Постановление ЕСПЧ от 29 января 2019 года по делу "Алимурадов против Российской Федерации (Alimuradov v. Russia)" (жалоба N 23019/15).

По делу успешно рассмотрена жалоба заявителя на бесчеловечные условия его содержания под стражей в специальном учреждении временного содержания иностранных граждан в ожидании административного выдворения, а также на то, что власти Российской Федерации не провели надлежащим образом разбирательство по делу о его высылке в иностранного государство с того момента, когда узнали, что его высылка была невозможна в связи с отсутствием у заявителя гражданства иностранного государства. По делу допущено нарушение требований статьи 3, пунктов 1 и 4 статьи 5 Конвенции о защите прав человека и основных свобод.

В 2015 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

В своей жалобе Заявитель жаловался на бесчеловечные условия его содержания под стражей в специальном учреждении временного содержания иностранных граждан в ожидании административного выдворения, а также на то, что власти Российской Федерации не провели надлежащим образом разбирательство по делу о его высылке в Азербайджан с того момента, когда узнали, что его высылка была невозможна в связи с отсутствием у заявителя гражданства Азербайджана.

29 января 2019 года, по жалобе поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 3 Конвенции (запрещение пыток), пунктов 1 и 4 статьи 5 Конвенции (право на свободу и личную неприкосновенность), и обязал власти государства-ответчика выплатить представителю заявителя 15 000 евро в качестве компенсации морального вреда.

The ECtHR judgment of January 29, 2019 in the case of Alimuradov v. Russia (Alimuradov v. Russia) (application No. 23019/15).
The case has successfully examined the applicant’s application about the inhuman conditions of his detention in a special institution for temporary detention of foreign citizens pending administrative expulsion, as well as the fact that the authorities of the Russian Federation did not conduct proper proceedings on the case of his expulsion to a foreign state from that moment when they learned that his expulsion was impossible due to the applicant’s lack of citizenship of a foreign state. The case has violated the requirements of Article 3, paragraphs 1 and 4 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2015, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

On January 29, 2019, on a application filed by the applicant, the European Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 3 of the Convention (prohibition of torture), paragraphs 1 and 4 of Article 5 of the Convention (right to liberty and security of person), and ordered The respondent Government have to pay the representative of the applicant EUR 15,000 in respect of non-pecuniary damage.

По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявитель с 1948 года был активным борцом за мир. В 2005 году он начал участвовать в демонстрациях, организованных агрессивной протестной группой и проводившихся в присутствии значительного количества сотрудников полиции. Заявитель никогда не привлекался к ответственности за какое-либо правонарушение, и риск совершения им насильственных преступлений был абстрактным.

 

В судах Соединенного Королевства заявитель требовал удаления информации о себе из базы данных полиции, известной как "База данных по экстремизму". Данные, содержавшиеся в базе, включали имя заявителя, его адрес, дату рождения и сведения о его участии в демонстрациях. Большинство сведений было связано с демонстрациями, организованными агрессивной протестной группой, но также в них содержалась информация о его участии в иных политических и профсоюзных мероприятиях.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции. В отношении вопроса о том, была ли насущная необходимость собирать личные данные заявителя, Европейский Суд признал, что да. Эти сведения были получены открыто. Сам характер такого сбора данных предполагал, что полиция с начала собирает информацию, а уже затем оценивает ее ценность. У сотрудников полиции была очевидная роль наблюдателей за протестами, когда было известно, что деятельность организационной группы имела насильственный и потенциально преступный характер. Соответственно, даже если самого заявителя не подозревали в прямом участии в преступной деятельности группы, для полиции было вполне обоснованным собирать его личные данные. В итоге он сам решил неоднократно и публично присоединиться к деятельности данной протестной группы.

 

Что касается того, имелась ли насущная необходимость хранения данных заявителя, Европейский Суд счел, что такая необходимость отсутствовала. В условиях отсутствия каких-либо правил, определяющих максимальный срок хранения подобных сведений, заявитель полностью зависел от тщательного применения в высшей степени гибких гарантий, закрепленных в соответствующем кодексе практики, для обеспечения соразмерности хранения его данных. Если государство принимает решение о создании такой системы, необходимость эффективных процессуальных гарантий становится решающей. Эти гарантии должны обеспечивать удаление подобной информации, как только ее продолжающееся хранение становится несоразмерным.

 

Что касается информации о заявителе, то существовала возможность того, что она могла храниться в течение неопределенного периода. Хотя заявитель имел и использовал возможность потребовать раскрытия и уничтожения своих данных, такая гарантия, по-видимому, имела ограниченное действие, учитывая факт получения им отказа в удалении его данных или предоставления какого-либо объяснения их продолжавшегося хранения. Отсутствие эффективных гарантий вызвало особую озабоченность в деле заявителя, поскольку хранившаяся в базе данных информация касалась его политических взглядов, которые требовали повышенного уровня защиты. Участие в мирных протестах подлежало специальной защите в рамках статьи 11 Конвенции, как и профсоюзов, в мероприятиях которых заявитель также участвовал.

 

Определение "внутригосударственный экстремизм" в контексте "Базы данных по экстремизму", озвученное в ходе производства дела в судах Соединенного Королевства, ссылалось на сбор сведений о группах и лицах, которые действовали "за пределами демократического процесса". Таким образом, из материалов дела не следовало, что сотрудники полиции соблюдали свое собственное определение экстремизма при хранении данных о связи заявителя с мирными политическими мероприятиями.

 

В отношении хранения данных заявителя, в частности, касавшихся мирного протеста, не было доказано ни то, что оно было абсолютно необходимым, ни то, что оно было необходимым для целей конкретного расследования.

 

Европейский Суд не был убежден в том, что удаление данных было бы настолько обременительным, что быть неразумным. Создание базы данных таким образом, чтобы содержащиеся в ней сведения не могли быть легко пересмотрены или изменены, и затем использование этого обстоятельства в качестве оправдания для отказа удаления информации из базы данных полностью противоречило бы необходимости защиты личной жизни, предоставленной статьей 8 Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Заявитель не представил требований о выплате компенсации, поэтому Европейский Суд не присудил ему каких-либо сумм по данному основанию.

ECHR judgment of 24 January 2019 in the case of Catt v. The United Kingdom (аpplication No. 43514/15).

 

In 2015, the applicant was assisted in preparing the аpplication. Subsequently, the аpplication was communicated to the United Kingdom.

 

In the case, the applicant’s complaint regarding the inclusion of information about him in the database of law enforcement agencies, including personal data and information related to the applicant’s participation in demonstrations organized by the aggressive protest group, as well as other political and trade union events, was successfully considered. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 


Circumstances of the case

 


The applicant has been an active peace activist since 1948. In 2005, he began participating in demonstrations organized by an aggressive protest group and held in the presence of a significant number of police officers. The applicant was never held accountable for any offense, and the risk of committing violent crimes was abstract.

 

In the courts of the United Kingdom, the applicant requested the removal of information about himself from the police database, known as the “Extremism Database”. The data contained in the database included the name of the applicant, his address, date of birth and information about his participation in the demonstrations. Most of the information was related to demonstrations organized by an aggressive protest group, but they also contained information about his participation in other political and trade union events.

 


QUESTIONS OF LAW

 


Regarding compliance with article 8 of the Convention. As regards the issue of whether there was an urgent need to collect the applicant’s personal data, the Court acknowledged that yes. This information was obtained openly. The very nature of this data collection suggested that the police collect information from the beginning, and only then assess its value. Police officers had an obvious role as observers for protests when it was known that the activities of the organizing group were violent and potentially criminal. Accordingly, even if the applicant himself was not suspected of being directly involved in the criminal activities of the group, it was quite reasonable for the police to collect his personal data. As a result, he himself decided to repeatedly and publicly join the activities of this protest group.

 

As to whether there was an urgent need to store the applicant's data, the Court considers that there was no such need. In the absence of any rules determining the maximum period of storage of such information, the applicant was completely dependent on the careful application of the highly flexible guarantees enshrined in the relevant code of practice to ensure the proportionality of the storage of his data. If the state decides to create such a system, the need for effective procedural guarantees becomes crucial. These safeguards should ensure the removal of such information as soon as its continued storage becomes disproportionate.

 

As regards the information about the applicant, there was a possibility that it could be stored for an indefinite period. Although the applicant had and used the opportunity to demand the disclosure and destruction of his data, such a guarantee, apparently, had a limited effect, given the fact that he received a refusal to delete his data or any explanation of their continued storage. The lack of effective guarantees was of particular concern to the applicant, as the information stored in the database concerned his political views, which required a higher level of protection. Participation in peaceful protests was subject to special protection under Article 11 of the Convention, as well as the trade unions in which the applicant also participated.

 

The definition of “domestic extremism” in the context of the “Database of Extremism”, voiced during the proceedings in the courts of the United Kingdom, referred to the collection of information about groups and individuals who acted “outside the democratic process”. Thus, it did not follow from the case file that the police officers complied with their own definition of extremism when storing data on the applicant’s connection with peaceful political events.

 

As regards the storage of the applicant’s data, in particular regarding the peaceful protest, it was neither proved that it was absolutely necessary, nor that it was necessary for the purposes of a specific investigation.

 

The Court was not convinced that data deletion would be so burdensome as to be unreasonable. Creating a database in such a way that the information contained in it could not be easily reviewed or changed, and then using this circumstance as an excuse for refusing to delete information from the database would be completely contrary to the need to protect the privacy provided by Article 8 of the Convention.

 


RESOLUTION

 


In the case there was a violation of the requirements of Article 8 of the Convention (adopted unanimously).

 


COMPENSATION

 


In application of Article 41 of the Convention. The applicant did not submit a claim for compensation, therefore the Court did not award him any amounts under this head.

По делу успешно рассмотрена жалоба на отсутствие расследования по жалобе на жестокое обращение со стороны сотрудников полиции во время допроса лица, находившегося в состоянии шока. По делу было допущено нарушение требований статьи 3, пункта 1 статьи 6 и подпункта "c" пункта 3 статьи 6 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В период, относившийся к обстоятельствам настоящего дела, заявительница, студентка из США, которой тогда было 20 лет, находилась в Италии в течение около двух месяцев. Она нашла временную работу в пабе, менеджером которого был D.L. После обнаружения тела соседки заявительницы по квартире, когда заявительница и ее друг находились там, последние были допрошены, и их разговоры стали прослушиваться.

 

6 ноября 2007 г., в 1.45, заявительницу допросили в присутствии трех сотрудников полиции и A.D., выполнявшей функции переводчицы. Заявительница сказала, помимо прочего, что лицом, совершившим преступление, был D.L. Затем прокурор допросил заявительницу в 5.45 в присутствии A.D. и некоторых сотрудников полиции. Заявительнице не был предоставлен защитник. В 8.30 заявительница, ее друг и D.L. были задержаны по подозрению в совершении сексуального насилия и убийстве. D.L., доказавший свое алиби, был освобожден.

 

К 13.00 и впоследствии в ходе производства по делу заявительница утверждала, что она находилась в состоянии шока во время последнего допроса, в ходе которого она дала обвинительные показания под давлением сотрудников полиции, и снова высказала обвинения в отношении D.L. Однако 14 мая 2008 г. ее признали подозреваемой по делу о клевете на D.L.

 

После судебного заседания 13 марта 2009 г., в ходе которого заявительница вновь описала, как с ней обращались во время допросов 6 ноября 2007 г., и жаловалась на действия переводчицы A.D., защитник заявительницы потребовал передачи дела в прокуратуру, однако безрезультатно. Против заявительницы также было возбуждено дело о клевете в отношении сотрудников полиции и прокурора, допрашивавших ее 6 ноября 2007 г.

 

В сентябре 2015 года кассационный суд оправдал заявительницу в отношении обвинений в убийстве и сексуальном насилии и отметил, что назначение заявительнице наказания в виде трех лет лишения свободы за клевету в отношении D.L. уже получило преюдициальную силу. В процессе о клевете в отношении сотрудников полиции и прокурора заявительница также была оправдана.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 3 Конвенции (процессуально-правовой аспект). После выдвижения обвинений в адрес D.L. 6 ноября 2007 г. и в ходе всего последующего производства по делу заявительница утверждала, что в тот момент она находилась в состоянии шока и чрезвычайного волнения и что сотрудники полиции оказывали на нее давление. 3 октября 2011 г. апелляционный суд счел, что заявительница действительно испытывала страдания, повлекшие за собой возникновение невыносимой психологической ситуации, и для того, чтобы выйти из нее, заявительница высказала обвинения против D.L.

 

Кроме того, переводчица A.D. также действовала в качестве медиатора, что абсолютно не требовалось с учетом ее функций. К тому же один из сотрудников полиции обнял заявительницу, гладил ее, брал ее за руки и, таким образом, вел себя неподобающим образом в то время, когда заявительница озвучивала обвинения, впоследствии расцененные как клеветнические и приведшие к ее осуждению.

 

На подобное поведение, из которого можно сделать вывод об общем контексте, в котором проходил допрос заявительницы, необходимо было обратить внимание властей в связи с возможным нарушением уважения достоинства заявительницы и ее дееспособности.

 

Несмотря на неоднократные жалобы заявительницы в отношении унижающего достоинство обращения, на которое она жаловалась, не было проведено расследования, способного прояснить факты и обстоятельства ее дела. В частности, требование о передаче материалов дела в прокуратуру, поданное защитой 13 марта 2009 г., осталось без ответа. Кроме того, уголовный процесс, инициированный заявительницей о клевете в отношении властей, в результате которого заявительница была оправдана, поскольку ничто не доказывало, что ее утверждения могли не соответствовать реальным фактам, не мог считаться эффективным расследованием по жалобе заявительницы.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 3 Конвенции (принято единогласно).

 

По поводу соблюдения пункта 1 статьи 6 и подпункта "c" пункта 3 статьи 6 Конвенции. (a) Применимость статьи 6 Конвенции. Европейский Суд напоминает, что "уголовное обвинение" имеет место, когда лицо официально привлечено в качестве подозреваемого компетентными властями или когда действия последних, вызванные подозрениями в отношении этого лица, имеют для него важные последствия. Заявительница могла считаться подозреваемой не позднее момента дачи показаний 6 ноября 2007 г., в 5.45, прокурору республики. Следовательно, не позднее 5.45 в отношении заявительницы было выдвинуто "уголовное обвинение" по смыслу Конвенции.

 

(b) Наличие насущной необходимости, способной оправдать ограничение права на доступ к адвокату. Власти Италии указывали на тот факт, что согласно существующей в стране судебной практике спорные показания от 6 ноября 2007 г. могли быть использованы в отсутствие адвоката в той мере, в которой они сами по себе содержали состав преступления. Однако Европейский Суд отмечает, что судебная практика, на которую ссылались власти Италии, носит общий характер и что последние не доказали наличие исключительных обстоятельств, которые оправдывали бы ограничения права заявительницы. Таким образом, отсутствовала насущная необходимость, оправдывающая ограничение права заявительницы на помощь адвоката.

 

(c) Справедливость судебного разбирательства в целом. Через несколько часов после допросов 6 ноября 2007 г. заявительница, являвшаяся уязвимым лицом в силу своего статуса иностранной гражданки 20-летнего возраста, находившейся в Италии в течение непродолжительного времени и не говорившей свободно по-итальянски, отказалась от своих показаний. Однако через шесть месяцев, 14 мая 2008 г., она была привлечена в качестве подозреваемой по делу о клевете.

 

Спорные показания были получены в результате сильного психологического давления, обстоятельства которого не были выяснены в ходе расследования. Данные показания сами по себе представляли преступление, в котором обвинялась заявительница, и, следовательно, материальное доказательство для вынесения ей обвинительного приговора по делу о клевете. Наконец, протокол допроса заявительницы, состоявшегося в 5.45, не содержит отметки о том, что она была уведомлена о своих процессуальных правах.

 

Таким образом, ограничение права заявительницы на юридическую помощь в ходе допроса 6 ноября 2007 г., в 5.45, необратимым образом нарушило справедливость судебного разбирательства в целом.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований пункта 1 статьи 6 и подпункта "c" пункта 3 статьи 6 Конвенции (принято единогласно).

 

По поводу соблюдения пункта 1 статьи 6 и подпункта "e" пункта 3 статьи 6 Конвенции. Роль медиатора, которую играла переводчица A.D. в то время, когда заявительница, обвинявшаяся в преступлении, излагала свою версию событий, выходила за рамки функций переводчицы, которые A.D. должна была выполнять. Однако власти не дали оценки поведению A.D. и не установили, выполнялись ли ею функции переводчицы в соответствии с гарантиями, предусмотренными в пункте 1 статьи 6 и подпункте "e" пункта 3 статьи 6 Конвенции, и не рассмотрели вопрос о том, имели ли действия A.D. последствия для исхода процесса по делу заявительницы. Кроме того, в протоколе допроса от 6 ноября 2007 г. отсутствуют сведения о взаимодействии заявительницы и A.D. в ходе этого процессуального действия.

 

Данный изначальный недостаток, таким образом, имел последствия для других прав, которые, хотя и были отличными от того, на нарушение которого жаловалась заявительница, тесно связаны с ним, и нарушил справедливость судебного процесса в целом.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований пункта 1 статьи 6 и подпункта "e" пункта 3 статьи 6 Конвенции (принято единогласно).

 

Европейский Суд также пришел к выводу, что не было допущено нарушения требований статьи 3 Конвенции в ее материально-правовом аспекте ввиду отсутствия сведений, которые позволили бы заключить, что в отношении заявительницы было допущено бесчеловечное или унижающее достоинство обращение.

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявительнице 10 400 евро в качестве компенсации морального вреда.

Sentenza della Corte EDU del 24 gennaio 2019 nella causa Knox contro Italia (reclami n. 76577/13).

 

Nel 2013 il richiedente è stato assistito nella preparazione del reclamo. Successivamente, la reclami è stata comunicata dall'Italia.

 

Nel caso, la denuncia è stata considerata con successo che non vi sono state indagini sulla denuncia di maltrattamenti da parte della polizia durante l'interrogatorio di una persona in stato di shock. Vi è stata una violazione dei requisiti di cui all'articolo 3, paragrafo 1 dell'articolo 6 e alla lettera "c" del paragrafo 3 dell'articolo 6 della Convenzione per la protezione dei diritti dell'uomo e delle libertà fondamentali.

 


Circostanze

 


Nel periodo rilevante per le circostanze della presente causa, il richiedente, uno studente degli Stati Uniti che aveva allora 20 anni, era stato in Italia per circa due mesi. Ha trovato un lavoro temporaneo in un pub gestito da D.L. Dopo la scoperta del corpo del vicino del richiedente nell'appartamento, quando il richiedente e la sua amica erano lì, quest'ultimo fu interrogato e le loro conversazioni furono intercettate.

 

Il 6 novembre 2007, alle 1.45, il richiedente fu interrogato alla presenza di tre agenti di polizia e A.D., che servirono da interprete. Il richiedente disse, tra l'altro, che l'autore del reato era D.L. Il pubblico ministero ha quindi interrogato il richiedente alle 5.45 in presenza di A.D. e alcuni ufficiali di polizia. Il richiedente non è stato fornito di consulenza. Alle 8.30 la richiedente, la sua amica e D.L. sono stati arrestati per sospetto di violenza sessuale e omicidio. D.L., che ha dimostrato il suo alibi, è stato rilasciato.

 

Entro le 13.00 e successivamente nel corso del procedimento, la ricorrente ha affermato di essere in stato di choc durante l'ultimo interrogatorio, durante il quale ha accusato la polizia di essere accusata e accusata di nuovo D.L. Tuttavia, il 14 maggio 2008, è stata riconosciuta sospetta nel caso di diffamazione nei confronti di D.L.

 

Dopo l'udienza del 13 marzo 2009, durante la quale la ricorrente descrisse nuovamente il modo in cui era stata trattata durante gli interrogatori il 6 novembre 2007 e si lamentò delle azioni del traduttore A.D., l'avvocato della richiedente chiese che il caso fosse trasferito alla procura, ma senza risultato. È stato inoltre aperto un caso di diffamazione nei confronti del ricorrente nei confronti di agenti di polizia e del procuratore che l'ha interrogata il 6 novembre 2007.

 

Nel settembre 2015, la Corte di cassazione ha assolto il richiedente dalle accuse di omicidio e violenza sessuale e ha osservato che il ricorrente è stato condannato a tre anni di carcere per diffamazione di D.L. già ricevuto forza pregiudizievole. Nel procedimento di diffamazione contro la polizia e il pubblico ministero, anche il richiedente fu assolto.

 


DOMANDE DI LEGGE

 


Per quanto riguarda il rispetto dell'articolo 3 della Convenzione (aspetto procedurale). A seguito di accuse contro D.L. Il 6 novembre 2007 e durante tutti i procedimenti successivi nella causa, la richiedente sostenne che a quel tempo era in uno stato di shock e di eccitazione estrema e che la polizia l'aveva messa sotto pressione. Il 3 ottobre 2011 la corte d'appello ha riscontrato che il richiedente aveva effettivamente sofferto angoscia causando una situazione psicologica insopportabile e, al fine di uscirne, il ricorrente aveva accusato D.L.

 

Inoltre, il traduttore A.D. fungeva anche da mediatore, il che non era assolutamente necessario date le sue funzioni. Inoltre, uno degli agenti di polizia ha abbracciato il richiedente, l'ha accarezzata, le ha preso le mani e, quindi, si è comportato in modo inappropriato nel momento in cui il richiedente ha espresso le accuse, che sono state successivamente considerate diffamatorie e hanno portato alla sua condanna.

 

Tale comportamento, dal quale si può trarre una conclusione sul contesto generale in cui il richiedente è stato interrogato, ha dovuto essere portato all'attenzione delle autorità in relazione a una possibile violazione del rispetto della dignità del richiedente e della sua capacità giuridica.

 

Nonostante le ripetute denunce della ricorrente per il trattamento degradante di cui si lamentava, non vi erano indagini in grado di chiarire i fatti e le circostanze del suo caso. In particolare, l'obbligo di trasferire i materiali del caso all'ufficio del procuratore, depositato dalla difesa il 13 marzo 2009, è rimasto senza risposta. Inoltre, i procedimenti penali avviati dal richiedente per diffamazione delle autorità, a seguito dei quali il richiedente è stato assolto, dal momento che non c'erano prove che le sue accuse potrebbero essere incompatibili con fatti reali, non potevano essere considerati un'indagine efficace sul reclamo del richiedente.

 


DECISIONE

 


Il caso conteneva una violazione dell'articolo 3 della Convenzione (adottata all'unanimità).

 

Per quanto riguarda il rispetto dell'articolo 6, paragrafo 1, e dell'articolo 6, paragrafo 3, lettera c), della Convenzione. (a) Applicabilità dell'articolo 6 della Convenzione. La Corte ribadisce che una "accusa penale" ha luogo quando una persona è formalmente perseguita come sospetto dalle autorità competenti o quando le azioni di quest'ultima causate da sospetti di quella persona hanno conseguenze importanti per lui. Il richiedente poteva essere considerato un sospetto entro il momento della testimonianza del 6 novembre 2007, alle 5.45, al procuratore della repubblica. Di conseguenza, entro e non oltre le 5.45 è stata proposta una "accusa penale" nei confronti del richiedente ai sensi della Convenzione.

 

(b) Vi è un'urgente necessità che può giustificare una restrizione al diritto di accesso a un difensore. Il governo italiano ha sottolineato il fatto che, secondo la prassi giudiziaria del paese, le prove controverse del 6 novembre 2007 avrebbero potuto essere utilizzate in assenza di un avvocato nella misura in cui esse stesse contenevano il reato. Tuttavia, la Corte osserva che la pratica giudiziaria invocata dalle autorità italiane è di natura generale e che quest'ultima non ha dimostrato l'esistenza di circostanze eccezionali che giustificherebbero i diritti della ricorrente. Pertanto, non vi era alcuna urgente necessità di giustificare il diritto del richiedente a un avvocato.

 

(c) Equità del processo nel suo insieme. Poche ore dopo gli interrogatori del 6 novembre 2007, la richiedente, che era vulnerabile a causa del suo status di cittadino straniero di 20 anni che era stato in Italia per un breve periodo e non parlava fluentemente italiano, ha rifiutato la sua testimonianza. Tuttavia, sei mesi dopo, il 14 maggio 2008, è stata processata come sospetta nel caso della diffamazione.

 

Prove controverse sono state ottenute a seguito di una forte pressione psicologica, le cui circostanze non sono state chiarite durante l'indagine. La stessa testimonianza costituiva il reato di cui era stata accusata la ricorrente e, quindi, prove materiali per condurla in giudizio per diffamazione. Infine, il verbale dell'interrogazione della ricorrente alle 5.45 non conteneva una nota secondo cui era stata informata dei suoi diritti procedurali.

 

Pertanto, la restrizione al diritto del richiedente all'assistenza legale durante l'interrogatorio del 6 novembre 2007, alle 5.45, ha irreversibilmente violato l'equità del processo nel suo insieme.

 


DECISIONE

 


Nel caso si è verificata una violazione dei requisiti di cui al paragrafo 1 dell'articolo 6 e alla lettera "c" del paragrafo 3 dell'articolo 6 della Convenzione (adottata all'unanimità).

 

Per quanto riguarda il rispetto dell'articolo 6, paragrafo 1, e dell'articolo 6, paragrafo 3, lettera e), della Convenzione. Il ruolo del mediatore svolto dal traduttore d.C. mentre la ricorrente, accusata del crimine, esponeva la sua versione degli eventi, andava oltre le funzioni della traduttrice, che A.D. dovuto esibirsi. Tuttavia, le autorità non hanno valutato A.D. e non ha stabilito se svolgesse le funzioni di un traduttore conformemente alle garanzie di cui all'articolo 6, paragrafo 1, e all'articolo 6, paragrafo 3, lettera e), della Convenzione, e non ha preso in considerazione la possibilità che A.D. le conseguenze per l'esito del caso del richiedente. Inoltre, il rapporto degli interrogatori del 6 novembre 2007 non contiene informazioni sull'interazione del richiedente con A.D. durante questa azione procedurale.

 

Questo difetto iniziale, quindi, ebbe conseguenze per altri diritti che, sebbene fossero diversi dalla violazione di cui si lamentava il richiedente, erano strettamente correlati a lui e violavano l'equità del processo nel suo insieme.

 


DECISIONE

 


Nel caso si è verificata una violazione dei requisiti di cui al paragrafo 1 dell'articolo 6 e alla lettera "e" del paragrafo 3 dell'articolo 6 della Convenzione (adottata all'unanimità).

 

La Corte ha anche concluso che non vi era stata violazione dei requisiti dell'articolo 3 della Convenzione nel suo aspetto sostanziale a causa della mancanza di informazioni che avrebbero permesso di concludere che il richiedente era stato sottoposto a trattamento disumano o degradante.

 


COMPENSAZIONE

 


In applicazione dell'articolo 41 della Convenzione. La Corte assegna al richiedente 10.400 EUR per danni non pecuniari.

ECHR judgment of 24 January 2019 in the Knox v. Italy case (аpplication No. 76577/13).

 

In 2013, the applicant was assisted in preparing the complaint. Subsequently, the complaint was communicated by Italy.

 

In the case, the complaint was successfully considered that there was no investigation into the complaint of ill-treatment by the police during the interrogation of a person in a state of shock. There was a violation of the requirements of Article 3, paragraph 1 of Article 6 and subparagraph “c” of paragraph 3 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 


Circumstances of the case

 


In the period relevant to the circumstances of the present case, the applicant, a student from the USA who was then 20 years old, had been in Italy for about two months. She found a temporary job in a pub run by D.L. After the discovery of the body of the applicant’s neighbor in the apartment, when the applicant and her friend were there, the latter were interrogated and their conversations were tapped.

 

On November 6, 2007, at 1.45, the applicant was questioned in the presence of three police officers and A.D., who served as an interpreter. The applicant said, inter alia, that the offender was D.L. The prosecutor then questioned the applicant at 5.45 in the presence of A.D. and some police officers. The applicant was not provided with counsel. At 8.30 the applicant, her friend and D.L. were detained on suspicion of sexual assault and murder. D.L., who proved his alibi, was released.

 

By 13.00 and subsequently in the course of the proceedings, the applicant alleged that she was in a state of shock during the last interrogation, during which she gave indictments under pressure from the police and again charged her with D.L. However, on May 14, 2008, she was recognized as a suspect in the libel case against D.L.

 

After the hearing on March 13, 2009, during which the applicant again described how she was treated during interrogations on November 6, 2007, and complained about the actions of the translator A.D., the applicant's lawyer requested that the case be transferred to the prosecutor's office, but to no avail. A defamation case was also opened against the applicant against police officers and the prosecutor who questioned her on 6 November 2007.

 

In September 2015, the Court of Cassation acquitted the applicant of the charges of murder and sexual violence and noted that the applicant was sentenced to three years in prison for defamation of D.L. already received prejudicial force. In the defamation proceedings against the police and the prosecutor, the applicant was also acquitted.

 


QUESTIONS OF LAW

 


Regarding compliance with Article 3 of the Convention (procedural aspect). Following charges against D.L. On 6 November 2007 and throughout the subsequent proceedings in the case, the applicant claimed that at that time she was in a state of shock and extreme excitement and that the police had put pressure on her. On 3 October 2011 the appellate court found that the applicant had indeed suffered distress resulting in an unbearable psychological situation, and in order to get out of it, the applicant had charged against D.L.

 

In addition, the translator A.D. also acted as a mediator, which was absolutely not required given its functions. In addition, one of the police officers hugged the applicant, stroked her, took her hands and, therefore, behaved inappropriately at the time when the applicant voiced the charges, which were subsequently regarded as defamatory and led to her conviction.

 

Such behavior, from which one can draw a conclusion about the general context in which the applicant was questioned, had to be brought to the attention of the authorities in connection with a possible violation of respect for the dignity of the applicant and her legal capacity.

 

Despite the applicant's repeated complaints about the degrading treatment she complained about, there was no investigation capable of clarifying the facts and circumstances of her case. In particular, the requirement to transfer the case materials to the prosecutor’s office, filed by the defense on March 13, 2009, remained unanswered. Furthermore, the criminal proceedings initiated by the applicant for defamation of the authorities, as a result of which the applicant was acquitted, since there was no evidence that her allegations could be inconsistent with real facts, could not be considered an effective investigation into the applicant's complaint.

 


RESOLUTION

 


In the case there was a violation of the requirements of Article 3 of the Convention (adopted unanimously).

 

Regarding compliance with paragraph 1 of Article 6 and subparagraph “c” of paragraph 3 of Article 6 of the Convention. (a) Applicability of Article 6 of the Convention. The Court reiterates that a “criminal charge” takes place when a person is formally prosecuted as a suspect by the competent authorities or when the latter’s actions caused by suspicions of that person have important consequences for him. The applicant could be considered a suspect no later than the moment of testifying on 6 November 2007, at 5.45, to the prosecutor of the republic. Consequently, no later than 5.45 a “criminal charge” was brought against the applicant within the meaning of the Convention.

 

(b) There is an urgent need that can justify a restriction on the right to access a lawyer. The Italian Government pointed to the fact that, according to the country's judicial practice, the disputed evidence of 6 November 2007 could have been used in the absence of a lawyer to the extent that they themselves contained the offense. However, the Court observes that the judicial practice relied on by the Italian authorities is of a general nature and that the latter did not prove the existence of exceptional circumstances that would justify the restriction on the applicant's right. Thus, there was no pressing need justifying the applicant’s right to a lawyer.

 

(c) Fairness of the trial as a whole. A few hours after the interrogations on November 6, 2007, the applicant, who was vulnerable due to her status as a foreign citizen of 20 years of age who had been in Italy for a short time and did not speak fluent Italian, refused her testimony. However, six months later, on May 14, 2008, she was prosecuted as a suspect in the libel case.

 

Controversial evidence was obtained as a result of strong psychological pressure, the circumstances of which were not clarified during the investigation. The testimony itself constituted the offense of which the applicant was charged and, therefore, material evidence to convict her of the libel case. Lastly, the record of the applicant’s interrogation at 5.45 did not contain a note that she had been notified of her procedural rights.

 

Thus, the restriction on the applicant’s right to legal assistance during the interrogation on November 6, 2007, at 5.45, irreversibly violated the fairness of the trial as a whole.

 


RESOLUTION

 


In the case there was a violation of the requirements of paragraph 1 of Article 6 and subparagraph "c" of paragraph 3 of Article 6 of the Convention (adopted unanimously).

 

Regarding compliance with paragraph 1 of Article 6 and subparagraph "e" of paragraph 3 of Article 6 of the Convention. The role of the mediator played by the translator A.D. while the applicant, accused of the crime, set out her version of events, went beyond the functions of the translator, who A.D. should have performed. However, the authorities did not evaluate A.D. and did not establish whether she performed the functions of a translator in accordance with the guarantees provided for in paragraph 1 of Article 6 and subparagraph "e" of paragraph 3 of Article 6 of the Convention, and did not consider whether A.D. the consequences for the outcome of the applicant’s case. Furthermore, the interrogation report of 6 November 2007 does not contain information on the applicant’s interaction with A.D. during this procedural action.

 

This initial flaw, therefore, had consequences for other rights, which, although they were different from the violation of which the applicant complained, were closely related to him and violated the fairness of the trial as a whole.

 


RESOLUTION

 


In the case there was a violation of the requirements of paragraph 1 of Article 6 and subparagraph "e" of paragraph 3 of Article 6 of the Convention (adopted unanimously).

 

The Court also concluded that there had been no violation of the requirements of Article 3 of the Convention in its substantive aspect in view of the lack of information that would allow concluding that the applicant had been subjected to inhuman or degrading treatment.

 


COMPENSATION

 


In application of Article 41 of the Convention. The Court awards the applicant EUR 10,400 in respect of non-pecuniary damage.
