L'arrêt de la Cour EDH du 11 juillet 2017 dans l'affaire Dakir c. Belgique (requête n ° 4619/12) et l'arrêt de la Cour EDH du 11 juillet 2017 "Beljacemi et Oussar c. Belgique" (requête n ° 37798/13) ).

En 2012 et 2013, les requérants ont été assistés dans la préparation des requêtes. Par la suite, les requêtes s ont été communiquées à la Belgique.

En l'espèce, les griefs des requérants concernant l'interdiction de porter des vêtements couvrant une personne dans un lieu public ont été examinés avec succès. Il n'y a pas eu violation de l'article 8 de la Convention de sauvegarde des Droits de l'Homme et des Libertés fondamentales.

 

CIRCONSTANCES DE L'ESPÈCE


Les requérants dans la présente affaire sont des femmes musulmanes qui se sont plaintes de les gêner dans le port de vêtements couvrant leurs visages. La loi du 1er juin 2011 prévoit une sanction sous la forme d'une amende et / ou d'une peine d'emprisonnement (de 200 euros ou sept jours respectivement) pour avoir dissimulé une personne dans des lieux publics. Des interdictions similaires dans le passé ont déjà été introduites par certaines municipalités. Le requérant a tenté de renverser l'un des actes municipaux contestés du Conseil d'Etat (le cas Dakir) Loi 2011 ou la Cour constitutionnelle (cas Beldzhadzhemi et Ussar).


QUESTIONS DE DROIT


Concernant le respect des articles 8 et 9 de la Convention. a) La base juridique et la qualité de la loi. Quant à l'acte municipal dans l'affaire Dakir, le requérant n'a pas contesté la validité de son cadre juridique et a adressé ses critiques à la loi, qui a ensuite été mise en œuvre. Quant à la loi du 1er juin 2011, la Cour européenne n'a vu aucun arbitraire dans la motivation de la Cour constitutionnelle de Belgique. En utilisant les mêmes critères, la Cour constitutionnelle a décidé que la loi répondait aux exigences de prévisibilité et d'exactitude, car l'expression «lieux d'accès du public» est interprétée comme n'incluant pas les lieux de culte. En outre, l'interdiction litigieuse est formulée dans des termes très proches de ceux utilisés dans la loi française, considérée dans l'affaire "S.A.S. c. France".

(b) Un objectif légitime. Les objectifs poursuivis par l'acte municipal contesté ou la loi de 2011 incluaient la sécurité publique, l'égalité des genres et un certain concept de «vivre ensemble» dans la société. Comme dans le cas de l'affaire S.S.S. c. France, l'objectif consistant à assurer le respect des conditions minimales requises pour la vie en société pourrait être considéré comme faisant partie de la "protection des droits et libertés d'autrui". En outre, rien n'indique que, dans le contexte belge, une plus grande importance était attachée à l'objectif de l'égalité qu'à d'autres fins.

(c) La nécessité d'une interdiction dans une société démocratique. Dans le cas de Dakir, il n'y avait pas d'arguments spécifiques contre l'acte municipal théoriquement affecté.

Selon les travaux préparatoires de la loi susmentionnée et son analyse de la Cour constitutionnelle des problèmes qui ont provoqué le débat en Belgique, ont été très semblables à celles qui ont provoqué l'adoption de l'interdiction en France, discuté dans le « SAS contre la France » (SAS c. France) (arrêt de la Grande Chambre de la européenne La cour du 1er juillet 2014, plainte no 43835/11 (Bulletin de la Cour européenne des droits de l'homme, 2014. No. 11).

Partant de ce qui précède, la Cour européenne s'est référée à diverses considérations de cette décision et notamment à ce qui suit:

- l'interdiction contestée était le choix de la société, l'équilibre a été établi par le législateur de manière démocratique, ce qui a exigé une certaine retenue de la part de la Cour européenne;

- bien que les limites de l'interdiction litigieuse était large, il ne porte pas atteinte à la liberté du port public de tout vêtement ou parties de vêtements, avec ou sans connotation religieuse qui ne sont pas le résultat de cacher le visage;

- il n'y a toujours pas de consensus entre les Etats membres du Conseil de l'Europe sur cette question, ce qui justifie de leur donner une très large marge d'appréciation.

Certaines des caractéristiques spécifiques alléguées de la situation en Belgique ont été résolues de la manière suivante.

(i) La manière dont la règle est appliquée en cas de violation (Belljamie et Ussar c. Belgique). La législation belge semble différer de la législation française en ce qu'elle prévoit, en plus de l'amende, la possibilité d'appliquer une peine d'emprisonnement. Cependant, la privation de liberté ne peut être appliquée qu'en cas de violation répétée. En outre, les juridictions pénales devaient appliquer la loi conformément au principe de proportionnalité et de la Convention, et la gravité théorique de la peine d'emprisonnement est compensé par le fait qu'il n'a pas été appliquée automatiquement.

En outre, conformément à la loi belge, une infraction consistant à dissimuler une personne dans un lieu public était «mixte», tombant sous le coup du droit pénal et administratif. Dans ce dernier contexte, des mesures alternatives étaient possibles, souvent appliquées dans la pratique au niveau municipal. Dans le reste de l'évaluation spécifique de la proportionnalité des sanctions qui peuvent être appliquées dans le cadre de l'interdiction litigieuse relève de la compétence des juridictions nationales (à l'identité se limitait au rôle de la Cour si l'Etat défendeur a outrepassé les limites de son pouvoir discrétionnaire).

ii) La déclaration selon laquelle le processus démocratique, qui a conduit à l'interdiction en Belgique de porter des vêtements couvrant toute la personne, n'a pas pris en compte toutes les circonstances pertinentes (affaire Dakir). Mis à part le fait que cette critique ne soit pas directement affecté le règlement, et fait référence à la loi le 1er Juin 2011, la Cour a tenu compte du fait que le processus de prise de décision en ce qui concerne l'interdiction litigieuse a duré plusieurs années et a été accompagnée d'un large débat à la Chambre des représentants, ainsi que examen approfondi et approfondi de tous les intérêts par la Cour constitutionnelle. En conclusion, bien que l'interdiction était controversée et créer indéniablement des risques en termes de promotion de la tolérance dans la société, l'interdiction attaquée au regard de la marge d'appréciation accordée aux autorités de l'Etat défendeur pouvait être considérée comme proportionnée au but poursuivi, à savoir la création de conditions pour « vivre ensemble » comme élément "pour protéger les droits et libertés des autres". Cette conclusion vaut pour les articles 8 et 9 de la Convention.


DÉCISION


Les exigences de l'article 8 de la Convention n'ont pas été violées (unanimité).

Selon l'article 14 de la Convention combiné avec les articles 8 et 9 de la Convention. Plainte à la discrimination indirecte a été rejetée parce que la mesure contestée pour les mêmes raisons exposées ci-dessus, avait une justification objective et raisonnable.


DÉCISION


Dans le cas avait pas eu violation de l'article 14 de la Convention (unanimité).

Dans le cas de la Cour Dakir conclut à l'unanimité qu'il y avait eu violation de l'article 6 § 1 de la Convention parce que le demandeur a refusé l'accès à un tribunal en raison de formalisme excessif.

The ECtHR judgment of 11 July 2017 in the Dakir v. Belgium case (application no. 4619/12) and the ECtHR judgment of 11 July 2017 "Beljacemi and Oussar v. Belgium" (application No. 37798/13 ).

In 2012 and 2013, the applicants were assisted in the preparation of applications. Subsequently, applications were communicated to Belgium.

In the case, the applicants' complaints on the prohibition of wearing clothing covering a person in a public place were successfully considered. There was no violation of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

CIRCUMSTANCES OF THE CASE


The applicants in the present case are Muslim women who complained of hindering them in wearing clothes covering their faces. The law of 1 June 2011 provides for punishment in the form of a fine and / or imprisonment (no more than 200 euros or seven days respectively) for concealing a person in public places. Similar bans in the past have already been introduced by certain municipalities. The applicants attempted to obtain the cancellation of one of the contested municipal acts in the State Council (the Dakir case) or the 2011 Law in the Constitutional Court (the Beljajami and Ussar case).


ISSUES OF LAW


Concerning compliance with Articles 8 and 9 of the Convention. (a) The legal basis and quality of the law. As for the municipal act in the Dakir case, the applicant did not dispute the validity of his legal framework, and sent her criticism to the law, which was subsequently put into effect. As for the Law of June 1, 2011, the European Court did not see any arbitrariness in the motivation of the Constitutional Court of Belgium. Using the same criteria, the Constitutional Court decided that the law met the requirements of predictability and accuracy, since the expression "places in which the public has access" is interpreted as not including places of worship. In addition, the contested prohibition is formulated in terms that are very close to those used in the law of France, considered in the case of "S.A.S. v. France".

(b) A legitimate aim. The objectives pursued by the challenged municipal act or the Law of 2011 included public safety, gender equality and a certain concept of "living together" in society. As in the case of S.S.S. v. France, the objective of ensuring compliance with the minimum requirements for life in society could be considered part of the "protection of the rights and freedoms of others." In addition, there was nothing to indicate that in the Belgian context greater importance was attached to the goal of equality than to other purposes.

(c) The need for a ban in a democratic society. In the case of Dakir, there were no specific arguments against the theoretically affected municipal act.

According to the preparatory material for the aforementioned law and its analysis by the Constitutional Court, the problems that sparked the discussion in Belgium were very similar to those that led to the adoption of the prohibition in France, examined in the SAS v. France case (Grand Chamber of Europe The court of July 1, 2014, complaint No. 43835/11 (Bulletin of the European Court of Human Rights, 2014. No. 11).

Proceeding from the above, the European Court referred to various considerations of this decision and especially to the following:

- the impugned ban was the choice of society, the balance was established by the legislator in a democratic way, which required some restraint on the part of the European Court;

- although the scope of the contested ban was broad, it did not affect the freedom to publicly wear any clothes or details of clothing that either did not have religious implication, which did not result in concealment of the face;

- there is still no consensus between the member states of the Council of Europe on this issue, which justifies giving them very wide margin of appreciation.

Some of the alleged specific features of the situation in Belgium were resolved in the following way.
(i) The manner in which the rule is applied in the event of a breach (Belljamie and Ussar v. Belgium). Belgium's legislation appeared to differ from the French one in that it provided, in addition to the fine, the possibility of applying punishment in the form of imprisonment. However, deprivation of liberty could only be applied in case of a repeated violation. In addition, the criminal courts had to apply the law in accordance with the principle of proportionality and the Convention, and the theoretical severity of punishment in the form of deprivation of liberty was balanced by the fact that it was not applied automatically.

In addition, in accordance with Belgian law, an offense in the form of concealing a person in a public place was "mixed", falling within the scope of criminal and administrative law. In the latter context, alternative measures were possible, which were often applied in practice at the municipal level. In the rest, the specific assessment of the proportionality of any punishment that may be imposed in connection with the impugned prohibition was within the competence of the domestic courts (the role of the European Court was limited to verifying whether the authorities of the respondent State had exceeded their discretion).

(ii) The statement that the democratic process, which led to a ban in Belgium on wearing clothing that covers the whole person, did not take into account all the relevant circumstances (the Dakir case). In addition to the fact that this criticism did not directly touch upon this by-law but referred to the Law of June 1, 2011, the Court took into account that the decision-making process for the impugned ban took several years and was accompanied by extensive discussions in the House of Representatives, as well as detailed and thorough consideration of all interests by the Constitutional Court. In conclusion, although the ban was controversial and unreservedly created possible risks in terms of promoting tolerance in society, the contested ban, taking into account the limits of discretion granted to the authorities of the respondent State, could be considered as proportional to the aim pursued, namely, the creation of conditions for "cohabitation" as element "to protect the rights and freedoms of others." This conclusion is true of articles 8 and 9 of the Convention.


DECISION


The requirements of Article 8 of the Convention were not violated (unanimously).

Compliance with Article 14 of the Convention in conjunction with Articles 8 and 9 of the Convention. The complaint of indirect discrimination was rejected, because the controversial measure for the same reasons as stated above had an objective and reasonable justification.


DECISION


The requirements of Article 14 of the Convention were not violated (unanimously).

In the Dakir case, the Court unanimously held that there had been a violation of the requirements of Article 6 § 1 of the Convention, since the applicant had been denied access to the court owing to excessive formalism.

Η απόφαση του Ευρωπαϊκού Δικαστηρίου Ανθρωπίνων Δικαιωμάτων της 29ης Ιουνίου 2017 στην υπόθεση Κοσμάς και άλλοι κατά Ελλάδας (καταγγελία αριθ. 20086/13).

 

Το 2013, ο αιτών βοήθησε στην προετοιμασία της καταγγελίας. Στη συνέχεια, η καταγγελία κοινοποιήθηκε στην Ελλάδα.

 

Ο αιτητής διαμαρτυρήθηκε με επιτυχία για την ανεπαρκή καταγραφή της κατάστασης της προσφεύγουσας όσον αφορά την επίλυση της διαφοράς σχετικά με τη γη που απέκτησε το μοναστήρι μέσω παράνομης κατοχής. Σε περίπτωση παραβίασης του άρθρου 1 του πρωτοκόλλου αριθ 1 για την Προστασία των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών.

 

 

 

Επί της περιπτώσεως

 


Τα μοναστήρια του Αγίου Όρους είναι δημόσιες νομικές οντότητες με ειδικό καθεστώς. Σύμφωνα με το νόμο, η ιδιοκτησία τους δεν μπορούσε να αποκτηθεί μέσω παράνομης κατοχής, εκτός από περιπτώσεις όπου η συνεχής κατοχή μπορεί να αποδειχθεί για περισσότερα από 30 χρόνια μέχρι το 1915.

 

Το 2004, το μοναστήρι άσκησε έφεση ενώπιον των δικαστηρίων για να αναγνωρίσει την ιδιοκτησία της γης που χρησιμοποίησε ο πρώτος αιτών (στο εξής "ο αιτών"). Η μονή αναφερόταν στην πράξη, με ημερομηνία 1824, και ως εναλλακτική λύση στη συνεχή κατοχή από το 1882 έως το 1915. Η προσφεύγουσα αμφισβήτησε, αναφερόμενη σε ορισμένες πράξεις μεταβίβασης που χρονολογούνται από το 1883, καθώς και διάφορα μέτρα κατοχής που ελήφθησαν από το 1974. Ισχυρίστηκε επίσης ότι η αγωγή ήταν κατάχρηση του νόμου. Τα δικαστήρια αναγνώρισαν το μοναστήρι ως ιδιοκτήτη, τουλάχιστον λόγω παράνομης κατοχής ακινήτων από το 1912, δεδομένου ότι ο αιτών δεν απέδειξε τη συνεχή κατοχή των προκατόχων του κατά την ίδια περίοδο. Κατά συνέπεια, τα δικαστήρια αναγνώρισαν ότι οι μεταγενέστερες πράξεις που διέπραξε ο αιτητής δεν μπορούσαν να ληφθούν υπόψη εξαιτίας του γεγονότος ότι η μοναστική ιδιοκτησία δεν μπορούσε να αποκτηθεί μέσω παράνομης κατοχής. Ο ισχυρισμός περί καταχρήσεως δικαιωμάτων απορρίφθηκε επίσης.

 


ΖΗΤΗΜΑΤΑ ΤΟΥ ΝΟΜΟΥ

 


(α) Η ύπαρξη "περιουσίας" και ο εφαρμοστέος κανόνας. Ο τίτλος ή η κατοχή του αιτούντος ή των προκατόχων του δεν αμφισβητήθηκε ποτέ (ο αιτών έλαβε ακόμη διοικητική άδεια για τη λειτουργία του εστιατορίου και την ανέγερση του κτιρίου). Το γεγονός ότι αυτή η κατάσταση δεν έχει αμφισβητηθεί για μεγάλο χρονικό διάστημα, δείχνει ότι οι αρχές και το μοναστήρι έχουν πράγματι συμφωνήσει ότι η προσφεύγουσα και οι προκάτοχοί του έχουν δικαίωμα σε ακίνητο στη γη που αποτελεί το ακίνητο αναγνωρίζεται και προστατεύεται από την εθνική νομοθεσία, και ότι δεν είχε αναλάβει δράση, επιτρέποντας να υποθέσουμε ότι η κατάσταση θα αλλάξει.

 

Ως εκ τούτου, το ενδιαφέρον ιδιοκτησίας της προσφεύγουσας αποδείχθηκε επαρκώς και βαρύ για να ανέλθει σε «κατοχή» κατά την έννοια της πρώτης πρότασης του άρθρου 1 του πρωτοκόλλου αριθ 1 της Σύμβασης, ως εκ τούτου, η εν λόγω διάταξη της Σύμβασης ίσχυε.

 

β) Παρέμβαση και αναλογικότητα. Η έξωση του αιτούντος μετά την απόφαση του Ακυρωτικού Δικαστηρίου προβλεπόταν από το νόμο και να επιδιώκει θεμιτό σκοπό (προστασία της ιδιοκτησίας Μονής κατά παράβαση εκ μέρους τρίτων). Εντούτοις, οι ακόλουθοι λόγοι οδήγησαν το Δικαστήριο στο συμπέρασμα ότι η προσφεύγουσα έπρεπε να φέρει ατομικό και υπερβολικό βάρος, το οποίο δεν δικαιολογείται από το νόμιμο συμφέρον.

 

Ο προσφεύγων, θεωρώντας ότι αγόρασε νόμιμα και με καλή πίστη τη γη, βάσει νομικών εγγράφων που χρονολογούνται από το 1883, δημιούργησε και ασκούσε επιχειρηματικές δραστηριότητες με την οικογένειά του.

 

Ελληνικά δικαστήρια δεν λαμβάνουν υπόψη αυτά τα νομικά έγγραφα, το γεγονός ότι η προσφεύγουσα είχε λάβει μια ποικιλία των αδειών λειτουργίας και των κατασκευών, σαν να ήταν ο ιδιοκτήτης της γης, ή το γεγονός ότι πληρώνει το φόρο ακίνητης περιουσίας. Πράγματι, οι διοικητικές αρχές δεν μπορούσαν να γνωρίζουν εκείνη την εποχή ότι το μοναστήρι διεκδίκησε με επιτυχία το δικαίωμα ιδιοκτησίας το 2004.

 

Ωστόσο, διοικητικές και νομικές πράξεις που συντάσσονται από τις δημόσιες αρχές, θα μπορούσε να ενισχύσει μόνο την πεποίθηση των δικαιούχων ότι το σύστημα συλλογής και η μεταβίβαση της κυριότητας είναι σταθερή και αξιόπιστη και ότι ανήκουν νόμιμα από το συγκεκριμένο ακίνητο.

 

Εν πάση περιπτώσει, ο ενάγων ισχυρίστηκε επίσης ότι η αξίωση της μονής συνιστούσε κατάχρηση του νόμου. Εάν γίνει αποδεκτό αυτό το επιχείρημα, ο αιτών τουλάχιστον θα είχε την ευκαιρία να διατηρήσει "την κατοχή" της γης. Ωστόσο, ο ισχυρισμός απορρίφθηκε με το επιχείρημα ότι τα έξοδα που προέκυψαν κατά τη χρήση της γης για εμπορικούς σκοπούς επικαλύφθηκαν με το κέρδος που αποκτήθηκε και το γεγονός ότι το ενοίκιο προς τη μονή δεν καταβλήθηκε.
Κατά συνέπεια, τα δικαστήρια δεν έλαβαν υπόψη τη ζημία, ελλείψει αποζημίωσης των εμπορικών μέσων της προσφεύγουσας, η οποία αποτέλεσε την πηγή της ύπαρξης της οικογένειάς του και της οικογένειάς του από το 1986.

 


ΑΠΟΦΑΣΗ

 


Στην περίπτωση αυτή υπήρξε παραβίαση των απαιτήσεων του άρθρου 1 του Πρωτοκόλλου αριθ. 1 της Σύμβασης (που εγκρίθηκε με πέντε ψήφους "για" με δύο - "εναντίον").

 


ΑΠΟΖΗΜΙΩΣΗ

 


Κατά την εφαρμογή του άρθρου 41 της Σύμβασης. Το Δικαστήριο χορήγησε στον αιτούντα 75.000 ευρώ για χρηματική και ηθική βλάβη.

The ECHR judgment of 29 June 2017 in the case of Kosmas and Others v. Greece (application No. 20086/13).

 

In 2013, the applicant was assisted in preparing the application. Subsequently, the application was communicated to Greece.

 

The applicant successfully complained of the applicant's insufficient account of the applicant's situation in settling the dispute over land acquired by the monastery through illegal possession. The case involved a violation of the requirements of Article 1 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

CIRCUMSTANCES OF THE CASE

 


Monasteries of Mount Athos are public legal entities that have a special status. Under the law, their property could not be acquired through illegal possession, except in cases where continuous possession can be proved for more than 30 years until 1915.

 

In 2004, the monastery appealed to the courts to recognize the ownership of the land used by the first applicant (hereinafter - the applicant). The monastery referred to the deed, dated 1824, and as an alternative to continuous possession from 1882 to 1915. The applicant objected, referring to a number of transfer acts dating back to 1883, and various measures of possession taken since 1974. He also argued that the lawsuit was an abuse of the law. The courts recognized the monastery as the owner, at least due to illegal possession of property since 1912, since the applicant did not prove the continued possession of his predecessors in the same period. Accordingly, the courts acknowledged that subsequent acts committed by the applicant could not be accounted for because of the fact that monastic property could not be acquired through illegal possession. The allegation of abuse of rights was also rejected.

 


ISSUES OF LAW

 


(a) The existence of "property" and the applicable rule. The title or possession of the applicant or his predecessors was never contested (the applicant even received an administrative permit to operate the restaurant and build the building). The fact that this situation was not contested over a long period shows that the authorities and the monastery actually agreed that the applicant and his predecessors had property interest in the land constituting property recognized and protected by domestic legislation and that they had never taken any action, allowing to assume that the situation will change.

 

As a result, the applicant's pecuniary interest was sufficiently established and significant to constitute "property" within the meaning of the first sentence of Article 1 of Protocol No. 1, hence this provision of the Convention was applicable.

 

(b) Intervention and proportionality. Eviction of the applicant after the decision of the Court of Cassation was provided by law and pursued a legitimate aim (protection of monastic real estate from the encroachments of third parties). Nevertheless, the following reasons compelled the Court to conclude that the applicant had to bear an individual and excessive burden which was not justified by lawful interest.

 

The applicant, believing that he acquired the land legally and in good faith, on the basis of legal documents dating back to 1883, created and carried out business there with his family.

 

The Greek courts did not take into account these legal documents, the fact that the applicant received various permits for exploitation and construction, as if he were the owner of the land, or the fact that he paid the property tax. Indeed, the administrative authorities could not have known at that time that the monastery successfully claimed the right of ownership in 2004.

 

At the same time, administrative legal acts drawn up by state bodies could only reinforce the conviction of beneficiaries that the system of acquisition and transfer of ownership was stable and reliable and that they legally own this property.

 

In any event, the applicant also submitted that the claim brought by the monastery constituted an abuse of the law. If this argument were accepted, the applicant, at least, would have had the opportunity to maintain "possession" of the land. However, the claim was dismissed on the grounds that the costs incurred when using the land for commercial purposes were overlapped with the profit gained and the fact that the rent to the monastery was not paid.

 

Accordingly, the courts did not take into account the loss in the absence of compensation of the applicant's trading instruments, which constituted the source of his and his family's existence since 1986.

 


DECISION

 


In the case there was a violation of the requirements of Article 1 of Protocol No. 1 to the Convention (adopted by five votes "for" with two - "against").

 


COMPENSATION

 


In the application of Article 41 of the Convention. The Court awarded the applicant EUR 75,000 in respect of pecuniary and non-pecuniary damage.

EHTY: n 27. kesäkuuta 2017 antama tuomio Satakunnan Markkinpersy Oy: n ja Satamedun Oy: n (Satakunnan Markkinaporssi Oy ja Satamedia Oy) tapauksesta Suomeen (valituksen nro 931/13).

 

Vuonna 2013 hakijaa avustettiin valituksen laatimisessa. Tämän jälkeen valitus toimitettiin Suomeen.

 

Tällöin kantajan valitus päätöksestä, jolla rajoitettiin verotietojen massan julkaisemista, tutkittiin onnistuneesti. Asia ei ole ristiriidassa ihmisoikeuksien ja perusvapauksien suojaamiseksi tehdyn yleissopimuksen 10 artiklan vaatimusten kanssa. Jos kyseessä olisi ollut rikottu 15 artiklan yleissopimuksen ihmisoikeuksista ja perusvapauksien kestosta vireillä kotimaan tuomioistuimissa.

 

 

 

ASIASUHTEET

 


Ensimmäinen hakijayhtiö Satakunnan Markkinpersi Oi julkaisi päiväkirjan, joka sisälsi tietoa veronmaksajien verotettavasta tulosta ja varoista. Nämä tiedot olivat julkisia lain (lain julkaisemista ja verotustietojen luottamuksellisuutta koskevan lain 5 §: n nojalla). Toinen yritys, kantaja "Satamedia Oi", tarjosi palveluja verotuksen alalla tietojen toimittamiseksi tekstiviestien kautta. Huhtikuussa 2003 oikeusasiamies tietosuojakomitean ehdotti neuvostolle tietosuojaa kieltää yrityksiä hakijoille verotuskohtelun datan siten ja siinä määrin, että he käyttivät vuonna 2002, ja siirto tietojen tekstiviestitoimintoon. Neuvoja Tietosuojavaltuutetun hylkäsi vetoomuksen sillä perusteella, että hakija, yhtiö toteutti journalistista toimintaa ja näin ollen oli oikeus poiketa annetun lain henkilötietoja. Asia saatettiin korkeimpaan hallinto-oikeuteen, joka helmikuussa 2007 pyysi alustavasti, Court Euroopan unionin (jäljempänä - unionin tuomioistuin) tulkintaan liittyvät direktiivin 95/46 / EY, Euroopan parlamentin ja neuvoston 24. lokakuuta 1995, yksilöiden suojelusta henkilötietojen käsittely ja näiden tietojen vapaa liikkuvuus. Tuomiossaan 16. joulukuuta 2008 (Tietosuojavaltuutettu v. Satakunnan {Markkinapörssi} Oy ja Satamedia Oy, C73 / 07, asiassa 16. joulukuuta 2008). Unionin tuomioistuimen totesi, että toimia, jotka liittyvät tiedot asiakirjoihin, jotka ovat yleisön saatavilla kansallisen lainsäädännön, voidaan pitää "journalismi", jos sen tarkoituksena on julkinen tiedonvälitys, mielipiteiden tai ajatusten, riippumatta käytetystä menetelmästä ja niiden lisäykseen. Syyskuussa 2009 korkein hallinto-oikeus määräsi tietosuojalautakunnan kieltämään verotietojen käsittelyn tällä tavalla ja siinä määrin kuin hakijayritykset käyttivät vuonna 2002. Toteaa, että unionin tuomioistuimen totesi, että ratkaisevaa oli arvioida, onko julkaiseminen on osa julkista keskustelua tai pyrittiin yksinomaan täyttämään lukijoiden uteliaisuutta, korkein hallinto-oikeus katsoi, että julkaisemista kokonaisuudessaan pohjan kerättyjen tietojen määrää journalistisia tarkoituksia varten ja lähettämällä tekstiviesti tietoa -palvelua ei voitu pitää journalistisena toimintana.

 

Yleissopimuksen mukaisessa menettelyssä kantajayhtiöt valittivat erityisesti yleissopimuksen 10 artiklan rikkomisesta. Tuomiossaan 21. heinäkuuta 2015 tuomioistuin jaosto todennut, kuusi ääntä "eli" yksi - "vastaan", että kun kyseessä on 10 artiklan yleissopimuksen ollut rikottu. Joulukuun 14. päivänä 2015 asia siirrettiin käsiteltäväksi suurelle jaostolle hakijoiden pyynnöstä.

 


LAINSÄÄDÄNTÖÄ

 


a) Alustava kysymys siitä, oliko verovelvollisille kilpailevaa yksityisyyden suojaa yleissopimuksen 8 artiklan mukaisesti. Se, että tiedot olivat jo julkisesti saatavilla, ei kumonnut tarvetta suojella yleissopimuksen 8 artiklaa. Jos oli kokoelma tietoja tietyn henkilön, käsittelyä tai henkilötietojen käyttöä ja julkaisemalla asiaa olennaisella tavalla tai aste sitä, mikä on yleensä ennustettavissa, on huomioita yksityisyyttä. Käsiteltävänä olevassa asiassa, kerätyt tiedot, käsitellään ja julkaistaan ​​yritysten hakijan sanomalehti paljastaa yksityiskohtia koskevat verotettavaa ansio- ja pääomatulo ja verotuksellisen nettovarallisuuden ja selvästi vaikuttaa yksityisyyden kiinnostuneille henkilöille, vaikka mukaan Suomen lainsäädännön tiedot voivat olla yleisön saatavilla.

 

b) Onko kyseessä ollut häiriö, onko häiriö lakisääteinen, ja onko se pyrkineet oikeutettuun tavoitteeseen. Päätös kieltää verotietoja suojelua neuvoston tietojen arveluttavaa, koska pysytettiin kotimaisissa tuomioistuimissa johti puuttumista oikealla hakijayritykset levittää tietoa, kuten 10 artiklassa taattua yleissopimuksen. c) Demokraattisen yhteiskunnan tarve. Tuomioistuin on tutkinut perusteet, jotka se on muotoillut aiemmassa oikeuskäytännössä olevan merkitystä tasapainottamisessa kilpailevia oikeuksia yksityiselämän kunnioitukseen artiklan mukaisesti yleissopimuksen 8, ja sananvapauteen 10 artiklan mukaisesti yleissopimuksen.

 

i) Osallistuminen keskusteluun yhteistä etua koskevasta kysymyksestä. Perustelu lainsäädäntöpolitiikkaa Suomessa tarjoten saatavuuden julkista taloutta koskevien tietojen on tarve tarjota mahdollisuuksia julkisen toiminnan valvomiseksi viranomaisten. Kuitenkin yleisen saatavuuden verotietoja mukaisesti selkeät säännöt ja menettelyt ja yleistä avoimuutta Suomen verojärjestelmän ei tarkoita, että sinänsä kiistanalainen julkaisun osallistuneet keskusteluun aiheesta, yleistä etua. Ottaen huomioon julkaisun kokonaisuutena ja osana Euroopan yhteisöjen tuomioistuimen sekä korkeimman hallinto-oikeuden ei ole vakuuttunut siitä, että julkaiseminen verotustietojen yritysten hakijan siten ja siinä määrin (alkuperäiset tiedot on julkaistu massiivinen luetteloita, lähes sananmukaisesti) osallistui yleiseen keskusteluun tai jopa sen päätavoitteena oli tämä.

 

ii) Julkaisemisen kohde. Julkaisu vaikutti noin 1 200 000 yksilöön. Kaikki ne ovat veronmaksajia, mutta hyvin harvat ovat olleet omistajat korkean nettotuloista, julkisuuden henkilöt ja tunnetut henkilöt tarkoitettu tuomioistuimen ennakkotapaukset. Suurin osa henkilöistä, joiden tiedot oli listattu sanomalehdessä, kuului matalapalkkaisiin ryhmiin.

 

iii) Tietojen hankkimismenetelmä ja sen luotettavuus. Julkaistujen tietojen luotettavuutta ei koskaan kiistetty, eikä tietoja saatu laittomasti. Oli kuitenkin selvää, että yritykset, joihin hakija jotka ovat peruneet pyyntönsä tietoja Valtion verotus vaan palkkasi ihmisiä keräämään verotietoja manuaalisesti paikallisille veroviranomaisille, jumissa ohitus tavanomaisten kanavien politiikan ja vastaavasti valvontaa ja tasapainoa perustettu Suomen viranomaisten säännellä pääsyä ja levittämistä.

 

iv) julkaisun sisältö, muoto ja seuraukset. Huolimatta siitä, että toimittajat voivat valita vapaasti valita, mitä uutislähteitä numerot soveltamisalaan kuuluvien niiden huomiota ja miten ne toimivat, tämä vapaus liittyy velvollisuuksia. Vaikka pidetään verotietoja, kun on kyse niiden oli Suomessa yleisölle, ne voidaan ainoastaan ​​saatu verotoimistot, ja niiden tuotanto johtui ehdoin. Tietojen julkaiseminen sanomalehti ja edelleen levittäminen näiden tietojen avulla SMS-palvelu tarkoittaa tapaa saavutettavuus, jotka oli tarkoitus lainsäätäjä. Takaukset Suomen lainsäädännössä on säädetty juuri saatavuutta henkilötietojen verotietoja, luonne ja tarkoitus tietosuojalainsäädäntö ja niihin liittyvät poikkeamat toimittajia. Tällaisessa tilanteessa viranomaisten vastaajahallituksella nauttinut suuri harkintavalta päättää, miten saavutetaan oikea tasapaino oikeuksien artiklassa säädettyjä 8 ja 10 yleissopimuksen. Verrattaessa näitä oikeuksia tuomioistuimissa Suomessa pyrki tasapainoon sananvapautta ja oikeutta yksityisyyteen kirjattu tietosuojalainsäädäntöä. Hakeminen poikkeaa lain vaatimuksia, asetuksen 2 (5) koskevan lain henkilötietoja, ja testi yleishyödyllisten kiisteltyä oikeusviranomaisten toimia, erityisesti korkein hallinto-oikeus, analysoi johtuvat yleissopimuksen oikeuskäytäntö ja oikeuskäytännön unionin tuomioistuimen ja huolellisesti sovellettu oikeuskäytännössä Euroopan yhteisöjen tuomioistuimen nyt esillä olevan asian tosiseikoihin.

 

v) rangaistus. Yritykset-kantajia ole kiellettyä julkaista verotuksellisia tietoja tai jatkaa julkaisemista sanomalehden sillä ehdolla, että he tekevät sen tavalla, joka vastaa Suomen ja EU: n sääntöjen tietosuojaa ja tiedonsaannin. Se, että käytännössä asetetut rajoitukset informaation määrä julkistetaan, voisi osana liiketoimintaansa vähemmän kannattavaa, ei ollut täytäntöönpanokelpoinen sellaisenaan tarkoitettuna tuomioistuimen ennakkotapaukset.

 

Tämän seurauksena toimivaltaisten viranomaisten vastaajahallituksella, ja erityisesti korkein hallinto-oikeus antoi asianmukaista huomiota periaatteisiin ja vahvistettuja kriteerejä yhteisöjen tuomioistuimen käytäntö, jotta tasapaino oikeus yksityisyyteen ja oikeus sananvapauteen. In 2013, the applicant was assisted in preparing the application. Subsequently, the application was communicated to Finland.

 

In the case, the applicant's complaint on the decision limiting the mass publication of tax information was successfully considered. The case did not violate the requirements of Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The case involved violation of the requirements of Article 15 of the Convention for the Protection of Human Rights and Fundamental Freedoms with regard to the length of proceedings in the courts of the country.

 

 

 

CIRCUMSTANCES OF THE CASE

 


The first applicant company, Satakunnan Markkinpersi Oi, published a journal containing information on the taxable income and assets of Finnish taxpayers. This information was public due to the law (by virtue of Article 5 of the Law on Public Disclosure and Confidentiality of Tax Information). The second company, the applicant, "Satamedia Oi," offered a service to provide information in the field of taxation through text messages. In April 2003, the Data Protection Ombudsman suggested that the Data Protection Board prohibit applicant companies from processing tax data in such a way and to the extent that they used in 2002 and the transfer of these data to the SMS service. The Data Protection Board rejected the Ombudsman's application on the grounds that the applicant companies carried out journalistic activities and therefore had the right to deviate from the provisions of the Personal Data Law. The case was later referred to the Supreme Administrative Court, which in February 2007 requested a preliminary determination from the Court of Justice of the European Union (hereinafter referred to as CJEU) concerning the interpretation of Directive 95/46 / EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals processing of personal data and the free circulation of such data. In its judgment of 16 December 2008 (Tietosuojavaltuutettu v. Satakunnan {Markkinaporssi} Oy and Satamedia Oy, C73 / 07, judgment of 16 December 2008). The CJEU concluded that activities relating to data from documents that are publicly available under domestic law may be recognized as "journalistic activity" if its purpose is to communicate information, opinions or ideas to the public regardless of the method used to disseminate them. In September 2009, the Supreme Administrative Court ordered the Data Protection Board to prohibit the processing of tax data in this way and to the extent that the applicant companies used in 2002. Noting that the CJEU acknowledged that the decisive factor was the assessment of whether the publication was part of a public discussion or was aimed solely at satisfying the reader's curiosity, the Supreme Administrative Court concluded that the publication in full of the database collected for journalistic purposes and the transmission of SMS information -service could not be considered as journalistic activity.

 

In the framework of the Convention proceedings, the applicant companies complained in particular of a violation of Article 10 of the Convention. In the judgment of 21 July 2015, the Chamber of the European Court decided, by six votes in favor, one against, that the requirements of Article 10 of the Convention had not been violated. On December 14, 2015, the case was referred for review to the Grand Chamber at the request of the applicants.

 


ISSUES OF LAW

 


(a) A preliminary question whether the taxpayers had a competing privacy right in accordance with Article 8 of the Convention. The fact that the information was already publicly available did not undo the need to protect Article 8 of the Convention. If there was a collection of data about a particular person, processing or using personal data or publishing the relevant material in a way or to an extent that is beyond what is usually predictable, considerations arise regarding privacy. In the present case, the data collected, processed and published by the applicant companies in the newspaper disclosed details of taxable earned and unearned income and taxable net assets, and therefore clearly affected the privacy of the persons concerned, despite the fact that, under Finnish law, the data could be publicly available.

 

(b) Whether there was interference, whether the interference was prescribed by law, and whether it pursued a legitimate aim. The Board's decision to protect data on the prohibition of the processing of tax data in a disputable manner, left unchanged by the domestic courts, entailed interference with the right of the applicant companies to disseminate information guaranteed by Article 10 of the Convention. The interference was provided for by law, the wording of the relevant legislation, the nature and scope of the journalistic derogation from the provisions of the legislation relied on by the applicant companies were applied in a fairly predictable manner following the interpretation given to the CJEU Supreme Administrative Court and, as media professionals, were aware that the massive data collection and mass distribution could not be considered as data processing "exclusively" for the and the interference pursued the legitimate aim of protecting the reputation or rights of others.

 

(c) The need for a democratic society. The Court considered the criteria that it formulated in its previous case-law as relevant in balancing competing rights to respect for private life in accordance with article 8 of the Convention and freedom of expression under article 10 of the Convention.

 

(i) Contribution to the discussion on an issue of common interest. The rationale for Finland's legislative policy, which provides for the general availability of tax data, was the need to provide the public with the opportunity to monitor the activities of public authorities. Nevertheless, universal access to tax data in accordance with clear rules and procedures and the overall transparency of the Finnish tax system did not mean that the controversial publication itself facilitated discussion on a matter of general interest. In examining the publication as a whole and in the context, the Court, like the Supreme Administrative Court, is not convinced that the publication of tax data by the applicant companies in this way and in such volume (the original data was published as mass catalogs almost verbatim) or even that its main purpose was this.

 

(ii) Subject of publication. About 1,200,000 individuals were affected by the publication. All of them were taxpayers, but very few were owners of high net income, public figures or well-known personalities in the meaning of the Court's case-law. Most of the individuals whose data were listed in the newspaper belonged to low-income groups.

 

(iii) Method of obtaining information and its reliability. The reliability of the published information was never disputed, and the data were not obtained illegally. However, it was clear that the applicant companies that withdrew their request for data from the National Taxation Board and instead hired people to collect tax data manually by local tax authorities followed a policy of bypassing conventional channels and, accordingly, checks and balances imposed by the Finnish authorities to regulate access and dissemination.

 

(iv) The content, form and consequences of the publication. Despite the fact that journalists enjoy freedom of choice as to which news sources are among those falling in the scope of their attention and how to work for them, this freedom is accompanied by duties. Even though the tax data in the applicant companies case were publicly available in Finland, they could only be obtained from local tax offices, and their receipt was subject to clear conditions. Journalists could receive tax data in digital format, but only a certain amount of data could be selected. Journalists are required to indicate that the information is requested for journalistic purposes and that it will not be published as a list. Thus, although information concerning citizens was publicly available, specific rules and guarantees regulated access to it. From the point of view of the Court, the fact that the relevant data were available to the public in accordance with domestic law did not necessarily mean that they could be published without any restrictions. The publication of data in the newspaper and the further dissemination of these data via SMS service meant the manner and degree of their availability that were not planned by the legislator. Guarantees in the legislation of Finland were provided precisely because of the general availability of personal tax data, the nature and purpose of legislation on data protection and accompanying deviation from it for journalists. In such circumstances, the authorities of the respondent State enjoyed broad discretion in deciding how to achieve an equitable balance between the relevant rights provided for in articles 8 and 10 of the Convention. When comparing these rights, the courts of Finland sought to strike a balance between freedom of expression and the right to privacy as embodied in the data protection legislation. Applying a derogation from the requirements of the law provided for in § 2 (5) of the Personal Data Act and a test of general interest in the disputed interference, the courts, in particular the Supreme Administrative Court, analyzed the relevant Convention case-law and CJEU case-law and carefully applied the case-law of the European Court to the facts of the present case.

 

(v) Sanction. The applicant companies were not prevented from publishing tax data or continuing the publication of the newspaper, provided that they would do so in a manner consistent with the Finnish and European rules on data protection and access to information. The fact that in practice the restrictions imposed on the amount of information to be published could make part of their commercial activities less profitable, was not, as such, a sanction in the meaning of the Court's case-law.

 

As a result, the competent authorities of the respondent State and, in particular, the Supreme Administrative Court attached due importance to the principles and criteria laid down in the Court's case-law for balancing the right to respect for private life and the right to freedom of expression. The Supreme Administrative Court gave due importance to its conclusion that the publication of tax data in the manner described and on the scale described did not facilitate discussions on a matter of general interest and that the applicants could not substantiate the claim that this was done solely for journalistic purposes in the sense of domestic and European legislation. Consequently, the motives on which the Finnish courts based their findings were relevant and sufficient to demonstrate that the interference complained of was "necessary in a democratic society" and that the authorities of the respondent State acted within their discretion in establishing a fair balance between competing interests, considered in the case.

 


DECISION

 


In the case, the requirements of Article 10 of the Convention were not violated (adopted by 15 votes "for" with two - "against").

 

Also, the Grand Chamber of the European Court decided by 15 votes in favor, against two, that there had been a violation of the requirements of Article 6 § 1 of the Convention as regards the length of proceedings before the domestic courts.
