Постановление ЕСПЧ от 17 декабря 2019 года по делу "Карабулин и другие (Karabulin and Others) против Российской Федерации" (жалоба N 50796/17 и три другие жалобы).

В 2017 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были оюъединены и коммуницированы Российской Федерации.

По делу успешно рассмотрены жалобы на то, что дела заявителей не были рассмотрены в течение разумного срока. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

В своих жалобах заявители жаловались на то, что их дела не были рассмотрены в течение разумного срока.

17 декабря 2019 года, по жалобам, поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство). Заявителям в качестве компенсации были присуждены различные суммы от 1 400 до 3 900 евро.

The ECHR judgment of December 17, 2019 in the case “Karabulin and Others v. The Russian Federation” (application No. 50796/17 and three applications).

In 2017, the applicants were assisted in preparing applications. Subsequently, the applications were united and communicated by the Russian Federation.

The case has successfully examined complaints that the applicants' cases were not examined within a reasonable time. The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In their applications, the applicants complained that their cases had not been examined within a reasonable time.

On December 17, 2019, according to the applications submitted by the applicants, the Court unanimously ruled that in the present case the Russian authorities had violated the requirements of Article 6 § 1 of the Convention (right to a fair trial). The applicants were awarded various amounts of EUR 1,400 to EUR 3,900 in compensation.

Постановление ЕСПЧ от 17 декабря 2019 года по делу "Яковлев (Yakovlev) против Российской Федерации" (жалоба N 44240/12 и две другие жалобы).

 

В 2012 году заявителю была оказана помощь в подготовке жалоб. Впоследствии жалобы были оюъединены и коммуницированы Российской Федерации.

 

По делу успешно рассмотрены жалобы на содержание заявителя в бесчеловечных условиях в отделении милиции, отсутствие у заявителя эффективного средства правовой защиты, отклонение ходатайства заявителя о пересмотре судебного решения без рассмотрения. По делу допущено нарушение требований статей 3, 13, пункта 1 статьи 5, пункта 1 и подпунктов "c", "d" пункта 3 статьи 6 Конвенции о защите прав человека и основных свобод.

 

В своих жалобах заявитель жаловался на то, что он содержался в бесчеловечных условиях в отделении милиции и что у него не было эффективного средства правовой защиты в этой связи. Заявитель также жаловался на отклонение его ходатайства о пересмотре судебного решения без рассмотрения.

 

17 декабря 2019 года, по жалобам, поданным заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 3 (запрещение пыток) и 13 Конвенции (право на эффективное средство правовой защиты), пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), пункта 1 и подпунктов "c", "d" пункта 3 статьи 6 Конвенции (право на справедливое судебное разбирательство), и обязал власти государства-ответчика выплатить заявителю 1 700 евро в качестве компенсации морального вреда.

In the case, applications about the applicant’s detention in inhuman conditions at the police station, the applicant’s lack of an effective remedy, the rejection of the applicant’s request for review of the court decision without consideration were successfully considered. The case has violated the requirements of Articles 3, 13, paragraph 1 of Article 5, paragraph 1 and subparagraphs “c”, “d” of paragraph 3 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his applications, the applicant complained that he was detained in inhuman conditions at the police station and that he did not have an effective remedy in this regard. The applicant also complained about the rejection of his application for review of the judgment without consideration.

 

On December 17, 2019, according to the applications submitted by the applicant, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Articles 3 (prohibition of torture) and 13 of the Convention (right to an effective remedy), Article 5 § 1 of the Convention (right liberty and security of person), paragraph 1 and subparagraphs “c”, “d” of paragraph 3 of Article 6 of the Convention (right to a fair trial), and ordered the respondent Government to pay the applicant EUR 1,700 in respect of non-pecuniary damage.

В 2015 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на то, что областной суд не уведомил заявителя о ходатайстве о пересмотре судебного решения, поданном начальником ГИБДД, и что в результате этого он был лишен возможности представить свои аргументы, а также что решение суда по его делу было необоснованным. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе заявитель жаловался на то, что областной суд не уведомил его о ходатайстве о пересмотре судебного решения, поданном начальником ГИБДД, и что в результате этого он был лишен возможности представить свои аргументы. Он также утверждал, что решение суда по его делу было необоснованным.

 

17 декабря 2019 года, по жалобе, поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство), и обязал власти государства-ответчика выплатить заявителю 1 000 евро в качестве компенсации морального вреда.

In 2015, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

 

In the case, the application was successfully examined that the regional court did not notify the applicant about the request for review of the court decision submitted by the head of the traffic police and that as a result he was deprived of the opportunity to present his arguments, as well as that the court decision in his case was unfounded. The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his application, the applicant complained that the regional court had not notified him of the request for a review of the judgment submitted by the head of the traffic police and that as a result he was unable to present his arguments. He also argued that the court decision in his case was unfounded.

 

On December 17, 2019, in an application lodged by the applicant, the Court unanimously ruled that in the present case the Government violated the requirements of Article 6 § 1 of the Convention (right to a fair trial) and ordered the respondent Government to pay the applicant EUR 1,000 in as compensation for non-pecuniary damage.
