Постановление ЕСПЧ от 09 ноября 2018 года по делу "Без (Beuze) против Бельгии" (жалоба N 71409/10).

В 2010 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Бельгии.

По делу успешно рассмотрена жалоба заявителя на то, что в ходе содержания под стражей и следствия он допрашивался в отсутствие адвоката, а также на то, что суд присяжных отклонил требование заявителя о признании недопустимыми показаний, полученных в ходе допросов, проведенных полицией и следственным судьей. По делу допущено нарушение требований статьи 6 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

17 декабря 2007 г. заявитель был задержан жандармами во Франции и заключен под стражу на основании европейского ордера на арест. 31 декабря 2007 г. он был передан властям Бельгии, где в ходе содержания под стражей и следствия допрашивался в отсутствие адвоката.

Суд присяжных отклонил требование заявителя о признании недопустимыми показаний, полученных в ходе допросов, проведенных полицией и следственным судьей. По окончании прений заявитель был признан присяжными виновным, в частности, в умышленном убийстве и приговорен к пожизненному лишению свободы.

Впоследствии Кассационный суд отклонил довод об отсутствии помощи адвоката на предварительной стадии производства. Кассационный суд счел, что, принимая во внимание производство по делу в целом, следует считать, что право заявителя на справедливое судебное разбирательство было соблюдено.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения пункта 1 и подпункта "c" пункта 3 статьи 6 Конвенции. (a) Наличие и масштаб ограничений. Заявитель был передан властям Бельгии 31 декабря 2007 г., в 10.40. Однако право на помощь адвоката было признано за ним лишь после того, как по окончании допроса в 17.42 следственный судья вынес постановление о его заключении под стражу и уведомил об этом палату адвокатов с целью назначения заявителю адвоката. Вместе с тем из материалов дела неясно, с какого момента заявитель фактически получил доступ к адвокату с целью подготовки своей защиты.

Даже если заявитель мог свободно общаться с адвокатом, назначенным ему в дальнейшем, он не мог пользоваться его помощью во время допросов и других следственных действий, проводившихся на стадии предварительного расследования по делу. Помимо того, что данное ограничение было основано на толковании соответствующих положений закона, действовавших на тот момент, оно применялось в течение всего периода предварительного расследования, а именно при 10 допросах. Адвокат заявителя также не участвовал при проверке показаний на месте 6 июня 2008 г.

(b) Наличие настоятельной необходимости. Спорные ограничения были вызваны пробелом в законодательстве Бельгии и толкованием последнего судами государства-ответчика. Однако ограничения на доступ к адвокату в случае настоятельной необходимости разрешаются на предварительной стадии производства лишь в исключительных случаях. Они должны иметь временный характер и основываться на индивидуальной оценке конкретных обстоятельств дела. Такая индивидуальная оценка, очевидно, не была проведена в настоящем деле. Кроме того, власти государства-ответчика не установили наличие исключительных обстоятельств. Следовательно, ограничения права заявителя на доступ к адвокату не были оправданы какой-либо настоятельной необходимостью.

Заявитель ссылался на определенное толкование прецедентной практики Европейского Суда, касающейся права на доступ к адвокату. Согласно данному толкованию, если ограничение права на доступ к адвокату вытекает из закона и носит систематический характер, при отсутствии настоятельной необходимости этого достаточно, чтобы прийти к выводу о нарушении требований статьи 6 Конвенции. Однако, как следует из Постановления Большой Палаты Европейского Суда по делу "Ибрагим и другие против Соединенного Королевства" ((Ibrahim and Others v. United Kingdom) от 13 сентября 2016 г., жалоба N 50541/08 и три других жалобы), после которого было принято Постановление Большой Палаты Европейского Суда по делу "Симеоновы против Болгарии" (Simeonovi v. Bulgaria) от 12 мая 2017 г., жалоба N 21980/04, Европейский Суд отклонил довод заявителей о том, что в Постановлении Большой Палаты Европейского Суда по делу "Салдуз против Турции" (Salduz v. Turkey) от 27 ноября 2008 г., жалоба N 36391/02) содержится абсолютное правило такого характера. Европейский Суд, таким образом, отошел от принципа, закрепленного в Постановлении по делу "Данаян против Турции" (Dayanan v. Turkey) от 13 октября 2009 г., жалоба N 7377/03, а также в других постановлениях, вынесенных против Турции.

(c) Соблюдение общей справедливости процесса. Европейский Суд должен оценить справедливость процесса, применяя очень строгий подход, тем более в случаях, когда ограничения права на доступ к адвокату основаны на положениях законодательства, имеющих общий и обязательный характер. Таким образом, бремя доказывания лежит на властях государства-ответчика, которые должны предоставить убедительные доказательства того, что производство по уголовному делу заявителя было в целом справедливым. Однако неспособность властей государства-ответчика представить доказательства настоятельной необходимости имеет большой вес на чаше весов и может заставить Европейский Суд склониться к выводу о нарушении подпункта "c" пункта 3 и пункта 1 статьи 6 Конвенции.

Ниже будут проанализированы различные факторы, рассмотренные в упомянутых выше Постановлениях Большой Палаты Европейского Суда по делам "Ибрагим и другие против Соединенного Королевства" и "Симеоновы против Болгарии".

(i) Уязвимость заявителя. Заявитель не находился в состоянии особой уязвимости, превышающем состояние, в котором обычно находятся лица, допрашиваемые следователем. Допросы и другие следственные действия, проведенные во время содержания заявителя под стражей, не были ни необычными, ни чрезмерно продолжительными.

(ii) Обстоятельства получения доказательств. Следователи в Бельгии и французские жандармы не оказывали на заявителя какого-либо давления.

(iii) Положения законодательства о производстве по делу до вынесения приговора и допустимость доказательств, а также возможность оспорить собранные доказательства и их исследование. По окончании содержания под стражей общие гарантии, предусмотренные соответствующими положениями законодательства, позволили заявителю общаться с адвокатом в течение всего времени, кроме проведения допросов. Однако законодательство Бельгии, которое было применено в производстве по уголовному делу заявителя, не соответствовало требованиям пункта 3 статьи 6 Конвенции. Поэтому отдельные положения законодательства, предусматривающие in abstracto определенные гарантии, не могли сами по себе обеспечить общую справедливость процесса. Европейскому Суду необходимо было проверить, имело ли применение этих положений законодательства в настоящем деле компенсаторный характер, в силу которого весь процесс был справедливым. В рамках данной проверки было отмечено, что поведение заявителя во время допросов могло иметь такие последствия для его дальнейшей защиты, что заявитель не мог быть уверен, что помощь, оказанная ему впоследствии адвокатом, или состязательность последующих стадий процесса будут достаточными для того, чтобы исправить недостатки, допущенные в период его содержания под стражей. Кроме того, из материалов дела было неясно, с какого момента заявителю была предоставлена юридическая помощь. Очевидно, что защитник заявителя несколько раз менялся, но в материалах дела отсутствуют сведения ни о частоте консультаций, ни о том, что адвокат предупреждался о датах допросов. Соответственно, у заявителя не было возможности заранее подготовить свою защиту вместе с адвокатом, и ему приходилось довольствоваться тем, что он сообщал адвокату о том, как проходили его допросы, возможно, используя протокол, и заявитель делал из этого выводы на будущее.

Таким образом, гарантия того, что расследование находилось под контролем палаты обвинений, в которую заявитель мог в любой момент обратиться с тем, чтобы с помощью адвоката оспорить законность следственных действий, не сыграла важной роли в настоящем деле.

Допустимость показаний заявителя в качестве доказательств была предметом спора в суде присяжных. Заявитель при помощи своего защитника подал замечания, в которых он требовал признания недопустимыми протоколов допросов, проведенных в отсутствие адвоката, и прекращения уголовного преследования. Ссылаясь на упоминавшееся выше Постановление Большой Палаты Европейского Суда по делу "Салдуз против Турции", заявитель утверждал, что систематическое лишение права на доступ к адвокату начиная с первого допроса было достаточным для того, чтобы констатировать нарушение статьи 6 Конвенции. В приговоре, вынесенном в тот же день, суд присяжных отклонил доводы заявителя и признал все протоколы допустимыми доказательствами на основании того, что, по мнению суда, заявитель еще мог воспользоваться своим правом на справедливое судебное разбирательство, несмотря на отсутствие адвоката во время предварительных допросов.

Суд присяжных не рассмотрел более детально ни протоколы, ни обстоятельства, при которых проводились спорные допросы, ни полученные показания. Следовательно, отсутствовали какие-либо доказательства того, что суд проанализировал последствия отсутствия адвоката для ключевых моментов производства, хотя такой анализ был, тем не менее, необходим. Данное упущение имеет тем более важное значение, что в силу устного характера прений в суде присяжных и отсутствия подробных протоколов судебных заседаний невозможно оценить, какое влияние оказали судебные прения на мнение присяжных.

Кассационный суд мог оценить влияние допросов, проведенных в отсутствие адвоката, на справедливость производства по делу и принять меры в отношении судей, рассмотревших дело по существу и признавших допустимыми показания, данные заявителем против себя в отсутствие адвоката. Однако Кассационный суд впервые вынес соответствующее постановление уже после того, как был вынесен приговор по настоящему делу. При рассмотрении хода производства по делу заявителя Кассационный суд сконцентрировался на отсутствии признательных показаний, данных в период содержания под стражей, а в отношении остального периода предварительного расследования, когда права заявителя также ограничивались, указал только, что заявителя никогда не принуждали свидетельствовать против себя и что он всегда давал показания добровольно.

(iv) Характер показаний. По мнению суда присяжных и Кассационного суда, показания, данные заявителем во время спорных допросов, не были признательными и не представляли собой явку с повинной. Очевидно, что заявитель никогда не признавался в преступлениях, в которых его обвиняли и, соответственно, строго говоря, не свидетельствовал против себя. Тем не менее он давал подробные показания следователям, которые направляли ход проведения слушаний и допросов. К этому добавился тот факт, что заявитель в ходе всего предварительного расследования несколько раз менял версию событий, подрывая, таким образом, доверие к своим словам, в результате чего первый допрос приобретал ключевое значение.

В начале первого и каждого последующего допроса полицией заявитель извещался о том, что его показания могли быть использованы в качестве доказательств, в праве Бельгии подобным косвенным образом закреплено право хранить молчание. Однако при обстоятельствах настоящего дела информация, представленная следователями, не была достаточно ясной, чтобы обеспечить эффективность права заявителя хранить молчание и не свидетельствовать против себя. Заявитель делал важные заявления и широко использовал свою возможность выбирать или скрывать факты.

(v) Использование полученных показаний, а в случае, когда виновность определяется присяжными, содержание инструкций и разъяснений, данных присяжным. Производство по делу осуществлял суд присяжных, непостоянный судебный орган, состоявший из профессиональных судей и коллегии присяжных.

Обвинительный акт был зачитан в начале процесса, до прений сторон. В нем были указаны сведения, которые заявитель признал, а также различные версии изложения заявителем фактов. Таким образом, обвинение основывалось также на различных доказательствах, не связанных с показаниями заявителя и не зависящих от них. Тем не менее в показаниях, полученных в самом начале содержания заявителя под стражей, подробно описывались события, произошедшие в день убийства, а в последующих показаниях, более обстоятельных, излагались дополнительные и противоречивые сведения. Кроме того, заявитель не отрицал, что он присутствовал на месте преступления и угрожал свидетелю. Он также сам предоставил следствию информацию, которая могла быть использована против него. Эти показания, без сомнения, предоставили следователям основу для составления обвинительного акта, даже если следователи уже располагали определенной информацией до первого допроса заявителя.

Обвинительный акт имеет ограниченное значение для понимания вердикта присяжных, поскольку он зачитывается до прений, которые призваны позволить присяжным сформировать собственное внутреннее убеждение по делу. При этом присяжные признали доказанным умысел заявителя на совершение одной из двух попыток убийства, той, которая была доказана с помощью показаний заявителя, помимо прочих доказательств. Европейский Суд придает важное значение указанному факту, который позволяет считать показания заявителя, данные им в отсутствие адвоката, неотъемлемой частью доказательств, послуживших основанием для вынесения приговора заявителю в части, касавшейся обвинения в убийстве.

Кроме того, председательствующий судья не дал присяжным каких-либо указаний относительно того, какое значение следует придавать многочисленным показаниям заявителя в ходе их совещания. Несмотря на усилия, предпринятые Кассационным судом для того, чтобы оценить в рамках настоящего дела справедливость процесса в целом в свете прецедентной практики Европейского Суда, Кассационный суд, по-видимому, не принял во внимание значение для вердикта присяжных того обстоятельства, что коллегии присяжных не были предоставлены сведения, которые могли направить оценку ими значения показаний заявителя, данных в отсутствие адвоката.

В настоящем деле полное отсутствие инструкций и разъяснений присяжным в отношении того, как им следует оценивать показания заявителя по сравнению с другими материалами дела, и относительно их доказательственной силы, несмотря на то, что эти показания были получены в отсутствие адвоката и в том, что касается содержания под стражей, без предоставления заявителю достаточно ясной информации о его праве хранить молчание, является серьезным недостатком.

(vi) Важность общественных интересов. Уголовное преследование заявителя было оправдано важными соображениями общественного интереса, поскольку заявитель обвинялся в убийстве и двух покушениях на убийство.

(vii) Наличие в соответствующем законодательстве Бельгии и правоприменительной практике других процессуальных гарантий. Во время событий настоящего дела Кассационный суд Бельгии принял во внимание ряд процессуальных гарантий, предусмотренных законодательством Бельгии, чтобы оценить соответствие Конвенции законных ограничений права на адвоката в период содержания под стражей.

(viii) Заключение относительно справедливости процесса в целом. Уголовный процесс в отношении заявителя, если рассматривать его в целом, не позволил исправить процессуальные недостатки, допущенные на предварительной стадии производства по делу, среди которых наиболее важными были следующие:

- ограничения права заявителя на доступ к адвокату были особого масштаба. Он был допрошен во время содержания под стражей без предварительной консультации с адвокатом и в его отсутствие, а затем в ходе предварительного расследования в отсутствие адвоката, который также не участвовал в других следственных действиях;

- при данных обстоятельствах и при отсутствии достаточно ясной предварительной информации о праве хранить молчание заявитель во время своего содержания под стражей дал обстоятельные показания, затем он представил различные версии фактов и дал показания, которые, если и не были признательными в узком смысле этого слова, тем не менее, существенно повлияли на его положение, особенно в отношении обвинения в покушении на убийство, указанного в пункте (v);

- совокупность данных показаний была признана судом присяжных допустимой в качестве доказательств, хотя суд не провел соответствующей проверки ни обстоятельств, при которых данные показания были получены, ни последствий отсутствия адвоката;

- если Кассационный суд и рассмотрел вопрос о прекращении уголовного преследования и, кроме того, стремился проверить, было ли соблюдено право заявителя на справедливое судебное разбирательство, он сконцентрировался на отсутствии адвоката во время содержания заявителя под стражей, не оценив последствия для права заявителя на защиту отсутствия его адвоката во время допросов и иных следственных действий, проводившихся в ходе предварительного расследования;

- показания заявителя занимали важное место в обвинительном акте и, что касается обвинения в покушении на убийство, упомянутого выше, являлись неотъемлемой частью доказательств, на которых был основан приговор, вынесенный заявителю;

- в ходе судебного следствия присяжные не получили от председательствующего судьи каких-либо инструкций или разъяснений относительно того, как следовало оценивать показания заявителя и их доказательственную силу.

В настоящем деле совокупность различных факторов, а не каждый из них в отдельности привели к тому, что процесс в отношении заявителя в целом не был справедливым.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 6 Конвенции (принято единогласно).

В порядке применения статьи 41 Конвенции. Европейский Суд постановил что установление факта нарушения Конвенции само по себе будет являться достаточной справедливой компенсацией морального вреда.

Arrêt de la Cour européenne des droits de l'homme du 9 novembre 2018 dans l'affaire Bezéz (c. Belgique) (requête no 71409/10).
En 2010, le plaignant a été assisté dans la préparation d'une requête. La requête a ensuite été transmise à la Belgique.
Le requête a examiné avec succès l’affaire. Au cours de sa détention et de l’enquête, il a été interrogé en l’absence d’un avocat et le jury a rejeté l’argument du plaignant selon lequel les témoignages recueillis lors des interrogatoires menés par la police et le juge d’instruction étaient irrecevables. L'affaire a violé les exigences de l'article 6 de la Convention de sauvegarde des droits de l'homme et des libertés fondamentales.


LES CIRCONSTANCES DE L'AFFAIRE


Le 17 décembre 2007, le requérant a été arrêté par des gendarmes en France sur la base d'un mandat d'arrêt européen. Le 31 décembre 2007, il a été remis aux autorités belges, où il a été interrogé pendant sa détention et son enquête en l'absence d'un avocat.

Le jury a rejeté l’affirmation du demandeur selon laquelle les témoignages recueillis lors des interrogatoires menés par la police et le juge d’instruction étaient irrecevables. À l'issue du débat, le jury a déclaré le requérant coupable, notamment pour meurtre avec préméditation, et l'a condamné à une peine de réclusion à perpétuité.

Par la suite, la Cour de cassation rejeta l'argument selon lequel un avocat n'aurait pas été assisté au stade préliminaire de la procédure. La Cour de cassation a estimé que, compte tenu de l'ensemble de la procédure, il convenait de considérer que le droit du requérant à un procès équitable était respecté.


QUESTIONS DE DROIT


Concernant le respect du paragraphe 1 et de l’alinéa "c" du paragraphe 3 de l’article 6 de la Convention. a) Disponibilité et portée des restrictions. Le requérant a été remis aux autorités belges le 31 décembre 2007 à 10 h 40. Toutefois, son droit à l’assistance d’un avocat ne lui a été reconnu qu’après la fin de l’interrogatoire qui a eu lieu à 17 h 42, le juge d’instruction a ordonné sa mise en détention et a informé le bureau des avocats en vue de nommer le requérant à un avocat. En même temps, il ne ressort pas des documents de l'affaire à partir de quel moment le requérant a effectivement eu accès à un avocat pour préparer sa défense.

Même si le requérant pouvait librement communiquer ultérieurement avec l'avocat qui lui avait été désigné, il ne pouvait faire appel à son aide pendant les interrogatoires et les autres enquêtes effectuées au stade de l'enquête préliminaire. Outre le fait que cette restriction reposait sur l'interprétation des dispositions pertinentes de la loi en vigueur à l'époque, elle a été appliquée pendant toute la période de l'enquête préliminaire, à savoir au cours de 10 interrogatoires. L'avocat de la requérante n'a pas non plus participé à la vérification sur place des tests le 6 juin 2008.

(b) Il y a un besoin urgent. Les restrictions controversées ont été causées par une lacune dans la législation belge et par l'interprétation de celle-ci par les tribunaux de l'Etat défendeur. Toutefois, des restrictions à l'accès à un avocat en cas de besoin urgent ne sont autorisées au stade préliminaire de la procédure que dans des cas exceptionnels. Ils devraient être temporaires et fondés sur une évaluation individuelle des circonstances particulières de l'affaire. Une telle évaluation individuelle n'a évidemment pas été réalisée en l'espèce. De plus, les autorités de l'Etat défendeur n'ont pas établi l'existence de circonstances exceptionnelles. Par conséquent, les restrictions imposées au droit du requérant de consulter un avocat n'étaient justifiées par aucun besoin urgent.

Le requérant s'est référé à une certaine interprétation de la jurisprudence de la Cour européenne concernant le droit d'accès à un avocat. Selon cette interprétation, si la restriction du droit d'accès à un avocat découle de la loi et est systématique, en l'absence d'un besoin urgent, il suffit de conclure que les exigences de l'article 6 de la Convention sont violées. Toutefois, comme il ressort de l'arrêt de la Grande Chambre de la Cour européenne de justice dans l'affaire Ibrahim et autres c. Royaume-Uni ((Ibrahim et autres c. Royaume-Uni) du 13 septembre 2016, plainte n ° 50541/08 et trois autres plaintes), à la suite de quoi Il a été adopté par la Grande Chambre de la Cour européenne de justice dans l’affaire Simeonovi c. Bulgarie (Simeonovi c. Bulgarie) du 12 mai 2017, plainte n Salduz c. Turquie (Salduz c. Turquie) du 27 novembre 2008, plainte n ° 36391/02) contient une olyutnoe règle de cette nature. La Cour européenne s’est donc écartée du principe consacré dans l’affaire Danayan c. Turquie (Dayanan c. Turquie) du 13 octobre 2009, plainte n ° 7377/03, ainsi que dans d’autres décisions rendues contre la Turquie.

(c) Respect de l'équité globale du processus. La Cour européenne doit évaluer l'équité du processus, en appliquant une approche très stricte, en particulier dans les cas où les restrictions au droit d'accès à un avocat sont fondées sur des dispositions juridiques de nature générale et impérative. La charge de la preuve incombe donc aux autorités de l’État défendeur, qui doivent fournir des preuves convaincantes de l’équité de la procédure dans l’affaire pénale du requérant. Toutefois, l'incapacité des autorités de l'État défendeur à fournir la preuve d'un besoin urgent pèse lourdement sur la balance et peut amener la Cour à conclure à la violation des paragraphes 3 c) et 1 de l'article 6 de la Convention.

Nous analyserons ci-dessous les différents facteurs examinés dans les arrêts susmentionnés de la Grande Chambre de la Cour de justice des Communautés européennes pour Ibrahim et autres c. Royaume-Uni et Simeonovs c. Bulgarie.

(i) Vulnérabilité du demandeur. Le requérant n'était pas dans un état de vulnérabilité particulière, supérieur à l'état dans lequel se trouvent généralement les personnes interrogées par l'enquêteur. Les interrogatoires et autres démarches d’enquête effectués pendant la détention du requérant n’ont été ni inhabituels ni excessivement longs.

ii) Circonstances dans lesquelles des éléments de preuve sont obtenus. Les enquêteurs en Belgique et les gendarmes français n’ont exercé aucune pression sur le requérant.

iii) Dispositions relatives à la législation antérieure à la détermination de la peine et à l'admissibilité des preuves, ainsi que la possibilité de contester les preuves recueillies et leur enquête. À la fin de la période de détention, les garanties générales prévues par les dispositions pertinentes de la loi permettaient au requérant de communiquer avec un avocat pendant tout le temps, à l'exception des interrogatoires. Cependant, la législation belge appliquée dans les poursuites pénales à l'encontre du requérant n'était pas conforme aux exigences du paragraphe 3 de l'article 6 de la Convention. Par conséquent, certaines dispositions de la loi, qui prévoient certaines garanties in abstracto, ne pourraient à elles seules assurer l’équité globale du processus. La Cour devait vérifier si l'application de ces dispositions légales en l'espèce avait un caractère compensatoire, en vertu duquel l'ensemble du processus était équitable. Dans le cadre de cet examen, il a été noté que le comportement du requérant pendant les interrogatoires pouvait avoir des conséquences telles sur sa défense que celui-ci ne pouvait pas être sûr que l'assistance fournie ultérieurement par un avocat ou par l'adversaire des étapes ultérieures du processus suffirait à corriger les irrégularités admis pendant sa détention. En outre, il n’était pas clair, à partir des documents de l’affaire, à partir du moment où le requérant avait bénéficié d’une assistance juridique. Il est évident que l'avocat de la requérante a changé plusieurs fois, mais le dossier ne contient aucune information sur la fréquence des consultations ni sur le fait que l'avocat a été averti des dates des interrogatoires. En conséquence, le requérant n'a pas eu la possibilité de préparer sa défense avec l'avocat à l'avance et il devait se contenter de l'information qu'il avait fournie à l'avocat sur la manière dont ses interrogatoires avaient eu lieu, en utilisant éventuellement le protocole, et le requérant tirait des conclusions pour l'avenir.

Ainsi, la garantie que l'enquête était placée sous le contrôle de la chambre des charges, à laquelle le requérant pouvait à tout moment faire appel, de sorte que, avec l'aide d'un avocat, pour contester la légalité des actes d'instruction, ne jouait pas un rôle important en l'espèce.

L'admissibilité du témoignage du requérant en tant que preuve a fait l'objet d'un différend lors d'un procès avec jury. Le requérant, avec l'aide de son avocat, a déposé des conclusions dans lesquelles il demandait que les procès-verbaux des interrogatoires menés en l'absence d'un avocat et que les poursuites pénales soient déclarés irrecevables. Se référant à la résolution susmentionnée de la Grande Chambre de la Cour européenne dans l'affaire Salduz c. Turquie, le requérant soutient que le fait de nier systématiquement le droit de consulter un avocat dès le premier interrogatoire suffit pour constater une violation de l'article 6 de la Convention. Le même jour, le jury rejeta les arguments du requérant et reconnut tous les protocoles comme des preuves recevables au motif que, selon le tribunal, le requérant pourrait toujours exercer son droit à un procès équitable malgré l'absence d'un avocat lors des interrogatoires préliminaires.

Le jury n'a pas examiné plus en détail ni les protocoles, ni les circonstances dans lesquelles ont eu lieu les interrogatoires controversés, ni les témoignages obtenus. En conséquence, rien n'indique que le tribunal ait analysé les conséquences de l'absence d'un avocat sur les points essentiels de la procédure, bien qu'une telle analyse soit néanmoins nécessaire. Cette omission est d’autant plus importante que, du fait de la nature orale du débat au jury et de l’absence de procès-verbaux détaillés, il est impossible d’évaluer l’impact du débat sur l’opinion du jury.

La cour de cassation pourrait évaluer l’impact des interrogatoires menés en l’absence d’avocat sur l’équité de la procédure et prendre des mesures à l’encontre des juges qui ont examiné l’affaire au fond et admis les preuves fournies par le requérant contre lui-même en l’absence d’avocat. Cependant, la Cour de cassation a rendu pour la première fois une décision pertinente après le prononcé de la sentence dans la présente affaire. Dans son examen des progrès de l’affaire du requérant, la Cour de cassation se concentra sur l’absence d’aveux lors de sa détention. En ce qui concerne le reste de l’instruction, les droits du requérant étaient également limités, mais il indiqua seulement que le requérant n’était jamais contraint de témoigner contre lui-même et toujours témoigné volontairement.

iv) La nature de la preuve. De l'avis du jury et de la Cour de cassation, le témoignage de la requérante lors des interrogatoires controversés ne lui était pas reconnaissant et ne constituait pas une remise. Il est évident que le requérant n'a jamais avoué les crimes dont il était accusé et qu'en conséquence, à proprement parler, il n'a pas témoigné contre lui-même. Il a néanmoins témoigné de manière détaillée aux enquêteurs, qui ont dirigé le déroulement des audiences et des interrogatoires. À cela s’ajoute le fait que le requérant a changé plusieurs fois la version des événements au cours de l’enquête préliminaire, sapant ainsi la crédibilité de ses propos, de sorte que le premier interrogatoire a acquis une importance capitale.

Au début du premier et de chaque interrogatoire ultérieur de la police, le plaignant a été informé que son témoignage pouvait être utilisé comme preuve, le droit de la Belgique de consacrer implicitement le droit de garder le silence. Toutefois, dans les circonstances de l'espèce, les informations fournies par les enquêteurs n'étaient pas suffisamment claires pour garantir l'efficacité du droit du requérant de garder le silence et de ne pas s'incriminer lui-même. Le demandeur a fait des déclarations importantes et a largement fait usage de sa capacité à choisir ou à cacher des faits.

(v) L'utilisation de la preuve obtenue, et dans le cas où la culpabilité est déterminée par le jury, le contenu des instructions et des explications données par le jury. Les procédures ont été menées par un jury, un organe judiciaire non permanent composé de juges professionnels et un jury.

L'acte d'accusation a été lu au début du processus, avant le débat des parties. Il contenait des informations que le requérant avait admises, ainsi que diverses versions de l'exposé des faits présenté par le requérant. Ainsi, l’accusation était également fondée sur divers éléments de preuve non liés aux déclarations du requérant et indépendants d’eux. Cependant, les déclarations obtenues au tout début de la détention du requérant décrivaient en détail les événements survenus le jour du meurtre et les déclarations ultérieures, plus détaillées, contenaient des informations supplémentaires et contradictoires. En outre, le requérant n'a pas nié sa présence sur les lieux du crime et a menacé le témoin. Il a lui-même également fourni à l'enquête des informations pouvant être utilisées contre lui. Ces déclarations ont sans aucun doute fourni aux enquêteurs les bases nécessaires à l'établissement de l'acte d'accusation, même si ces derniers disposaient déjà de certaines informations avant le premier interrogatoire du requérant.

L’acte d’accusation a une valeur limitée pour la compréhension du verdict du jury, puisqu’il est lu dans le débat, qui a pour but de permettre au jury de se forger sa propre conviction sur l’affaire. En l'espèce, le jury a reconnu entre autres éléments de preuve l'intention du demandeur de commettre l'une des deux tentatives de meurtre, celle qui a été prouvée à l'aide du témoignage du demandeur. La Cour attache une grande importance à ce fait, qui permet de considérer le témoignage du requérant, rendu en l’absence d’un avocat, comme faisant partie intégrante de la preuve qui a servi de fondement à la condamnation du requérant pour le chef de meurtre.

En outre, le président du tribunal n’a pas indiqué au jury quelle importance il fallait attacher aux nombreux témoignages du demandeur au cours de sa réunion. Malgré les efforts déployés par la Cour de cassation pour évaluer l’équité de la procédure dans son ensemble à la lumière de la jurisprudence de la Cour européenne en l'espèce, la Cour de cassation n'a apparemment pas tenu compte du fait que le jury n'était pas compétent. fourni des informations susceptibles d’envoyer leur appréciation de la valeur du témoignage du demandeur, donné en l’absence d’un avocat.

En l’espèce, le jury manque totalement d’instructions et d’explications sur la manière dont il convient d’évaluer le témoignage de la requérante par rapport à d’autres pièces de la cause et sur leur force probante, alors même que ce témoignage a été obtenu en l’absence d’avocat et une détention, sans donner au requérant des informations suffisamment claires sur son droit de garder le silence, constitue une grave lacune.

(vi) L'importance de l'intérêt public. Les poursuites pénales engagées contre le requérant étaient justifiées par d'importantes considérations d’intérêt public, le requérant étant inculpé de meurtre et de deux tentatives de meurtre.

(vii) La présence dans la législation et la pratique belges pertinentes d’autres garanties procédurales. Lors des événements de la présente affaire, la Cour de cassation de Belgique a tenu compte d'un certain nombre de garanties procédurales prévues par le droit belge afin d'évaluer la conformité de la Convention avec les restrictions légales du droit à un avocat pendant sa détention.

(viii) Conclusion concernant l'équité du processus dans son ensemble. La procédure pénale engagée contre le requérant, si elle était considérée dans son ensemble, ne permettait pas de remédier aux irrégularités de procédure constatées au stade préliminaire de la procédure, parmi lesquelles les plus importantes étaient les suivantes:

- les restrictions au droit du requérant de consulter un avocat revêtaient une importance particulière. Il a été interrogé au cours de sa détention sans consultation préalable avec l'avocat et en son absence, puis au cours de l'enquête préliminaire en l'absence d'un avocat qui n'a pas non plus participé à d'autres enquêtes;

- dans les circonstances et en l'absence d'informations préliminaires suffisamment claires sur le droit de garder le silence, le requérant a fourni un témoignage détaillé au cours de sa détention, puis il a présenté diverses versions des faits et a présenté un témoignage qui, s'ils n'étaient pas élogieux au sens étroit du terme, pas moins, cela a grandement influencé sa position, en particulier en ce qui concerne l'accusation de tentative de meurtre visée à l'alinéa v);

- le jury a reconnu que l'ensemble de ces témoignages était recevable à titre de preuve, bien que le tribunal n'ait pas procédé à un examen approprié des circonstances dans lesquelles les preuves ont été obtenues, ni des conséquences de l'absence d'un avocat;

- si la Cour de cassation examinait la question de la clôture de l’accusation et cherchait en outre à vérifier si le droit du requérant à un procès équitable était respecté, il se concentrait sur l’absence d’un avocat pendant sa détention, sans évaluer les conséquences pour le droit à la défense du requérant. son avocat lors d'interrogatoires et d'autres enquêtes menées au cours de l'enquête préliminaire;

- le témoignage du requérant occupait une place importante dans l'acte d'accusation et, s'agissant de l'accusation de tentative de meurtre susmentionnée, faisait partie intégrante des éléments de preuve sur lesquels se fondait la peine infligée au requérant;

- Au cours du procès, le jury n'a pas reçu d'instructions ni de clarifications de la part du juge qui présidait sur la manière d'évaluer les preuves du demandeur et leur valeur probante.

En l'espèce, la combinaison de divers facteurs, et non chacun individuellement, a conduit à ce que le processus concernant le demandeur dans son ensemble n'était pas équitable.


Résolution


L'affaire constituait une violation de l'article 6 de la Convention (adopté à l'unanimité).

En application de l'article 41 de la Convention. La Cour européenne a déclaré que le constat de violation de la Convention constituerait en soi une réparation équitable suffisante pour le préjudice moral.

ECHR judgment of November 9, 2018 in the case of Bezéz (v. Belgium) (application No. 71409/10).

In 2010, the complainant was assisted in preparing a application. Subsequently, the application was communicated to Belgium.

The case was successfully examined by the application that during his detention and the investigation he was questioned in the absence of a lawyer, and that the jury rejected the complainant’s claim that the testimony obtained during the interrogations conducted by the police and the investigating judge were inadmissible. The case has violated the requirements of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.


THE CIRCUMSTANCES OF THE CASE


On 17 December 2007, the complainant was detained by gendarmes in France and detained on the basis of a European arrest warrant. On December 31, 2007, he was handed over to the Belgian authorities, where he was interrogated during his detention and investigation in the absence of a lawyer.

The jury rejected the claimant’s claim that the testimony obtained during interrogations conducted by the police and the investigating judge were inadmissible. At the end of the debate, the complainant was found guilty by the jury, in particular for premeditated murder and sentenced to life imprisonment.

Subsequently, the Court of Cassation dismissed the argument that a lawyer was not assisted at the preliminary stage of the proceedings. The Court of Cassation considered that, taking into account the proceedings in the case as a whole, it should be considered that the applicant's right to a fair trial was respected.


QUESTIONS OF RIGHT


Regarding compliance with paragraph 1 and subparagraph "c" of paragraph 3 of Article 6 of the Convention. (a) Availability and scope of restrictions. The applicant was handed over to the Belgian authorities on 31 December 2007 at 10.40. However, the right to the assistance of a lawyer was recognized for him only after, at the end of the interrogation at 17.42, the investigating judge ordered him to be taken into custody and notified the lawyers ’office with a view to appointing the applicant a lawyer. At the same time, it is not clear from the materials of the case from which moment the applicant actually gained access to a lawyer in order to prepare his defense.

Even if the applicant could freely communicate with the lawyer appointed to him later, he could not use his help during interrogations and other investigative actions carried out at the preliminary investigation stage of the case. In addition to the fact that this restriction was based on the interpretation of the relevant provisions of the law in force at the time, it was applied during the whole period of the preliminary investigation, namely during 10 interrogations. The applicant's lawyer also did not participate in the on-site verification of tests on 6 June 2008.

(b) There is an urgent need. The controversial restrictions were caused by a gap in the legislation of Belgium and the interpretation of the latter by the courts of the respondent state. However, restrictions on access to a lawyer in case of urgent need are allowed at the preliminary stage of the proceedings only in exceptional cases. They should be temporary and based on an individual assessment of the particular circumstances of the case. Such an individual assessment was obviously not carried out in the present case. Furthermore, the authorities of the respondent State have not established the existence of exceptional circumstances. Consequently, the restrictions on the applicant's right to access a lawyer were not justified by any urgent need.

The applicant referred to a certain interpretation of the case law of the European Court concerning the right of access to a lawyer. According to this interpretation, if the restriction of the right of access to a lawyer follows from the law and is systematic, in the absence of an urgent need, it is enough to conclude that the requirements of Article 6 of the Convention are violated. However, as follows from the judgment of the Grand Chamber of the European Court of Justice in the case of Ibrahim and Others v. The United Kingdom ((Ibrahim and Others v. United Kingdom) of September 13, 2016, complaint No. 50541/08 and three other complaints), after which It was adopted by the Grand Chamber of the European Court of Justice in the case of Simeonovi v. Bulgaria (Simeonovi v. Bulgaria) of 12 May 2017, complaint no. 21980/04, the European Court rejected the applicants ’argument that the European Court of Justice’s judgment Salduz v. Turkey (Salduz v. Turkey) of November 27, 2008, complaint No. 36391/02) contains an olyutnoe rule of this nature. The European Court has thus departed from the principle enshrined in the Danayan v. Turkey case (Dayanan v. Turkey) of October 13, 2009, complaint No. 7377/03, as well as in other rulings issued against Turkey.

(c) Compliance with the overall fairness of the process. The European Court must evaluate the fairness of the process, using a very strict approach, especially in cases where restrictions on the right of access to a lawyer are based on legal provisions of a general and mandatory nature. Thus, the burden of proof lies with the authorities of the respondent state, which must provide convincing evidence that the proceedings in the applicant’s criminal case were generally fair. However, the failure of the authorities of the respondent State to provide evidence of an urgent need carries great weight in the balance and may lead the Court to conclude that there has been a violation of paragraph 3 (c) and paragraph 1 of Article 6 of the Convention.

Below, we will analyze the various factors considered in the above-mentioned judgments of the Grand Chamber of the European Court of Justice for Ibrahim and Others v. United Kingdom and Simeonovs v Bulgaria.

(i) Applicant’s vulnerability. The applicant was not in a state of particular vulnerability, exceeding the state in which persons interrogated by the investigator are usually found. The interrogations and other investigative steps taken during the applicant's detention were neither unusual nor excessively lengthy.

(ii) Circumstances of obtaining evidence. Investigators in Belgium and the French gendarmes did not exert any pressure on the applicant.

(iii) Provisions for pre-sentencing legislation and the admissibility of evidence, as well as the opportunity to challenge the evidence collected and its investigation. At the end of the custody period, the general guarantees provided by the relevant provisions of the law allowed the applicant to communicate with a lawyer during the whole time except for interrogations. However, the Belgian legislation that was applied in the criminal proceedings against the applicant did not comply with the requirements of paragraph 3 of Article 6 of the Convention. Therefore, certain provisions of the law, which provide certain guarantees in abstracto, could not by themselves ensure the overall fairness of the process. The Court had to check whether the application of these legal provisions in the present case was of a compensatory nature, by virtue of which the whole process was fair. As part of this review, it was noted that the applicant’s behavior during interrogations could have such consequences for his further defense that the applicant could not be sure that the assistance provided later by a lawyer or the adversary of the subsequent stages of the process would be sufficient to correct the deficiencies admitted during his detention. In addition, it was not clear from the materials of the case from when the applicant was provided with legal assistance. It is obvious that the applicant's counsel has changed several times, but there is no information in the case file either about the frequency of consultations or that the lawyer was warned about the dates of the interrogations. Accordingly, the applicant did not have the opportunity to prepare his defense with the lawyer in advance, and he had to be content with what he informed the lawyer about how his interrogations took place, perhaps using the protocol, and the applicant drew conclusions for the future.

Thus, the guarantee that the investigation was under the control of the Chamber of Charges, to which the applicant could at any time appeal so that, with the help of a lawyer, to challenge the legality of the investigative actions, did not play an important role in the present case.

The admissibility of the applicant's testimony as evidence was the subject of a dispute in a jury trial. The applicant, with the help of his lawyer, filed remarks in which he demanded that the protocols of interrogations conducted in the absence of a lawyer and the criminal prosecution be declared inadmissible. Referring to the above-mentioned Resolution of the Grand Chamber of the European Court in the case of Salduz v. Turkey, the applicant argued that systematically denying the right of access to a lawyer since the first interrogation was sufficient to state a violation of Article 6 of the Convention. In the same day sentence, the jury rejected the applicant's arguments and recognized all the protocols as admissible evidence on the grounds that, according to the court, the applicant could still exercise his right to a fair trial, despite the absence of a lawyer during the preliminary interrogations.

The jury did not examine in more detail neither the protocols, nor the circumstances in which the controversial interrogations were conducted, nor the testimony obtained. Consequently, there was no evidence that the court analyzed the consequences of the absence of a lawyer for the key points of the proceedings, although such an analysis was nevertheless necessary. This omission is all the more important because, due to the oral nature of the debate in the jury and the lack of detailed court records, it is impossible to assess the impact of the debate on the jury’s opinion.

The court of cassation could assess the impact of interrogations conducted in the absence of a lawyer on the fairness of the proceedings and take measures against the judges who examined the case on the merits and admitted the evidence given by the applicant against himself in the absence of a lawyer. However, the Court of Cassation for the first time issued a relevant decision after the sentence was pronounced in the present case. In reviewing the progress of the applicant’s case, the Court of Cassation focused on the absence of confessions given during the detention period, and regarding the remainder of the preliminary investigation, when the applicant’s rights were also limited, indicated only that the applicant was never forced to testify against himself and always testified voluntarily.

(iv) The nature of the evidence. In the opinion of the jury and the Court of Cassation, the testimony given by the applicant during the controversial interrogations was not grateful and did not constitute a surrender. It is obvious that the applicant never confessed to the crimes he was accused of and, accordingly, strictly speaking, did not testify against himself. Nevertheless, he gave detailed testimony to the investigators, who directed the course of the hearings and interrogations. To this was added the fact that the applicant, during the whole preliminary investigation, changed the version of events several times, thus undermining the credibility of his words, with the result that the first interrogation acquired key importance.

At the beginning of the first and each subsequent interrogation by the police, the complainant was informed that his testimony could be used as evidence, the right of Belgium to implicitly enshrined the right to remain silent. However, in the circumstances of the present case, the information provided by the investigators was not clear enough to ensure the effectiveness of the applicant's right to remain silent and not to incriminate himself. The applicant made important statements and made extensive use of his ability to choose or hide facts.

(v) The use of the evidence obtained, and in the case when the guilt is determined by the jury, the content of the instructions and explanations given by the jury. The proceedings were carried out by a jury, a non-permanent judicial body composed of professional judges and a jury.

The indictment was read at the beginning of the process, before the debate of the parties. It contained information that the applicant admitted, as well as various versions of the statement of facts by the applicant. Thus, the prosecution was also based on various evidences not related to the statements of the applicant and not dependent on them. However, the statements obtained at the very beginning of the applicant's detention, described in detail the events that occurred on the day of the murder, and the subsequent, more detailed, statements contained additional and contradictory information. In addition, the applicant did not deny that he was present at the crime scene and threatened the witness. He himself also provided the investigation with information that could be used against him. These statements, without doubt, provided the investigators with the basis for drawing up the indictment, even if the investigators already had certain information before the first interrogation of the applicant.

The indictment is of limited value for understanding the jury’s verdict, since it is read to the debate, which is intended to allow the jury to form his own inner conviction on the case. In this case, the jury recognized as proved the intent of the applicant to commit one of the two attempted murders, the one that was proved with the help of the testimony of the applicant, among other evidence. The Court attaches great importance to this fact, which makes it possible to consider the testimony of the applicant, given in the absence of a lawyer, as an integral part of the evidence that served as the basis for sentencing the applicant in relation to the murder charge.

In addition, the presiding judge did not give any instructions to the jury as to how much importance should be attached to the numerous testimonies of the applicant during their meeting. Despite the efforts made by the Court of Cassation to evaluate the fairness of the process as a whole in the light of the case-law of the European Court in the present case, the Court of Cassation apparently did not take into account the fact that the jury was not provided information that could send their assessment of the value of the testimony of the applicant, given in the absence of a lawyer.

In the present case, there is a complete lack of instructions and explanations to the jury regarding how they should evaluate the applicant's testimony compared to other materials of the case, and about their evidentiary force, despite the fact that this testimony was obtained in the absence of a lawyer and in relation to detention, without giving the applicant sufficiently clear information about his right to remain silent, is a serious shortcoming.

(vi) The importance of public interest. The criminal prosecution of the applicant was justified by important considerations of public interest, since the applicant was charged with murder and two attempted murder.

(vii) The presence in the relevant Belgian legislation and law enforcement practice of other procedural safeguards. During the events of the present case, the Court of Cassation of Belgium took into account a number of procedural guarantees provided for by Belgian law in order to assess the compliance of the Convention with the legal restrictions on the right to a lawyer during detention.

(viii) Conclusion regarding the fairness of the process as a whole. The criminal proceedings against the applicant, if considered as a whole, did not allow remedying the procedural shortcomings made at the preliminary stage of the proceedings, among which the most important were the following:

- restrictions on the applicant's right to access a lawyer were of a special scale. He was interrogated during his detention without prior consultation with the lawyer and in his absence, and then during the preliminary investigation in the absence of a lawyer who also did not participate in other investigative actions;

- under the circumstances and in the absence of sufficiently clear preliminary information about the right to remain silent, the applicant gave detailed testimony during his detention, then he presented various versions of the facts and gave testimony, which, if they were not appreciative in the narrow sense of the word, no less, it greatly influenced his position, especially with regard to the charge of attempted murder referred to in paragraph (v);

- the aggregate of these testimonies was recognized by the jury as admissible as evidence, although the court did not carry out an appropriate examination of the circumstances in which the evidence was obtained, nor the consequences of the absence of a lawyer;

- if the Court of Cassation considered the question of the termination of the prosecution and, moreover, sought to check whether the applicant’s right to a fair trial was respected, he concentrated on the absence of a lawyer during the applicant’s detention, without assessing the consequences for the applicant’s right to defense his lawyer during interrogations and other investigative actions conducted during the preliminary investigation;

- the applicant's testimony held an important place in the indictment and, as regards the charge of attempted murder, mentioned above, were an integral part of the evidence on which the sentence imposed on the applicant was based;

- During the trial, the jury did not receive any instructions or clarifications from the presiding judge on how to evaluate the evidence of the applicant and their evidentiary value.

In the present case, the combination of various factors, and not each of them individually, led to the fact that the process with respect to the applicant as a whole was not fair.


RESOLUTION


The case was a violation of Article 6 of the Convention (adopted unanimously).

In application of Article 41 of the Convention. The European Court ruled that the finding of a violation of the Convention will in itself constitute sufficient just compensation for non-pecuniary damage.

В 2012 году организации-заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Хорватии.

 

По делу успешно рассмотрена жалоба заявителя на возложение на него обязанности компенсировать вред, причиненный публикацией статьи, признанной порочащей честь судьи. По делу допущено нарушение требований статьи 10 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Организации-заявительнице было предписано выплатить компенсацию за публикацию в еженедельной газете сведений, порочащих честь судьи. За два года до публикации спорной статьи данный судья вынес постановление об обыске помещений организации-заявительницы, что, по мнению одного из журналистов газеты, нарушало свободу журналистов. Тот же судья вновь привлек к себе внимание журналистов газеты, когда он появился на вечере, посвященном открытию новой газеты, основанной местным предпринимателем, мнения о личности которого были противоречивыми. В итоге была опубликована статья, в которой указывалось, что судья оказался в ситуации потенциального конфликта интересов. В ней упоминалось о выдаче разрешения на обыск два года назад и утверждалось, что судья должен был быть "привязан к позорному столбу".

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 10 Конвенции. Настоящее дело касалось свободы прессы при освещении профессиональной деятельности судей. Замечаниям по вопросам, представляющим общественный интерес, обычно предоставляется высокий уровень защиты. Однако необходимо учитывать особую роль судебной власти в обществе. Как гарант правосудия, фундаментальной ценности в государстве, подчиненном верховенству закона, правосудие должно пользоваться доверием общественности, чтобы успешно выполнять свои функции. Следовательно, может быть необходимо защищать такое доверие от посягательств, наносящих ему серьезный ущерб и по большому счету лишенных оснований, тем более с учетом того факта, что судьи, в адрес которых направлена критика, связаны обязанностью соблюдения конфиденциальности и потому не могут на нее ответить. Тем не менее судьи могут подвергаться личной критике в дозволенных рамках, и не только теоретическим или общим образом. При осуществлении должностных полномочий они, таким образом, могут стать объектом критики в более широких пределах, чем обычные граждане.

 

Целью спорной статьи было привлечение внимания общественности к вопросам, касавшимся функционирования судебной системы. Чтобы провести различие между утверждениями о фактах и оценочными суждениями, необходимо было принять во внимание все обстоятельства дела и общий характер замечаний, учитывая, что утверждения по вопросам, представляющим общественный интерес, могли являться скорее оценочными суждениями, чем утверждениями о фактах. Европейский Суд согласился с выводом судов Хорватии о том, что в статье содержались оценочные суждения. Однако поскольку суды государства-ответчика решили, что статья была оскорбительной и представляла собой голословное обвинение одного конкретного судьи, они далее не рассмотрели вопрос о том, имели ли оценочные суждения, содержавшиеся в статье, достаточные фактические основания.

 

Европейский Суд отклонил довод властей Хорватии о том, что единственной целью спорной статьи была публичная дискредитация судьи. На содержание статьи действительно наложили отпечаток личный опыт журналистов и их недовольство конкретным судьей, однако при данных обстоятельствах это не изменяло того факта, что статья касалась вопроса, представлявшего общественный интерес. Хотя статья была язвительной и содержала серьезную критику, преувеличения и жесткую метафору, она не была оскорбительной по своей сути. Использование язвительного тона в комментариях, касающихся судьи, в принципе не противоречит требованиям статьи 10 Конвенции.

 

Настоящее дело касалось ситуации, в которой журналист в рамках обсуждения вопросов, представляющих общественный интерес, выразил оценочные суждения, причинившие ущерб репутации судьи. Организация-заявительница была обязана выплатить 6 870 евро в качестве компенсации морального вреда. Сложно допустить, что посягательство на репутацию судьи было такого уровня серьезности, что оправдывало бы присуждение компенсации в таком размере. Размер присужденной компенсации может препятствовать открытому обсуждению вопросов, представляющих общественный интерес.

 

Следовательно, вмешательство в свободу выражения мнения не было "необходимым в демократическом обществе".

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции Европейский Суд присудил организации-заявительнице 5 000 евро в качестве компенсации морального вреда, требование о возмещении материального ущерба было отклонено.

Pravilnik ECHR-a od 8. studenog 2018. godine u predmetu Narodni list d. (Narodni list d.d.) protiv Hrvatske (zahtjeva br. 2782/12).

 

U 2012. godini organizaciji podnositeljici zahtjeva pružena je pomoć u pripremi zahtjeve. Nakon toga, zahtjeva je priopćena Hrvatskoj.

 

U predmetu je uspješno razmotren zahtjeva podnositelja zahtjeva da mu se nametne obveza nadoknade štete prouzročene objavljivanjem članka kojim se priznaje diskreditacijska čast suca. Slučaj je povrijedio zahtjeve članka 10. Konvencije o zaštiti ljudskih prava i temeljnih sloboda.

 


OKOLNOSTI SLUČAJA

 


Organizaciji podnositeljici zahtjeva naloženo je da plati naknadu za objavljivanje informacija u tjednim novinama kojima se diskreditira sudačka čast. Dvije godine prije objavljivanja kontroverznog članka, sudac je naložio pretragu prostorija organizacije podnositeljice zahtjeva, koja je, po mišljenju jednog od novinara, prekršila slobodu novinara. Isti je sudac ponovno privukao pozornost novinarskih novinara kada se pojavio na večeri posvećenoj otvaranju novih novina, koje je osnovao lokalni poduzetnik, čija su mišljenja o identitetu proturječna. Kao rezultat toga, objavljen je članak koji ukazuje na to da je sudac u situaciji potencijalnog sukoba interesa. Odnosi se na izdavanje dozvole za pretraživanje prije dvije godine i tvrdi da je sudac trebao biti "vezan za stub srama".

 


PITANJA PRAVA

 


Što se tiče usklađenosti s člankom 10. Konvencije. Ovaj predmet odnosio se na slobodu tiska u pokrivanju profesionalnih aktivnosti sudaca. Primjedbe o pitanjima od javnog interesa obično imaju visoku razinu zaštite. Međutim, potrebno je uzeti u obzir posebnu ulogu pravosuđa u društvu. Kao jamac pravde, fundamentalne vrijednosti u državi podređenoj vladavini prava, pravda mora uživati ​​povjerenje javnosti kako bi uspješno obavljala svoje funkcije. Slijedom toga, možda će biti potrebno zaštititi takvo povjerenje od zadiranja, nanošenje mu ozbiljne štete i, uglavnom, neopravdano, posebno s obzirom na činjenicu da su suci upućeni na kritiku vezani dužnošću povjerljivosti i stoga ne mogu odgovoriti na njega. Međutim, suci mogu biti predmetom osobne kritike unutar dopuštenih granica, a ne samo na teoretski ili opći način. U izvršavanju službenih ovlasti, oni stoga mogu biti predmetom kritike u širem opsegu nego obični građani.

 

Svrha spornog članka bila je skrenuti pozornost javnosti na pitanja koja se odnose na funkcioniranje pravosudnog sustava. Da bi se razlikovale izjave o činjenicama i vrijednosnim sudovima, bilo je potrebno uzeti u obzir sve okolnosti slučaja i opću prirodu komentara, s obzirom da izjave o pitanjima od javnog interesa mogu biti vrijednosne prosudbe, a ne izjave činjenica. Europski sud složio se s zaključkom hrvatskih sudova da je članak sadržavao vrijednosne presude. Međutim, budući da su sudovi tužene države odlučili da je članak uvredljiv i da predstavljaju neosnovanu optužbu pojedinog suca, oni nadalje nisu razmatrali jesu li vrijednosne presude sadržane u članku imale dovoljno činjeničnih osnova.

 

Europski sud je odbacio argument hrvatskih vlasti da je jedina svrha spornog članka bila javno diskreditirati suca. Sadržaj članka uistinu je ostavio traga na osobnom iskustvu novinara i njihovom nezadovoljstvu pojedinim sudiji, međutim, u tim okolnostima to nije promijenilo činjenicu da se članak odnosi na pitanje od javnog interesa. Iako je članak bio oštar i sadržavao ozbiljnu kritiku, pretjerivanje i oštru metaforu, nije bio uvredljiv u svojoj biti. Upotreba nagrizajućeg tona u komentarima koji se tiču ​​suca, u načelu, nije u suprotnosti sa zahtjevima članka 10. Konvencije.

 

Ovaj se predmet odnosio na situaciju u kojoj je novinar, raspravljajući o pitanjima od javnog interesa, izrazio vrijednosne sudove koji su prouzročili štetu ugledu suca. Organizacija podnositeljica zahtjeva bila je dužna platiti 6.870 EUR na ime nematerijalne štete. Teško je pretpostaviti da je narušavanje ugleda suca bilo tako ozbiljno da bi opravdalo dodjeljivanje naknade u takvoj veličini. Iznos dodijeljene naknade može spriječiti otvorenu raspravu o pitanjima od javnog interesa.

 

Stoga uplitanje u slobodu izražavanja nije bilo "nužno u demokratskom društvu".

In 2012, the applicant organization was assisted in the preparation of the application. Subsequently, the application was communicated to Croatia.

 

The case was successfully considered the application of the applicant to impose on him the obligation to compensate for the harm caused by the publication of an article that recognized the discrediting honor of the judge. THE CIRCUMSTANCES OF THE CASE

 


The applicant organization was ordered to pay compensation for publishing information in the weekly newspaper discrediting the judge’s honor. Two years before the publication of the controversial article, the judge ordered the search of the premises of the applicant organization, which, in the opinion of one of the journalists, violated the freedom of journalists. The same judge again attracted the attention of newspaper journalists when he appeared at an evening dedicated to the opening of a new newspaper, founded by a local entrepreneur, whose opinions about the identity were contradictory. As a result, an article was published, which indicated that the judge was in a situation of potential conflict of interest. It referred to the issuance of a search permit two years ago and claimed that the judge should have been "tied to the pillory."

 


QUESTIONS OF RIGHT

 


Regarding compliance with Article 10 of the Convention. The present case concerned the freedom of the press in covering the professional activities of judges. Remarks on matters of public interest are usually given a high level of protection. However, it is necessary to take into account the special role of the judiciary in society. As the guarantor of justice, of fundamental value in a state subordinate to the rule of law, justice must enjoy the trust of the public in order to successfully carry out its functions. Consequently, it may be necessary to protect such trust from encroachment, causing him serious damage and by and large unjustified, especially given the fact that judges addressed to criticism are bound by the duty of confidentiality and therefore cannot respond to it. However, judges may be subject to personal criticism within the limits allowed, and not only in a theoretical or general way. In the exercise of official powers, they, therefore, can be the object of criticism in a wider range than ordinary citizens.

 

The purpose of the controversial article was to draw public attention to issues relating to the functioning of the judicial system. To distinguish between statements of fact and value judgments, it was necessary to take into account all the circumstances of the case and the general nature of the comments, given that statements on matters of public interest could be value judgments rather than statements of facts. The European Court agreed with the conclusion of the Croatian courts that the article contained value judgments. However, since the courts of the respondent State decided that the article was insulting and constituted an unfounded accusation of one particular judge, they further did not consider whether the value judgments contained in the article had sufficient factual grounds.

 

The European Court rejected the Croatian authorities' argument that the sole purpose of the controversial article was to publicly discredit the judge. The content of the article really left an imprint on the personal experience of journalists and their dissatisfaction with a particular judge, however, under the circumstances, this did not change the fact that the article concerned a matter of public interest. Although the article was caustic and contained serious criticism, exaggeration and harsh metaphor, it was not insulting in its essence. The use of a caustic tone in the comments concerning the judge, in principle, does not contradict the requirements of Article 10 of the Convention.

 

The present case concerned a situation in which the journalist, in discussing matters of public interest, expressed value judgments that caused damage to the judge’s reputation. The applicant organization was required to pay EUR 6,870 in respect of non-pecuniary damage. It is difficult to assume that an encroachment on the reputation of a judge was of such a level of seriousness that would justify awarding compensation in such a size. The amount of compensation awarded may prevent open discussion of issues of public interest.

 

Therefore, interfering with freedom of expression was not “necessary in a democratic society.”

 


RESOLUTION

 


The case was a violation of Article 10 of the Convention (adopted unanimously).

 


COMPENSATION

 


In application of Article 41 of the Convention, the Court awarded the applicant organization EUR 5,000 in respect of non-pecuniary damage, the claim for pecuniary damage was rejected.

Постановление ЕСПЧ от 06 ноября 2018 года по делу "Рамос Нунеш де Карвальо э Са (Ramos Nunes de Carvalho e Sa) против Португалии" (жалоба N 55391/13 и другие жалобы).

 

В 2013 году заявительнице была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Португалии.

 

По делу успешно рассмотрена жалоба заявительницы, являвшейся судьей, на нарушение ее прав на рассмотрение дела независимым и беспристрастным судом ввиду двойственности функций председателя Верховного суда, являвшегося также председателем Высшего совета магистратуры, на пересмотр фактов дела, установленных Высшим советом магистратуры, а также права на устное слушание. По делу допущено нарушение требований статьи 6 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В отношении заявительницы, которая в период, относившийся к обстоятельствам дела, являлась судьей, были возбуждены три дисциплинарных производства. Она была привлечена к дисциплинарной ответственности Высшим советом магистратуры (далее - ВСМ), и ей было назначено наказание в виде штрафа и двух временных отстранений от должности.

 

Жалобы заявительницы с требованием о пересмотре дела и новом установлении фактов были отклонены. Секция Верховного суда по спорам (далее - СВСС) оставила в силе решения ВСМ на основании, в частности, того, что в полномочия СВСС входили не новое установление фактов дела, а лишь надзор за разумностью оценки фактов.

 

В рамках назначения наказания по совокупности ВСМ объединил все назначенные заявительнице меры наказания и назначил ей единое наказание в виде 240 дней временного отстранения от должности.

 

Заявительница утверждала в ходе производства в Европейском Суде, что было допущено нарушение ее права на рассмотрение дела независимым и беспристрастным судом, на пересмотр фактов дела, установленных ВСМ, а также на устное слушание. 21 июня 2016 г. Палата Европейского Суда единогласно постановила, что в настоящем деле имело место нарушение статьи 6 Конвенции. 17 октября 2016 г. по ходатайству властей Португалии дело было передано на пересмотр в Большую Палату Европейского Суда.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения пункта 1 статьи 6 Конвенции. (1) Применимость. Статья 6 Конвенции применима в ее гражданско-правовом аспекте. Что касается ее уголовно-правового аспекта, то положения административного законодательства, примененные в ходе спорных производств, относились к тем, которые регулируют привлечение судей к дисциплинарной ответственности. Эти положения, допускавшие назначение наказаний, касались определенной категории судей, а не широкой общественности. Дело было рассмотрено управленческим и дисциплинарным органом, ВСМ. При таких условиях правонарушения, в которых обвинялась заявительница, имели исключительно дисциплинарный характер. Наконец, все виды наказания, которые могли быть назначены заявительнице, являлись чисто дисциплинарными. Тяжесть примененного к ней наказания, а именно штраф большого размера, имеющий характер карательной меры, не является достаточной для того, чтобы отнести спорные правонарушения к уголовно-правовой сфере. Таким образом, дисциплинарные производства в отношении заявительницы не представляли собой дела о предъявлении ей уголовного обвинения по смыслу статьи 6 Конвенции. Следовательно, уголовно-правовой аспект данной статьи Конвенции не подлежит применению в настоящем деле. Соответственно, жалобы заявительницы на нарушение пункта 3 статьи 6 Конвенции являются несовместимыми с положениями Конвенции ratione materiae.

 

(2) Существо жалобы. (a) Независимость и беспристрастность Секции Верховного суда по спорам. (i) Двойственность функций председателя Верховного суда. Жалоба заявительницы касалась, помимо прочего, того факта, что председатель Верховного суда также являлся председателем ВСМ.

 

Состав СВСС определялся Статутом судей (Statut des magistrats du siège) на основании объективных критериев, таких как стаж работы в должности судьи и принадлежность судей к определенной секции, и председатель Верховного суда не входил в состав СВСС ad hoc. На практике официальное назначение членов СВСС осуществлялось заместителем председателя Верховного суда с наибольшим стажем работы в этой должности.

 

Помимо этого, заявительница не утверждала, что судьи СВСС действовали согласно инструкциям или под влиянием председателя Верховного суда или что они иным образом проявили отсутствие беспристрастности. В частности, не было установлено, что данные судьи были назначены специально для рассмотрения дела заявительницы. В настоящем деле отсутствуют сведения, позволяющие установить, что жалоба заявительницы была оправдана объективно обоснованными опасениями.

 

Таким образом, двойственность функций председателя Верховного суда не может поставить под сомнение независимость и объективную беспристрастность данной судебной инстанции.

 

(ii) Роль ВСМ в карьере судей Верховного суда и дисциплинарное производство в отношении судей. В отличие от дела "Александр Волков против Украины" (Oleksandr Volkov v. Ukraine) (Постановление от 9 января 2013 г., жалоба N 21722/11) в рамках ВСМ Португалии не было выявлено серьезных недостатков структурного характера или признаков заинтересованности членов ВСМ в исходе разбирательства дела.

 

Независимость судей гарантируется в Португалии как Конституцией, так и другими положениями законодательства страны, и Конституционный суд Португалии несколько раз признавал соответствующим Конституции механизм, в ходе которого жалобы на решения ВСМ рассматривает Секция Верховного суда по спорам.

 

Вместе с тем тот факт, что судьи подчинялись закону в целом и правилам в области дисциплины и профессиональной деонтологии, в частности, не позволял подвергать сомнению их беспристрастность. Судьи Верховного суда являлись высококвалифицированными специалистами и, как правило, находились на завершающем этапе карьеры, они более не проходили аттестацию и не стремились получить повышение, и дисциплинарные полномочия ВСМ в отношении них были скорее теоретическими. Таким образом, в деле не было каких-либо конкретных сведений, которые бы указывали на отсутствие беспристрастности судей. Следовательно, то обстоятельство, что судьи, рассматривавшие дело, сами были подчинены режиму дисциплинарной ответственности и могли в тот или иной момент сами оказаться в положении одной из сторон по делу, не был достаточен для того, чтобы прийти к выводу о нарушении требований беспристрастности.

 

В связи с этим, принимая во внимание все конкретные обстоятельства настоящего дела, а также гарантии, имеющие целью защитить СВСС от внешних воздействий, Европейский Суд счел, что утверждения заявительницы не могли рассматриваться как объективно обоснованные и что система надзора за решениями ВСМ по дисциплинарным делам, а именно механизм обращения в Секцию Верховного суда по спорам, не противоречили независимости и беспристрастности, которые требуются в соответствии с пунктом 1 статьи 6 Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу не было допущено нарушения требований статьи 6 Конвенции (принято 11 голосами "за" при шести - "против").

 

(b) Надзор Секции Верховного суда по спорам и отсутствие устного слушания по делу. (i) Предмет решений ВСМ. Предметом рассмотрения в настоящем деле был вопрос о том, выполнила ли заявительница свои профессиональные обязанности. При разрешении данного вопроса ВСМ должен был осуществить свои дискреционные полномочия. Этот орган, созданный специально для толкования и применения норм, регулирующих поведение судей в дисциплинарной сфере, был призван способствовать надлежащему отправлению правосудия. Однако в настоящем деле для оценки фактов и осуществления надзора в отношении назначенных дисциплинарных мер наказания необязательно требовались специальные знания или специальный профессиональный опыт. Эти вопросы могли относиться к сфере полномочий любого судебного органа. В данном деле речь не шла о классическом осуществлении дискреционных административных полномочий в конкретной правовой сфере.

 

Решения ВСМ являлись предметом обжалования в административном порядке в Секцию Верховного суда по спорам. Надзор за решениями о наложении дисциплинарного взыскания отличался от надзора за административными решениями, не содержавшими такого карательного аспекта. Кроме того, в настоящем деле дисциплинарный спор касался судьи. Судебный контроль должен был быть адаптирован к предмету спора, то есть к дисциплинарной природе спорных административных решений, a fortiori в дисциплинарном производстве, направленном против судьи.

 

(ii) Производство в ВСМ (дисциплинарный аспект). В ходе производства по делу заявительница имела возможность представить доводы в свою защиту. Однако производство по делу было письменным, несмотря на то, что заявительнице могло быть назначено очень серьезное наказание. Заявительница не могла принять участия ни в одном из заседаний по трем касавшимся ее производствам, поскольку закон не позволял ВСМ проводить открытые слушания по делу. Заявительница не имела возможности устно изложить свои аргументы, будь то по вопросам факта и меры наказания или по различным вопросам права. Кроме того, ВСМ не заслушивал свидетелей, хотя под вопрос ставилось доверие не только к заявительнице, но и к ключевым свидетелям. При таких обстоятельствах осуществление ВСМ своих дискреционных полномочий не имело соответствующих фактических оснований.

 

(iii) Производство в ВСМ (судебное разбирательство). (альфа) Вопросы, подлежавшие судебному контролю. Во-первых, в своих жалобах, поданных в Верховный суд, заявительница систематически оспаривала деяния, которые вменялись ей ВСМ. Во-вторых, дисциплинарные взыскания были наложены на нее на основании заключения о том, что она не выполнила свои профессиональные обязанности судьи. Таким образом, квалификация профессионального поведения заявительницы имела ключевое значение. В-третьих, в той мере, насколько заявительница жаловалась на то, что взыскания, которые на нее были наложены в ходе каждого из производств, были несоразмерными, судебная инстанция могла считаться пользующейся всей полнотой юрисдикции, только если у нее есть полномочия по оценке соразмерности между совершенным правонарушением и назначенным наказанием.

 

В конкретном контексте дисциплинарного производства вопросы факта, как и вопросы права имели определяющее значение для исхода процесса о "гражданских правах и обязанностях". Установление фактов имеет тем более важное значение, когда речь идет о производствах, предполагающих наложение наказания, в частности, дисциплинарного взыскания в отношении судей, которые должны пользоваться уважением, необходимым для осуществления их полномочий таким способом, чтобы обеспечивать доверие общественности к функционированию и независимости судебной власти. В настоящем деле фактические обстоятельства являлись решающими в рамках производств, касавшихся заявительницы, они не имели второстепенного значения по сравнению с вопросами, решение которых относилось к дискреционным полномочиям администрации. Установление фактов дела вызвало споры между членами ВСМ, и эти факты были названы "решающими". Деяния, которые вменялись заявительнице, могли повлечь временное или окончательное ее отстранение от должности, то есть к очень тяжким мерам наказания, имеющим порочащий характер и способным привести к необратимым последствиям для жизни и карьеры заявительницы. В действительности они привели к назначению дисциплинарного взыскания в виде 240 дней временного отстранения от должности, хотя на практике данное отстранение длилось всего 100 дней.

 

(бета) Судебный контроль. Секция Верховного суда по спорам ясно указала, что она не имела полной юрисдикции в соответствующей сфере, но была уполномочена проверять лишь правомерность спорных решений.

 

Учитывая ограничения, которые накладывали на нее законодательство Португалии и ее собственная прецедентная практика, СВСС не была уполномочена рассматривать вопросы, имевшие решающее значение для дела. СВСС могла только "рассматривать противоречия, несоответствия, а также недостаточность доказательств и очевидные ошибки в их оценке в той мере, в которой эти недостатки являлись явными". В прецедентной практике СВСС "очевидные ошибки" определялись как "ошибки, которые являются не только серьезными (грубыми, поскольку они очевидно противоречат разуму и здравому смыслу или являются недостоверными, либо демонстрируют плохо определенные знания), но и явными (очевидными)".

 

Спорные процессы не касались исключительно правовых аспектов, имевших ограниченные последствия, или сложных технических вопросов, которые могли быть надлежащим образом разрешены на основе материалов дела. Напротив, жалобы, поданные заявительницей, затрагивали важные вопросы права и факта. Даже если Верховный суд полагал, что в его задачу не входило исследование доказательств, ему, тем не менее, следовало проверить, была ли доказательственная база решений ВСМ достаточной для обоснования выводов последнего по делу. Спор о фактах и последствия дисциплинарных взысканий для репутации заявительницы требовали от СВСС осуществления достаточно продвинутого контроля, который бы позволил рассмотреть вопросы, касавшиеся достоверности утверждений заявительницы и свидетелей. Безусловно, дисциплинарное производство в закрытом судебном заседании с согласия заинтересованного лица не противоречило Конвенции. Однако заявительница требовала проведения устного слушания по ее делу, и она должна была иметь возможность получить на это согласие от органа, наделенного полнотой юрисдикции. Подобное состязательное слушание позволило бы получить устные показания сторон и более тщательно исследовать факты дела.

 

(гамма) Полномочия по принятию решений. Прецедентная практика Секции Верховного суда по спорам не позволяла ей подменять оценку дисциплинарного органа своей. Вместе с тем СВСС имела право отменить решение полностью или в части в случае "грубой очевидной ошибки", в том числе, если было установлено, что в ходе процесса, завершившегося принятием спорного решения, были нарушены материальное право или процессуальные требования равенства сторон. СВСС могла, таким образом, вернуть дело в ВСМ на повторное рассмотрение, при котором подлежали учету указания, которые СВСС могла сделать относительно нарушений, которые она могла установить.

 

(дельта) Мотивация решений Верховного суда. При вынесении решений в рамках своих полномочий, определенных в законодательстве страны и прецедентной практике Верховного суда, СВСС в достаточной степени указала основания таких решений, ответив на все доводы заявительницы. Однако оправданное ограниченным характером полномочий СВСС отсутствие устного заседания, в котором были бы рассмотрены ключевые вопросы факта, не позволило СВСС включить в мотивировку решений соображения, касавшиеся оценки данных вопросов.

 

(iv) Заключение. Учитывая, в частности, специфический контекст дисциплинарных процессов в отношении судьи, тяжесть наказания, тот факт, что процессуальные гарантии при рассмотрении дел в ВСМ были ограничены, необходимость оценки фактов, касавшихся достоверности утверждений заявительницы и свидетелей и представлявших собой ключевые сведения, сочетание двух элементов, а именно недостаточность судебного контроля со стороны СВСС и отсутствие устного слушания как на стадии дисциплинарного производства, так и на стадии судебного контроля, привели к тому, что дело заявительницы не было рассмотрено в соответствии с требованиями пункта 1 статьи 6 Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 6 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

Resolução do TEDH, de 6 de novembro de 2018, no caso Ramos Nunes de Carvalho e Sá (Ramos Nunes de Carvalho e Sá) contra Portugal (queixa nº 55391/13 e outras queixas).

 

Em 2013, o requerente foi ajudado na preparação de reclamações. Posteriormente, as queixas foram fundidas e comunicadas a Portugal.

 

O caso examinou com sucesso a queixa da recorrente, juíza, sobre a violação dos seus direitos ao processo por um tribunal independente e imparcial devido à dualidade das funções do presidente do Supremo Tribunal, que era também presidente do Conselho Superior da Magistratura, sobre a revisão dos factos do caso estabelecido pelo Conselho Superior da Magistratura, bem como o direito à oralidade audição. O caso violou os requisitos do Artigo 6 da Convenção para a Proteção dos Direitos Humanos e Liberdades Fundamentais.

 


AS CIRCUNSTÂNCIAS DO CASO

 


Em relação ao requerente, que durante o período relacionado com as circunstâncias do caso, foi um juiz, três processos disciplinares foram instituídos. Ela foi trazida à responsabilidade disciplinar pelo Conselho Superior da Magistratura (doravante - SCM), e foi condenada a uma multa e duas suspensões temporárias do cargo.

 

As exigências do queixoso de uma revisão do caso e uma nova descoberta de fatos foram rejeitadas. A Secção do Supremo Tribunal de Litígios (a seguir designada por SSIA) confirmou as decisões do Supremo Tribunal de Justiça com base, inter alia, no facto de a autoridade do SSCC não incluir um novo apuramento de factos, mas apenas uma supervisão sobre a razoabilidade de uma apreciação dos factos.

 

No âmbito da sentença, o Supremo Conselho de Justiça unificou todas as penalidades impostas ao requerente e atribuiu-lhe uma única sentença de 240 dias de suspensão temporária do cargo.

 

Durante o processo perante a Corte Européia, a demandante alegou que seu direito a um caso foi violado por um tribunal independente e imparcial, para examinar os fatos do caso estabelecido pelo Conselho Superior de Justiça, bem como para uma audiência oral. Em 21 de junho de 2016, a Câmara da Corte Européia decidiu por unanimidade que, no presente caso, houve uma violação do artigo 6 da Convenção. Em 17 de outubro de 2016, a pedido das autoridades portuguesas, o caso foi remetido para análise à Grande Secção do Tribunal Europeu.

 


PERGUNTAS DO DIREITO

 


Quanto ao cumprimento do parágrafo 1 do Artigo 6 da Convenção. (1) Aplicabilidade. O artigo 6 da Convenção é aplicável em seu aspecto civil. Quanto ao seu aspecto de direito penal, as disposições da legislação administrativa aplicada no curso do processo disputado relacionaram-se àquelas que regulamentam a entrega de juízes à responsabilidade disciplinar. Estas disposições, que permitiam a imposição de punições, aplicavam-se a uma determinada categoria de juízes, e não ao público em geral. O caso foi revisado por um órgão administrativo e disciplinar, o Supremo Conselho de Arbitragem. Nestas condições, as infracções pelas quais o recorrente foi acusado eram de natureza exclusivamente disciplinar. Finalmente, todos os tipos de punição que poderiam ser impostos ao candidato eram puramente disciplinares. A severidade da punição aplicada a ela, ou seja, uma multa grande, que tem o caráter de uma medida punitiva, não é suficiente para atribuir crimes controversos ao campo do direito penal. Assim, o processo disciplinar contra a recorrente não constituía um processo penal contra ela, na acepção do artigo 6.º da Convenção. Por conseguinte, o aspecto de direito penal deste artigo da Convenção não é aplicável no presente caso. Por conseguinte, as queixas do queixoso relativas a uma violação do artigo 6.º, n.º 3, da Convenção são incompatíveis com as disposições da Convenção ratione materiae.

 

(2) O mérito da reclamação. (a) Independência e imparcialidade da Seção de Litígios do Supremo Tribunal. (i) A dualidade das funções do Presidente do Supremo Tribunal. A queixa da recorrente dizia respeito, entre outras coisas, ao facto de o presidente do Supremo Tribunal ser também o presidente do Supremo Tribunal de Justiça.

 

A composição da SBC foi determinada pelo Estatuto dos Juízes (Statut des magistrats du siège) com base em critérios objetivos, como o tempo de serviço como juiz e os juízes pertencentes a uma seção específica, e o Presidente da Suprema Corte não era membro da SSC ad hoc. Na prática, a nomeação oficial dos membros da SSCU foi realizada pelo Vice-Presidente do Supremo Tribunal com o maior tempo de serviço neste cargo.

 

Além disso, a recorrente não alegou que os juízes do SVSS agiram de acordo com as instruções ou sob a influência do presidente do Supremo Tribunal ou que, de outro modo, demonstraram falta de imparcialidade. Em particular, não foi estabelecido que esses juízes foram nomeados especificamente para lidar com o caso do requerente. No presente caso, não existem informações que demonstrem que a queixa da recorrente se justifica por preocupações objetivamente justificadas.

 

Assim, a dualidade das funções do Chefe de Justiça do Supremo Tribunal não pode pôr em causa a independência e imparcialidade objetiva desta instância judicial.

 

(ii) O papel do SCM na carreira dos juízes do Supremo Tribunal e processos disciplinares contra juízes. Em contraste com o caso de “Alexander Volkov v. Ucrânia” (Oleksandr Volkov v. Ucrânia) (Decreto de 9 de janeiro de 2013, queixa nº 21722/11), no HMC de Portugal não houve sérias fraquezas estruturais ou sinais de interesse dos membros da HMS no resultado o processo.

 

A independência dos juízes é garantida em Portugal pela Constituição e outras disposições da legislação do país, e o Tribunal Constitucional de Portugal reconheceu várias vezes o mecanismo correspondente à Constituição, durante o qual as queixas do Supremo Tribunal de Justiça são consideradas pela Secção de Litígios do Supremo Tribunal.

 

No entanto, o fato de os juízes obedecerem à lei em geral e às regras no campo da disciplina e da ética profissional, em particular, não permitiu questionar sua imparcialidade. Os juízes do Supremo Tribunal eram especialistas altamente qualificados e, por via de regra, estavam na fase final das suas carreiras, já não passavam o atestado e não procuravam promoção, e a autoridade disciplinar do Supremo Tribunal de Justiça em relação a eles era mais teórica. Assim, o caso não continha informações específicas que indicassem a falta de imparcialidade dos juízes. Conseqüentemente, o fato de que os juízes que consideraram o caso em si estavam sujeitos ao regime disciplinar e pudessem, em um momento ou outro, encontrar-se na posição de uma das partes no caso não era suficiente para atingir uma violação dos requisitos de imparcialidade.

 

A este respeito, tendo em conta todas as circunstâncias específicas do presente caso, bem como as garantias destinadas a proteger o CAS de influências externas, o Tribunal considera que as declarações das recorrentes não podem ser consideradas objectivamente fundamentadas e que o sistema de supervisão das decisões do Supremo Tribunal de Justiça sobre processos disciplinares, ou seja, o mecanismo de aplicação à Seção da Corte Suprema sobre controvérsias não contradiz a independência e a imparcialidade exigidas em conformidade com o parágrafo 1 do Artigo 6 da Convenção.

 


RESOLUÇÃO

 


O caso não violou os requisitos do Artigo 6 da Convenção (tomado por 11 votos "para" com seis - "contra").

 

(b) Supervisão da Seção de Controvérsias do Supremo Tribunal Federal e ausência de audiência oral no caso. (i) O assunto das decisões do SCM O assunto em questão no caso presente era se o pretendente cumpriu suas funções profissionais. Ao resolver essa questão, o Conselho Supremo do Trabalho deveria exercer seus poderes discricionários. Este órgão, criado especificamente para interpretar e aplicar as regras que regem a conduta dos juízes no campo disciplinar, foi concebido para promover a boa administração da justiça. No entanto, no presente caso, a avaliação dos fatos e a supervisão das sanções disciplinares impostas não requerem necessariamente conhecimento especial ou experiência profissional especial. Estas questões podem ser da competência de qualquer autoridade judicial. Nesse caso, não se tratava do exercício clássico de poderes administrativos discricionários em uma esfera jurídica específica.

 

As decisões do Supremo Tribunal de Justiça foram objecto de um recurso administrativo à Secção de Litígios do Supremo Tribunal. A supervisão das decisões sobre a imposição de uma sanção disciplinar diferia da supervisão de decisões administrativas que não contivessem tal aspecto punitivo. Além disso, no presente caso, uma disputa disciplinar envolveu um juiz. O controle judicial teve que ser adaptado ao objeto da disputa, isto é, ao caráter disciplinar das decisões administrativas disputadas, a fortiori no processo disciplinar dirigido contra o juiz.

 

(ii) Processos no Supremo Tribunal de Justiça (aspecto disciplinar) Durante o processo, a recorrente pôde apresentar seus argumentos em sua defesa. No entanto, o processo foi escrito, apesar do fato de que o requerente poderia ser punido com muita gravidade. A recorrente não pôde participar em nenhuma das reuniões relativas aos três processos contra ela, uma vez que a lei não permitia ao Supremo Tribunal de Justiça realizar audiências públicas sobre o caso. A recorrente não pôde apresentar seus argumentos oralmente, seja em questões de fato e punição ou em várias questões de direito. Além disso, o Supremo Tribunal de Justiça não ouviu as testemunhas, embora a questão fosse colocada não só sobre a confiança do recorrente, mas também sobre as principais testemunhas. Sob tais circunstâncias, a implementação do SCM de seus poderes discricionários não tinha base factual relevante.

 

(iii) Processos no Supremo Tribunal de Justiça (julgamento). (alfa) Questões sujeitas a controle judicial. Em primeiro lugar, nas suas queixas ao Supremo Tribunal, a recorrente contestou sistematicamente os actos que lhe são imputados pelo Supremo Tribunal de Justiça. Em segundo lugar, sanções disciplinares foram impostas a ela com base na conclusão de que ela não havia cumprido seus deveres profissionais como juíza. Assim, a qualificação da conduta profissional do solicitante era de fundamental importância. Em terceiro lugar, na medida em que a recorrente se queixou de que as sanções que lhe foram impostas durante cada um dos processos eram desproporcionadas, o tribunal só podia ser considerado como tendo competência plena se tivesse autoridade para avaliar a proporcionalidade entre a ofensa e a penalidade imposta.

 

No contexto específico do processo disciplinar, questões de fato, bem como questões de direito, foram cruciais para o resultado do processo de “direitos e obrigações civis”. A averiguação é ainda mais importante quando se trata de processos que envolvem a imposição de sanções, em particular acções disciplinares contra juízes, que devem ser respeitados para exercer a sua autoridade de forma a assegurar a confiança do público no funcionamento e independência do poder judiciário. . No presente caso, as circunstâncias factuais foram decisivas no processo relativo à recorrente, não sendo de importância secundária em comparação com as questões abordadas pelos poderes discricionários da administração. O estabelecimento dos fatos do caso causou disputas entre membros do Supremo Conselho do Supremo Tribunal Federal, e esses fatos foram chamados de "decisivos". Os atos que foram atribuídos ao requerente poderiam ter resultado na sua demissão temporária ou final, isto é, em multas muito severas, que são de natureza depreciativa e poderiam levar a consequências irreversíveis para a vida e carreira do requerente. De facto, levaram à nomeação de uma sanção disciplinar sob a forma de 240 dias de suspensão do mandato, embora na prática esta suspensão durasse apenas 100 dias.

 

(beta) revisão judicial. A Seção de Litígios do Supremo Tribunal Federal indicou claramente que não tinha jurisdição plena no campo relevante, mas foi autorizada a verificar apenas a legalidade das decisões contestadas.

 

Considerando as limitações que a legislação portuguesa e sua própria jurisprudência impõem a ela, a CAS não foi autorizada a considerar assuntos cruciais para o caso. O SSS só podia "considerar contradições, inconsistências, bem como evidências insuficientes e erros óbvios em sua avaliação, na medida em que essas falhas eram óbvias". Na prática jurisprudencial do SSSS, “erros óbvios” foram definidos como “erros que não são apenas sérios (grosseiros, pois obviamente contradizem a razão e o senso comum ou são pouco confiáveis, ou demonstram conhecimento mal definido), mas também óbvios (óbvios)”.

 

Os processos controversos não tratavam apenas de aspectos legais que tinham conseqüências limitadas ou problemas técnicos complexos que poderiam ser resolvidos adequadamente com base nos materiais do caso. Pelo contrário, as denúncias apresentadas pelo requerente suscitaram importantes questões de direito e de fato. Mesmo que o Supremo Tribunal considerasse que a sua tarefa não era examinar provas, deveria, no entanto, ter verificado se a base de provas das decisões relativas ao MCP era suficiente para fundamentar as conclusões deste último no caso. A disputa sobre os fatos e as conseqüências das ações disciplinares para a reputação do solicitante exigiu que o SVSS exercesse controles suficientemente avançados que permitissem considerar questões relativas à credibilidade das declarações do solicitante e das testemunhas. Evidentemente, o processo disciplinar em sessão judicial fechada com o consentimento da pessoa em causa não contradiz a Convenção. No entanto, a recorrente exigiu uma audiência oral sobre o seu caso, e ela deveria ter tido a oportunidade de obter o consentimento da autoridade investida de plena jurisdição. Tal audiência contraditória permitiria provas orais das partes e investigaria mais profundamente os fatos do caso.

 

(gama) Poder de tomada de decisão. A jurisprudência da Seção de Litígios do Supremo Tribunal Federal não lhe permitiu substituir sua própria avaliação da autoridade disciplinar. Ao mesmo tempo, a União Soviética tinha o direito de cancelar a decisão, no todo ou em parte, no caso de um “erro grosseiramente óbvio”, inclusive se fosse estabelecido que a lei substantiva ou os requisitos processuais de igualdade das partes foram violados durante o processo que terminou em uma decisão controversa. O SSS poderia, portanto, devolver o caso ao Supremo Tribunal de Justiça para reconsideração, sob o qual era necessário levar em conta as instruções que o SSS poderia fazer sobre violações que ele poderia estabelecer.

 

(delta) Motivação das decisões do Supremo Tribunal. Ao tomar decisões no âmbito das suas competências, definidas na legislação do país e na jurisprudência do Supremo Tribunal, o SVSS indicou suficientemente os fundamentos de tais decisões, respondendo a todos os argumentos do recorrente. No entanto, a ausência de uma reunião oral, justificada pela natureza limitada dos poderes da CSCU, em que questões fundamentais de fato seriam consideradas, não permitiu que o CSC incluísse considerações sobre a avaliação dessas questões na motivação das decisões.

 

(iv) Conclusão. Considerando, em particular, o contexto específico do processo disciplinar em relação ao juiz, a gravidade da punição, o fato de que as garantias processuais no processo perante o Supremo Tribunal de Justiça foram limitadas, a necessidade de avaliar os fatos relativos à credibilidade do queixoso e das testemunhas e que foram as informações-chave, uma combinação de dois elementos, nomeadamente, a falta de controlo judicial por parte da SCSS e a falta de audição oral tanto na fase do processo disciplinar como na fase de controlo judicial, levaram a do caso do requerente não tinham sido examinados em conformidade com os requisitos do artigo 6 § 1 da Convenção.

 


RESOLUÇÃO

 


O caso foi uma violação do Artigo 6 da Convenção (adotado por unanimidade).

 


PAGAMENTO

 


Em aplicação do artigo 41 da Convenção. O Tribunal Europeu rejeitou o pedido de danos pecuniários.

In 2013, the applicant was assisted in the preparation of applications. Subsequently, the applications were merged and communicated to Portugal.

 

The case successfully examined the application of the applicant, who was a judge, about the violation of her rights to the case by an independent and impartial court due to the duality of the functions of the chairperson of the Supreme Court, who was also the chairperson of the High Council of the Magistracy, about the review of the facts of the case established by the High Council of the Magistracy, as well as the right to oral hearing. The case has violated the requirements of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 


THE CIRCUMSTANCES OF THE CASE

 


In respect of the applicant, who during the period related to the circumstances of the case, was a judge, three disciplinary proceedings were instituted. She was brought to disciplinary responsibility by the Superior Council of Magistrates (hereinafter - SCM), and she was sentenced to a fine and two temporary suspension from office.

 

The complainant’s demands for a review of the case and a new finding of facts were rejected. The Section of the Supreme Court on Disputes (hereinafter referred to as the SSIA) upheld the decisions of the Supreme Court of Justice on the basis of, inter alia, that the authority of the SSCC did not include a new fact-finding, but only a supervision over the reasonableness of an assessment of the facts.

 

Within the framework of sentencing, the Supreme Council of Justice unified all penalties imposed on the applicant and assigned her a single sentence of 240 days temporary suspension from office.

 

During the proceedings before the European Court, the applicant claimed that her right to a case was violated by an independent and impartial court, to review the facts of the case established by the Supreme Council of Justice, as well as to an oral hearing. On 21 June 2016, the Chamber of the European Court unanimously decided that in the present case there had been a violation of Article 6 of the Convention. On October 17, 2016, at the request of the Portuguese authorities, the case was referred for review to the Grand Chamber of the European Court.

 


QUESTIONS OF RIGHT

 


Regarding compliance with paragraph 1 of Article 6 of the Convention. (1) Applicability. Article 6 of the Convention is applicable in its civil aspect. As for its criminal law aspect, the provisions of the administrative legislation applied in the course of the disputed proceedings related to those regulating the bringing of judges to disciplinary responsibility. These provisions, which allowed the imposition of punishments, applied to a certain category of judges, and not to the general public. The case was reviewed by a management and disciplinary body, the Supreme Council of Arbitration. Under these conditions, the offenses for which the applicant was accused were of an exclusively disciplinary nature. Finally, all types of punishment that could be imposed on the applicant were purely disciplinary. The severity of the punishment applied to it, namely, a large fine, which has the character of a punitive measure, is not sufficient to attribute controversial offenses to the criminal law field. Thus, the disciplinary proceedings against the applicant did not constitute criminal proceedings against her within the meaning of Article 6 of the Convention. Consequently, the criminal law aspect of this Article of the Convention is not applicable in the present case. Accordingly, the complainant’s complaints of a violation of Article 6 § 3 of the Convention are incompatible with the provisions of the Convention ratione materiae.

 

(2) The merits of the complaint. (a) Independence and impartiality of the Dispute Section of the Supreme Court. (i) The duality of the functions of the Chief Justice of the Supreme Court. The applicant's complaint concerned, among other things, the fact that the President of the Supreme Court was also the President of the Supreme Court of Justice.

 

The composition of the SBC was determined by the Statute of Judges (Statut des magistrats du siège) on the basis of objective criteria, such as the length of service as a judge and the judges belonging to a particular section, and the President of the Supreme Court was not a member of the SSC ad hoc. In practice, the official appointment of members of the SSCU was carried out by the Deputy Chairman of the Supreme Court with the most length of service in this position.

 

In addition, the applicant did not allege that the judges of the SVSS acted according to instructions or under the influence of the Chief Justice of the Supreme Court or that they otherwise showed a lack of impartiality. In particular, it was not established that these judges were appointed specifically to deal with the applicant's case. In the present case, there is no information to establish that the applicant's complaint was justified by objectively justified concerns.

 

Thus, the duality of the functions of the Chief Justice of the Supreme Court cannot call into question the independence and objective impartiality of this court instance.

 

(ii) The role of the SCM in the career of judges of the Supreme Court and disciplinary proceedings against judges. In contrast to the case of “Alexander Volkov v. Ukraine” (Oleksandr Volkov v. Ukraine) (Decree of January 9, 2013, complaint No. 21722/11), within the HMC of Portugal there were no serious structural weaknesses or signs of interest of HMS members in the outcome the proceedings.

 

The independence of judges is guaranteed in Portugal by both the Constitution and other provisions of the country's legislation, and the Constitutional Court of Portugal has several times recognized the mechanism corresponding to the Constitution, during which complaints by the Supreme Court of Justice are considered by the Dispute Section of the Supreme Court.

 

However, the fact that the judges obeyed the law in general and the rules in the field of discipline and professional ethics, in particular, did not allow to question their impartiality. The judges of the Supreme Court were highly qualified specialists and, as a rule, were at the final stage of their careers, they no longer passed the attestation and did not seek promotion, and the disciplinary authority of the Supreme Court of Justice in relation to them was more theoretical. Thus, the case did not contain any specific information that would indicate the lack of impartiality of the judges. Consequently, the fact that the judges who considered the case themselves were subject to the disciplinary regime and could themselves at one time or another find themselves in the position of one of the parties to the case was not sufficient to reach a violation of the requirements of impartiality.

 

In this regard, taking into account all the specific circumstances of the present case, as well as the guarantees aimed at protecting the CAS from external influences, the Court considers that the applicants' statements could not be regarded as objectively substantiated and that the system of supervision of the decisions of the Supreme Court of Justice on disciplinary proceedings namely, the mechanism for applying to the Section of the Supreme Court on disputes did not contradict the independence and impartiality that are required in accordance with paragraph 1 of Article 6 of the Convention.

 


RESOLUTION

 


The case did not violate the requirements of Article 6 of the Convention (taken by 11 votes "for" with six - "against").

 

(b) Supervision of the Disputes Section of the Supreme Court and the absence of an oral hearing in the case. (i) The subject matter of the decisions of the SCM. The subject matter in the present case was whether the applicant fulfilled her professional duties. In resolving this issue, the Supreme Council of Labor was to exercise its discretionary powers. This body, created specifically to interpret and apply the rules governing the conduct of judges in the disciplinary field, was designed to promote the proper administration of justice. However, in the present case, the assessment of the facts and the supervision of the disciplinary sanctions imposed did not necessarily require special knowledge or special professional experience. These questions could fall within the remit of any judicial authority. In this case, it was not a matter of the classical exercise of discretionary administrative powers in a particular legal sphere.

 

The decisions of the Supreme Court of Justice were the subject of an administrative appeal to the Dispute Section of the Supreme Court. The supervision of the decisions on the imposition of a disciplinary sanction differed from the supervision of administrative decisions that did not contain such a punitive aspect. In addition, in the present case, a disciplinary dispute concerned a judge. Judicial control had to be adapted to the subject of the dispute, that is, to the disciplinary nature of the disputed administrative decisions, a fortiori in the disciplinary proceedings directed against the judge.

 

(ii) Proceedings at the Supreme Court of Justice (disciplinary aspect). During the proceedings, the applicant was able to present her arguments in her defense. However, the proceedings were written, despite the fact that the applicant could be given a very serious punishment. The applicant could not take part in any of the meetings concerning the three proceedings against her, since the law did not allow the Supreme Court of Justice to hold open hearings on the case. The applicant was not able to present her arguments orally, whether on issues of fact and punishment or on various issues of law. In addition, the Supreme Court of Justice did not hear the witnesses, although the question was put not only on the applicant’s confidence, but also on the key witnesses. Under such circumstances, the implementation of the SCM of its discretionary powers had no relevant factual basis.

 

(iii) Proceedings at the Supreme Court of Justice (trial). (alpha) Issues subject to judicial control. Firstly, in her complaints to the Supreme Court, the applicant systematically challenged the acts imputed to her by the Supreme Court of Justice. Secondly, disciplinary sanctions were imposed on her on the basis of the conclusion that she had not fulfilled her professional duties as a judge. Thus, the qualification of the applicant’s professional conduct was of key importance. Thirdly, to the extent that the applicant complained that the penalties imposed on her during each of the proceedings were disproportionate, the court could be considered as having full jurisdiction only if she had the authority to assess the proportionality between the offense and the punishment imposed.

 

In the specific context of disciplinary proceedings, questions of fact, as well as questions of law, were crucial to the outcome of the “civil rights and obligations” process. Fact-finding is all the more important when it comes to proceedings involving the imposition of punishment, in particular disciplinary action against judges, who must be respected in order to exercise their authority in such a way as to ensure public confidence in the functioning and independence of the judiciary . In the present case, the factual circumstances were decisive in the proceedings concerning the applicant, they were not of secondary importance in comparison with the issues that were addressed by the administration’s discretionary powers. The establishment of the facts of the case caused disputes between members of the Supreme Council of the Supreme Court, and these facts were called "decisive". The acts that were attributed to the applicant could have resulted in her temporary or final dismissal, that is, to very severe penalties, which are derogatory in nature and could lead to irreversible consequences for the life and career of the applicant. In fact, they led to the appointment of a disciplinary sanction in the form of 240 days of suspension from office, although in practice this suspension lasted only 100 days.

 

(beta) Judicial review. The Dispute Section of the Supreme Court clearly indicated that it did not have full jurisdiction in the relevant field, but was authorized to verify only the legality of the disputed decisions.

 

Considering the limitations that Portuguese legislation and its own case law impose on it, the CAS was not authorized to consider matters that were crucial to the case. The SSS could only "consider contradictions, inconsistencies, as well as insufficient evidence and obvious errors in their assessment to the extent that these flaws were obvious." In case-law practice of the SSSS, “obvious mistakes” were defined as “mistakes that are not only serious (gross, since they obviously contradict reason and common sense or are unreliable, or demonstrate poorly defined knowledge), but also obvious (obvious)”.

 

The controversial processes did not deal solely with legal aspects that had limited consequences or complex technical issues that could be properly resolved on the basis of the case materials. On the contrary, the complaints lodged by the applicant raised important issues of law and fact. Even if the Supreme Court considered that its task was not to examine evidence, it nevertheless should have checked whether the evidence base of the SCM decisions was sufficient to substantiate the latter’s findings in the case. The dispute about the facts and the consequences of disciplinary actions for the applicant's reputation demanded that the SVSS should exercise sufficiently advanced controls that would allow to consider questions concerning the credibility of the statements of the applicant and witnesses. Of course, the disciplinary proceedings in a closed court session with the consent of the person concerned did not contradict the Convention. However, the applicant demanded an oral hearing on her case, and she should have had the opportunity to obtain consent from the authority vested with full jurisdiction. Such an adversarial hearing would allow oral evidence from the parties and more thoroughly investigate the facts of the case.

 

(gamma) Authority to make decisions. The case law of the Dispute Section of the Supreme Court did not allow it to substitute its own assessment of the disciplinary authority. At the same time, the Soviet Union had the right to cancel the decision in whole or in part in the case of a “grossly obvious mistake”, including if it was established that the substantive law or the procedural requirements of equality of the parties were violated during the process that ended in a controversial decision. The SSS could, therefore, return the case to the Supreme Court of Justice for reconsideration, under which it was necessary to take into account the instructions that the SSS could make regarding violations that it could establish.

 

(delta) Motivation of Supreme Court decisions. When making decisions within the framework of its powers, defined in the legislation of the country and the case-law of the Supreme Court, the SVSS sufficiently indicated the grounds for such decisions, responding to all the applicant's arguments. However, the absence of an oral meeting, justified by the limited nature of the CSCU powers, in which key issues of fact would be considered, did not allow the CSC to include considerations regarding the assessment of these issues in the motivation of the decisions.

 

(iv) Conclusion. Considering, in particular, the specific context of the disciplinary process in relation to the judge, the severity of the punishment, the fact that the procedural guarantees in the proceedings before the Supreme Court of Justice were limited, the need to assess the facts concerning the credibility of the complainant and the witnesses and that were key information, a combination of two elements, namely, the lack of judicial control on the part of the SCSS and the lack of an oral hearing both at the stage of disciplinary proceedings and at the stage of judicial control, led to of the applicant's case had not been examined in accordance with the requirements of Article 6 § 1 of the Convention.

In application of Article 41 of the Convention. The European Court rejected the claim for pecuniary damage.
