Постановление ЕСПЧ от 03 марта 2020 года по делу "Баш (Bas) против Турции" (жалоба N 66448/17).

В 2017 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Турции.

По делу успешно рассмотрена жалоба на законность содержания под стражей заявителя, подозреваемого в участии в вооруженной террористической организации. По делу допущено нарушение требований пункта 1 статьи 5 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель являлся судьей, подозреваемым в участии в вооруженной террористической организации (FETÖ/PDY), которая 15 июля 2016 г. попыталась осуществить военный переворот в стране. Его заключили под стражу в рамках избранной меры пресечения 20 июля 2016 г., и 9 июня 2017 г. ему было предъявлено обвинение.

Впервые заявитель предстал перед судьей, который принимал решение о содержании заявителя под стражей, 19 сентября 2017 г., после того, как началось судебное разбирательство.

19 марта 2018 г. заявитель был признан виновным и приговорен к уголовному наказанию судом ассизов ("аслие").

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения пункта 1 статьи 5 Конвенции. (a) Законность содержания под стражей в рамках избранной меры пресечения.

(i) Пункт 1 статьи 5 Конвенции per se. В настоящем деле Европейский Суд пришел к тем же выводам, что и в деле "Алпарслан Алтан против Турции" (Alparslan Altan v. Turkey) (Постановление от 16 апреля 2019 г., жалоба N 12778/17).

Принцип правовой определенности может быть нарушен, если внутригосударственные суды вводят исключения в свое прецедентное право, которые противоречат положениям применимых норм законодательства. В этой связи Уголовно-процессуальный кодекс Турции содержал определение концепции in flagrante delicto, связанной с обнаружением преступления во время его совершения или сразу после этого. Однако в соответствии с новым толкованием Кассационного суда подозрения в участии в преступной организации могло являться достаточным для того, чтобы охарактеризовать элемент in flagrante delicto без необходимости устанавливать какие-либо текущие фактические обстоятельства или иные доказательства совершающегося преступления.

Это являлось расширительным толкованием концепции in flagrante delicto, отрицающим процессуальные гарантии, предоставленные членам судейского сообщества для защиты от вмешательства со стороны исполнительной власти. Данная судебная защита предоставлялась судьям для обеспечения их независимой работы без незаконных ограничений со стороны внесудебных органов или даже со стороны других судей, осуществляющих функцию надзора или контроля.

(ii) Статья 15 Конвенции. Расширительное толкование концепции in flagrante delicto имело юридические последствия, выходящие за пределы действия правовых норм, регулировавших вопрос о чрезвычайном положении. Следовательно, такое толкование не было каким-либо образом обоснованно особыми обстоятельствами чрезвычайного положения.

В свете вышеизложенного нельзя считать, что решение заключить заявителя под стражу в рамках применения меры пресечения, которое не было принято "в соответствии с процедурой, предусмотренной законом", было бы строго обусловлено срочностью ситуации.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований пункта 1 статьи 5 Конвенции (принято единогласно).

(b) Предполагаемое отсутствие на момент первоначального помещения заявителя под стражу разумного подозрения в том, что заявитель совершил преступление.

(i) Подпункт "c" пункта 1 статьи 5 Конвенции per se. Мировой суд (magistrate's court) основал свой вывод о наличии разумного подозрения в том, что заявитель совершил преступление в виде причастности к деятельности вооруженной террористической группы, на решении Совета судей и прокуроров (далее - HSK) и на ходатайстве прокуратуры начать расследование в отношении заявителя на следующий день после попытки военного переворота. HSK приостановил полномочия 2 735 судей и прокуроров, включая заявителя, на основании серьезного подозрения в том, что они являлись членами террористической организации. Однако решение HSK не содержало фактов или информации, которые бы прямо или лично касались заявителя. Общие и расплывчатые ссылки на Уголовно-процессуальный кодекс Турции и на доступные мировому суду доказательства не могли считаться достаточными в отсутствие либо специального рассмотрения отдельных доказательств из материалов дела, либо какой-либо информации, которая могла бы обосновать подозрение в отношении заявителя, либо иного вида подлежащих доказыванию материалов или фактов. Очевидно, что заявителя не подозревали в участии в попытке военного переворота. Более того, указания прокуратуры не были основаны на каких-либо "фактах" или "информации", способных послужить фактическим обоснованием действий в отношении заявителя.

Тот факт, что до того, как заявителя заключили под стражу, его допрашивал мировой суд в связи с участием заявителя в незаконной организации, свидетельствовал самое большее о том, что власти действительно подозревали заявителя в совершении указанного преступления, однако один этот факт не убедил бы объективного наблюдателя в том, что заявитель совершил рассматриваемое преступление. Кроме того, последующее осуждение заявителя по существу дела не имело отношения к рассмотрению этой жалобы.

Представленных Европейскому Суду доказательств было недостаточно, чтобы он мог согласиться с выводом о том, что на момент первоначального заключения заявителя под стражу в отношении него имелось какое-либо разумное подозрение. Также власти Турции не привели иных обоснований "разумного подозрения" в отношении заявителя.

(ii) Статья 15 Конвенции. При толковании и применении статьи 5 Конвенции Европейский Суд вынужден был принять во внимание проблемы, с которыми столкнулись власти Турции после попытки военного переворота в стране. Вместе с тем сложности в разрешении проблем, связанных с терроризмом, не могли оправдать расширения понятия "обоснованность" до такой степени, когда нарушается суть гарантии, предусмотренной подпунктом "c" пункта 1 статьи 5 Конвенции. Подозрение в отношении заявителя не достигло необходимого минимального уровня "обоснованности". При таких обстоятельствах нельзя считать, что рассматриваемая мера была строго необходима вследствие сложностей сложившейся ситуации.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований подпункта "c" пункта 1 статьи 5 Конвенции (принято единогласно).

По поводу соблюдения пункта 4 статьи 5 Конвенции.

(i) Пункт 4 статьи 5 Конвенции per se. На протяжении одного года и двух месяцев заявитель не являлся в суд, который принимал решение о его содержании под стражей. Такой промежуток времени нельзя было назвать "обоснованным".

(ii) Статья 15 Конвенции. Действительно, трудности, с которыми судебная система была вынуждена столкнуться в первое время после попытки государственного переворота в стране, являлись таковыми, что оправдывали отступление на основании статьи 15 Конвенции от права заключенных предстать перед судом, принимающим решение об их содержании под стражей, эти доводы постепенно теряли силу и относимость к делу, пока состояние чрезвычайного положения в государстве, угрожающее здоровью нации, хотя и сохранялось, но становилось менее напряженным. В связи с этим критерий крайней необходимости следовало применять более строго.

В то время, когда казалось невозможным провести судебное слушание при автоматических продлениях срока содержания лица под стражей и рассмотрении ходатайств об освобождении его из-под стражи, нормы законодательства не исключали такую возможность в случае возражений участников процесса. Однако все возражения заявителя по делу были рассмотрены и отклонены без проведения судебного заседания. Заявитель так и не предстал перед судьей в ходе предварительного следствия, хотя он был задержан без предъявления обвинения.

Кроме того, всего через несколько дней после отмены в стране чрезвычайного положения в законодательство было внесено изменение, согласно которому судебные слушания по делам о преступлениях, попадающих под действие Закона "О предотвращении террористической деятельности", должны были проводиться каждые 90 дней, в то время как Уголовно-процессуальный кодекс Турции требовал проведения судебного заседания каждые 30 дней.

Способ, с помощью которого суды Турции рассматривали вопрос о содержании заявителя под стражей, особенно в первые несколько месяцев, не предполагал, что внутригосударственные суды проанализировали вопрос о том, была ли эта мера законна по своей сути. Они выносили решение в отношении заявителя одновременно с принятием решений в отношении десятков других заключенных, не указывая отдельных причин в каждом конкретном деле, а принятые по делу заявителя решения не свидетельствуют о том, что судами были рассмотрены доводы заявителя, изложенные в его ходатайствах об освобождении и в возражениях в отношении применения данной меры.

Когда государство борется с чрезвычайной ситуацией, угрожающей жизни нации, оно останется беззащитным, если от него потребуют совершить все сразу, обеспечить с самого начала каждое из избранных им действий каждой гарантией, отвечающей приоритетным требованиям надлежащего функционирования властей и восстановления мира в сообществе. Толкование статьи 15 Конвенции должно оставлять место для прогрессивных изменений. Тем не менее в ситуации, влекущей за собой вмешательство в основополагающее конвенционное право, такое как право на свободу, и учитывая потенциально негативные последствия содержания лица под стражей без предъявления обвинения, тот факт, что на протяжении длительного срока заявитель не был доставлен в суд, решавший вопрос о содержании его под стражей, нарушал саму суть права, гарантированного пунктом 4 статьи 5 Конвенции, и непроведение судебного заседания не могло с обоснованностью считаться строго необходимым ввиду необходимости сохранения общественной безопасности.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований пункта 4 статьи 5 Конвенции (принято шестью голосами "за" при одном - "против").

Европейский Суд также отклонил как явно необоснованную жалобу на нарушение пункта 4 статьи 5 Конвенции в связи с предполагаемой зависимостью и предвзятостью мировых судов, принимая во внимание, в частности, конституционные и правовые гарантии, которыми пользовались эти суды, и отсутствие каких-либо относящихся к делу доводов, указывающих на причины сомневаться в беспристрастности и непредвзятости судов в деле заявителя.

ECHR decision of March 03, 2020 in the case "Bash (Bas) V. Turkey"(aplication N 66448/17).

In 2017, the applicant was assisted in preparing the aplication. The aplication was subsequently communicated to Turkey.

The case successfully considered an aplication about the legality of the detention of an applicant suspected of participating in an armed terrorist organization. The case violated the requirements of article 5, paragraph 1, of the Convention for the protection of human rights and fundamental freedoms.

 

FACTUAL BACKGROUND

 

The applicant was a judge suspected of participating in an armed terrorist organization (FETÖ/PDY) that attempted to carry out a military coup in the country on 15 July 2016. He was remanded in custody as part of a pre-trial measure on July 20, 2016, and charged on June 9, 2017.

The applicant first appeared before the judge who decided on the applicant's detention on 19 September 2017, after the trial had begun.

On 19 March 2018, the applicant was found guilty and sentenced to criminal punishment by the assize court ("asliye").

 

POINT OF LAW

 

Regarding compliance with article 5, paragraph 1, of the Convention. (a) the Lawfulness of detention under the chosen preventive measure.

(i) article 5, Paragraph 1, of the Convention per se. In the present case, the court reached the same conclusions as in Alparslan Altan V. Turkey (Judgment of 16 April 2019, application No. 12778/17).

The principle of legal certainty may be violated if domestic courts introduce exceptions to their case law that contradict the provisions of applicable law. In this regard, the Turkish code of Criminal procedure defined the concept of in flagrante delicto, which is related to the detection of a crime during its Commission or immediately after. However, according to the new interpretation of the court of Cassation, suspicion of participation in a criminal organization could be sufficient to characterize the element in flagrante delicto without the need to establish any current factual circumstances or other evidence of the crime being committed.

This was an extended interpretation of the concept of in flagrante delicto, denying the procedural guarantees provided to members of the judicial community to protect them from interference by the Executive. This judicial protection was granted to judges in order to ensure their independent work without unlawful restrictions by non-judicial bodies or even by other judges who exercise a Supervisory or Supervisory function.

(ii) Article 15 of the Convention. The broad interpretation of the concept of in flagrante delicto had legal consequences that went beyond the scope of the legal rules governing the state of emergency. Consequently, this interpretation was not in any way justified by the special circumstances of the state of emergency.

In the light of the above, it cannot be considered that the decision to detain the applicant as part of a preventive measure that was not taken "in accordance with the procedure provided for by law" would have been strictly based on the urgency of the situation.

 

RESOLUTION

 

The case violated the requirements of article 5, paragraph 1, of the Convention (adopted unanimously).

(b) the Alleged absence at the time of the applicant's initial detention of a reasonable suspicion that the applicant had committed a crime.

(i) Subparagraph "c" of paragraph 1 of article 5 of the Convention per se. The magistrate's court based its conclusion that there was a reasonable suspicion that the applicant had committed a crime of involvement in the activities of an armed terrorist group on the decision of the Council of judges and prosecutors (HSK) and on the request of the Prosecutor's office to launch an investigation against the applicant the day after the attempted military coup. HSK suspended the powers of 2,735 judges and prosecutors, including the applicant, on the basis of serious suspicion that they were members of a terrorist organization. However, the HSK decision did not contain facts or information that directly or personally concerned the applicant. General and vague references to the Turkish code of Criminal procedure and to the evidence available to the world court could not be considered sufficient in the absence of either a special examination of individual evidence from the case file, or any information that could justify suspicion of the applicant, or any other type of material or facts to be proved. It is clear that the applicant was not suspected of participating in the attempted military coup. Moreover, the Prosecutor's office's instructions were not based on any "facts" or "information" that could serve as a factual justification for actions against the applicant.

The fact that the applicant had been questioned by a magistrate's court in connection with the applicant's involvement in an illegal organization before being taken into custody indicated at most that the authorities did suspect the applicant of having committed the crime in question, but this fact alone would not have convinced an objective observer that the applicant had committed the crime in question. Furthermore, the applicant's subsequent conviction on the merits was not relevant to the consideration of this complaint.

The evidence before the court was insufficient to allow it to accept the conclusion that there was any reasonable suspicion of the applicant at the time of his initial detention. Nor did the Turkish authorities provide any other grounds for "reasonable suspicion" against the applicant.

(ii) Article 15 of the Convention. In interpreting and applying article 5 of the Convention, the European Court had to take into account the problems faced by the Turkish authorities after the attempted military coup in the country. However, difficulties in dealing with terrorism-related issues could not justify expanding the concept of "reasonableness" to the extent that the essence of the guarantee provided for in article 5, paragraph 1 (c), of the Convention was violated. The suspicion against the applicant did not reach the required minimum level of"validity". In such circumstances, it cannot be considered that the measure in question was strictly necessary due to the complexities of the situation.

 

RESOLUTION

 

The case violated the requirements of article 5, paragraph 1 (c), of the Convention (adopted unanimously).

Regarding compliance with article 5, paragraph 4, of the Convention.

(i) article 5, Paragraph 4, of the Convention per se. For one year and two months, the applicant did not appear before the court, which decided on his detention. Such a period of time could not be called "justified".

(ii) Article 15 of the Convention. Indeed, the difficulties that the judicial system was forced to face in the first period after the attempted coup d'etat in the country were such as to justify a derogation under article 15 of the Convention from the right of prisoners to appear before a court that decides on their detention.these arguments gradually lost their force and relevance, while the state of emergency in the state, which threatens the health of the nation, although maintained, became less tense. In this regard, the criterion of extreme necessity should have been applied more strictly.

At a time when it seemed impossible to hold a court hearing with automatic extensions of the period of detention of a person and consideration of applications for release from custody, the law did not exclude this possibility if the participants in the process objected. However, all the applicant's objections in the case were considered and rejected without a court hearing. The applicant never appeared before a judge during the preliminary investigation, although he was detained without charge.

In addition, just a few days after the state of emergency was lifted in the country, a change was made to the legislation, according to which court hearings in cases of crimes falling under the law "on the prevention of terrorist activities" were to be held every 90 days, while the Criminal procedure code of Turkey required a court session every 30 days.

The manner in which the Turkish courts dealt with the issue of the applicant's detention, especially in the first few months, did not imply that the domestic courts had examined whether the measure was inherently lawful. They made decisions against the applicant at the same time as they made decisions against dozens of other prisoners, without specifying individual reasons in each particular case, and the decisions taken in the applicant's case do not indicate that the courts considered the applicant's arguments set out in his requests for release and in the objections to the application of this measure.

When a state is dealing with an emergency that threatens the life of a nation, it will be left defenseless if it is required to do everything at once, to provide from the very beginning each of its chosen actions with every guarantee that meets the priority requirements of the proper functioning of the authorities and the restoration of peace in the community. The interpretation of article 15 of the Convention should leave room for progressive changes. However, in a situation that interfered with a fundamental Convention right, such as the right to liberty, and given the potentially negative consequences of holding a person in custody without charge, the fact that the applicant had not been brought before a court for a long period of time to decide on his detention violated the very essence of the right guaranteed by article 5, paragraph 4, of the Convention, and the failure to hold a trial could not reasonably be considered strictly necessary in view of the need to preserve public safety.

 

RESOLUTION

 

The case violated the requirements of article 5, paragraph 4, of the Convention (adopted by six votes in favor and one against).

The court also rejected as manifestly unfounded the complaint of a violation of article 5, paragraph 4, of the Convention on the alleged dependence and bias of the magistrates ' courts, taking into account, in particular, the constitutional and legal guarantees enjoyed by these courts and the absence of any relevant arguments indicating reasons to doubt the impartiality and impartiality of the courts in the applicant's case.

KARAR

По делу успешно рассмотрена жалоба на аннулирование государственных образовательных дипломов заявителей в связи с административными нарушениями, допущенными в первый год обучения заявителей в высшем учебном заведении. По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В 2003 и 2004 годах заявители, пять граждан Италии, начали проходить обучение в университете после того, как они подали заявления об их зачислении на курс обучения стоматологов. Решения о зачислении заявителей, вынесенные от имени ректора университета, содержали указание на то, что процедура зачисления на обучение "не завершена", поскольку еще не получено соответствующее разрешение из Министерства образования Румынии. В конце 2008 года или начале 2009 года заявители сдали экзамены на знание румынского языка.

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции. Аннулирование государственных дипломов заявителей о получении специальности "стоматолог" повлекло определенные последствия не только для социальной самоидентификации заявителей в форме взаимоотношений с другими лицами, но и для их профессиональной жизни, поскольку была поставлена под сомнение их квалификация как специалистов, а их планы по профессиональному росту были внезапно нарушены. При таких обстоятельствах принятая властями мера повлекла последствия для осуществления заявителями их права на уважение "частной жизни". Мера являлась вмешательством в указанное право, которое было предусмотрено законом и имело целью предотвращение беспорядков и защиту прав других лиц.

 

Решения о приеме студентов были оформлены и подписаны деканом факультета медицины и фармакологии до того, как были получены письма о разрешении Министерством образования и результаты сдачи экзамена на владение румынским языком. На основании этих решений заявителям было разрешено пройти полный шестилетний курс обучения на врача-стоматолога, и они были допущены к выпускным экзаменам. Заявители не могли бы все это сделать, если бы с самого начала университет отказал бы им в приеме по административным причинам.

 

На основании изложенного совет университета также подтвердил законность административного положения заявителей и их участие в выпускных экзаменах. Однако особое значение следует уделить контексту, в котором принимались решения о приеме заявителей в университет, который характеризовался, как оказалось, определенными расхождениями в позиции администрации университета и Министерства образования Румынии относительно позднего оформления писем о разрешении принять заявителей в университет. Последовавшую ситуацию неопределенности и непоследовательности, безусловно, нельзя ставить в вину заявителям.

 

В заключение, аннулируя дипломы заявителей, власти Румынии неожиданно причинили ущерб профессиональному положению заявителей, при этом отсутствовали какие-либо негативные оценки, которые могли бы заставить предположить, что заявители были недостаточно квалифицированы для работы по специальности.

 

Таким образом, обжалуемые меры не отвечали критерию настоятельной общественной необходимости и не были пропорциональны преследуемой законной цели. Следовательно, они не являлись необходимыми в демократическом обществе.

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил каждому из заявителей по 100 00 евро в качестве компенсации морального вреда.

In 2014, the applicants were assisted in preparing the aplication. The aplication was subsequently communicated to Romania.

 

The case successfully considered an aplication about the cancellation of the applicants 'state educational diplomas in connection with administrative violations committed in the applicants' first year of higher education. The case violated the requirements of article 8 of the Convention for the protection of human rights and fundamental freedoms.

 

 

 

FACTUAL BACKGROUND

 

 

 

In 2003 and 2004, the applicants, five Italian citizens, started University studies after they applied for admission to a dental training course. The decisions on the applicants ' admission, made on behalf of the University rector, indicated that the enrollment procedure was "not completed", since the relevant permission from the Romanian Ministry of education had not yet been received. In late 2008 or early 2009, the applicants passed the Romanian language proficiency exams.

 

In 2009, during a data exchange between the rector of the University and the Ministry of education of Romania, attention was drawn to the fact that the first applicant had not received a letter from this Ministry confirming admission to the University, and the letters to four other applicants concerned their second year of study, but not their first. However, the University Council agreed to the Dean's proposal to allow all applicants to take their final exams.

 

Thus, after six years of study, applicants were admitted to the final exams and passed them. They received state diplomas in the specialty "dentist". Subsequently, the applicants initiated a procedure for recognition of their diplomas by the Italian authorities in order to continue working in that country.

 

In 2011, the applicants ' documents were the subject of an administrative review, which found violations due to the late processing of letters of permission for applicants to study at the University of Romania. Thus, the applicants ' diplomas were revoked by the University Council at the request of the Romanian Ministry of education. The applicants ' complaints were unsuccessful.

 

 

 

POINT OF LAW

 

 

 

Regarding compliance with article 8 of the Convention. The cancellation of the applicants ' state diplomas for the specialty "dentist" entailed certain consequences not only for the applicants ' social self-identification in the form of relationships with other persons, but also for their professional life, since their qualifications as specialists were called into question, and their plans for professional growth were suddenly disrupted. In these circumstances, the measure taken by the authorities had consequences for the applicants ' exercise of their right to respect for "private life". The measure was an interference with the said right, which was provided for by law and was intended to prevent riots and protect the rights of others.

 

The student admission decisions were drawn up and signed by the Dean of the faculty of medicine and pharmacology before the letters of approval from the Ministry of education and the results of the Romanian language proficiency exam were received. Based on these decisions, the applicants were allowed to complete a full six-year course of training as a dentist and were allowed to take their final exams. The applicants would not have been able to do all this if the University had refused them admission from the very beginning for administrative reasons.

 

Based on the above, the University Council also confirmed the legality of the applicants ' administrative status and their participation in the final exams. However, special attention should be paid to the context in which decisions were made to admit applicants to the University, which was characterized, as it turned out, by certain differences in the position of the University administration and the Ministry of education of Romania regarding the late processing of letters of permission to admit applicants to the University. The resulting situation of uncertainty and inconsistency cannot, of course, be blamed on the applicants.

 

In conclusion, by cancelling the applicants 'diplomas, the Romanian authorities unexpectedly damaged the applicants' professional standing, and there were no negative assessments that could lead to the assumption that the applicants were not qualified to work in their specialty.

 

Thus, the measures complained of did not meet the criterion of urgent public necessity and were not proportionate to the legitimate aim pursued. Consequently, they were not necessary in a democratic society.

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The European Court awarded each of the applicants EUR 100,00 in respect of non-pecuniary damage.

În 2014, solicitanților li s-a acordat ajutor în pregătirea plîngerii. Plângerea a fost ulterior comunicată României.

 

În dosar a fost examinată cu succes plângerea privind anularea diplomelor educaționale de stat ale solicitanților în legătură cu încălcările administrative comise în primul an de studii ale solicitanților din instituția de învățămînt superior. CIRCUMSTANȚELE CAZULUI

 

 

 

În 2003 și 2004, solicitanții, cinci cetățeni italieni, au început studiile la universitate după ce au depus cereri de înscriere pentru un curs de formare dentară. Deciziile de înscriere a solicitanților, emise în numele rectorului universității, conțineau indicația că procedura de înscriere la studii "nu a fost finalizată", deoarece încă nu a fost obținută autorizația corespunzătoare din partea Ministerului Educației al României. La finele anului 2008 sau începutul anului 2009, solicitanții au susținut examenele de cunoaștere a limbii române.

 

În 2009, la cursul de schimb de date între rectorul universității și de Ministerul educației din România, s-a atras atenția asupra faptului că primul solicitantul nu a primit o scrisoare de la acest Minister, cu confirmare de acceptare de la universitate, și scrisori în adresa altor patru solicitanți au vizat de-al doilea an de formarea lor, dar nu din prima. Cu toate acestea, Consiliul universității a fost de acord cu propunerea decanului de a permite tuturor solicitanților să treacă examenele finale.

 

Astfel, după șase ani de studii, solicitanții au fost admiși la examenele finale și le-au trecut. Ei au primit diplome de stat la specialitatea "dentist". Ulterior, solicitanții au inițiat procedura de recunoaștere a diplomelor lor de către autoritățile italiene pentru a continua activitatea în această țară.

 

În 2011, documentele solicitanților au făcut obiectul unui control administrativ, care a stabilit încălcări în legătură cu emiterea târzie a scrisorilor de autorizare a solicitanților de a studia la Universitatea din România. PROBLEME DE DREPT

 

 

 

Privind respectarea articolului 8 din Convenție. Anularea diplomelor de stat solicitanților de specialitate "dentist" a generat implicații nu numai pentru a socială a identității solicitanților în a forma relații cu alte persoane, dar și pentru viața lor profesională, deoarece a fost pus la îndoială calificarea lor ca specialiști, iar planurile lor de cariere au fost brusc încălcate. În astfel de circumstanțe, măsura adoptată de autorități a dus la consecințe pentru exercitarea de către solicitanți a dreptului lor de a respecta "viața privată". Măsura a fost o intervenție în dreptul menționat, care a fost prevăzut de lege și a avut scopul de a preveni revoltele și de a proteja drepturile altora.

 

Deciziile privind admiterea studenților au fost întocmite și semnate de decanul Facultății de Medicină și farmacologie înainte de a fi primite scrisorile de autorizare de către Ministerul Educației și rezultatele examenului de competență în limba română. În baza acestor decizii, solicitanților li sa permis să urmeze un curs complet de șase ani de instruire la medicul dentist și au fost admiși la examenele finale. Solicitanții nu ar fi putut face toate acestea dacă, de la început, Universitatea le-ar fi refuzat admiterea din motive administrative.

 

În baza Consiliului universitar, de asemenea, a confirmat legalitatea dispozițiilor administrative ale solicitanților și participarea lor la examenele finale. Cu toate acestea, o importanță deosebită trebuie acordată contextului în care au fost luate decizii privind primirea solicitanților de la universitatea, care a fost caracterizat, după cum sa dovedit, anumite discrepanțe în poziția administrației universității și de Ministerul educației din România relativ târziu efectuarea de e-mailuri cu privire la autorizarea solicitanților să ia în universitate. По делу успешно рассмотрена жалоба на запрет на общение с психически больной женщиной, являвшейся матерью ребенка заявителя. Жалоба на нарушение статьи 8 Конвенции о защите прав человека и основных свобод объявлена неприемлемой для рассмотрения по существу. По делу не допущено нарушений пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод. По делу допущено нарушение требований статьи 6 Конвенции о защите прав человека и основных свобод в ее гражданско-правовом аспекте применительно к заслушиванию показаний заявителя в суде.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявитель, которому был 71 год, проживал с партнершей P.B., которая являлась опекуном своей дочери V., 22-летней психически больной молодой женщины. У заявителя были сексуальные отношения с V., и в марте 2011 года у нее родился от заявителя ребенок.

 

В 2009 и 2010 годах в отношении заявителя возбуждались уголовные дела по обвинению в сексуальном домогательстве в отношении лиц, которые не могли оказать сопротивления. Оба уголовных дела были прекращены.

 

В сентябре 2010 года в районный суд поступила информация из местной больницы о том, что V., вероятно, подверглась сексуальному насилию, поскольку она страдала от средней степени психического расстройства и была беременна от заявителя. Воспользовавшись процедурой временного судебного предписания, районный суд поместил V. в специальный приют и назначил ей профессионального опекуна. В марте 2011 года районный суд продлил действие временного судебного предписания, ссылаясь на три экспертных заключения. Однако заявитель настаивал на продолжении сексуальных отношений с V. В январе 2013 года районным судом было вынесено постановление о запрете общения заявителя и V. для защиты последней.

 

Заявитель утверждал, что указанный запрет на общение нарушал его права, гарантированные статьями 6 и 8 Конвенции.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции. Один только тот факт, что заявитель жил совместно с P.B. и V. и являлся биологическим отцом ребенка V., не означал наличия семейной связи, которая требовала бы защиты как "семейная жизнь" согласно статье 8 Конвенции.

 

Понятие "частная жизнь" нельзя понимать как гарантирующее право устанавливать отношения с определенным человеком. "Частная жизнь", как правило, отсутствует в ситуациях, когда заявитель не вел "семейной жизни" с указанным человеком и когда этот человек не разделял стремления поддерживать такой контакт. Это правило применяется еще шире, когда лицо, с которым заявитель хотел поддерживать отношения, становилось жертвой поведения, которое суды соответствующего государства считали наносящим ущерб указанному лицу.

 

На статью 8 Конвенции также нельзя ссылаться для обжалования утраты репутации, которая являлась предвидимым последствием чьих-либо собственных действий, таких, например, как совершение уголовного преступления. Это правило не ограничивается причинением ущерба репутации, но распространяется на более широко применимый принцип, согласно которому личные, социальные, психологические и экономические трудности, которые являлись предвидимыми последствиями совершения уголовного преступления, не могли использоваться как основания для жалобы на то, что приговор по уголовному делу являлся вмешательством в право на уважение "частной жизни". Этот расширенный принцип распространяется не только на уголовные преступления, но и на противоправное поведение, влекущее юридическую ответственность с предвидимыми негативными последствиями для "частной жизни".

 

В настоящем деле запрет на общение не затронул взаимоотношения заявителя с другими людьми в целом, а только исключил какие-либо контакты с V. Заявитель настаивал на контактах с V., хотя суды Германии установили, что V. не высказывала какой-либо особой заинтересованности в контактах с заявителем. Более того, контакты между заявителем и V. были признаны наносящими ущерб V., которая проявляла признаки психического расстройства и нуждалась в медицинской помощи после визитов заявителя в приют, где жила V. В связи с этим Европейский Суд пришел к выводу, что заявитель не мог ссылаться на статью 8 Конвенции для обжалования постановления о запрете контактов с V.

 

Кроме того, согласно мнению гражданских судов, которые основывали свою позицию на заключениях трех экспертов, V. родила ребенка в результате серьезного нарушения ее личных прав, поскольку она не могла понимать последствий и рисков половых отношений и беременности. Заявитель не оставлял своих намерений продолжить злоупотреблять состоянием V., что, вероятно, привело бы к дальнейшим беременностям V. и риску для нее самой. В своем предложении прекратить производство по уголовному делу окружной суд прямо указал заявителю и P.B., что V. считалась лицом, неспособным оказывать сопротивление. Следовательно, решение вынести постановление о запрете на общение и его последствия являлись предвидимыми результатами намерения заявителя продолжать посещать V.

 

При таких обстоятельствах обжалование заявителем запрета на общение не относилось к сфере действия понятия "частная жизнь" по смыслу статьи 8 Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

Жалоба на нарушение статьи 8 Конвенции объявлена неприемлемой для рассмотрения по существу (как несовместимая с требованиями Конвенции ratione materiae).

 

По поводу соблюдения статьи 6 Конвенции (гражданско-правовой аспект). Разбирательство в целом имело достаточную доказательственную базу, поскольку суды Германии выслушали показания V. и исследовали три экспертных заключения. Суды также располагали и другими доказательствами и предоставили заявителю возможность изложить свои доводы в письменном виде.

 

Власти Германии основывали свое решение о запрете заявителю общаться с V. не на том факте, что V. являлась недееспособным лицом, а, скорее, на тех обстоятельствах, что недееспособность V. носила такой характер, что лишала ее возможности адекватно понимать (i) значение и последствия контактов с заявителем, и (ii) на особенностях взаимоотношений с заявителей, включая, inter alia, тот факт, что ранее заявитель был сексуальным партнером матери V. Власти Германии дополнительно приняли во внимание тот фактор, что любая иная форма контакта с заявителем также не принесет пользу V.

 

В итоге ничто не указывало на то, что суды Германии недостаточным образом мотивировали свои решения или что они произвольно отказались рассматривать относящиеся к делу доказательства.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу не было допущено нарушения требований статьи 6 Конвенции в ее гражданско-правовом аспекте (принято единогласно).

 

По поводу соблюдения статьи 6 Конвенции (гражданско-правовой аспект). Вопросы, являвшиеся сутью разбирательства, повлекли оценку личности заявителя и его взаимоотношений с V., характер которых заявитель оспаривал. Даже при том, что заявитель настаивал на своей позиции, чтобы продолжать сексуальные отношения с V., и хотя районный суд заслушал показания самого заявителя в ходе производства по вопросу об опекунстве, рассматриваемый в деле вопрос не имел чисто правового и технического характера и позволил бы судам Германии сформировать свое мнение о заявителе, а заявителю объяснить свою личную ситуацию. Следовательно, отсутствовали какие-либо исключительные обстоятельства, которые освободили бы суды Германии от обязанности выслушать объяснения непосредственно от заявителя.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 6 Конвенции в ее гражданско-правовом аспекте применительно к заслушиванию показаний заявителя в суде (принято четырьмя голосами "за" при трех - "против").

 

Европейский Суд также постановил единогласно, что не было допущено нарушения пункта 1 статьи 6 Конвенции, поскольку отказ судов Германии предоставить заявителю полный доступ к материалам дела об опекунстве не имел такого характера, чтобы нарушить саму суть способности заявителя защищать свою позицию относительно предполагаемого запрета на общение, так как данное обстоятельство было подтверждено относящимися к делу и достаточными доказательствами.

 

 

 

КОМПЕНСАЦИЯ

ECHR decision of 31 October 2019 in the case "Evers V. Germany" (aplication N 17895/14).

 

In 2014, the applicant was assisted in the preparation of the aplication. The aplication was subsequently communicated to Germany.

 

The case successfully considered an aplication against the ban on communication with a mentally ill woman who was the mother of the applicant's child. The complaint of a violation of article 8 of the Convention for the protection of human rights and fundamental freedoms was declared inadmissible on the merits. There were no violations of article 6, paragraph 1, of the Convention for the protection of human rights and fundamental freedoms. The case violated the requirements of article 6 of the Convention for the protection of human rights and fundamental freedoms in its civil law aspect in relation to hearing the applicant's testimony in court.

 

 

 

FACTUAL BACKGROUND

 

 

 

The applicant, aged 71, lived with his partner P. B., who was the guardian of her daughter V., a 22-year-old mentally ill young woman. The applicant had a sexual relationship with V. and in March 2011 she had a child with the applicant.

 

In 2009 and 2010, criminal proceedings were initiated against the applicant on charges of sexual harassment against persons who could not resist. Both criminal cases were dismissed.

 

In September 2010, the district court received information from a local hospital that V. had probably been sexually assaulted, as she suffered from a moderate degree of mental disorder and was pregnant with the applicant's child. Using the temporary injunction procedure, the district court placed V. in a special shelter and assigned her a professional guardian. In March 2011, the district court extended the temporary injunction, citing three expert opinions. However, the applicant insisted on continuing sexual relations with V. In January 2013, the district court issued an order banning communication between the applicant and V. in order to protect the latter.

 

The applicant claimed that the ban on communication violated his rights under articles 6 and 8 of the Convention.

 

 

 

POINT OF LAW

 

 

 

Regarding compliance with article 8 of the Convention. The mere fact that the applicant lived together with P. B. and V. and was the biological father of child V. did not mean that there was a family connection that would require protection as "family life" under article 8 of the Convention.

 

The concept of "private life" cannot be understood as guaranteeing the right to establish a relationship with a particular person. "Private life "is generally absent in situations where the applicant did not have a" family life " with the person in question and where the person did not share the desire to maintain such contact. This rule applies even more broadly when the person with whom the applicant wished to maintain a relationship was the victim of conduct that the courts of the state concerned considered prejudicial to the person concerned.

 

Article 8 of the Convention can also not be invoked to appeal against loss of reputation that was a foreseeable consequence of someone's own actions, such as the Commission of a criminal offence. This rule is not limited to damage to reputation, but extends to the more widely applicable principle that personal, social, psychological and economic difficulties that were the foreseeable consequences of the Commission of a criminal offence could not be used as grounds for complaining that a criminal conviction interfered with the right to respect for "private life". This expanded principle applies not only to criminal offences, but also to illegal conduct that entails legal liability with foreseeable negative consequences for "private life".

 

In the present case, the ban on communication did not affect the applicant's relationship with other people in General, but only excluded any contact with V. The applicant insisted on contacting V., although the German courts found that V. did not Express any particular interest in contacting the applicant. Moreover, the contacts between the applicant and V. were found to be detrimental to V., who showed signs of a mental disorder and needed medical attention after the applicant's visits to the shelter where V. lived. The court therefore concluded that the applicant could not invoke article 8 of the Convention to appeal against the decision banning contact with V.

 

In addition, according to the civil courts, which based their position on the conclusions of three experts, V. gave birth to a child as a result of a serious violation of her personal rights, since she could not understand the consequences and risks of sexual relations and pregnancy. The applicant did not abandon his intention to continue abusing V.'s condition, which would probably have led to V.'s further pregnancies and risk to herself. In its motion to terminate the criminal proceedings, the district court explicitly stated to the applicant and P. B. that V. was considered incapable of resisting. Consequently, the decision to order a ban on communication and its consequences were the foreseeable results of the applicant's intention to continue visiting V.

 

In these circumstances, the applicant's appeal against the ban on communication did not fall within the scope of the concept of "private life" within the meaning of article 8 of the Convention.

 

 

 

RESOLUTION

 

 

 

The complaint of a violation of article 8 of the Convention is declared inadmissible on the merits (as incompatible with the requirements of the Convention ratione materiae).

 

Regarding compliance with article 6 of the Convention (civil law aspect). The proceedings generally had a sufficient evidentiary basis, as the German courts listened to V.'s testimony and examined three expert opinions. The courts also had other evidence and provided the applicant with an opportunity to present his arguments in writing.

 

The German authorities did not base their decision to prohibit the applicant from communicating with V. on the fact that V. was an incapacitated person, but rather under the circumstances that incapacitation V. it was of such a nature that it prevented her from adequately understanding (i) the meaning and consequences of contact with the applicant, and (ii) the specifics of the relationship with the applicants, including, inter alia, the fact that the applicant had previously been a sexual partner of mother V. The German authorities further took into account the fact that any other form of contact with the applicant would also not benefit V.

 

As a result, there was nothing to indicate that the German courts had insufficiently motivated their decisions or that they had arbitrarily refused to consider relevant evidence.

 

 

 

RESOLUTION

 

 

 

The case did not violate the requirements of article 6 of the Convention in its civil aspect (adopted unanimously).

 

Regarding compliance with article 6 of the Convention (civil law aspect). The issues at the heart of the proceedings led to an assessment of the applicant's identity and his relationship with V., the nature of which the applicant disputed. Even though the applicant maintained his position in order to continue sexual relations with V., and although the district court heard the applicant's own testimony during the custody proceedings, the issue at issue was not purely legal and technical and would have allowed the German courts to form an opinion on the applicant and the applicant to explain his personal situation. Consequently, there were no exceptional circumstances that would have exempted the German courts from the obligation to hear explanations directly from the applicant.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of article 6 of the Convention in its civil law aspect in relation to the hearing of the applicant's testimony in court (adopted by four votes in favour and three against).

 

The court also held unanimously that there was no violation of article 6, paragraph 1, of the Convention, since the refusal of the German courts to grant the applicant full access to the custody case file was not of such a nature as to violate the very essence of the applicant's ability to defend his position on the alleged prohibition of communication, as this fact was confirmed by relevant and sufficient evidence.

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The European Court of justice held that the finding of a violation of the Convention would in itself constitute sufficient just compensation for non-pecuniary damage.

Die Beschwerde über das Verbot der Kommunikation mit einer psychisch Kranken Frau, die Mutter des Kindes des Antragstellers war, wurde erfolgreich in dem Fall geprüft. Eine Beschwerde über die Verletzung von Artikel 8 des übereinkommens zum Schutz der Menschenrechte und Grundfreiheiten wurde als inakzeptabel für inhaltlich betrachtet. In dem Fall sind keine Verstöße gegen Artikel 6 Absatz 1 des übereinkommens zum Schutz der Menschenrechte und Grundfreiheiten zulässig. In dem Fall wurde eine Verletzung der Anforderungen des Artikels 6 des übereinkommens zum Schutz der Menschenrechte und Grundfreiheiten in seinem zivilrechtlichen Aspekt in Bezug auf die Anhörung der Aussage des Antragstellers vor Gericht zugelassen.

 

 

 

SACHVERHALT

 

 

 

Die Klägerin, die 71 Jahre alt war, lebte mit einer Partnerin von P. B., die der Vormund Ihrer Tochter V. war, einer 22-jährigen psychisch Kranken Jungen Frau. Die Klägerin hatte eine sexuelle Beziehung zu V. und im März 2011 wurde von der Klägerin ein Kind geboren.

 

In den Jahren 2009 und 2010 wurden gegen den Beschwerdeführer Strafverfahren wegen sexueller Belästigung gegen Personen eingeleitet, die keinen Widerstand leisten konnten. Beide Strafverfahren wurden eingestellt.

 

Im September 2010 ging beim Landgericht die Information aus dem örtlichen Krankenhaus ein, dass V. wahrscheinlich sexuell missbraucht worden sei, da Sie an einer mittelschweren psychischen Störung litt und von der Klägerin Schwanger war. Das Landgericht setzte V. in ein spezielles Tierheim und ernannte Sie zu einem professionellen Betreuer. Im März 2011 verlängerte das Landgericht die einstweilige Verfügung und verwies auf drei Gutachten. Die Klägerin Bestand jedoch darauf, die sexuelle Beziehung mit V. fortzusetzen. Im Januar 2013 hatte das Landgericht den Beschluss gefasst, die Kommunikation von Klägerin und V. zur Verteidigung des letzteren zu verbieten.

 

Der Beschwerdeführer behauptete, dass dieses Verbot der Kommunikation gegen seine in den Artikeln 6 und 8 des übereinkommens garantierten Rechte verstoße.

 

 

 

RECHTSFRAGE

 

 

 

Über die Einhaltung von Artikel 8 des übereinkommens. Allein die Tatsache, dass der Beschwerdeführer zusammen mit P. B. und V. lebte und der biologische Vater des Kindes V. war, bedeutete nicht, dass es eine familiäre Verbindung gab, die Schutz als "Familienleben" nach Artikel 8 des übereinkommens erforderte.

 

Der Begriff "Privatleben" kann nicht als garantiere das Recht verstanden werden, eine Beziehung mit einer bestimmten Person aufzubauen. In Situationen, in denen der Antragsteller kein" Familienleben "mit einer bestimmten Person führte und in denen die Person nicht den Wunsch teilte, einen solchen Kontakt aufrechtzuerhalten, besteht in der Regel kein" Privatleben". Diese Regel gilt noch weiter, wenn die Person, mit der der Antragsteller eine Beziehung pflegen wollte, Opfer eines Verhaltens wurde, das die Gerichte des betreffenden Staates für schädlich hielten.

 

Artikel 8 des übereinkommens kann auch nicht zur Berufung auf den Verlust des Rufs, der eine vorhersehbare Folge der eigenen Handlungen, wie zum Beispiel die Begehung einer straftat war, verwiesen werden. Diese Regel beschränkt sich nicht auf die Schädigung des Rufs, sondern erstreckt sich auf einen allgemein anwendbaren Grundsatz, Wonach persönliche, soziale, psychologische und wirtschaftliche Schwierigkeiten, die vorhersehbare Folgen einer straftat waren, nicht als Grundlage für Beschwerden verwendet werden konnten, dass ein Strafverfahren einen Eingriff in das Recht auf die Achtung des "Privatlebens"darstellte. Dieses erweiterte Prinzip gilt nicht nur für Straftaten, sondern auch für rechtswidriges Verhalten, das eine rechtliche Haftung mit vorhersehbaren negativen Folgen für das "Privatleben"mit sich bringt.

 

In diesem Fall hat das kommunikationsverbot die Beziehung des Klägers zu anderen Personen im Allgemeinen nicht berührt, sondern nur jegliche Kontakte mit V. ausgeschlossen der Kläger Bestand auf Kontakten mit V., obwohl die deutschen Gerichte festgestellt haben, dass V. kein besonderes Interesse an Kontakten mit dem Kläger äußerte. Darüber hinaus wurden die Kontakte zwischen der Klägerin und V. als schädlich für V. angesehen, die Anzeichen einer psychischen Störung zeigte und nach den besuchen des Antragstellers in der Unterkunft, in der V. lebte, ärztliche Hilfe benötigte. In diesem Zusammenhang kam der Europäische Gerichtshof zu dem Schluss, dass der Antragsteller nicht auf Artikel 8 des übereinkommens verweisen konnte, um gegen die Verordnung über das Verbot von Kontakten mit V. zu appellieren.

 

Zudem, so die Auffassung der Zivilgerichte, die Ihre Position auf den Gutachten der drei Experten stützten, habe V. das Kind aufgrund einer schweren Verletzung Ihrer persönlichen Rechte zur Welt gebracht, da Sie die Folgen und Risiken von Geschlechtsverkehr und Schwangerschaft nicht verstehen könne. Die Klägerin ließ Ihre Absicht nicht aus, den Zustand von V. weiter zu missbrauchen, was wahrscheinlich zu weiteren Schwangerschaften von V. und einem Risiko für Sie selbst geführt hätte. In seinem Angebot einzustellen Strafverfahren Bezirksgericht wies direkt an den Antragsteller und P. B., daß V. galt als das Gesicht, unfähig, Widerstand zu zeigen. Folglich waren die Entscheidung, ein Verbot der Kommunikation und Ihre Folgen zu erlassen, die vorhersehbaren Ergebnisse der Absicht des Antragstellers, V weiter zu besuchen.

 

Unter diesen Umständen war die Berufung des Beschwerdeführers gegen das Verbot der Kommunikation im Sinne von Artikel 8 des übereinkommens nicht Gegenstand des Begriffs "Privatleben".

 

 

 

VERORDNUNG

 

 

 

Eine Beschwerde über die Verletzung von Artikel 8 des übereinkommens wurde für inhaltlich unzulässig erklärt (als unvereinbar mit den Anforderungen des übereinkommens ratione materiae).

 

Über die Einhaltung von Artikel 6 des übereinkommens (zivilrechtlicher Aspekt). Das Verfahren hatte insgesamt eine ausreichende Beweisgrundlage, da die deutschen Gerichte die Aussagen von V. hörten und drei Gutachten untersuchten. Die Gerichte verfügten auch über andere Beweise und Gaben dem Beschwerdeführer die Möglichkeit, seine Argumente schriftlich darzulegen.

 

Die deutschen Behörden stützten Ihre Entscheidung, dem Beschwerdeführer die Kommunikation mit V. nicht auf die Tatsache, dass V. eine arbeitsunfähige Person war, sondern auf die Tatsache, dass V. eine arbeitsunfähige Person war, die Ihr die Möglichkeit entzog, (i) die Bedeutung und Folgen des Kontakts mit dem Beschwerdeführer angemessen zu verstehen, und (ii) auf die Besonderheiten der Beziehung mit dem Beschwerdeführer, einschließlich, inter alia, dass der Beschwerdeführer zuvor ein sexueller Partner der Mutter von V. war, haben die deutschen Behörden ferner den Faktor, dass jede andere Form des Kontakts mit dem Beschwerdeführer profitieren wird v.

 

Am Ende deutete nichts darauf hin, dass die deutschen Gerichte Ihre Entscheidungen unzureichend motiviert hatten oder dass Sie sich willkürlich weigerten, Beweismittel in Bezug auf den Fall zu prüfen.

 

 

 

VERORDNUNG

 

 

 

In dem Fall wurde kein Verstoß gegen die Anforderungen des Artikels 6 des übereinkommens in seinem zivilrechtlichen Aspekt zugelassen (einstimmig angenommen).

 

Über die Einhaltung von Artikel 6 des übereinkommens (zivilrechtlicher Aspekt). Fragen, die das Wesen des Verfahrens waren, führten zu einer Bewertung der Identität des Antragstellers und seiner Beziehung zu V., deren Charakter der Antragsteller bestritten hat. VERORDNUNG

 

 

 

In dem Fall wurde eine Verletzung der Anforderungen des Artikels 6 des übereinkommens in seinem zivilrechtlichen Aspekt in Bezug auf die Anhörung der Aussage des Antragstellers vor Gericht (angenommen mit vier ja-Stimmen und drei - "gegen").

 

Der Europäische Gerichtshof entschied einstimmig, dass nicht verträglich Verletzung des Absatzes 1 des Artikels 6 der Konvention, da die Weigerung der Gerichte Deutschland zu gewähren Klägerin vollen Zugang zu den Akten über die Vormundschaft nicht hatte diesen Charakter zu stören, das Wesen Fähigkeit des Antragstellers verteidigen Sie Ihre Position bezüglich der angeblichen Verbot der Kommunikation, da dieser Umstand wurde bestätigt-Engagement und genügend Beweise.
