Постановление ЕСПЧ от 08 октября 2019 года по делу "Капустин (Kapustin) против Российской Федерации" (жалоба N 36801/09).

В 2009 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

По делу успешно рассмотрена жалоба на незаконное и необоснованное прерывание одиночного пикета заявителя против "правящей партии", а также то, что заявитель был доставлен в отдел полиции и затем содержался там без составления протокола. По делу допущено нарушение требований статей 5 и 10 Конвенции о защите прав человека и основных свобод.

В своей жалобе заявитель жаловался на незаконное и необоснованное прерывание его одиночного пикета против "правящей партии", что он был доставлен в отдел полиции и затем содержался там без составления протокола.

08 октября 2019 года, по жалобе, поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 5 (право на свободу и личную неприкосновенность) 10 Конвенции (право на свободу выражения мнения), и обязал власти государства-ответчика выплатить заявителю 2 000 евро в качестве компенсации морального вреда.

The ECHR judgment of 08 October 2019 in the case of “Kapustin (v. Kapustin) v. Russian Federation” (application No. 36801/09).

In 2009, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

The case has successfully examined the application about the unlawful and unreasonable interruption of the applicant’s picket against the “ruling party”, as well as the fact that the applicant was taken to the police department and then kept there without drawing up a protocol. The case has violated the requirements of Articles 5 and 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In his application, the applicant complained about the unlawful and unjustified interruption of his solitary picket against the “ruling party” that he had been taken to the police department and then detained there without drawing up a protocol.

On October 8, 2019, in an application lodged by the applicant, the Court unanimously ruled that in this case the authorities of the Russian Federation violated the requirements of Articles 5 (right to liberty and security of person) 10 of the Convention (right to freedom of expression), and ordered the authorities to defendant to pay the applicant 2,000 euros in respect of non-pecuniary damage.

Постановление ЕСПЧ от 08 октября 2019 года по делу "R.K. (R.K.) против Российской Федерации" (жалоба N 30261/17).

 

В 2017 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на то, что возвращение заявителя в Демократическую Республику Конго будет являться нарушением его права на жизнь и на запрет подвергаться жестокому обращению. Заявитель также утверждал, что его содержание под стражей было незаконным. По делу допущено нарушение требований подпункта "f" пункта 1 и пункта 4 статьи 5 Конвенции о защите прав человека и основных свобод. По делу не допущено нарушений статьи 3 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе заявитель жаловался на то, что его возвращение в Демократическую Республику Конго будет являться нарушением его права на жизнь и запрету подвергаться жестокому обращение. Он также утверждал, что его содержание под стражей было незаконным.

 

08 октября 2019 года, по жалобе, поданной заявителем, Европейский Суд единогласно постановил, что принудительное возвращение заявителя в Демократическую Республику Конго не приведет к нарушению статьи 3 Конвенции, однако, что имело место нарушение требований подпункта "f" пункта 1 и пункта 4 статьи 5 Конвенции (право на свободу и личную неприкосновенность), и обязал власти государства-ответчика выплатить заявителю 5 000 евро в качестве компенсации морального вреда.

The case has successfully examined the application that the applicant’s return to the Democratic Republic of the Congo would constitute a violation of his right to life and a ban on ill-treatment. The applicant also alleged that his detention was unlawful. The case has violated the requirements of subparagraph "f" of paragraph 1 and paragraph 4 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms. There are no violations of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his application, the complainant complained that his return to the Democratic Republic of the Congo would constitute a violation of his right to life and a ban on ill-treatment. He also claimed that his detention was unlawful.

 

On 08 October 2019, in an application lodged by the applicant, the Court unanimously decided that the forced return of the applicant to the Democratic Republic of the Congo would not result in a violation of Article 3 of the Convention, however, that there had been a violation of the requirements of paragraph 1 (f) and Article 5 (4) Convention (the right to liberty and security of person), and ordered the respondent Government to pay the applicant 5,000 euros in respect of non-pecuniary damage.

В 2011 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на нарушения прав заявителя на справедливое судебное разбирательство и на презумпцию невиновности, а также то, что суды государства-ответчика должным образом не мотивировали свои решения в отношении отклонения доказательств, представленных заявителем, которые могли бы оправдать его. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе заявитель жаловался на то, что суды государства-ответчика должным образом не мотивировали свои решения в отношении отклонения доказательств, представленных заявителем, которые могли бы оправдать его. Он также жаловался на нарушение его права на справедливое судебное разбирательство и права на презумпцию невиновности.

 

08 октября 2019 года, по жалобе, поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство) и что установление факта нарушения является достаточной справедливой компенсацией морального вреда, причиненного заявителю.

In 2011, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

 

The case has successfully examined the application about violations of the applicant’s rights to a fair trial and the presumption of innocence, as well as the fact that the courts of the respondent state did not properly motivate their decisions regarding the rejection of the evidence presented by the applicant that could justify him. The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his application, the applicant complained that the courts of the respondent State had not properly motivated their decisions in respect of the rejection of the evidence submitted by the applicant that could justify him. He also complained of a violation of his right to a fair trial and the right to the presumption of innocence.

 

On 08 October 2019, in an application lodged by the applicant, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 6 § 1 of the Convention (right to a fair trial) and that the finding of a violation constitutes sufficient just satisfaction for non-pecuniary damage to the applicant.
