Постановление ЕСПЧ от 17 сентября 2019 года по делу "Филин (Filin) против Республики Молдова и Российской Федерации" (жалоба N 48841/11).

В 2011 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Республике Молдова и Российской Федерации.

По делу успешно рассмотрена жалоба на условия содержания заявителя под стражей на территории "Приднестровской Молдавской Республики", незаконность лишения его свободы, а также отсутствие у него эффективного средства правовой защиты для осуществления прав, гарантированных различными статьями Конвенции о защите прав человека и основных свобод. По делу допущено нарушение требований статьи 3, пункта 1 статьи 5, статьи 13 Конвенции о защите прав человека и основных свобод.

В своей жалобе заявитель жаловался на условия его содержания под стражей на территории "Приднестровской Молдавской Республики", на незаконность лишения его свободы, а также на отсутствие у него эффективного средства правовой защиты для осуществления прав, гарантированных различными статьями Конвенции.

17 сентября 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что власти Республики Молдова нарушили требования статьи 3 Конвенции (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) во взаимосвязи со статьей 3 Конвенции и что власти Российской Федерации нарушили требования статьи 3 Конвенции, пункта 1 статьи 5 Конвенции, статьи 13 Конвенции во взаимосвязи со статьей 3 Конвенции.

17 сентября 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что власти Республики Молдова должны выплатить заявителю 8 000 евро в качестве компенсации морального вреда и 800 евро в качестве компенсации судебных расходов и издержек, а также что власти Российской Федерации должны выплатить заявителю 12 000 евро в качестве компенсации морального вреда и 1 200 евро в качестве компенсации судебных расходов и издержек.

In his application, the applicant complained about the conditions of his detention in the territory of the Pridnestrovskaia Moldavskaia Respublika, the unlawfulness of his deprivation of liberty, and his lack of an effective remedy to exercise the rights guaranteed by various articles of the Convention.

On September 17, 2019, on an application filed by the applicant, the European Court unanimously ruled that the authorities of the Republic of Moldova violated the requirements of Article 3 of the Convention (prohibition of torture), Article 5 § 1 of the Convention (right to liberty and security of person), Article 13 of the Convention (right to an effective domestic remedy) in conjunction with Article 3 of the Convention and that the Russian authorities violated the requirements of Article 3 of the Convention, Article 5 § 1 of the Convention, Article 13 of the Convention in conjunction with Article 3 of the Convention.

On September 17, 2019, following an application filed by the applicant, the European Court unanimously decided that the authorities of the Republic of Moldova should pay the applicant 8,000 euros in respect of non-pecuniary damage and 800 euros in respect of costs and expenses, and that the authorities of the Russian Federation should pay the applicant EUR 12,000 in respect of non-pecuniary damage and EUR 1,200 in respect of costs and expenses.

Постановление ЕСПЧ от 17 сентября 2019 года по делу "Иовцев и другие (Iovcev and Others) против Республики Молдова и Российской Федерации" (жалоба N 40942/14).

 

В 2014 году заявителям была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована и Российской Федерации.

 

По делу успешно рассмотрена жалоба на нарушения прав заявителей на образование, на уважение частной и семейной жизни, а также незаконное лишение свободы, незаконность проведенных у них обысков и конфискации их имущества, отсутствие эффективных средств правовой защиты для осуществления своих прав, нарушенных властями "Приднестровской Молдавской Республики". По делу допущено нарушение пункта 1 статьи 5 Конвенции о защите прав человека и основных свобод (право на свободу и личную неприкосновенность), статьи 8 Конвенции (право на уважение частной и семейной жизни), статьи 2 Протокола N 1 к Конвенции (право на образование) властями РФ; властями Республики Молдова не допущено нарушений Конвенции.

 

В своей жалобе заявители, 18 граждан Республики Молдова, жаловались на нарушения их права на образование, права на уважение частной и семейной жизни, на незаконное лишение свободы, на незаконность проведенных у них обысков и конфискацию их имущества, а также на отсутствие эффективных средств правовой защиты для осуществления своих прав, нарушенных властями "Приднестровской Молдавской Республики".

 

17 сентября 2019 года, по жалобе поданной заявителями, Европейский Суд единогласно постановил, что власти Российской Федерации нарушили требования пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 8 Конвенции (право на уважение частной и семейной жизни), статьи 2 Протокола N 1 к Конвенции (право на образование) и что властями Республики Молдова не было допущено какого-либо нарушения Конвенции, и обязал власти Российской Федерации выплатить заявителям различные суммы от 6 000 до 12 000 евро в качестве компенсации морального вреда.

On September 17, 2019, on an application filed by the applicants, the Court unanimously ruled that the Government violated the requirements of Article 5 § 1 of the Convention (right to liberty and security of person), Article 8 of the Convention (right to respect for private and family life), Article 2 Protocol No. 1 to the Convention (the right to education) and that the authorities of the Republic of Moldova did not commit any violation of the Convention, and ordered the authorities of the Russian Federation to pay the applicants various amounts from 6,000 to 12,000 euros in respect of moral Foot injury.

По делу успешно рассмотрена жалоба на условия содержания заявителя под стражей, незаконность заключения под стражу и неправомерность изъятия у заявителя транспортного средства. По делу допущено нарушение статьи 3 Конвенции о защите прав человека и основных свобод (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 1 Протокола N 1 к Конвенции (право на защиту собственности).

 

В своей жалобе заявитель жаловался на условия его содержания под стражей, на незаконность заключения под стражу и на неправомерность изъятия у него транспортного средства.

 

17 сентября 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что власти Республики Молдова нарушили требования статьи 3 Конвенции (запрещение пыток), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), статьи 1 Протокола N 1 к Конвенции (право на защиту собственности) и что власти Российской Федерации нарушили требования статьи 3 Конвенции, пункта 1 статьи 5 Конвенции, статьи 1 Протокола N 1 к Конвенции.

 

17 сентября 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что власти Республики Молдова должны выплатить заявителю 5 600 евро в качестве компенсации морального вреда и 700 евро в качестве компенсации судебных расходов и издержек, а власти Российской Федерации - 9 500 евро в качестве компенсации морального вреда и 1 200 евро в качестве компенсации судебных расходов и издержек.

On September 17, 2019, in an application filed by the applicant, the European Court unanimously decided that the authorities of the Republic of Moldova should pay the applicant EUR 5,600 in respect of non-pecuniary damage and EUR 700 in respect of costs and expenses, and the Russian authorities - EUR 9,500 in in respect of non-pecuniary damage and 1,200 euros in respect of costs and expenses.
