Постановление Межамериканского суда по правам человека от 31 августа 2017 года по делу "Лагос дель Кампо (Lagos del Campo) против Перу" (серия C, N 340).

Заявителю была оказана помощь в подготовке жалобы в Межамериканскую комиссию по правам человека (г. Вашингтон, США).

Впоследствии Межамериканская комиссия по правам человека передала жалобу заявителя для рассмотрения в Межамериканский суд по правам человека (г. Сан-Хосе, Коста-Рика). Затем жалоба была коммуницирована Гватемале.

По делу успешно рассмотрена жалоба на обязательства государства в отношении прав на трудовую стабильность, на ассоциацию и свободу выражения мнения.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель, Альфредо Лагос дель Кампо, был выбран председателем Генеральной ассамблеи избирательного комитета частной компании. В интервью для периодического издания он сделал несколько заявлений, осуждавших недостатки в работе дирекции компании во время выборов. Впоследствии, 1 июля 1989 г., он был уволен за нарушение трудовой дисциплины. Заявитель подал жалобу в трудовой трибунал, который признал увольнение "неприемлемым и неоправданным". Однако суд второй инстанции отменил это решение и подтвердил, что его увольнение было законным и оправданным. Все последующие средства правовой защиты, использованные заявителем, были признаны неприемлемыми, или ему было отказано по существу.

 

ВОПРОСЫ ПРАВА

 

Статьи 13(2) (свобода мысли и выражения мнения) и 8(2) (право на справедливое судебное разбирательство) Американской конвенции о правах человека (далее - ACHR) во взаимосвязи с ее статьей 1(1). Межамериканский суд по правам человека (далее - Межамериканский суд) подчеркнул применимость права на свободу мысли и свободы выражения мнения в трудовой сфере, тогда как государство имеет обязанность соблюдать и гарантировать это право, чтобы работники и их представители могли его осуществлять. В делах, в которых затронут общий и публичный интерес, требуется более высокий стандарт, особенно для существующих представительских выборных должностей. Межамериканский суд определил, что высказывания, допущенные заявителем в качестве представителя работников, относились к вопросам публичного интереса. Он заключил, что государство согласилось на ограничение, примененное к праву заявителя на свободу мысли и выражения в результате применения необязательной санкции, которое не было адекватно мотивировано. ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований ACHR (принято единогласно).

(b) Статья 26 (право на трудовую стабильность) во взаимосвязи со статьями 1(1) (обязательство соблюдать и обеспечивать права без дискриминации), 13 (свобода мысли и выражения), 8 (право на справедливое судебное разбирательство) и 16 (свобода ассоциации) ACHR. Межамериканский суд подтвердил свою юрисдикцию в соответствии с принципом iura novit curiae для анализа первоначального обращения и влияния на трудовые права заявителя. В этом отношении Межамериканский суд напомнил свою позицию по поводу независимости и неделимости в ACHR гражданских, политических и экономических, социальных и культурных прав. Обе группы прав должны восприниматься в совокупности как права человека без всякого иерархического разделения между ними и соблюдаться компетентными органами. Межамериканский суд впервые приступил к анализу статьи 26 ACHR, которая устанавливает экономические, социальные и культурные права в данном договоре. Iura novit curiae (лат.) - судьи знают право, положение римского права, означающее, что суд независимо ни от кого определяет, какие законы должны быть применены для решения спора.

Межамериканский суд вывел объем и содержания права на трудовую стабильность в соответствии со статьей 26 ACHR из Устава Организации американских государств и Американской декларации прав и обязанностей человека, правил толкования, установленных в статье 29 ACHR, международных и региональных corpus iuris, и законодательства Перу. Он установил, что защита права на трудовую стабильность в частной сфере корреспондирует конкретным обязанностям государства, таким как адекватное регулирование и аудит, защита работников от неоправданных увольнений, предоставление средств правовой защиты в случае неоправданного увольнения и создание эффективных правовых механизмов.

Заявитель не был восстановлен в должности и не получил компенсации или соответствующих социальных льгот. Следовательно, власти государства не обеспечили его право на трудовую стабильность.

 

ПОСТАНОВЛЕНИЕ

 

По делу допущено нарушение требований ACHR (принято пятью голосами "за" при двух - "против").

(c) Статьи 16 (свобода ассоциации) и 26 (право на трудовую стабильность) во взаимосвязи со статьями 1(1) (обязательство соблюдать и обеспечивать права без дискриминации), 13 (свобода мысли и выражения) и 8 (право на справедливое судебное разбирательство) ACHR. Межамериканский суд указал, что свобода ассоциации применяется не только к профсоюзам, но и к любой организации, намеренной представлять законные интересы работников. Он напомнил, что свобода ассоциации влечет индивидуальную и общественную оценку. С одной стороны, она включает право на свободное объединение и использование любых адекватных средств для осуществления такой свободы. С другой стороны, это механизм, который позволяет членам трудового коллектива или группы совместно достигать определенных целей и извлекать для себя выгоды. В настоящем деле незаконное увольнение заявителя не позволило ему сохранить свое положение представителя работников и посещать собрание избирательного комитета. Поэтому, приняв во внимание двойственную природу права на ассоциацию, Межамериканский суд установил, что нарушение прав заявителя в качестве представителя работников могло также иметь устрашающий и сдерживающий эффект на других рабочих, поскольку он был уволен за высказывания, сделанные им в таком качестве.

(d) Компенсация. Межамериканский суд установил, что настоящее Постановление само собой является формой компенсации, и предложил государству (i) опубликовать Постановление и его официальное резюме, (ii) выплатить компенсацию материального ущерба (включая потерю заработка, пенсии по старости и социальных пособий) и морального вреда, а также возместить судебные расходы и издержки.

El solicitante recibió asistencia para preparar una queja ante la Comisión Interamericana de Derechos Humanos (Washington, EE. UU.).

Posteriormente, la Comisión Interamericana de Derechos Humanos remitió la queja del solicitante a la Corte Interamericana de Derechos Humanos (San José, Costa Rica). La denuncia fue luego comunicada a Guatemala.

LAS CIRCUNSTANCIAS DEL CASO


El solicitante, Alfredo Lagos del Campo, fue elegido presidente de la Asamblea General del comité electoral de una empresa privada. En una entrevista con un periódico, hizo varias declaraciones denunciando las deficiencias en la gestión de la empresa durante las elecciones. Posteriormente, el 1 de julio de 1989, fue despedido por violación de la disciplina laboral. El demandante presentó una queja ante el Tribunal Laboral, que declaró el despido "inadmisible e injustificado". Sin embargo, el tribunal de segunda instancia revocó esta decisión y confirmó que su despido era legal y justificado. Todos los recursos subsiguientes utilizados por el solicitante fueron declarados inadmisibles o se le negó el fondo.


PREGUNTAS DE LEY


Los artículos 13 (2) (libertad de pensamiento y expresión) y 8 (2) (derecho a un juicio justo) de la Convención Americana sobre Derechos Humanos (en adelante - CADH) junto con su artículo 1 (1). La Corte Interamericana de Derechos Humanos (en adelante, la Corte Interamericana) ha enfatizado la aplicabilidad del derecho a la libertad de pensamiento y expresión en el lugar de trabajo, mientras que el estado tiene el deber de respetar y garantizar este derecho para que los trabajadores y sus representantes puedan ejercerlo. En casos que involucran interés general y público, se requiere un estándar más alto, especialmente para los cargos electos representativos existentes. La Corte Interamericana resolvió que las declaraciones hechas por el solicitante como representante de los trabajadores eran asuntos de interés público. Concluyó que el Estado había aceptado la restricción aplicada al derecho del solicitante a la libertad de pensamiento y expresión como resultado de la aplicación de una sanción opcional, que no había sido debidamente justificada. En las circunstancias del caso, no había necesidad imperiosa de justificar su despido.


RESOLUCIÓN


El caso violó los requisitos de la CADH (adoptada por unanimidad).

(b) el Artículo 26 (derecho a la estabilidad en el trabajo) junto con el Artículo 1 (1) (obligación de respetar y garantizar los derechos sin discriminación), 13 (libertad de pensamiento y expresión), 8 (derecho a un juicio justo) y 16 (libertad de asociación ) ACHR. La Corte Interamericana ha confirmado su jurisdicción bajo el principio de iura novit curiae para analizar la apelación inicial y el impacto en los derechos laborales del solicitante. En este sentido, la Corte Interamericana de Justicia recordó su posición sobre la independencia e indivisibilidad de los derechos civiles, políticos y económicos, sociales y culturales en la CADH. Ambos grupos de derechos deben considerarse juntos como derechos humanos sin ninguna división jerárquica entre ellos y respetados por las autoridades competentes. Por primera vez, la Corte Interamericana comenzó a analizar el artículo 26 de la CADH, que establece los derechos económicos, sociales y culturales en este tratado. Llegó a la conclusión de que había una violación específica del derecho al trabajo, en particular los derechos a la estabilidad laboral y la asociación.

Iura novit curiae (lat.): Los jueces conocen la ley, una disposición de la ley romana, lo que significa que el tribunal determina independientemente qué leyes se deben aplicar para resolver la disputa.

La Corte Interamericana de Justicia ha derivado el alcance y el contenido del derecho a la estabilidad laboral bajo el Artículo 26 ACHR de la Carta de la Organización de los Estados Americanos y la Declaración Americana de los Derechos y Deberes de los Derechos Humanos, las reglas de interpretación establecidas en el Artículo 29 ACHR, corpus iuris internacional y regional, y la ley peruana. Encontró que proteger el derecho a la estabilidad laboral en el ámbito privado es coherente con las responsabilidades específicas del gobierno, como una regulación y auditoría adecuadas, proteger a los trabajadores de despidos injustificados, proporcionar soluciones en caso de despidos injustificados y establecer mecanismos legales efectivos.

La Corte Interamericana concluyó que las autoridades estatales no tomaron las medidas adecuadas para proteger al solicitante de violaciones de su derecho al trabajo por parte de terceros, ya que aprobaron su despido indebido por parte de las autoridades judiciales. El solicitante no fue readmitido y no recibió compensación ni beneficios sociales relacionados. Por lo tanto, perdió su trabajo y el acceso a la pensión de vejez, no pudo ejercer sus derechos como representante de los trabajadores. En consecuencia, las autoridades estatales no garantizaron su derecho a la estabilidad laboral.


RESOLUCIÓN


Hubo una violación de los requisitos de la CADH en el caso (aprobado por cinco votos a favor y dos en contra).

La Corte Interamericana ha indicado que la libertad de asociación se aplica no solo a los sindicatos, sino a cualquier organización que pretenda representar los intereses legítimos de los trabajadores. Recordó que la libertad de asociación implica una evaluación individual y pública. Por un lado, incluye el derecho a la libertad de asociación y el uso de cualquier medio adecuado para ejercer dicha libertad. Por otro lado, es un mecanismo que permite a los miembros de un colectivo o grupo de trabajo lograr conjuntamente ciertos objetivos y obtener beneficios para sí mismos. En el presente caso, el despido ilegal del solicitante le impidió conservar su puesto como representante de los empleados y asistir a una reunión del comité electoral. Por lo tanto, teniendo en cuenta la doble naturaleza del derecho de asociación, la Corte Interamericana determinó que la violación de los derechos del solicitante como representante de los trabajadores también podría tener un efecto aterrador y disuasorio en otros trabajadores, ya que fue despedido por hablar en esa capacidad.

(d) Compensación. La Corte Interamericana ha determinado que esta Orden es en sí misma una forma de compensación y ha invitado al Estado a (i) publicar la Orden y su resumen oficial, (ii) pagar una compensación por daños materiales (incluida la pérdida de ganancias, pensiones de vejez y beneficios sociales) y daños no materiales, y También reembolsar los costos y gastos legales.

The applicant was assisted in preparing a complaint to the Inter-American Commission on Human Rights (Washington, USA).

THE CIRCUMSTANCES OF THE CASE


The applicant, Alfredo Lagos del Campo, was elected chairman of the General Assembly of the electoral committee of a private company. In an interview with a periodical, he made several statements denouncing the shortcomings in the company's management during the elections. Subsequently, on 1 July 1989, he was dismissed for violation of labor discipline. The applicant lodged a complaint with the labor tribunal, which found the dismissal “unacceptable and unjustified”. However, the court of second instance overturned this decision and confirmed that his dismissal was lawful and justified. All subsequent remedies used by the applicant were declared inadmissible or he was denied on the merits.


QUESTIONS OF LAW


Articles 13 (2) (freedom of thought and expression) and 8 (2) (right to a fair trial) of the American Convention on Human Rights (ACHR) in conjunction with its article 1 (1). The Inter-American Court of Human Rights (hereinafter - the Inter-American Court) has emphasized the applicability of the right to freedom of thought and freedom of expression in the workplace, while the state has a duty to respect and guarantee this right so that workers and their representatives can exercise it. In matters involving general and public interest, a higher standard is required, especially for existing representative elected offices. The Inter-American Court ruled that the statements made by the applicant as a representative of the workers were matters of public interest. It concluded that the State had accepted the restriction applied to the applicant's right to freedom of thought and expression as a result of the application of an optional sanction, which had not been adequately justified. In the circumstances of the case, there was no imperative need to justify his dismissal.


RESOLUTION


The case violated the ACHR requirements (adopted unanimously).

(b) Article 26 (right to labor stability) in conjunction with Articles 1 (1) (obligation to respect and ensure rights without discrimination), 13 (freedom of thought and expression), 8 (right to a fair trial) and 16 (freedom of association ) ACHR. The Inter-American Court has upheld its jurisdiction under the iura novit curiae principle to analyze the initial appeal and the impact on the applicant's labor rights. In this regard, the Inter-American Court of Justice recalled its position on the independence and indivisibility of civil, political and economic, social and cultural rights in the ACHR. Both groups of rights should be taken together as human rights without any hierarchical division between them and respected by the competent authorities. For the first time, the Inter-American Court has begun to analyze Article 26 of the ACHR, which sets out economic, social and cultural rights in this treaty. He concluded that there was a specific violation of the right to work, in particular the rights to labor stability and association.

Iura novit curiae (lat.) - judges know the law, a provision of Roman law, meaning that the court independently determines which laws should be applied to resolve the dispute.

The Inter-American Court has deduced the scope and content of the right to labor stability under Article 26 ACHR from the Charter of the Organization of American States and the American Declaration of the Rights and Duties of Human Rights, the rules of interpretation set out in Article 29 ACHR, international and regional corpus iuris, and Peruvian law. It found that protecting the right to employment stability in the private sphere is consistent with specific government responsibilities, such as adequate regulation and auditing, protecting workers from unjustified dismissals, providing remedies in the event of unjustified dismissals, and establishing effective legal mechanisms.

The Inter-American Court concluded that the State authorities failed to take adequate measures to protect the applicant against violations of his right to work by third parties, as they approved his improper dismissal by the judicial authorities. The applicant was not reinstated and received no compensation or related social benefits. Thus, he lost his job and access to old-age pension, could not exercise his rights as a representative of workers. Consequently, the state authorities did not ensure his right to labor stability.


RESOLUTION


The case violated the ACHR requirements (adopted by five votes in favor and two against).

(c) Articles 16 (freedom of association) and 26 (right to labor stability) in conjunction with Articles 1 (1) (obligation to respect and ensure rights without discrimination), 13 (freedom of thought and expression) and 8 (right to a fair trial ) ACHR. The Inter-American Court has indicated that freedom of association applies not only to trade unions, but also to any organization that intends to represent the legitimate interests of workers. He recalled that freedom of association entails individual and public assessment. On the one hand, it includes the right to freedom of association and the use of any adequate means to exercise such freedom. On the other hand, it is a mechanism that allows members of a work collective or group to jointly achieve certain goals and derive benefits for themselves. In the present case, the applicant's unlawful dismissal prevented him from retaining his position as an employee representative and from attending an election committee meeting. Therefore, taking into account the dual nature of the right to association, the Inter-American Court found that the violation of the applicant's rights as a workers' representative could also have a frightening and dissuasive effect on other workers, as he was fired for speaking out in that capacity.

(d) Compensation. The Inter-American Court has found that this Order is itself a form of compensation and has invited the State to (i) publish the Order and its official summary, (ii) pay compensation for pecuniary damage (including loss of earnings, old-age pensions and social benefits) and non-pecuniary damage, and also reimburse legal costs and expenses.
