Постановление ЕСПЧ от 26 марта 2019 года по делу "Коняев против Российской Федерации (Konyayev v. Russia)" (жалоба N 9759/09).

В 2009 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

По делу успешно рассмотрена жалоба заявителя на жестокое обращение с ним во время содержания в отделе внутренних дел и на отсутствие эффективного расследования этого обстоятельства. По делу допущено нарушение требования статьи 3 Конвенции о защите прав человека и основных свобод.

В своей жалобе Заявитель жаловался на то, что он подвергся жестокому обращению в отделе внутренних дел и что не было проведено эффективного расследования этого обстоятельства.

26 марта 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требование статьи 3 Конвенции (запрещение пыток) в ее процессуально-правовом и материально-правовом аспектах, и обязал власти государства-ответчика выплатить заявителю 25 000 евро в качестве компенсации морального вреда.

In his application, the applicant complained that he had been ill-treated in the police department and that there had been no effective investigation into this circumstance.

On March 26, 2019, on an application filed by the applicant, the Court unanimously ruled that in the present case the Government violated the requirement of Article 3 of the Convention (prohibition of torture) in its procedural and substantive aspects, and ordered the respondent Government to pay the applicant 25,000 euros in respect of non-pecuniary damage.

В 2013 году заявительницам была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницирована Российской Федерации.

 

По делу успешно рассмотрены жалобы на незаконное и непропорциональное вмешательство в право на свободу выражения мнения, а также отсутствие представителей стороны обвинения на судебных слушаниях в административном производстве против заявителей.

 

В своих жалобах Заявительницы жаловались на то, что имело место незаконное и непропорциональное вмешательство в их право на свободу выражения мнения. Заявительницы также жаловались на отсутствие представителей стороны обвинения на судебных слушаниях в административном производстве против них.

 

26 марта 2019 года, по жалобам поданным заявительницами, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство), статьи 11 Конвенции (право на свободу собраний и объединений), и обязал власти государства-ответчика выплатить каждой из заявительниц по 9 800 евро в качестве компенсации морального вреда.

Постановление ЕСПЧ от 26 марта 2019 года по делу "Аношина против Российской Федерации (Anoshina v. Russia)" (жалоба N 45013/05).

 

В 2005 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на непроведение эффективного расследования обстоятельств смерти брата заявительницы в медицинском вытрезвителе. По делу допущено нарушение статьи 2 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе Заявительница жаловалась на то, что ее брат умер, находясь в медицинском вытрезвителе. Заявительница также утверждала, что не было проведено эффективного расследования в связи с этим обстоятельством.

 

26 марта 2019 года, по жалобе поданной заявительницей, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требование статьи 2 Конвенции (право на жизнь) в ее материально-правовом и процессуально-правовом аспектах, и обязал власти государства-ответчика выплатить заявительнице 36 600 евро в качестве компенсации морального вреда.

The case has successfully examined the application about the failure to conduct an effective investigation into the death of the applicant’s brother in a medical detoxification center. The case has violated article 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In her application, the applicant complained that her brother had died while in a medical detox. The applicant also alleged that no effective investigation had been carried out in connection with this circumstance.

 

On March 26, 2019, in response to an application by the applicant, the Court unanimously ruled that in the present case the Government violated the requirement of Article 2 of the Convention (the right to life) in its substantive and procedural aspects, and ordered the respondent Government to pay the applicant 36,600 euros (EUR) in respect of non-pecuniary damage.

По делу успешно рассмотрена жалоба заявителя на жестокое обращение в отделе внутренних дел и на неэффективное расследования этого обстоятельства. По делу допущено нарушение требований статьи 3 Конвенции о защите прав человека и основных свобод.
