Постановление ЕСПЧ от 22 октября 2019 года по делу "Куратов и другие (Kuratov and Others) против Российской Федерации" (жалоба N 24377/15 и две другие жалобы).

В 2015 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Российской Федерации.

По делу успешно рассмотрены жалобы на небеспристрастность суда, рассматривавшего дела заявителей, отсутствие достаточного времени для подготовки защиты у первого заявителя, рассмотрение обоих дел против второго заявителя одним и тем же судьей, отсутствие у третьего заявителя возможности допросить сотрудников полиции, которые возбудили против него административное дело. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

В своих жалобах заявители жаловались на то, что суд, рассматривавший их дела, не был беспристрастным. Один из заявителей также утверждал, что у него не было достаточно времени для подготовки своей защиты. Другой заявитель жаловался на то, что оба дела против него рассматривал один и тот же судья. Третий заявитель утверждал, что он не имел возможности допросить сотрудников полиции, которые возбудили против него административное дело.

22 октября 2019 года, по жалобам, поданным заявителями, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования пункта 1 статьи 6 Конвенции (право на справедливое судебное разбирательство) в отношении всех заявителей, и обязал власти государства-ответчика выплатить двум заявителям по 1 000 евро в качестве компенсации морального вреда.

The ECHR judgment of October 22, 2019 in the case of Kuratov and Others v. Russia (application No. 24377/15 and two other applications).

In 2015, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.

The case successfully examined applications about the impartiality of the court examining the applicants' cases, the lack of sufficient time for the first applicant to prepare the defense, the consideration of both cases against the second applicant by the same judge, the third applicant's inability to question the police officers who instituted administrative proceedings against him . The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In their applications, the applicants complained that the court hearing their cases was not impartial. One of the applicants also alleged that he did not have enough time to prepare his defense. Another applicant complained that the same judge had heard both cases against him. The third applicant alleged that he had not had the opportunity to question the police officers who had instituted administrative proceedings against him.

On October 22, 2019, in respect of the applications submitted by the applicants, the Court unanimously ruled that in the present case the Government violated the requirements of Article 6 § 1 of the Convention (right to a fair trial) in respect of all the applicants, and ordered the respondent Government to pay two the applicants 1,000 euros each in respect of non-pecuniary damage.

Постановление ЕСПЧ от 22 октября 2019 года по делу "Барсова (Barsova) против Российской Федерации" (жалоба N 20289/10).

 

В 2010 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Российской Федерации.

 

По делу успешно рассмотрена жалоба на необеспечение властями эффективной защиты заявительницы от актов насилия в семье. По делу допущено нарушение требований статьи 3 Конвенции о защите прав человека и основных свобод.

 

В своей жалобе заявительница жаловалась на то, что власти Российской Федерации не обеспечили ей эффективную защиту от актов насилия в семье. В результате их действий истекли сроки давности, и виновный так и не был привлечен к ответственности.

 

22 октября 2019 года, по жалобе, поданной заявительницей, Европейский Суд единогласно постановил, что в данном деле власти Российской Федерации нарушили требования статьи 3 Конвенции (запрещение пыток), и обязал власти государства-ответчика выплатить заявительнице 7 500 евро в качестве компенсации морального вреда.

On October 22, 2019, in an application lodged by the applicant, the Court unanimously ruled that in the present case the Government violated the requirements of Article 3 of the Convention (prohibition of torture) and ordered the respondent Government to pay the applicant EUR 7,500 in respect of non-pecuniary damage.
