Постановление ЕСПЧ от 13 февраля 2020 года по делу "Гаугран (Gaughran) против Соединенного Королевства" (жалоба N 45245/15).

В 2015 году заявителям была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Соединенному Королевству.

По делу успешно рассмотрена жалоба на неизбирательный характер полномочий властей Соединенного Королевства по хранению ДНК, отпечатков пальцев и фотографии заявителя как лица, осужденного за совершение преступления, вне зависимости от тяжести совершенного им преступления или необходимости бессрочного хранения этой информации и при отсутствии какой-либо реальной возможности пересмотра решения. По делу допущено нарушение требований статьи 8 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель был осужден за совершение преступления небольшой тяжести в Северной Ирландии. Он жаловался на то, что полиция могла неограниченное время хранить его ДНК, отпечатки пальцев и фотографии.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 8 Конвенции. Хранение ДНК и отпечатков пальцев заявителя представляло собой вмешательство в его личную жизнь. Учитывая, что фотография заявителя была сделана после его задержания и что ее хранение в базе данных местной полиции не было ограничено каким-либо сроком, что позволяло полиции применять технику распознавания лиц, фотографирование и хранение фотографии заявителя также представляли собой вмешательство в его право на уважение личной жизни.

Вмешательство было предусмотрено законом и преследовало правомерную цель предупреждения совершения преступлений. Если первоначальное получение данной информации было предназначено для установления связи лица с конкретным преступлением, в котором это лицо подозревалось, хранение данной информации преследовало более широкую цель: содействовать идентификации лиц, которые могут совершить преступления в будущем.

При определении срока хранения биометрических данных осужденных лиц пределы усмотрения властей сужены. Однако продолжительность срока хранения необязательно имеет решающее значение для разрешения вопроса о том, вышли ли власти государства-ответчика за границы допустимых пределов усмотрения при установлении соответствующего режима. Вместе с тем следует также учитывать тот факт, принимались ли во внимание тяжесть преступления и необходимость хранения данных, а также гарантии, предоставляемые соответствующему лицу. Когда власти государства-ответчика находятся на границе пределов усмотрения, предоставляя себе широкие полномочия по хранению данных без ограничения срока, наличие и функционирование некоторых гарантий приобретают решающее значение.

Власти Соединенного Королевства утверждали, что чем больше информации хранилось в базе данных полиции, тем больше преступлений можно было предотвратить. Согласие с этим доводом в контексте бессрочного хранения данных на практике было бы равнозначно оправданию хранения информации обо всем населении и об умерших лицах, что определенно было бы чрезмерно и излишне. Власти Соединенного Королевства также подчеркивали высокую вероятность того, что ранее осужденные лица будут снова привлечены к уголовной ответственности в течение относительно короткого двухлетнего срока.

Расследование "глухих дел" представляет собой общественный интерес в общем смысле борьбы с преступностью. Однако полиция должна была выполнять свои обязанности таким образом, который был совместим с правами и свободами других лиц.

Сделав выбор в пользу установления неограниченного сроком хранения данных, власти Соединенного Королевства должны были обеспечить наличие и эффективность некоторых гарантий для заявителя, осужденного за совершение преступления. Тем не менее биометрические данные и фотографии заявителя хранились без учета тяжести совершенного им преступления и наличия продолжающейся необходимости бессрочного хранения. Кроме того, полиция была вправе удалять биометрические данные и фотографии только в исключительных случаях. В законодательстве отсутствовали положения, которые бы позволяли заявителю обратиться с требованием об удалении касавшихся его данных, если их хранение более не представлялось необходимым ввиду характера преступления, возраста соответствующего лица, истекшего срока давности и поведения лица в настоящее время. Следовательно, пределы пересмотра, которого могло добиться заинтересованное лицо, были настолько узкими, что являлись почти гипотетическими.

Неизбирательный характер полномочий по хранению ДНК, отпечатков пальцев и фотографии заявителя как лица, осужденного за совершение преступления, вне зависимости от тяжести совершенного им преступления или необходимости бессрочного хранения этой информации и при отсутствии какой-либо реальной возможности пересмотра нарушал справедливый баланс между конкурирующими общественным и частным интересами. Пределы усмотрения властей государства-ответчика были немного шире применительно к хранению отпечатков пальцев и фотографии. Однако они не были достаточными для того, чтобы прийти к выводу о том, что хранение таких данных могло быть соразмерно при обстоятельствах дела, а именно при отсутствии каких-либо соответствующих гарантий и возможности реального пересмотра этого решения.

Следовательно, власти Соединенного Королевства вышли за пределы предоставленного им усмотрения в этом отношении, и оспариваемое заявителем хранение данных представляло собой несоразмерное вмешательство в его право на уважение личной жизни и не могло рассматриваться как необходимое в демократическом обществе.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 8 Конвенции (принято единогласно).

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд постановил, что констатация факта нарушения Конвенции будет являться достаточной справедливой компенсацией морального вреда.

ECHR judgment of 13 February 2020 in the case of Gaughran v. The United Kingdom (application no. 45245/15).

In 2015, the complainants were assisted in preparing their application. The application was subsequently communicated to the United Kingdom.

The case successfully addressed an application about the indiscriminate nature of the authority of the United Kingdom authorities to store DNA, fingerprints and photographs of the applicant as a convicted person, regardless of the gravity of the crime committed by him or the need to store this information indefinitely and in the absence of any real possibility revision of the decision. The case violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.


THE CIRCUMSTANCES OF THE CASE


The applicant was convicted of a minor offense in Northern Ireland. He complained that the police could keep his DNA, fingerprints and photographs indefinitely.


QUESTIONS OF LAW


Compliance with Article 8 of the Convention. The possession of the applicant's DNA and fingerprints amounted to an interference with his privacy. Given that the applicant's photograph was taken after his arrest and that its storage in the local police database was not limited to any length of time, which allowed the police to use facial recognition techniques, photographing and storing the applicant's photograph also constituted an interference with his right to personal respect. life.

The interference was prescribed by law and pursued the legitimate aim of preventing the commission of crimes. Where the initial acquisition of this information was intended to establish a link between a person and a specific crime of which that person was suspected, the storage of this information pursued a broader purpose: to facilitate the identification of persons who may commit crimes in the future.

When determining the storage period for biometric data of convicted persons, the limits of the authorities' discretion are narrowed. However, the length of the retention period is not necessarily decisive in deciding whether the respondent Government has overstepped the margin of appreciation in establishing the relevant regime. However, consideration should also be given to whether the gravity of the offense and the need for data storage, as well as the guarantees provided to the person concerned, were taken into account. When the authorities of the respondent State are on the border of the margin of appreciation, granting themselves broad powers to retain data for an indefinite period, the existence and functioning of some safeguards becomes crucial.

The United Kingdom government argued that the more information was stored in the police database, the more crimes could be prevented. Accepting this argument in the context of perpetual data storage would in practice be tantamount to justifying the storage of information about the entire population and about deceased persons, which would definitely be excessive and unnecessary. The United Kingdom authorities also stressed the high likelihood that previously convicted persons would be brought back to criminal responsibility within a relatively short two-year period.

The investigation of "deaf cases" is of public interest in the general sense of the fight against crime. However, the police had to carry out their duties in a manner that was compatible with the rights and freedoms of others.

Having opted for an indefinite retention period, the UK authorities had to ensure that some safeguards were in place and effective for an applicant convicted of a crime. However, the applicant's biometric data and photographs were stored without taking into account the gravity of the crime he had committed and the continuing need for indefinite storage. In addition, the police were only allowed to delete biometric data and photographs in exceptional cases. There were no provisions in the legislation that would allow the applicant to request the deletion of data concerning him, if their storage was no longer necessary due to the nature of the crime, the age of the person concerned, the expired statute of limitations and the person's current behavior. Consequently, the scope of revision that a stakeholder could obtain was so narrow that it was almost hypothetical.

The non-selective nature of the power to retain DNA, fingerprints and photographs of the applicant as a convicted person, irrespective of the severity of the crime he committed or the need for indefinite storage of this information, and in the absence of any real possibility of revision, upset the fair balance between competing public and private. interests. The Government's margin of appreciation was slightly wider with regard to the storage of fingerprints and photographs. However, they were not sufficient to conclude that the storage of such data could have been proportionate in the circumstances of the case, namely in the absence of any appropriate guarantees and the possibility of a real revision of this decision.

Consequently, the United Kingdom authorities went beyond their margin of appreciation in this respect and the retention of data contested by the applicant constituted a disproportionate interference with his right to respect for his private life and could not be regarded as necessary in a democratic society.


RESOLUTION

                    
There was a violation of Article 8 of the Convention in the case (adopted unanimously).


COMPENSATION


Application of Article 41 of the Convention. The Court held that a finding of a violation of the Convention would constitute sufficient just satisfaction for non-pecuniary damage.

По делу успешно рассмотрена жалоба на обстоятельства проведения оперативно-розыскных мероприятий в связи с предполагаемой причастностью к торговле наркотиками и возбуждения уголовного дела в отношении заявителей, нанесших граффити с антиправительственными лозунгами на памятник и не имевших какого-либо криминального прошлого до соответствующих событий. По делу допущено нарушение требований статей 3, 10, 18 во взаимосвязи со статьей 5, а также пункта 4 статьи 5 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Оба заявителя являются членами NIDA, молодежной организации, которая активно участвовала в организации и проведении антиправительственных демонстраций и изображалась властями как "радикально деструктивная". В одну из ночей в мае 2016 года заявители нанесли граффити с антиправительственными лозунгами на памятник бывшего президента Азербайджана с целью выразить свое несогласие с политикой властей, а затем распространили фотографии этого действия в социальных сетях.

 

На следующий день днем оба заявителя были доставлены в полицию. По утверждениям властей Азербайджана:

 

(i) ранее в тот же день полиция получила по отдельному и не связанному с настоящим делом оперативную информацию о том, что неустановленные лица по именам "Гияс" и "Байрам" (как и у заявителей) были причастны к торговле наркотиками в г. Баку, транспортировали и хранили наркотики у себя дома (информация не содержала подробных сведений, которые позволяли бы установить личность данных лиц);

 

(ii) с целью проверки этой информации и установления личностей подозреваемых полиция решила провести оперативно-розыскные мероприятия как единственное средство установить личности упомянутых выше лиц.

 

Следственные действия, которые были выполнены в связи с предполагаемой причастностью заявителей к торговле наркотиками, состояли главным образом в проведении личных обысков, обысков их квартир и изъятии наркотических веществ, обнаруженных в результате данных обысков. После задержания заявителей в отношении них было возбуждено уголовное дело, и они были заключены под стражу.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения пункта 1 статьи 5 Конвенции. Хотя уголовные дела в отношении каждого из заявителей формально не были связаны между собой и были основаны на разных фактах, из материалов дел следовало, что оба производства были построены по одному образцу в том, что касалось (i) обвинений в совершении преступлений и описания того, каким именно образом заявители предположительно приобретали и хранили наркотики, (ii) выполнения следственных действий (по существу и по охвату), (iii) времени проведения соответствующих проверок и принятия мер в отношении заявителей.

 

Ввиду следующих элементов и выводов, которые могли быть из них сделаны, в частности, что касается статуса заявителей, последовательности событий, способа проведения расследования и поведения властей, предоставленные Европейскому Суду материалы не достигали минимального стандарта обоснованности подозрений, служащих основанием для задержания.

 

(a) Оперативная информация, которая привела к задержанию заявителей. Возникали серьезные вопросы относительно надежности информации и мер, принятых в данном контексте, поскольку (i) у заявителей не было какого-либо криминального прошлого до соответствующих событий, (ii) сбор и получение соответствующей оперативной информации (ее источник и так далее) не уточнялись, (iii) а также, что наиболее важно, принимая во внимание тот факт, что власти смогли идентифицировать заявителей как двух подозреваемых торговцев наркотиками в течение нескольких часов без проведения каких-либо специальных мероприятий (особенно с учетом того, что оперативная информация не позволяла сразу "вычислить" заявителей таким образом, чтобы идентифицировать их, например, путем указания их полных имен или иных персональных данных).

 

(b) Следственные мероприятия после задержания заявителей. Нижеуказанные недостатки заставляют сомневаться в достоверности и точности доказательств, полученных в результате:

 

- личных обысков заявителей. Непроведение личного обыска на месте задержания было тем более удивительным, что согласно оперативной информации лица, упомянутые в ней, имели при себе наркотики. Кроме того, заявители были подвергнуты бесчеловечному и унижающему достоинство обращению в полиции после их задержания и в результате дали признательные показания. Это совпадало со временем их обысков и обнаружения у них наркотических веществ, которые были использованы в качестве доказательств против них;

 

- обысков в квартирах заявителей. Несмотря на то, что заявители обвинялись не просто в хранении наркотиков, а, скорее, в причастности к торговле наркотиками, единственным предположительно найденным и изъятым доказательством были пакеты с героином. Полиция не пыталась искать другие потенциальные доказательства, такие как наличные деньги, информацию о возможных поставщиках или покупателях или предметы, используемые при наркоторговле, в том числе весы и упаковочный материал. Даже предположив, что данные обыски проводились в присутствии понятых, этот довод не мог быть решающим при отсутствии каких-либо иных доказательств, например, видеозаписей. Кроме того, Комитет по предупреждению пыток и бесчеловечного или унижающего достоинство обращения или наказания сообщал о случаях, когда уличающие доказательства подбрасывались задержанным до приглашения понятых для проведения официального обыска и изъятия.

 

Наконец, несоответствие проявлялось также в том, что, хотя обыски в квартирах заявителей проводились в отсутствие адвокатов, в соответствующих протоколах было указано обратное;

 

- пределов расследований по уголовным делам. Обстоятельства, связанные с предполагаемым приобретением и сбытом заявителями наркотиков, предполагаемые существование преступных групп и роль заявителей в них абсолютно не интересовали следственные органы. В то же время заявители, которые являлись членами оппозиционного движения, постоянно жаловались на то, что наркотики были подброшены им в отместку за графическое нанесение ими политических лозунгов, однако ни на одной из стадий производства власти Азербайджана не старались проверить и провести расследование по данным жалобам.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований пункта 1 статьи 5 Конвенции (принято единогласно).

 

По поводу соблюдения статьи 18 Конвенции во взаимосвязи со статьей 5 Конвенции. По мнению Европейского Суда, было ясно, что реальной целью ограничения свободы заявителей было их наказание за нанесение граффити на памятник бывшего президента Азербайджана и выражение тем самым политических лозунгов против правительства. Данный вывод был сделан с учетом следующих элементов: (i) статуса заявителей (их членство в оппозиционной организации), (ii) последовательности событий (задержание заявителей вскоре после нанесения ими граффити с политическими лозунгами и распространения фотографий об этом) без "обоснованных подозрений" в совершении преступления, (iii) того факта, что мишенью правоохранительных органов явно являлись организация NIDA и ее члены, (iv) действий, свидетельствовавших о наличии практики произвольных задержаний и заключений под стражу лиц, критикующих правительство, активистов гражданского общества и правозащитников путем уголовного преследования за их действия и злоупотребление уголовным законом, что было установлено в деле "Алиев против Азербайджана" (Aliyev v. Azerbaijan) (Постановление Европейского Суда от 20 сентября 2018 г., жалобы N 68762/14 и 71200/14).

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 18 Конвенции во взаимосвязи со статьей 5 Конвенции (принято единогласно).

 

По поводу соблюдения статьи 10 Конвенции. Уголовное преследование заявителей формально не было связано с нанесением ими граффити на памятнике: вместо того, чтобы действовать в соответствии с ограничениями закона, власти предпочли подвергнуть заявителей преследованию за преступления, связанные с наркотиками, в качестве мести за их действия.

 

По мнению Европейского Суда, такое вмешательство в право на свободу выражения мнения заявителей было не только незаконным, но и явно произвольным и несовместимым с принципом верховенства права, который ясно упомянут в Преамбуле к Конвенции и неотъемлем от всех ее статей.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято единогласно).

 

Европейский Суд также единогласно постановил, что по делу были допущены нарушения требований статьи 3 Конвенции (как в материально-правовом, так и в процессуальном аспекте) и пункта 4 статьи 5 Конвенции.

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил каждому из заявителей по 30 000 евро в качестве компенсации морального вреда.

İşdə narkotik alveri ilə əlaqəli olduğu və abidədə hökumət əleyhinə şüarlar yazaraq qrafiti tətbiq edən və müvafiq hadisələrdən əvvəl heç bir cinayət hadisəsi keçirməmiş müraciət edənlərə qarşı əməliyyat-axtarış tədbirlərinin aparılması halları barədə şikayət uğurla araşdırılıb. 5-ci maddə ilə birlikdə 3, 10, 18-ci maddələrin, habelə İnsan Hüquqları və Əsas Azadlıqlarının Müdafiəsi Konvensiyasının 5-ci maddəsinin 4-cü bəndlərinin tələbləri pozulmuşdur.

 


İŞİN HALLARI

 


Hər iki müraciətçi hökumət əleyhinə nümayişlərin təşkili və aparılmasında fəal iştirak edən və səlahiyyətlilər tərəfindən “köklü dağıdıcı” kimi göstərilən bir gənclik təşkilatı olan NİDA-nın üzvləridir. Ərizəçilər 2016-cı ilin may ayının bir gecəsində hakimiyyətin siyasəti ilə razılaşmadıqlarını ifadə etmək üçün Azərbaycanın keçmiş prezidentinin abidəsi üzərində hökumət əleyhinə şüarlar yazılmış qrafiti çəkdilər və daha sonra bu aksiyanın fotolarını sosial şəbəkələrdə yaydılar.

 

Səhəri gün hər iki ərizəçi polis bölməsinə aparıldı. Azərbaycan hakimiyyət orqanlarına görə:

 

(i) həmin günün əvvəlində polis, bu işlə əlaqəli olmayan və "Qiyas" və "Bayram" adlı şəxsiyyəti olmayan şəxslərin (habelə müraciət edənlərin) Bakıda narkotik ticarəti ilə məşğul olduqlarına dair əməliyyat məlumatı aldı. evdə narkotik maddələrin daşınması və saxlanılması (məlumatda bu şəxslərin müəyyənləşdirilməsinə imkan verəcək ətraflı məlumat yox idi);

 

(ii) bu məlumatları yoxlamaq və şübhəlilərin şəxsiyyətlərini müəyyənləşdirmək üçün polis, yuxarıda göstərilən şəxslərin şəxsiyyətlərini müəyyənləşdirən yeganə vasitə olaraq əməliyyat-axtarış tədbirlərini həyata keçirməyə qərar verdi.

 

Müraciət edənlərin narkotik ticarəti ilə əlaqəli olduqları ilə əlaqədar aparılan istintaq addımları əsasən şəxsi axtarışlar, mənzillərində axtarışlar və bu axtarışlar nəticəsində aşkar edilmiş narkotik maddələrin ələ keçirilməsindən ibarətdir. Müraciət edənlərin həbsindən sonra barələrində cinayət işi açıldı və barələrində həbs qətimkan tədbiri seçildi.

 


HÜQUQ SUALLARI

 


Konvensiyanın 5-ci maddəsinin 1-ci bəndinə uyğun gəldikdə. Ərizəçilərin hər birinə qarşı açılan cinayət işləri rəsmi şəkildə əlaqələndirilməməsinə və fərqli faktlara əsaslanmasına baxmayaraq, hər iki məhkəmə işinin (i) cinayət ittihamları və təsviri əsasında tərtib edildiyi iş materiallarından irəli gəlir. ərizəçilərin narkotikləri necə əldə etdikləri və saxladıqları, (ii) istintaq mərhələlərinin necə aparıldığı (mahiyyəti və həcmi baxımından), (iii) müvafiq yoxlamaların və müraciət edənlərə qarşı tədbirlərin vaxtı.

- müraciət edənlərin şəxsi axtarışları. Müraciət edənlər yalnız narkotik maddə saxlamaqda deyil, əksinə narkotik ticarəti ilə əlaqəli olmaqda günahlandırılmasına baxmayaraq, tapıldığı və ələ keçirildiyi iddia edilən yeganə dəlil heroin paketləridir. Polis nağd pul, mümkün tədarükçülər və ya alıcılar haqqında məlumat, ya da pul qabları və qablaşdırma materialları da daxil olmaqla narkotik ticarətində istifadə olunan əşyalar kimi digər potensial dəlillər axtarmadı. Bu axtarışların vəsatət verən şahidlərin iştirakı ilə həyata keçirildiyini fərz etsək də, başqa dəlil, məsələn video qeydlər olmadıqda bu mübahisə həlledici ola bilməz. Bundan əlavə, İşgəncə və Qeyri-insani və ya ləyaqəti alçaldan rəftar və ya cəzanın qarşısının alınması Komitəsi, rəsmi şahidləri rəsmi axtarış və müsadirə üçün dəvət etməzdən əvvəl məhbuslara qarşı ittiham sübutlarının yerləşdirildiyi halları bildirdi.

 

Nəhayət, uyğunsuzluq həm də onda təzahür etdi ki, ərizəçilərin mənzillərində axtarışlar vəkil olmadıqda aparılsa da, əksi müvafiq protokollarda göstərildi;

 

- cinayət istintaqının hədləri. Ərizəçilər tərəfindən iddia edilən narkotik alqı-satqısı, cinayətkar qrupların mövcudluğu və ərizəçilərin onlardakı rolu ilə əlaqəli hallar istintaq orqanları üçün qətiliklə maraqlanmırdı. Eyni zamanda, müxalifət hərəkatının üzvü olan ərizəçilər daim siyasi şüarların qrafik tətbiq edilməsinə görə qisas almaq üçün üzərlərinə narkotik maddələrin əkildiyindən şikayət edirdilər, lakin məhkəmə prosesinin heç bir mərhələsində Azərbaycan hakimiyyəti bu şikayətləri yoxlamağa və araşdırmağa çalışmadı.

Məhkəmənin fikrincə, ərizəçilərin ifadə azadlığı ilə bu cür müdaxilə yalnız qanunsuz idi, həm də açıq şəkildə özbaşına və Konvensiyanın Preambulasında açıq şəkildə bəhs edilən və bütün maddələri ilə ayrılmaz olan qanunun aliliyi prinsipi ilə uyğun gəlmir.

Judgment of the ECHR of 13 February 2020 in the case of Ibrahimov and Mammadov v. Azerbaijan (application no. 63571/16).

 

In 2016, the complainants were assisted in preparing their application. Subsequently, the application was communicated to Azerbaijan.

 

The case successfully examined an application about the circumstances of the conduct of operational-search measures in connection with the alleged involvement in drug trafficking and the initiation of a criminal case against the applicants who applied graffiti with anti-government slogans on the monument and did not have any criminal past prior to the relevant events. There has been a violation of the requirements of Articles 3, 10, 18 in conjunction with Article 5, as well as paragraph 4 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 


THE CIRCUMSTANCES OF THE CASE

 


Both complainants are members of NIDA, a youth organization that was actively involved in organizing and conducting anti-government demonstrations and was portrayed by the authorities as “radically destructive”. On one night in May 2016, the applicants painted graffiti with anti-government slogans on the monument of the former President of Azerbaijan to express their disagreement with the policy of the authorities, and then circulated photographs of this action on social networks.

 

On the following day, both applicants were taken to the police station. According to the Azerbaijani authorities:

 

(i) earlier that day, the police received, in a separate and unrelated to the present case, operational information that unidentified persons named "Giyas" and "Bayram" (as well as the applicants) were involved in the drug trade in Baku , transported and stored drugs at home (the information did not contain detailed information that would allow identifying these persons);

 

(ii) in order to verify this information and establish the identities of the suspects, the police decided to carry out operational-search measures as the only means of identifying the above-mentioned persons.

 

The investigative steps that were carried out in connection with the applicants' alleged involvement in drug trafficking consisted mainly of conducting personal searches, searches of their apartments and the seizure of drugs found as a result of these searches. Following the applicants' arrest, criminal proceedings were instituted against them and they were remanded in custody.

 


QUESTIONS OF LAW

 


With regard to compliance with paragraph 1 of Article 5 of the Convention. Although the criminal cases against each of the applicants were not formally linked and were based on different facts, it followed from the case file that both proceedings followed the same pattern as regards (i) the charges of crimes and the description of exactly how the applicants allegedly acquired and possessed the drugs, (ii) how the investigative steps were carried out (in substance and scope), (iii) the timing of the relevant checks and action against the applicants.

 

In view of the following elements and the inferences that could be drawn from them, in particular as regards the applicants' status, the sequence of events, the manner in which the investigation was conducted and the conduct of the authorities, the materials submitted to the Court did not reach the minimum standard of substantiation of the suspicion that served as the basis for the arrest.

 

(a) The operational information that led to the applicants' arrest. Serious questions arose regarding the reliability of the information and the measures taken in this context, since (i) the applicants did not have any criminal history prior to the relevant events, (ii) the collection and receipt of relevant intelligence (its source, etc.) was not specified, (iii) and also, most importantly, taking into account the fact that the authorities were able to identify the applicants as two suspected drug traffickers within a few hours without any special measures (especially given the fact that the intelligence did not allow immediately " calculate "applicants in such a way as to identify them, for example, by indicating their full names or other personal data).

 

(b) Investigative measures following the applicants' arrest. The following shortcomings raise doubts about the reliability and accuracy of the evidence obtained as a result:

 

- personal searches of the applicants. The failure to conduct a personal search at the place of detention was all the more surprising since, according to the operational information, the persons mentioned in it had drugs with them. In addition, the applicants were subjected to inhuman and degrading treatment by the police after their arrest and as a result made confessions. This coincided with the time of their searches and the discovery of drugs on them, which were used as evidence against them;

 

- searches in the applicants' apartments. Despite the fact that the applicants were accused not only of drug possession, but rather of involvement in drug trafficking, the only evidence allegedly found and seized was packets of heroin. The police did not seek other potential evidence, such as cash, information about possible suppliers or buyers, or items used in the drug trade, including scales and packaging material. Even assuming that these searches were carried out in the presence of attesting witnesses, this argument could not be decisive in the absence of any other evidence, for example, video recordings. In addition, the Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment has reported cases where incriminating evidence was planted on detainees prior to inviting attesting witnesses for an official search and seizure.

 

Finally, the inconsistency was also manifested in the fact that, although the searches in the applicants' apartments were carried out in the absence of lawyers, the opposite was indicated in the relevant protocols;

 

- the limits of criminal investigations. The circumstances surrounding the alleged purchase and sale of drugs by the applicants, the alleged existence of criminal groups and the applicants' role in them were of absolutely no interest to the investigating authorities. At the same time, the applicants, who were members of the opposition movement, constantly complained that drugs were planted on them in retaliation for their graphic application of political slogans, but at no stage of the proceedings did the Azerbaijani authorities try to check and investigate these complaints.

 


RESOLUTION

 


There was a violation of Article 5 § 1 of the Convention in the case (adopted unanimously).

 

Regarding compliance with Article 18 of the Convention in conjunction with Article 5 of the Convention. In the Court's opinion, it was clear that the real purpose of restricting the applicants' freedom was to punish them for graffitiing a monument to the former President of Azerbaijan and thereby expressing political slogans against the government. This conclusion was drawn on the basis of the following elements: (i) the status of the applicants (their membership in an opposition organization), (ii) the sequence of events (the arrest of the applicants shortly after they had painted graffiti with political slogans and disseminated photographs about it) without “reasonable suspicion” of the commission of a crime, (iii) the fact that NIDA and its members were clearly targeted by law enforcement agencies, (iv) actions that indicated the existence of a practice of arbitrary arrest and detention of individuals who criticize the government, civil society activists and human rights defenders through criminal prosecutions for their actions and abuse of the criminal law, which was established in the case Aliyev v. Azerbaijan (Judgment of the European Court of September 20, 2018, applications nos. 68762/14 and 71200/14).

 


RESOLUTION

 


There was a violation of the requirements of Article 18 of the Convention in conjunction with Article 5 of the Convention (adopted unanimously).

 

Compliance with Article 10 of the Convention. The criminal prosecution of the applicants was not formally linked to their graffiti on the monument: instead of acting in accordance with the restrictions of the law, the authorities preferred to prosecute the applicants for drug-related crimes in retaliation for their actions.

 

In the Court's opinion, such interference with the applicants' right to freedom of expression was not only unlawful, but manifestly arbitrary and incompatible with the principle of the rule of law, which is clearly mentioned in the Preamble to the Convention and is inseparable from all its articles.

 


RESOLUTION

 


There was a violation of Article 10 of the Convention in the case (adopted unanimously).

 

The Court also held unanimously that there had been a violation of Article 3 of the Convention (both substantively and procedurally) and Article 5 § 4 of the Convention.

 


COMPENSATION

 


Application of Article 41 of the Convention. The Court awards each of the applicants EUR 30,000 in respect of non-pecuniary damage.
