Постановление ЕСПЧ от 30 января 2020 года по делу "Винкс и Рибицка (Vinks and Ribicka) против Латвии" (жалоба N 28926/10).

В 2010 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Латвии.

По делу успешно рассмотрена жалоба на обыск, проведенный в доме заявителей в рамках расследования экономических преступлений, без предоставления каких-либо гарантий против злоупотреблений. По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

В рамках расследования экономических преступлений полиция провела обыск в доме заявителей с участием сотрудников специального антитеррористического подразделения: вооруженные сотрудники специального полицейского подразделения "Омега" проникли в дом заявителей через окна, а за ними в дом зашли сотрудники финансовой полиции (VID FPP), которые провели обыск.

Заявители жаловались, inter alia, на то, что обыск и участие сотрудников специального подразделения были оправданы не какими-либо фактическими обстоятельствами, а стремлением отомстить заявителю в связи с тем, что ранее он выступал свидетелем по делу о коррупции, обвиняемыми по которому проходили два сотрудника финансовой полиции.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 8 Конвенции. Риск злоупотребления полномочиями и унижение человеческого достоинства особенно возможны в таких ситуациях, как в настоящем деле, не только потому, что вторжение в личную сферу заявителей было серьезным (см. ниже), но и поскольку ходатайство о вмешательстве со стороны антитеррористического подразделения исходило от их коллег, в отношении которых расследовалось уголовное дело по факту совершения преступлений, связанных с коррупцией. Заявитель дал показания против данных сотрудников, а обыск проводился тем же отделом финансовой полиции, в котором работали эти сотрудники.

В связи с отсутствием гарантий в настоящем деле оспариваемое вмешательство не могло быть признано соразмерным преследуемой цели по нижеследующим причинам.

(a) Недостатки при проведении обыска. Ни одна из гарантий, предусмотренных законодательством Латвии, как представляется, не обеспечивала заявителям эффективной защиты. Данные гарантии были таковыми:

(i) предварительный судебный контроль. Ходатайство финансовой полиции о разрешении на проведение обыска было основано на подозрении о том, что заявитель был замешан в масштабном уклонении от уплаты налогов и отмывании денег, в которых участвовало более 60 компаний. Эти подозрения были основаны на материалах уголовного дела, а производству по нему предшествовала оперативная проверка данных фактов.

Основной довод заявителя заключался в том, что он не был связан с какой-либо из компаний, которые участвовали в совершении соответствующих преступлений. У Европейского Суда не было возможности установить, была ли такая позиция обоснованной. Однако расследование уголовного дела, которое было возбуждено в отношении заявителя, продолжалось более 10 лет и оставалось на стадии предварительного расследования, которое осуществлялось тем же отделом полиции, сотрудники которого провели обыск.

Необходимо отметить, что следственный судья рассмотрел материалы представленного ему дела. Однако он не указал факторы, которые связывали заявителя с компаниями, в отношении которых проводилось расследование. В своем анализе председатель соответствующего суда не отреагировал на доводы, специально озвученные заявителем в этом отношении.

(ii) Последующий контроль со стороны прокуроров. Хотя прокуроры разных уровней несколько раз рассматривали материалы дела и запрашивали дополнительную информацию от различных органов полиции, они в значительной степени ссылались на выводы, представленные этими же органами, действия которых прокуроры должны были проверять, и пришли к выводу, что содействие специального полицейского подразделения было оправдано и что сотрудники подразделения "Омега" действовали в соответствии с внутренними правилами и "с учетом обстоятельств".

Поскольку прокуроры не ответили на конкретные доводы заявителей и не предоставили какой-либо дальнейшей информации, контроль со стороны прокуратуры в отношении содействия специального полицейского подразделения не обеспечил эффективной защиты в настоящем деле.

(b) Отсутствие правовых оснований для участия в обыске сотрудников специального полицейского подразделения. Содействие антитеррористического подразделения "Омега" было запрошено финансовой полицией как часть более масштабной операции. Однако хотя данная операция включала в себя одновременное проведение 19 обысков, содействие специально обученных и вооруженных сотрудников было запрошено только для двух обысков, в том числе для обыска в доме заявителя.

Лишь веские причины могли оправдать такое серьезное вмешательство в личную жизнь заявителей, как принудительное проникновение ранним утром в жилище через окна с использованием мер принуждения и оружия в отношении заявителей и несовершеннолетней дочери заявительницы.

Европейскому Суду не стоит строить предположения относительно элементов, на которые ссылались соответствующие органы для обоснования необходимости участия сотрудников антитеррористического подразделения "Омега" в проведении обыска в доме заявителей. Вместе с тем предполагаемое присутствие вооруженных лиц или сторожевых собак в помещении или возможность обнаружения огнестрельного оружия в ходе обыска, на которые делались ссылки, как представляется, были либо необоснованными, либо относились к другому подозреваемому.

Можно согласиться с тем, что участие специальных подразделений полиции могло считаться необходимым при определенных обстоятельствах. Однако простая ссылка на общие положения о координации между различными органами власти или на внутренние правила антитеррористического подразделения "Омега" в той мере, в какой сотрудники последнего оказывали правоохранительным органам помощь в затруднительных ситуациях, не были достаточными, по мнению Европейского Суда, для того, чтобы создать правовую базу, способную предоставить надлежащие эффективные гарантии от злоупотреблений и произвола.

Такие гарантии могут включать в себя принятие мер регулирования, которые ограничивают использование специальных сил ситуациями, когда обычное вмешательство со стороны полиции не может считаться безопасным и достаточным, а также предоставляют дополнительные гарантии (см. для сравнения Постановление Европейского Суда по делу "Кучера против Словакии" (Kučera v. Slovakia) от 17 июля 2007 г., жалоба N 48666/99).

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил каждому из заявителей по 1 500 евро в качестве компенсации морального вреда, требования заявительницы о возмещении материального ущерба были отклонены.

2010. gadā pieteikuma iesniedzējs saņēma palīdzību sūdzības sagatavošanā. Pēc tam sūdzība tika nosūtīta Latvijai.

Lieta veiksmīgi adresēja sūdzību par kratīšanu iesniedzēju mājā ekonomisko noziegumu izmeklēšanas ietvaros, nesniedzot nekādas garantijas pret ļaunprātīgu izmantošanu. Lieta pārkāpa Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 8. panta prasības.


LIETAS APSTĀKĻI


Ekonomisko noziegumu izmeklēšanas ietvaros policija veica kratīšanu iesniedzēju mājā, piedaloties īpašās pretterorisma vienības virsniekiem: īpašās policijas vienības “Omega” bruņotie darbinieki ienāca iesniedzēju mājā pa logiem, pēc tam sekoja finanšu policijas darbinieki (VID FPP), kuri veica kratīšanu. ...

Iesniedzēji cita starpā sūdzējās, ka īpašās vienības virsnieku meklēšanu un dalību neattaisno nekādi faktiski apstākļi, bet gan vēlme atriebties iesniedzējam saistībā ar to, ka viņš iepriekš bija liecinieks korupcijas lietā, kurā tika apsūdzēti divi virsnieki. finanšu policija.


LIKUMU JAUTĀJUMI


Atbilstība konvencijas 8. pantam. Iestāžu ļaunprātīgas izmantošanas un cilvēka cieņas pazemināšanas risks ir īpaši iespējams tādās situācijās kā šajā gadījumā ne tikai tāpēc, ka prasītāju privātums bija nopietni iejaukts (sk. Turpmāk), bet arī tāpēc, ka pretterorisma vienības iejaukšanās iemesls bija viņu kolēģiem. , attiecībā uz kuru tika izmeklēta krimināllieta par ar korupciju saistītu noziegumu izdarīšanas faktu. Iesniedzējs sniedza liecības pret šiem darbiniekiem, un kratīšanu veica tā pati finanšu policijas nodaļa, kurā šie darbinieki strādāja.

Tā kā šajā gadījumā nav garantiju, apstrīdēto iejaukšanos nevar uzskatīt par samērīgu ar izvirzīto mērķi šādu iemeslu dēļ.

a) Pārmeklēšanas nepilnības. Neviena no Latvijas likumos paredzētajām garantijām neparādīja pretendentiem efektīvu aizsardzību. Šīs garantijas bija šādas:

i) iepriekšēja tiesas pārbaude. Finanšu policijas lūgums par atļauju veikt kratīšanu tika pamatots ar aizdomām, ka iesniedzējs bija iesaistīts liela mēroga nodokļu nemaksāšanā un naudas atmazgāšanā, iesaistot vairāk nekā 60 uzņēmumus. Šīs aizdomas tika pamatotas ar krimināllietas materiāliem, un pirms lietas izskatīšanas tika veikta šo faktu operatīva pārbaude.

Iesniedzēja galvenais arguments bija, ka viņš nebija saistīts ar nevienu no uzņēmumiem, kas bija iesaistīti attiecīgajos noziegumos. Tiesa nespēja noteikt, vai šāda nostāja ir pamatota. Tomēr krimināllietas izmeklēšana, kas tika uzsākta pret iesniedzēju, ilga vairāk nekā 10 gadus un palika sākotnējās izmeklēšanas stadijā, kuru veica tas pats policijas departaments, kura darbinieki veica kratīšanu.

Jāatzīmē, ka izmeklēšanas tiesnesis pārbaudīja viņam iesniegtos lietas materiālus. Tomēr viņš nenorādīja faktorus, kas prasītāju saistīja ar uzņēmumiem, attiecībā uz kuriem tika veikta izmeklēšana. Veicot analīzi, attiecīgās tiesas priekšsēdētājs neatbildēja uz argumentiem, ko šajā sakarā īpaši paudis iesniedzējs.

ii) Prokuroru veiktā pēcpārbaude. Lai gan dažādu līmeņu prokurori vairākkārt pārskatīja lietas materiālus un pieprasīja papildu informāciju no dažādām policijas iestādēm, viņi ļoti paļāvās uz secinājumiem, ko iesniegušas tās pašas iestādes, kuru rīcību prokuroriem vajadzēja pārbaudīt, un secināja, ka īpašās policijas vienības palīdzība ir pamatota. un ka Omega darbinieki rīkojās saskaņā ar iekšējiem noteikumiem un “ņemot vērā apstākļus”.

Tā kā prokurori neatbildēja uz iesniedzēju konkrētajiem argumentiem vai nesniedza papildu informāciju, prokurora kontrole pār īpašās policijas vienības palīdzību šajā lietā nenodrošināja efektīvu aizstāvību.

b) Juridiskā pamata trūkums dalībai īpašās policijas vienības virsnieku meklēšanā. Plašākas operācijas ietvaros Finanšu policija lūdza palīdzību Omega pretteroristu vienībai. Lai gan šī operācija ietvēra 19 vienlaicīgus meklējumus, speciāli apmācītu un bruņotu virsnieku palīdzība tika lūgta tikai divos meklējumos, ieskaitot meklēšanu pieteikuma iesniedzēja mājās.

Tikai nopietni iemesli varēja attaisnot tik nopietnu iejaukšanos iesniedzēju privātajā dzīvē, piemēram, piespiedu ienākšana mājā caur logiem agrā rītā, izmantojot piespiedu līdzekļus un ieročus pret iesniedzējiem un iesniedzēja nepilngadīgo meitu.

Tiesai nevajadzētu spekulēt par elementiem, uz kuriem atsaucas attiecīgās iestādes, lai pamatotu Omega pretteroristu vienības dalību prasītāju mājas meklēšanā. Tomēr apgalvotā bruņoto personu vai apsardzes suņu klātbūtne telpās vai iespēja kratīšanas laikā atrast šaujamieročus, uz kuriem tika norādīts, izrādījās vai nu nepamatota, vai saistīta ar citu aizdomās turēto.

Var piekrist, ka noteiktos apstākļos īpašu policijas vienību iesaisti varētu uzskatīt par nepieciešamu. Tomēr ar Tiesas uzskatiem nepietika tikai ar atsauci uz vispārīgiem noteikumiem par koordināciju starp dažādām iestādēm vai uz pretterorisma vienības Omega iekšējiem noteikumiem, ciktāl tā sniedza palīdzību tiesībaizsardzības aģentūrām sarežģītās situācijās. jāizveido tiesiskais regulējums, kas spēj nodrošināt adekvātas un efektīvas garantijas pret ļaunprātīgu izmantošanu un patvaļu.

Šādos aizsardzības pasākumos var ietilpt tādu regulatīvu pasākumu pieņemšana, kas ierobežo speciālo spēku izmantošanu situācijās, kad parastu policijas iejaukšanos nevar uzskatīt par drošu un pietiekamu, kā arī nodrošina papildu aizsardzības pasākumus (sk. REZOLŪCIJA


Lietā tika pārkāpts Konvencijas 8. pants (pieņemts vienbalsīgi).


KOMPENSĀCIJA


Konvencijas 41. panta piemērošana. Tiesa katram pretendentam piešķīra EUR 1500 par morālo kaitējumu, bet iesniedzēja prasības par morālo kaitējumu tika noraidītas.

Judgment of the ECHR of January 30, 2020 in the case Vinks and Ribicka v. Latvia (application no. 28926/10).

In 2010, the applicant received assistance in preparing an application. Subsequently, the application was communicated to Latvia.

The case successfully addressed an application about a search carried out in the applicants' house as part of an investigation of economic crimes, without providing any guarantees against abuse. The case violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.


THE CIRCUMSTANCES OF THE CASE


As part of the investigation of economic crimes, the police conducted a search of the applicants 'house with the participation of officers of the special anti-terrorist unit: armed officers of the special police unit "Omega" entered the applicants' house through the windows, followed by the financial police officers (VID FPP) who searched ...

The applicants complained, inter alia, that the search and the participation of the special unit officers were not justified by any factual circumstances, but by a desire to take revenge on the applicant in connection with the fact that he had previously been a witness in a corruption case in which two officers were accused financial police.


QUESTIONS OF LAW


Compliance with Article 8 of the Convention. The risk of abuse of authority and humiliation of human dignity is especially possible in situations such as in the present case, not only because the intrusion into the applicants' privacy was serious (see below), but also because the request for intervention by the anti-terrorist unit came from their colleagues , in respect of whom a criminal case was investigated on the fact of committing crimes related to corruption. The applicant testified against these officers and the search was carried out by the same department of the financial police where these officers worked.

Due to the lack of guarantees in the present case, the impugned interference could not be considered proportionate to the aim pursued for the following reasons.

(a) Deficiencies in the search. None of the guarantees provided for by Latvian law appeared to provide the applicants with effective protection. These guarantees were as follows:

(i) preliminary judicial review. The Financial Police's request for permission to conduct the search was based on the suspicion that the applicant was involved in large-scale tax evasion and money-laundering involving more than 60 companies. These suspicions were based on the materials of the criminal case, and the proceedings on it were preceded by an operational verification of these facts.

The applicant's main argument was that he was not associated with any of the companies that were involved in the relevant crimes. The Court was unable to establish whether such a position was justified. However, the investigation of the criminal case that had been opened against the applicant lasted more than 10 years and remained at the stage of preliminary investigation, which was carried out by the same police department whose officers carried out the search.

It should be noted that the investigating judge examined the materials of the case presented to him. However, he did not indicate the factors that linked the applicant to the companies in respect of which the investigation was carried out. In his analysis, the president of the relevant court did not respond to the arguments specifically voiced by the applicant in this regard.

(ii) Follow-up control by prosecutors. Although prosecutors at various levels reviewed the case file on several occasions and requested additional information from various police authorities, they relied heavily on the findings presented by the same authorities, whose actions the prosecutors were supposed to verify, and concluded that the assistance of the special police unit was justified. and that Omega staff acted in accordance with internal rules and “taking into account the circumstances”.

Since the prosecutors did not respond to the applicants' specific arguments or provide any further information, the prosecutor's control over the assistance of the special police unit did not provide an effective defense in the present case.

(b) Lack of legal grounds for participating in the search of the officers of the special police unit. The assistance of the Omega Anti-Terrorist Unit was requested by the Financial Police as part of a larger operation. However, although this operation involved 19 simultaneous searches, the assistance of specially trained and armed officers was requested for only two searches, including the search at the applicant's house.

Only compelling reasons could justify such a serious interference with the applicants' private life, such as the forced entry into the house through the windows in the early morning using coercive measures and weapons against the applicants and the applicant's minor daughter.

The Court should not speculate about the elements relied on by the relevant authorities to justify the need for the participation of the Omega anti-terrorist unit in the search of the applicants' house. However, the alleged presence of armed persons or guard dogs in the premises or the possibility of finding firearms during the search, to which the references were made, appeared to be either unfounded or related to another suspect.

It can be agreed that the involvement of special police units could be considered necessary under certain circumstances. However, a mere reference to general provisions on coordination between different authorities or to the internal rules of the Omega anti-terrorist unit, insofar as the latter provided assistance to law enforcement agencies in difficult situations, was not sufficient, in the Court's opinion, to ensure that create a legal framework capable of providing adequate and effective safeguards against abuse and arbitrariness.

Such safeguards may include the adoption of regulatory measures that restrict the use of special forces to situations where ordinary police intervention cannot be considered safe and sufficient, as well as provide additional safeguards (see, for comparison, Kucera v. Slovakia) (Kučera v. Slovakia) dated 17 July 2007, application no. 48666/99).


RESOLUTION


There was a violation of Article 8 of the Convention in the case (adopted unanimously).


COMPENSATION


Application of Article 41 of the Convention. The Court awarded each of the applicants EUR 1,500 in respect of non-pecuniary damage; the applicant's claims for pecuniary damage were dismissed.

В 2009 году заявителям была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Литве.

 

По делу успешно рассмотрена жалоба на политическое вмешательство и процессуальные недостатки с целью помешать предписанному судом возвращению ребенка, незаконно удерживаемого другим родителем на территории иностранного государства. По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявителями по делу являются гражданин Германии (заявитель) и его дочь (заявительница), которая родилась в 2005 году от брака с гражданкой Литвы. В 2006 году последняя покинула Германию, чтобы отвезти дочь в Литву на каникулы, но больше она не вернулась в Германию. За этим последовали следующие судебные процессы:

 

(1) в Германии: заявитель обратился в суд, который вынес решение о назначении его временным опекуном и о возвращении ему дочери. В 2007 году было вынесено решение о разводе супругов, и заявителю была предоставлена постоянная опека над дочерью.

 

(2) В Литве (где дело широко обсуждалось как на политическом уровне, так и в средствах массовой информации):

 

- в октябре 2006 года заявитель обратился в суд с ходатайством о возвращении дочери на основании Гаагской конвенции о гражданских аспектах международных похищений детей от 25 октября 1980 г. (далее - Гаагская конвенция) и Регламента Европейского союза "Брюссель IIbis". В марте 2007 года суд апелляционной инстанции предписал матери вернуть дочь в Германию (вынеся судебное решение, которое подлежало немедленному исполнению и не могло быть обжаловано). В июне 2007 года был выдан исполнительный лист;

 

- мать дочери и Генеральный прокурор несколько раз пытались добиться возобновления производства по делу о возвращении ребенка путем подачи заявления и жалоб, в том числе по вопросам права. В октябре 2007 года Председатель Верховного суда Литвы приостановил исполнение приказа о возвращении ребенка;

 

- в апреле 2008 года Верховный суд Литвы передал вопрос на рассмотрение Суда Европейского союза, отложив вынесение решения до апреля 2008 года. Ходатайство и жалоба, поданные с целью добиться возобновления производства по делу, были оставлены без удовлетворения;

 

- в октябре 2008 года, когда возвращение ребенка вновь было задержано, и заявитель забрал дочь из детского дома и отвез в Латвию (где он ненадолго был заключен под стражу, а затем ему было разрешено вернуться в Германию). После этого Прокуратура Литвы начала расследование по факту похищения, но прекратила производство по нему в ноябре 2009 года.

 

В 2009 году заявитель подал жалобу в Европейский Суд. Мать девочки впоследствии уехала жить в Германию и получила право видеться с ребенком в этой стране.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции. Европейский Суд провел различие между двумя периодами времени по настоящему делу.

 

(a) В период до июня 2007 года, хотя и являвшийся длительным, семь месяцев вместо шести недель, предусмотренных Гаагской конвенцией, процесс принятия судами решений соответствовал требованиям статьи 8 Конвенции с учетом трудностей дела.

 

(b) Дальнейшие рассуждения, тем не менее, привели Европейский Суд к выводу о том, что в целом действия властей не соответствовали их позитивным обязательствам.

 

Он также придал значение доводу заявителей о том, что семейные отношения, которые стали возможны ввиду сдержанного поведения матери после ее возвращения в Германию, были исключены в то время, когда помощь со стороны властей Литвы заходила так далеко, что вводила ее в заблуждение относительно возможности удержания дочери в Литве, несмотря на решения судов и международные обязательства государства.

 

(i) Внесудебные реакции. После того, как судебный пристав начал исполнение приказа о возвращении ребенка, на дело возобновилось давление со стороны общественности, государства, политических сил (за исключением Президента Литвы).

 

В дополнение к таким фактам, как составление публичной петиции и публикации писем, демонизировавших заявителя (в которых он назывался "немецкой свиньей" и "нацистом"), а также тому, что заявитель, его адвокат и судебный пристав получали угрозы, Европейский Суд был встревожен тем, что, по-видимому, являлось целенаправленными официальными усилиями для обеспечения того, чтобы ребенок остался жить в Литве, в частности:

 

- члены парламента открыто высказывали сомнения в законности судебных решений, а министр юстиции Литвы заверял мать, что производство по делу будет возобновлено;

 

- оказывалось давление на судебного пристава с целью заставить его не исполнять судебное решение, а также на социальные службы для того, чтобы последние изменили свое мнение о том, что возвращение в Германию соответствовало интересам ребенка;

 

- во внутригосударственное законодательство были внесены изменения, чтобы позволить ребенку получить гражданство Литвы;

 

- власти Литвы предоставляли матери юридическую, а затем финансовую помощь в рамках производства в Суде Европейского союза.

 

Данные меры с учетом последовательности событий в целом, а не отдельных инцидентов указывали на наличие prima facie доказательств того, что в настоящем деле были замешаны политические интересы, что не соответствовало необходимой справедливости процесса принятия решений при исполнении судебного приказа о возвращении ребенка.

 

(ii) Процессуальные недостатки. Несмотря на то, что в соответствии с законодательством Литвы приказ о возвращении ребенка нельзя было обжаловать, он, тем не менее, был оспорен двумя способами:

 

- во-первых, Генеральный прокурор Литвы потребовал возобновления производства по делу, используя доводы, которые либо ставили под сомнение res judicata, либо позволяли родителю, похитившему ребенка, воспользоваться истечением времени, что не соответствовало духу Гаагской конвенции;

 

- во-вторых, была подана жалоба по вопросам права, в ходе рассмотрения которой Верховный суд Литвы рассмотрел также вопросы факта, тем самым превысив пределы своей юрисдикции.

 

Кроме того, Председатель Верховного суда Литвы лично вмешался в дело, чтобы оно могло быть повторно рассмотрено.

 

Дальнейшие задержки в рассмотрении дела были вызваны решением Верховного суда Литвы о приостановлении производства по делу в ожидании ответа от Суда Европейского союза, хотя предварительный запрос был направлен в рамках срочной процедуры.

 

Упомянутое выше вмешательство и процессуальные недостатки полностью игнорировали фундаментальные цели не только Гаагской конвенции и Регламента Европейского Суда, но и статьи 8 Конвенции.

 

Что касается того факта, что заявитель в итоге неожиданно забрал дочь в Германию, Европейский Суд не счел необходимым рассматривать данный вопрос, отметив, что заявитель уже ожидал в течение длительного периода времени и боялся новых задержек, поскольку мать по-прежнему возражала против возвращения ребенка.

 

Таким образом, время, которое потребовалось властям Литвы для того, чтобы принять окончательное решение по делу заявителей, не отвечало необходимости, обусловленной безотлагательностью принятия решения в сложившейся ситуации.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил 30 000 евро совместно обоим заявителям в качестве компенсации морального вреда, отклонив требования о возмещении материального ущерба. Он также присудил заявителю 92 230 евро в качестве возмещения судебных расходов и издержек с учетом особой сложности дела, которое потребовало участия ряда адвокатов, специализирующихся в сфере международного частного права, права Европейского союза, а также гражданского и уголовного права Литвы, которые представляли заявителя в гражданских судах Литвы и в Суде Европейского союза или впоследствии осуществляли его защиту в уголовных судах.

2020 m. Sausio 14 d. EŽTT sprendimas byloje „Rinau prieš Lietuvą“ (pareiškimo Nr. 10926/09).

 

2009 m. Pareiškėjams buvo suteikta pagalba rengiant pareiškimo. Vėliau pareiškimo buvo perduotas Lietuvai.

 

Byloje buvo sėkmingai pareiškimo skundas dėl politinio kišimosi ir procedūrinių trūkumų, siekiant užkirsti kelią teismo nurodymui grąžinti užsienio valstybėje neteisėtai sulaikytą vaiką. Byla pažeidė Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijos 8 straipsnio reikalavimus.

 


BYLOS APLINKYBĖS

 


Pareiškėjai byloje yra Vokietijos pilietis (pareiškėjas) ir jo dukra (pareiškėjas), gimę 2005 m. Iš santuokos su Lietuvos piliečiu. 2006 m. Pastaroji išvyko iš Vokietijos pasiimti dukters į Lietuvą atostogauti, tačiau niekada negrįžo į Vokietiją. Po to sekė šie ieškiniai:

 

(1) Vokietijoje: pareiškėjas kreipėsi į teismą, kuris nutarė paskirti laikiną globėją ir grąžinti dukrą. 2007 m. Buvo įsakyta skyrybų byla ir pareiškėjui buvo suteikta nuolatinė globa savo dukrai.

 

(2) Lietuvoje (kur byla buvo plačiai aptariama tiek politiniu lygmeniu, tiek žiniasklaidoje):

 

spalio mėn. pareiškėjas kreipėsi į teismą dėl dukters grąžinimo remdamasis 1980 m. spalio 25 d. Hagos konvencija dėl tarptautinio vaikų pagrobimo civilinių aspektų (toliau - Hagos konvencija) ir Europos Sąjungos Briuselio IIbis reglamentu. 2007 m. Kovo mėn. Apeliacinės instancijos teismas liepė motinai grąžinti dukrą į Vokietiją (priimdamas sprendimą, kuris buvo nedelsiant vykdomas ir negalėjo būti skundžiamas). 2007 m. Birželio mėn. Buvo išduotas vykdomasis raštas;

 

- dukters motina ir generalinis prokuroras kelis kartus bandė atnaujinti procesą dėl vaiko grąžinimo, pateikdami prašymą ir skundus, taip pat ir teisės klausimais. 2007 m. Spalio mėn. Lietuvos Aukščiausiojo Teismo pirmininkas sustabdė nutarties grąžinti vaiką vykdymą;

 

- 2008 m. balandžio mėn. Lietuvos Aukščiausiasis Teismas perdavė klausimą Europos Sąjungos Teisingumo Teismui, atidėjęs sprendimą iki 2008 m. balandžio mėn. Pareiškimas ir skundas, pateikti siekiant atnaujinti procesą, buvo atmesti.

 

- 2008 m. spalio mėn., kai vaiko grąžinimas vėl buvo atidėtas, o pareiškėjas paėmė dukrą iš našlaičių namų ir išvežė į Latviją (kur jis buvo trumpam sulaikytas, o po to jam leista grįžti į Vokietiją). Po to Lietuvos prokuratūra pradėjo pagrobimo tyrimą, tačiau 2009 m. Lapkričio mėn. Nutraukė procesą dėl jo.

 

2009 m. Pareiškėjas pateikė ieškinį Europos teismui. Vėliau mergaitės motina išvyko gyventi į Vokietiją ir gavo teisę pamatyti vaiką šioje šalyje.

 


TEISĖS KLAUSIMAI

 


Konvencijos 8 straipsnio laikymasis. Šioje byloje teismas išskyrė du laikotarpius.

 

a) laikotarpiu iki 2007 m. birželio mėn., nors ir ilgą, septynis mėnesius, vietoj šešių savaičių, nustatytų Hagos konvencijoje, teismo sprendimų priėmimo procesas atitiko konvencijos 8 straipsnio reikalavimus, atsižvelgiant į bylos sunkumus.

 

(b) Tačiau dėl papildomų aplinkybių Teisingumo Teismas padarė išvadą, kad valdžios institucijų veiksmai iš esmės prieštaravo jų teigiamiems įsipareigojimams.

 

Jis taip pat pabrėžė pareiškėjų argumentą, kad santykiai šeimoje, kurie tapo įmanomi dėl motinos santūraus elgesio jai grįžus į Vokietiją, buvo atmesti tuo metu, kai Lietuvos valdžios institucijų pagalba buvo tokia, kad suklaidino ją dėl galimybės išlaikyti dukterų Lietuvoje, nepaisant teismo sprendimų ir tarptautinių valstybės įsipareigojimų.

 

i) neteisminės reakcijos. Antstoliui pradėjus vykdyti įsakymą grąžinti vaiką, visuomenės, valstybės, politinių jėgų (išskyrus Lietuvos prezidentą) spaudimas bylai atnaujinti.

 

Be tokių faktų, kaip viešos peticijos rengimas ir laiškų, demonizuojančių pareiškėją (kuriame jis buvo vadinamas „vokiška kiaulė“ ir „nacistas“) paskelbimas ir kad pareiškėjas, jo advokatas ir antstolis sulaukė grasinimų, Teismas buvo sunerimęs. kaip atrodė sąmoningos oficialios pastangos užtikrinti, kad vaikas liktų Lietuvoje, visų pirma:

 

- Seimo nariai atvirai reiškė abejones dėl teismo sprendimų teisėtumo, o Lietuvos teisingumo ministras patikino savo motiną, kad bylos nagrinėjimas bus atnaujintas;

 

- antstoliui buvo daromas spaudimas priversti jį nevykdyti teismo sprendimo, taip pat socialinės tarnybos, kad pastarieji pakeistų savo nuomonę, kad grįžimas į Vokietiją buvo vaiko interesų labui;

 

- buvo padaryti pakeitimai šalies įstatymuose, kad vaikas galėtų įgyti Lietuvos pilietybę;

 

- Lietuvos valdžios institucijos suteikė motinai teisinę ir finansinę pagalbą vykstant procesui Europos Sąjungos Teisingumo Teisme.

 

Šios priemonės, atsižvelgiant į įvykių seką kaip visumą, o ne į atskirus įvykius, parodė, kad yra prima facie įrodymų, kad nagrinėjamoje byloje buvo įsitraukę politiniai interesai, kurie neatitiko būtino sprendimų priėmimo proceso teisingumo vykdant nutartį dėl vaiko grąžinimo.

 

ii) Procedūriniai trūkumai. Nors įsakymas grąžinti vaiką negalėjo būti skundžiamas pagal Lietuvos įstatymus, jis vis dėlto buvo apskųstas dviem būdais:

 

- pirmiausia, Lietuvos generalinis prokuroras reikalavo atnaujinti procesą, naudodamasis argumentais, kurie arba kėlė abejonių dėl res judicata, arba leido tėvui, pagrobusiam vaiką, pasinaudoti laikui bėgant, o tai neatitiko Hagos konvencijos dvasios;

 

- antra, buvo pateiktas skundas teisės klausimais, kurių metu Lietuvos Aukščiausiasis Teismas taip pat nagrinėjo faktinius klausimus ir taip peržengė savo jurisdikcijos ribas.

 

Be to, į bylą asmeniškai įsikišo Lietuvos Aukščiausiojo Teismo pirmininkas, kad ją būtų galima iš naujo išnagrinėti.

 

Tolesnį bylos nagrinėjimo vilkinimą lėmė Lietuvos Aukščiausiojo Teismo sprendimas sustabdyti bylos nagrinėjimą, laukiant Europos Sąjungos Teisingumo Teismo atsakymo, nors preliminarus prašymas buvo išsiųstas kaip skubaus proceso dalis.

 

Minėti įsikišimai ir procedūriniai trūkumai visiškai nepaisė pagrindinių tikslų, nustatytų ne tik Hagos konvencijoje ir Europos teismo taisyklėse, bet ir konvencijos 8 straipsnyje.

 

Kalbant apie tai, kad pareiškėjas netikėtai išvežė dukrą į Vokietiją, Teismas nemanė, kad būtina spręsti šį klausimą, pažymėdamas, kad ieškovė jau ilgai laukė ir bijojo tolesnių vėlavimų, nes motina ir toliau prieštaravo vaiko grąžinimui.

 

Taigi laikas, per kurį Lietuvos valdžios institucijos turėjo priimti galutinį sprendimą pareiškėjų byloje, neatitiko poreikio, kylančio dėl skubos priimti sprendimą šioje situacijoje.

 


SPRENDIMAS

 


Byloje buvo pažeistas Konvencijos 8 straipsnis (priimtas vieningai).

 


KOMPENSACIJA

 


Konvencijos 41 straipsnio taikymas. Teismas atmeta ieškinius dėl turtinės žalos atlyginimo abiem pareiškėjams solidariai po 30 000 Eur neturtinei žalai atlyginti. Ji taip pat priteisė ieškovui 92 230 EUR bylinėjimosi išlaidų ir išlaidų, atsižvelgiant į ypatingą bylos sudėtingumą, dėl kurio reikėjo dalyvauti keletui teisininkų, besispecializuojančių tarptautinėje privatinėje teisėje, Europos Sąjungos teisėje ir Lietuvos civilinėje bei baudžiamojoje teisėje, kurie atstovavo pareiškėjui civilinėje byloje Lietuvos ir Europos Sąjungos Teisingumo Teismo teismai arba vėliau jį gynė baudžiamuosiuose teismuose.

Judgment of the ECHR of January 14, 2020 in the case "Rinau v. Lithuania" (application no. 10926/09).

 

In 2009, the applicants received assistance in preparing their application. Subsequently, the application was communicated to Lithuania.

 

The case successfully examined a complaint about political interference and procedural deficiencies in order to prevent the court-ordered return of a child illegally detained by another parent in a foreign state. The case violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 


THE CIRCUMSTANCES OF THE CASE

 


The applicants in the case are a German citizen (the applicant) and his daughter (the applicant), who was born in 2005 from a marriage with a Lithuanian citizen. In 2006, the latter left Germany to take her daughter to Lithuania on vacation, but she never returned to Germany. This was followed by the following lawsuits:

 

(1) in Germany: the applicant applied to the court, which ruled to appoint him a temporary guardian and to return his daughter. In 2007, the divorce was ordered and the applicant was granted permanent custody of his daughter.

 

(2) In Lithuania (where the case was widely discussed both at the political level and in the media):

 

- in October 2006, the applicant applied to the court for the return of his daughter on the basis of the Hague Convention on the Civil Aspects of International Abduction of Children of 25 October 1980 (hereinafter - the Hague Convention) and the European Union Brussels IIbis Regulation. In March 2007, the appellate court ordered the mother to return her daughter to Germany (by passing a judgment that was subject to immediate execution and could not be appealed). In June 2007 a writ of execution was issued;

 

- the daughter's mother and the Prosecutor General tried several times to obtain the resumption of the proceedings on the return of the child by filing an application and complaints, including on issues of law. In October 2007, the Chief Justice of the Supreme Court of Lithuania suspended the execution of the order to return the child;

 

- in April 2008, the Supreme Court of Lithuania referred the issue to the Court of Justice of the European Union, postponing the decision until April 2008. The petition and complaint filed with the aim of obtaining the reopening of the proceedings were dismissed;

 

- in October 2008, when the return of the child was again delayed and the applicant took his daughter from the orphanage and took her to Latvia (where he was briefly detained and then allowed to return to Germany). Thereafter, the Lithuanian Prosecutor's Office launched an investigation into the abduction, but stopped proceedings on it in November 2009.

 

In 2009 the applicant lodged an application with the European Court. The girl's mother subsequently went to live in Germany and received the right to see the child in this country.

 


QUESTIONS OF LAW

 


Compliance with Article 8 of the Convention. The Court has drawn a distinction between the two time periods in the present case.

 

(a) In the period up to June 2007, although a lengthy one, seven months instead of the six weeks stipulated in the Hague Convention, the judicial decision-making process complied with the requirements of Article 8 of the Convention, taking into account the difficulties of the case.

 

(b) Further considerations, however, led the Court to conclude that, on the whole, the authorities' actions were inconsistent with their positive obligations.

 

It also highlighted the applicants' argument that family relations, which had become possible due to the restrained behavior of the mother after her return to Germany, had been excluded at a time when assistance from the Lithuanian authorities went so far as to mislead her about the possibility of keeping daughters in Lithuania, despite court decisions and international obligations of the state.

 

(i) Extrajudicial Reactions. After the bailiff began executing the order to return the child, pressure on the case from the public, the state, political forces (with the exception of the President of Lithuania) resumed.

 

In addition to facts such as the drafting of a public petition and the publication of letters demonizing the applicant (in which he was called a “German pig” and a “Nazi”) and that the applicant, his lawyer and the bailiff received threats, the Court was alarmed what appeared to be a deliberate official effort to ensure that the child remains in Lithuania, in particular:

 

- Members of parliament openly expressed doubts about the legality of the court decisions, and the Minister of Justice of Lithuania assured their mother that the proceedings on the case would be resumed;

 

- pressure was exerted on the bailiff in order to force him not to comply with the court decision, as well as on social services in order for the latter to change their opinion that returning to Germany was in the interests of the child;

 

- amendments have been made to the domestic legislation to enable the child to acquire Lithuanian citizenship;

 

- the Lithuanian authorities provided the mother with legal and then financial assistance in the framework of the proceedings before the Court of Justice of the European Union.

 

These measures, taking into account the sequence of events as a whole, rather than individual incidents, indicated that there was prima facie evidence that political interests were involved in the present case, which did not correspond to the necessary fairness of the decision-making process in the execution of the order for the return of the child.

 

(ii) Procedural deficiencies. Although the order to return the child could not be appealed under Lithuanian law, it was nevertheless challenged in two ways:

 

- firstly, the General Prosecutor of Lithuania demanded the reopening of the proceedings, using arguments that either cast doubt on res judicata or allowed the parent who abducted the child to take advantage of the lapse of time, which was not in line with the spirit of the Hague Convention;

 

- secondly, a complaint was filed on issues of law, during the consideration of which the Supreme Court of Lithuania also considered issues of fact, thereby exceeding the limits of its jurisdiction.

 

In addition, the President of the Supreme Court of Lithuania personally intervened in the case so that it could be re-examined.

 

Further delays in the consideration of the case were caused by the decision of the Supreme Court of Lithuania to suspend the proceedings pending a response from the Court of Justice of the European Union, although the preliminary request was sent as part of an urgent procedure.

 

The aforementioned interference and procedural shortcomings completely ignored the fundamental objectives of not only the Hague Convention and the Rules of the European Court, but also Article 8 of the Convention.

 

As regards the fact that the applicant ended up unexpectedly taking his daughter to Germany, the Court did not consider it necessary to address this issue, noting that the applicant had already waited for a long period of time and was afraid of further delays as the mother continued to object to the child's return.

 

Thus, the time it took for the Lithuanian authorities to take a final decision in the applicants' case did not correspond to the need arising from the urgency of taking a decision in the current situation.

 


RESOLUTION

 


There was a violation of Article 8 of the Convention in the case (adopted unanimously).

 


COMPENSATION

 


Application of Article 41 of the Convention. The Court awards EUR 30,000 jointly to both applicants in respect of non-pecuniary damage, dismissing the claims for pecuniary damage. It also awarded the applicant EUR 92,230 in legal costs and expenses, given the particular complexity of the case, which required the participation of a number of lawyers specializing in private international law, European Union law and Lithuanian civil and criminal law, who represented the applicant in civil courts of Lithuania and the Court of Justice of the European Union or subsequently defended him in criminal courts.

В 2014 и 2015 годах заявителю была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Румынии.

 

По делу успешно рассмотрена жалоба на нарушение права заключенного на доступ к онлайн-коммуникациям для поддержания контактов с внешним миром, в частности с членами семьи. Жалоба объявлена неприемлемой для рассмотрения по существу. В отношении другой жалобы заключенного, касавшейся условий его содержания под стражей, по делу допущено нарушение требований статьи 3 Конвенции о защите прав человека и основных свобод в отношении первого периода времени.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявитель отбывал наказание с 2009 года до конца 2016 года. В феврале 2014 года вступил в силу закон, согласно которому в некоторых случаях заключенным было разрешено поддерживать контакты с внешним миром, в частности, с членами семьи с помощью онлайн-коммуникаций. По соображениям безопасности и по практическим причинам реализация данного права зависела от предварительной оценки и получения разрешения со стороны администрации пенитенциарного учреждения.

 

Конкретные обстоятельства, которые следовало учитывать для получения разрешения и осуществления данного права, должны были быть определены в соответствующих подзаконных актах, принятых в течение шести месяцев с даты вступления указанного закона в силу. Такой подзаконный акт был принят в апреле 2016 года.

 

Начиная с апреля 2015 года заявитель жаловался на отсутствие такого закона, ссылаясь на то, что его жена могла навещать его лишь один раз в три месяца, поскольку проживала далеко, в Италии.

 

Ссылаясь на положения внутригосударственного законодательства, суды Румынии признали наличие упомянутого выше права и постановили, что отсутствие регулирования, обеспечивающего реализацию данного права, являлось его длящимся нарушением.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции. Данное положение Конвенции не может толковаться как гарантирующее заключенным право общаться с внешним миром посредством устройств онлайн-коммуникации, в частности, когда альтернативные возможности для поддержания контактов являются доступными и адекватными (см. в аналогичном контексте, касавшемся права на телефонные звонки, Постановление Европейского Суда по делу "Лебуа против Болгарии" (Lebois v. Bulgaria) от 19 октября 2017 г., жалоба N 67482/14).

 

В настоящем деле право заявителя на доступ к средствам коммуникации для поддержания его контактов с женой было предусмотрено законодательством Румынии.

 

Следует признать, что по делу была допущена задержка продолжительностью один год и восемь месяцев по отношению к сроку, установленному соответствующими положениями законодательства Румынии для реализации данного права. Таким образом, соответствующее право было ограничено в силу временного отсутствия надлежащей юридической и инфраструктурной базы для предоставления заключенным возможности пользоваться онлайн-коммуникациями. Однако Европейский Суд отметил следующее:

 

- данное ограничение продолжалось в течение сравнительно короткого периода времени (с апреля 2015 года, когда заявитель впервые пожаловался на это в суд по вопросам исполнения наказания, до апреля 2016 года (самое позднее), когда были приняты нормативные акты об имплементации соответствующего права);

 

- в это время жена заявителя могла навещать его один раз в три месяца;

 

- ничто не препятствовало заявителю поддерживать нормальный контакт с женой с помощью альтернативных средств коммуникации.

 

 

 

РЕШЕНИЕ

 

 

 

Жалоба объявлена неприемлемой для рассмотрения по существу (как явно необоснованная).

 

Другая жалоба заявителя, касавшаяся условий его содержания под стражей, была рассмотрена по существу. Европейский Суд единогласно пришел к выводу, что по делу было допущено нарушение статьи 3 Конвенции в отношении первого периода времени (в этой связи Европейский Суд присудил заявителю 3 000 евро в качестве компенсации морального вреда) и что не было допущено нарушения статьи 3 Конвенции в отношении второго периода.

Hotărârea CEDO din 7 ianuarie 2020 în cauza „Ciupercescu împotriva României (nr. 3)” (plângerea nr. 41995/14 și 50276/15).

 

În 2014 și 2015, solicitantul a primit asistență în pregătirea plângerea. Ulterior, plângerea au fost consolidate și comunicate României.

 

În acest caz, a fost examinată cu succes o plângerea privind încălcarea dreptului unui deținut de a accesa comunicații online pentru a menține contactul cu lumea exterioară, în special cu membrii familiei. Plângerea a fost declarată inadmisibilă pe fond. În legătură cu o altă plângere a unui deținut cu privire la condițiile de detenție, a existat o încălcare a cerințelor articolului 3 din Convenția pentru protecția drepturilor omului și a libertăților fundamentale cu privire la prima perioadă de timp.

 


CIRCUMSTANȚELE CAZULUI

 


Reclamantul și-a executat sentința din 2009 până la sfârșitul anului 2016 În februarie 2014, a intrat în vigoare o lege, potrivit căreia, în unele cazuri, deținuților li s-a permis să mențină contactul cu lumea exterioară, în special cu membrii familiei, prin intermediul comunicării online. Din motive de securitate și practică, exercitarea acestui drept a depins de o evaluare preliminară și de obținerea permisiunii din partea administrației penitenciarului.

 

Circumstanțele specifice care trebuiau luate în considerare pentru a obține permisiunea și a exercita acest drept trebuiau stabilite în statutele relevante adoptate în termen de șase luni de la data intrării în vigoare a legii menționate. Un astfel de regulament a fost adoptat în aprilie 2016.

 

Din aprilie 2015, reclamanta s-a plâns de absența unei astfel de legi, referindu-se la faptul că soția sa nu putea să-l viziteze decât o dată la trei luni, din moment ce locuia departe în Italia.

 

Referindu-se la prevederile dreptului intern, instanțele române au recunoscut existența dreptului menționat mai sus și au decis că lipsa reglementărilor care să asigure exercitarea acestui drept era o încălcare continuă a acestuia.

 


ÎNTREBĂRI DE DREPT

 


Respectarea articolului 8 din Convenție. Această prevedere a Convenției nu poate fi interpretată ca garantând prizonierilor dreptul de a comunica cu lumea exterioară prin intermediul dispozitivelor de comunicare online, în special atunci când sunt disponibile și adecvate mijloace alternative de menținere a contactului (a se vedea, într-un context similar referitor la dreptul la apeluri telefonice, Hotărârea Curții Europene de Justiție cu privire la în Lebois împotriva Bulgariei, 19 octombrie 2017, cererea nr. 67482/14).

 

În cazul de față, dreptul reclamantului de a avea acces la mijloace de comunicare pentru a-și menține contactele cu soția sa era prevăzut de legislația română.

 

Trebuie admis faptul că a existat o întârziere în cazul unui an și opt luni în raport cu perioada de timp stabilită prin dispozițiile relevante din legislația română pentru exercitarea acestui drept. Astfel, dreptul relevant a fost limitat din cauza lipsei temporare a unui cadru legal și infrastructural adecvat care să le permită prizonierilor să utilizeze comunicații online. Cu toate acestea, Curtea a luat act de următoarele:

 

- această restricție a durat o perioadă relativ scurtă (din aprilie 2015, când reclamantul a plâns pentru prima dată instanța de judecată cu privire la executarea pedepsei, până cel târziu în aprilie 2016 (cel târziu), când au fost adoptate reglementările privind punerea în aplicare a dreptului relevant);

 

- la acea dată soția solicitantului putea să-l viziteze o dată la trei luni;

 

- nimic nu l-a împiedicat pe reclamant să mențină un contact normal cu soția sa prin mijloace alternative de comunicare.

 


DECIZIE

 


Plângerea a fost declarată inadmisibilă (în mod vădit nefondată).

 

O altă plângere a reclamantului cu privire la condițiile reținerii sale a fost examinată pe fond. Curtea conchide în unanimitate că a existat o încălcare a articolului 3 din Convenție pentru prima perioadă (în acest sens, Curtea acordă reclamantului 3.000 EUR pentru daune morale) și că nu a existat nicio încălcare a articolului 3 din Convenție pentru cea de-a doua perioadă.

Judgment of the ECHR of January 7, 2020 in the case "Ciupercescu v. Romania (no. 3)" (applications no. 41995/14 and 50276/15).

 

In 2014 and 2015, the applicant received assistance in preparing applications. Subsequently, the applications were consolidated and communicated to Romania.

 

In the case, an application about a violation of a prisoner's right to access online communications to maintain contact with the outside world, in particular with family members, was successfully considered. The complaint was declared inadmissible on the merits. In relation to another complaint by a detainee concerning the conditions of his detention, there was a violation of the requirements of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms in respect of the first period of time.

 


THE CIRCUMSTANCES OF THE CASE

 


The applicant served his sentence from 2009 until the end of 2016. In February 2014, a law came into force, according to which, in some cases, prisoners were allowed to maintain contact with the outside world, in particular with family members, through online communication. For security and practical reasons, the exercise of this right depended on a preliminary assessment and obtaining permission from the administration of the penitentiary.

 

The specific circumstances that should have been taken into account in order to obtain permission and exercise this right were to be determined in the relevant by-laws adopted within six months from the date of entry into force of the said law. Such a bylaw was adopted in April 2016.

 

Since April 2015, the applicant complained about the absence of such a law, referring to the fact that his wife could only visit him once every three months, since she lived far away in Italy.

 

Referring to the provisions of domestic law, the Romanian courts recognized the existence of the aforementioned right and ruled that the lack of regulation to ensure the exercise of this right was a continuing violation of it.

 


QUESTIONS OF LAW

 


Compliance with Article 8 of the Convention. This provision of the Convention cannot be interpreted as guaranteeing prisoners the right to communicate with the outside world through online communication devices, in particular when alternative means of maintaining contact are available and adequate (see, in a similar context regarding the right to telephone calls, Judgment of the European Court of Justice on in Lebois v. Bulgaria, 19 October 2017, application no. 67482/14).

 

In the present case, the applicant's right to access means of communication to maintain his contacts with his wife was provided for by Romanian law.

 

It should be admitted that there was a delay in the case of one year and eight months in relation to the time period established by the relevant provisions of Romanian legislation for the exercise of this right. Thus, the relevant right was limited due to the temporary lack of an appropriate legal and infrastructural framework to enable prisoners to use online communications. However, the Court noted the following:

 

- this restriction lasted for a relatively short period of time (from April 2015, when the applicant first complained about it to the court on the execution of the sentence, until April 2016 (at the latest), when the regulations on the implementation of the relevant right were adopted);

 

- at that time the applicant's wife could visit him once every three months;

 

- nothing prevented the applicant from maintaining normal contact with his wife through alternative means of communication.

 


DECISION

 


The complaint was declared inadmissible (as manifestly unfounded).

 

Another complaint by the applicant concerning the conditions of his detention was examined on the merits. The Court unanimously concludes that there has been a violation of Article 3 of the Convention in respect of the first period of time (in this connection the Court awards the applicant EUR 3,000 in respect of non-pecuniary damage) and that there has been no violation of Article 3 of the Convention in respect of the second period.
