Постановление ЕСПЧ от 16 октября 2018 по делу "Шкицкий и Водорацкая (Shkitskiy and Vodoratskaya) против Российской Федерации" (жалобы N 27863/12 и 66513/12).

По делу успешно рассмотрены жалобы заявителей на то, что они были лишены статуса адвокатов предположительно за выраженное ими мнение в отношении судей. По делу допущено нарушение требований статьи 10 Конвенции о защите прав человека и основных свобод.

В 2012 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

В своих жалобах Заявители жаловались на то, что они были лишены статуса адвокатов предположительно за выраженное ими мнение в отношении судей.

16 октября 2018 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 10 Конвенции (право на свободу выражения мнения), и обязал государство-ответчика выплатить заявительнице 7 500 евро в качестве компенсации. Поскольку заявитель не представил требований о выплате компенсации, Европейский Суд не присудил ему каких-либо сумм по данному основанию.

ECHR ruling dated October 16, 2018 in the case of Shkitsky and Vodoratskaya (Shkitskiy and Vodoratskaya) v. Russia (applications No. 27863/12 and 66513/12).

The case successfully examined the applications of the applicants that they were deprived of the status of lawyers, allegedly for their expressed opinion of the judges. The case has violated the requirements of Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2012, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.

In their applications, the applicants complained that they had been deprived of the status of lawyers, allegedly for their expressed opinion of the judges.

On 16 October 2018, on applications filed by the applicants, the European Court unanimously decided that in this case the authorities violated the requirements of Article 10 of the Convention (the right to freedom of expression), and ordered the respondent state to pay the applicant 7,500 euros in compensation. As the applicant did not submit any claims for compensation, the Court did not award him any amounts for this reason.

Постановление ЕСПЧ от 16 октября 2018 года по делу "Махлоев (Makhloyev) против Российской Федерации" (жалоба N 16397/07).

 

По делу успешно рассмотрена жалоба заявителя на то, что его сын был похищен предположительно представителями правоохранительных органов и что какого-либо эффективного расследования этого обстоятельства проведено так и не было. По делу допущено нарушение требований статьи 2 и пункта 1 статьи 5 Конвенции о защите прав человека и основных свобод.

 

В 2007 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

В своей жалобе Заявитель жаловался на то, что в октябре 2009 года в Республике Ингушетия его сын был похищен предположительно представителями правоохранительных органов. Заявитель также утверждал, что не было проведено какого-либо эффективного расследования этого обстоятельства.

 

16 октября 2018 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 2 (право на жизнь) в ее материальном и процессуальном аспекте и 3 Конвенции (запрещение пыток), а также пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), и обязал государство-ответчика выплатить заявителю 60 000 евро в качестве компенсации морального вреда.

The case has violated the requirements of Article 2 and Clause 1 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In 2007, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

 

In his application, the applicant complained that in October 2009 in the Republic of Ingushetia his son was allegedly abducted by law enforcement officials. The applicant also submitted that no effective investigation had been carried out into this circumstance.

 

On 16 October 2018, on the application submitted by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirements of articles 2 (right to life) in its substantive and procedural aspect and 3 of the Convention (prohibition of torture), as well as article 1 5 of the Convention (the right to liberty and security of person), and ordered the respondent state to pay the applicant 60,000 euros in respect of non-pecuniary damage.

Постановление ЕСПЧ от 16 октября 2018 года по делу "Фокс (Foks) против Российской Федерации" (жалоба N 5582/12).

 

По делу успешно рассмотрена жалоба заявителя на лишение его права собственности на квартиру вследствие того, что продавшее ему квартиру лицо не имело прав на нее, а также установление данного факта после того, как право собственности заявителя на квартиру было зарегистрировано органами власти. По делу допущено нарушение требований статьи 1 Протокола N 1 к Конвенции о защите прав человека и основных свобод.

 

В 2012 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

В своей жалобе Заявитель, гражданин Израиля, являвшийся добросовестным приобретателем квартиры, жаловался на то, что он был лишен своей собственности вследствие того, что продавшее ему квартиру лицо не имело прав на нее. Указанный факт был установлен лишь после того, как право собственности заявителя на квартиру было зарегистрировано органами власти города Москвы.

 

16 октября 2018 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 1 Протокола N 1 к Конвенции (защита собственности), и обязал государство-ответчика выплатить заявителю 144 997 евро в качестве компенсации материального ущерба и 5 000 евро в качестве компенсации морального вреда.

The case was successfully considered the applicant's application about the deprivation of his ownership of the apartment due to the fact that the person who sold him the apartment had no rights to it, as well as the establishment of this fact after the applicant's ownership of the apartment was registered by the authorities. The case has violated the requirements of Article 1 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In 2012, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

 

In his application, the Complainant, an Israeli citizen who was a bona fide purchaser of an apartment, complained that he was deprived of his property due to the fact that the person who sold him the apartment did not have rights to it. This fact was established only after the applicant's title to the apartment was registered by the Moscow authorities.

 

On 16 October 2018, on a application filed by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirements of Article 1 of Protocol No. 1 to the Convention (protection of property), and ordered the respondent state to pay the applicant EUR 144,997 in compensation for material damage and 5,000 euros in respect of non-pecuniary damage.

По делу успешно рассмотрены жалобы заявителей на то, что они были лишены своего имущества, поскольку их здания были отнесены к категории самовольных построек (из-за нахождения вблизи газо- и нефтепроводов) и им было предписано снести их. По делу допущено нарушение требований статьи 1 Протокола N 1 к Конвенции о защите прав человека и основных свобод.

 

В 2010 и 2014 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

В своих жалобах Заявители жаловались на то, что они были лишены своего имущества, поскольку их здания были отнесены к категории самовольных построек (из-за нахождения вблизи газо- и нефтепроводов) и им было предписано снести их.

 

Европейский Суд единогласно постановил, что лишь на некоторых заявителей нельзя возлагать ответственность за отнесение их построек к категории самовольных из-за небрежных действий государственных органов, и установил нарушение прав таких заявителей в соответствии со статьей 1 Протокола N 1 к Конвенции (защита собственности).

 

16 октября 2018 года, по жалобам поданным заявителями, Европейский Суд решил отложить рассмотрение вопроса о справедливой компенсации и предложил властям Российской Федерации уведомить его о любом соглашении, которое они и заявители могут достичь в течение шести месяцев с даты вступления настоящего Постановления в силу.

The case successfully reviewed the applications of the applicants that they had been deprived of their property, since their buildings were classified as unauthorized buildings (due to being close to the gas and oil pipelines) and were ordered to demolish them. The case has violated the requirements of Article 1 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In 2010 and 2014, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.

 

In their applications the applicants complained that they had been deprived of their property because their buildings were categorized as unauthorized buildings (due to being close to gas and oil pipelines) and were ordered to demolish them.

 

The European Court unanimously ruled that only some applicants could not be held responsible for classifying their buildings as unauthorized due to negligent actions of state bodies, and found a violation of the rights of such applicants in accordance with Article 1 of Protocol No. 1 to the Convention (property protection).

 

On October 16, 2018, on applications filed by the applicants, the European Court decided to postpone consideration of the question of just compensation and invited the Russian authorities to notify him of any agreement that they and the applicants could reach within six months from the date of entry into force of this Decree.

Постановление ЕСПЧ от 16 октября 2018 года по делу "Шатохин (Shatokhin) против Российской Федерации (обращение о пересмотре) (жалоба N 50236/06).

 

По делу подано и успешно рассмотрено обращение о пересмотре в связи со смертью заявителя постановления Европейского Суда по правам человека, которым в отношении заявителя установлено нарушение статьи 3 Конвенции о защите прав человека и основных свобод. Обращение удовлетворено, присужденную заявителю сумму постановлено выплатить наследнику заявителя.

 

В 2006 году заявителю, умершему в 2012 году, была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

В Постановлении по делу "Шатохин против Российской Федерации" (Shatokhin v. Russia) от 27 февраля 2018 г., жалоба N 50236/06, Европейский Суд установил, что имело место нарушение статьи 3 Конвенции (запрещение пыток) из-за помещения заявителя в одиночную камеру, несмотря на рекомендацию его психиатра о неприменении к нему такой меры, и обязал государство-ответчика выплатить заявителю 15 000 евро. Однако 30 марта 2018 г. представитель заявителя сообщил Европейскому Суду, что заявитель умер 21 октября 2012 г., поэтому он просил пересмотреть данное Постановление по смыслу правила 80 Регламента Суда (ходатайство о пересмотре постановления).

 

16 октября 2018 года, по обращению представителя заявителя, Европейский Суд единогласно постановил, что сумму в размере 15 000 евро, присужденную ранее заявителю, следует выплатить его матери как наследнице.

Resolution of the ECHR of October 16, 2018 in the case of Shatokhin (Shatokhin) v. Russian Federation (appeal for revision) (application No. 50236/06).

 

The case filed and successfully reviewed an appeal for review in connection with the death of the applicant of the decision of the European Court of Human Rights, which against the applicant found a violation of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The appeal is satisfied, the amount awarded to the applicant is decided to pay to the applicant's heir.

 

In 2006, the applicant, who died in 2012, was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

 

In the Shatokhin v. Russia case decision of 27 February 2018, complaint no. 50236/06, the European Court found that there was a violation of Article 3 of the Convention (prohibition of torture) because of the solitary confinement camera, despite the recommendation of his psychiatrist about not applying such a measure, and ordered the respondent state to pay the applicant 15,000 euros. However, on 30 March 2018 a representative of the applicant informed the European Court that the applicant died on 21 October 2012, therefore he requested a review of this Order within the meaning of Rule 80 of the Rules of Court (request for review of the judgment).

 

On 16 October 2018, at the request of the representative of the applicant, the European Court unanimously decided that the amount of 15,000 euros awarded earlier to the applicant should be paid to his mother as heiress.
