Постановление ЕСПЧ от 11 июня 2019 года по делу "S.S. и B.Z. (S.S. и B.Z.) против Российской Федерации" (жалобы N 35332/17 и 79223/17).

В 2017 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

По делу успешно рассмотрены жалобы на нерассмотрение органами власти доводов заявителей о том, что им может угрожать жестокое обращение в случае их высылки в страны их происхождения. Первый заявитель также жаловался на бесчеловечные условия содержания под стражей. Заявители также указывали на ряд других нарушений Конвенции о защите прав человека и основных свобод. По делу в отношении первого заявителя допущено нарушение статьи 3 Конвенции (запрещение пыток), в отношении обоих заявителей - пункта 4 статьи 5 Конвенции (право на свободу и личную неприкосновенность), также в случае, если второй заявитель будет выслан в страну своего происхождения, будет иметь место нарушение статьи 3 Конвенции.

В своих жалобах Заявители жаловались на то, что органы власти не рассмотрели их доводы о том, что им может угрожать жестокое обращение в случае их высылки в страны их происхождения. Первый заявитель также жаловался на бесчеловечные условия содержания под стражей. Заявители также указывали на ряд других нарушений Конвенции.

11 июня 2019 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил, что будет иметь место нарушение статьи 3 Конвенции (запрещение пыток), если второй заявитель будет выслан в страну своего происхождения и что имело место нарушение статьи 3 Конвенции по делу первого заявителя в связи с его выдворением в Таджикистан. Европейский Суд единогласно постановил, что имело место нарушение статьи 3 Конвенции в отношении первого заявителя, пункта 4 статьи 5 Конвенции (право на свободу и личную неприкосновенность) в отношении обоих заявителей. Европейский Суд также указал, что власти Российской Федерации проигнорировали обеспечительную меру, указанную им в соответствии с правилом 39 Регламента Европейского Суда, и поэтому не выполнили свои обязательства согласно статье 34 Конвенции (право на подачу индивидуальной жалобы) по делу первого заявителя, и обязал власти Российской Федерации выплатить первому заявителю 10 000 евро в качестве компенсации морального вреда.

The Court also pointed out that the Government ignored the interim measure indicated in accordance with Rule 39 of the Rules of Court and therefore failed to fulfill their obligations under Article 34 of the Convention (the right to lodge an individual complaint) in the first applicant’s case and ordered the Russian authorities The federations pay the first applicant 10,000 euros in respect of non-pecuniary damage.

В 2012, 2013 и 2014 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

По делу успешно рассмотрены жалобы на отсутствие эффективного расследования по факту исчезновения родственников заявителей после их предположительного задержания представителями государства и причинение заявителям моральных страданий в связи с данными обстоятельствами, а также незаконность содержания родственников заявителей под стражей. По делу допущено нарушение требований статей 2, 3, 5 Конвенции о защите прав человека и основных свобод, а также статьи 13 Конвенции во взаимосвязи со статьей 2 Конвенции и статьи 13 Конвенции во взаимосвязи со статьей 3 Конвенции в отношении отдельных заявителей.

 

В своих жалобах Заявители жаловались на то, что их родственники исчезли после предположительного задержания представителями государства и что в этой связи не было проведено эффективного расследования. 04 июня 2019 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил что в данном деле власти Российской Федерации нарушили требования статей 2 (право на жизнь) в ее материально-правовом и процессуально-правовом аспектах, 3 (запрещение пыток), 5 (право на свободу и личную неприкосновенность) и 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) во взаимосвязи со статьей 2 Конвенции, статьи 13 Конвенции во взаимосвязи со статьей 3 Конвенции в отношении отдельных заявителей, и обязал власти государства-ответчика выплатить заявителям различные суммы от 80 000 до 1300 000 евро в качестве компенсации морального вреда.

По делу допущено нарушение требований статьи 2 Конвенции о защите прав человека и основных свобод в ее материально-правовом и процессуально-правовом аспектах в отношении отдельных заявителей, статьи 3, статьи 5 и статьи 13 Конвенции о защите прав человека и основных свобод в совокупности со статьей 2.

По делу успешно рассмотрена жалоба на моральные страдания, причиненные заявителям вследствие исчезновения их родственника, и незаконность содержания родственника под стражей. Заявители также утверждали, что они не располагали какими-либо эффективными внутригосударственными средствами правовой защиты в связи с этими обстоятельствами. По делу допущено нарушение требований статей 2, 3, 5 и 13 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе Заявители утверждали, что в ноябре 2003 года в Республике Ингушетия их родственники были похищены предположительно представителями государства и что органы власти не смогли эффективно расследовать их жалобы. Первый и второй заявители жаловались на моральные страдания, причиненные им вследствие исчезновения их родственника, и на незаконность его содержания под стражей. Они также утверждали, что не располагали какими-либо эффективными внутригосударственными средствами правовой защиты в связи с этими обстоятельствами.

 

04 июня 2019 года, по жалобе поданной заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 2 (право на жизнь) в ее материально-правовом и процессуально-правовом аспектах, 3 (запрещение пыток) в отношении первого и второго заявителя, 5 (право на свободу и личную неприкосновенность) и 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) во взаимосвязи со статьями 2 и 3 Конвенции, и обязал власти государства-ответчика выплатить первому и второму заявителю совместно 80 000 евро в качестве компенсации морального вреда, 5 000 евро в качестве компенсации материального ущерба.

Постановление ЕСПЧ от 28 мая 2019 года по делу "Егоров и другие против (Yegorov and Others) Российской Федерации" (жалобы N 77208/16, 77506/16, 79424/16, 12537/17, 26118/17).

 

В 2016 и 2017 годах заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

По делу успешно рассмотрены жалобы на отсутствие представителя стороны обвинения при рассмотрении дел о привлечении заявителей к административной ответственности, в связи с чем рассмотрение данных дел в суде не было беспристрастным. По делу допущено нарушение требований статьи 6 Конвенции о защите прав человека и основных свобод.

 

В своих жалобах Заявители, которые были привлечены к административной ответственности, жаловались на то, что рассмотрение их дел в суде не было беспристрастным в связи с отсутствием представителя стороны обвинения.

 

28 мая 2019 года, по жалобам поданным заявителями, Европейский Суд единогласно постановил что в данном деле власти Российской Федерации нарушили требования статьи 6 Конвенции (право на справедливое судебное разбирательство), и обязал власти государства-ответчика выплатить каждому из пяти заявителей по 1 000 евро в качестве компенсации морального вреда.

In 2016 and 2017, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.

 

In the case, applications about the absence of a representative of the prosecution were successfully considered in the consideration of cases on bringing the applicants to administrative responsibility, and therefore the consideration of these cases in court was not impartial. The case has violated the requirements of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In their applications, the applicants, who were brought to administrative responsibility, complained that the consideration of their cases in court was not impartial due to the absence of a representative of the prosecution.

 

On May 28, 2019, following applications by the applicants, the Court unanimously ruled that in the present case the Government violated the requirements of Article 6 of the Convention (right to a fair trial) and ordered the respondent Government to pay each of the five applicants EUR 1,000 each as compensation for non-pecuniary damage.
