Постановление Межамериканского суда по правам человека от 06 марта 2019 года по делу "Мюэль Флорес (Muelle Flores) против Перу" (Series C, дело N 375).

Заявителю была оказана помощь в подготовке жалобы в Межамериканскую комиссию по правам человека (г. Вашингтон, США).

Впоследствии Межамериканская комиссия по правам человека передала жалобу заявителя для рассмотрения в Межамериканский суд по правам человека (г. Сан-Хосе, Коста-Рика). Затем жалоба была коммуницирована Перу.

По делу успешно рассмотрена жалоба на нарушение права на социальную защиту в связи с отказом в выплате пенсии.

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

30 сентября 1990 г. заявитель, Оскар Мюэль Флорес, вышел на пенсию с работы в принадлежавшей государству компании "Минера Эспесьяль Тинтая Лтд" (Minera Especial Tintaya Ltd) (далее - компания). 27 января 1991 г. компания приостановила выплату ему пенсии. После приостановления заявитель подал жалобу amparo в Пятый гражданский суд г. Лима (Lima), который предписал компании возобновить выплаты пенсии. Решение суда было оставлено в силе судом апелляционной инстанции и затем Верховным судом в его постановлении от 2 февраля 1993 г., в котором приостановление выплаты пенсии было признано недействительным.

17 февраля 1993 г. компания возобновила приостановление выплат пенсий нескольким бывшим работникам, в том числе заявителю. Последний вновь подал жалобу amparo, требуя восстановления пенсионных выплат и возмещения ущерба. Конституционный суд Перу предписал компании продолжить выплату пенсии заявителю, но оставил без удовлетворения требование заявителя о возмещении ущерба. Компания потребовала судебного пересмотра административного решения и того, чтобы реинтеграция заявителя в пенсионный режим была объявлена неприемлемой. Суд первой инстанции удовлетворил требования компании, но его решение было отменено по жалобе заявителя Верховным судом Перу, который пришел к выводу, что требования были необоснованными. Надзорное производство в отношении исполнения решения по первой жалобе amparo, поданной заявителем, по-прежнему не завершено. Кроме того, в 1994 году компания была приватизирована в соответствии с Декрет-законом N 674, который установил дополнительные препятствия для исполнения компанией судебных постановлений, предписывавших выплату пенсии заявителю.

 

ВОПРОСЫ ПРАВА

 

Межамериканский суд по правам человека (далее - Межамериканский суд) решил, что у властей Перу была обязанность выплачивать пенсию, как установили суды, немедленно, эффективно и быстро, поскольку речь шла о праве, которое касалось удовлетворения базовых потребностей и заменяло право на получение заработной платы. Кроме того, Межамериканский суд отметил, что власти Перу также были обязаны явно и ясно установить, какая организация несла ответственность за исполнение данного решения, что не было сделано в настоящем деле. Межамериканский суд указал, что в настоящем деле бремя было перенесено на потерпевшего. Более того, Межамериканский суд отметил, что прошло 26 и 19 лет соответственно с момента вынесения решений в 1993 и 1999 годах. Данный период повлиял на правовое положение потерпевшего, учитывая, что он был пожилым человеком с ограниченными финансовыми возможностями. Принимая во внимание вышеизложенные факты, Межамериканский суд пришел к выводу, что власти Перу не действовали оперативно, что было необходимо ввиду уязвимого положения заявителя и того факта, что срок был неразумным. Таким образом, власти Перу нарушили требования статьи 8, пункта 1 статьи 25 и подпункта "c" пункта 2 статьи 25 Американской конвенции о правах человека во взаимосвязи с пунктом 1 статьи 1 и статьей 2 данной Конвенции.

В дополнение к этому Межамериканский суд в первый раз высказал мнение по поводу права на социальную защиту. Он сослался на автономное право на получение пенсии, являющееся частью экономических, социальных, культурных и экологических прав. Он также указал, что составляющие элементы данного права могли быть выведены из статьи 45 Устава Организации американских государств в свете Американской декларации о правах и обязанностях человека и иных международных правозащитных договоров и документов. В связи с неисполнением решений судов страны право заявителя на пенсию не защищалось надлежащим образом. Кроме того, данные решения не исполнены до настоящего времени, поскольку производство по делу по-прежнему не завершено. Более того, Межамериканский суд установил, что в контексте невыплаты пенсии, право на которую признано в судебном порядке, права на социальную защиту, личную неприкосновенность и уважение человеческого достоинства связаны между собой и в некоторых случаях нарушение одного из них может прямо влиять на другое, в частности, в делах, касающихся пожилых лиц. Межамериканский суд определил, что отказ в праве на социальную защиту в течение 27 лет причинил серьезный ущерб качеству жизни и возмещению медицинских расходов заявителя, который нуждался в социальной защите в связи с тем, что он был пожилым человеком с ограниченными возможностями. Нарушения, вызванные отсутствием пенсионных выплат, не ограничивались теми, которые были вызваны неразумной задержкой, поскольку пенсия являлась единственным источником дохода заявителя. Продолжающаяся невыплата пенсии неизбежно приводила к нестабильности финансового положения заявителя, что оказывало влияние на его способность удовлетворять свои базовые потребности, а это в свою очередь имело последствия для его психологического и морального состояния, а также на уважение человеческого достоинства. Таким образом, существующие механизмы не были способны гарантировать соответствующее право, и власти государства-ответчика нарушили статью 26 во взаимосвязи со статьей 5, пунктом 1 статьи 8, пунктом 1 статьи 11, подпунктом "c" пункта 2 статьи 25 и пунктом 1 статьи 1, а также статью 2 Американской конвенции о правах человека.

В дополнение к этому, принимая во внимание, что отсутствие судебной защиты повлияло на право потерпевшего на пенсию, которая стала частью его имущества, Межамериканский суд решил, что власти Перу нарушили право частной собственности, гарантированное пунктом 1 статьи 21 и пунктом 2 статьи 21 во взаимосвязи с пунктом 1 статьи 25, подпунктом "c" пункта 2 статьи 25, статьей 26 и пунктом 1 статьи 1 Американской конвенции о правах человека.

 

КОМПЕНСАЦИЯ

 

С учетом установленных им нарушений Межамериканский суд предписал властям Перу:

(i) восстановить получение заявителем пенсии, что также включало обязанность государства гарантировать предоставление ему медицинской помощи через План социального здравоохранения Перу (Es Salud);

(ii) опубликовать настоящее Постановление и его официальное краткое изложение;

(iii) выплатить суммы, указанные в судебном решении в отношении материального ущерба и морального вреда, потери пенсионного дохода и издержек, а также оплатить расходы, понесенные Фондом по оказанию юридической помощи потерпевшим.

Sentencia de la Corte Interamericana de Derechos Humanos de 06 de marzo de 2019 en Muelle Flores v. Perú (Serie C caso no. 375).

El solicitante recibió asistencia para preparar una queja ante la Comisión Interamericana de Derechos Humanos (Washington, EE. UU.).

Posteriormente, la Comisión Interamericana de Derechos Humanos remitió la queja del solicitante a la Corte Interamericana de Derechos Humanos (San José, Costa Rica). La denuncia fue luego comunicada a Perú.

En el caso, se consideró con éxito una queja sobre la violación del derecho a la protección social en relación con la negativa a pagar una pensión.

LAS CIRCUNSTANCIAS DEL CASO


El 30 de septiembre de 1990, el solicitante, Oscar Muel Flores, se retiró de su trabajo en la empresa estatal Minera Especial Tintaya Ltd (en adelante, "la empresa"). El 27 de enero de 1991, la compañía suspendió sus pagos de pensión. Luego de la suspensión, el solicitante presentó una demanda con amparo ante el Quinto Tribunal Civil de Lima, que ordenó a la compañía que reanudara los pagos de pensión. La decisión del tribunal fue confirmada por el tribunal de apelación y luego por el Tribunal Supremo en su fallo del 2 de febrero de 1993, que invalidó la suspensión del pago de la pensión.

El 17 de febrero de 1993, la empresa renovó la suspensión de los pagos de pensiones a varios ex empleados, incluido el solicitante. Este último nuevamente presentó una queja ante el amparo, buscando beneficios y daños por jubilación. El Tribunal Constitucional peruano ordenó a la empresa que continuara pagando la pensión del solicitante, pero desestimó el reclamo del demandante por daños y perjuicios. La empresa solicitó una revisión judicial de la decisión administrativa y que la reinserción del solicitante en el régimen de pensiones se declare inadmisible. El tribunal de primera instancia otorgó los reclamos de la compañía, pero su decisión fue revocada por la demanda del solicitante por la Corte Suprema peruana, que concluyó que los reclamos eran infundados. Los procedimientos de supervisión con respecto a la ejecución de la primera queja de amparo presentada por el solicitante aún están pendientes. Además, en 1994 la empresa fue privatizada de conformidad con el Decreto Ley n. 674, que estableció obstáculos adicionales para que la empresa cumpliera con las órdenes judiciales que ordenaban el pago de la pensión del solicitante.


PREGUNTAS DE LEY


La Corte Interamericana de Derechos Humanos (en adelante, la Corte Interamericana) decidió que las autoridades peruanas tenían la obligación de pagar la pensión, como los tribunales determinaron, de manera inmediata, eficiente y rápida, ya que era un derecho que abordaba las necesidades básicas y reemplazaba el derecho a recibir salarios. ... Además, la Corte Interamericana señaló que las autoridades peruanas también debían establecer de manera explícita y clara qué organización era responsable de la ejecución de la sentencia, lo que no se hizo en el presente caso. La Corte Interamericana indicó que en el presente caso la carga se transfirió a la víctima. Además, la Corte Interamericana de Justicia señaló que han transcurrido 26 y 19 años, respectivamente, desde las sentencias de 1993 y 1999. Este período influyó en el estado legal de la víctima, dado que era una persona mayor con capacidades financieras limitadas. Teniendo en cuenta los hechos anteriores, la Corte Interamericana concluyó que las autoridades peruanas no actuaron con prontitud, lo que era necesario en vista de la posición vulnerable del solicitante y el hecho de que el plazo no era razonable. Por lo tanto, las autoridades peruanas han violado los requisitos del artículo 8, párrafo 1 del artículo 25 y el subpárrafo "c" del párrafo 2 del artículo 25 de la Convención Americana sobre Derechos Humanos en relación con el párrafo 1 del artículo 1 y el artículo 2 de esta Convención.

Además, la Corte Interamericana ha expresado por primera vez su opinión sobre el derecho a la protección social. Se refirió al derecho autónomo de recibir una pensión como parte de los derechos económicos, sociales, culturales y ambientales. También señaló que los elementos constitutivos de este derecho podrían derivarse del artículo 45 de la Carta de la Organización de los Estados Americanos a la luz de la Declaración Americana de los Derechos y Deberes del Hombre y otros tratados y documentos internacionales de derechos humanos. Debido al incumplimiento de las decisiones de los tribunales nacionales, el derecho del solicitante a una pensión no estaba adecuadamente protegido. Además, estas decisiones no se han ejecutado hasta la fecha, ya que los procedimientos del caso aún están pendientes. Además, la Corte Interamericana ha encontrado que en el contexto del impago de una pensión legalmente reconocida, los derechos a la protección social, la seguridad de la persona y el respeto a la dignidad humana están vinculados y, en algunos casos, la violación de uno de ellos puede afectar directamente al otro, en en particular en casos que involucran a ancianos. La Corte Interamericana determinó que la denegación del derecho a la protección social durante 27 años causó graves daños a la calidad de vida y el reembolso médico del solicitante, que necesitaba protección social debido al hecho de que era una persona mayor con discapacidad. Las irregularidades causadas por la falta de pagos de pensiones no se limitaron a las causadas por demoras irrazonables, ya que la pensión era la única fuente de ingresos del solicitante. El continuo impago de la pensión condujo inevitablemente a la inestabilidad de la situación financiera del solicitante, lo que afectó su capacidad para satisfacer sus necesidades básicas, lo que a su vez tuvo consecuencias para su estado psicológico y moral, así como el respeto a la dignidad humana. Por lo tanto, los mecanismos existentes no pudieron garantizar el derecho pertinente y las autoridades del Estado demandado violaron el Artículo 26 en relación con el Artículo 5, el Artículo 8, párrafo 1, el Artículo 11, párrafo 1, el Artículo 25, párrafo 2 (c) y el Artículo 1, párrafo 1, y el artículo 2 de la Convención Americana sobre Derechos Humanos.

Además, dado que la falta de protección judicial afectó el derecho de la víctima a una pensión que se convirtió en parte de su propiedad, la Corte Interamericana resolvió que las autoridades peruanas violaron el derecho a la propiedad privada garantizado por el artículo 21, párrafo 1, y el artículo 21, párrafo 2, en conjunto con el artículo 25, párrafo 1, el artículo 25, el párrafo 2 (c), el artículo 26 y el artículo 1, párrafo 1 de la Convención Americana sobre Derechos Humanos.


COMPENSACIÓN


En vista de las violaciones que encontró, la Corte Interamericana ordenó a las autoridades peruanas:

(i) restablecer el recibo de la pensión del solicitante, que también incluía la obligación del Estado de garantizar la prestación de atención médica a través del Plan de Salud Social del Perú (Es Salud);

(ii) publicar el presente Reglamento y su resumen oficial;

(iii) pagar los montos especificados en la sentencia con respecto a daños materiales e inmateriales, pérdida de ingresos y costos de jubilación, y pagar los costos incurridos por el Fondo de Asistencia Legal para Víctimas.

Inter-American Court of Human Rights judgment of 06 March 2019 in Muelle Flores v. Peru (Series C case no. 375).

The applicant was assisted in preparing a complaint to the Inter-American Commission on Human Rights (Washington, USA).

Subsequently, the Inter-American Commission on Human Rights referred the applicant's complaint to the Inter-American Court of Human Rights (San José, Costa Rica). The complaint was then communicated to Peru.

THE CIRCUMSTANCES OF THE CASE


On 30 September 1990 the applicant, Oscar Muel Flores, retired from his job at the state-owned Minera Especial Tintaya Ltd (hereinafter “the company”). On January 27, 1991, the company suspended his pension payments. Following the suspension, the applicant lodged a complaint with amparo with the Lima Fifth Civil Court, which ordered the company to resume pension payments. The decision of the court was upheld by the appeal court and then by the Supreme Court in its ruling of 2 February 1993, which invalidated the suspension of the payment of the pension.

On 17 February 1993 the company renewed the suspension of pension payments to several former employees, including the applicant. The latter again lodged a complaint with amparo, seeking retirement benefits and damages. The Peruvian Constitutional Court ordered the company to continue paying the applicant's pension, but dismissed the applicant's claim for damages. The company requested a judicial review of the administrative decision and that the applicant's reintegration into the pension regime be declared inadmissible. The trial court granted the company's claims, but its decision was overturned on the applicant's complaint by the Peruvian Supreme Court, which concluded that the claims were unfounded. The supervisory proceedings regarding the enforcement of the first amparo complaint filed by the applicant are still pending. Moreover, in 1994 the company was privatized in accordance with Decree-Law no.674, which established additional obstacles for the company to comply with court orders ordering the payment of the applicant's pension.


QUESTIONS OF LAW


The Inter-American Court of Human Rights (hereinafter - the Inter-American Court) decided that the Peruvian authorities had an obligation to pay the pension, as the courts found, immediately, efficiently and quickly, since it was a right that addressed basic needs and replaced the right to receive wages ... In addition, the Inter-American Court noted that the Peruvian authorities were also required to establish explicitly and clearly which organization was responsible for the enforcement of the judgment, which was not done in the present case. The Inter-American Court indicated that in the present case the burden was shifted to the victim. Moreover, the Inter-American Court of Justice noted that 26 and 19 years have elapsed, respectively, since the 1993 and 1999 judgments. This period influenced the legal status of the victim, given that he was an elderly person with limited financial capabilities. Taking into account the above facts, the Inter-American Court concluded that the Peruvian authorities did not act promptly, which was necessary in view of the applicant's vulnerable position and the fact that the time limit was unreasonable. Thus, the Peruvian authorities have violated the requirements of Article 8, paragraph 1 of Article 25 and subparagraph "c" of paragraph 2 of Article 25 of the American Convention on Human Rights in conjunction with paragraph 1 of Article 1 and Article 2 of this Convention.

In addition, the Inter-American Court has for the first time expressed its opinion on the right to social protection. He referred to the autonomous right to receive a pension as part of economic, social, cultural and environmental rights. He also pointed out that the constituent elements of this right could be derived from Article 45 of the Charter of the Organization of American States in the light of the American Declaration of the Rights and Duties of Man and other international human rights treaties and documents. Due to the failure to enforce the decisions of the domestic courts, the applicant's right to a pension was not adequately protected. In addition, these decisions have not been executed to date, since the proceedings on the case are still pending. Moreover, the Inter-American Court has found that in the context of non-payment of a legally recognized pension, the rights to social protection, security of person and respect for human dignity are linked and in some cases violation of one of them can directly affect the other, in in particular in cases involving the elderly. The Inter-American Court found that the denial of the right to social protection for 27 years caused serious damage to the quality of life and medical reimbursement of the applicant, who was in need of social protection due to the fact that he was an elderly person with disabilities. The irregularities caused by the lack of pension benefits were not limited to those caused by unreasonable delay, since the pension was the applicant's only source of income. The continued non-payment of the pension inevitably led to instability in the applicant's financial situation, which affected his ability to meet his basic needs, which in turn had consequences for his psychological and moral state, as well as respect for human dignity. Thus, the existing mechanisms were unable to guarantee the relevant right and the authorities of the respondent State violated Article 26 in conjunction with Article 5, Article 8 paragraph 1, Article 11 paragraph 1, Article 25 paragraph 2 (c) and Article 1 paragraph 1, and article 2 of the American Convention on Human Rights.

In addition, given that the lack of judicial protection affected the victim's right to a pension that became part of his property, the Inter-American Court ruled that the Peruvian authorities violated the right to private property guaranteed by article 21, paragraph 1, and article 21, paragraph 2, in conjunction with article 25, paragraph 1, article 25, paragraph 2 (c), article 26 and article 1, paragraph 1 of the American Convention on Human Rights.


COMPENSATION


In view of the violations it found, the Inter-American Court ordered the Peruvian authorities:

(i) reinstate the applicant's receipt of the pension, which also included the obligation of the State to guarantee the provision of medical care to him through the Peruvian Social Health Plan (Es Salud);

(ii) publish this Regulation and its official summary;

(iii) pay the amounts specified in the judgment in respect of pecuniary and non-pecuniary damage, loss of retirement income and costs, and pay the costs incurred by the Victim Legal Assistance Fund.
