Постановление Межамериканского суда по правам человека от 05 октября 2015 года по делу "Руано Торрес и другие (Ruano Torres et al.) против Сальвадора" (серия C, N 303).

Заявителю была оказана помощь в подготовке жалобы в Межамериканскую комиссию по правам человека (г. Вашингтон, США).

В последствии Межамериканская комиссия по правам человека передала жалобу заявителя для рассмотрения в Межамериканский суд по правам человека (г. Сан-Хосе, Коста-Рика). Затем жалоба была коммуницирована Сальвадору.

По делу успешно рассмотрена жалоба на нарушение презумпция невиновности и защиты через назначенного адвоката.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель Хосе Агапито Руано Торрес ( Agapito Ruano Torres) был осужден к 15 годам лишения свободы за похищение водителя общественного автобуса, несмотря на серьезные сомнения в том, являлся ли он в действительности лицом по прозвищу Эль-Чопо, который, согласно показаниям другого подследственного, предположительно участвовал в преступлении. В ходе уголовного разбирательства заявителю были назначены защитники. Во время опознания жертва преступления выразила уверенность в том, что заявитель был одним из тех, кто совершил преступление. Однако несколько раз во время разбирательства были представлены доказательства того, что заявитель не был человеком по прозвищу Эль-Чопо и что он ремонтировал школу в момент похищения. Судья первой инстанции и суд, вынесший приговор, отказали в принятии этого доказательства, поскольку оно было признано "несущественным", или в связи с истечением срока давности.

В судебном заседании потерпевший назвал всех присутствовавших обвиняемых в качестве ответственных за его похищение. Заявитель промолчал, но когда ему было предоставлено последнее слово, сказал, что он не является человеком по прозвищу Эль-Чопо.

5 октября 2001 г. суд объявил обвинительный приговор заявителю и другим обвиняемым как соучастникам совершения похищения. Назначенный заявителю защитник не обжаловал приговор. Заявитель подал три жалобы о пересмотре, которые были признаны неприемлемыми. 19 сентября 2014 г. суд оставил приговор без изменения после проведения проверочного слушания, которого потребовала защита, когда Межамериканская комиссия представила доклад по существу.

В разбирательстве дела в Межамериканском суде по правам человека (далее - Межамериканский суд) власти Сальвадора признали свою международную ответственность с полным принятием фактов и правовых вопросов, поставленных Межамериканской комиссией.

 

ВОПРОСЫ ПРАВА

 

(a) Пункт 2 статьи 8 (презумпция невиновности) Американской конвенции о правах человека (далее - АКПЧ) во взаимосвязи с пунктом 1 статьи 1 (обязательство соблюдать и обеспечивать права). С самого начала расследования и на всем протяжении уголовного разбирательства многие элементы порождали вопросы относительно тождества заявителя в качестве Эль-Чопо. Однако заявитель был осужден в отсутствие организации полицейскими, следственными или судебными органами минимальных разбирательств для устранения сомнений по поводу его личности или обеспечения явки человека, который в действительности мог быть Эль-Чопо. Межамериканский суд установил, что в ситуациях, где существуют разумные доводы о неучастии одного из обвиняемых в преступлении, презумпция невиновности должна возобладать.

Межамериканский суд также отметил, что два доказательства определили исход уголовного разбирательства: "единодушные и совпадающие показания" жертвы преступления и сообвиняемого, который выигрывал от применения принципа возможности. Межамериканский суд установил, что отсутствовало оправдание в уголовно-процессуальном смысле для получения показаний последнего на предварительной стадии без предоставления обвиняемым возможности осуществления своего права на защиту и перекрестный допрос. Межамериканский суд также указал на ограниченную доказательную ценность заявления сообвиняемого, если оно является единственным доказательством, на котором основано решение о признании виновным, поскольку оно объективно не будет достаточным для опровержения презумпции невиновности. Таким образом, обоснование виновности исключительно заявлением сообвиняемого в отсутствие других подкрепляющих элементов нарушало презумпцию невиновности. В этом деле другим доказательством, оцененным судом, было опознание заявителя на очной ставке и на публичном слушании. Однако власти государства-ответчика признали нарушения, допущенные при опознании, и что жертва преступления ранее видела обвиняемых в различных средствах массовой информации. Следовательно, Межамериканский суд пришел к выводу, что государство ответственно за нарушение презумпции невиновности.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований статьи 8 (вынесено единогласно).

(b) Пункт 1 статьи 8(1), подпункт "d" пункта 2 статьи 8 и подпункт "e" пункта 2 статьи 8 АКПЧ (право быть заслушанным и право на защиту посредством назначенного защитника) во взаимосвязи с пунктом 1 статьи 1 АКПЧ. Межамериканский суд подтвердил, что право на защиту является центральным компонентом справедливого судебного разбирательства. Он напомнил, что право на защиту осуществляется двумя способами в рамках уголовного разбирательства: (i) действиями обвиняемого, особенно возможностями дачи показаний не под присягой по поводу вменяемых ему деяний, и (ii) средствами технической защиты, адвоката, который консультирует подследственного. Подпункты "d" и "e" пункта 2 статьи 8 АКПЧ указывают, что обвиняемый имеет право "защищать себя лично или через посредство выбранного им самим защитника", а если он этого не сделал, имеет "неотъемлемое право на помощь со стороны защитника, предоставляемого государством с оплатой или безвозмездно, в зависимости от внутреннего законодательства".

Межамериканский суд установил, что, хотя эти положения создают различные варианты разработки механизмов, гарантирующих эти права, в уголовных делах, где техническая защита является неотчуждаемым правом, в связи со значимостью затронутых прав и намерением обеспечить равенство сторон и полное уважение презумпции невиновности, право на адвоката, осуществляющего техническую защиту для адекватного участия в разбирательстве, означает, что защитник, предоставляемый государством, не ограничен только делами, где отсутствуют средства. В этом отношении Межамериканский суд признал, что отличительная черта большинства государств - участников АКПЧ - это развитие институциональной структуры и публичной политики, которая обеспечивает на всех стадиях разбирательства неотчуждаемое право на техническую защиту в уголовном деле со стороны публичных защитников. Таким образом, государства способствуют обеспечению доступа к правосудию наиболее незащищенных лиц, по отношению к которым обычно действует выборочность уголовного разбирательства. Вместе с тем Межамериканский суд отметил, что назначение публичного защитника только для соблюдения процессуальной формальности равно непредоставлению технической защиты, следовательно, существенно, чтобы этот защитник действовал старательно с целью защищать процессуальные гарантии обвиняемого и воспрепятствовать умалению его прав и нарушению отношений доверия. Для этого Межамериканский суд установил, что публичная защита как средство, которым государство обеспечивает неотчуждаемое право каждого обвиняемого в преступлении на помощь защитника, должна иметь достаточные гарантии, позволяющие ей действовать эффективно и с равенством возможностей по отношению к стороне преследования. Государство должно принять все необходимые меры для соблюдения данного обязательства. Это включает наличие квалифицированных и обученных защитников, которые могут действовать с функциональной автономией.

Межамериканский суд отметил, что необходимо рассмотреть разбирательство в целом, если конкретное действие или бездействие не является столь серьезным, что само по себе составляет нарушение гарантии. Кроме того, он разъяснил, что несущественное несогласие со стратегией защиты или результат разбирательства не будет достаточным для умаления права на защиту, непростительная неосторожность или очевидная ошибка должны быть доказаны. В настоящем деле Межамериканский суд установил, что публичные защитники, представлявшие заявителя, не ссылались на ничтожность нарушений, допущенных при опознании, что являлось основанием для его осуждения, и не подали жалобу на его осуждение, что помешало ему добиться полного пересмотра приговора. Межамериканский суд заключил, что подобные упущения составляли нарушение неотчуждаемого права подсудимого на помощь защитника.

Межамериканский суд также отметил, что международная ответственность государства может возникать в связи с реакцией судебных органов на действия и бездействие публичного защитника. Судебные органы имели обязательство защиты и контроля для обеспечения того, чтобы право на защиту не стало иллюзорным вследствие неэффективной юридической помощи. Таким образом, международная ответственность государства возникает также, если непростительная неосторожность или явная ошибка защиты должна быть очевидной судебным органам или они будут информированы об этом и не примут необходимых и достаточных мер для предотвращения и/или устранения нарушения права на защиту.

В настоящем деле Межамериканский суд пришел к выводу, что грубые ошибки в деятельности публичных защитников и отсутствие адекватной и эффективной реакции судебных органов оставили заявителя в состоянии полной беззащитности, усугубленной тем фактом, что он был лишен свободы на протяжении всего уголовного разбирательства. При таких обстоятельствах Межамериканский суд установил, что заявитель не был заслушан с надлежащими гарантиями.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований статьи 8 Конвенции (вынесено единогласно).

(c) Другие нарушения прав, предусмотренных АКПЧ. Межамериканский суд также установил нарушения пунктов 1 и 2 статьи 5 (право на личную неприкосновенность и запрет пытки), пунктов 1, 3 и 6 статьи 7 (право на личную свободу) и пункта 1 статьи 25 (право на судебную защиту) АКПЧ во взаимосвязи с пунктом 1 статьи 1 АКПЧ в ущерб заявителю (вынесено единогласно).

Наконец, он установил нарушение пункта 1 статьи 5 АКПЧ (право на личную неприкосновенность) во взаимосвязи с пунктом 1 статьи 1 АКПЧ (ущерб его близким родственникам) (вынесено единогласно).

(d) Репарации. Межамериканский суд установил, что само по себе постановление составляет форму репарации, и обязал государство: (i) инициировать и эффективно провести в разумный срок расследование и уголовное разбирательство против виновных в предполагаемых актах пытки против заявителя; (ii) определить ответственность представителей публичной защиты, которые способствовали нарушению прав заявителя; (iii) обеспечить, чтобы обвинительный приговор, вынесенный заявителю, не имел юридической силы, и, следовательно, устранить все судебные, административные, уголовные или полицейские документы, существующие против него в таком разбирательстве; (iv) предоставить бесплатную психологическую помощь; (v) предоставить специальные знания в публичных учреждениях Сальвадора заявителю и его семье; (vi) опубликовать постановление; (vii) разместить доску на видном месте в штаб-квартире отдела публичной защиты во избежание повторения таких событий, как в настоящем деле; (viii) имплементировать обязательные и постоянные тренировочные программы, обращенные к внутригосударственной гражданской полиции по поводу принципов прав человека и норм, особенно о расследовании и документировании пытки; (ix) усилить отбор соответствующих публичных защитников и разработать протоколы для обеспечения эффективности публичной защиты в уголовном разбирательстве; (x) принять или усилить тренировочные программы, обращенные к публичным защитникам; (xi) выплатить суммы, предусмотренные в постановлении в качестве компенсации материального ущерба и морального вреда.

El fallo de la Corte Interamericana de Derechos Humanos de 5 de octubre de 2015 en el caso de “Ruano Torres y otros (Ruano Torres y otros) V. El Salvador” (Serie C, No. 303).

El solicitante recibió asistencia para preparar una queja ante la Comisión Interamericana de Derechos Humanos (Washington, EE. UU.).

Posteriormente, la Comisión Interamericana de Derechos Humanos remitió la queja del solicitante a la Corte Interamericana de Derechos Humanos (San José, Costa Rica) para su consideración. Luego la denuncia fue comunicada a Salvador.

Circunstancias del caso


El demandante, José Agapito Ruano Torres, fue sentenciado a 15 años de prisión por secuestrar a un conductor de autobús público, a pesar de las serias dudas sobre si en realidad era una persona apodada El Chopo, quien, según otra persona bajo investigación, supuestamente participó en el crimen. Durante el proceso penal, se designó un abogado para el solicitante. Durante la identificación, la víctima del delito expresó su confianza en que el solicitante era uno de los autores del delito. Sin embargo, varias veces durante el proceso se presentaron pruebas de que el solicitante no era un hombre apodado El Chopo y que estaba reparando la escuela al momento del secuestro. El 5 de octubre de 2001, el tribunal anunció la condena del solicitante y otros acusados ​​como cómplices del secuestro. El abogado designado por el solicitante no apeló la sentencia. El solicitante presentó tres quejas de revisión, que fueron declaradas inadmisibles. El 19 de septiembre de 2014, el tribunal confirmó el veredicto después de la audiencia de selección que la defensa solicitó cuando la Comisión Interamericana presentó un informe sustantivo.

En los procedimientos ante la Corte Interamericana de Derechos Humanos (en adelante, la Corte Interamericana de Justicia), las autoridades de El Salvador reconocieron su responsabilidad internacional con la plena aceptación de los hechos y asuntos legales planteados por la Comisión Interamericana.


PREGUNTAS DE LEY


(a) Sección 8, párrafo 2 (presunción de inocencia) de la Convención Americana sobre Derechos Humanos (en adelante, CADH) junto con la Sección 1, párrafo 1 (obligación de respetar y garantizar los derechos). Desde el comienzo de la investigación y durante todo el proceso penal, muchos elementos plantearon preguntas sobre la identidad del solicitante como El Chopo. Sin embargo, el solicitante fue condenado en ausencia de la organización de procedimientos mínimos por parte de las autoridades policiales, investigativas o judiciales para eliminar dudas sobre su identidad o para asegurar la apariencia de una persona que en realidad podría haber sido El Chopo. La Corte Interamericana determinó que en situaciones donde hay evidencia razonable de que uno de los acusados ​​no estuvo involucrado en el crimen, la presunción de inocencia debe prevalecer.

La Corte Interamericana también señaló que dos pruebas determinaron el resultado del proceso penal: el "testimonio unánime y concurrente" de la víctima del delito y el coacusado que se benefició de la aplicación del principio de oportunidad. La Corte Interamericana determinó que no había justificación en el sentido procesal penal para obtener el testimonio de este último en una etapa preliminar sin dar al acusado la oportunidad de ejercer su derecho de defensa y contrainterrogatorio. La corte interamericana también señaló el limitado valor probatorio de la declaración del acusado si es la única evidencia en la que se basa la decisión de condenar, ya que no sería objetivamente suficiente para refutar la presunción de inocencia. Por lo tanto, la justificación de la culpa únicamente por la declaración del coacusado en ausencia de otros elementos de apoyo viola la presunción de inocencia. En este caso, otra evidencia evaluada por el tribunal fue la identificación del solicitante en un enfrentamiento y en una audiencia pública. Sin embargo, el Gobierno demandado reconoció las violaciones cometidas durante la identificación y que la víctima había visto previamente a los acusados ​​en varios medios. En consecuencia, la Corte Interamericana concluyó que el estado era responsable de violar la presunción de inocencia.


RESOLUCIÓN


El caso ha violado los requisitos del Artículo 8 (entregado por unanimidad).

(b) Cláusula 1 del Artículo 8 (1), subpárrafo “d” del párrafo 2 del Artículo 8 y subpárrafo “e” del párrafo 2 del Artículo 8 de la CADH (el derecho a ser escuchado y el derecho a la defensa por un abogado defensor designado) en conjunción con el párrafo 1 del Artículo 1 de la ACCHR. La Corte Interamericana de Justicia afirmó que el derecho a la defensa es un componente central de un juicio justo. Recordó que el derecho de defensa se ejerce de dos maneras en el marco de los procesos penales: (i) las acciones del acusado, especialmente la posibilidad de presentar pruebas bajo juramento con respecto a sus presuntos actos, y (ii) la protección técnica, un abogado que asesora a la persona bajo investigación. Los subpárrafos "d" y "e" del párrafo 2 del artículo 8 de la AHRC indican que el acusado tiene el derecho de "defenderse en persona o mediante la asistencia legal de su elección", y si no lo ha hecho, tiene un "derecho inalienable a la asistencia de la asistencia legal provista por estado pagado o gratis, según la ley nacional".

De esta manera, los Estados contribuyen a garantizar el acceso a la justicia para las personas más vulnerables, que generalmente están sujetas a procesos penales selectivos. Al mismo tiempo, la Corte Interamericana señaló que el nombramiento de un defensor público solo para cumplir con la formalidad procesal es la falta de protección técnica, por lo tanto, es esencial que este defensor actúe diligentemente para defender las garantías procesales del acusado y evitar la derogación de sus derechos y la violación de la relación de confianza. Con este fin, la Corte Interamericana determinó que la defensa pública como un medio por el cual el Estado garantiza el derecho inalienable de toda persona acusada de un delito a la asistencia de un abogado debe tener garantías suficientes para que pueda actuar de manera efectiva y con igualdad de oportunidades en relación con el enjuiciamiento. El estado debe tomar todas las medidas necesarias para cumplir con esta obligación. Esto incluye tener defensores calificados y capacitados que puedan operar con autonomía funcional.

En el presente caso se alegó que la protección técnica brindada por el Estado no funcionó de manera efectiva. En El Salvador, el departamento de defensa pública formaba parte de la Oficina del Fiscal General. Como organismo estatal, su comportamiento debería haberse considerado como las acciones del estado. Sin embargo, la Corte Interamericana determinó que el Estado no podía ser considerado responsable de todas las deficiencias de la defensa pública a la luz de la independencia de la profesión y la opinión profesional del defensor. Además, señaló que como parte de la obligación del Estado de proporcionar protección pública adecuada, debe llevar a cabo una selección adecuada de defensores públicos, desarrollar el control sobre su trabajo y garantizar su capacitación periódica. Para evaluar una posible violación del derecho a la defensa por parte del Estado, la Corte Interamericana analizó si el acto u omisión constituía una negligencia imperdonable o un error obvio en la defensa, que tuvo o pudo haber tenido un efecto negativo decisivo en los intereses de los acusados. La Corte Interamericana señaló que es necesario considerar el proceso en su conjunto si la acción u omisión específica no es tan grave que en sí misma constituye una violación de la garantía. Además, aclaró que un desacuerdo menor con la estrategia de defensa o el resultado del proceso no sería suficiente para disminuir el derecho de defensa, la negligencia inexcusable o un error obvio debe ser probado. En el presente caso, la Corte Interamericana determinó que los defensores públicos que representaban al solicitante no invocaron la nulidad de las violaciones cometidas durante la identificación, que fue la base de su condena, y no presentaron una queja contra su condena, lo que le impidió obtener una revisión completa de la sentencia. La Corte Interamericana concluyó que tales omisiones constituían una violación del derecho inalienable del abogado del acusado.

La Corte Interamericana también señaló que la responsabilidad internacional del Estado puede surgir en relación con la reacción del poder judicial ante las acciones y omisiones de un defensor público. Las autoridades judiciales tenían la obligación de proteger y controlar para garantizar que el derecho a la defensa no se hiciera ilusorio debido a la asistencia jurídica ineficaz. Por lo tanto, la responsabilidad internacional del estado también surge si la negligencia imperdonable o un claro error de defensa deben ser obvios para las autoridades judiciales o se les informará al respecto y no tomarán las medidas necesarias y suficientes para prevenir y / o eliminar la violación del derecho a la defensa.

En el presente caso, la Corte Interamericana concluyó que los graves errores en las actividades de los defensores públicos y la falta de una respuesta judicial adecuada y efectiva dejaron al solicitante en un estado de total indefensión, agravado por el hecho de que fue privado de su libertad durante todo el proceso penal. En tales circunstancias, la Corte Interamericana determinó que el solicitante no había sido escuchado con las garantías adecuadas.


RESOLUCIÓN


El caso ha violado los requisitos del artículo 8 de la Convención (entregado por unanimidad).

(c) Otras violaciones de los derechos provistos por la CADH. La Corte Interamericana también encontró violaciones del artículo 5, párrafos 1 y 2 (derecho a la integridad personal y la prohibición de la tortura), artículo 7, párrafos 1, 3 y 6 (derecho a la libertad personal) y artículo 25, párrafo 1 (derecho a la protección judicial) de la ACCHR junto con párrafo 1 del artículo 1 de la CADH en detrimento del solicitante (por unanimidad).

Finalmente, encontró una violación del párrafo 1 del artículo 5 de la AHRC (derecho a la integridad personal) en relación con el párrafo 1 del artículo 1 de la AHRC (daño a sus parientes cercanos) (por unanimidad).

(d) Reparaciones. La Corte Interamericana determinó que el fallo en sí mismo constituye una forma de reparación y ordenó al estado: (i) iniciar y llevar a cabo de manera efectiva, en un plazo razonable, una investigación y un proceso penal contra los responsables de presuntos actos de tortura contra el solicitante; (ii) determinar la responsabilidad de los representantes de defensa pública que contribuyeron a la violación de los derechos del solicitante; (iii) garantizar que la condena impuesta al solicitante no sea legalmente vinculante y, por lo tanto, eliminar todos los documentos judiciales, administrativos, penales o policiales existentes en su contra en dichos procedimientos; (iv) proporcionar asistencia psicológica gratuita; (v) proporcionar conocimientos especializados en las instituciones públicas de El Salvador al solicitante y su familia; (vi) publicar la decisión; (vii) colocar el tablero en un lugar visible en la sede del departamento de defensa pública para evitar la repetición de eventos como en el presente caso; (viii) implementar programas de capacitación obligatorios y continuos que apelen a la policía civil nacional en relación con los principios y normas de derechos humanos, especialmente con respecto a la investigación y documentación de la tortura; (ix) fortalecer la selección de defensores públicos relevantes y desarrollar protocolos para asegurar la efectividad de la defensa pública en los procesos penales; (x) adoptar o fortalecer programas de capacitación dirigidos a defensores públicos; (xi) pagar los montos previstos en el reglamento con respecto a daños materiales e inmateriales.

The applicant was assisted in preparing a complaint to the Inter-American Commission on Human Rights (Washington, USA).

Presumption of innocence and defense through a designated lawyer.


Circumstances of the case


The applicant, José Agapito Ruano Torres, was sentenced to 15 years in prison for abducting a public bus driver, despite serious doubts as to whether he was in fact a person nicknamed El Chopo, who, according to another prisoner, was allegedly participated in the crime. During the criminal proceedings, counsel were appointed for the applicant. During the identification, the victim of the crime expressed confidence that the applicant was one of the perpetrators of the crime. However, several times during the proceedings evidence was presented that the applicant was not a man nicknamed El Chopo and that he was repairing the school at the time of the abduction. The trial judge and the sentencing court refused to accept this evidence because it was declared “immaterial” or because the statute of limitations had expired.

At the hearing, the victim named all the defendants present as responsible for his abduction. The applicant was silent, but when he was given the last word, he said that he was not a man nicknamed El Chopo.

On 5 October 2001 the court announced the conviction of the applicant and other defendants as accomplices to the abduction. The counsel appointed by the applicant did not appeal the sentence. The applicant filed three review complaints, which were declared inadmissible. On September 19, 2014, the court upheld the verdict after the screening hearing that the defense requested when the Inter-American Commission submitted a substantive report.

In the proceedings before the Inter-American Court of Human Rights (hereinafter referred to as the Inter-American Court of Justice), the authorities of El Salvador recognized their international responsibility with full acceptance of the facts and legal issues raised by the Inter-American Commission.


QUESTIONS OF LAW


(a) Section 8, paragraph 2 (presumption of innocence) of the American Convention on Human Rights (hereinafter - ACHR) in conjunction with Section 1, paragraph 1 (obligation to respect and ensure rights). From the very beginning of the investigation and throughout the criminal proceedings, many elements raised questions regarding the identity of the applicant as El Chopo. However, the applicant was convicted in the absence of the organization of minimum proceedings by the police, investigative or judicial authorities to eliminate doubts about his identity or to ensure the appearance of a person who in reality could have been El Chopo. The Inter-American Court found that in situations where there is reasonable evidence that one of the defendants was not involved in the crime, the presumption of innocence should prevail.

The Inter-American Court also noted that two evidence determined the outcome of the criminal proceedings: the “unanimous and concurring testimony” of the victim of the crime and the co-accused who benefited from the application of the principle of opportunity. The Inter-American Court found that there was no justification in the criminal procedural sense for obtaining the latter’s testimony at a preliminary stage without giving the accused the opportunity to exercise their right to defense and cross-examination. The Inter-American court also pointed out the limited evidentiary value of the accused’s statement if it is the only evidence on which the decision to convict is based, since it would not objectively be sufficient to refute the presumption of innocence. Thus, the justification of guilt solely by the statement of the co-accused in the absence of other supporting elements violated the presumption of innocence. In this case, another evidence assessed by the court was the applicant’s identification at a confrontation and at a public hearing. However, the respondent Government acknowledged the violations committed during the identification and that the victim had previously seen the defendants in various media. Consequently, the Inter-American Court concluded that the state was responsible for violating the presumption of innocence.


RESOLUTION


The case has violated the requirements of Article 8 (delivered unanimously).

(b) Clause 1 of Article 8 (1), subparagraph “d” of paragraph 2 of Article 8 and subparagraph “e” of paragraph 2 of Article 8 of the ACHR (the right to be heard and the right to defense by an appointed defense counsel) in conjunction with paragraph 1 of Article 1 of the ACCHR. The Inter-American Court of Justice affirmed that the right to a defense is a central component of a fair trial. He recalled that the right to defense is exercised in two ways in the framework of criminal proceedings: (i) the actions of the accused, especially the possibility of giving evidence under oath regarding his alleged acts, and (ii) technical protection, a lawyer who advises the person under investigation. Subparagraphs “d” and “e” of paragraph 2 of Article 8 of the AHRC indicate that the accused has the right to “defend himself in person or through legal assistance of his own choosing”, and if he has not done so, he has an “inalienable right to assistance from the legal assistance provided by paid or gratis state, depending on domestic law."

The Inter-American Court found that although these provisions create various options for developing mechanisms to guarantee these rights in criminal cases where technical protection is an inalienable right, due to the significance of the rights involved and the intention to ensure equality of arms and full respect for the presumption of innocence, the right to a lawyer providing technical protection for adequate participation in the proceedings means that the defense counsel provided by the state is not limited only to cases where there are no funds. In this regard, the Inter-American Court found that a distinctive feature of most of the States parties to the AHRC is the development of an institutional structure and public policy that ensures at all stages of the proceedings the inalienable right to technical defense in a criminal case by public defenders. In this way, States contribute to ensuring access to justice for the most vulnerable people, who are usually subject to selective criminal proceedings. At the same time, the Inter-American Court noted that the appointment of a public defender only to comply with the procedural formality is the failure to provide technical protection, therefore, it is essential that this defender act diligently in order to defend the procedural guarantees of the accused and prevent the derogation of his rights and violation of the relationship of trust. To this end, the Inter-American Court found that public defense as a means by which the state ensures the inalienable right of every person accused of a crime to the assistance of a lawyer must have sufficient guarantees to enable it to act effectively and with equal opportunities in relation to the prosecution. The state must take all necessary measures to comply with this obligation. This includes having qualified and trained advocates who can operate with functional autonomy.

In the present case it was alleged that the technical protection provided by the State did not work effectively. In El Salvador, the public defense department was part of the Office of the Attorney-General. As a state body, his behavior should have been considered as the actions of the state. However, the Inter-American Court found that the state could not be held responsible for all the shortcomings of public defense in the light of the independence of the profession and professional opinion of the defender. In addition, he indicated that, as part of the State’s obligation to provide adequate public protection, it should carry out appropriate selection of public defenders, develop control over their work and ensure their periodic training. To assess a possible violation of the right to defense by the state, the Inter-American Court analyzed whether the act or omission constituted an unforgivable negligence or an obvious error in the defense, which had or could have had a decisive negative effect on the interests of the accused. The Inter-American Court noted that it is necessary to consider the proceedings as a whole if the specific action or omission is not so serious that in itself constitutes a violation of the guarantee. In addition, he clarified that a minor disagreement with the defense strategy or the outcome of the proceedings would not be sufficient to diminish the right to defense, inexcusable negligence or an obvious mistake should be proved. In the present case, the Inter-American Court found that the public defenders representing the applicant did not invoke the nullity of the violations committed during the identification, which was the basis for his conviction, and did not file a complaint against his conviction, which prevented him from obtaining a full review of the sentence. The Inter-American Court concluded that such omissions constituted a violation of the defendant's inalienable right to counsel.

The Inter-American Court also noted that international responsibility of the state may arise in connection with the reaction of the judiciary to the actions and omissions of a public defender. The judiciary had an obligation to protect and control to ensure that the right to a defense did not become illusory due to ineffective legal assistance. Thus, the international responsibility of the state also arises if the unforgivable negligence or a clear mistake of defense should be obvious to the judicial authorities or they will be informed about it and will not take the necessary and sufficient measures to prevent and / or eliminate the violation of the right to defense.

In the present case, the Inter-American Court concluded that gross errors in the activities of public defenders and the lack of an adequate and effective judicial response left the applicant in a state of complete defenselessness, aggravated by the fact that he was deprived of his liberty throughout the criminal proceedings. In such circumstances, the Inter-American Court found that the applicant had not been heard with adequate guarantees.


RESOLUTION


The case has violated the requirements of Article 8 of the Convention (delivered unanimously).

(c) Other violations of the rights provided by the ACHR. The Inter-American Court also found violations of article 5, paragraphs 1 and 2 (right to personal integrity and the prohibition of torture), article 7, paragraphs 1, 3 and 6 (right to personal freedom) and article 25, paragraph 1 (right to judicial protection) of the ACCHR in conjunction with paragraph 1 of Article 1 of the ACHR to the detriment of the applicant (unanimously).

Finally, he found a violation of paragraph 1 of article 5 of the AHRC (right to personal integrity) in conjunction with paragraph 1 of article 1 of the AHRC (damage to his close relatives) (unanimously).

(d) Reparations. The Inter-American Court found that the ruling itself constitutes a form of reparation, and ordered the state: (i) to initiate and effectively conduct, within a reasonable time, an investigation and criminal proceedings against those responsible for alleged acts of torture against the applicant; (ii) determine the liability of the public defense representatives who contributed to the violation of the applicant's rights; (iii) ensure that the conviction imposed on the applicant is not legally binding and, therefore, eliminate all judicial, administrative, criminal or police documents existing against him in such proceedings; (iv) provide free psychological assistance; (v) provide specialized knowledge in the public institutions of El Salvador to the applicant and his family; (vi) publish the decision; (vii) place the board in a conspicuous place at the headquarters of the public defense department in order to avoid recurrence of events such as in the present case; (viii) implement compulsory and ongoing training programs that appeal to the domestic civilian police regarding human rights principles and norms, especially regarding the investigation and documentation of torture; (ix) strengthen the selection of relevant public defenders and develop protocols to ensure the effectiveness of public defense in criminal proceedings; (x) adopt or strengthen training programs addressed to public defenders; (xi) pay the amounts provided for in the regulation in respect of pecuniary and non-pecuniary damage.
