Постановление ЕСПЧ от 25 февраля 2020 года по делу "Y.I. (Y.I.) против Российской Федерации" (жалоба N 68868/14).

В 2014 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

По делу успешно рассмотрена жалоба лишение заявительницы родительских прав в отношении детей и помещение некоторых из них в детский дом. По делу допущено нарушение статьи 8 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявительница была лишена родительских прав в отношении трех ее детей, а двое ее младших детей были помещены в детский дом. Суды Российской Федерации сослались на тот факт, что мать была наркозависимой и безработной, и решили, что оставлять детей под ее присмотром было опасно. Ее жалобы на данное решение были безуспешны.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 8 Конвенции. Лишение заявительницы родительских прав в отношении детей представляло собой вмешательство в ее право на уважение семейной жизни. Данное вмешательство было предусмотрено законом и преследовало правомерную цель защиты прав детей заявительницы.

Отобрание детей и их помещение в детский дом в начале производства по уголовному делу в отношении заявительницы по обвинению в торговле наркотиками было обоснованным, поскольку в тот момент она находилась под воздействием токсических веществ, затем страдала от "ломки" и явно была неспособна заботиться о своих детях. Однако из этого не следовало, что данный факт сам по себе являлся достаточным основанием для принятия такой далеко идущей меры, как лишение родительских прав.

До возбуждения уголовного дела в отношении заявительницы она не находилась на учете органов социальной защиты, ей не выносилось предупреждение относительно ее поведения или последствий, к которым оно могло привести. Когда положение заявительницы привлекло внимание властей, уполномоченные органы не предприняли попыток оказать ей надлежащую помощь. Также не было представлено доказательств того, что в своих решениях суды Российской Федерации приняли во внимание какие-либо из данных факторов.

Кроме того, внутригосударственные суды не упоминали о каких-либо ситуациях или событиях, когда заявительница оставляла детей без присмотра, не заботилась о них либо иным образом оставляла их без внимания, не говоря уже о том, чтобы подвергать их жизнь или здоровье опасности в результате ее действий или бездействия. Суды Российской Федерации лишь сослались на показания заявительницы в контексте уголовного дела о том, что она разрешала своим знакомым использовать свою квартиру для приема наркотиков, а также на устные показания сотрудника полиции, который утверждал, что заявительница позволяла своим знакомым принимать наркотики у себя на кухне в присутствии детей.

Тем не менее, во-первых, из показаний заявительницы не следовало, что она или ее знакомые когда-либо принимали наркотики в присутствии детей. Внутригосударственные суды не проверили, на чем основывались соответствующие показания сотрудника полиции. Во-вторых, заявительница, ее старший сын и ее мать последовательно утверждали, что заявительница не проявляла свою зависимость перед членами семьи. Суды Российской Федерации не предприняли попыток получить больше информации с целью прояснить важное противоречие с показаниями сотрудника полиции.

Заявительница последовательно утверждала о своем намерении решить проблему наркозависимости и, кроме того, предпринимала меры в этом направлении. Однако суды Российской Федерации не получили каких-либо независимых доказательств, таких как заключение психолога, чтобы оценить степень эмоциональной зрелости заявительницы и ее мотивацию для того, чтобы вести себя как ответственный родитель и решить проблему наркозависимости. Кроме того, представленные заявительницей доводы и доказательства, свидетельствовавшие о том, что она начала лечение, были проигнорированы судами страны. Это особенно поразительно в ситуации, когда наркозависимость заявительницы являлась, по-видимому, основным, если не единственным основанием для лишения ее родительских прав.

Суды Российской Федерации ссылались на тот факт, что заявительница была безработной, но в их постановлениях не разъяснялось, каким образом это влияло на ее способность и возможность заботиться о детях. В заключении, на которое ссылались суды страны, не упоминалось о каких-либо значимых недостатках, касавшихся условий проживания семьи заявительницы, у детей были отдельные спальные места, они хорошо питались. Кроме того, в другом заключении ясно были указаны последовавшие улучшения, в частности, то, что квартира была чистой, уютной и хорошо проветривалась. Тем не менее внутригосударственные суды не дали оценки этим изменениям, в частности, тому, могли ли они считаться искренней попыткой заявительницы улучшить свою ситуацию после отобрания у нее детей.

Власти Российской Федерации не рассмотрели альтернативу применения менее радикальной меры - ограничение родительских прав заявительницы, а не лишение ее этих прав. Они не выносили в адрес заявительницы каких-либо предупреждений относительно возможных последствий ее предположительно небрежного поведения по отношению к детям.

Заявительница последовательно выражала свою привязанность к детям и свое стремление поддерживать отношения с ними. Дети также были глубоко привязаны к матери и бабушке по материнской линии, и последняя выражала желание оставить детей у себя. Однако внутригосударственные суды надлежащим образом не рассмотрели ни один из данных аспектов. В частности, выбирая меру, которая подлежала применению в деле заявительницы, они не оценили, к каким последствиям для благополучия детей могла привести их разлука с матерью и бабушкой.

В результате оспариваемой меры дети были не только разлучены с заявительницей, своей матерью, но и были разлучены друг с другом, поскольку старший сын был передан на попечение отца, а младшие дети были помещены в детский дом.

В целом основания, на которые ссылались внутригосударственные суды, не были достаточными, чтобы оправдать лишение заявительницы родительских прав в отношении трех ее детей и помещение двух младших детей в детский дом. Власти Российской Федерации не доказали убедительным образом, что, несмотря на возможность принятия менее радикальных решений, оспариваемая мера представляла собой наиболее подходящий вариант, соответствовавший интересам детей. Несмотря на пределы допустимого для государства усмотрения в этой сфере, вмешательство в право заявительницы на уважение семейной жизни, таким образом, не было соразмерно преследуемой цели.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявительнице 20 000 евро в качестве компенсации морального вреда.

Judgment of the ECHR of February 25, 2020 in the case "Y.I. (Y.I.) v. Russian Federation" (application no. 68868/14).

In 2014, the applicant received assistance in preparing an application. The application was subsequently communicated to the Russian Federation.

The case successfully examined the application of the deprivation of the applicant's parental rights in relation to children and the placement of some of them in an orphanage. There has been a violation of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms in the case.


THE CIRCUMSTANCES OF THE CASE


The applicant was deprived of parental rights in respect of her three children, and her two younger children were placed in an orphanage. The courts of the Russian Federation referred to the fact that the mother was a drug addict and unemployed and decided that it was dangerous to leave the children under her supervision. Her complaints about this decision were unsuccessful.


QUESTIONS OF LAW


Compliance with Article 8 of the Convention. The applicant's deprivation of parental rights in respect of her children amounted to an interference with her right to respect for family life. This interference was prescribed by law and pursued the legitimate aim of protecting the rights of the applicant's children.

The removal of the children and their placement in an orphanage at the beginning of the criminal proceedings against the applicant on drug trafficking charges was justified, since at that time she was under the influence of toxic substances, then suffered from "withdrawal" and was clearly unable to take care of her children ... However, it did not follow from this that this fact in itself was a sufficient reason for taking such a far-reaching measure as deprivation of parental rights.

Prior to the initiation of criminal proceedings against the applicant, she was not registered with the social security authorities, and she was not given a warning regarding her behavior or the consequences it could lead to. When the applicant's situation attracted the attention of the authorities, the authorities made no attempt to provide her with adequate assistance. Also, no evidence was presented that the courts of the Russian Federation took into account any of these factors in their decisions.

Moreover, the domestic courts did not mention any situations or events in which the applicant left the children unattended, did not care for them or otherwise left them unattended, let alone endanger their life or health as a result of it. action or inaction. The courts of the Russian Federation only referred to the applicant's testimony in the context of the criminal case that she had allowed her acquaintances to use her apartment for taking drugs, as well as to the oral testimony of a police officer who alleged that the applicant had allowed her acquaintances to take drugs in her kitchen in the presence of children.

However, firstly, it did not follow from the applicant's statements that she or her acquaintances had ever taken drugs in the presence of children. The domestic courts did not verify the basis of the police officer's respective testimony. Secondly, the applicant, her eldest son and her mother consistently argued that the applicant had not shown her dependence towards family members. The courts of the Russian Federation made no attempt to obtain more information in order to clarify an important contradiction with the testimony of the police officer.

The applicant consistently asserted her intention to solve the drug addiction problem and, moreover, took steps in this direction. However, the Russian courts did not obtain any independent evidence, such as a psychologist's opinion, to assess the applicant's emotional maturity and her motivation to behave like a responsible parent and solve the drug addiction problem. Moreover, the arguments and evidence presented by the applicant indicating that she had begun treatment were ignored by the domestic courts. This is especially striking in a situation where the applicant's drug addiction appears to be the main, if not the only, ground for depriving her of her parental rights.

The Russian courts relied on the fact that the applicant was unemployed, but their decisions did not explain how this affected her ability and ability to take care of children. The report referred to by the domestic courts did not mention any significant shortcomings in the living conditions of the applicant's family, the children had separate sleeping places, and they ate well. In addition, another report clearly indicated the subsequent improvements, in particular that the apartment was clean, comfortable and well ventilated. However, the domestic courts did not assess these changes, in particular whether they could be considered a sincere attempt by the applicant to improve her situation after the removal of her children.

The Government did not consider an alternative to a less drastic measure - restricting the applicant's parental rights rather than depriving her of those rights. They did not issue any warnings to the applicant about the possible consequences of her allegedly negligent behavior towards children.

The applicant consistently expressed her affection for the children and her desire to maintain a relationship with them. The children were also deeply attached to their mother and maternal grandmother, and the latter expressed a desire to keep the children with her. However, the domestic courts did not adequately address any of these aspects. In particular, when choosing the measure to be applied in the applicant's case, they did not assess the consequences for the well-being of the children that separation from their mother and grandmother could have led.

As a result of the contested measure, the children were not only separated from the applicant, their mother, but also separated from each other, since the eldest son was placed in the care of the father, and the younger children were placed in an orphanage.

On the whole, the grounds relied on by the domestic courts were not sufficient to justify the deprivation of the applicant's parental rights in respect of her three children and the placement of her two younger children in an orphanage. The Government did not conclusively prove that, despite the possibility of adopting less radical decisions, the impugned measure represented the most appropriate option in the interests of children. Despite the State's margin of appreciation in this area, the interference with the applicant's right to respect for family life was thus not proportionate to the aim pursued.

 

RESOLUTION


There was a violation of Article 8 of the Convention in the case (adopted unanimously).


COMPENSATION


Application of Article 41 of the Convention. The European Court awarded the applicant EUR 20,000 in respect of non-pecuniary damage.

В 2019 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Румынии.

 

По делу успешно рассмотрена жалоба на ограничение права заявителя на общение с ребенком в связи с психическим расстройством заявителя без оценки последствий такого ограничения для его способности заботиться о ребенке или для безопасности ребенка. По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод, статьи 14 Конвенции во взаимосвязи со статьей 8 Конвенции.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Жалоба касалась ограничений прав заявителя на общение с его четырехлетней дочерью, установленных судами Румынии в ходе производства по делам о разводе и установлении опеки над ребенком. Заявитель утверждал, что расписание встреч с дочерью, в соответствии с которым он не мог встречаться с ней более двух раз в неделю по два часа в присутствии матери, не позволяло ему развивать личные отношения с ней и эффективно участвовать в ее образовании. Он также настаивал на том, что его психическое заболевание сыграло существенную роль в принятии решения о применении к нему данного ограничения, хотя судам не было представлено доказательств того, что он представлял собой угрозу для благополучия своей дочери.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции. Решения, принятые судами Румынии по вопросу об общении заявителя с ребенком, привели к вмешательству в право заявителя на уважение его семейной жизни, которое было предусмотрено законом и преследовало правомерную цель защиты прав других лиц.

 

Не было представлено каких-либо доказательств в подтверждение утверждения о том, что заявитель не был способен заботиться о дочери или представлял угрозу для нее. Что еще более важно, Европейский Суд не смог понять, какие подтверждения заявитель мог бы представить, чтобы доказать судам Румынии, что его психическое состояние не угрожало безопасности его дочери. При оценке состояния психического здоровья заявителя суды не ссылались на какие-либо недавние экспертные заключения. Данное обстоятельство значительно ограничило фактическую оценку уязвимости и психического состояния заявителя и его способности заботиться о ребенке в период, относившийся к обстоятельствам настоящего дела.

 

Кроме того, решения судов Румынии не содержали объяснений относительно того, каким образом они установили или оценили наилучшие интересы ребенка. Было неясно, рассмотрели ли они и попытались ли смягчить потенциальные страдания, которые ребенок мог испытывать в связи с тем, что все контакты с отцом проходили в присутствии обоих родителей, несмотря на их конфликты в то время. Отсутствовали доводы, указывавшие на то, какую пользу приносили ребенку подобные условия проведения встреч. Суды Румынии не рассмотрели альтернативные средства, такие как, например, общение под надзором представителя органа защиты детей.

 

Внутригосударственные суды в недостаточной степени проверили утверждения о том, что девочка страдала в результате действий отца. Ребенок был допрошен судьей in camera, в отсутствие эксперта-психолога из органа по защите детей. Из судебных решений было неясно, в какой степени утверждения ребенка о негативном поведении отца были приняты во внимание, было ли расписание встреч составлено с учетом данной угрозы, и если да, то каким образом. Оценка угрозы или ее отсутствия для ребенка представлялись противоречившими самому запрету домашнего насилия над детьми, который был абсолютным образом запрещен во внутригосударственном законодательстве, и бросали тень на процесс принятия решений.

 

Суды Румынии действовали быстро, в течение трех с половиной месяцев, как то требовалось в делах, затрагивавших права детей. Однако безотлагательность производства не должна была достигаться за счет качества оценки судами всех соответствующих доказательств.

 

В целом процесс принятия спорного решения не обеспечивал надлежащей оценки текущего состояния здоровья заявителя и учета всех мнений и интересов. Процедура не сопровождалась гарантиями, которые соответствовали тяжести вмешательства и серьезности затронутых в деле интересов.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

По поводу соблюдения статьи 14 Конвенции во взаимосвязи со статьей 8 Конвенции. Наличие психического заболевания может приниматься во внимание при оценке способности родителей заботиться о ребенке. Однако ссылка на психическое заболевание как на решающий элемент или даже как на один из многих элементов может представлять собой дискриминацию, если при конкретных обстоятельствах дела психическое заболевание не отразилось на способности родителя заботиться о ребенке. В соответствии с международными стандартами лица с психическими заболеваниями должны получать надлежащую помощь от государства при выполнении ими своих родительских обязанностей, а дети не должны разлучаться с родителями без надлежащего судебного контроля.

 

В настоящем деле, несмотря на то, что психическое заболевание заявителя не было единственным элементом, принятым во внимание судами Румынии, оно учитывалось на всех стадиях процесса принятия решения. Влияние этого заболевания на оценку утверждений заявителя являлось решающим фактором и привело к решению об ограничении контактов заявителя с ребенком. Таким образом, заявитель столкнулся с различием в обращении по сравнению с другими родителями, требующими восстановления контактов с их детьми. Данное различие было основано на состоянии его психического здоровья, то есть было проведено по "иному признаку". Европейский Суд должен был проверить, привели ли власти Румынии достаточные основания для того, чтобы психическое заболевание заявителя принималось во внимание при оценке обстоятельств дела. Заявитель рассматривался как угроза для дочери из-за его психического заболевания без дальнейшего анализа конкретных обстоятельств дела и семейной ситуации. В этом отношении настоящее дело отличается от дела "S.S. против Словении" (S.S. v. Slovenia) (Постановление Европейского Суда от 30 октября 2018 г., жалоба N 40938/16), в котором заявительница была лишена родительских прав не на основании ее диагноза, а вследствие ее неспособности заботиться о ребенке, что подтверждалось представленными в ходе производства экспертными заключениями.

 

Суды Румынии не оценили психическое состояние здоровья заявителя надлежащим образом. В их решениях не было элементов, которые позволили бы им определить, было ли это уместным соображением, которое должно было быть принято во внимание. Тот факт, что заявитель страдал психическим заболеванием, сам по себе не мог оправдать то, что с ним обращались не так, как с другими родителями, требовавшими общения с детьми. В частности, на момент принятия судебных решений заявитель регулярно принимал назначенные ему медикаменты, в предшествующие два года не было случаев психиатрической декомпенсации, вызванной болезнью. Следовательно, ограничив контакты заявителя с ребенком, суды Румынии провели различие, основанное на состоянии его психического здоровья, для оправдания которого они не привели уместных и достаточных оснований.

 

При таких обстоятельствах был установлен prima facie факт дискриминации. Бремя доказывания перешло к властям государства-ответчика, которые должны были убедительно доказать, что контакт заявителя с ребенком был ограничен не по дискриминационному основанию, а, скорее, поскольку его психическое состояние действительно снижало его способность заботиться о ребенке или что имели место иные основания для такого ограничения. С учетом специфики фактов и характера утверждений заявителя по подобным делам на практике заявителю было бы чрезвычайно сложно доказать факт дискриминации без переноса бремени доказывания. Однако власти Румынии не указали убедительных причин для опровержения презумпции о дискриминации в отношении заявителя по состоянию его психического здоровья.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 14 Конвенции во взаимосвязи со статьей 8 Конвенции (принято пятью голосами "за" при двух - "против").

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 10 000 евро в качестве компенсации морального вреда.

Hotărârea CtEDO din 18 februarie 2020 în cauza Cinta împotriva României (plangerea nr. 3891/19).

 

În 2019, solicitantul a fost asistat la pregătirea unei plângeri. Plângerea a fost ulterior comunicată României.

 

Cazul a examinat cu succes plângerea cu privire la restricția dreptului solicitantului de a comunica cu copilul în legătură cu tulburarea mintală a solicitantului, fără a evalua consecințele unei astfel de restricții asupra capacității acestuia de a avea grijă de copil sau pentru siguranța acestuia. A existat o încălcare a cerințelor articolului 8 din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale, articolul 14 din convenție coroborat cu articolul 8 din convenție.

 


CIRCUMSTANȚELE CAZULUI

 


Plângerea se referea la restricțiile impuse drepturilor reclamantului de a comunica cu fiica sa de patru ani de către instanțele române în timpul procedurilor de divorț și custodie a copilului. Reclamantul a susținut că programul întâlnirilor cu fiica sa, potrivit căruia nu se putea întâlni cu ea mai mult de două ori pe săptămână timp de două ore în prezența mamei sale, îl împiedica să dezvolte o relație personală cu ea și să participe efectiv la educația ei. El a insistat, de asemenea, că boala sa mintală a jucat un rol semnificativ în decizia de a-i aplica această restricție, deși nu s-au prezentat instanțelor dovezi că ar fi amenințat bunăstarea fiicei sale.

 


ÎNTREBĂRI DE LEGE

 


Respectarea articolului 8 din convenție. Deciziile luate de instanțele române cu privire la comunicarea reclamantului cu copilul au dus la o ingerință în dreptul reclamantului la respectarea vieții sale de familie, care a fost prevăzut de lege și a urmărit scopul legitim de a proteja drepturile altora.

 

Nu au fost prezentate dovezi care să susțină afirmația potrivit căreia reclamantul nu era capabil să-și îngrijească fiica sau să reprezinte o amenințare pentru ea. Mai important, Curtea nu a putut înțelege ce probe ar fi putut prezenta reclamantul pentru a demonstra instanțelor române că starea sa mentală nu a pus în pericol siguranța fiicei sale. În evaluarea sănătății mintale a reclamantului, instanțele nu au făcut trimitere la rapoarte de expertiză recente. Această circumstanță a limitat în mod semnificativ evaluarea faptică a vulnerabilității și stării mentale a solicitantului și a capacității acestuia de a îngriji copilul în perioada relevantă pentru circumstanțele din acest caz.

 

Mai mult, deciziile instanțelor române nu au oferit nicio explicație cu privire la modul în care au stabilit sau evaluat interesul superior al copilului. Nu era clar dacă au luat în considerare și au încercat să atenueze potențialul necaz pe care l-ar fi putut experimenta copilul, întrucât toate contactele cu tatăl au avut loc în prezența ambilor părinți, în ciuda conflictelor lor din acel moment. Nu au existat dovezi care să arate cum a beneficiat copilul de aceste condiții de întâlnire. Instanțele române nu au luat în considerare mijloace alternative, cum ar fi, de exemplu, comunicarea sub supravegherea unui reprezentant al autorității pentru protecția copilului.

 

Instanțele naționale nu au verificat suficient acuzațiile pe care le-a suferit fata ca urmare a acțiunilor tatălui ei. Copilul a fost audiat de un judecător în cameră, în absența unui psiholog expert de la autoritatea pentru protecția copilului. Din deciziile instanței nu a fost clar în ce măsură au fost luate în considerare acuzațiile copilului de comportament negativ de către tată, dacă programarea numirilor a fost făcută având în vedere această amenințare și, dacă da, cum. Evaluarea amenințării sau a lipsei acesteia pentru copil părea să contrazică însăși interzicerea violenței domestice împotriva copiilor, care era absolut interzisă în legislația internă, și arunca o umbră asupra procesului decizional.

 

Instanțele române au acționat rapid, timp de trei luni și jumătate, după cum se impune în cazurile care implică drepturile copilului. Cu toate acestea, urgența procedurilor nu trebuia atinsă în detrimentul calității evaluării instanțelor asupra tuturor probelor relevante.

 

În general, procesul de luare a deciziei controversate nu a oferit o evaluare adecvată a stării actuale de sănătate a solicitantului și luarea în considerare a tuturor opiniilor și intereselor. Procedura nu a fost însoțită de garanții care să fie proporționale cu gravitatea ingerinței și gravitatea intereselor implicate.

 


REZOLUŢIE

 


A existat o încălcare a articolului 8 din Convenție în acest caz (adoptat în unanimitate).

 

Respectarea articolului 14 din convenție coroborat cu articolul 8 din convenție. Prezența unei boli mintale poate fi luată în considerare la evaluarea capacității unui părinte de a avea grijă de un copil. Cu toate acestea, referirea la boala mintală ca un element crucial, sau chiar ca unul dintre numeroasele elemente, poate constitui discriminare dacă, în circumstanțele particulare ale cazului, boala mintală nu a afectat capacitatea părintelui de a avea grijă de copil. În conformitate cu standardele internaționale, persoanele cu boli mintale ar trebui să primească asistență adecvată din partea statului în îndeplinirea responsabilităților lor parentale, iar copiii nu ar trebui să fie separați de părinți fără o supraveghere judiciară adecvată.

 

În cazul de față, deși boala mintală a reclamantului nu a fost singurul element luat în considerare de instanțele române, a fost luată în considerare în toate etapele procesului decizional. Influența acestei boli asupra evaluării afirmațiilor reclamantului a fost un factor decisiv și a condus la decizia de a restricționa contactul reclamantului cu copilul. În acest sens, prezenta cauză diferă de SS împotriva Sloveniei (30 octombrie 2018, cererea nr. 40938/16), în care reclamanta a fost privată de drepturile sale părintești, nu pe baza diagnosticului său, dar din cauza incapacității sale de a avea grijă de copil, lucru confirmat de avizele experților prezentate în timpul procedurii.

 

Instanțele române nu au evaluat corect starea mentală a reclamantului. Nu au existat elemente în deciziile lor care să le permită să stabilească dacă aceasta a fost o considerație adecvată care ar fi trebuit să fie luată în considerare. Faptul că reclamantul suferea de o boală mintală nu putea justifica în sine faptul că era tratat diferit față de ceilalți părinți care aveau nevoie de comunicare cu copiii. În special, la momentul adoptării hotărârilor judecătorești, reclamantul lua în mod regulat medicamentele care i-au fost prescrise; în ultimii doi ani nu au existat cazuri de decompensare psihiatrică cauzată de boală. În consecință, prin limitarea contactului reclamantului cu copilul, instanțele române au făcut o distincție în funcție de starea sa de sănătate mintală, pentru care nu au oferit motive relevante și suficiente pentru a justifica.

 

În astfel de circumstanțe, a fost stabilit un fapt prima facie al discriminării. Sarcina probei a revenit autorităților statului pârât, care au trebuit să demonstreze convingător că contactul reclamantului cu copilul nu a fost restricționat pe o bază discriminatorie, ci mai degrabă pentru că starea sa mentală a afectat, de fapt, capacitatea sa de a avea grijă de copil sau că au existat și alte motive pentru a face acest lucru. restricții. In 2019, the applicant was assisted in preparing the application. The application was subsequently communicated to Romania.

 

The case successfully examined the application about the restriction of the applicant's right to communicate with the child in connection with the applicant's mental disorder without assessing the consequences of such restriction on his ability to take care of the child or for the child's safety. The case violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms, Article 14 of the Convention in conjunction with Article 8 of the Convention.

 


THE CIRCUMSTANCES OF THE CASE

 


The complaint concerned the restrictions imposed on the applicant's rights to communicate with his four-year-old daughter by the Romanian courts during the divorce and child custody proceedings. The applicant submitted that the schedule of meetings with his daughter, according to which he could not meet with her more than twice a week for two hours in the presence of his mother, prevented him from developing a personal relationship with her and effectively participating in her education. He also insisted that his mental illness played a significant role in the decision to apply the restriction to him, although no evidence was presented to the courts that he posed a threat to his daughter's well-being.

 


QUESTIONS OF LAW

 


Compliance with Article 8 of the Convention. The decisions taken by the Romanian courts on the applicant's communication with the child resulted in an interference with the applicant's right to respect for his family life, which was provided by law and pursued the legitimate aim of protecting the rights of others.

 

No evidence was presented to support the claim that the applicant was not capable of caring for his daughter or posed a threat to her. More importantly, the Court was unable to understand what evidence the applicant could have submitted to prove to the Romanian courts that his mental state did not endanger his daughter's safety. In assessing the applicant's mental health, the courts did not refer to any recent expert reports. This circumstance significantly limited the factual assessment of the applicant's vulnerability and mental state and his ability to care for the child at the time relevant to the circumstances of the present case.

 

Moreover, the decisions of the Romanian courts did not provide any explanation as to how they established or assessed the best interests of the child. It was unclear if they considered and attempted to mitigate the potential distress the child might have experienced as all contact with the father took place in the presence of both parents, despite their conflicts at the time. There was no evidence to show how the child benefited from these meeting conditions. Romanian courts have not considered alternative means such as, for example, communication under the supervision of a representative of the child protection authority.

 

The domestic courts did not sufficiently verify the allegations that the girl suffered as a result of her father's actions. The child was questioned by a judge in camera, in the absence of an expert psychologist from the child protection authority. It was not clear from the court decisions to what extent the child's allegations of negative behavior by the father were taken into account, whether the scheduling of the meetings had been drawn up with this threat in mind, and if so, how. The assessment of the threat, or lack thereof, to the child appeared to be in conflict with the very prohibition of domestic violence against children, which was absolutely prohibited in domestic law, and cast a shadow on the decision-making process.

 

Romanian courts acted quickly, over three and a half months, as required in cases involving children's rights. However, the urgency of the proceedings was not to be achieved at the expense of the quality of the courts' assessment of all relevant evidence.

 

In general, the process of making the controversial decision did not provide a proper assessment of the applicant's current state of health and consideration of all opinions and interests. The procedure was not accompanied by guarantees that were commensurate with the severity of the interference and the seriousness of the interests at stake.

 


RESOLUTION

 


There was a violation of Article 8 of the Convention in the case (adopted unanimously).

 

With regard to compliance with Article 14 of the Convention in conjunction with Article 8 of the Convention. The presence of a mental illness can be taken into account when assessing a parent's ability to care for a child. However, referring to mental illness as a crucial element, or even as one of many elements, may constitute discrimination if, in the particular circumstances of the case, the mental illness has not affected the parent's ability to care for the child. In accordance with international standards, persons with mental illness should receive adequate assistance from the state in fulfilling their parenting responsibilities, and children should not be separated from their parents without proper judicial supervision.

 

In the present case, although the applicant's mental illness was not the only element taken into account by the Romanian courts, it was taken into account at all stages of the decision-making process. The influence of this illness on the assessment of the applicant's allegations was a decisive factor and led to the decision to restrict the applicant's contact with the child. Thus, the applicant was faced with a difference in treatment compared to other parents requiring the restoration of contact with their children. This distinction was based on the state of his mental health, that is, it was drawn on a “different basis”. The Court had to check whether the Romanian authorities had adduced sufficient grounds for the applicant's mental illness to be taken into account in assessing the circumstances of the case. The applicant was viewed as a threat to his daughter due to his mental illness without further analysis of the specific circumstances of the case and the family situation. In this respect, the present case differs from SS v. Slovenia (judgment of 30 October 2018, application no. 40938/16), in which the applicant was deprived of her parental rights not on the basis of her diagnosis, but due to her inability to take care of the child, which was confirmed by the expert opinions presented during the proceedings.

 

The Romanian courts did not properly assess the applicant's mental state. There were no elements in their decisions that would enable them to determine whether this was an appropriate consideration that should have been taken into account. The fact that the applicant suffered from a mental illness could not in itself justify the fact that he was treated differently from other parents who required communication with children. In particular, at the time of the adoption of the court decisions the applicant was regularly taking the medication prescribed to him; in the previous two years there had been no cases of psychiatric decompensation caused by illness. Consequently, by limiting the applicant's contact with the child, the Romanian courts made a distinction based on his mental health condition, for which they did not provide relevant and sufficient grounds to justify.

 

In such circumstances, a prima facie fact of discrimination was established. The burden of proof shifted to the respondent State's authorities, which had to prove convincingly that the applicant's contact with the child was not restricted on a discriminatory basis, but rather because his mental state did in fact impair his ability to take care of the child or that there were other reasons for doing so. restrictions. Given the specifics of the facts and the nature of the applicant's allegations in such cases, in practice it would be extremely difficult for the applicant to prove the fact of discrimination without shifting the burden of proof. However, the Romanian authorities did not provide convincing reasons for rebutting the presumption of discrimination against the applicant on the basis of his mental health.

 


RESOLUTION

 


There was a violation of the requirements of Article 14 of the Convention in conjunction with Article 8 of the Convention (adopted by five votes in favor, two against).

 


COMPENSATION

 


Application of Article 41 of the Convention. The Court awarded the applicant EUR 10,000 in respect of non-pecuniary damage.
