Постановление ЕСПЧ от 02 июля 2019 года по делу "Добровицкая и другие (Dobrovitskaya and Others) против Республики Молдова и Российской Федерации" (жалобы N 41660/10, 25197/11, 8064/11, 6151/12, 28972/13 и 29182/14).

По делу успешно рассмотрены жалобы на бесчеловечные условия содержания заявителей, за исключением одного, под стражей, недостаточная медицинская помощь одному из заявителей во время его содержания под стражей, а также незаконность задержания заявителей на основании решений, вынесенных органами, которые не были созданы на основании закона. По делу допущено нарушение статьи 3 Конвенции о защите прав человека и основных свобод, пункта 1 статьи 5 Конвенции, статьи 6 Конвенции, статьи 2 Протокола N 4 к Конвенции в отношении одной заявительницы, статьи 13 Конвенции в отношении отдельных заявителей.

В 2010, 2011, 2012, 2013 и 2014 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

В своих жалобах все заявители, за исключением одного, жаловались на бесчеловечные условия содержания под стражей. Один заявитель также жаловался на недостаточную медицинскую помощь во время его содержания под стражей. Заявители также жаловались на незаконность их задержания, поскольку решения об этом выносились органами, которые не были созданы на основании закона. Заявители утверждали, что они были признаны виновными органами, которые не были созданы на основании закона.

02 июля 2019 года по жалобам поданным заявителями Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 3 Конвенции (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 6 Конвенции (право на справедливое судебное разбирательство), статьи 2 Протокола N 4 к Конвенции (право на свободу передвижения) в отношении одной заявительницы, статьи 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) в отношении отдельных заявителей, и обязал власти государства-ответчика выплатить заявителям различные суммы от 1 500 до 33 800 евро в качестве всех видов компенсации.

In 2010, 2011, 2012, 2013 and 2014, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.

In their applications, all but one of the applicants complained of inhuman conditions of detention. One applicant also complained of inadequate medical assistance during his detention. The applicants also complained about the unlawfulness of their detention, since decisions on this were made by bodies that were not established by law. The applicants alleged that they were found guilty by bodies that were not established by law.

On July 2, 2019, on applications submitted by the applicants, the European Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 3 of the Convention (prohibition of torture), Article 5 § 1 of the Convention (right to liberty and security of person), Article 6 of the Convention (right to fair trial), Article 2 of Protocol No. 4 to the Convention (right to freedom of movement) in respect of one applicant, Article 13 of the Convention (right to an effective domestic remedy) in respect of certain applicants, and ordered the respondent Government to pay the applicants various amounts from 1,500 to 33,800 euros as all forms of compensation.

Постановление ЕСПЧ от 02 июля 2019 года по делу "Новая газета" и Милашина (Novaya Gazeta and Milashina) против Российской Федерации" (жалоба N 4097/06).

 

По делу успешно рассмотрена жалоба на то, что решения судов необоснованно ограничили право заявителей на свободу выражения мнения. По делу было допущено нарушение требований статьи 10 Конвенции о защите прав человека и основных свобод.

 

В 2006 году заявителям была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

В своей жалобе заявители жаловались на то, что решения судов необоснованно ограничили их право на свободу выражения мнения.

 

02 июля 2019 года по жалобе поданной заявителями Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 10 Конвенции (право на свободу выражения мнения), и обязал власти государства-ответчика выплатить заявителям 1 160 евро в качестве компенсации материального вреда, 3 250 и 6 000 евро компании-заявительнице и заявительнице соответственно в качестве компенсации материального ущерба.

In their application, the applicants complained that the decisions of the courts unreasonably restricted their right to freedom of expression.

 

On July 2, 2019, on an application filed by the applicants, the Court unanimously ruled that in the present case the Government violated the requirements of Article 10 of the Convention (right to freedom of expression) and ordered the respondent Government to pay the applicants 1,160 euros in respect of pecuniary damage, 3 250 and 6 000 euros to the applicant company and the applicant respectively in respect of pecuniary damage.

По делу успешно рассмотрены жалобы на бесчеловечные условия содержания заявителей под стражей, жестокое обращение с одним из заявителей в период содержания под стражей с целью заставить его дать признательные показания, задержание заявителей по решению органов, которые не были созданы на основании закона, неразрешение свиданий с родственниками. По делу допущено нарушение статьи 3 Конвенции о защите прав человека и основных свобод (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статей 8 (право на уважение частной и семейной жизни) и 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты).

 

В 2010 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах заявители жаловались на бесчеловечные условия содержания под стражей. Один из заявителей также жаловался на жестокое обращение с ним в период содержания под стражей с целью заставить его дать признательные показания. Заявители также утверждали, что их задержания производились по решению органов, которые не были созданы на основании закона. Некоторые заявители также жаловались на то, что в период содержания под стражей им не разрешались свидания с родственниками.

 

02 июля 2019 года по жалобам поданным заявителями Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 3 Конвенции (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статей 8 (право на уважение частной и семейной жизни) и 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) и обязал власти государства-ответчика выплатить каждому заявителю по 9 750 евро в качестве компенсации морального вреда и 1 500 евро в качестве компенсации судебных расходов и издержек. Европейский Суд единогласно постановил, что власти Республики Молдова не допустили нарушения какого-либо положения Конвенции.

The European Court unanimously decided that the authorities of the Republic of Moldova had not committed a violation of any provision of the Convention.
