and trial. The case involved violation of the requirements of articles 3 and 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

CIRCUMSTANCES OF THE CASE


The applicant was born in 2001. In February 2004, his mother asked the child protection agency to report that her son was subjected to domestic violence by her husband, the father of the child. From March to July 2004, she complained to the police five more times. After the fifth complaint, the authorities started a criminal trial. The prosecutor's office heard the testimony of six witnesses, examined psychological conclusions, and as a result, the applicant's father was charged in December 2007.

The case was examined in three instances. The applicant's father was first acquitted, since the courts decided that his "periodically inadequate behavior" in relation to his son was not a crime. However, after several transmissions of the case in connection with various shortcomings in the decisions of lower courts, the district court finally found the applicant's father guilty of physical and verbal violence against his son in April 2012, finding that the applicant's father's actions were more serious than " single or accidental "violence that can occur if parents simply punish their children.

The trial ended in November 2012 after the filing of cassation complaints by both parties. The Court of Appeal confirmed that the father used violence against his child and sentenced him to a suspended prison term that was reduced due to the excessive length of the trial. The applicant and the prosecutor complained that the applicant was not awarded any compensation. However, the appellate court ruled that he could not consider the issue of compensation, since neither the applicant nor the prosecutor requested her to pay in lower courts.


ISSUES OF LAW


Concerning compliance with Article 3 of the Convention (procedural aspect). The Court recalls that States should strive to protect children's dignity clearly and comprehensively. This, in turn, requires in practice the existence of an appropriate legal framework providing for the protection of children from domestic violence, including (a) effective deterrence from such serious violations of personal integrity, (b) taking reasonable steps to prevent ill-treatment known to the authorities or should know, and (c) conduct an adequate official investigation if the person submits a provable allegation of ill-treatment.

An essential goal pursued by the investigation of allegations of domestic violence in the applicant's case could be considered achieved if the person responsible for the violence (father) was subsequently convicted and sentenced to imprisonment. However, despite this, the investigation should have been considered ineffective, since it lasted too long and was characterized by serious shortcomings.

(a) Duration of the investigation. The authorities first learned about the applicant's situation in February 2004, when his mother informed the child protection agency of domestic violence. However, there was no indication that something specific had been done to verify this information, its transfer to the police or the protection of the victims. The authorities did not take any action with respect to the first four applications for criminal proceedings filed by the mother against the applicant's father from March to June 2004. When the investigation finally began in July 2004, it lasted almost three years and six months. In total, due to significant periods of inactivity on the part of investigators and the Institute of Forensic Medicine, a number of canceled decisions, owing to omissions of lower courts, the proceedings continued for eight years and four months in three instances. This period of investigation was excessive.

(b) Disadvantages of the investigation. There were obviously several shortcomings in the proceedings: (i) Unlike the father whose punishment was reduced, the applicant was not afforded any form of compensation for the excessive length of the case, (ii) the applicant did not receive compensation for the violence to which he was subjected ( (iii) The approach of domestic courts to the issue of domestic violence, which presumably implies that "isolated and incidental" acts of domestic violence can be tolerated, incompatible with domestic law or with the Convention, which prohibit ill-treatment, including corporal punishment. Indeed, any form of justification for child abuse, including corporal punishment, detracts from respect for children's dignity.

For the foregoing reasons, taking into account the importance of the case to the applicant, the length and speed of the procedure, the difference in treatment between the applicant and the offender in respect of this duration, and the manner in which the courts dealt with the issue of domestic violence, the Court concluded that the investigation into allegations of ill-treatment was ineffective.

 

DECISION


There has been a violation of Article 3 of the Convention (unanimously).

Concerning compliance with article 6, paragraph 1, of the Convention (fair trial). The Court observes that under Romanian law (article 17 of the Code of Criminal Procedure), domestic courts are required to consider compensation in cases in which the victim was a minor and therefore incompetent, even in the absence of a formal claim of the victim. Courts and the prosecutor had to actively seek information from the victim about the extent of the damage caused. Consequently, the legislation provided enhanced protection to vulnerable persons, such as the applicant, by imposing on the authorities an expanded duty to take an active role in this regard. For this reason, and in the light of the subject matter of the investigation, the proceedings went beyond the mere dispute between private persons and therefore included the responsibility of the State in accordance with article 6, paragraph 1, of the Convention.

In view of this ambiguous formulation of domestic legislation, the appellate court should have examined the merits of the applicant's complaint about evading compensation. Instead, he limited himself to pointing out that neither the prosecutor nor the applicant requested compensation in the lower courts and therefore did not consider the role of the courts of the country or the prosecutor in ensuring the best interests of the applicant. This circumstance amounted to a denial of justice in violation of Article 6 § 1 of the Convention.


DECISION


There has been a violation of Article 6 of the Convention (four votes in favor, three against).

The Court also unanimously found that, in view of its finding of a procedural violation of Article 3 of the Convention, there is no need to examine separately the applicant's complaint under Article 6 § 1 of the Convention.


COMPENSATION


In the application of Article 41 of the Convention. The Court awarded EUR 10,000 in respect of non-pecuniary damage to the applicant.

Hotărârea CEDO din 03 octombrie 2017 privind cazul "Alexandru Enache (împotriva lui Alexandru Enache) împotriva României" (plângerea nr. 16986/12).

 

În anul 2012, reclamantul a fost asistat la pregătirea plângerii. Ulterior, plângerea a fost comunicată României.
În acest caz, reclamantul sa plâns cu succes că legislația României, care permite suspendarea executării unei pedepse cu închisoarea, se aplică mamei copiilor de vârstă mică, dar nu părinților. CIRCUMSTANȚELE CAUZEI

ASPECTE ALE LEGII

 


Cu privire la respectarea articolului 14 al Convenției coroborat cu articolul 8 al Convenției. (a) Situația reclamantului a fost comparabilă cu situația unui deținut care are un copil sub vârsta de un an. Legea penală din România în vigoare în perioada relevantă pentru circumstanțele cazului prevedea că toți prizonierii, indiferent de sex, aveau alte posibilități de a cere suspendarea executării pedepsei. De exemplu, tribunalele din țară ar putea lua în considerare existența unor circumstanțe speciale care să însoțească executarea pedepsei, care ar putea avea consecințe grave atât pentru deținut însuși, cât și pentru familia sau angajatorul său. Reclamantul a recurs la această cale de atac, dar dificultățile pe care le-a menționat nu aparțineau categoriei de circumstanțe speciale prevăzute de lege.

CIRCUMSTANCES OF THE CASE

 


The applicant, who was sentenced to seven years in prison, filed two motions to suspend the execution of the sentence. He, in particular, claimed that he wanted to take care of his child, who was only a few months old. However, his applications were rejected by the courts on the grounds that the suspension of performance provided for in subparagraph (b) of paragraph 1 of article 453 of the former Code of Criminal Procedure for convicted mothers should be interpreted literally until the first birthday of the child and that the applicant can not claim its application for analogy.

 


ISSUES OF LAW

 


Concerning compliance with Article 14 of the Convention in conjunction with Article 8 of the Convention. (a) Was the situation of the applicant comparable to the situation of a prisoner having a child under the age of one year. According to Romanian law, there was a difference in treatment between two categories of prisoners who had children under the age of one year: on the one hand, by women who could be suspended, and, on the other hand, by men who were not entitled to such suspension . The introduction of the suspension of the execution of sentences in the form of deprivation of liberty was originally aimed at ensuring the best interests of these children in order to receive adequate attention and care in the first year of their life. However, such attention and care could be provided by the mother or father, despite the possible differences in their relationship with children. In addition, the right to suspend the execution was valid until the first birthday of the child and, thus, extended to the period after the mother's pregnancy and the birth itself. So, the applicant could argue that he was in a similar situation with respect to female prisoners.

 

(b) Whether the difference in treatment was objectively justified. Female prisoners did not receive the right to suspend the execution of punishment automatically. The domestic courts conducted a detailed examination of the applications and dismissed them when the applicant's personal situation did not justify the suspension of the execution of the sentence.

 

The Romanian criminal law in force during the period relevant to the circumstances of the case provided that all prisoners, irrespective of sex, had other possibilities for demanding suspension of the execution of punishment. For example, the courts of the country could consider whether there were special circumstances accompanying the execution of the punishment, which could have serious consequences for the prisoner himself, as well as for his family or employer. The applicant availed himself of this remedy, but the difficulties mentioned by him did not belong to the category of special circumstances set forth in the law.

 

Indeed, the modern movement towards gender equality is the main goal in the member states of the Council of Europe, and only very indisputable considerations may force such a differentiated treatment to be compatible with the Convention. The purpose of these legal provisions is to take into account specific personal situations, including pregnancy and the first year of life of the child, taking into account, in particular, the special links between mother and child in this period. In a specific area relevant to the present case, these considerations may provide a sufficient basis for differentiated treatment of the applicant. Maternity has specific features that should be taken into account, often through the adoption of protective equipment. International law provides that the adoption by States of special measures to protect mothers and mothers should not be considered as discrimination. A similar situation applies when a woman is sentenced to imprisonment.

 

In the light of the above considerations and given the wide margin of appreciation available to the respondent State authorities in this area, there is a reasonable proportional relationship between the funds used and the legitimate aim pursued. The impugned exception, therefore, does not constitute a distinction in treatment prohibited under article 14 in conjunction with article 8 of the Convention.

 


DECISION

 


On the case, the requirements of Article 14 of the Convention were not violated (taken by five votes "for" with two - "against").

 

The Court also found a violation of the requirements of Article 3 of the Convention in connection with the conditions of the applicant's detention.

 


COMPENSATION

 


In the application of Article 41 of the Convention. The Court awarded EUR 4,500 in respect of non-pecuniary damage to the applicant, the claim for pecuniary damage was rejected.

La sentencia del TEDH de 03 de octubre de 2017 en el caso de N.D. y N.T. (N.D. y N.T.) v. España (demandas Nos. 8675/15 y 8697/15).

 

En 2015, los solicitantes fueron asistidos en la preparación de demandas. Posteriormente, las demandas se fusionaron y se comunicaron a España. En el caso, los solicitantes se quejaron con éxito de su expulsión inmediata al territorio del país vecino después de que treparon las vallas fronterizas. CIRCUNSTANCIAS DEL CASO

 


En agosto de 2014 un grupo de unos 80 migrantes que vienen de países de África subsahariana, incluidos los solicitantes, intentado entrar en España a través de la cerca alrededor de la ciudad de Melilla, un enclave español en la costa norte de África. Después de superar los obstáculos que fueron detenidos por la Guardia Civil, que les esposado y volvió a la cara externa de la frontera sin procedimiento de identificación o la posibilidad de explicar su situación personal. Contra los solicitantes que pudieron regresar ilegalmente a España, se emitieron órdenes de expulsión. Sus quejas administrativas y una solicitud de asilo, presentada por uno de ellos, fueron rechazadas.

 


CUESTIONES DE DERECHO

 


(a) Jurisdicción del Gobierno del Estado demandado (artículo 1 de la Convención). Es indiferente que los obstáculos, que superaron los solicitantes, en España o en Marruecos fueron: desde el momento en que los solicitantes abajo a estas barreras, que estaban bajo el control de facto continua y exclusiva de las autoridades españolas. Las conjeturas sobre los poderes, las funciones y las acciones de las fuerzas de seguridad españolas o la naturaleza y el propósito de su intervención no podían conducir a ninguna otra conclusión. En consecuencia, no cabía duda de que los hechos alegados estaban bajo la jurisdicción de las autoridades españolas en el sentido del artículo 1 del Convenio.

 

(b) Admisibilidad. (i) Estado de la víctima (Artículo 34 de la Convención). (alfa) Evidencia. El Tribunal rechazó las dudas del Gobierno del Gobierno demandado sobre si los solicitantes eran efectivamente parte de este grupo de migrantes:

 

- los solicitantes presentaron una versión coherente de las circunstancias de sus países de origen y las dificultades que les llevaron a un campamento temporal en el monte Gurugú (campamento de inmigrantes en el territorio vecino de Marruecos), y su participación, junto con otros trabajadores en un intento de superar la valla que rodea el paso fronterizo de Beni Enzar 13 de agosto de 2014, con el objetivo de penetrar el territorio de España; presentaron videos que parecen auténticos;

 

- las autoridades del Estado demandado no niegan el hecho de las expulsiones en una forma simplificada. Poco después de estos eventos, incluso hicieron cambios en la Ley Institucional sobre los Derechos y Libertades de los Ciudadanos Extranjeros con el objetivo de legalizar estas "deportaciones en el lugar". En cualquier caso, no pudieron invocar el hecho de que los solicitantes no fueron identificados, ya que ellos mismos son responsables de esta circunstancia.

 

(beta) sin daños El hecho de que los solicitantes podrían posteriormente entrar en el territorio de España, en otros aspectos, no se priva de su condición de víctima, ya que estas alegaciones no fueron considerados durante los procedimientos posteriores.

 


SOLUCIÓN

 


La excepción preliminar del Gobierno del Estado demandado fue rechazada (adoptada por unanimidad).

 

(ii) Agotamiento de los recursos internos (artículo 35 de la Convención). Es irrelevante que los solicitantes no hayan presentado ante el tribunal quejas sobre las órdenes de deportación emitidas contra ellos después de su reingreso a España. Estas órdenes fueron emitidas después de los hechos de la queja denunciados, que se refieren únicamente a la expulsión colectiva después de los hechos del 13 de agosto de 2014.

 


DECISIÓN

 


La excepción preliminar fue rechazada por las autoridades del Estado demandado (adoptado por unanimidad).

 

(c) Fondo. Respecto del cumplimiento del Artículo 4 del Protocolo No. 4 al Convenio. La cuestión de la aplicabilidad de esta disposición se pospuso hasta que se examinaron los méritos de la queja.

 

(i) "Expulsión". No era necesario en este momento determinar si los solicitantes fueron deportados después de haber penetrado en el territorio de España o si habían sido devueltos antes de que pudieran hacerlo. Incluso intercepciones en alta mar dentro del alcance del artículo 4 del Protocolo N 4 de la Convención (ver. La sentencia del Tribunal Europeo en el caso "Hirsi Jamaa y otros v Italia" (Hirsi Jamaa y otros v. Italia) el 23 de febrero de 2012, la queja N 27765/09 (Boletín del Tribunal Europeo de Derechos Humanos, 2012. N 8)). Es bastante lógico que lo mismo se aplique a la negativa a otorgar permiso para ingresar al territorio del estado a personas que llegaron ilegalmente por tierra. Contra su voluntad, los solicitantes, que estaban bajo el control continuo y exclusivo de las autoridades españolas, fueron enviados a Marruecos.

 

(ii) "Carácter colectivo". Los solicitantes fueron sometidos a una medida de carácter general, que consiste en contener y repeler los intentos de los migrantes de cruzar ilegalmente la frontera. Las medidas de expulsión se adoptaron sin decisión administrativa o judicial previa. Los solicitantes no fueron sometidos a ningún procedimiento de identificación. A falta de consideración de las situaciones individuales de los solicitantes, su expulsión debe considerarse de naturaleza colectiva.

 


DECISIÓN

 


Ha habido una violación del Artículo 4 del Protocolo No. 4 (por unanimidad).

 

La Corte también determinó por unanimidad que se había violado el artículo 13 de la Convención en relación con el artículo 4 del Protocolo Nº 4 de la Convención.

 

 

 

COMPENSACIÓN

 


En la aplicación del artículo 41 de la Convención. El Tribunal concedió a cada demandante 5.000 euros (EUR) en concepto de daños inmateriales.

The ECHR judgment of 03 October 2017 in the case of N.D. and N.T. (N.D. and N.T.) v. Spain (applications Nos. 8675/15 and 8697/15).

In 2015, the applicants were assisted in the preparation of applications. Subsequently, applications were merged and communicated to Spain. In the case, the applicants successfully complained about their immediate expulsion to the territory of the neighboring country after they climbed over the border fences. The case involved violation of the requirements of Article 13 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Article 4 of Protocol No. 4 to the Convention.

 

 

 

CIRCUMSTANCES OF THE CASE

 


In August 2014, a group of about 80 migrants from sub-Saharan countries, including the applicants, attempted to enter Spain through fences around Melilla, a Spanish enclave on the North African coast. After overcoming the obstacles, they were detained by members of the Civil Guard, who handcuffed them and returned them to the outside of the border without a procedure of identification or the possibility of clarifying their personal situation. Against those applicants who were able to return illegally to Spain, orders for expulsion were issued. Their administrative complaints and an application for asylum, filed by one of them, were rejected.

 


ISSUES OF LAW

 


(a) Jurisdiction of the Government of the respondent State (article 1 of the Convention). It is irrelevant whether there were obstacles that the applicants overcame in Spain or Morocco: from the time when the applicants had descended from these obstacles, they were under continuous and exclusive factual control of the Spanish authorities. Guesses about the powers, functions and actions of the Spanish security forces or nature and the purpose of their intervention could not lead to any other conclusion. Consequently, there was no doubt that the alleged facts were within the jurisdiction of the Spanish authorities within the meaning of Article 1 of the Convention.

 

(b) Admissibility. (i) Status of the victim (Article 34 of the Convention). (alpha) Evidence. The Court rejected the doubts of the Government of the respondent Government as to whether the applicants were indeed part of this group of migrants:

 

- The applicants presented a coherent version of the circumstances, their countries of origin and difficulties that led them to the temporary camp on Mount Gurugu (the migrant camp in neighboring Morocco) and their participation together with other migrants in an attempt to move through the barriers surrounding the Beni-Enzar border crossing August 13, 2014, with the aim of penetrating the territory of Spain; they presented videos that look authentic;

 

- the authorities of the respondent State did not deny the fact of expulsions in a simplified form. Soon after these events, they even made changes to the Institutional Law on the Rights and Freedoms of Foreign Citizens with a view to legalizing these "deportations on the spot." In any case, they could not invoke the fact that the applicants were not identified, since they themselves are responsible for this circumstance.

 

(beta) No damage. The fact that the applicants could subsequently enter Spain by other means did not deprive them of the status of victims of a violation of the Convention, since these allegations were not the subject of further investigation.

 


DECISION

 


The preliminary objection of the Government of the respondent State was rejected (adopted unanimously).

 

(ii) Exhaustion of domestic remedies (Article 35 of the Convention). It is irrelevant that the applicants did not apply to the court with complaints about the deportation orders issued against them after re-entry to Spain. These orders were issued after the facts of the complaint complained of, which concern only collective expulsion after the events of August 13, 2014.

 


DECISION

 


The preliminary objection was rejected by the authorities of the respondent State (unanimously adopted).

 

(c) Merits. Concerning compliance with Article 4 of Protocol No. 4 to the Convention. The issue of the applicability of this provision was postponed until the merits of the complaint were examined.

 

(i) "Expulsion". It was not necessary at this time to determine whether the applicants were deported after they had penetrated the territory of Spain or whether they had been returned before they were able to do so. Even interceptions on the high seas fall within the scope of Article 4 of Protocol No. 4 to the Convention (see Hirsi Jamaa and Others v. Italy, judgment of 23 February 2012, complaint No. 27765/09 (Bulletin of the European Court of Human Rights, 2012. N 8)). It is quite logical that the same applies to refusal to grant permission to enter the territory of the state to persons who illegally arrived by land. Against their will, the applicants, who were under the continuous and exclusive control of the Spanish authorities, were sent to Morocco.

 

(ii) "Collective character". The applicants were subjected to a measure of a general nature, consisting in containing and repelling attempts by migrants to illegally cross the border. The measures of expulsion were adopted without any preliminary administrative or judicial decision. The applicants were not subjected to any identification procedure. In the absence of consideration of individual situations of applicants, their expulsion should be considered as collective in nature.

 


DECISION

 


There has been a violation of Article 4 of Protocol No. 4 (unanimously).

 

The Court also unanimously found that there had been a violation of Article 13 of the Convention in conjunction with Article 4 of Protocol No. 4 to the Convention.

 

 

 

COMPENSATION

 


In the application of Article 41 of the Convention. The Court awarded each applicant 5,000 euros (EUR) in respect of non-pecuniary damage.
