Постановление Межамериканского суда по правам человека от 23 ноября 2015 года по делу "Народности калинья и локоно (Kalina and Lokono Peoples) против Суринама" (серия C, N 309).

Заявителям была оказана помощь в подготовке жалобы в Межамериканскую комиссию по правам человека (г. Вашингтон, США).

Впоследствии Межамериканская комиссия по правам человека передала жалобу заявителя для рассмотрения в Межамериканский суд по правам человека (г. Сан-Хосе, Коста-Рика). Затем жалоба была коммуницирована Суринаму.

По делу успешно рассмотрена жалоба на защиту экологических и природных ресурсов с учетом прав коренных народов.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Народы калинья и локоно представляют собой две из четырех крупнейших коренных групп Суринама. Дело касается действий, совершенных народами калинья и локоно для получения признания государством их коллективной дееспособности и права на коллективное владение их традиционными территориями, титулы на которые отсутствовали. Части оспариваемой территории примыкали к поселениям племени ндюка марун. Что касается других спорных территорий, некоренные третьи стороны приобрели имущественные титулы на участки, граничащие с рекой Марони. На спорной территории были созданы три природных заповедника: (i) заповедник Виа-Виа в 1966 году, (ii) заповедник Галиби в 1969 году и (iii) заповедник Уэйн-Крик в 1986 году. Заповедники Виа-Виа и Галиби были созданы для защиты побережья, где гнездились морские черепахи. В определенные периоды были созданы военные посты в пунктах доступа, чтобы помешать членам коренных общин проникать в последний заповедник в связи с увеличением случаев кражи черепашьих яиц. Заповедник Уэйн-Крик был создан для защиты и сохранения экосистем. Добыча бокситов открытым способом проводилась в этом заповеднике в отсутствие эффективного участия названных народов в процессе консультаций. Эти операции вызвали проблемы деградации окружающей среды и ограничения возможности охоты и рыболовства.

Судебное разбирательство, возбужденное народами калинья и локоно, было отклонено, поскольку члены коренных народов не имели правового статуса коллективного лица и не обладали титулом коллективного имущества на спорную территорию, и административные петиции, направленные публичным должностным лицам, не получили ответа.

Для целей этого конкретного дела делегация Межамериканского суда по правам человека (далее - суд) во главе с его председателем осуществила выезд на территорию.

 

ВОПРОСЫ ПРАВА

 

(a) Статья 3 (право на признание правосубъектности) в отношении статей 1(1) (обязанность уважения прав и свобод без какой-либо дискриминации), 2 (значение внутреннего законодательства), 21 (право на имущество) и 25 (право на судебную защиту) Американской конвенции о правах человека (далее - ACHR). Суд напомнил свою практику по предыдущим делам относительно Суринама и определил, что, поскольку законодательство государства не признает коллективную правосубъектность коренных и племенных народов, государство нарушило статью 3 в отношении статьи 2 ACHR. Это также повлекло нарушение других прав, признанных в статьях 1(1), 21 и 25 ACHR.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований статьи 3 ACHR (вынесено шестью голосами "за" и одним - "против").

(b) Статьи 21 и 23 (политические права) в отношении статей 1(1) и 2 ACHR. Что касается права на коллективное имущество, суд заключил, что уклонение государства от ограничения, демаркации и передачи титула на территорию народам калинья и локоно нарушило право на коллективное имущество, предусмотренное статьей 21 ACHR, а также обязанность принять национальные законодательные требования, установленные статьей 2. Он также указал, что государство должно через процедуру консультаций определить территории, относящиеся к народам калинья и локоно, а также демаркировать и передать титул на указанные территории, гарантируя эффективное владение и пользование данными землями. В связи с этим суд отметил, что государство должно соблюдать также права марунских общин или их членов в этой области. Что касается индивидуальных имущественных титулов, предоставленных некоренным третьим лицам, суд нашел, что право запрашивать реституцию территории остается действительным и что государство должно, таким образом, сопоставить частные или государственные имущественные интересы с территориальными правами членов коренных общин.

Суд отметил, что учреждение заповедников и предоставление горнодобывающей концессии имели место до того, как Суринам присоединился к ACHR и признал юрисдикцию суда в 1987 году. Таким образом, суд принял во внимание свою юрисдикцию ratione temporis в отношении соответствующих споров.

Относительно предполагаемого сохранения природных заповедников на традиционной территории, суд определил, что народы калинья и локоно имеют право требовать возможной реституции земель, соответствующих их традиционной территории в соответствии с внутригосударственным законодательством, и в этом отношении государство должно взвесить затронутые права, то есть коллективные права народов калинья и локоно с защитой окружающей среды как частью публичного интереса.

Кроме того, суд нашел, что было важно сослаться на необходимость обеспечить совместимость между гарантией защищенных районов и адекватного владения и пользования традиционными территориями коренных народов. Суд решил, что защищенный район состоит не только из биологического измерения, но также из социокультурного измерения и, таким образом, требуется междисциплинарный и совместный подходы.

Соответственно, суд заключил, что в принципе защита природных зон совместима с правом коренных и племенных народов на защиту природных ресурсов на их территориях. Он также подчеркнул, что по причине взаимосвязи между природой и их образом жизни коренные и племенные народы вносят важный вклад в сохранение природы. В связи с этим следующие критерии: (a) эффективное участие, (b) доступ к традиционным территориям и их использование, и (c) возможность получения выгоды от консервации при условии, что они совместимы с защитой и устойчивым использованием, - являются существенными элементами для достижения совместимости, которое должно быть оценено государством. Соответственно, суд постановил, что государство должно иметь адекватные механизмы для имплементации этих критериев.

Кроме того, суд отметил, что участие коренных общин в консервации окружающей среды не только вопрос публичного интереса, но также образует часть осуществления их права как коренных народов "на участие в процессе принятия решений по вопросам, которые затрагивают их права... в соответствии с их собственными процедурами и... институтами" (Статья 18 Декларации ООН о правах коренных народов, Резолюция 61/295, 13 сентября 2007 г.).

Что касается отрицательного влияния на природные заповедники, суд счел, что в данном деле нарушение не следовало из отсутствия исключительного управления и мониторинга природных заповедников коренными народами. Вместе с тем суд проверил отсутствие прямых механизмов, гарантирующих доступ, использование и эффективное участие коренных народов калинья и локоно в консервации природных заповедников и вытекающих из нее выгод.

В отношении концессии на добычу полезных ископаемых в заповеднике Уэйн-Крик, суд указал, что государство должно обеспечивать (a) эффективное участие членов коренных и племенных народов в отношении любых планов развития, инвестирования, исследования или добычи, реализуемых на их территории, (b) получение ими разумной выгоды и (c) невыдачу концессий на их территории, пока независимые и технически квалифицированные органы под контролем государства не проведут предварительную оценку социального и экологического воздействия. Суд также решил, что государство должно для целей настоящего дела создать механизмы эффективного участия коренных народов, используя процедуры, которые культурно адаптированы для принятия решений такими народами. Суд установил, что это был не только вопрос публичного интереса, но он также составлял часть осуществления их права на участие в принятии решений по вопросам, затрагивающим их интересы, в соответствии с их собственными процедурами и институтами в отношении статьи 23 ACHR.

Кроме того, суд указал, что обязанность государства обеспечить эффективное участие через процесс консультации применяется до совершения любых действий, которые могут иметь важное влияние на интересы коренных и племенных народов, таких как стадии исследования и эксплуатации или добычи. Таким образом, гарантия эффективного участия должна быть введена в действие до начала горнодобывающей деятельности по выемке или эксплуатации, что не имело места в данном случае. Суд отметил, что, даже если заповедник Уэйн-Крик был создан для защиты и сохранения уникальных экосистем в части территории, относящейся к традиционным землям, выемка бокситов влекла серьезный ущерб окружающей среде и природным ресурсам, необходимым для выживания и развития народов калинья и локоно. В этом отношении горнодобывающие компании ввели определенную политику для реабилитации зоны, но до настоящего времени принятые меры не отвечали удовлетворительной реабилитации данной территории. Таким образом, суд заключил, что государство имело обязанность защищать зоны природного заповедника и традиционных территорий для предотвращения ущерба туземным землям, даже если ущерб причиняется третьими лицами. Это должно быть достигнуто за счет надлежащих механизмов надзора и мониторинга, в частности, надзора и мониторинга экологического воздействия.

В настоящем деле горнодобывающая деятельность, которая повлекла отрицательное воздействие на окружающую среду и, следовательно, на права коренных народов, осуществлялась частными агентами. Суд напомнил, что "государства должны защищать от нарушений прав человека в пределах их территории и/или юрисдикции третьими лицами, включая предпринимательские образования. Это требует принятия целесообразных мер для предотвращения, расследования, наказания и возмещения за такие нарушения через эффективную политику, законодательство, регулирование и судопроизводство".

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований статей 21 и 23 ACHR (вынесено шестью голосами "за" и одним - "против").

(c) Статья 25 (право на судебную защиту) в отношении статей 1(1), 2 и 13 (свобода мысли и выражения мнения) ACHR. Что касается средств правовой защиты в соответствии с национальным законодательством о защите коллективных прав, суд решил, что проанализированные по делу нормы не включали целесообразные и эффективные административные или судебные средства правовой защиты, которые установили процедуры для защиты права на коллективную собственность коренных и племенных народов. Суд установил, что национальные средства правовой защиты должны толковаться и применяться для обеспечения прав человека коренных народов, и указал различные критерии по данному вопросу. Суд также решил, что судебные разбирательства и поданные петиции не были эффективными и что государство не обеспечило предоставления публичной информации, запрошенной представителями, или не обосновало невозможность ее передачи.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований статьи 25 ACHR (вынесено шестью голосами "за" и одним - "против").

(d) Компенсации. Межамериканский суд постановил, что данное постановление само по себе является формой компенсации, и, в частности, обязал государство (i) предоставить народам калинья и локоно правовое признание коллективной правосубъектности; (ii) определять, демаркировать и предоставлять коллективный титул на территорию членов народов калинья и локоно и обеспечивать эффективное владение и пользование ими, принимая во внимание права иных племенных народов зоны; (iii) определять территориальные права народов калинья и локоно в случаях, когда спорная земля принадлежит государству или некоренным и неплеменным третьим лицам; (iv) принимать целесообразные меры для обеспечения доступа, использования и участия народы калинья и локоно в природных заповедниках Галиби и Уэйн-Крик; (v) принимать необходимые меры для обеспечения того, чтобы не осуществлялась деятельность, способная оказать воздействие на традиционную территорию, поскольку вышеупомянутые процедуры эффективного участия народов калинья и локоно не гарантировались; (vi) имплементировать достаточные и необходимые меры для реабилитации затронутой зоны в заповеднике Уэйн-Крик; (vii) создать фонд общинного развития для членов народов калинья и локоно; (viii) принимать необходимые меры в пользу коренных и племенных народов в Суринаме, чтобы: (a) признать коллективную правосубъектность, (b) создать эффективный механизм для определения, демаркации и передачи титула на их территории, (c) учредить национальные средства правовой защиты или адаптировать существующие для обеспечения коллективного доступа к правосудию, (d) обеспечить процедуры эффективного участия этих народов, осуществление оценок социального и экологического воздействия и распределения выгоды.

De uitspraak van het Inter-Amerikaanse Hof voor de Rechten van de Mens van 23 november 2015 in de zaak Kalina en Lokono Peoples v. Suriname (Series C, nr. 309).

Omstandigheden van de zaak


De volkeren Kalinya en Lokono zijn twee van de vier grootste inheemse groepen van Suriname. De zaak betreft daden die door de volkeren van Kalinya en Lokono zijn gepleegd om erkenning door de staat te verkrijgen van hun collectieve juridische bevoegdheid en het recht op collectief eigendom van hun traditionele gebieden, waarvoor titels ontbraken. Delen van het betwiste gebied grenzen aan de nederzettingen van de Ndyuka Marun-stam. Voor andere betwiste gebieden hebben niet-inheemse derde partijen eigendomsbewijzen verworven in gebieden die grenzen aan de rivier de Maroni. Op het betwiste gebied zijn drie natuurreservaten gecreëerd: (i) het Via Via-natuurreservaat in 1966, (ii) het Galibi-natuurreservaat in 1969 en (iii) het Wayne Creek-natuurreservaat in 1986. De Via Via en Galibi natuurreservaten zijn gecreëerd om de kust te beschermen, waar zeeschildpadden nestelden. Op bepaalde tijdstippen werden militaire posten opgezet bij toegangspunten om te voorkomen dat leden van inheemse gemeenschappen het laatstgenoemde reservaat zouden binnenkomen als gevolg van een toename van diefstal van schildpadeieren. Wayne Creek Nature Reserve is gemaakt om ecosystemen te beschermen en te behouden. In deze reserve werd dagbouwmijnbouw uitgevoerd zonder de effectieve deelname van deze volkeren aan het overlegproces. Deze operaties hebben geleid tot aantasting van het milieu en beperkte jacht- en vangstmogelijkheden.

De rechtszaak die was aangespannen door de volkeren Kalynia en Lokono werd afgewezen omdat inheemse leden niet de juridische status van collectieve persoon hadden en niet de titel hadden van collectief eigendom in het betwiste gebied, en administratieve verzoekschriften die aan overheidsfunctionarissen waren gezonden, kregen geen reactie.

Voor de toepassing van dit specifieke geval is een delegatie van het Inter-Amerikaanse Hof voor de Rechten van de Mens (hierna de rechtbank genoemd), onder leiding van haar voorzitter, naar het grondgebied gereisd.


RECHTSVRAGEN


a) artikel 3 (het recht om als rechtspersoonlijkheid te worden erkend) met betrekking tot artikel 1, lid 1 (de verplichting om rechten en vrijheden zonder discriminatie te eerbiedigen), 2 (de betekenis van het nationale recht), 21 (het recht op eigendom) en 25 (het recht op gerechtelijke bescherming) van het Amerikaans Verdrag voor de rechten van de mens (hierna - ACHR). De rechtbank herinnerde aan haar praktijk in eerdere zaken met betrekking tot Suriname en stelde vast dat, aangezien de wet van de staat de collectieve persoonlijkheid van inheemse en inheemse volken niet erkent, de staat artikel 3 heeft geschonden met betrekking tot artikel 2 van de ACHR. Het betekende ook een schending van andere rechten erkend in artikel 1, lid 1, 21 en 25 van de ACHR.


RESOLUTIE


De zaak is in strijd met de vereisten van artikel 3 van de ACHR (uitgesproken met zes stemmen voor en één tegen).

(b) Artikelen 21 en 23 (politieke rechten) met betrekking tot artikel 1, lid 1, en 2 van de ACHR. Wat het recht op collectieve eigendom betreft, concludeerde de rechtbank dat het door de staat vermijden van beperking, afbakening en eigendomsoverdracht naar de gebieden van de volkeren van Kalyne en Lokono het in artikel 21 van de ACHR voorziene recht op collectieve eigendom heeft geschonden, evenals de verplichting om de nationale wettelijke vereisten van artikel 2 aan te nemen. Hij wees er ook op dat de staat via de raadplegingsprocedure de territoria van de volkeren van Kalinya en Lokono moet bepalen, en de titel moet afbakenen en overdragen naar deze territoria, om een ​​effectief eigendom en gebruik van deze landen te garanderen. In dit verband merkte de rechtbank op dat de staat ook de rechten van de Marron-gemeenschappen of hun leden op dit gebied moet respecteren. Met betrekking tot de individuele eigendomstitels die aan niet-inheemse derde partijen zijn verleend, oordeelde de rechtbank dat het recht om teruggave van het grondgebied te vragen geldig blijft en dat de staat dus privé- of staatseigendomsbelangen moet matchen met de territoriale rechten van leden van inheemse gemeenschappen.

De rechtbank merkte op dat het aanleggen van reserves en het verlenen van mijnconcessies plaatsvond voordat Suriname toetrad tot de ACHR en de bevoegdheid van de rechtbank in 1987 erkende. De rechtbank heeft daarom ratione temporis rekening gehouden met de relevante geschillen.

Met betrekking tot het vermeende behoud van natuurreservaten op het traditionele grondgebied, oordeelde de rechtbank dat de volkeren van Kalinya en Lokono het recht hebben om de mogelijke terugbetaling van gronden die overeenkomen met hun traditionele grondgebied te eisen in overeenstemming met het nationale recht, en in dit verband moet de staat de rechten die worden aangetast, dat wil zeggen de collectieve rechten van de Kalynia-volkeren, afwegen en krullen met milieubescherming als onderdeel van het algemeen belang.

Daarnaast oordeelde de rechtbank dat het belangrijk was te verwijzen naar de noodzaak om compatibiliteit te waarborgen tussen het garanderen van beschermde gebieden en een toereikend eigendom en gebruik van traditionele inheemse gebieden. De rechtbank oordeelde dat het beschermde gebied niet alleen bestaat uit de biologische dimensie, maar ook uit de sociaal-culturele dimensie, en dus een interdisciplinaire en collaboratieve aanpak vereist.

De rechtbank concludeerde dan ook dat de bescherming van natuurgebieden in principe verenigbaar is met het recht van inheemse en tribale volken om de natuurlijke hulpbronnen op hun grondgebied te beschermen. Hij benadrukte ook dat, door de relatie tussen de natuur en hun manier van leven, inheemse en inheemse volken een belangrijke bijdrage hebben geleverd aan het behoud van de natuur. In dit verband zijn de volgende criteria: (a) effectieve deelname, (b) toegang tot en gebruik van traditionele gebieden, en (c) de mogelijkheid om te profiteren van instandhouding, mits deze verenigbaar zijn met bescherming en duurzaam gebruik, essentiële elementen zijn voor het bereiken van compatibiliteit, die door de staat moet worden beoordeeld. Dienovereenkomstig oordeelde de rechtbank dat de staat over adequate mechanismen moet beschikken voor de implementatie van deze criteria.

Bovendien merkte de rechtbank op dat de deelname van inheemse gemeenschappen aan milieubehoud niet alleen een zaak van algemeen belang is, maar ook deel uitmaakt van de uitoefening van hun recht als inheemse volkeren "om deel te nemen aan het besluitvormingsproces over kwesties die hun rechten aantasten ... in overeenstemming met hun eigen procedures en ... instellingen "(artikel 18 van de VN-verklaring over de rechten van inheemse volken, resolutie 61/295, 13 september 2007).

Wat betreft de negatieve gevolgen voor natuurgebieden, oordeelde de rechtbank dat de schending in dit geval niet het gevolg was van het gebrek aan exclusief beheer en toezicht op natuurreservaten door inheemse volkeren. Tegelijkertijd verifieerde de rechtbank het ontbreken van directe mechanismen die de toegang, het gebruik en de effectieve deelname van de inheemse volkeren van Kalinya en Lokono aan de instandhouding van natuurreservaten en de voordelen die daaruit voortvloeien, garanderen.

Met betrekking tot de mijnconcessie in het Wayne Creek Reserve gaf de rechtbank aan dat de staat moet zorgen voor: (a) de effectieve deelname van inheemse en tribale leden met betrekking tot alle ontwikkelings-, investeringen-, onderzoeks- of mijnplannen die op hun grondgebied worden uitgevoerd, (b) het verkrijgen van redelijke voordelen voor hen en (c) het niet verlenen van concessies op hun grondgebied totdat onafhankelijke en technisch gekwalificeerde autoriteiten onder staatscontrole een voorlopige beoordeling van de sociale en milieueffecten uitvoeren. De rechtbank besloot ook dat de staat, in het kader van de onderhavige zaak, mechanismen moet instellen voor de effectieve deelname van inheemse volkeren, met behulp van procedures die cultureel zijn aangepast voor besluitvorming door dergelijke volkeren. De rechtbank oordeelde dat het niet alleen een zaak van algemeen belang was, maar ook deel uitmaakte van de uitoefening van hun recht om deel te nemen aan beslissingen over zaken die hun belangen schaden, in overeenstemming met hun eigen procedures en instellingen met betrekking tot artikel 23 van de ACHR.

Daarnaast gaf de rechtbank aan dat de verplichting van de staat om te zorgen voor effectieve deelname door middel van het raadplegingsproces wordt toegepast vóór acties die een belangrijke impact kunnen hebben op de belangen van inheemse en inheemse volken, zoals de stadia van exploratie en exploitatie of productie. De garantie van daadwerkelijke deelname moet dus worden gegeven vóór het begin van de mijnbouwactiviteiten voor mijnbouw of exploitatie, die in dit geval niet heeft plaatsgevonden. Bovendien werden er geen sociale en milieueffectbeoordelingen uitgevoerd en werden de voordelen van het mijnbouwproject niet gedeeld.

De rechtbank merkte op dat, zelfs als Wayne Creek Nature Reserve werd gecreëerd om unieke ecosystemen te beschermen en te behouden in het deel van het grondgebied dat behoort tot traditionele gronden, de winning van bauxiet ernstige schade aan het milieu en de natuurlijke hulpbronnen heeft veroorzaakt die nodig zijn voor het voortbestaan ​​en de ontwikkeling van de Kalinya- en Lokono-volkeren. In dit verband hebben mijnbouwbedrijven een specifiek beleid voor de rehabilitatie van de zone ingevoerd, maar tot nu toe hebben de genomen maatregelen niet naar tevredenheid gereageerd op de rehabilitatie van het gebied. Zo concludeerde de rechtbank dat de staat verplicht was om de gebieden van het natuurgebied en de traditionele gebieden te beschermen om schade aan geboorteland te voorkomen, zelfs als de schade door derden was veroorzaakt. Dit moet worden bereikt door middel van passende toezichts- en monitoringmechanismen, met name toezicht en monitoring van de milieueffecten.

In het onderhavige geval werd de mijnbouw, die een negatieve invloed had op het milieu en dus ook op de rechten van inheemse volkeren, uitgevoerd door particuliere agenten. In dit verband nam de rechtbank nota van de "Richtlijnen voor het bedrijfsleven en de mensenrechten", bekrachtigd door de VN-Mensenrechtenraad, die oordeelde dat ondernemers de mensenrechten moeten respecteren en beschermen, en dat ze de negatieve gevolgen voor de mensenrechten moeten voorkomen, verzachten en verantwoordelijk moeten houden, direct gerelateerd aan hun activiteiten. De rechtbank herinnerde eraan dat "staten zich moeten beschermen tegen schendingen van de mensenrechten op hun grondgebied en / of jurisdictie door derden, waaronder bedrijfsentiteiten. RESOLUTIE

RESOLUTIE

(d) Compensatie. The ruling of the Inter-American Court of Human Rights of November 23, 2015 in the case of Kalina and Lokono Peoples v. Suriname (Series C, No. 309).

The applicants were assisted in preparing a complaint to the Inter-American Commission on Human Rights (Washington, USA).

Subsequently, the Inter-American Commission on Human Rights referred the applicant's complaint to the Inter-American Court of Human Rights (San Jose, Costa Rica) for consideration. Then the complaint was communicated to Suriname.

In the case, the complaint on the protection of environmental and natural resources, taking into account the rights of indigenous peoples, was successfully considered.

Circumstances of the case


The peoples of Kalinya and Lokono are two of the four largest indigenous groups of Suriname. The case concerns the acts committed by the peoples of Kalinya and Lokono to obtain recognition by the state of their collective legal capacity and the right to collective ownership of their traditional territories, for which titles were missing. Parts of the disputed territory adjoined the settlements of the Ndyuka Marun tribe. For other disputed territories, non-indigenous third parties have acquired title deeds in areas bordering the Maroni River. Three nature reserves were created on the disputed territory: (i) the Via Via Nature Reserve in 1966, (ii) the Galibi Nature Reserve in 1969 and (iii) the Wayne Creek Nature Reserve in 1986. The Via Via and Galibi nature reserves were created to protect the coast, where sea turtles nested. At certain times, military posts were set up at access points to prevent members of indigenous communities from entering the latter reserve due to an increase in theft of turtle eggs. Wayne Creek Nature Reserve was created to protect and preserve ecosystems. Open pit mining was carried out in this reserve in the absence of the effective participation of these peoples in the consultation process. These operations have caused environmental degradation and limited hunting and fishing opportunities.

The lawsuit instituted by the Kalynia and Lokono peoples was rejected because indigenous members did not have the legal status of a collective person and did not have the title to collective property in the disputed territory, and administrative petitions sent to public officials did not receive a response.

For the purposes of this particular case, a delegation of the Inter-American Court of Human Rights (hereinafter referred to as the court), headed by its chairman, has traveled to the territory.


QUESTIONS OF LAW


(a) Article 3 (the right to be recognized as a legal personality) in relation to Articles 1 (1) (the obligation to respect rights and freedoms without any discrimination), 2 (the meaning of domestic law), 21 (the right to property) and 25 (the right to judicial protection) of the American Convention on Human Rights (hereinafter - ACHR). The court recalled its practice in previous cases regarding Suriname and determined that, since the law of the state does not recognize the collective personality of indigenous and tribal peoples, the state violated article 3 in relation to article 2 of the ACHR. It also entailed a violation of other rights recognized in Articles 1 (1), 21 and 25 of the ACHR.


RESOLUTION


The case has violated the requirements of Article 3 of the ACHR (pronounced by six votes in favor and one against).

(b) Articles 21 and 23 (political rights) in relation to Articles 1 (1) and 2 of the ACHR. As regards the right to collective property, the court concluded that the state’s avoidance of restriction, demarcation and transfer of title to the territories of the Kalyne and Lokono peoples violated the right to collective property provided for in article 21 of the ACHR, as well as the obligation to adopt the national legislative requirements established by article 2. It He also indicated that the state should, through the consultation procedure, determine the territories belonging to the peoples of Kalinya and Lokono, as well as demarcate and transfer the title to these territories, guaranteeing effective ownership and use of these lands. In this regard, the court noted that the state should also respect the rights of the Maroon communities or their members in this area. As regards the individual property titles granted to non-indigenous third parties, the court found that the right to request restitution of the territory remains valid and that the state must thus match private or state property interests with the territorial rights of members of indigenous communities.

The court noted that the establishment of reserves and the provision of mining concessions took place before Suriname joined the ACHR and recognized the jurisdiction of the court in 1987. Therefore, the court took into account its jurisdiction ratione temporis in respect of the relevant disputes.

Regarding the alleged preservation of nature reserves in the traditional territory, the court determined that the peoples of Kalinya and Lokono have the right to demand the possible restitution of lands corresponding to their traditional territory in accordance with domestic law, and in this regard, the state must weigh the rights that are affected, that is, the collective rights of the Kalynia peoples and curls with environmental protection as part of the public interest.

In addition, the court found that it was important to refer to the need to ensure compatibility between guaranteeing protected areas and adequate ownership and use of traditional indigenous territories. The court decided that the protected area consists not only of the biological dimension, but also of the sociocultural dimension, and thus requires an interdisciplinary and collaborative approach.

Accordingly, the court concluded that, in principle, the protection of natural zones is compatible with the right of indigenous and tribal peoples to protect natural resources in their territories. He also emphasized that, due to the relationship between nature and their way of life, indigenous and tribal peoples made an important contribution to the conservation of nature. In this regard, the following criteria: (a) effective participation, (b) access to and use of traditional territories, and (c) the possibility of benefiting from conservation, provided that they are compatible with protection and sustainable use, are essential elements for achieving compatibility, which should be evaluated by the state. Accordingly, the court ruled that the state should have adequate mechanisms for the implementation of these criteria.

In addition, the court noted that the participation of indigenous communities in environmental conservation is not only a matter of public interest, but also forms part of the exercise of their right as indigenous peoples "to participate in the decision-making process on issues that affect their rights ... in accordance with their own procedures and ... institutions "(Article 18 of the UN Declaration on the Rights of Indigenous Peoples, Resolution 61/295, September 13, 2007).

As regards the negative impact on nature reserves, the court found that in the present case the violation did not result from the lack of exclusive management and monitoring of nature reserves by indigenous peoples. At the same time, the court verified the absence of direct mechanisms guaranteeing the access, use and effective participation of the indigenous peoples of Kalinya and Lokono in the conservation of nature reserves and the benefits arising from it.

With regard to the mining concession in the Wayne Creek Reserve, the court indicated that the state should ensure (a) the effective participation of indigenous and tribal members in relation to any development, investment, research or mining plans implemented in their territory, (b) obtaining reasonable benefits for them and (c) non-granting of concessions on their territory until independent and technically qualified authorities under state control conduct a preliminary assessment of social and environmental impacts. The court also decided that the state should, for the purposes of the present case, establish mechanisms for the effective participation of indigenous peoples, using procedures that are culturally adapted for decision-making by such peoples. The court found that it was not only a matter of public interest, but it was also part of the exercise of their right to participate in decisions on matters affecting their interests, in accordance with their own procedures and institutions in relation to article 23 of the ACHR.

In addition, the court indicated that the obligation of the state to ensure effective participation through the consultation process is applied before any actions that may have an important impact on the interests of indigenous and tribal peoples, such as the stages of exploration and exploitation or production. Thus, the guarantee of effective participation must be put in place before the start of mining operations for mining or exploitation, which did not take place in this case. In addition, social and environmental impact assessments were not carried out, and the benefits of the mining project were not shared.

The court noted that even if Wayne Creek Nature Reserve was created to protect and preserve unique ecosystems in a part of the territory belonging to traditional lands, the extraction of bauxites caused serious damage to the environment and natural resources necessary for the survival and development of the Kalinya and Lokono peoples. In this regard, mining companies have introduced a specific policy for the rehabilitation of the zone, but so far the measures taken have not responded satisfactorily to the rehabilitation of the area. Thus, the court concluded that the state had an obligation to protect the zones of the nature reserve and traditional territories to prevent damage to native lands, even if the damage was caused by third parties. This should be achieved through appropriate oversight and monitoring mechanisms, in particular, oversight and monitoring of environmental impacts.

In the present case, mining, which had a negative impact on the environment and, therefore, on the rights of indigenous peoples, was carried out by private agents. In this regard, the court noted the “Guidelines on Business and Human Rights,” endorsed by the UN Human Rights Council, which found that entrepreneurs should respect and protect human rights, as well as prevent, mitigate and be held accountable for negative consequences for human rights, directly related to their activities. The court recalled that “states must protect against human rights violations within their territory and / or jurisdiction by third parties, including business entities. This requires the adoption of appropriate measures to prevent, investigate, punish and redress such violations through effective policies, legislation, regulation and legal proceedings."

(c) Article 25 (right to judicial defense) in relation to Articles 1 (1), 2 and 13 (freedom of thought and expression) of the ACHR. As regards the remedies in accordance with the national law on the protection of collective rights, the court decided that the norms analyzed in the case did not include appropriate and effective administrative or judicial remedies that established procedures for protecting the collective right of indigenous and tribal peoples. The court found that national remedies should be interpreted and applied to ensure the human rights of indigenous peoples, and indicated various criteria on this issue. The court also decided that the trials and petitions filed were not effective and that the state failed to ensure the provision of public information requested by the representatives or did not justify the impossibility of transmitting it.


RESOLUTION


The case has violated the requirements of Article 25 of the ACHR (pronounced with six votes in favor and one against).

(d) Compensation. The Inter-American Court ruled that this ruling is in itself a form of compensation, and, in particular, obliged the state to (i) provide the peoples of Kalinya and the local legal recognition of collective legal personality; (ii) determine, demarcate and grant a collective title to the territory of the members of the Kalinya and Lokono peoples and ensure their effective possession and use, taking into account the rights of other tribal peoples of the zone; (iii) determine the territorial rights of the peoples of Kalinya and Lokono in cases where the disputed land belongs to the state or to non-indigenous and tribal third parties; (iv) take appropriate measures to ensure access, use and participation of the peoples of Kalinya and Lokono in the Galibi and Wayne Creek nature reserves; (v) take the necessary measures to ensure that activities that may have an impact on traditional territory are not carried out, since the above-mentioned procedures for the effective participation of the peoples of Kalinya and Lokono are not guaranteed; (vi) implement sufficient and necessary measures to rehabilitate the affected area in Wayne Creek Nature Reserve; (vii) create a community development fund for members of the peoples of Kalinya and Lokono; (viii) take the necessary measures in favor of the indigenous and tribal peoples in Suriname to: (a) recognize the collective legal personality, (b) create an effective mechanism for determining, demarcating and transferring the title in their territory, (c) establish national remedies or adapt existing ones to ensure collective access to justice, (d) ensure procedures for the effective participation of these peoples, the implementation of social and environmental impact assessments and benefit-sharing.
