Постановление Межамериканского суда по правам человека от 23 ноября 2015 года по делу "Киспиалая Вилкапома (Quispialaya Vilcapoma) против Перу" (серия C, N 308).

Заявителю была оказана помощь в подготовке жалобы в Межамериканскую комиссию по правам человека (г. Вашингтон, США).

Впоследствии Межамериканская комиссия по правам человека передала жалобу заявителя для рассмотрения в Межамериканский суд по правам человека (г. Сан-Хосе, Коста-Рика). Затем жалоба была коммуницирована Перу.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

26 января 2001 г. командир ударил в лоб и правый глаз Вальдемира Киспиалаю Вилькапому прикладом его винтовки во время стрелковых занятий, поскольку тот не смог стрелять правильно. Из-за полученной травмы Киспиалая потерял зрение на правом глазу и впоследствии страдал от депрессии. Вышеупомянутые действия были обусловлены практикой злоупотребления, существовавшей в Перу, где физическое и психологическое насилие применялось для поддержания военной дисциплины и авторитета. Судебное разбирательство по поводу нападения было инициировано в судах общей юрисдикции и военных судах. Тем не менее никто не был осужден за эти действия.

 

ВОПРОСЫ ПРАВА

 

(a) Предварительные возражения. Государство представило два предварительных возражения по поводу неисчерпания внутренних средств правовой защиты. Первое возражение было отклонено на том основании, что средство правовой защиты, на которое ссылалось государство в разбирательстве о приемлемости, отличалось от того, которое упоминалось в Межамериканском суде. Второе предварительное возражение заключалось в том, что, по мнению Межамериканского суда, вопрос относился к репарационной мере, запрошенной представителями потерпевших, и, таким образом, не мог анализироваться в качестве предварительного возражения. На основе стандартов, установленных Европейским Судом (см. Постановление Европейского Суда по делу "Чембер против Российской Федерации" (Chember v. Russia) от 3 июля 2008 г., жалоба N 7188/03, § 50, "Информационный бюллетень по прецедентной практике Европейского Суда по правам человека" N 110, Постановление Европейского Суда по делу "Плачи против Италии" (Placì v. Italy) от 21 января 2014 г., жалоба N 48754/11, § 51, "Информационный бюллетень по прецедентной практике Европейского Суда по правам человека" N 170, Постановление Европейского Суда по делу "Лариссис и другие против Греции" (Larissis and Others v. Greece) от 24 февраля 1998 г., жалоба N 23372/94, §§ 50 - 51, и Постановление Европейского Суда по делу "Константин Маркин против Российской Федерации" (Konstantin Markin v. Russia) от 22 марта 2012 г., жалоба N 30078/06, § 135, "Информационный бюллетень по прецедентной практике Европейского Суда по правам человека" N 150) и Комитета ООН по правам человека (Замечание общего порядка N 35, 16 декабря 2014, UN Doc. CCPR/C/GC/35, §§ 5 - 6), Межамериканский суд определил, что конкретная ситуация, в соответствии с которой проходит военная служба, влечет ограничения прав и свобод призывников. Следовательно, существует презумпция, что государство несет ответственность за предполагаемые нарушения личной неприкосновенности лиц, находящихся под властью и контролем представителей государства, как на военной службе. Анализируя нападение, совершенное на Киспиалаи, Межамериканский суд рассмотрел многие факторы, такие как злоупотребляющее поведение военных властей, насилие, проявленное нападавшим, беззащитность потерпевшего, его обоснованный страх, угрозы, высказанные нападавшим с целью избежания осуждения, медицинские документы, и объяснения эксперта по психологии, имеющиеся в настоящем деле. (c) Статьи 8(1) (право на справедливое судебное разбирательство) и 25 (право на судебную защиту) во взаимосвязи со статьей 1(1) (обязательство соблюдать права) ACHR и статьи 1, 6 и 8 IACPPT. Кроме того, Межамериканский суд пришел к выводу, что вышеизложенные факты должны были быть расследованы и впоследствии осуждены и наказаны в рамках уголовного разбирательства в судах общей юрисдикции. Соответственно, Межамериканский суд установил, что решение постоянной палаты по уголовным делам Верховного суда Перу нарушило принцип компетентного суда, воспрепятствовав расследованию и рассмотрению дела судами общей юрисдикции и сохранив военную юрисдикцию дела в 2002 - 2007 годах. Межамериканский суд счел это неоправданным распространением системы военной юстиции, что привело к нарушению требований статьи 8(1) ACHR.

В отношении вмешательства судов общей юрисдикции Межамериканский суд указал на ряд недостатков в их деятельности. Суды не рассматривали факты старательно и эффективно, они также не анализировали доказательства, переданные военным судьей. В частности, следственные органы также проявили халатность при выявлении свидетелей. Кроме того, Межамериканский суд решил, что государство потратило неразумное количество времени для проведения расследования. С учетом вышеизложенного Межамериканский суд заключил, что государство нарушило права на справедливое судебное разбирательство и на судебную защиту, предусмотренные статьями 8(1) и 25 ACHR, а также обязательства, установленные в статьях 1, 6 и 8 IACPPT.

Что касается запугивания и угроз в отношении заявителя, Межамериканский суд пришел к выводу, что расследование, проведенное государством, было неэффективным, что составляло нарушение права на судебную защиту, установленное статьей 25(1) ACHR.

(e) Статья 2 (внутригосударственные правовые последствия) ACHR во взаимосвязи со статьей 6 IACPPT. Что касается обязанности принять внутригосударственные меры, Межамериканский суд решил, что статья 6 IACPPT касается пытки и другого жестокого, бесчеловечного или унижающего достоинство обращения или наказания иным образом, что подтверждают различные обязанности, возлагаемые Конвенцией при разных обстоятельствах. Пункт 2 статьи 6 ACHR устанавливает обязанность принять национальное законодательство, признающее акты пытки уголовно наказуемым преступлением в юрисдикции государства. Что касается жестокого, бесчеловечного или унижающего достоинство обращения или наказания, устанавливает обязанность принятия мер для предотвращения и наказания таких мер, но не устанавливает обязанность принятия соответствующего внутригосударственного уголовного законодательства. В этом смысле Межамериканский суд пришел к выводу, что предотвращение и преследование жестокого, бесчеловечного или унижающего достоинство обращения или наказания могли быть достигнуты в настоящем деле за счет использования иных целесообразных уголовных преступлений, уже предусмотренных в Уголовном кодексе (например, тяжкий вред здоровью). Кроме того, Межамериканский суд отметил, что, хотя такое преступление, как пытка, предусмотрено для случаев особого значения, это не предполагает, что случай причинения вреда здоровью менее тяжкий в Перу, поскольку наказание, установленное во внутригосударственном законодательстве за подобное преступление, такое же строгое, как и установленное за пытку. Исходя из этого Межамериканский суд заключил, что такое преступление, как причинение тяжкого вреда здоровью, само по себе не нарушает обязательство предотвращать и наказывать иное жестокое, бесчеловечное или унижающее достоинство обращение или наказание. По этой причине Межамериканский суд не признал государство ответственным за нарушение требований статьи 2 ACHR или статьи 6 IACPPT.

 

ПОСТАНОВЛЕНИЕ

 

По делу требования Конвенции нарушены не были (принято единогласно).

(g) Компенсация. Межамериканский суд постановил, что данное постановление само по себе является формой компенсации, и, в частности, обязал государство (i) продолжить и завершить в разумный срок расследование нарушения личной неприкосновенности Киспиалаи и, если применимо, наказать виновных, (ii) обеспечить регулярные и непредвиденные визиты независимых, автономных и компетентных органов в военные казармы, где проходит военная служба, для наблюдения за условиями ее прохождения и осуществления прав призывников, (iii) выдать сертификат инвалидности Киспиалае в связи с травмами, полученными на военной службе, (iv) незамедлительно предоставить Киспиалае льготы, связанные с пенсией по инвалидности, опубликовать постановление и официальную выдержку из него, (iv) принести публичные извинения, (v) обеспечить доступ Киспиалаи к образовательным программам технического или профессионального характера, а также (vi) выплатить компенсацию материального ущерба и морального вреда, а также судебных расходов и издержек.

El fallo de la Corte Interamericana de Derechos Humanos de 23 de noviembre de 2015 en el caso de Quispialaya Vilcapoma v. Perú (Serie C, No. 308).

El solicitante recibió asistencia para preparar una queja ante la Comisión Interamericana de Derechos Humanos (Washington, EE. UU.).

Circunstancias del caso


El 26 de enero de 2001, el comandante golpeó a Valdemir Kispialai Vilkapoma en la frente y el ojo derecho con la culata de su rifle durante los ejercicios, ya que no podía disparar correctamente. Debido a la lesión, Kispialaya perdió la vista en su ojo derecho y posteriormente sufrió de depresión. PREGUNTAS DE LEY


(a) Objeciones preliminares. El Estado ha presentado dos objeciones preliminares a la falta de agotamiento de los recursos internos. La primera objeción fue desestimada por el hecho de que el recurso invocado por el Estado en los procedimientos de admisibilidad era diferente del mencionado en la Corte Interamericana. La segunda objeción preliminar fue que, en opinión de la Corte Interamericana, la cuestión relacionada con la medida de reparación solicitada por los representantes de las víctimas y, por lo tanto, no podía analizarse como una objeción preliminar. Además, el plazo de prescripción ha expirado con respecto al argumento del Estado.

(b) Artículos 5 (1) (derecho a la seguridad de la persona) y 5 (2) (prohibición de tortura y castigos o tratos crueles, inhumanos o degradantes) de la Convención Americana sobre Derechos Humanos (en adelante, CADH) junto con el artículo 1 (1) ) de la misma Convención y el artículo 6 de la Convención Interamericana para Prevenir y Sancionar la Tortura (en adelante, IACPPT). (c) Artículos 8 (1) (derecho a un juicio justo) y 25 (derecho a protección judicial) junto con el Artículo 1 (1) (obligación de respetar los derechos) de la CADH y los Artículos 1, 6 y 8 del IACPPT. Además, la Corte Interamericana concluyó que los hechos anteriores deberían haber sido investigados y posteriormente condenados y castigados en procesos penales en tribunales de jurisdicción general. (e) Artículo 2 (consecuencias legales internas) de la CADH en conjunto con el Artículo 6 del IACPPT. Con respecto a la obligación de tomar medidas internas, la Corte Interamericana decidió que el artículo 6 de la IACPPT se ocupa de la tortura y otros tratos o penas crueles, inhumanos o degradantes de cualquier otra manera, lo que confirma las diversas obligaciones impuestas por la Convención en diferentes circunstancias. El artículo 6, párrafo 2, de la CADH establece la obligación de promulgar legislación nacional que penalice los actos de tortura en la jurisdicción del estado. Con respecto a los tratos o penas crueles, inhumanos o degradantes, establece la obligación de tomar medidas para prevenir y sancionar tales medidas, pero no establece la obligación de adoptar el derecho penal interno apropiado. En este sentido, la Corte Interamericana concluyó que la prevención y el enjuiciamiento de los tratos o penas crueles, inhumanos o degradantes podrían lograrse en el presente caso utilizando otros delitos penales apropiados ya previstos en el Código Penal (por ejemplo, daños corporales graves). Además, la Corte Interamericana señaló que, aunque un delito como la tortura se proporciona para casos de especial importancia, esto no implica que el caso de lesiones personales sea menos severo en Perú, ya que el castigo establecido en la legislación nacional para dicho delito es igualmente severo. según lo establecido para la tortura. RESOLUCIÓN

(g) Compensación. La Corte Interamericana dictaminó que esta decisión es en sí misma una forma de compensación y, en particular, ordenó al estado que (i) continúe y complete dentro de un tiempo razonable una investigación sobre la violación de la integridad personal de Kispialai y, si corresponde, castigue a los responsables, (ii) garantice la regularidad e imprevisto visitas de autoridades independientes, autónomas y competentes a los cuarteles militares donde se realiza el servicio militar, para controlar las condiciones de su paso y ejercer los derechos de los reclutas, (iii) emitir un certificado de discapacidad a Kispialae en relación con las lesiones sufridas en el servicio militar, (iv) proporcionar inmediatamente Kispialae beneficios de pensión de invalidez, publicar un decreto y un extracto oficial del mismo, (iv) hacer una disculpa pública, (v) garantizar el acceso de Kispialai a programas educativos de naturaleza técnica o profesional, y (vi) pagar una indemnización por daños materiales y no materiales, así como los costos y gastos legales.

The second preliminary objection was that, in the opinion of the Inter-American Court, the issue related to the reparation measure requested by the representatives of the victims and, therefore, could not be analyzed as a preliminary objection. In addition, the statute of limitations has expired with respect to the State's argument.

Based on this, the Inter-American Court concluded that the standards set for persons deprived of their liberty are applicable to servicemen who are in active military service in the barracks, since the state has a special guarantor position with respect to persons under its control or under the influence of relations between the boss and subordinates. Thus, in relation to persons subject to such a special relationship, the Inter-American Court has indicated that the state is obliged (i) to ensure the health and well-being of military service members, (ii) to ensure that the method and method of training does not go beyond the inevitable level of suffering inherent military service, and (iii) provide a satisfactory and convincing explanation of the harm done to the health of those in military service. Consequently, there is a presumption that the state is responsible for alleged violations of the personal integrity of persons under the authority and control of state representatives, as in military service. Analyzing the attack on Kispialai, the Inter-American Court examined many factors, such as the abusive behavior of the military authorities, the violence shown by the attacker, the defenselessness of the victim, his legitimate fear, threats made by the attacker to avoid conviction, medical documents, and explanations of a psychologist, available in the present case. For these reasons, the Inter-American Court found that the attack on Kispialai constituted a violation of Articles 5 (1) and 5 (2) of the ACHR and Article 6 of the IACPPT, which prohibit torture and cruel, inhuman or degrading punishment or treatment.

The case has violated the requirements of the Convention (adopted unanimously).

(c) Articles 8 (1) (right to a fair trial) and 25 (right to legal defense) in conjunction with Article 1 (1) (obligation to respect rights) of the ACHR and Articles 1, 6 and 8 of the IACPPT. In addition, the Inter-American Court concluded that the above facts should have been investigated and subsequently convicted and punished in criminal proceedings in courts of general jurisdiction. Accordingly, the Inter-American Court found that the decision of the Permanent Court of Criminal Cases of the Supreme Court of Peru violated the principle of a competent court, hindering the investigation and consideration of the case by the courts of general jurisdiction and retaining the military jurisdiction of the case in 2002-2007. The Inter-American Court considered this an unjustified extension of the military justice system, which led to a violation of the requirements of Article 8 (1) of the ACHR.

With regard to the interference of courts of general jurisdiction, the Inter-American Court pointed out a number of shortcomings in their activities. The courts did not examine the facts diligently and effectively, nor did they analyze the evidence transmitted by the military judge. In particular, the investigating authorities also showed negligence in identifying witnesses. In addition, the Inter-American Court decided that the state spent an unreasonable amount of time to conduct an investigation. Subject to the foregoing, the Inter-American Court concluded that the state violated the rights to a fair trial and to the judicial protection provided for in Articles 8 (1) and 25 of the ACHR, as well as the obligations set forth in Articles 1, 6 and 8 of the IACPPT.

As regards intimidation and threats against the applicant, the Inter-American Court concluded that the investigation conducted by the state was ineffective, which amounted to a violation of the right to judicial protection established by Article 25 (1) of the ACHR.

(d) Section 5 (right to security of person) in conjunction with section 1 (1) (obligation to respect rights) ACHR. The Inter-American court took into account the close relationship between Victoria Vilcapoma Takia, the applicant’s mother, and her son, the suffering she experienced due to the consequences of the attack, as well as the threats and intimidation. The Inter-American Court concluded that the state was liable for violation of Article 5 (1) of the ACHR for damage caused to Victoria Vilcapome Takia.

(e) Article 2 (domestic legal consequences) of the ACHR in conjunction with Article 6 of the IACPPT. With regard to the obligation to take domestic measures, the Inter-American Court ruled that Article 6 of the IACPPT deals with torture and other cruel, inhuman or degrading treatment or punishment in any other way, which confirms the various obligations imposed by the Convention under different circumstances. Article 6, paragraph 2, of the ACHR establishes the obligation to enact national legislation that makes torture a criminal offense in the jurisdiction of the state. With regard to cruel, inhuman or degrading treatment or punishment, it establishes the obligation to take measures to prevent and punish such measures, but does not establish the obligation to adopt appropriate domestic criminal law. In this sense, the Inter-American Court concluded that the prevention and prosecution of cruel, inhuman or degrading treatment or punishment could be achieved in the present case through the use of other appropriate criminal offenses already provided for in the Criminal Code (for example, grievous bodily harm). In addition, the Inter-American Court noted that, although a crime such as torture is provided for cases of special significance, this does not imply that the case of personal injury is less severe in Peru, since the punishment established in domestic law for such a crime is equally severe as established for torture. Based on this, the Inter-American Court concluded that a crime of grievous bodily harm does not in itself violate the obligation to prevent and punish other cruel, inhuman or degrading treatment or punishment. For this reason, the Inter-American Court did not hold the state liable for violation of the requirements of Article 2 of the ACHR or Article 6 of the IACPPT.


RESOLUTION


In the case, the requirements of the Convention were not violated (adopted unanimously).

(g) Compensation. The Inter-American Court ruled that this ruling is in itself a form of compensation and, in particular, ordered the state to (i) continue and complete within a reasonable time an investigation into the violation of Kispialai’s personal integrity and, if applicable, punish those responsible, (ii) ensure regular and unforeseen visits by independent, autonomous and competent authorities to military barracks where military service takes place, to monitor the conditions of its passage and exercise the rights of draftees, (iii) issue a certificate of disability to Kispialae in connection with injuries sustained in the military service, (iv) immediately provide Kispialae disability pension benefits, publish a decree and an official extract from it, (iv) make a public apology, (v) ensure Kispialai’s access to educational programs of a technical or professional nature, and (vi) pay compensation for material and non-pecuniary damage, as well as legal costs and expenses.
