Постановление ЕСПЧ от 29 октября 2019 года по делу "Баралия против Боснии и Герцеговины (Baralija v. Bosnia and Herzegovina)" (жалоба N 30100/18).

В 2018 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Боснии и Герцоговине.

По делу успешно рассмотрена жалоба на отсутствие возможности голосовать и выдвигать свою кандидатуру на местных выборах, что являлось дискриминацией по месту жительства. По делу допущено нарушение требований статьи 1 Протокола N 12 к Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель проживал в г. Мостар (Mostar), где местные выборы в последний раз проводились в 2008 году.

В ноябре 2010 года Конституционный суд объявил некоторые положения Закона о выборах 2001 года и Устава г. Мостар неконституционными. Конституционный суд предписал Парламентской ассамблее Боснии и Герцеговины внести в течение шести месяцев с даты публикации его постановления в официальной газете изменения в неконституционные положения Закона о выборах 2001 года. Конституционный суд также предписал властям г. Мостар уведомить его о действиях, предпринятых для того, чтобы привести Устав г. Мостар в соответствие с Конституцией Боснии и Герцеговины, в течение трех месяцев с даты публикации в официальной газете изменений, принятых Парламентской ассамблеей с целью приведения Закона о выборах от 2001 года в соответствие с Конституцией Боснии и Герцеговины и постановлением Конституционного суда.

На сентябрь 2019 года соответствующие положения Закона о выборах 2001 года, регулирующие выборы в городской совет, по-прежнему не были приняты.

Заявитель жаловался на то, что отсутствие возможности голосовать и выдвигать свою кандидатуру на местных выборах в г. Мостар являлось дискриминацией по месту жительства.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 1 Протокола N 12 к Конвенции. (a) Было ли у заявителя право, установленное законом. У заявителя было право, установленное законом, а именно голосовать и выдвигать свою кандидатуру на местных выборах, и он соответствовал общим условиям для осуществления данного права.

(b) Имела ли место аналогичная или похожая ситуация и различие в обращении. Заявитель как лицо, проживающее в городе, находился в аналогичной или похожей ситуации по отношению к лицу, проживающему в другой части страны, в том, что касалось реализации права голосовать и выдвигать свою кандидатуру на местных выборах.

Настоящее дело касалось разного применения одного и того же законодательства в зависимости от места жительства лица. Поскольку различие в обращении, на которое жаловался заявитель, было основано на "ином признаке", заявитель пользовался защитой статьи 1 Протокола N 12 к Конвенции.

(c) Приняли ли власти Боснии и Герцеговины достаточные меры для защиты заявителя от предположительно дискриминационного обращения. Задержка имплементации постановления Конституционного суда была обоснована необходимостью создания долгосрочного и эффективного механизма распределения властных полномочий в городском совете с целью поддержания мира и содействия диалогу между разными этническими группами в городе. Аналогичное обоснование уже было рассмотрено в контексте существовавших конституционных положений, предназначенных для того, чтобы положить конец жестокому конфликту, в ходе которого имели место геноцид и "этническая чистка", и необходимых для обеспечения мира. Европейский Суд счел, что некоторые из существовавших способов распределения властных полномочий постольку, поскольку они предоставляли основному населению особые права по исключению этнических меньшинств и лиц, которые не заявили о своей принадлежности к какой-либо определенной группе, не были несовместимы с Конвенцией. Тем не менее Европейский Суд также отметил, что "Конвенция не содержит требования упразднения всех механизмов распределения властных полномочий, характерных для Боснии и Герцеговины, и что, [возможно], еще не пришло время для того, чтобы политическая система стала простым выражением власти большинства". Однако если в предыдущих делах Европейский Суд рассматривал существующие законодательные положения, в настоящем деле предметом рассмотрения была юридическая недействительность, которая сделала невозможным для заявителя осуществлять свои избирательные права в течение продолжительного периода.

В контексте статьи 3 Протокола N 1 к Конвенции Европейский Суд установил, что первичным обязательством государства применительно к праву на свободные выборы было не невмешательство, как в случае большинства гражданских и политических прав, а принятие государством позитивных мер для "проведения" демократических выборов. Такой же точки зрения придерживался Комитет ООН по правам человека в контексте прав, предусмотренных статьей 25 Международного пакта о гражданских и политических правах, которые действовали в Боснии и Герцеговине в силу их конституционного статуса.

Местные выборы в городе в последний раз проводились в 2008 году. С 2012 года городом управлял только мэр, у которого был "технический мандат" и потому не было необходимой демократической легитимности. Кроме того, он не мог осуществлять все функции местного управления, которые, следовательно, оставались неисполняемыми. Не было сомнений в том, что демократия была фундаментальной характеристикой европейского публичного порядка, и понятие подлинно демократического режима применялось на местном уровне так же, как и на уровне всей страны, с учетом пределов полномочий по принятию решений, предоставленных местным властям, и близостью местных избирателей к политике, которую проводили местные политические деятели. В этом отношении Преамбула к Хартии Совета Европы о местном самоуправлении гласит, что органы местного самоуправления составляют одну из главных основ любого демократического строя и что местное самоуправление осуществляется советами или собраниями, состоящими из членов, избранных путем свободного голосования.

На этом фоне трудности достижения политического соглашения по поводу устойчивого механизма распределения властных полномочий не являлись достаточным, объективным и разумным обоснованием ситуации, на которую жаловался заявитель и которая продолжалась на протяжении уже долгого времени. В целом власти не выполнили своих позитивных обязательств по проведению демократических выборов в городе.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 1 Протокола N 12 к Конвенции (принято единогласно).

В порядке применения статьи 46 Конвенции. Европейский Суд указал, что в настоящем деле жалоба была связана с неисполнением властями Боснии и Герцеговины постановления Конституционного суда и связанных с ним постановлений. Неисполнение окончательного, подлежавшего исполнению судебного решения могло привести к ситуациям, которые были несовместимыми с принципом верховенства права, который Договаривающиеся Государства обязались соблюдать при ратификации Конвенции. Следовательно, принимая во внимание данные соображения и большое количество потенциальных заявителей, а также срочную необходимость положить конец обжалуемой ситуации, власти Боснии и Герцеговины обязаны в течение шести месяцев после вступления в силу настоящего Постановления внести изменения в Закон о выборах 2001 года с целью обеспечить проведение местных выборов в г. Мостар. Если власти Боснии и Герцеговины не сделают этого, Конституционный суд вправе в соответствии с законодательством страны и существующей практикой установить промежуточные правила в качестве необходимых переходных мер.

В порядке применения статьи 41 Конвенции. Европейский Суд отклонил требование о возмещении материального ущерба и постановил, что констатация факта нарушения Конвенции являлась достаточной справедливой компенсацией в отношении любого морального вреда.

Presuda ESLJP-a od 29. listopada 2019. u predmetu „Baralia protiv Bosne i Hercegovine (Baralija protiv Bosne i Hercegovine)“ (žalba br. 30100/18).

U 2018. godini podnositelju je pomognuta u pripremi žalbe. Nakon toga, žalba je proslijeđena Bosni i Hercegovini.

U slučaju je uspješno razmatrana žalba u vezi s nedostatkom mogućnosti da glasaju i kandidiraju se na lokalnim izborima, a to je bila diskriminacija u mjestu prebivališta. Slučaj je prekršio zahtjeve člana 1. Protokola br. 12 uz Konvenciju o zaštiti ljudskih prava i temeljnih sloboda.


Okolnosti slučaja


Podnosilac prijave je boravio u Mostaru, gdje su lokalni izbori posljednji put održani 2008. godine.

U studenom 2010. godine Ustavni sud proglasio je pojedine odredbe Izbornog zakona iz 2001. godine i Ustava Mostara neustavnim. Ustavni sud naložio je Parlamentarnoj skupštini Bosne i Hercegovine da u roku od šest mjeseci od dana donošenja svoje odluke u službenim novinama izmijeni neustavne odredbe Izbornog zakona 2001. godine. Ustavni sud također je naložio vlastima Mostara da ga, u roku od tri mjeseca od dana objave u službenom listu, u roku od tri mjeseca od dana objave u službenom listu izmjene i dopune Parlamentarne skupštine, s ciljem donošenja Zakona, obavijeste o izmjenama u Mostarskom statutu. o izborima 2001. godine u skladu s Ustavom Bosne i Hercegovine i odlukom Ustavnog suda.

PITANJA ZAKONA


Što se tiče poštivanja člana 1 Protokola br. 12 uz Konvenciju. (a) Da li je podnosilac zahteva imao zakonsko pravo. Podnositelj zahtjeva imao je zakonom utvrđeno pravo, naime, glasati i kandidirati se na lokalnim izborima, a ispunio je opće uvjete za ostvarivanje ovog prava.

Kašnjenje u provedbi presude Ustavnog suda opravdano je potrebom da se stvori dugoročan i učinkovit mehanizam raspodjele vlasti u gradskom vijeću, kako bi se održao mir i olakšao dijalog između različitih etničkih grupa u gradu. Slična su opravdanja već ispitana u kontekstu postojećih ustavnih odredbi namijenjenih za okončanje brutalnog sukoba, tokom kojeg je došlo do genocida i „etničkog čišćenja“, i neophodnog za osiguranje mira. Sud smatra da neke od postojećih metoda raspodjele moći u mjeri u kojoj su općoj populaciji osigurale posebna prava za isključenje etničkih manjina i osoba koje se nisu izjasnile o svom članstvu u određenoj skupini nisu nespojive s Konvencijom. Međutim, Sud je također primijetio da "Konvencija ne zahtijeva ukidanje svih mehanizama distribucije moći specifičnih za Bosnu i Hercegovinu, te da [možda] još nije došlo vrijeme da politički sistem postane jednostavan izraz moći većine." . Međutim, ako je Sud u prethodnim slučajevima razmotrio postojeće zakonske odredbe, u ovom slučaju predmet razmatranja bio je pravna nevaljanost, što je onemogućilo podnositelju prijave dugoročno ostvarivanje svojih izbornih prava.

U kontekstu članka 3. Protokola br. 1 uz Konvenciju, Sud je utvrdio da primarna obveza države u vezi s pravom na slobodne izbore nije miješanje, kao u slučaju većine građanskih i političkih prava, već usvajanje pozitivnih mjera države za "održavanje" demokratskih izbora. UN-ov Komitet za ljudska prava zauzimao je isto stajalište u kontekstu prava predviđenih člankom 25. Međunarodnog pakta o građanskim i političkim pravima, koji su u Bosni i Hercegovini važili na osnovu njihovog ustavnog statusa.

Lokalni izbori u gradu posljednji su put održani 2008. godine. Od 2012. gradom je upravljao samo gradonačelnik koji je imao „tehnički mandat“ i stoga nije imao potrebnu demokratsku legitimitet. Pored toga, nije mogao da obavlja sve funkcije lokalne uprave, što je, prema tome, ostalo nedostižno. S tim u svezi, u Preambuli Povelje Vijeća Europe o lokalnoj samoupravi stoji da lokalne vlasti predstavljaju jedan od glavnih stubova svakog demokratskog sustava i da lokalnu samoupravu provode vijeća ili skupštine koje čine članovi izabrani slobodnim glasanjem.

U skladu s tim, poteškoće u postizanju političkog dogovora o stabilnom mehanizmu raspodjele vlasti nisu bile dovoljno, objektivno i razumno opravdanje za situaciju na koju se podnositelj zahtjeva žalio i koja traje već duže vrijeme. Općenito, vlasti nisu ispunile svoje pozitivne obaveze za održavanje demokratskih izbora u gradu.


RJEŠENJE


U slučaju je došlo do kršenja zahtjeva iz članka 1. Protokola br. 12 uz Konvenciju (usvojenog jednoglasno).

Primjenjujući članak 46. Konvencije. Sud je naznačio da je u ovom slučaju žalba povezana s neuspjehom vlasti Bosne i Hercegovine da ispoštuju presudu Ustavnog suda i srodne presude. Nepoštivanje konačne, izvršne presude moglo bi dovesti do situacija koje su nespojive s vladavinom zakona, a koje su se države ugovornice obavezale da poštuju prilikom ratifikacije Konvencije. Slijedom toga, uzimajući u obzir ta razmatranja i veliki broj potencijalnih podnositelja zahtjeva, kao i hitnu potrebu za ukidanjem situacije na koju su prigovorili, vlasti Bosne i Hercegovine su dužne izmijeniti Izborni zakon 2001. kako bi se osiguralo da lokalni izbori budu održani u roku od šest mjeseci nakon stupanja na snagu ove Rezolucije izbori u Mostaru. Ako vlasti Bosne i Hercegovine to ne učine, Ustavni sud ima pravo u skladu sa zakonodavstvom zemlje i postojećom praksom utvrditi privremena pravila kao potrebne prijelazne mjere.

Primjenjujući članak 41. Konvencije. Sud je odbacio zahtjev za novčanu štetu i utvrdio da nalaz povrede Konvencije predstavlja dovoljno pravednog zadovoljstva u odnosu na bilo kakvu nematerijalnu štetu.

The ECHR judgment of 29 October 2019 in the case “Baralia v. Bosnia and Herzegovina (Baralija v. Bosnia and Herzegovina)” (application No. 30100/18).

In 2018, the applicant was assisted in preparing the application. Subsequently, the application was communicated to Bosnia and Herzegovina.

In the case, an application was successfully considered regarding the lack of the ability to vote and stand for election in local elections, which was discrimination at the place of residence. The case has violated the requirements of Article 1 of Protocol No. 12 to the Convention for the Protection of Human Rights and Fundamental Freedoms.


Circumstances of the case


The applicant resided in Mostar, where the local elections were last held in 2008.

In November 2010, the Constitutional Court declared certain provisions of the 2001 Election Law and the Constitution of Mostar unconstitutional. The Constitutional Court ordered the Parliamentary Assembly of Bosnia and Herzegovina to amend, within six months from the date of its decision in the official newspaper, the unconstitutional provisions of the 2001 Election Law. The Constitutional Court also ordered the authorities of Mostar to notify him of the actions taken to bring the Statute of Mostar into line with the Constitution of Bosnia and Herzegovina, within three months from the date of publication in the official newspaper of the amendments adopted by the Parliamentary Assembly with the aim of bringing the Law on the elections of 2001 in accordance with the Constitution of Bosnia and Herzegovina and the decision of the Constitutional Court.

In January 2012, the Constitutional Court adopted a ruling on non-enforcement of its ruling of November 2010 by the Parliamentary Assembly. He found that the provisions of the 2001 Election Law, which were declared unconstitutional, would cease to be effective the day after the publication of the Constitutional Court ruling in the official newspaper. In February 2012, the relevant provisions of the 2001 Election Law ceased to be in force.

In this regard, local elections in Mostar could not be held in the prescribed manner in 2012 and 2016. The mayor of Mostar, acting at the time of the trial, was elected by the city council in 2009. Since 2012, he has had a “technical mandate” due to the lack of elections. As of September 2019, the relevant provisions of the 2001 Election Law governing elections to the city council were still not adopted.

The applicant complained that the lack of the ability to vote and run for the local elections in Mostar constituted discrimination at the place of residence.


QUESTIONS OF LAW


Regarding compliance with Article 1 of Protocol No. 12 to the Convention. (a) Whether the applicant had a statutory right. The applicant had the right established by law, namely, to vote and run for office in local elections, and he met the general conditions for the exercise of this right.

(b) Whether there has been a similar or similar situation and a difference in treatment. The applicant, as a person residing in a city, was in a similar or similar situation with respect to a person residing in another part of the country as regards the exercise of the right to vote and stand for election in local elections.

The present case concerned the different application of the same legislation depending on the place of residence of the person. Since the difference in the treatment complained of by the applicant was based on a “different grounds”, the applicant enjoyed the protection of Article 1 of Protocol No. 12 to the Convention.

(c) Have the authorities of Bosnia and Herzegovina taken sufficient measures to protect the applicant from allegedly discriminatory treatment? The delay in the implementation of the Constitutional Court ruling was justified by the need to create a long-term and effective mechanism for the distribution of power in the city council in order to maintain peace and facilitate dialogue between different ethnic groups in the city. A similar rationale has already been examined in the context of existing constitutional provisions designed to put an end to the brutal conflict, during which there was genocide and "ethnic cleansing", and necessary to ensure peace. The Court considers that some of the existing methods of distributing power to the extent that they provided the general population with special rights to exclude ethnic minorities and persons who did not declare their membership in a particular group were not incompatible with the Convention. However, the Court also noted that “the Convention does not require the abolition of all power distribution mechanisms specific to Bosnia and Herzegovina, and that [perhaps] the time has not yet come for the political system to become a simple expression of the majority’s power” . However, if in previous cases the Court considered existing legislative provisions, in the present case the subject of consideration was legal invalidity, which made it impossible for the applicant to exercise his electoral rights for a long period.

In the context of Article 3 of Protocol No. 1 to the Convention, the Court has found that the primary obligation of the state in relation to the right to free elections was not non-interference, as in the case of most civil and political rights, but the adoption of positive measures by the state to “hold” democratic elections. The UN Committee on Human Rights held the same point of view in the context of the rights provided for in article 25 of the International Covenant on Civil and Political Rights, which were valid in Bosnia and Herzegovina by virtue of their constitutional status.

Local elections in the city were last held in 2008. Since 2012, the city was ruled only by a mayor who had a “technical mandate” and therefore did not have the necessary democratic legitimacy. In addition, he could not carry out all the functions of local government, which, therefore, remained unattainable. This situation was not compatible with the concepts of “truly democratic regime” and “rule of law”, which are mentioned in the Preamble to the Convention. There was no doubt that democracy was a fundamental characteristic of European public order, and the concept of a truly democratic regime was applied at the local level as well as at the country level, taking into account the limits of decision-making authority granted to local authorities and the proximity of local voters to the policies pursued by local politicians. In this regard, the Preamble to the Council of Europe Charter on Local Self-Government states that local authorities constitute one of the main pillars of any democratic system and that local self-government is carried out by councils or assemblies consisting of members elected by free voting.

Against this background, the difficulties of reaching a political agreement on a stable mechanism for the distribution of power were not a sufficient, objective and reasonable justification for the situation the applicant complained about and which had been going on for a long time. In general, the authorities did not fulfill their positive obligations to hold democratic elections in the city.


RESOLUTION


In the case there was a violation of the requirements of Article 1 of Protocol No. 12 to the Convention (adopted unanimously).

In application of Article 46 of the Convention. The Court has indicated that in the present case the complaint was related to the failure by the authorities of Bosnia and Herzegovina to comply with the judgment of the Constitutional Court and the related judgments. Failure to comply with a final, enforceable judgment could lead to situations that were incompatible with the rule of law, which the Contracting States undertook to comply with when ratifying the Convention. Consequently, taking into account these considerations and the large number of potential applicants, as well as the urgent need to put an end to the situation complained of, the authorities of Bosnia and Herzegovina are required to amend the Election Act 2001 in order to ensure local elections are held within six months after the entry into force of this Resolution elections in Mostar. If the authorities of Bosnia and Herzegovina do not do this, the Constitutional Court is entitled, in accordance with the legislation of the country and existing practice, to establish intermediate rules as necessary transitional measures.

In application of Article 41 of the Convention. The Court dismissed the claim for pecuniary damage and held that the finding of a violation of the Convention constituted sufficient just satisfaction in respect of any non-pecuniary damage.

Постановление ЕСПЧ от 24 октября 2019 года по делу "J.D. и A против Соединенного Королевства (J.D. and A v. United Kingdom)" (жалобы N 32949/17 и 34614/17).

 

В 2017 году заявительницам была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Соединенному Королевству.

 

По делу успешно рассмотрены жалобы на отсутствие разграничения в пользу определенных уязвимых категорий жильцов квартир по социальному найму при применении измененной схемы выплаты пособий на оплату жилья. По делу допущено нарушение требований статьи 14 Конвенции о защите прав человека и основных свобод в отношении второй заявительницы и не было допущено нарушения в отношении первой заявительницы.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявительницы проживали в квартирах по договору социального найма. После внесения изменений в законодательство суммы пособий на жилье, на которые заявительницы ранее имели право для снижения (через субсидию) оплаты проживания в квартирах, были снижены, поскольку согласно новой установленной законом схеме заявительницы имели лишнюю спальню. Большая часть разницы в сумме между их платой за жилье и уменьшившейся суммой пособия на жилье была заменена платежами по самостоятельной схеме пособий на оплату жилья, за получением которых заявительницы должны были обратиться отдельно.

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 14 Конвенции в совокупности со статьей 1 Протокола N 1 к Конвенции. (a) Общие принципы. В контексте одной только статьи 1 Протокола N 1 к Конвенции в вопросах, касающихся общих мер экономической или социальной стратегии, государства обычно пользуются широкой свободой усмотрения согласно Конвенции, а Европейский Суд обычно уважает выбор законодателя, если только он "явно не имел разумных оснований".

 

Однако в контексте статьи 1 Протокола N 1 к Конвенции в совокупности со статьей 14 Конвенции, хотя свобода усмотрения в контексте общих экономических и социальных мер являлась в принципе обширной, данные меры тем не менее должны были осуществляться таким образом, чтобы не нарушать конвенционный запрет дискриминации и соответствовать требованию пропорциональности. Соответственно, даже широкие пределы свободы усмотрения в сфере экономической или социальной политики не оправдывали принятие законов или практик, которые нарушали бы запрет дискриминации. Следовательно, в этом контексте Европейский Суд ограничивал свое согласие уважать выбор законодателя, когда он являлся "явно необоснованным", если предполагаемое расхождение в обращении было обусловлено временной/переходной мерой, являющейся частью схемы, применяемой для исправления исторически сложившегося неравенства. Вне этого контекста, учитывая необходимость, например, предотвратить дискриминацию по отношению к инвалидам или усилить степень равноправия полов, должны быть приведены "крайне веские причины", прежде чем такое различие в отношении будет считаться соответствующим Конвенции.

 

(b) Применение вышеизложенных принципов в настоящем деле. Внесенные изменения применялись ко всем лицам, пользовавшимся схемой пособий, без разграничений со ссылкой на их характеристики, в том числе, инвалидность или пол. К заявительницам относились так же, как и к другим получателям пособия на оплату жилья, поскольку их право на пособие было уменьшено на тех же основаниях и по тем же критериям, что и у других получателей пособия. Таким образом, возник вопрос о косвенной дискриминации. Необходимо было рассмотреть, допустили ли власти Соединенного Королевства дискриминационную ошибку, не сделав исключения в пользу заявительниц на том основании, что их личные обстоятельства значительно отличались от обстоятельств иных получателей пособия и причинили им ущерб в результате применения обжалуемой политики.

 

Предвидимым последствием снижения пособия на оплату жилья было то, что все получатели пособия, на которых распространилось снижение, рисковали потерять свое жилье. Действительно, власти Соединенного Королевства утверждали, что эта нестабильность и была целью применения новой схемы: заставить семьи переехать. Заявительницы находились в существенно другой ситуации, и такая политика причинила им особый ущерб, поскольку у них была настоятельная необходимость оставаться в их специально оборудованных домах по причинам, прямо связанным с их статусом.

 

Установив, что заявительницы, с которыми обращались так же, как и с другими получателями пособия на оплату жилья, хотя их личные обстоятельства были совершенно иными, и которые особо пострадали от обжалуемой меры, Европейский Суд должен был выяснить, была ли неспособность властей Соединенного Королевства принять это различие во внимание дискриминационной. При обстоятельствах дел заявительниц, когда предполагаемая дискриминация была осуществлена по принципу инвалидности и пола и не была обусловлена временной мерой, принимаемой добросовестно для исправления неравенства, требовалось привести очень веские причины, чтобы оправдать применение обжалуемой меры к заявительницам.

 

(i) Первая заявительница. Хотя было признано, что для первой заявительницы любой переезд был исключительно деструктивным и крайне нежелательным, переезд в меньшее по площади, надлежащим образом оборудованное жилье не противоречило бы в своей основе признанным потребностям инвалидов, проживающих в специально оборудованном жилье, но без медицинской необходимости в "дополнительной" спальне.

 

Независимая схема платежей за квартиру имела ряд существенных недостатков, включая, inter alia, то, что решение о выплате этих сумм носило характер свободного усмотрения и продолжительность данных платежей не была определена. Фактически первой заявительнице предоставлялись платежи на протяжении нескольких лет после внесения изменений в законодательство о пособиях. Хотя независимая схема оплаты за квартиру не могла быть охарактеризована как гарантирующая такой же уровень уверенности и стабильности, как предыдущая схема установленного пособия на оплату жилья, ее наличие вместе с сопутствующими гарантиями являлось достаточно веской причиной, чтобы убедить Европейский Суд в том, что способы, использованные для реализации схемы, имели разумное пропорциональное соотношение с преследуемой законной целью. Следовательно, указанное в деле первой заявительницы различие в обращении было обоснованным.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу не было допущено нарушения требований статьи 14 Конвенции в отношении первой заявительницы (принято единогласно).

 

(ii) Вторая заявительница. В деле второй заявительницы законная цель схемы заставить лиц в домах с "лишними" спальнями сменить жилье на меньшее по размеру, противоречила цели, которая была поставлена схемой предоставления убежищ от домашнего насилия и позволяла лицам, находящимся под угрозой насилия, находиться дома в безопасности, если бы этого захотели.

 

Учитывая две противоречащие друг другу законные цели, Европейский Суд решил, что последствия обращения со второй заявительницей или иными лицами, проживающими в домах, защищаемых схемой предоставления убежищ, так же, как и с другими получателями пособия на оплату жилья, пострадавшими от новой схемы, являлись непропорциональными в том смысле, что они не соответствовали законной цели этой меры. Власти Соединенного Королевства не привели каких-либо веских оснований для оправдания того, почему цели данной схемы были поставлены выше схемы, позволявшей жертвам домашнего насилия, получивших защиту, оставаться дома в безопасности. В этом контексте предоставление независимых платежей для компенсации оплаты жилья не делало пропорциональными взаимоотношения между использованными способами и поставленной целью, являвшейся частью схемы, направленной на то, чтобы вынудить жильцов переехать из своих домов, что было подтверждено установленными недостатками.

 

Следовательно, применение законодательных изменений к небольшой и легко определяемой группе населения не было оправдано и являлось дискриминационным.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 14 Конвенции в отношении второй заявительницы (принято пятью голосами "за" при двух - "против").

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил второй заявительнице 10 000 евро в качестве компенсации морального вреда.

ECHR judgment of 24 October 2019 in the case of J.D. and A v. The United Kingdom (J.D. and A v. United Kingdom) (applications Nos. 32949/17 and 34614/17).

 

In 2017, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated to the United Kingdom.

 

In the case, applications on the lack of differentiation in favor of certain vulnerable categories of residents of socially rented apartments when applying the amended scheme for paying housing allowances were successfully considered. There was a violation of Article 14 of the Convention for the Protection of Human Rights and Fundamental Freedoms in respect of the second applicant and no violation of the first applicant.

 


Circumstances of the case

 


The applicants lived in apartments under a social contract of employment. After amendments to the law, the amount of housing allowances for which the applicants were previously entitled to reduce (through a subsidy) the payment of accommodation in apartments were reduced, because according to the new statutory scheme, the applicants had an extra bedroom. Most of the difference in the amount between their housing payment and the reduced amount of housing allowance was replaced by payments under an independent housing allowance scheme, for which the applicants had to apply separately.

 

The applicants claimed that these changes put them in a more vulnerable position compared to other persons who were affected by the reduction in benefits due to their personal circumstances: the first applicant was taking care of the disabled child around the clock, and the second applicant was included in the “asylum scheme” to protect people who have been affected by domestic violence and who are still at risk of using it.

 


QUESTIONS OF LAW

 


Concerning compliance with Article 14 of the Convention in conjunction with Article 1 of Protocol No. 1 to the Convention. (a) General principles. In the context of Article 1 of Protocol No. 1 to the Convention, in matters relating to general measures of an economic or social strategy, States generally enjoy wide discretion under the Convention, and the Court generally respects the choice of the legislator, unless it “clearly had no reasonable basis”.

 

However, in the context of Article 1 of Protocol No. 1 in conjunction with Article 14 of the Convention, although the margin of appreciation in the context of general economic and social measures was in principle extensive, these measures should nevertheless be implemented in such a way as not to violate the Convention prohibition of discrimination and comply with the requirement of proportionality. Accordingly, even the wide limits of discretion in economic or social policy did not justify the adoption of laws or practices that would violate the prohibition of discrimination. Consequently, in this context, the Court limited its consent to respect the choice of the legislator when it was “manifestly ill-founded” if the alleged discrepancy in treatment was due to a temporary / transitional measure, which is part of the scheme used to correct historical inequalities. Outside of this context, given the need, for example, to prevent discrimination against persons with disabilities or to enhance gender equality, “extremely compelling reasons” must be given before such a difference in treatment is deemed relevant to the Convention.

 

(b) Application of the above principles in the present case. The amendments applied to all persons who used the benefits scheme without distinction with reference to their characteristics, including disability or gender. The applicants were treated the same way as other recipients of housing allowance, since their right to an allowance was reduced on the same grounds and by the same criteria as other recipients of the allowance. Thus, the question arose of indirect discrimination. It was necessary to consider whether the UK authorities had made a discriminatory mistake without making an exception in the applicants' favor on the ground that their personal circumstances were significantly different from those of other beneficiaries and caused damage to them as a result of the application of the appealed policy.

 

The foreseeable consequence of the reduction in housing allowance was that all recipients of the allowance, to which the reduction spread, risked losing their housing. Indeed, authorities in the United Kingdom argued that this instability was the purpose of applying the new scheme: forcing families to move. The applicants were in a significantly different situation, and such a policy caused them particular harm, since they had an urgent need to stay in their specially equipped homes for reasons directly related to their status.

 

Having found that the applicants who were treated in the same way as other recipients of housing allowance, although their personal circumstances were completely different and who were particularly affected by the measure complained of, the Court must find out whether the failure of the Government to accept this distinction is considered discriminatory. In the circumstances of the applicants' cases, when the alleged discrimination was based on the principle of disability and gender and was not caused by a provisional measure taken in good faith to remedy the inequality, very good reasons were required to justify the application of the complained measure to the applicants.

 

(i) The first applicant. Although it was recognized that for the first applicant any relocation was extremely destructive and extremely undesirable, relocation to a smaller, properly equipped housing would not in principle contradict the recognized needs of persons with disabilities living in specially equipped housing, but without the medical need for “additional "bedroom.

 

The independent apartment payment scheme had a number of significant drawbacks, including, inter alia, that the decision to pay these amounts was free discretion and the duration of these payments was not determined. In fact, the first applicant was provided with payments for several years after the amendment of the legislation on benefits. Although the independent apartment payment scheme could not be described as guaranteeing the same level of confidence and stability as the previous scheme of the established housing allowance, its presence, together with the accompanying guarantees, was a good enough reason to convince the Court that the methods used to implement the scheme, they had a reasonable proportional relationship with the legitimate aim pursued. Consequently, the difference in treatment indicated in the first applicant's case was substantiated.

 


RESOLUTION

 


There was no violation of Article 14 of the Convention in respect of the first applicant (accepted unanimously).

 

(ii) The second applicant. In the second applicant’s case, the legitimate aim of the scheme to force persons in houses with “extra” bedrooms to change their housing to a smaller one was contrary to the goal set by the scheme for providing shelter from domestic violence and to allow those at risk of violence to be safe at home if would want it.

 

Considering two conflicting legitimate goals, the Court decided that the consequences of the treatment of the second applicant or other persons living in houses protected by the asylum scheme, as well as other recipients of housing allowance, who suffered from the new scheme, were disproportionate in the sense that they did not meet the legitimate aim of this measure. The United Kingdom did not provide any good reason to justify why the objectives of this scheme were set above the scheme that allowed victims of domestic violence who were protected to remain safe at home. In this context, the provision of independent payments to compensate for the payment of housing did not make proportional the relationship between the methods used and the goal set, which was part of a scheme aimed at forcing residents to move out of their homes, which was confirmed by established shortcomings.

 

Consequently, the application of legislative changes to a small and easily defined group of the population was not justified and was discriminatory.

 


RESOLUTION

 


In the case, there was a violation of Article 14 of the Convention in respect of the second applicant (adopted by five votes in favor and two against).

 


COMPENSATION

 


In application of Article 41 of the Convention. The Court awards the second applicant EUR 10,000 in respect of non-pecuniary damage.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В августе 2015 года журнал правого толка опубликовал статью, в которой автор называл лиц, освобожденных из концентрационного лагеря Маутхаузен в 1945 году, "чумой", а бывших пленных - "уголовниками", которые "заполонили страну", "грабя, разоряя, убивая и оскверняя". Уголовное дело, возбужденное против автора статьи, было прекращено. В феврале 2016 года тот же журнал опубликовал статью этого же автора, сообщая о прекращении производства по уголовному делу против него и повторяя обжалованные указанные выше высказывания.

 

Заявитель, переживший Холокост, активист и бывший пленный Маутхаузена, подал иск на основании статей 6 и 8а Закона о средствах массовой информации в отношении статьи 2016 года, требуя выплаты компенсации морального вреда и опровержения изложенной в статье информации. Суды Австрии отклонили его иск, утверждая, что нельзя было установить, что заявителя можно было идентифицировать индивидуально и что никто не мог быть лично задет этой статьей, в которой в основном сообщалось о результатах рассмотрения уголовного дела.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения пункта 1 статьи 35 Конвенции. Чтобы защитить свою репутацию от клеветнических утверждений, заявитель мог выбирать среди нескольких юридических способов. Целями заявителя в ходе рассмотрения его дела в Австрии было (1) заставить суды государства-ответчика признать, что оспариваемые отрывки из статьи 2016 годы были клеветническими по содержанию и нарушали его личные права, защищаемые статьей 8 Конвенции, опровергнуть соответствующие высказывания и опубликовать опровержение, (2) получить компенсацию морального вреда, предположительно причиненного ему в результате публикации рассматриваемой статьи.

 

(а) Эффективность средств правовой защиты согласно статье 1330 Гражданского кодекса и статьям 12 и 14(1) Закона о средствах массовой информации. Власти Австрии утверждали, что заявителю было необходимо подать иски на основании статьи 1330 Гражданского кодекса в отношении статей, опубликованных в 2015 и 2016 годах. Это являлось бы эффективным средством правовой защиты для первой заявленной цели, а именно для опровержения утверждений, содержавшихся в рассматриваемых статьях.

 

Европейский Суд регулярно присуждал компенсации морального вреда в случаях, когда личные права заявителя нарушались публикациями в средствах массовой информации. В некоторых случаях Европейский Суд приходил к выводу, что установление факта нарушения статьи 8 Конвенции само по себе являлось достаточной справедливой компенсацией, и отклонял требование о компенсации морального вреда. Из прецедентной практики Европейского Суда, касающейся личных прав в связи с публикациями в средствах массовой информации, следует, a fortiory, что доступное на внутригосударственном уровне средство правовой защиты должно предоставлять судам как минимум возможность присуждения компенсации вреда, если это уместно в обстоятельствах конкретного дела. Соответственно, средство правовой защиты, которое не позволяет подать иск о компенсации морального вреда, не может считаться эффективным в отношении жалоб на неприкосновенность частной жизни, гарантированную статьей 8 Конвенции.

 

Поскольку второй целью заявителя было получить компенсацию морального вреда за публикацию оспариваемых статей, следовательно, иск на основании статьи 1330 Гражданского кодекса не мог считаться эффективным средством, поскольку он не предоставлял возможности получения возмещения за причиненный вред в случае установления факта нарушения личных прав. Аналогичные доводы применимы к средствам правовой защиты в соответствии со статьями 12 и 14(1) Закона о средствах массовой информации, которые в отличие от исков на основании статей 6 и 7с Закона о средствах массовой информации не предусматривали возможности подачи иска о компенсации.

 

(b) Эффективность иска на основании статей 6 и 8а Закона о средствах массовой информации в отношении статьи 2015 года. Часть вторая статьи 8а Закона о средствах массовой информации требовала, чтобы иск в соответствии со статьями 6 и 8а Закона о средствах массовой информации был подан в отношении первой публикации, содержавшей предположительно диффамационные утверждения. Власти Австрии отмечали, что в деле заявителя, касавшемся статьи 2015 года, он не исчерпал внутригосударственные средства правовой защиты, пропустив шестимесячный срок для подачи жалобы.

 

Если следовать логике властей Австрии, то это означало бы, что заявитель более не располагал средством правовой защиты, доступным в отношении первой статьи, когда была опубликована вторая статья. Однако суды Австрии не объяснили, был ли этот крайний срок, в отношении "распространения первой статьи" применим и ко всем иным случаям повторяющихся высказываний в другом контексте в новых статьях в прессе. Отсутствие объяснения было тем более значимым, поскольку статья была опубликована под другим заголовком и в ней были добавлены новые комментарии и фрагменты, которых не было в первой статье.

 

Европейский Суд также отклонил возражение властей Австрии относительно того, что заявитель мог сообщить об обжалуемых высказываниях в прокуратуру в соответствии со статьей 297 Уголовного кодекса, требуя проведения расследования на основании статей 111 и 115 данного Кодекса.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

Жалоба объявлена приемлемой для рассмотрения по существу (принято единогласно).

 

По поводу соблюдения статьи 8 Конвенции. Относящиеся к делу факты касались частной жизни заявителя, даже если его имя не было названо в оспариваемой статье.

 

Прежде всего следует отметить, что суд первой инстанции установил, что у истца не было юридических оснований для подачи иска. Сам вопрос о том, могли ли члены группы быть лично затронуты высказыванием об историческом событии, касавшемся данной группы, которая в период этого события была значительной, но со временем сократилась, как в случае с заявителем, еще не рассматривался судами Австрии. Апелляционный суд вообще не упомянул вопрос о юридических основаниях, несмотря на явный недостаток прецедентной практики, развернутые доводы, приведенные заявителем в его первоначальном иске и жалобе, и тот факт, что определение этого предварительного вопроса было существенным для рассмотрения иска по существу. В связи с тем что каких-либо выводов в этом отношении сделано не было, суть иска заявителя, а именно то, что, по его мнению, он действительно лично пострадал от диффамационного характера высказываний, поскольку рассматриваемая группа лиц сократилась до небольшого количества человек, так никогда и не была рассмотрена судами Австрии.

 

Анализируя оспариваемые высказывания в контексте статьи 2016 года, Европейский Суд не был убежден позицией судов Австрии о том, что истец не мог быть затронут высказываниями, приведенными в данной статье. Содержание статьи 2016 года значительно отличалось от статьи 2015 года: статья 2015 года была посвящена историческому событию, освобождению заключенных из лагеря Маутхаузен, а статья 2016 года касалась уголовных расследований в отношении автора статей и человека, который предоставил информацию прокуратуре. Следовательно, было необходимо представить всестороннее объяснение причин для подобного толкования со стороны судов Австрии.

 

Из-за отсутствия всестороннего исследования вопросов юридического обоснования и о том, имели ли высказывания то же или иное значение в контексте статьи 2016 года, суды Австрии фактически никогда не рассматривали иск заявителя о диффамации по существу. Соответственно, они не выполнили свое предусмотренное статьей 8 Конвенции процессуальное обязательство по проведению всестороннего рассмотрения вопроса, касающегося защиты личных прав человека.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 648,48 евро в качестве компенсации материального ущерба и 5 000 евро в качестве компенсации морального вреда.

Urteil des EGMR vom 10. Oktober 2019 in der Rechtssache Levit gegen Österreich (Lewit gegen Österreich) (Beschwerde Nr. 4782/18).

 

Im Jahr 2018 wurde der Antragsteller bei der Vorbereitung der Beschwerde unterstützt. Anschließend wurde die Beschwerde an Österreich weitergeleitet.

 

In diesem Fall wurde eine Beschwerde in Bezug auf einen in den Medien veröffentlichten verleumderischen Artikel, der die Persönlichkeitsrechte des Antragstellers verletzt, erfolgreich geprüft. Der Fall hat gegen die Anforderungen von Artikel 8 der Konvention zum Schutz der Menschenrechte und Grundfreiheiten in Bezug auf den Antragsteller verstoßen.

 


Umstände des Falles

 


Im August 2015 veröffentlichte eine rechtsgerichtete Zeitschrift einen Artikel, in dem der Autor die 1945 aus dem Konzentrationslager Mauthausen entlassenen Menschen als "Pest" und die ehemaligen Gefangenen als "Kriminelle" bezeichnete, die "in das Land einmarschierten", beraubten, ruinierten, töteten und beschmutzen. " Das Strafverfahren gegen den Verfasser des Artikels wurde abgewiesen. Im Februar 2016 veröffentlichte dieselbe Zeitschrift einen Artikel desselben Autors, in dem über die Beendigung des Strafverfahrens gegen ihn berichtet und die Einsprüche gegen die obigen Aussagen wiederholt wurden.

 

Der Holocaust-Überlebende, ein Aktivist und ehemaliger Gefangener von Mauthausen, reichte in Bezug auf Artikel 2016 eine Klage nach Artikel 6 und 8a des Mediengesetzes ein, in der er eine Entschädigung für immaterielle Schäden und eine Widerlegung der in dem Artikel enthaltenen Informationen forderte. Österreichische Gerichte wiesen seine Klage mit der Begründung zurück, es könne nicht nachgewiesen werden, dass der Beschwerdeführer einzeln identifiziert werden könne und dass niemand persönlich von diesem Artikel betroffen gewesen sei, der hauptsächlich über den Ausgang des Strafverfahrens berichtete.

 


FRAGEN DES RECHTS

 


In Bezug auf die Einhaltung von Artikel 35 Absatz 1 des Übereinkommens. Um seinen Ruf vor verleumderischen Ansprüchen zu schützen, konnte der Antragsteller zwischen verschiedenen Rechtsmethoden wählen. Das Ziel des Beschwerdeführers bei der Prüfung seines Falls in Österreich bestand darin, (1) die Gerichte des befragten Staates zu zwingen, zuzugeben, dass die umstrittenen Passagen von Artikel 2016 inhaltlich verleumderisch waren und seine durch Artikel 8 des Übereinkommens geschützten Persönlichkeitsrechte verletzten, die entsprechenden Erklärungen zu widerlegen und eine Widerlegung zu veröffentlichen ( 2) eine Entschädigung für immaterielle Schäden erhalten, die ihm angeblich durch die Veröffentlichung des betreffenden Artikels entstanden sind.

 

(a) Die Wirksamkeit der Rechtsmittel gemäß § 1330 des Bürgerlichen Gesetzbuchs und §§ 12 und 14 Abs. 1 des Mediengesetzes. Die Regierung machte geltend, dass der Antragsteller Ansprüche nach Artikel 1330 des Bürgerlichen Gesetzbuchs in Bezug auf in den Jahren 2015 und 2016 veröffentlichte Artikel geltend machen müsse. Dies wäre ein wirksames Mittel gegen den erstgenannten Zweck, nämlich die in den fraglichen Artikeln enthaltenen Behauptungen zu widerlegen.

 

In Fällen, in denen die Persönlichkeitsrechte des Beschwerdeführers durch Medienpublikationen verletzt wurden, hat das Gericht regelmäßig immateriellen Schadenersatz gewährt. In einigen Fällen gelangt der Gerichtshof zu dem Schluss, dass die Feststellung eines Verstoßes gegen Artikel 8 des Übereinkommens an sich ausreicht, um die Befriedigung zu gewährleisten, und lehnte den Antrag auf nicht finanziellen Schaden ab. Aus der Rechtsprechung des Gerichtshofs zu Persönlichkeitsrechten im Zusammenhang mit Veröffentlichungen in den Medien folgt vierzig, dass ein innerstaatlicher Rechtsbehelf den Gerichten zumindest die Möglichkeit bieten sollte, gegebenenfalls unter den Umständen eines bestimmten Falles Schadensersatz zu gewähren. Dementsprechend kann ein Rechtsbehelf, der keinen Anspruch auf Schadensersatz für immaterielle Schäden zulässt, nicht als wirksam in Bezug auf Beschwerden über die Privatsphäre angesehen werden, die durch Artikel 8 des Übereinkommens garantiert werden.

 

Da der zweite Zweck des Antragstellers darin bestand, eine Entschädigung für einen nicht finanziellen Schaden für die Veröffentlichung der streitigen Artikel zu erhalten, konnte eine Klage nach Artikel 1330 des Bürgerlichen Gesetzbuchs nicht als wirksames Mittel angesehen werden, da sie keine Gelegenheit bot, eine Entschädigung für den Schaden zu erhalten, der im Falle der Feststellung einer Verletzung der Persönlichkeitsrechte entstanden war. Ähnliche Argumente gelten für Rechtsmittel gemäß Artikel 12 und 14 Absatz 1 des Mediengesetzes, die im Gegensatz zu den Ansprüchen nach Artikel 6 und 7c des Mediengesetzes keine Möglichkeit zur Einreichung eines Schadensersatzanspruchs vorsahen.

 

(b) Die Wirksamkeit des Anspruchs nach Artikel 6 und 8a des Mediengesetzes in Bezug auf Artikel 2015. Gemäß Abschnitt 8a Teil 2 des Mediengesetzes musste eine Klage gemäß den Abschnitten 6 und 8a des Mediengesetzes bezüglich der ersten Veröffentlichung eingereicht werden, die angeblich diffamierende Anschuldigungen enthielt. Die Regierung stellte fest, dass der Beschwerdeführer im Fall des Artikels von 2015 die innerstaatlichen Rechtsbehelfe nicht ausgeschöpft hatte und die sechsmonatige Frist für die Einreichung einer Beschwerde verpasst hatte.

 

Nach der Logik der österreichischen Behörden würde dies bedeuten, dass der Antragsteller bei Veröffentlichung des zweiten Artikels nicht mehr über das Rechtsmittel für den ersten Artikel verfügte. Die österreichischen Gerichte haben jedoch nicht erläutert, ob diese Frist im Hinblick auf die „Verbreitung des ersten Artikels“ auf alle anderen Fälle wiederholter Aussagen in einem anderen Kontext in neuen Artikeln in der Presse anwendbar ist. Der Mangel an Erklärung war umso bedeutender, als der Artikel unter einer anderen Überschrift veröffentlicht wurde und neue Kommentare und Fragmente hinzugefügt wurden, die nicht im ersten Artikel enthalten waren.

 

Der Gerichtshof wies auch den Einwand der österreichischen Regierung zurück, dass der Beschwerdeführer die beanstandeten Beschwerden gemäß Artikel 297 des Strafgesetzbuchs dem Staatsanwalt melden könne, und forderte eine Untersuchung auf der Grundlage der Artikel 111 und 115 dieses Kodex.

 


AUFLÖSUNG

 


Die Beschwerde wird in der Sache für zulässig erklärt (einstimmig angenommen).

 

In Bezug auf die Einhaltung von Artikel 8 des Übereinkommens. Die relevanten Tatsachen betrafen das Privatleben des Beschwerdeführers, auch wenn sein Name im angefochtenen Artikel nicht erwähnt wurde.

 

Zunächst ist darauf hinzuweisen, dass das Gericht festgestellt hat, dass der Kläger keine rechtlichen Gründe für die Einreichung eines Anspruchs hatte. Die Frage, ob die Mitglieder der Gruppe persönlich von der Aussage über ein historisches Ereignis in Bezug auf diese Gruppe betroffen sein könnten, die während des Zeitraums dieses Ereignisses erheblich war, aber wie im Fall des Antragstellers im Laufe der Zeit zurückging, wurde von den österreichischen Gerichten noch nicht geprüft. Das Berufungsgericht erwähnte die Frage der rechtlichen Gründe trotz des offensichtlichen Mangels an Rechtsprechung, der detaillierten Argumente, die der Beschwerdeführer in seiner ursprünglichen Klage und Beschwerde vorbrachte, und der Tatsache, dass die Feststellung dieser vorläufigen Frage für die Prüfung der Klage in der Sache von wesentlicher Bedeutung war, überhaupt nicht. Aufgrund der Tatsache, dass diesbezüglich keine Schlussfolgerungen gezogen wurden, war das Wesentliche der Behauptung des Beschwerdeführers, dass er seiner Meinung nach wirklich persönlich unter dem diffamierenden Charakter der Aussagen gelitten habe, da die betrachtete Personengruppe auf eine kleine Anzahl von Personen reduziert worden sei Es wurde von den Gerichten Österreichs nie berücksichtigt.

 

Bei der Analyse der umstrittenen Aussagen im Zusammenhang mit dem Artikel von 2016 war der Gerichtshof von der Position der österreichischen Gerichte nicht überzeugt, dass der Kläger von den in diesem Artikel gemachten Aussagen nicht betroffen sein könnte. Der Inhalt des Artikels 2016 unterschied sich erheblich vom Artikel 2015: Der Artikel 2015 widmete sich einem historischen Ereignis, der Freilassung von Gefangenen aus dem Lager Mauthausen und dem Artikel 2016 im Zusammenhang mit strafrechtlichen Ermittlungen gegen den Verfasser der Artikel und die Person, die der Staatsanwaltschaft Informationen zur Verfügung stellte. Folglich war es notwendig, die Gründe für diese Auslegung durch die österreichischen Gerichte umfassend zu erläutern.

 

Aufgrund des Fehlens einer umfassenden Untersuchung von rechtlichen Begründungsfragen und der Frage, ob die Aussagen im Zusammenhang mit dem Artikel von 2016 von gleicher oder anderer Bedeutung waren, haben die österreichischen Gerichte den Antrag des Beschwerdeführers auf Verleumdung in der Sache nie tatsächlich geprüft. Dementsprechend haben sie ihre verfahrenstechnische Verpflichtung gemäß Artikel 8 der Konvention nicht erfüllt, eine umfassende Überprüfung der Frage des Schutzes der persönlichen Menschenrechte durchzuführen.

 


AUFLÖSUNG

 


Der Fall enthielt einen Verstoß gegen Artikel 8 des Übereinkommens (einstimmig angenommen).

 


VERGÜTUNG

 


In Anwendung von Artikel 41 des Übereinkommens. Der Gerichtshof hat dem Beschwerdeführer 648,48 EUR für Vermögensschäden und 5.000 EUR für Sachschäden zuerkannt.

ECHR judgment of 10 October 2019 in the case of Levit v. Austria (Lewit v. Austria) (application No. 4782/18).

 

In 2018, the applicant was assisted in preparing the application. Subsequently, the application was communicated to Austria.

 

In the case, an application was successfully examined regarding a slanderous article published in the media that violates the applicant’s personal rights. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms in respect of the applicant.

 


Circumstances of the case

 


In August 2015, a right-wing magazine published an article in which the author called the people released from the Mauthausen concentration camp in 1945 "the plague," and the former prisoners "criminals" who "invaded the country," robbing, ruining, killing and defiling. " The criminal case against the author of the article was dismissed. In February 2016, the same magazine published an article by the same author, reporting the termination of criminal proceedings against him and repeating the appeals of the above statements.

 

The Holocaust survivor, an activist and former prisoner of Mauthausen, filed a lawsuit under Articles 6 and 8a of the Media Law in relation to article 2016, demanding compensation for non-pecuniary damage and a refutation of the information contained in the article. Austrian courts dismissed his lawsuit, arguing that it could not be established that the applicant could be identified individually and that no one could have been personally affected by this article, which mainly reported on the outcome of the criminal case.

 


QUESTIONS OF LAW

 


Regarding compliance with Article 35 § 1 of the Convention To protect his reputation from slanderous claims, the applicant could choose among several legal methods. The objectives of the applicant during the consideration of his case in Austria were (1) to compel the courts of the respondent State to admit that the disputed passages of Article 2016 were libelous in content and violated his personal rights protected by Article 8 of the Convention, refute the relevant statements and publish a refutation, ( 2) receive compensation for non-pecuniary damage allegedly caused to him as a result of the publication of the article in question.

 

(a) The effectiveness of the remedies pursuant to section 1330 of the Civil Code and sections 12 and 14 (1) of the Media Act. The Government submitted that it was necessary for the applicant to file claims under article 1330 of the Civil Code in relation to articles published in 2015 and 2016. This would be an effective remedy for the first stated purpose, namely, to refute the allegations contained in the articles in question.

 

The Court has regularly awarded non-pecuniary damage in cases where the applicant’s personal rights were violated by media publications. In some cases, the Court concludes that the finding of a violation of Article 8 of the Convention was in itself sufficient just satisfaction and rejected the claim for non-pecuniary damage. From the Court's case-law on personal rights in connection with publications in the media, it follows, a fortiory, that a domestic remedy should provide the courts with at least the possibility of awarding damages if appropriate in the circumstances of a particular case. Accordingly, a remedy that does not allow a claim for non-pecuniary damage cannot be considered effective in respect of complaints of privacy guaranteed by Article 8 of the Convention.

 

Since the second purpose of the applicant was to obtain compensation for non-pecuniary damage for the publication of the disputed articles, therefore, a lawsuit under Article 1330 of the Civil Code could not be considered an effective means, since it did not provide an opportunity to receive compensation for the damage caused in the event of the establishment of a violation of personal rights. Similar arguments apply to remedies in accordance with Articles 12 and 14 (1) of the Media Law, which, unlike claims under Articles 6 and 7c of the Media Law, did not provide for the possibility of filing a compensation claim.

 

(b) The effectiveness of the claim under Articles 6 and 8a of the Media Act in relation to article 2015. Part two of Section 8a of the Media Law required that a lawsuit be filed in accordance with sections 6 and 8a of the Media Law regarding the first publication containing allegedly defamatory allegations. The Government noted that in the applicant's case concerning the 2015 article, he had not exhausted domestic remedies, missing the six-month deadline for filing a complaint.

 

Following the logic of the Austrian authorities, this would mean that the applicant no longer had the remedy available in respect of the first article when the second article was published. However, the Austrian courts did not explain whether this deadline, with regard to the “distribution of the first article”, was applicable to all other cases of repeated statements in a different context in new articles in the press. The lack of explanation was all the more significant since the article was published under a different heading and new comments and fragments were added in it, which were not in the first article.

 

The Court also rejected the Austrian Government's objection that the applicant could report the appealed complaints to the prosecutor in accordance with Article 297 of the Criminal Code, demanding an investigation on the basis of Articles 111 and 115 of this Code.

 


RESOLUTION

 


The complaint is declared admissible on the merits (accepted unanimously).

 

Regarding compliance with article 8 of the Convention. The relevant facts concerned the applicant’s private life, even if his name was not mentioned in the contested article.

 

First of all, it should be noted that the trial court found that the plaintiff had no legal grounds for filing a claim. The very question of whether the members of the group could have been personally affected by the statement about a historical event concerning this group, which during the period of this event was significant but declined over time, as in the case of the applicant, has not yet been examined by the Austrian courts. The Court of Appeal did not mention the issue of legal grounds at all, despite the obvious lack of case-law, the detailed arguments presented by the applicant in his initial claim and complaint, and the fact that the determination of this preliminary question was essential for the consideration of the claim on the merits. Due to the fact that no conclusions were made in this regard, the essence of the applicant’s claim, namely that, in his opinion, he really personally suffered from the defamatory nature of the statements, since the group of persons under consideration was reduced to a small number of people, so It has never been considered by the courts of Austria.

 

Analyzing the disputed statements in the context of the 2016 article, the Court was not convinced by the position of the Austrian courts that the plaintiff could not be affected by the statements made in this article. The content of the 2016 article was significantly different from the 2015 article: the 2015 article was devoted to a historical event, the release of prisoners from the Mauthausen camp, and the 2016 article related to criminal investigations against the author of the articles and the person who provided information to the prosecutor. Consequently, it was necessary to provide a comprehensive explanation of the reasons for this interpretation by the Austrian courts.

 

Due to the lack of a comprehensive study of legal substantiation issues and whether the statements were of the same or other significance in the context of the 2016 article, the Austrian courts never actually examined the applicant’s claim for defamation on the merits. Accordingly, they failed to fulfill their procedural obligation under article 8 of the Convention to conduct a comprehensive review of the issue of the protection of personal human rights.

 


RESOLUTION

 


In the case there was a violation of the requirements of Article 8 of the Convention (adopted unanimously).

 


COMPENSATION

 


In application of Article 41 of the Convention. The Court awarded the applicant EUR 648.48 in respect of pecuniary damage and EUR 5,000 in respect of non-pecuniary damage.
