Постановление ЕСПЧ от 24 сентября 2019 года по делу "Милинов (Milinov) против Российской Федерации" (жалоба N 51165/08).

В 2008 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

По делу успешно рассмотрена жалоба на то, что заявителю не позволили выразить свое мнение на публичном мероприятии. По делу допущено нарушение статьи 10 Конвенции о защите прав человека и основных свобод.

В своей жалобе заявитель жаловался на то, что ему не позволили выразить свое мнение на публичном мероприятии.

24 сентября 2019 года, по жалобе, поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 10 Конвенции (право на свободу выражения мнения), и обязал власти государства-ответчика выплатить наследнице заявителя 9 750 евро в качестве компенсации морального вреда и 850 евро в качестве компенсации судебных расходов и издержек.

The ECHR judgment of September 24, 2019 in the case of Milinov v. Russia (application No. 51165/08).

In 2008, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

In the case, the application was successfully examined that the applicant was not allowed to express his opinion at a public event. The case has violated article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In his application, the applicant complained that he was not allowed to express his opinion at a public event.

On 24 September 2019, in response to an application filed by the applicant, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 10 of the Convention (the right to freedom of expression) and ordered the respondent Government to pay EUR 9,750 in compensation to the applicant’s heir non-pecuniary damage and 850 euros in respect of costs and expenses.

Постановление ЕСПЧ от 24 сентября 2019 года по делу "Исмаилов (Ismailov) против Российской Федерации" (жалоба N 45852/17).

 

В 2017 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на незаконное содержание заявителя под стражей в ожидании депортации, а также то, что в ходе разбирательства не было проявлено должной осмотрительности, так как, несмотря на то, что властям Российской Федерации стало известно об отсутствии у заявителя гражданства той страны, куда его намеревались экстрадировать, заявитель еще восемь месяцев продолжал находиться под стражей. По делу допущено нарушение пункта 1 статьи 5 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе заявитель жаловался на то, что его содержание под стражей в ожидании депортации было незаконным и что в ходе разбирательства не было проявлено должной осмотрительности, так как, несмотря на то, что властям Российской Федерации стало известно об отсутствии у заявителя гражданства той страны, куда его намеревались экстрадировать, заявитель еще восемь месяцев продолжал находиться под стражей.

 

24 сентября 2019 года, по жалобе, поданной заявителем, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), и обязал власти государства-ответчика выплатить заявителю 3 000 евро в качестве компенсации морального вреда и 1 500 евро в качестве компенсации судебных расходов и издержек.

The case has successfully examined the application about the applicant’s unlawful detention pending deportation, as well as the lack of due diligence during the proceedings, since, despite the fact that the authorities of the Russian Federation became aware of the applicant’s citizenship of that country, where he was intended to be extradited, the applicant continued to be detained for another eight months. The case has violated article 5, paragraph 1, of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

In his application, the applicant complained that his detention pending deportation was unlawful and that due diligence had not been shown during the proceedings because, despite the fact that the authorities of the Russian Federation had become aware of the applicant’s citizenship of that country, where he was intended to be extradited, the applicant continued to be detained for another eight months.

 

On September 24, 2019, on an application filed by the applicant, the European Court unanimously ruled that in the present case the Government violated the requirements of Article 5 § 1 of the Convention (right to liberty and security of person) and ordered the respondent Government to pay the applicant 3,000 euros in in respect of non-pecuniary damage and 1,500 euros in respect of costs and expenses.

В 2009 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

 

По делу успешно рассмотрены жалобы на то, что близкие родственники заявителей исчезли после того, как они якобы были незаконно задержаны в ходе спецопераций, а также что не было проведено эффективного расследования этого обстоятельства. По делу допущено нарушение требований статьи 2, пункта 1 статьи 5, статьи 13 Конвенции о защите прав человека и основных свобод, а также статьи 1 Протокола N 1 к Конвенции.

 

В своих жалобах заявители жаловались на то, что их близкие родственники исчезли после того, как они якобы были незаконно задержаны в ходе спецопераций. Заявители также жаловались на то, что не было проведено эффективного расследования этого обстоятельства.

 

24 сентября 2019 года, по жалобам, поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статей 2 (право на жизнь) и 3 Конвенции (запрещение пыток) в отношении родственников заявителей, пункта 1 статьи 5 Конвенции (право на свободу и личную неприкосновенность), 13 Конвенции (право на эффективное внутригосударственное средство правовой защиты) во взаимосвязи со статьей 2 Конвенции, статьи 1 Протокола N 1 к Конвенции (право на защиту собственности), и обязал власти государства-ответчика выплатить заявителям различные суммы от 68 850 до 94 850 евро в качестве всех видов компенсаций.

The case has successfully examined applications that the applicants' close relatives disappeared after they were allegedly illegally detained during special operations, and that there was no effective investigation into this circumstance. The case has violated the requirements of Article 2, paragraph 1 of Article 5, Article 13 of the Convention for the Protection of Human Rights and Fundamental Freedoms, as well as Article 1 of Protocol No. 1 to the Convention.

 

In their applications, the applicants complained that their close relatives disappeared after they were allegedly illegally detained during special operations. The applicants also complained that there had been no effective investigation into this circumstance.

 

On September 24, 2019, according to the applications submitted by the applicants, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Articles 2 (the right to life) and 3 of the Convention (prohibition of torture) in respect of the applicants' relatives, Article 5 § 1 of the Convention (right liberty and security of person), 13 of the Convention (the right to an effective domestic remedy) in conjunction with Article 2 of the Convention, Article 1 of Protocol No. 1 to the Convention (the right to protection of property), and obliged the authorities of the vetchika pay the applicants various sums from 68 850 to 94 850 euros as compensation of all kinds.
