Постановление ЕСПЧ от 12 февраля 2019 года по делу "Белан и Свидерская против Российской Федерации (Belan and Sviderskaya v. Russia)" (жалобы N 42294/13 и 42585/13).

По делу успешно рассмотрены жалобы на доставление в отдел внутренних дел за участие в пикетировании и несправедливость судебного разбирательства. По делу допущено нарушение требований статьи 11 Конвенции о защите прав человека и основных свобод.

В 2013 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

В своих жалобах Заявительницы жаловались на то, что их доставление в отдел внутренних дел за участие в пикетировании нарушало их права. Первая заявительница также жаловалась на несправедливость судебного разбирательства по ее делу. Заявительницы также утверждали, что действия властей представляли собой незаконное и непропорциональное вмешательство в их права на свободу выражения мнения и свободу мирных собраний.

12 февраля 2019 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 11 Конвенции (право на свободу собраний и объединений) в отношении двух заявительниц.

The ECHR judgment of February 12, 2019 in the case of Belan and Sviderskaya v. Russia (Belan and Sviderskaya v. Russia) (applications Nos. 42294/13 and 42585/13).

In the case, applications about the delivery to the Department of Internal Affairs for participating in the picketing and the unfairness of the trial were successfully considered. The case has violated the requirements of Article 11 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2013, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.

In their applications, the applicants complained that their delivery to the police department for participating in the picket violated their rights. The first applicant also complained about the unfairness of the trial in her case. The applicants also alleged that the authorities' actions constituted an unlawful and disproportionate interference with their right to freedom of expression and freedom of peaceful assembly.

On February 12, 2019, following applications by the applicants, the Court unanimously ruled that in the present case the Government had violated the requirements of Article 11 of the Convention (the right to freedom of assembly and association) in respect of the two applicants.

Постановление ЕСПЧ от 12 февраля 2019 года по делу "Рыклин и Шаров против Российской Федерации (Ryklin and Sharov v. Russia)" (жалобы N 37513/15 и 37528/15).

 

По делу успешно рассмотрены жалобы на незаконное и произвольное задержание и содержание под стражей в отделе внутренних дел из-за участия в демонстрации. По делу допущено нарушение требований пункта 1 статьи 6, статей 10 и 11 Конвенции о защите прав человека и основных свобод.

 

В 2015 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах Заявители жаловались на то, что их задержание и содержание под стражей в отделах внутренних дел из-за их участия в демонстрации 6 мая 2015 г. были незаконными и произвольными. Заявители также жаловались на отсутствие представителей стороны обвинения на судебных слушаниях в административном производстве против них. Кроме того, они утверждали, что имело место незаконное и непропорциональное вмешательство в их право на свободу выражения мнения.

 

12 февраля 2019 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство) в отношении каждого из заявителей, статьи 10 (право на свободу выражения мнения), рассмотренной в свете статьи 11 Конвенции (право на свободу собраний и объединений), в отношении каждого из заявителя, и обязал власти государства-ответчика выплатить каждому из заявителей по 5 000 евро в качестве компенсации морального вреда.

On February 12, 2019, in response to applications submitted by the applicants, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 6 § 1 of the Convention (right to a fair trial) in respect of each of the applicants, Article 10 (right to freedom of expression ), examined in the light of Article 11 of the Convention (the right to freedom of assembly and association), in respect of each of the applicants, and ordered the respondent Government to pay 5,000 euros to each of the applicants in respect of moral th harm.

По делу успешно рассмотрены жалобы на незаконное и непропорциональное вмешательство в права на свободу выражения мнения и свободу мирных собраний. По делу допущено нарушение требований пункта 1 статьи 6, пункта 1 и подпункта "b" пункта 3 статьи 6, статьи 10 и статьи 11 Конвенции о защите прав человека и основных свобод.

 

В 2015 и 2016 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах Заявители жаловались на то, что признание их виновными в совершении административного правонарушения представляло собой незаконное и непропорциональное вмешательство в их права на свободу выражения мнения и на свободу мирных собраний. Они также жаловались на отсутствие представителей стороны обвинения на судебных слушаниях в административном производстве против них по рассмотрению дел о проведении пикетирования. Заявители также утверждали, что им не было предоставлено достаточно времени и возможностей для подготовки своей защиты.

 

12 февраля 2019 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство), пункта 1 и подпункта "b" пункта 3 статьи 6 Конвенции в отношении второго заявителя, статьи 10 Конвенции (право на свободу выражения мнения) в отношении первого заявителя, статьи 11 Конвенции (право на свободу собраний и объединений) в отношении второго заявителя. Европейский Суд обязал власти государства-ответчика выплатить каждому заявителю по 5 200 евро в качестве компенсации морального вреда.

In their applications, the applicants complained that their conviction of an administrative offense constituted an unlawful and disproportionate interference with their rights to freedom of expression and freedom of peaceful assembly. They also complained about the absence of representatives of the prosecution at court hearings in administrative proceedings against them to consider picket cases. The applicants also submitted that they had not been given sufficient time and facilities to prepare their defense.

 

On February 12, 2019, in response to applications by the applicants, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 6 § 1 of the Convention (right to a fair trial), paragraph 1 and Article 6 § 3 (b) of the Convention in relation to the second applicant, Article 10 of the Convention (right to freedom of expression) in respect of the first applicant, Article 11 of the Convention (right to freedom of assembly and association) in respect of the second applicant. The Court obliged the respondent Government to pay EUR 5,200 to each applicant in respect of non-pecuniary damage.
