Постановление Межамериканского суда по правам человека от 20 октября 2016 года по делу "Организация "Фазенда Бразил Верде Уокерс" (Fazenda Brasil Verde Workers) против Бразилии" (серия C, N 318).

Заявителям была оказана помощь в подготовке жалобы в Межамериканскую комиссию по правам человека (г. Вашингтон, США).

Впоследствии Межамериканская комиссия по правам человека передала жалобу заявителя для рассмотрения в Межамериканский суд по правам человека (г. Сан-Хосе, Коста-Рика). Затем жалоба была коммуницирована Бразилии.

По делу успешно рассмотрена жалоба на современные формы рабства и торговли людьми.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Факты дела связаны с организацией "Фазенда Брасил Верди" (ферма "Бразил Верди"), расположенной в штате Пара (Бразилия). Начиная с 1988 года в федеральную полицию и Совет по защите прав человека был подан ряд жалоб, утверждавших о наличии там практики работорговли.

В марте 2000 года двум молодым людям удалось бежать с фазенды. После того, как они сообщили о ситуации, Министерство труда организовало инспекцию, во время которой рабочие выразили желание уехать. Аудиторская проверка отметила, что рабочие находились в рабстве. Инспекторы обязали управляющего возвратить рабочим их разрешения на работу и выплатить им суммы, необходимые для прекращения трудовых контрактов.

Рабочих привлекал на фазенду рекрутер, который предлагал хорошую заработную плату и даже авансовый платеж в штате Пиауи, одном из беднейших в стране. Они путешествовали несколько дней на автобусе, поезде и в кузове грузовика. По прибытии на фазенду разрешения на работу изымались, и их заставляли подписывать бланки документов. Режим предусматривал 12-часовой рабочий день с получасовым перерывом на обед и одним выходным в неделю. Десятки рабочих спали в подвесных койках на фермах без электричества, кроватей или санитарного оборудования. Питание было недостаточным, плохого качества и за него производились вычеты из зарплаты. Рабочие регулярно болели и не получали медицинской помощи. Работа проводилась по приказам, под действием угроз и вооруженного надзора. Кроме того, для получения зарплаты они должны были выполнять производственный план, что было трудно сделать, поэтому труд некоторых не оплачивался. Эти условия порождали желание скрыться. Однако бдительность, отсутствие зарплаты, изолированное расположение фазенды и ее окрестностей при наличии диких животных удерживали рабочих от побега.

 

ВОПРОСЫ ПРАВА

 

(a) Статьи 6(1) (свобода от рабства) в отношении статей 1(1) (обязательство уважать и соблюдать права без дискриминации), 3 (право на признание правосубъектности), 5 (право на личную неприкосновенность), 7 (право на личную свободу), 11 (право на личную жизнь) и 22 (свобода передвижения и местожительства) Американской конвенции о правах человека (далее - ACHR). Межамериканский суд расширил содержание и объем понятий рабства, подневольного состояния, работорговли и торговли женщинами, а также принудительного труда, которые запрещены ACHR. После обзора применимых положений международных инструментов и решений международных судов по поводу международного преступления рабства (или закабаления) Межамериканский суд напомнил его абсолютный и всеобщий запрет в международном праве и указал, что его правовое определение существенно не изменилось после принятия Конвенции о рабстве 1926 года.

Однако понятие рабства и его аналогичных форм эволюционировало и не ограничено собственностью в отношении лица, но также охватывает утрату собственной воли лица или значительное уменьшение личной автономии. Межамериканский суд напомнил, что ACHR использует выражение "работорговля и торговля женщинами". Однако с учетом развития международного права, наиболее благоприятного толкования и принципа pro persona это выражение следует понимать как "торговля людьми лично", что также приводит текущее определение в соответствие с Палермским протоколом. Здесь вероятно, имеется в виду Протокол "О предупреждении и пресечении торговли людьми, особенно женщинами и детьми, и наказании за нее" к Конвенции против транснациональной организованной преступности.

В настоящем деле власти Бразилии не доказали, что они приняли конкретные меры или действовали с надлежащей старательностью для предотвращения современной формы рабства, которой подверглись жертвы, и прекращения имевшейся ситуации. Это нарушение обязанности гарантии было особенно серьезным с учетом (a) осознания государством контекста и (b) особой ситуации уязвимости и угрозы для данных рабочих. Таким образом, государство несло ответственность за нарушение запрета рабства и подневольного состояния. Дополнительно, с учетом контекста вербовки из беднейших регионов страны рабочих за счет обмана, хитрости и ложных обещаний рабочие, спасшиеся в марте 2000 года, лично являлись жертвами торговли людьми. Наконец, Межамериканский суд также признал, что данные события имели место в контексте исторической структурной дискриминации, основанной на экономическом статусе 85 рабочих, выявленных и спасенных Министерством труда в марте 2000 года.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований Конвенции (единогласно), что касается структурной дискриминации, то по делу допущено нарушение требований Конвенции (принято пятью голосами "за" и одним - "против").

(b) Статьи 8(1) (право на справедливый суд) и 25(1) (право на судебную защиту) ACHR во взаимосвязи со статьями 1(1) (обязательство уважать и соблюдать права) и 2 (значение внутреннего законодательства) ACHR. Ни одна из внутригосударственных правовых процедур не определяла уголовную ответственность, не предоставляла возмещение жертвам и не исследовала проблему углубленно. Был применен срок давности, несмотря на неприменимость таких ограничений в международном праве за преступление рабства. По мнению Межамериканского суда, отсутствие действий и санкций за эти факты являлось следствием процесса нормализации условий, которым люди с определенными характеристиками длительное время подвергались в беднейших штатах Бразилии. Таким образом, Межамериканский суд нашел, что государство нарушило право доступа к правосудию 85 жертв, а также 43 других рабочих, которые спаслись в 1997 году и не получили адекватной судебной защиты.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований статьи 8(1) ACHR (единогласно) и статьи 25 ACHR (принято пятью голосами "за" и одним - "против").

(c) Компенсация. Межамериканский суд по правам человека установил, что решение само по себе составляло форму репарации, и обязал государство, в частности: (i) опубликовать решение и его официальное резюме, (ii) возобновить с надлежащей старательностью расследование и/или уголовное разбирательство в отношении фактов в разумный срок и при необходимости наказать виновных, (iii) принять необходимые меры для обеспечения того, чтобы установленный законом срок давности не применялся к предусмотренному международным правом преступлению рабства и аналогичных ему форм, и (iv) выплатить компенсацию морального вреда, а также судебных расходов и издержек.

A decisão da Corte Interamericana de Direitos Humanos, de 20 de outubro de 2016, no caso da Organização Fazenda Brasil Verde Trabalhadores Vs. Brasil (Série C, nº 318).

Posteriormente, a Comissão Interamericana de Direitos Humanos encaminhou a denúncia da recorrente à Corte Interamericana de Direitos Humanos (San Jose, Costa Rica) para consideração. Em seguida, a denúncia foi comunicada ao Brasil.

Circunstâncias do caso


Os fatos do caso estão relacionados à organização "Fazenda Brasil Verdi", localizada no estado do Pará (Brasil). Desde 1988, uma série de denúncias foi apresentada à polícia federal e ao Conselho de Proteção dos Direitos Humanos, alegando a existência de práticas de tráfico de escravos no país.

Em março de 2000, dois jovens conseguiram escapar da fazenda. Depois que relataram a situação, o Ministério do Trabalho organizou uma inspeção, durante a qual os trabalhadores expressaram o desejo de sair. A auditoria observou que os trabalhadores estavam em escravidão. Os inspetores ordenaram que o gerente devolvesse aos trabalhadores suas autorizações de trabalho e pagasse os montantes necessários para rescindir os contratos de trabalho.

Os trabalhadores foram atraídos para a fazenda por um recrutador que oferecia bons salários e até um adiantamento no estado do Piauí, um dos mais pobres do país. Eles viajaram por vários dias de ônibus, trem e caminhão. Ao chegar à fazenda, as autorizações de trabalho foram retiradas e elas foram forçadas a assinar formulários de documentos. O regime previa um dia de trabalho de 12 horas, com intervalo para almoço de meia hora e um fim de semana por semana. Dezenas de trabalhadores dormiam em camas suspensas em fazendas sem eletricidade, camas ou equipamento sanitário. A comida era inadequada, de baixa qualidade e deduções do salário. Os trabalhadores estavam regularmente doentes e não receberam atendimento médico. O trabalho era realizado sob ordens, sob a influência de ameaças e vigilância armada. Além disso, para receber um salário, eles precisavam cumprir um plano de produção difícil, de modo que o trabalho de alguns não era remunerado. Essas condições deram origem a um desejo de se esconder. No entanto, vigilância, falta de salário, localização isolada da fazenda e seus arredores na presença de animais silvestres impediram os trabalhadores de escapar.


PERGUNTAS DE LEI


a) Artigos 6 (1) (liberdade de escravidão) em relação ao artigo 1 (1) (obrigação de respeitar e respeitar direitos sem discriminação), 3 (direito ao reconhecimento da personalidade jurídica), 5 (direito à inviolabilidade pessoal), 7 (direito à liberdade pessoal), 11 (direito à privacidade) e 22 (liberdade de circulação e residência) da Convenção Americana sobre Direitos Humanos (doravante - CADH). A Corte Interamericana expandiu o conteúdo e o escopo dos conceitos de escravidão, servidão, tráfico e tráfico de mulheres e trabalho forçado, que são proibidos pela CADH. Após analisar as disposições aplicáveis ​​dos instrumentos internacionais e das decisões dos tribunais internacionais sobre o crime internacional de escravidão (ou escravização), a Corte Interamericana lembrou sua proibição absoluta e universal no direito internacional e indicou que sua definição legal não havia mudado significativamente desde a adoção da Convenção de Escravidão de 1926.

No entanto, o conceito de escravidão e suas formas semelhantes evoluiu e não se limita à propriedade de uma pessoa, mas também cobre a perda da vontade de uma pessoa ou uma diminuição significativa da autonomia pessoal. Essa manifestação do exercício dos atributos de propriedade nos tempos modernos deve ser entendida como controle que restringe ou nega significativamente a liberdade individual com a intenção de explorar o uso, gerenciamento, benefício, transferência ou descarte da pessoa, geralmente como resultado de violência, engano ou coerção.

Um tribunal interamericano lembrou que a CADH usa a expressão "tráfico de escravos e tráfico de mulheres". No entanto, dado o desenvolvimento do direito internacional, a interpretação mais favorável e o princípio pro persona, essa expressão deve ser entendida como “tráfico de pessoas pessoalmente”, o que também alinha a definição atual ao Protocolo de Palermo. Isso provavelmente se refere ao Protocolo “Prevenção, Repressão e Punição do Tráfico de Pessoas, Especialmente Mulheres e Crianças”, da Convenção contra o Crime Organizado Transnacional.

No presente caso, as autoridades brasileiras não provaram que haviam tomado medidas específicas ou agido com a devida diligência para impedir a forma moderna de escravidão sofrida pelas vítimas e para encerrar a situação. Essa violação da obrigação de garantia foi particularmente grave, dada (a) a conscientização do estado sobre o contexto e (b) a situação especial de vulnerabilidade e ameaça a esses trabalhadores. Assim, o Estado foi responsável por violar a proibição de escravidão e servidão. Além disso, dado o contexto do recrutamento de trabalhadores das regiões mais pobres do país devido a engano, esperteza e falsas promessas, os trabalhadores que escaparam em março de 2000 foram pessoalmente vítimas de tráfico. Por fim, a Corte Interamericana também constatou que esses eventos ocorreram no contexto de discriminação estrutural histórica, com base no status econômico de 85 trabalhadores identificados e resgatados pelo Departamento do Trabalho em março de 2000.


RESOLUÇÃO


O caso violou os requisitos da Convenção (por unanimidade), com relação à discriminação estrutural, o caso violou os requisitos da Convenção (adotado por cinco votos a favor e um contra).

(b) Artigos 8 (1) (direito a um julgamento justo) e 25 (1) (direito de reparação) da CADH em conjunto com os artigos 1 (1) (obrigação de respeitar e respeitar os direitos) e 2 (significado do direito interno) da CADH. Assim, a Corte Interamericana constatou que o Estado violou o direito de acesso à justiça a 85 vítimas, bem como a outros 43 trabalhadores que escaparam em 1997 e não receberam proteção judicial adequada.


RESOLUÇÃO


O caso violou os requisitos do artigo 8 (1) da CADH (por unanimidade) e do artigo 25 da CADH (adotado por cinco votos a favor e um contra).

(c) Remuneração. A Corte Interamericana de Direitos Humanos constatou que a própria decisão constituía uma forma de reparação e ordenou ao Estado, em particular: (i) que publique a decisão e seu resumo oficial, (ii) retome, com a devida diligência, a investigação e / ou processo criminal referente aos fatos em questão. um prazo razoável e, se necessário, punir os autores, (iii) tomar as medidas necessárias para garantir que o prazo de prescrição legal não se aplique ao crime de escravidão e formas semelhantes prescritas pelo direito internacional; custos.

Circumstances of the case


The facts of the case are connected with the organization "Fazenda Brasil Verdi" (Brazil Verdi farm), located in the state of Para (Brazil). Since 1988, a series of complaints have been filed with the federal police and the Human Rights Protection Council alleging the existence of slave trade practices there.

In March 2000, two young people managed to escape from the hacienda. After they reported the situation, the Ministry of Labor organized an inspection, during which the workers expressed a desire to leave. The audit noted that the workers were in slavery. The inspectors ordered the manager to return to the workers their work permits and to pay them the amounts necessary to terminate the labor contracts.

The workers were attracted to the hacienda by a recruiter who offered good wages and even an advance payment in the state of Piaui, one of the poorest in the country. They traveled for several days by bus, train, and truck. Upon arrival at the hacienda, work permits were withdrawn and they were forced to sign document forms. The regimen provided for a 12-hour working day with a half-hour lunch break and one weekend per week. Dozens of workers slept in hanging beds on farms without electricity, beds, or sanitary equipment. The food was inadequate, of poor quality, and deductions were made for it from the salary. Workers were regularly ill and did not receive medical attention. Work was carried out on orders, under the influence of threats and armed surveillance. In addition, in order to receive a salary, they had to fulfill a production plan, which was difficult to do, so the work of some was not paid. These conditions gave rise to a desire to hide. However, vigilance, lack of salary, isolated location of hacienda and its surroundings in the presence of wild animals kept the workers from escaping.


QUESTIONS OF LAW


(a) Articles 6 (1) (freedom from slavery) in relation to Articles 1 (1) (obligation to respect and respect rights without discrimination), 3 (right to recognition of legal personality), 5 (right to personal inviolability), 7 (right to personal freedom), 11 (right to privacy) and 22 (freedom of movement and residence) of the American Convention on Human Rights (hereinafter - ACHR). The Inter-American Court has expanded the content and scope of the concepts of slavery, servitude, slave trade and trafficking in women, and forced labor, which are prohibited by the ACHR. After reviewing the applicable provisions of international instruments and decisions of international courts regarding the international crime of slavery (or enslavement), the Inter-American Court recalled its absolute and universal prohibition in international law and indicated that its legal definition had not changed significantly since the adoption of the 1926 Slavery Convention.

However, the concept of slavery and its similar forms has evolved and is not limited to ownership of a person, but also covers the loss of a person’s own will or a significant decrease in personal autonomy. This manifestation of the exercise of property attributes in modern times should be understood as control that significantly restricts or denies individual freedom with the intention to exploit the use, management, benefit, transfer or disposal of the person, usually as a result of violence, deception or coercion.

An Inter-American court recalled that the ACHR uses the expression "slave trade and trafficking in women." However, given the development of international law, the most favorable interpretation and the pro persona principle, this expression should be understood as “trafficking in persons in person”, which also brings the current definition into line with the Palermo Protocol. This probably refers to the Protocol “On the Prevention, Suppression and Punishment of Trafficking in Persons, Especially Women and Children,” to the Convention against Transnational Organized Crime.

In the present case, the Brazilian authorities did not prove that they had taken specific measures or acted with due diligence to prevent the modern form of slavery suffered by the victims and to end the situation. This violation of the guarantee obligation was particularly serious given (a) the state's awareness of the context and (b) the special situation of vulnerability and threat to these workers. Thus, the state was responsible for violating the prohibition of slavery and servitude. Additionally, given the context of the recruitment of workers from the poorest regions of the country due to deception, cunning and false promises, the workers who escaped in March 2000 were personally victims of trafficking. Finally, the Inter-American Court also found that these events took place in the context of historical structural discrimination, based on the economic status of 85 workers identified and rescued by the Department of Labor in March 2000.


RESOLUTION


The case has violated the requirements of the Convention (unanimously), with regard to structural discrimination, the case has violated the requirements of the Convention (adopted by five votes in favor and one against).

(b) Articles 8 (1) (right to a fair trial) and 25 (1) (right to remedy) of the ACHR in conjunction with articles 1 (1) (obligation to respect and respect rights) and 2 (meaning of domestic law) of the ACHR. Thus, the Inter-American Court found that the state violated the right of access to justice to 85 victims, as well as 43 other workers who escaped in 1997 and did not receive adequate judicial protection.


RESOLUTION


The case has violated the requirements of Article 8 (1) of the ACHR (unanimously) and Article 25 of the ACHR (adopted by five votes in favor and one against).

(c) Compensation. The Inter-American Court of Human Rights found that the decision itself constituted a form of reparation, and ordered the state, in particular: (i) to publish the decision and its official summary, (ii) to resume, with due diligence, the investigation and / or criminal proceedings in respect of the facts in a reasonable time period and, if necessary, punishing the perpetrators, (iii) take the necessary measures to ensure that the statutory limitation period does not apply to the crime of slavery and similar forms prescribed by international law, and (iv) pay compensation for non-pecuniary damage, as well as legal expenses costs.
