Постановление ЕСПЧ от 24 марта 2020 года по делу "Мариус Александру и Маринела Штефан (Marius Alexandru and Marinela Stefan) против Румынии" (жалоба N 78643/11).

В 2011 году заявителям была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Румынии.

По делу успешно рассмотрена жалоба на неспособность властей установить причины падения дерева, которое привело к дорожно-транспортному происшествию со смертельным исходом, непроведение эффективного расследования, которое позволило бы установить виновных в происшествии и наказать их, а также длительность расследования. По делу допущено нарушение требований статьи 2 Конвенции о защите прав человека и основных свобод в ее процессуально-правовом аспекте. По делу не допущено нарушение требований статьи 2 Конвенции о защите прав человека и основных свобод в ее материально-правовом аспекте.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявители, муж и жена, ехали на автомобиле по общественной основной дороге, когда на обочину упало дерево, которое с корнями вырвало из земли. Это дерево упало на машину заявителей, которые получили многочисленные травмы, а трое других пассажиров погибли. Среди прочего, заявители жаловались на то, что не было проведено эффективного расследования, которое позволило бы установить виновных в происшествии и наказать их, а также они обжаловали длительность расследования.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 2 Конвенции (процессуально-правовой аспект). Дорожно-транспортная полиция возбудила уголовное дело в день инцидента, но в дальнейшем производство по делу затягивалось вследствие допущенных нарушений. Власти Румынии не выполнили свою обязанность по сбору ключевых доказательств относительно падения дерева и сохранения образцов, собранных со ствола и корней дерева. Это существенно повлияло на эффективность расследования, поскольку эксперты не могли составить судебно-медицинское заключение и сделать официальный вывод относительно причин падения дерева. Прокуратура не смогла установить причину падения дерева, а также установить, проявили ли власти халатность при осуществлении своих обязанностей.

Более того, на протяжении двух лет, пока материалы дела не направили в прокуратуру вместе с предложением прекратить производство по делу, сотрудники дорожной полиции предприняли крайне мало мер, и, кроме водителя автомобиля, никто больше не был назван потенциально виновным в инциденте. Суды Румынии также несколько раз отмечали многочисленные недостатки в ходе расследования по делу. Тот факт, что указанные недостатки не были рассмотрены, вызывает серьезные сомнения в тщательности работы следователей.

В ходе расследования уголовного дела судебные органы не выяснили некоторые вопросы, поскольку не определили точную роль различных дорожных служб и их сотрудников. Впоследствии, установив, что в деле не были нарушены правила дорожной безопасности, внутригосударственные суды пришли к выводу, что падение дерева являлось непредвидимым обстоятельством.

В заключение, по прошествии восьми с половиной лет после инцидента расследование все еще не было завершено, хотя настоящее дело не являлось особенно сложным. Такая продолжительность следствия не являлась обоснованной, и вину за его длительность несли власти Румынии, которые не предпринимали необходимых мер с самого начала расследования.

Что касается имевшейся у заявителей возможности воспользоваться гражданско-правовыми средствами защиты, чтобы добиться привлечения к ответственности службы дорожной безопасности и их сотрудников и вынесения постановления о выплате ими суммы компенсации ущерба, гражданский иск из причинения вреда не имел реальных перспектив быть рассмотренным, пока по уголовному делу не было вынесено вступившее в силу окончательное решение. Более того, ввиду того, что от начала расследования до его завершения прошло восемь с половиной лет, а также что власти не собрали и не обеспечили сохранность доказательств, имевших ключевое значение для установления виновных по делу, было бы чрезмерным требовать от заявителей, чтобы они пытались использовать новое средство правовой защиты с целью определить возможную ответственность органов государственной власти и их сотрудников за произошедший инцидент.

Таким образом, нельзя считать, что судебная система сделала возможным установление роли и ответственности государственных должностных лиц или органов государственной власти за дорожно-транспортное происшествие.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 2 Конвенции (процессуально-правовой аспект) (принято единогласно).

По поводу соблюдения статьи 2 Конвенции (материально-правовой аспект). Нельзя исключать, что при определенных обстоятельствах действия и бездействие властей в контексте обеспечения безопасности в общественных местах могут повлечь ответственность властей в рамках материально-правового аспекта статьи 2 Конвенции. Тем не менее, если Договаривающееся Государство принимает общую правовую систему и законодательство, составленные в ином контексте применительно к общественным местам, чтобы защитить пользующихся ими лиц, Европейский Суд не может согласиться с тем, что такие вопросы, как ошибочное суждение со стороны отдельного участника взаимоотношений или халатность в координировании действий среди профессионалов, не имеет значения, государственных или частных, сами по себе являются достаточными, чтобы Договаривающееся Государство несло ответственность с точки зрения предусмотренной статьей 2 Конвенции позитивной обязанности по защите жизни.

В ходе рассмотрения дела Европейским Судом заявители не жаловались на недостаточную нормативную правовую базу, регулировавшую безопасность на общественных дорогах, или на систематические нарушения, касавшиеся защиты безопасности лиц на этих дорогах в связи с неспособностью следить за деревьями вдоль них. Заявители лишь обжаловали предполагаемую неспособность уполномоченных властей Румынии предпринять надлежащие меры для предотвращения инцидента. Действительно, именно власти Румынии должны были определять необходимые действия, которые должны были быть предприняты, а также проверять зеленые насаждения вдоль дорог, которые были необходимы, чтобы обеспечить безопасность людей на дорогах. На момент инцидента в Румынии действовало законодательство, касавшееся безопасности на общественных дорогах, в частности, ухода и контроля за зелеными насаждениями вдоль дорог для предотвращения несчастных случаев. Данное законодательство регулировало перепись, контроль и уход за зелеными насаждениями, а также различные виды проверок, частоту этих проверок и лиц, ответственных за их проведение.

Если внутригосударственными властями была отмечена необходимость принятия мер безопасности, направленных на предотвращение потенциальных угроз для жизни людей, любое упущение в сфере обеспечения длительной эффективности данных мер должно было быть тщательно проверено судами Румынии, особенно если утверждалось, что такое упущение привело к тяжким телесным повреждениям или смерти. Следовательно, Европейский Суд должен был проверить, могли ли существовавшие механизмы прояснить обстоятельства настоящего дела и установить причины произошедшего инцидента. Вместе с тем данный вопрос должен был быть рассмотрен с точки зрения обязанности государства согласно процессуально-правовому аспекту статьи 2 Конвенции. Ввиду изложенных доводов настоящее дело не свидетельствует о каком-либо нарушении со стороны властей Румынии, связанном с выполнением ими обязанности защитить право заявителей на жизнь.

 

ПОСТАНОВЛЕНИЕ

 

По делу не было допущено нарушения требований статьи 2 Конвенции (материально-правовой аспект) (принято шестью голосами "за" при одном - "против").

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил по 20 000 и 5 000 евро первому и второму заявителям соответственно в качестве компенсации морального вреда.

in 2011, the applicants were assisted in preparing the aplication. The aplication was subsequently communicated to Romania.

The case successfully addressed an aplication about the failure of the authorities to determine the causes of the tree fall that led to the fatal traffic accident, the failure to conduct an effective investigation that would allow to identify the perpetrators of the accident and punish them, as well as the length of the investigation. The case violated the requirements of article 2 of the Convention for the protection of human rights and fundamental freedoms in its procedural and legal aspect. The case did not violate the requirements of article 2 of the Convention for the protection of human rights and fundamental freedoms in its substantive aspect.

 

FACTUAL BACKGROUND

 

The applicants, a husband and wife, were driving along a public main road when a tree fell to the side of the road and uprooted it. This tree fell on the applicants ' car, which sustained numerous injuries, and three other passengers were killed. Among other things, the applicants complained that an effective investigation had not been carried out to identify the perpetrators of the incident and punish them, and they also appealed against the length of the investigation.

 

POINT OF LAW

 

Regarding compliance with article 2 of the Convention (procedural and legal aspect). The traffic police opened a criminal case on the day of the incident, but further proceedings were delayed due to violations. The Romanian authorities failed in their duty to collect key evidence regarding the fall of the tree and to preserve samples collected from the trunk and roots of the tree. This significantly affected the effectiveness of the investigation, since experts could not draw up a forensic report and make an official conclusion about the causes of the tree fall. The Prosecutor's office was unable to determine the cause of the tree's fall, or whether the authorities were negligent in carrying out their duties.

Moreover, for two years, until the case file was sent to the Prosecutor's office along with a proposal to stop the proceedings, the traffic police took very little action, and, except for the driver of the car, no one else was named as potentially guilty of the incident. The Romanian courts also noted numerous shortcomings in the course of the investigation on several occasions. The fact that these shortcomings were not addressed raises serious doubts about the thoroughness of the investigators ' work.

During the investigation of the criminal case, the judicial authorities did not clarify some issues, because they did not determine the exact role of various road services and their employees. Subsequently, after finding that the road safety rules were not violated in the case, the domestic courts concluded that the fall of the tree was an unforeseen circumstance.

In conclusion, eight and a half years after the incident, the investigation was still incomplete, although the present case was not particularly complex. This length of investigation was not justified, and the Romanian authorities were blamed for its length, as they did not take the necessary measures from the very beginning of the investigation.

With regard to the applicants ' ability to use civil remedies to bring the road safety service and its employees to justice and order them to pay damages, the civil claim for damages had no real prospects of being considered until the final decision on the criminal case was made. Moreover, given that eight and a half years have elapsed from the beginning of the investigation to its conclusion, and that the authorities have not collected or preserved evidence that was key to identifying the perpetrators in the case, it would be excessive to require the applicants to try a new remedy in order to determine the possible responsibility of public authorities and their employees for the incident.

Thus, it cannot be considered that the judicial system has made it possible to establish the role and responsibility of public officials or public authorities for a road accident.

 

RESOLUTION

 

The case violated the requirements of article 2 of the Convention (procedural and legal aspect) (adopted unanimously).

Regarding compliance with article 2 of the Convention (substantive aspect). It cannot be excluded that, in certain circumstances, the actions and omissions of the authorities in the context of ensuring security in public places may entail the responsibility of the authorities under the substantive aspect of article 2 of the Convention. However, if a Contracting State adopts a General legal system and legislation drawn up in a different context in relation to public places in order to protect those who use them, the Court cannot accept that issues such as misjudgment on the part of an individual participant in the relationship or negligence in coordinating actions among professionals, whether public or private, are sufficient in themselves, that the Contracting State is responsible in terms of the positive duty to protect life provided for in article 2 of the Convention.

In the course of the case before the European Court of justice, the applicants did not complain about the insufficient legal framework governing safety on public roads, or about systematic violations related to the protection of the safety of persons on these roads due to the inability to monitor the trees along them. The applicants only appealed against the alleged failure of the authorized Romanian authorities to take appropriate measures to prevent the incident. Indeed, it was up to the Romanian authorities to determine the necessary actions to be taken, as well as to check the green spaces along the roads that were necessary to ensure the safety of people on the roads. At the time of the incident, Romania had legislation in place regarding safety on public roads, in particular the care and control of green spaces along roads to prevent accidents. This legislation regulated the census, control and maintenance of green spaces, as well as the various types of inspections, the frequency of these inspections and the persons responsible for them.

If the domestic authorities noted the need to take security measures aimed at preventing potential threats to human life, any omission in ensuring the long-term effectiveness of these measures should have been carefully checked by the Romanian courts, especially if it was alleged that such omission resulted in serious bodily injury or death. Consequently, the court should have checked whether the existing mechanisms could have clarified the circumstances of the present case and established the reasons for the incident. However, this issue should have been considered from the point of view of the state's obligation under the procedural and legal aspect of article 2 of the Convention. In view of the above arguments, the present case does not show any violation on the part of the Romanian authorities related to their duty to protect the applicants ' right to life.

 

RESOLUTION

 

The case did not violate the requirements of article 2 of the Convention (substantive aspect) (adopted by six votes in favor and one against).

 

COMPENSATION

 

In the application of article 41 of the Convention. The European Court awarded 20,000 and 5,000 euros each to the first and second applicants, respectively, in respect of non-pecuniary damage.

În 2011, solicitanților li s-a acordat ajutor în pregătirea plîngerii. Ulterior, plângerea a fost comunicată de România.

Cazul a examinat cu succes plângerea privind incapacitatea autorităților de a stabili cauzele căderii copacului care a dus la un accident rutier fatal, netestarea unei investigații eficiente care ar permite stabilirea vinovaților în accidente și pedepsirea acestora, precum și durata anchetei. În dosar a fost admisă încălcarea cerințelor articolului 2 din Convenția privind protecția drepturilor omului și libertăților fundamentale în aspectul ei procedural-juridic. În acest caz nu s-a admis încălcarea prevederilor articolului 2 din Convenția privind protecția drepturilor omului și libertăților fundamentale în aspectul financiar-juridic al acestuia.

 

CIRCUMSTANȚELE CAZULUI

 

Solicitanții, soțul și soția, au călătorit cu mașina pe drumul principal public, când un copac a căzut pe marginea drumului, care, cu rădăcini, a smuls din pământ. Acest copac a căzut pe mașina solicitanților care au suferit numeroase leziuni, iar alți trei pasageri au murit. Printre altele, solicitanții s-au plâns că nu a fost efectuată o investigație eficientă care să permită stabilirea vinovaților în caz de accident și pedepsirea acestora, precum și că au contestat durata anchetei.

 

PROBLEME DE DREPT

 

Cu privire la respectarea articolului 2 din Convenție (aspect procesual-juridic). Poliția Rutieră a intentat un dosar penal în ziua incidentului, însă ulterior producția în cauză a fost tergiversată în urma încălcărilor comise. Autoritățile române nu și-au îndeplinit obligația de a colecta dovezi-cheie privind căderea copacului și conservarea probelor colectate de pe trunchi și rădăcini de copac. Acest lucru a afectat în mod semnificativ eficacitatea anchetei, deoarece experții nu au putut să facă o concluzie medico-legală și să facă o concluzie oficială cu privire la cauzele căderii copacului. Procuratura nu a reușit să stabilească cauza căderii copacului, precum și să stabilească dacă autoritățile au manifestat neglijență în exercitarea atribuțiilor lor.

Mai mult, pe parcursul a doi ani, până la materialele dosarului nu au adresat la procuratură, împreună cu propunerea de a înceta procesul penal, colaboratorii poliției rutiere au luat foarte puține măsuri, și, în afară de conducătorul auto, nimeni nu a fost numit potențial vinovat de incident. De asemenea, instanțele din România au remarcat de mai multe ori numeroase deficiențe în cadrul anchetei în cauză. Faptul că aceste deficiențe nu au fost abordate ridică îndoieli serioase cu privire la diligența muncii anchetatorilor.

În cadrul anchetei penale, organele judiciare nu au clarificat unele probleme, deoarece nu au stabilit rolul exact al diferitelor servicii rutiere și al angajaților acestora. Ulterior, constatând că în dosar nu au fost încălcate regulile de siguranță rutieră, instanțele interne au ajuns la concluzia că căderea copacului a fost o circumstanță neprevăzută.

În concluzie, după opt ani și jumătate de la incident, ancheta nu a fost încă finalizată, deși cazul actual nu a fost deosebit de dificil. Această durată a anchetei nu a fost justificată, iar vina pentru durata acesteia a fost făcută de autoritățile române, care nu au întreprins măsurile necesare de la începutul anchetei.

În ceea ce privește disponibilă solicitanților posibilitatea de a beneficia de civil-mijloace legale de protecție, pentru a obține tragerea la răspundere a serviciului de siguranță rutieră și a angajaților acestora și a emiterii hotărîrii cu privire la plata de către aceștia a sumei de compensare a pagubei, acțiunea civilă din prejudiciu nu a avut perspective reale de a fi examinate până în cauza penală nu a fost pusă intrat în vigoare decizia finală. Mai mult, deoarece au trecut opt ani și jumătate de la începerea anchetei până la finalizarea acesteia, precum și că autoritățile nu au colectat și nu au asigurat siguranța dovezilor care au fost esențiale pentru stabilirea vinovaților în cauză, ar fi excesiv să solicite solicitanților să încerce să utilizeze un nou remediu pentru a determina posibila responsabilitate a autorităților publice și a angajaților acestora pentru incidentul

Astfel, nu se poate considera că sistemul judiciar a făcut posibilă stabilirea rolului și responsabilității funcționarilor publici sau a autorităților publice pentru accidentul rutier.

 

Hotărâre

 

În dosar a fost admisă încălcarea cerințelor articolului 2 al Convenției (aspect procesual-juridic) (adoptat în unanimitate).

Cu privire la respectarea articolului 2 din Convenție (aspect logistic). Nu se poate exclude că, în anumite circumstanțe, acțiunile și inacțiunile autorităților în contextul asigurării securității în locurile publice pot duce la responsabilitatea autorităților în cadrul aspectului logistic al articolului 2 al Convenției. Cu toate acestea, dacă un Stat Contractant ia generală a sistemului juridic și de legislație, întocmite în alt context, referitor la locurile publice, pentru a proteja vorbitorii de către aceștia a persoanelor, Curtea Europeană nu poate fi de acord cu faptul că probleme cum ar fi o neînțelegere din partea unui participant la relațiile sau neglijență în coordonarea acțiunilor în rândul profesioniștilor, nu contează, de stat sau private, de la sine sunt suficiente, pentru ca statul Contractant să fie responsabil în ceea ce privește obligația pozitivă de protecție a vieții prevăzută la articolul 2 al Convenției.

La momentul incidentului, în România au acționat legislația privind siguranța pe drumurile publice, în special îngrijirea și controlul spațiilor verzi de-a lungul drumurilor pentru prevenirea accidentelor. Această legislație reglementate recensământ, controlul și îngrijirea spațiilor verzi, precum și diferite tipuri de controale, frecvența acestor controale și a persoanelor responsabile de desfășurarea acestora.

Totodată, această problemă urma să fie examinată din punctul de vedere al atribuției statului în conformitate cu aspectul procesual-juridic al articolului 2 al Convenției. Având în vedere argumentele expuse, acest caz nu denotă nicio încălcare din partea autorităților române, legată de îndeplinirea obligației de a proteja dreptul reclamanților la viață.

 

Hotărâre

 

În dosar nu a fost admisă încălcarea cerințelor articolului 2 al Convenției (aspect logistic) (adoptată cu șase voturi "pentru" la un "contra").

 

Compensare

 

În ordinea aplicării articolului 41 din Convenție. Curtea Europeană a acordat 20 000 și 5 000 de euro primului și celui de-al doilea solicitant, respectiv, ca compensație pentru prejudiciul moral.

По делу успешно рассмотрена жалоба на то, что заявительница, являющаяся председателем фонда, представлявшего итальянское меньшинство в Румынии, оказалась в менее выгодном положении по сравнению с действующим кандидатом, представлявшим итальянское национальное меньшинство в стране (который принадлежал к другой организации), поскольку он не был обязан соблюдать какие-либо из формальностей, чтобы участвовать в повторных выборах. По делу было допущено нарушение требований статьи 14 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В Парламенте Румынии есть ряд мест, зарезервированных для представителей национальных меньшинств. Они освобождены от соблюдения предъявляемых при выборах требований, применимых к политическим партиям.

 

Заявительница, председатель фонда, представлявшего итальянское меньшинство в стране, хотела выставить свою кандидатуру на парламентских выборах в декабре 2012 года от имени возглавляемого ею фонда.

 

В мае 2012 года заявительница обратилась к Правительству Румынии, чтобы ее фонд получил статус благотворительного. Генеральный секретариат Правительства Румынии направил ходатайство заявительницы для рассмотрения одновременно в два органа административной власти: в Департамент межнациональных взаимоотношений и в Министерство культуры Румынии.

 

В июне 2012 года Департамент межнациональных взаимоотношений отказал в удовлетворении ходатайства заявительницы на том основании, что деятельность фонда не касалась данных взаимоотношений.

 

В июле 2012 года вступила в силу поправка к законодательству об ассоциациях и фондах, которая предусматривала более жесткие условия для предоставления организации статуса благотворительной.

 

В октябре 2012 года Центральная избирательная комиссия отказала заявительнице в регистрации в качестве кандидата на выборах, поскольку возглавляемый ею фонд не был благотворительным. Заявительница подала на это решение жалобу, которая была отклонена в том же месяце. В конце месяца истек срок для подачи кандидатами заявок для участия в парламентских выборах.

 

После выборов Министерство культуры Румынии сообщило заявительнице, что, хотя на момент подачи ходатайства возглавляемый ею фонд отвечал необходимым критериям, он не соответствовал новым критериям, введенным в действие указанной выше поправкой в законодательство Румынии.

 

Заявительница утверждала, что она оказалась в менее выгодном положении по сравнению с действующим кандидатом, представлявшим итальянское национальное меньшинство в стране (который принадлежал к другой организации), поскольку он не был обязан соблюдать какие-либо из формальностей, чтобы участвовать в повторных выборах.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 14 Конвенции во взаимосвязи со статьей 3 Протокола N 1 к Конвенции. В отличие от организаций, уже имевших представителей в парламенте, фонд, членом которого являлась заявительница, должен был получить статус благотворительного, чтобы заявительница могла участвовать в парламентских выборах от имени организации.

 

Настоящее дело следует отличать от дела "Данис и Ассоциация этнических турок против Румынии" (Danis and the Association of Ethinc Turks v. Romania) (Постановление Европейского Суда от 21 апреля 2015 г., жалоба N 16632/09) в отношении только одного формального аспекта, а именно установленных законом пределов действия условий для получения организацией статуса благотворительной, поскольку эти условия были изменены в 2012 году. В связи с этим выводы, сделанные Европейским Судом в вышеуказанном деле, относительно существования двухшаговой системы одобрения кандидатов от национальных меньшинств продолжали действовать. В отличие от упомянутого выше Постановления Европейского Суда по делу "Данис и Ассоциация этнических турок против Румынии" (Danis and the Association of Ethinc Turks v. Romania), заявительница в настоящем деле не узнала о новом условии внезапно. Следовательно, Европейский Суд должен был уточнить, была ли процедура предоставления организации статуса благотворительной, регулируемая соответствующими законодательными поправками, прозрачной и не произвольной и имела ли заявительница надлежащую возможность обжаловать в суде отказ в удовлетворении ее ходатайства.

 

По поводу полномочий по принятию решений. Согласно законодательству Румынии право наделить организацию статусом благотворительной принадлежало "Правительству Румынии", то есть исполнительной власти. Однако Генеральный секретариат Правительства Румынии направил ходатайство заявительницы в два разных административных органа, которые по-разному рассмотрели это ходатайство.

 

По поводу сроков для предоставления ответа. Хотя заявительница получила ответ от Департамента межнациональных взаимоотношений до истечения указанного срока для подачи документов, ответ от Министерства культуры Румынии она получила только после выборов.

 

По поводу критериев. Полученные заявительницей от двух административных органов ответы отличались. Приведенные Департаментом межнациональных взаимоотношений основания для отказа, по-видимому, предполагали, что заявительница не выполнила установленные законом требования (даже до внесения в них изменений). Со своей стороны Министерство культуры Румынии выразило мнение, что фонд заявительницы отвечал всем условиям, действовавшим на момент подачи ходатайства, но оно было рассмотрено в соответствии с измененными требованиями, которым фонд не соответствовал. Кроме того, Министерство культуры, по-видимому, не предоставило заявительнице возможность исправить свое первоначальное ходатайство с учетом новых законодательных критериев.

 

По поводу статуса ответов. Законодательство Румынии устанавливало, что орган административной власти должен был дать подавшему обращение лицу "мотивированный ответ" в течение 30 дней с даты "принятия решения". Однако в настоящем деле Генеральный секретариат Правительства Румынии потребовал, чтобы Департамент межнациональных взаимоотношений и Министерство культуры Румынии представили бы свои "мнения". По поводу судебных разбирательств. Ввиду изложенных ниже факторов заявительница не располагала эффективным средством правовой защиты в отношении ответов из Департамента межнациональных взаимоотношений или Министерства культуры Румынии.

 

По поводу пределов усмотрения органов исполнительной власти. Согласно прецедентной практике Высокого суда кассации и правосудия (Верховный суд Румынии) орган исполнительной власти сохранял право отказать в предоставлении организации статуса благотворительной, даже если указанная организация отвечала всем предусмотренным законом требованиям. Иными словами, окончательное решение принималось исходя из практической целесообразности, а не правовых критериев. Следовательно, любое судебное разбирательство в отношении решения Департамента межнациональных взаимоотношений ограничилось бы уточнением того, отвечал ли запрашивающий фонд установленным законом требованиям для получения статуса благотворительного, и суды не имели бы права предоставить фонду такой статус, даже если бы решили, что организация может получить этот статус.

 

По поводу отсутствия возможности подать жалобу в надлежащий срок. Поскольку заявительница была уведомлена об ответе Министерства культуры Румынии только после прошедших выборов, обжалование этого решения не смогло бы исправить обжалуемые заявительницей обстоятельства в такой срок, чтобы она смогла подать документы для участия в выборах.

 

Ввиду недостатков, касавшихся возможности судебного рассмотрения, которое не предоставляло достаточных гарантий против произвола, и несмотря на широкие пределы усмотрения, предоставленные государству в этом отношении, различие в обращении по сравнению с организациями национальных меньшинств, уже представленных в Парламенте Румынии, являлось недостаточно оправданным применительно к заявленной законной цели, а именно обеспечить, чтобы данные организации были бы представлены надлежащим образом, и поощрять только действительно заинтересованных кандидатов участвовать в выборах.

В порядке применения статьи 41 Конвенции. Европейский Суд постановил, что установление факта нарушения Конвенции само по себе будет являться достаточной справедливой компенсацией морального вреда, требование о компенсации материального ущерба было отклонено.

in 2013, the applicant was assisted in the preparation of the aplication. The aplication was subsequently communicated to Romania.

 

The case successfully dealt with an aplication that the applicant, who is the Chairman of a Foundation representing the Italian minority in Romania, was in a less favorable position than the current candidate representing the Italian national minority in the country (who belonged to another organization), since he was not required to comply with any of the formalities in order to participate in the re-election. The case violated the requirements of article 14 of the Convention for the protection of human rights and fundamental freedoms.

 

 

 

FACTUAL BACKGROUND

 

 

 

There are a number of seats reserved for members of national minorities in the Romanian Parliament. They are exempt from meeting the electoral requirements applicable to political parties.

 

The applicant, the chair of a Foundation representing the Italian minority in the country, wanted to run for the parliamentary elections in December 2012 on behalf of the Foundation she headed.

 

In may 2012, the applicant applied to the Romanian Government to have her Foundation granted charitable status. The General Secretariat of the government of Romania sent the applicant's application for consideration simultaneously to two administrative authorities: the Department of interethnic relations and the Ministry of culture of Romania.

 

In June 2012, the Department of interethnic relations rejected the applicant's request on the grounds that the Foundation's activities did not relate to these relationships.

 

In July 2012, an amendment to the law on associations and foundations came into force, which provided for stricter conditions for granting charitable status to an organization.

 

In October 2012, the Central election Commission refused to register the applicant as a candidate for the election, since the Foundation she headed was not a charity. The applicant filed a complaint against this decision, which was rejected in the same month. At the end of the month, the deadline for candidates to submit applications for participation in the parliamentary elections expired.

 

After the election, the Romanian Ministry of culture informed the applicant that, although at the time of submitting the application, the Foundation she headed met the necessary criteria, it did not meet the new criteria introduced by the above-mentioned amendment to Romanian legislation.

 

The applicant claimed that she was in a less favorable position than the current candidate representing the Italian national minority in the country (who belonged to a different organization), since he was not required to comply with any of the formalities in order to participate in the re-election.

 

 

 

POINT OF LAW

 

 

 

Concerning compliance with article 14 of the Convention in relation to article 3 of Protocol No. 1 to the Convention. Unlike organizations that already had representatives in Parliament, the Foundation of which the applicant was a member had to be granted charitable status in order for the applicant to participate in parliamentary elections on behalf of the organization.

 

The present case should be distinguished from the case of Danis and the Association of ethnic Turks V. Romania (Judgment of the European Court of justice of 21 April 2015, complaint N 16632/09) in respect of only one formal aspect, namely the legal limits on the conditions for obtaining charitable status for an organization, since these conditions were changed in 2012. In this regard, the conclusions reached by the European Court of justice in the above-mentioned case regarding the existence of a two-step system for approving candidates from national minorities continued to apply. In contrast to the above-mentioned judgment Of the European Court of justice in the case of Danis and the Association of ethnic Turks V. Romania, the applicant in the present case did not suddenly learn of the new condition. Consequently, the court should have clarified whether the procedure for granting charitable status to an organization regulated by the relevant legislative amendments was transparent and not arbitrary, and whether the applicant had a proper opportunity to appeal to the court against the rejection of her application.

 

About the decision-making authority. According to Romanian law, the right to grant charitable status to an organization belonged to the "government of Romania", i.e. the Executive power. However, the General Secretariat of the government of Romania sent the applicant's application to two different administrative bodies, which considered the application in different ways.

 

About the time frame for providing a response. Romanian law set a time limit (60 and 90 days, respectively) within which the authorized administrative authorities, and then the government, had to consider the application. Whether these terms were significant or binding was not clarified during the course of the court's consideration of the present complaint. However, this was an important issue in the present case, since the decision to grant the organization the status of "charitable" had to be obtained before the deadline for submission of documents by participants in the parliamentary elections. Although the applicant received a response from The Department of inter-ethnic relations before the deadline for submitting documents, she received a response from the Romanian Ministry of culture only after the election.

 

About the criteria. The responses received by the applicant from the two administrative authorities differed. The grounds for refusal given by the Department of interethnic relations seemed to suggest that the applicant had failed to comply with the legal requirements (even before they were amended). For its part, the Ministry of culture of Romania expressed the view that the applicant's Fund met all the conditions in force at the time of filing the application, but it was considered in accordance with the amended requirements, which the Fund did not meet. Furthermore, the Ministry of culture does not appear to have given the applicant the opportunity to correct her original application in accordance with the new legal criteria.

 

About the status of responses. Romanian law stipulated that the administrative authority had to give the applicant a "reasoned response "within 30 days from the date of the"decision". However, in the present case, the General Secretariat of the government of Romania requested that the Department of inter-ethnic relations and the Ministry of culture of Romania submit their "opinions". This information was not sufficient to determine with certainty whether these conclusions were preparatory in nature or were full-fledged administrative decisions. However, the responses received from the Department of interethnic relations and the Ministry of culture of Romania marked the end of the administrative procedure in this case, since, unlike in cases where the authorized administrative body proposed to assign the status of charity to the requesting organization, in situations where the application was rejected, the law did not provide for sending the request from the organization back to the government of Romania for a formal decision.

 

About legal proceedings. In view of the following factors, the applicant did not have an effective remedy for responses from the Department of inter-ethnic relations or the Ministry of culture of Romania.

 

Regarding the limits of discretion of the Executive authorities. According to the case-law of the High court of cassation and justice (the Supreme court of Romania), the Executive authority retained the right to refuse to grant charitable status to an organization, even if the organization met all the requirements stipulated by law. In other words, the final decision was made based on practical expediency, not legal criteria. Consequently, any judicial review of the decision of The Department of interethnic relations would be limited to determining whether the requesting Foundation met the legal requirements for obtaining charitable status, and the courts would not have the right to grant such status to the Foundation, even if they decided that the organization could obtain this status.

 

For not being able to file a complaint in due time. Since the applicant was notified of the response of the Romanian Ministry of culture only after the last election, an appeal against this decision would not have been able to correct the circumstances complained of by the applicant in such a time as to allow her to submit documents for participation in the election.

 

In view of the shortcomings regarding the possibility of judicial review, which did not provide sufficient guarantees against arbitrariness, and despite the wide margin of discretion granted to the state in this regard, the difference in treatment compared to organizations of national minorities already represented in the Romanian Parliament was not sufficiently justified in relation to the stated legitimate goal, namely, to ensure that these organizations were properly represented and to encourage only genuinely interested candidates to participate in elections.

 

 

 

RESOLUTION

 

 

 

The case violated the requirements of article 14 of the Convention (adopted unanimously).

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The European Court held that the finding of a violation of the Convention would in itself constitute sufficient just compensation for non-pecuniary damage, and the claim for compensation for pecuniary damage was rejected.

CIRCUMSTANȚELE CAZULUI

 

 

 

În Parlamentul României există o serie de locuri rezervate reprezentanților minorităților naționale. Acestea sunt scutite de respectarea cerințelor înaintate la alegeri aplicabile partidelor politice.

 

Solicitanta, președintele fondului, care a reprezentat minoritatea italiană din țară, a dorit să-și expună candidatura la alegerile parlamentare din decembrie 2012 în numele fondului pe care îl conduce.

 

În mai 2012, solicitantul a apelat la Guvernul României pentru ca fundația sa să obțină statutul de caritate. Secretariatul General al Guvernului României a înaintat demersul solicitantului de a fi examinat concomitent în două autorități administrative: la Departamentul Relații Interetnice și la Ministerul Culturii al României.

 

În iunie 2012, Departamentul Relații Interetnice a refuzat să satisfacă cererea solicitantului, pe motiv că activitatea fondului nu se referea la aceste relații.

 

În iulie 2012, a intrat în vigoare un amendament la legislația privind asociațiile și fondurile, care prevedea condiții mai stricte pentru a acorda organizației statutul de caritate.

 

În octombrie 2012, Comisia Electorală Centrală a refuzat solicitantului să se înregistreze în calitate de candidat la alegeri, deoarece fondul pe care îl conduce nu a fost caritabil. Reclamanta a depus o plângere împotriva acestei decizii, care a fost respinsă în aceeași lună. La finele lunii a expirat termenul de depunere a cererilor de participare la alegerile parlamentare de către candidați.

 

După alegeri, Ministerul Culturii al României i-a comunicat solicitantului că, deși la momentul depunerii demersului, fondul pe care îl conduce îndeplinea criteriile necesare, acesta nu corespundea noilor criterii impuse de amendamentul de mai sus în legislația României.

 

Reclamanta a susținut că s-a pomenit într-o poziție mai puțin avantajoasă față de candidatul în exercițiu care reprezenta minoritatea națională italiană din țară (care aparținea unei alte organizații), deoarece nu avea obligația de a respecta oricare dintre formalitățile de a participa la alegeri repetate.

 

 

 

PROBLEME DE DREPT

 

 

 

Privind respectarea articolului 14 din Convenție în legătură cu articolul 3 al Protocolului n 1 la Convenție. Spre deosebire de organizațiile care au avut deja reprezentanți în Parlament, fondul, al cărui membru era solicitantul, trebuia să obțină statutul de caritate, astfel încât solicitantul să poată participa la alegerile parlamentare în numele organizației.

 

În cazul de față ar trebui să fie diferențiate de la caz "Данис și Asociația etnicilor turci împotriva României" (Danis and the Association of Ethinc Turks v. Romania) (Hotărârea Curții Europene din 21 aprilie 2015, plângerea N 16632/09) în ceea ce privește doar una formală aspecte, și anume stabilite de lege, limite de acțiune condițiile pentru a obține statutul de organizație de caritate, pentru că aceste condiții au fost modificate în anul 2012. În acest sens, concluziile făcute de Curtea Europeană de justiție în dosarul de mai sus privind existența sistemului de aprobare în doi pași a candidaților din partea minorităților naționale au continuat să acționeze. Spre deosebire de Hotărârea de mai sus a Curții Europene în cazul "Danis și Asociația turcilor etnici împotriva României" (Danis and the Association of Ethinc Turks v.Romania), solicitantul în acest caz nu a aflat brusc despre noua condiție. Prin urmare, Curtea Europeană a trebuit să precizeze dacă procedura de acordare a statutului organizației a fost caritabilă, reglementată de amendamentele legislative relevante, transparentă și nu arbitrară și dacă solicitantul a avut o oportunitate adecvată de a contesta în instanță refuzul de a-și satisface cererea.

 

Cu privire la Autoritatea de luare a deciziilor. Potrivit legislației României, dreptul de a acorda organizației statutul de caritate a aparținut "Guvernului României", adică puterii executive. Însă Secretariatul General al Guvernului României a înaintat demersul solicitantului în două autorități administrative diferite, care au examinat diferit această demers.

 

Cu privire la termenele limită pentru a oferi un răspuns. Legislația României a stabilit termene (60 și 90 de zile, respectiv), în cadrul cărora autoritățile administrative abilitate și apoi guvernul urmau să examineze demersul. Întrebarea dacă aceste termene au fost semnificative sau obligatorii nu a fost clarificată în cadrul examinării prezentei plîngeri de către Curtea Europeană de justiție. Cu toate acestea, acest fapt a fost o întrebare importantă, deoarece decizia cu privire la acordarea statutului de organizare "caritate" a fost nevoie pentru a obține înainte de expirarea termenului de depunere a documentelor de către participanții la alegerile parlamentare. Deși solicitantul a primit un răspuns de la Departamentul Relații Interetnice pînă la expirarea termenului de depunere a documentelor, acesta a primit un răspuns de la Ministerul Culturii al României abia după alegeri.

 

Despre criterii. Răspunsurile primite de solicitant de la cele două autorități administrative au fost diferite. Motivele pentru refuz dintre departamentele relațiilor interetnice păreau să sugereze că solicitantul nu a îndeplinit cerințele stabilite de lege(chiar înainte de a face modificări). La rîndul său, Ministerul Culturii al României și-a exprimat opinia că fondul reclamantei a îndeplinit toate condițiile care au acționat la momentul depunerii demersului, însă acesta a fost examinat în conformitate cu cerințele modificate pe care fondul nu le corespundea. De asemenea, Ministerul Culturii, aparent, nu a oferit solicitantului posibilitatea de a-și corecta cererea inițială, ținând cont de noile criterii legislative.

 

Despre starea răspunsurilor. Legislația României a stabilit că autoritatea administrativă trebuia să dea persoanei care a depus sesizarea un "răspuns motivat" în termen de 30 de zile de la data"deciziei". Însă în acest caz, Secretariatul General al Guvernului României a cerut ca Departamentul Relații Interetnice și Ministerul Culturii al României să-și prezinte "opiniile". Aceste informații nu au fost suficiente pentru a stabili cu exactitate dacă aceste concluzii au avut un caracter pregătitor sau au fost decizii administrative complete. Cu toate acestea, răspunsurile primite de la Departamentul relații interetnice și Ministerul culturii din România, a însemnat finalizarea procedurii administrative de la acest fapt, deoarece, spre deosebire de cazuri, când autorizat de un organ administrativ propus atribuit organizației solicitante statutul de caritate, în situațiile în care cererea отклонялось, legea nu prevedea direcția de solicitare de organizare înapoi în Guvernul României, pentru a lua decizii oficiale.

 

În legătură cu procesul. Având în vedere factorii menționați mai jos, reclamanta nu avea un remediu eficient în ceea ce privește răspunsurile de la Departamentul Relații Interetnice sau de la Ministerul Culturii al României.

 

Referitor la limitele de discreție ale organelor puterii executive. Potrivit practicii precedente a Înaltei Curți de Casație și Justiție (Curtea Supremă a României), autoritatea executivă a menținut dreptul de a refuza acordarea de către organizație a statutului de caritate, chiar dacă organizația respectivă îndeplinea toate cerințele prevăzute de lege. Cu alte cuvinte, decizia finală a fost luată pe baza oportunității practice, nu a criteriilor juridice. Prin urmare, orice litigiu cu privire la decizia Departamentului de Relații Interetnice ar fi limitat la clarificarea faptului dacă fondul solicitant a îndeplinit cerințele legale stabilite pentru obținerea statutului de caritate, iar instanțele nu ar avea dreptul să ofere fondului un astfel de statut, chiar dacă ar fi decis că organizația ar putea obține acest statut.

 

Despre lipsa posibilității de a depune o plângere în termenul corect. Deoarece reclamanta a fost informată despre răspunsul Ministerului Culturii al României doar după alegerile din trecut, contestarea acestei decizii nu ar fi putut corecta circumstanțele contestate de solicitantă în acest termen, pentru ca ea să poată depune actele pentru a participa la alegeri.

 

Având în vedere neajunsurile ce țin de posibilitatea examinării judiciare, care nu oferea garanții suficiente împotriva arbitrajului și, în pofida limitelor largi de discreție oferite statului în acest sens, distincția de sesizare în comparație cu organizațiile minorităților naționale deja reprezentate în Parlamentul României a fost insuficient justificată în ceea ce privește scopul legal declarat, și anume de a se asigura că aceste organizații ar fi

 

 

 

Hotărâre

 

 

 

În dosar a fost admisă încălcarea cerințelor articolului 14 al Convenției (adoptată în unanimitate).

 

 

 

Compensare

 

 

 

În ordinea aplicării articolului 41 din Convenție. Curtea Europeană de Justiție a decis că stabilirea faptului încălcării Convenției în sine va fi o compensație echitabilă suficientă pentru prejudiciul moral, cererea de despăgubire a prejudiciului material a fost respinsă.

В 2011 году заявителю была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницирована Украине.

 

По делу успешно рассмотрены жалобы на обстоятельства неучастия свидетелей, давших обвинительные показания против заявителя, в судебном разбирательстве, которое завершилось признанием заявителя виновным. По делу допущено нарушение требований подпункта "d" пункта 3 статьи 6 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявитель был обвинен в краже наркотиков, к которым он имел доступ в качестве сотрудника полиции, и в их продаже своей знакомой Н.Ш. и ее друзьям, В.Г. и И.Г. Все указанные лица дали обвинительные показания против заявителя на этапе предварительного следствия. В этот период между ними и заявителем были проведены очные ставки. Только свидетельница Н.Ш. была допрошена в судебном заседании, но после того, как приговор был отменен судом второй инстанции, Н.Ш. не явилась повторно в суд. Двое других свидетелей никогда не давали показаний в суде.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения пункта 1 и подпункта "d" пункта 3 статьи 6 Конвенции. Европейский Суд применил совокупность двух групп принципов, выработанных в прецедентной практике Европейского Суда относительно допустимости показаний свидетелей, отсутствующих в суде, и принципа безотлагательности.

 

Первым важным фактором в отношении каждой из названных групп принципов являлся вопрос о том, какое значение имели эти показания в признании заявителя виновным. Трое свидетелей в настоящем деле являлись единственными непосредственными участниками противозаконной деятельности, в которой обвинялся заявитель. Все остальные доказательства против заявителя просто демонстрировали, что он имел возможность совершить преступление из-за доступа к наркотикам и что он контактировал с тремя указанными свидетелями. Следовательно, показания свидетелей являлись "решающими" в том смысле, что они, вероятно, имели решающее значение для результата рассмотрения дела в отношении заявителя.

 

Второй вопрос заключался в том, как изменился состав суда, который выносил приговор по делу заявителя. Состав суда был полностью изменен, и новый состав судей не допросил ни одного из указанных трех свидетелей.

 

Европейский Суд рассмотрел вопрос о том, имелись ли уважительные причины для неявки свидетелей при повторном судебном разбирательстве, которое завершилось признанием заявителя виновным, и применялись ли соответствующие гарантии для обеспечения того, что, несмотря на отсутствие свидетелей, состав суда, тем не менее, имел достаточное представление о показаниях отсутствующих свидетелей в целях соблюдения справедливости судебного процесса в целом.

 

Власти Украины не доказали, что соответствующие органы государственной власти проявили надлежащую старательность в своих усилиях по обеспечению явки свидетелей в суд. Что касается Н.Ш., власти не смогли установить ее местонахождение. Несмотря на то, что в ходе повторного судебного разбирательства один из свидетелей сказал, что он знал, где работала Н.Ш., отсутствуют данные о том, что власти использовали эту информацию или попытались найти Н.Ш. Следовательно, власти Украины не продемонстрировали, что имелись уважительные причины для неявки Н.Ш. в судебное заседание. Что касается В.Г. и И.С., отсутствовали причины сомневаться в том, что состояние их здоровья действительно мешало им проехать значительное расстояние до места проведения второго судебного разбирательства. Однако не было приведено каких-либо оснований для их неявки в ходе первого судебного разбирательства.

 

Европейский Суд счел особо важным тот факт, что власти Украины не доказали, что имелись уважительные причины для неявки свидетельницы Н.Ш. на второе судебное разбирательство. Поскольку показания двух остальных свидетелей были тесно связаны с показаниями Н.Ш. и учитывая основной характер показаний всех трех свидетелей, власти Украины должны были доказать, что применялись достаточно серьезные гарантии, которые обеспечивали надлежащее понимание новыми тремя судьями показаний указанных свидетелей, а также справедливость судебного процесса в целом.

 

В ходе судебного разбирательства были выявлены три потенциальных взаимоуравновешивающих альтернативных фактора:

 

(i) возможность, которая была у заявителя в ходе рассмотрения дела властями Украины, изложить свою версию событий, а также подвергнуть сомнению достоверность показаний неявившихся в суд свидетелей и указать на какие-либо несоответствия в их словах: у заявителя была такая возможность, но этот факт сам по себе не мог считаться достаточным уравновешивающим фактором, компенсировавшим ухудшившееся вследствие неявки свидетелей положение стороны защиты.

 

(ii) Доступность дополнительных подтверждающих доказательств: хотя они и существовали, они имели небольшую доказательственную ценность в отсутствие показаний трех рассматриваемых свидетелей.

 

(iii) Заявитель участвовал в перекрестных допросах всех трех свидетелей в ходе предварительного следствия и мог допросить Н.Ш. в суде во время первого судебного разбирательства.

 

В отличие от дел "Фамуляк против Украины" (Famulyak v. Ukraine) (Решение Европейского Суда от 26 марта 2019 г., жалоба N 30180/11) и "Пальчик против Украины" (Palchik v. Ukraine) (Постановление Европейского Суда по делу от 2 марта 2017 г., жалоба N 16980/06), заявитель утверждал, что на этапе предварительного расследования сторона защиты не имела доступа к доказательствам в материалах дела. Этот довод был важен для оценки справедливости процесса, но сам по себе не мог быть решающим, поскольку, если очная ставка имела место до завершения предварительного следствия, то во многих делах процесс сбора доказательств по своей природе мог оказаться незавершенным. Это нарушение не являлось настолько серьезным, чтобы сделать очные ставки со свидетелями полностью ненадлежащими процессуальными гарантиями.

 

Однако судья, рассматривавший дело заявителя и постановивший обвинительный приговор, не имел возможности лично допросить кого-либо из трех ключевых свидетелей стороны обвинения. Также он не располагал видеозаписью их показаний, хотя законодательство Украины предусматривало такую возможность, и эта запись могла бы являться важной дополнительной гарантией. Следовательно, нарушение в виде ограниченного ознакомления с материалами дела во время очных ставок, с которым заявитель столкнулся на этапе предварительного следствия, было осложнено отсутствием у заявителя возможности допросить свидетелей в присутствии судьи, рассматривавшего дело заявителя.

 

Таким образом, власти Украины не продемонстрировали наличие каких-либо особо серьезных гарантий, кроме того факта, что протоколы допросов свидетелей во время предварительного следствия и судебного разбирательства (Н.Ш.) были доступны новому судье, рассматривавшему дело. Власти Украины не доказали, что при обстоятельствах дела заявителя этой единственной гарантии было бы достаточно для соблюдения прав заявителя. Указанная совокупность обстоятельств могла оказать негативное воздействие на справедливость рассмотрения уголовного дела в отношении заявителя в целом.

 

В этом отношении дело заявителя следует отличать от упомянутого выше Решения Европейского Суда по делу "Фамуляк против Украины" (Famulyak v. Ukraine), в котором Европейский Суд признал соответствующую жалобу явно необоснованной, хотя состав суда был полностью изменен. Указанное дело характеризовалось особыми обстоятельствами, заключавшимися в том, что судья, рассматривавший дело заново, имел возможность допросить свидетеля, чьи показания имели ключевое значение для принятия решения по делу, даже при том, что сам заявитель не имел возможности допросить указанного свидетеля в присутствии указанного судьи.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований подпункта "d" пункта 3 статьи 6 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд постановил, что факт установления нарушения Конвенции сам по себе будет являться достаточной справедливой компенсацией морального вреда.

ECHR decision of March 12, 2020 in the case "Chernika V. Ukraine" (aplication N 53971/11 and other aplications).

 

In 2011, the applicant was assisted in preparing aplications. Subsequently, the aplications were combined and communicated to Ukraine.

 

The case successfully considered an aplications about the circumstances of the non-participation of witnesses who gave evidence against the applicant in the trial, which ended with the applicant's guilty plea. The case violated the requirements of article 6, paragraph 3 (d), of the Convention for the protection of human rights and fundamental freedoms.

 

 

 

FACTUAL BACKGROUND

 

 

 

The applicant was accused of stealing drugs that he had access to as a police officer and selling them to his friend N. sh.and her friends, V. G. and I. G. All of these persons testified against the applicant during the preliminary investigation. During this period, confrontations were held between them and the applicant. Only witness N. sh. was questioned at the court session, but after the verdict was overturned by the court of second instance, N. sh. did not appear again in court. The other two witnesses never testified in court.

 

 

 

POINT OF LAW

 

 

 

Regarding compliance with article 6, paragraph 3, paragraph 1 and subparagraph (d) of the Convention. The European Court applied a combination of two sets of principles developed in the case-law of the European Court of justice regarding the admissibility of testimony of witnesses who are absent from court, and the principle of urgency.

 

The first important factor in relation to each of these groups of principles was the question of what significance these statements had in the applicant's conviction. The three witnesses in the present case were the only direct participants in the illegal activities of which the applicant was accused. All other evidence against the applicant simply demonstrated that he was able to commit the crime because of his access to drugs and that he was in contact with the three named witnesses. Consequently, the witness statements were "decisive" in the sense that they were probably crucial to the outcome of the case against the applicant.

 

The second question was how the composition of the court that passed sentence in the applicant's case had changed. The composition of the court was completely changed, and the new judges did not question any of the three witnesses.

 

The court considered whether there were good reasons for the absence of witnesses at the retrial, which resulted in the applicant's conviction, and whether appropriate safeguards were applied to ensure that, despite the absence of witnesses, the court nevertheless had sufficient knowledge of the statements of the absent witnesses in order to ensure the fairness of the trial as a whole.

 

The Ukrainian authorities did not prove that the relevant state authorities had been diligent in their efforts to ensure the appearance of witnesses in court. As for N. S., the authorities were unable to determine her whereabouts. Despite the fact that during the retrial, one of the witnesses said that he knew where N. sh.worked, there is no evidence that the authorities used this information or tried to find N. sh. Consequently, the Ukrainian authorities did not demonstrate that there were valid reasons for N. sh. ' s non-appearance at the court session. As for V. G. and I. S., there was no reason to doubt that their state of health really prevented them from traveling a considerable distance to the venue of the second trial. However, no reason was given for their failure to appear during the first trial.

 

The European Court considered it particularly important that the Ukrainian authorities did not prove that there were valid reasons for the non-appearance of witness N. sh.at the second trial. Since the testimony of the other two witnesses was closely linked to that of N. S. and given the basic nature of the testimony of all three witnesses, the Ukrainian authorities had to prove that sufficient safeguards were applied to ensure that the new three judges properly understood the testimony of these witnesses, as well as the fairness of the trial as a whole.

 

In the course of the trial identified three potential alternative vzaimootnosheniyah factors:

 

(i) possibility, which was the applicant in the course of the proceedings by the Ukrainian authorities, to state its version of events and cast doubt on the credibility of no-shows of witnesses and point out any inconsistencies in their words: the applicant was a possibility, but this fact in itself could not be considered a sufficient countervailing factor that compensated for the deteriorating owing to the absence of witnesses the position of the defense.

 

(ii) Availability of additional supporting evidence: although it existed, it had little evidentiary value in the absence of the testimony of the three witnesses in question.

 

(iii) the Applicant participated in cross-examination of all three witnesses during the preliminary investigation and could have questioned N. S. in court during the first trial.

 

In contrast to The Famulyak V. Ukraine cases (Decision of the European Court of justice of 26 March 2019, complaint N 30180/11) and Palchik V. Ukraine (Judgment of the European Court of justice in the case of 2 March 2017, complaint N 16980/06), the applicant claimed that at the stage of the preliminary investigation, the defense party did not have access to evidence in the case file. This argument was important for assessing the fairness of the process, but it could not be decisive in itself, because if the confrontation took place before the conclusion of the preliminary investigation, in many cases the process of collecting evidence could by its nature be incomplete. This violation was not so serious as to make confrontations with witnesses completely inadequate due process guarantees.

 

However, the judge who reviewed the applicant's case and issued the guilty verdict was not able to personally question any of the three key prosecution witnesses. He also did not have a video recording of their testimony, although Ukrainian legislation provided for such a possibility, and this recording could be an important additional guarantee. Consequently, the violation of limited access to the case file during the confrontation, which the applicant encountered during the preliminary investigation, was complicated by the applicant's inability to question witnesses in the presence of the judge who examined the applicant's case.

 

Thus, the Ukrainian authorities did not demonstrate that there were any particularly serious guarantees, other than the fact that the records of the interviews of witnesses during the preliminary investigation and trial (N. S.) were available to the new judge who considered the case. The Ukrainian authorities did not prove that, in the circumstances of the applicant's case, this single guarantee would have been sufficient to ensure that the applicant's rights were respected. This combination of circumstances could have had a negative impact on the fairness of the criminal case against the applicant as a whole.

 

In this respect, the applicant's case should be distinguished from the above-mentioned decision of the European Court of justice In Famulyak V. Ukraine, in which The European Court found the relevant complaint manifestly unfounded, although the composition of the court was completely changed. The case in question was characterized by special circumstances, such as the fact that the judge who reviewed the case had the opportunity to question a witness whose testimony was key to making a decision on the case, even though the applicant himself did not have the opportunity to question the said witness in the presence of the said judge.

 

 

 

RESOLUTION

 

 

 

The case violated the requirements of article 6, paragraph 3 (d), of the Convention (adopted unanimously). &

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The European Court of justice held that the finding of a violation of the Convention would in itself constitute sufficient just compensation for non-pecuniary damage.

У справі успішно розглянути жалби на обставини неучасті свідків, що дали обвинувальні свідчення проти заявника, в судовому розгляді, яке завершилося визнанням заявника винним. ОБСТАВИНИ СПРАВИ

 

 

 

Заявник був звинувачений у крадіжці наркотиків, до яких він мав доступ в якості співробітника поліції, і в їх продажу своєї знайомої Н.Ш. і її друзям, в.г. І І. Г. всі зазначені особи дали обвинувальні свідчення проти заявника на етапі попереднього слідства. У цей період між ними і заявником були проведені очні ставки. Тільки свідок Н. Ш.була допитана в судовому засіданні, але після того, як вирок був скасований судом другої інстанції, Н. Ш.не з'явилася повторно в суд. Двоє інших свідків ніколи не давали свідчень у суді.

 

 

 

ПИТАННЯ ПРАВА

 

 

 

З приводу дотримання пункту 1 та підпункту "d" пункту 3 статті 6 Конвенції. Європейський Суд застосував сукупність двох груп принципів, вироблених у прецедентній практиці Європейського суду щодо допустимості показань свідків, відсутніх у суді, та принципу невідкладності.

 

Першим важливим фактором щодо кожної з названих груп принципів було питання про те, яке значення мали ці свідчення у визнанні заявника винним. Троє свідків у цій справі були єдиними безпосередніми учасниками протизаконної діяльності, в якій звинувачувався заявник. Всі інші докази проти заявника просто демонстрували, що він мав можливість вчинити злочин через доступ до наркотиків і що він контактував з трьома зазначеними свідками. Отже, показання свідків були "вирішальними" в тому сенсі, що вони, ймовірно, мали вирішальне значення для результату розгляду справи щодо заявника.

 

Друге питання полягало в тому, як змінився склад суду, який виносив вирок у справі заявника. Склад суду був повністю змінений, і новий склад суддів не допитав жодного із зазначених трьох свідків.

 

Європейський Суд розглянув питання про те, чи були поважні причини для неявки свідків при повторному судовому розгляді, яке завершилося визнанням заявника винним, і застосовувалися відповідні гарантії для забезпечення того, що, незважаючи на відсутність свідків, склад суду, тим не менш, мав достатнє уявлення про показання відсутніх свідків в цілях дотримання справедливості судового процесу в цілому.

 

Влада України не довела, що відповідні органи державної влади проявили належну старанність у своїх зусиллях щодо забезпечення явки свідків до суду. Що стосується Н. Ш., влада не змогла встановити її місцезнаходження. Незважаючи на те, що в ході повторного судового розгляду один зі свідків сказав, що він знав, де працювала Н.Ш., відсутні дані про те, що влада використовувала цю інформацію або спробували знайти Н.Ш. отже, влада України не продемонстрували, що були поважні причини для неявки Н.Ш. В судове засідання. Що стосується в. г. і І.З., були відсутні причини сумніватися в тому, що стан їх здоров'я дійсно заважало їм проїхати значну відстань до місця проведення другого судового розгляду. Однак не було наведено будь-яких підстав для їх неявки в ході першого судового розгляду.

 

Європейський Суд визнав особливо важливим той факт, що влада України не довела, що були поважні причини для неявки свідка Н.Ш. на другий судовий розгляд. Оскільки показання двох інших свідків були тісно пов'язані з показаннями Н. Ш. і враховуючи основний характер показань всіх трьох свідків, влада України повинна була довести, що застосовувалися досить серйозні гарантії, які забезпечували належне розуміння новими трьома суддями показань зазначених свідків, а також справедливість судового процесу в цілому.

 

В ході судового розгляду були виявлені три потенційних взаємоуравновешивающих альтернативних фактора:

 

(i) можливість, яка була у заявника в ході розгляду справи владою України, викласти свою версію подій, а також піддати сумніву достовірність показань не з'явилися в суд свідків і вказати на якісь невідповідності в їх словах: у заявника була така можливість, але цей факт сам по собі не міг вважатися достатнім врівноважуючим фактором, компенсировавшим погіршився внаслідок неявки свідків положення сторони захисту.

 

(ii) наявність додаткових підтверджуючих доказів: хоча вони і існували, вони мали невелику доказову цінність за відсутності показань трьох розглянутих свідків.

 

(iii) заявник брав участь у перехресних допитах всіх трьох свідків в ході попереднього слідства і міг допитати н.Ш. в суді під час першого судового розгляду.

 

На відміну від справ" Фамуляк проти України "(Famulyak v. Ukraine) (рішення Європейського суду від 26 березня 2019 р., скарга N 30180/11) та" Пальчик проти України " (Palchik v. Ukraine) (Постанова Європейського суду у справі від 2 березня 2017 р., скарга N 16980/06), заявник стверджував, що на етапі попереднього розслідування сторона захисту не мала доступу до доказів у матеріалах справи. Цей аргумент був важливий для оцінки справедливості процесу, але сам по собі не міг бути вирішальним, оскільки, якщо очна ставка мала місце до завершення попереднього слідства, то в багатьох справах процес збору доказів за своєю природою міг виявитися незавершеним. Це порушення не було настільки серйозним, щоб зробити очні ставки зі свідками повністю неналежними процесуальними гарантіями.

 

Однак суддя, який розглядав справу заявника і постановив обвинувальний вирок, не мав можливості особисто допитати кого-небудь з трьох ключових свідків сторони обвинувачення. Також він не мав відеозапису їхніх свідчень, хоча законодавство України передбачало таку можливість, і цей запис міг би бути важливою додатковою гарантією. Отже, порушення у вигляді обмеженого ознайомлення з матеріалами справи під час очних ставок, з яким заявник зіткнувся на етапі попереднього слідства, було ускладнене відсутністю у заявника можливості допитати свідків у присутності судді, який розглядав справу заявника.

 

Таким чином, влада України не продемонструвала наявність будь-яких особливо серйозних гарантій, крім того факту, що протоколи допитів свідків під час попереднього слідства і судового розгляду (Н.Ш.) були доступні новому судді, який розглядав справу. Влада України не довела, що за обставин справи заявника цієї єдиної гарантії було б достатньо для дотримання прав заявника. Зазначена сукупність обставин могла зробити негативний вплив на справедливість розгляду кримінальної справи щодо заявника в цілому.

 

У цьому відношенні справу заявника слід відрізняти від згаданого вище рішення Європейського суду у справі "Фамуляк проти України" (Famulyak v. Ukraine), в якому Європейський Суд визнав відповідну скаргу явно необґрунтованою, хоча склад суду був повністю змінений. Зазначена справа характеризувалася особливими обставинами, які полягали в тому, що суддя, який розглядав справу заново, мав можливість допитати свідка, чиї свідчення мали ключове значення для прийняття рішення у справі, навіть при тому, що сам заявник не мав можливості допитати зазначеного свідка в присутності зазначеного судді.

 

 

 

ПОСТАНОВА

 

 

 

У справі було допущено порушення вимог підпункту " d " пункту 3 статті 6 Конвенції (прийнято одноголосно).

 

 

 

КОМПЕНСАЦІЯ

 

 

 

У порядку застосування статті 41 Конвенції. Європейський Суд постановив, що факт встановлення порушення Конвенції сам по собі буде достатньою справедливою компенсацією моральної шкоди.
