Постановление ЕСПЧ от 20 сентября 2018 года по делу "Елисеев и Князькин (Yeliseyev and Knyazkin) против Российской Федерации" (жалобы N N 27414/17 и 51559/17).

По делу успешно рассмотрены жалобы заявителей на неадекватные условия содержания под стражей, а также на то, что они не располагали эффективным средством правовой защиты в этой связи. По делу допущено нарушение требований статьи 3 Конвенции о защите прав человека и основных свобод (запрещение пыток), статьи 13 Конвенции (право на эффективное средство правовой защиты).

В 2017 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

В своих жалобах заявители (два человека) жаловались на неадекватные условия содержания под стражей, а также на то, что они не располагали эффективным средством правовой защиты в этой связи.

20 сентября 2018 года по жалобам поданным заявителями Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требование статьи 3 Конвенции (запрещение пыток), требование статьи 13 Конвенции (право на эффективное средство правовой защиты), и обязал государство-ответчика выплатить 6 500 евро и 9 000 евро в качестве компенсации морального вреда первому и второму заявителю соответственно.

In 2017, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.

In their applications, the applicants (two persons) complained about the inadequate conditions of detention, as well as the fact that they did not have an effective remedy in this regard.

On September 20, 2018, the European Court unanimously ruled that in this case the authorities violated the requirement of Article 3 of the Convention (prohibition of torture), the requirement of Article 13 of the Convention (the right to an effective remedy), and ordered the respondent state to pay 6 500 euros and 9,000 euros in respect of non-pecuniary damage to the first and second applicants, respectively.

Постановление ЕСПЧ от 24 июля 2018 года по делу "Филюткин (Filyutkin) против Российской Федерации" (жалоба N 39234/08).

 

По делу успешно рассмотрена жалоба заявителя, проживающего в городе Навле Брянской области, на нарушение его права на разбирательство дела беспристрастным судом, гарантированное пунктом 1 статьи 6 Конвенции. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод (право на справедливое судебное разбирательство) Конвенции.

 

В 2008 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

В своей жалобе заявитель, проживающий в городе Навле Брянской области, жаловался на нарушение его права на разбирательство дела беспристрастным судом, гарантированное пунктом 1 статьи 6 Конвенции.

 

24 июля 2018 года по жалобе поданной заявителем Европейский Суд единогласно объявил жалобу приемлемой для рассмотрения по существу, а также признал, что имело место нарушение пункта 1 статьи 6 (право на справедливое судебное разбирательство) Конвенции. Европейский Суд обязал государство-ответчика выплатить заявителю в качестве компенсации морального вреда 6 000 евро.

On 24 July 2018, the European Court unanimously declared the complaint admissible on the merits of the complaint filed, and also acknowledged that there had been a violation of Article 6 § 1 (right to a fair trial) of the Convention. The European Court ordered the respondent State to pay the applicant EUR 6,000 in respect of non-pecuniary damage.

Постановление ЕСПЧ от 17 июля 2018 года по делу "Шульмин и другие (Shulmin and Others) против Российской Федерации" (жалобы N N 15918/13, 51623/15, 53700/15, 18524/16, 33214/17, 34421/17, 35675/17 и 36267/17).

 

По делу успешно рассмотрены жалобы заявителей на то, что их содержали в металлических клетках в залах судебных заседаний во время рассмотрения их дел. По делу допущено нарушение требований статьи 3 Конвенции о защите прав человека и основных свобод (запрещение пыток) в отношении всех заявителей.

 

В 2013, 2015, 2016 и 2017 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах заявители (восемь человек) жаловались на то, что их содержали в металлических клетках в залах судебных заседаний во время рассмотрения их дел.

 

17 июля 2018 года по жалобам поданным заявителями Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требование статьи 3 Конвенции (запрещение пыток) в отношении всех заявителей, и обязал государство-ответчика выплатить каждому заявителю по 7 500 евро в качестве компенсации морального вреда.
