Выход России из ЕСПЧ. Russia's exit from the ECHR.

15 марта 2022 года Россия направила уведомление о выходе из Совета Европы, а 16 марта 2022 года Россия была исключена из Совета Европы. 16 сентября 2022 года Россия окончательно выйдет из Совета Европы, а соответственно и из ЕСПЧ. Постараюсь ответить на главные вопросы.

 

1. С 01 февраля 2022 года срок для обращения в ЕСПЧ был снижен с 6 (шести) месяцев до 4 (четырех) месяцев. Соответственно с жалобами в ЕСПЧ против России граждане России, иностранные граждане и лица без гражданства могут обращаться до 15 июля 2022 года включительно. Т.е. если окончательное решение высшего национального суда (в России - это Верховный Суд РФ) будет вынесено 15 января 2023 года, то обращаться в ЕСПЧ с жалобой против России можно.

 

2. В определенных случаях можно обращаться с жалобой против России и после 15 июля 2022 года при условии, что нарушение прав заявителя было в период членства России в Совете Европы. Здесь необходимо изучение ситуации и документов.

 

3. С 16 января 2023 года жалобы в ЕСПЧ нельзя подавать на русском языке, т.к. русский язык в связи с выходом России из Совета Европы перестал считаться официальным, и жалоба может быть отклонена как несоответствующая критериям подачи жалобы. Здесь в арсенале остаются английский и французский языки, являющиеся рабочими языками, а также множество оставшихся официальных языков.

 

4. Все жалобы, которые поданы против России, в той или иной мере будут рассмотрены.

 

5. Вместо ЕСПЧ возможно обращение в специализированные комитеты ООН. В них русский язык является рабочим языком вместе с английским, французским, испанским, китайским и арабским языками. Т.е. обращаться в специализированные комитеты ООН можно на русском языке. Я готов помочь в подготовке сообщений (жалоб) в специализированные комитеты ООН.

 

6. Граждане России, равно как и иностранные граждане и лица без гражданства, вправе подавать жалобы в ЕСПЧ против государств, являющихся членами Совета Европы. Жалоба, поданная на русском языке после 15 января 2023 года, будет считаться не соответствующей критериями подачи жалобы и соответственно будет отклонена.

2. In certain cases, it is possible to file a complaint against Russia after July 15, 2022, provided that the violation of the applicant's rights was during the period of Russia's membership in the Council of Europe. Here it is necessary to study the situation and documents.

Since January 16, 2023, complaints to the ECHR cannot be filed in Russian, because Russian has ceased to be considered official due to Russia's withdrawal from the Council of Europe, and the complaint may be rejected as non-compliant with the criteria for filing a complaint. Here, English and French, which are the working languages, remain in the arsenal, as well as many remaining official languages.

 

4. All complaints filed against Russia will be considered in one way or another.

 

5. Instead of the ECHR, it is possible to appeal to specialized UN committees. Russian Russian is the working language in them, along with English, French, Spanish, Chinese and Arabic. That is, you can contact the specialized UN committees in Russian. I am ready to help in the preparation of reports (complaints) to specialized UN committees.

 

6. Russian citizens, as well as foreign citizens and stateless persons, have the right to file complaints with the ECHR against states that are members of the Council of Europe. A complaint filed in Russian after January 15, 2023, will be deemed not to meet the criteria for filing a complaint and will be rejected accordingly.
