Постановление ЕСПЧ от 28 мая 2019 года по делу "Самойлов (Samoylov) против Российской Федерации" (жалоба N 1750/11).

В 2011 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

По делу успешно рассмотрена жалоба на непроведение публичного слушания по уголовному делу заявителя. По делу допущено нарушение статьи 6 Конвенции о защите прав человека и основных свобод (право на справедливое судебное разбирательство).

В своей жалобе Заявитель жаловался на то, что по его уголовному делу не было проведено публичного слушания.

28 мая 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требование статьи 6 Конвенции (право на справедливое судебное разбирательство) и что установление факта нарушения будет являться достаточной справедливой компенсацией любого морального вреда, причиненного заявителю.

In 2011, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

The case has successfully examined the application about the failure to hold a public hearing in the applicant’s criminal case. The case has violated article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms (right to a fair trial).

In his application, the applicant complained that no public hearing had been held in his criminal case.

On May 28, 2019, in an application lodged by the applicant, the Court unanimously ruled that in the present case the Government violated the requirement of Article 6 of the Convention (the right to a fair trial) and that a finding of a violation would constitute sufficient just satisfaction for any non-pecuniary damage suffered by the applicant.

Постановление ЕСПЧ от 28 мая 2019 года по делу "Кабанов (Kabanov) против Российской Федерации" (жалоба N 17506/11).

 

В 2011 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на то, что разбирательство по делу заявителя было проведено пристрастным судом, что выразилось в бездействии председательствующего судьи областного суда, отказавшегося принять во внимание сообщение старшины присяжных заседателей о поведении одного из присяжных заседателей. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе Заявитель, содержавшийся под стражей в пенитенциарном учреждении, жаловался на то, что разбирательство по его делу было проведено пристрастным судом, что выразилось в бездействии председательствующего судьи областного суда, отказавшегося принять во внимание сообщение старшины присяжных заседателей о поведении одного из присяжных заседателей.

 

28 мая 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство) и что в случае, если производство по уголовному делу в отношении заявителя не будет возобновлено в течение трех месяцев со дня вступления настоящего Постановления Европейского Суда в силу, власти государства-ответчика должны будут выплатить заявителю 7 800 евро в качестве компенсации морального вреда.

In 2011, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

 

The case successfully examined the application that the proceedings in the applicant's case were conducted by a biased court, which resulted in the inaction of the presiding judge of the regional court, who refused to take into account the report of the jury foreman about the behavior of one of the jurors. The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his application, the applicant, detained in a penal institution, complained that the trial was conducted by a biased court, which resulted in the inaction of the presiding judge of the regional court, who refused to take into account the report of the jury foreman on the conduct of one of the jurors.

 

On May 28, 2019, following an application filed by the applicant, the Court unanimously decided that in the present case the Russian authorities violated the requirements of Article 6 § 1 of the Convention (right to a fair trial) and that if the criminal proceedings against the applicant were not will be renewed within three months from the date of the entry into force of this judgment, the respondent Government will have to pay the applicant EUR 7,800 in respect of non-pecuniary damage.

Постановление ЕСПЧ от 28 мая 2019 года по делу "Удут (Udut) против Российской Федерации" (жалоба N 1115/10).

 

В 2010 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на непроведение компетентными органами власти эффективного расследования обстоятельств смерти дочери заявительницы. По делу допущено нарушение требований статьи 2 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе Заявительница жаловалась на то, что компетентные органы власти не провели эффективного расследования обстоятельств смерти ее дочери.

 

28 мая 2019 года, по жалобе поданной заявительницей, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требование статьи 2 Конвенции (право на жизнь) в ее процессуально-правовом аспекте, и обязал власти государства-ответчика выплатить заявительнице 19 500 евро в качестве компенсации морального вреда и 2 200 евро в качестве компенсации судебных расходов и издержек.

The case has violated the requirements of Article 2 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In her application, the applicant complained that the competent authorities had failed to conduct an effective investigation into the circumstances of the death of her daughter.

 

On May 28, 2019, in an application lodged by the applicant, the Court unanimously ruled that in the present case the Government violated the requirement of Article 2 of the Convention (the right to life) in its procedural and legal aspect and ordered the respondent Government to pay the applicant EUR 19,500 in respect of non-pecuniary damage and 2,200 euros in respect of costs and expenses.

Постановление ЕСПЧ от 21 мая 2019 года по делу "Леденцов (Ledentsov) против Российской Федерации" (жалоба N 47283/09).

 

В 2009 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на отсутствие беспристрастности суда при рассмотрении дела в отношении заявителя, а также то, что суд ссылался на показания свидетелей, данные ими ранее в ходе расследования, которых заявитель не мог допросить лично. По делу допущено нарушение требований статьи 6 Конвенции о защите прав человека и основных свобод в связи с отсутствием беспристрастности суда.

 

В своей жалобе Заявитель жаловался на то, что судья первой инстанции не был беспристрастным по его делу, а также на то, что суд первой инстанции ссылался на показания пяти свидетелей, данные ими ранее в ходе расследования, которых заявитель не мог допросить лично.

 

21 мая 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 6 Конвенции (право на справедливое судебное разбирательство) в связи с отсутствием беспристрастности суда первой инстанции, и обязал власти государства-ответчика выплатить заявителю 7 800 евро в качестве компенсации морального вреда и 1 000 евро в качестве компенсации судебных расходов и издержек.

The case successfully examined the application about the lack of impartiality of the court when considering the case against the applicant, as well as the fact that the court referred to the witnesses given by them earlier during the investigation, which the applicant could not question in person. The case has violated the requirements of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms in connection with the lack of impartiality of the court.

 

In his application, the applicant complained that the trial judge had not been impartial in his case, and that the trial court had referred to the statements of five witnesses that they had previously given during the investigation, which the applicant could not question in person.

 

On May 21, 2019, on an application filed by the applicant, the European Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 6 of the Convention (the right to a fair trial) due to the lack of impartiality of the trial court and ordered the respondent Government to pay the applicant EUR 7,800 in respect of non-pecuniary damage and EUR 1,000 in respect of costs and expenses.

Постановление ЕСПЧ от 21 мая 2019 года по делу "О.О. (O.O.) против Российской Федерации" (жалоба N 36321/16).

 

В 2016 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на нерассмотрение органами власти утверждения заявителя о том, что ему будет угрожать реальная опасность подвергнуться жестокому обращению в случае его депортации, осуществление депортации заявителя в нарушение обеспечительных мер, указанных ЕСПЧ. По делу допущено нарушение требований статьи 3, статьи 34 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе Заявитель жаловался на то, что органы власти не рассмотрели его утверждения о том, что ему будет угрожать реальная опасность подвергнуться жестокому обращению в случае его депортации в Узбекистан. Заявитель также утверждал, что его депортация была осуществлена в нарушение обеспечительных мер, указанных Европейским Судом в соответствии с правилом 39 Регламента Европейского Суда.

 

21 мая 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 3 Конвенции (запрещение пыток) в связи с депортацией заявителя в Узбекистан. Европейский Суд счел, что власти Российской Федерации проигнорировали обеспечительную меру, указанную Европейским Судом в соответствии с правилом 39 Регламента Европейского Суда, и поэтому не выполнили свои обязательства по статье 34 Конвенции. Европейский Суд обязал власти государства-ответчика выплатить заявителю 20 000 евро в качестве компенсации морального вреда и 5 000 евро в качестве компенсации судебных расходов и издержек.

In 2016, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

 

In the case, the application was successfully examined regarding the authorities' failure to examine the applicant’s allegations that he would be in real danger of being subjected to ill-treatment if deported, and the applicant’s deportation in violation of the interim measures indicated by the ECHR. The case has violated the requirements of Article 3, Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his application, the applicant complained that the authorities had not examined his allegations that he would be in real danger of being subjected to ill-treatment if he was deported to Uzbekistan. The applicant also alleged that his deportation had been carried out in violation of the interim measures indicated by the Court in accordance with Rule 39 of the Rules of Court.

 

On May 21, 2019, following an application filed by the applicant, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 3 of the Convention (prohibition of torture) in connection with the applicant’s deportation to Uzbekistan. The Court considers that the Government ignored the interim measure indicated by the Court in accordance with Rule 39 of the Rules of Court and therefore failed to fulfill its obligations under Article 34 of the Convention. The Court ordered the respondent Government to pay the applicant EUR 20,000 in respect of non-pecuniary damage and EUR 5,000 in respect of costs and expenses.
