Постановление ЕСПЧ от 30 июня 2020 года по делу "Чимпершек (Cimpersek) против Словении" (жалоба N 58512/16).

В 2016 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Словении.

По делу успешно рассмотрена жалоба на отказ в присвоении статуса судебного эксперта заявителю, который успешно сдал соответствующий экзамен и был приглашен для принесения присяги. По делу допущено нарушение требований статьи 10, пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель хотел стать судебным экспертом. Он успешно сдал соответствующий экзамен и был приглашен для принесения присяги. Однако Министерство юстиции отказалось присвоить ему данный статус на основании того, что он не был подходящим кандидатом. В своем решении Министерство юстиции ссылалось на содержание блога заявителя, а также на его жалобы, касавшиеся недостатков в работе данного министерства и в отношении проведения церемонии принесения присяги.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 10 Конвенции. Заявитель не жаловался на отказ органов государственной власти назначить его судебным экспертом как таковой, но утверждал, что данное решение представляло собой наказание за осуществление им права на свободу выражения мнения, гарантированного статьей 10 Конвенции.

В соответствии с прецедентной практикой Европейского Суда, если Договаривающиеся Государства не пожелали взять на себя обязательство признать в Конвенции или Протоколах к ней право на доступ к государственной службе, они, тем не менее, обязаны не препятствовать данному доступу по основаниям, попадающим под защиту Конвенции, согласно статье 1 Конвенции. В этой связи можно провести параллель с прецедентной практикой Европейского Суда в сфере применения понятия "личная жизнь" к случаям, связанным с трудоустройством, в контексте статьи 8 Конвенции, в том числе к ограничениям доступа к государственной службе. В соответствии со статьей 8 Конвенции жалобы, касающиеся осуществления профессиональных обязанностей, признавались относящимися к понятию "личная жизнь", когда факторы, связанные с личной жизнью, были критериями для получения соответствующей должности, и когда оспариваемая мера была основана соображениях, затрагивающих свободу выбора частного лица в сфере личной жизни.

Европейский Суд отметил следующие имеющие значение элементы: перед тем, как министр отказался назначить заявителя судебным экспертом, заявитель успешно сдал соответствующий экзамен и был приглашен для принесения присяги, министр обосновал соответствующее решение исключительно ссылкой на содержание блога заявителя и его электронных писем, в которых последний высказывал критику по поводу того, что церемония принесения присяги была отложена. Из этого следует, что основные элементы решения были связаны с правом на свободу выражения мнения, даже если его осуществление рассматривалось Министерством юстиции как доказательство того, что заявитель не был подходящим кандидатом для должности судебного эксперта. Европейский Суд не согласился с доводом властей государства-ответчика о том, что, отказав заявителю, министр принял во внимание право заявителя на свободу выражения мнения лишь с целью установить, соответствовал ли он требованиям, предъявляемым к должности судебного эксперта, поскольку ущерб, причиненный заявителю, был прямо связан с реализацией ключевых элементов данного права. Отказ также имел сдерживающий эффект для осуществления свободы выражения мнения теми, кто хотел стать судебными экспертами. На вопрос о том, были ли данная мера и связанный с ней сдерживающий эффект обоснованными, необходимо было ответить при рассмотрении дела по существу. Следовательно, обжалуемая мера относилась главным образом к праву на свободу выражения мнения, а не к доступу к государственной службе. Отказ в назначении заявителя судебным экспертом представлял собой вмешательство в осуществление им права на свободу выражения мнения, гарантированного статьей 10 Конвенции.

Министр обосновал отказ в назначении заявителя судебным экспертом ссылкой на его блог и письма, которые министр счел оскорбительными. Министр не сослался на конкретный пост в блоге или на параграф письма и не уточнил каким-либо иным способом, какие именно высказывания заявителя в его блоге или письмах показались ему оскорбительными. Отсутствие такой мотивировки решения министра особенно заслуживает внимания, поскольку всего за несколько дней до этого министр считал, что для назначения заявителя судебным экспертом не было каких-либо препятствий.

Административный суд также не высказался по поводу права на свободу выражения мнения заявителя и не рассмотрел доводы последнего в этой связи, основываясь исключительно на мотивировке оспариваемого решения министра. В частности, административный суд не сопоставил право заявителя на свободу выражения мнения, гарантированное статьей 10 Конвенции, и общественный интерес, который предположительно преследовало оспариваемое решение. Принимая во внимание вышеизложенное и соображения, которые привели Европейский Суд к выводу о том, что по делу было допущено нарушение пункта 1 статьи 6 Конвенции, он считает, что рассматриваемое вмешательство в осуществление заявителем его права на свободу выражения мнения не сопровождалось эффективным и адекватным судебным пересмотром.

Поведение кандидата на должность судебного эксперта могло приводить к появлению разумных сомнений в том, будет ли он выполнять работу эксперта тщательно и беспристрастно. Однако при отсутствии в решениях министра и Административного суда подробного изложения причин, по которым осуществление заявителем его права на свободу выражения мнения было оскорбительным и как таковое несовместимым с работой эксперта, Европейский Суд не мог согласиться с доводом властей Словении о том, что отказ в назначении заявителя судебным экспертом был необходим для защиты нравственности и репутации судебных экспертов, а также для обеспечения авторитета и беспристрастности судебной власти.

Вышеизложенные соображения, в частности, тот факт, что министр и Административный суд не провели какой-либо оценки соблюдения справедливого баланса между затронутыми конкурирующими интересами и что поэтому Европейский Суд не смог эффективно проверить, применили ли власти государства-ответчика стандарты, установленные в его прецедентной практике по вопросу сопоставления этих интересов, были достаточными для того, чтобы Европейский Суд пришел к выводу, что при обстоятельствах дела заявителя вмешательство в осуществление им права на свободу выражения мнения не было "необходимо в демократическом обществе".

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято единогласно).

Европейский Суд также единогласно постановил, что по делу было допущено нарушение пункта 1 статьи 6 Конвенции в связи с непроведением устного судебного заседания в ходе производства в Административном суде.

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 15 600 евро в качестве компенсации морального вреда, требование о возмещении материального ущерба было отклонено.

Sklep EKČP z dne 30.Junija 2020 v zadevi "Cimpersek proti Sloveniji" (pritožba št. 58512/16).

leta 2016 je vložnik pomagal pri pripravi pritožbe. Pritožba je bila pozneje posredovana Sloveniji.

V primeru uspešno šteje za pritožbo zoper zavrnitev podelitve statusa forenzični strokovnjak, da prijavitelj, ki je uspešno opravil ustrezne izpit in bil povabljen na prisego. V primeru kršene zahteve iz člena 10 (1) člen 6, Konvencija o varstvu človekovih pravic in temeljnih svoboščin.

 

 

OKOLIŠČINE ZADEVE

 

Kandidat je hotel postati forenzični strokovnjak. Uspešno je opravil izpit in je bil povabljen, da priseže. Ministrstvo za pravosodje mu tega statusa ni odobrilo, ker ni bil primeren kandidat. V svoji odločbi Ministrstva za pravosodje iz vsebine prosilca blog, kot tudi za njegove pritožbe v zvezi z pomanjkljivosti v delo tega Ministrstva in v odnosu do ravnanja zaprisego v obred.

 

PRAVNA VPRAŠANJA

 

Glede skladnosti s členom 10 Konvencije. Tožeča stranka ni pritožujejo zavrnitev državnih organov, da imenuje ga kot forenzični strokovnjak, kot take, ampak je trdila, da je ta odločitev je bila kazen za uresničevanje svoje pravice do svobode izražanja zagotovljena z 10. člen Konvencije.

V skladu s sodno prakso Evropskega Sodišča, če Pogodbenice se niso odločili, da se zavežejo, da bodo prepoznali v Konvencije ali njenih Protokolov, pravico dostopa do javnih storitev, so kljub temu dolžan, ne da bi to preprečili dostop na podlagi tega, da sodijo pod zaščito Konvencije v skladu s 1. členom Konvencije. V zvezi s tem, vzporedno se lahko pripravi s sodno prakso Evropskega Sodišča v uporabo pojma "zasebno življenje" da, povezane z zaposlovanjem primerih v okviru 8. člena Konvencije, vključno z omejitvami glede dostopa do javnih storitev. V skladu z 8. členom Konvencije, reklamacije v zvezi z izvajanjem strokovnih nalog so se šteje, da spadajo v koncept "zasebno življenje", ko so dejavniki, povezani z osebno življenje so merila za pridobitev ustreznih položaj, in ko izpodbijani ukrep je bil na podlagi dejstev, ki vplivajo na svobodno izbiro posameznika, na področju osebnega življenja.

Sodišče je menilo, naslednje pomembne elemente: pred Minister zavrnil imenovanje vlagatelj kot forenzični strokovnjak, vlagatelj uspešno opravili ustreznih izpitov in bil povabljen, da bi prisegla, Minister utemeljenih odločitev izključno nanaša na vsebino prosilca blog in svojo e-pošto, v kateri je ta izražena kritika, ki zaprisego na slovesnosti je bila preložena. Iz tega sledi, da je glavni elementi odločitev je bila povezana s pravico do svobode izražanja, tudi če njegovo izvajanje je po mnenju Ministrstva za pravosodje kot dokazilo, da ima prijavitelj ni bil primeren kandidat za položaj forenzični strokovnjak. Sodišče ni strinjal z vlado trditev, da v zavrnitev vlagatelja, Minister moral upoštevati prosilčeve pravico do svobodnega izražanja le zato, da se ugotovi, ali se je srečal zahteve za položaj forenzični strokovnjak, saj je škodo povzročil, da je bil prosilec neposredno nanašajo na izvajanje ključnih elementov te pravice. Zavrnitev je imel tudi odvračalni učinek na uresničevanje svobode izražanja tistih, ki so želeli postati forenzični strokovnjaki. Na vprašanje, ali sta bila ukrep in njegov s tem povezan odvračilni učinek upravičena, je bilo treba odgovoriti na utemeljenost. Zato se je zadevni ukrep nanašal predvsem na pravico do svobode izražanja in ne na dostop do javnih storitev. Zavrnitev imenuje vlagatelj kot forenzični strokovnjak pomenila poseganje v njegovo uresničevanje pravice do svobode izražanja zagotovljena z 10. člen Konvencije.

Minister je utemeljil zavrnitev imenovanja prosilca za forenzičnega strokovnjaka s sklicevanjem na njegov blog in pisma, za katere je Minister menil, da so žaljivi. Minister, ni se nanašajo na določen blog post ali odstavek, črka, niti ni določite v kateri koli drugi način, ki izkazov vlagatelja v svoj blog ali črke zdelo žaljivo, da ga. Pomanjkanje kot utemeljitev za odločitev Ministra še posebno pozornost, saj je le nekaj dni prej Minister, je menil, da ni bilo nobenih ovir za vlagatelja dogovoru, kot forenzični strokovnjak.

Upravno sodišče tudi ni komentar o vložniku na njegovo pravico do svobode izražanja in ni upoštevala slednje trditve v zvezi s tem, ki temelji le na razlogih za izpodbijano odločbo Ministra. Zlasti upravno sodišče ni primerjati vlagatelj pravico do svobode izražanja zagotovljena z 10. člen Konvencije z javnim interesom naj bi ga zasleduje izpodbijani odločbi. Ob upoštevanju zgoraj, in ugotovitve, ki so privedle sodišča sklepamo, da je bil kršen člen 6, odstavek 1, Konvencije, vendar meni, da so motnje v vprašanje, s vlagatelja izvršujejo svojo pravico do svobode izražanja je ne spremlja učinkovitega in ustreznega sodnega nadzora.

Ravnanje kandidata za položaj forenzični strokovnjak, lahko povzroči, da se upravičen dvom, ali bi ga opravljajo strokovna dela, temeljito in nepristransko. Vendar pa je v odsotnosti podrobna obrazložitev v sklepi Vlade rs in Upravnega sodišča, ki od razlogov, zakaj vlagatelja izvršujejo svojo pravico do svobode izražanja je žaljivo in kot tak nezdružljiva z delom strokovnjakov, sodišče ne bi moglo sprejeti Slovenske oblasti " argument, da je zavrnitev imenuje vlagatelj kot forenzični strokovnjak, ki je potrebna za zaščito, morale in ugled forenzični strokovnjaki, kot tudi za zagotavljanje avtoritete in nepristranskosti sodstva.

Na zgoraj navedeno, zlasti dejstvo, da Vlade rs in Upravnega sodišča, ki si ne bi vsako ocenjevanje je pravično ravnovesje med konkurenčnih interesov sodelujejo in da sodišče je zato ne more učinkovito preverja, ali so organi Tožene država uporablja standardi, določenimi v njenem primeru-zakon o primerjavi teh interesov, je bilo dovolj za sodišče za sklenitev, da v primeru prosilca poseganje v uresničevanje njegove pravice do svobode izražanja ni bilo "potrebno v demokratični družbi".

 

Ločljivost

 

Primer je pomenil kršitev zahtev iz člena 10 Konvencije (sprejeto soglasno).

Evropsko Sodišče je tudi soglasno odločilo, da je bil kršen člen 6, odstavek 1, Konvencije v zvezi z opustitvijo izvede glavno obravnavo v postopku pred Upravnim sodiščem.

 

Nadomestila

 

Pri uporabi člena 41 Konvencije. Sodišče je tožeči stranki dodelilo 15,600 EUR za nedonosno škodo, vendar je bil zahtevek za denarno škodo zavrnjen.

CIRCUMSTANCES OF THE CASE

 

The applicant wanted to become a forensic expert. He successfully passed the relevant exam and was invited to take the oath. LEGAL ISSUES

 

Regarding compliance with article 10 of the Convention. The applicant did not complain about the refusal of the state authorities to appoint him as a forensic expert as such, but argued that this decision was a punishment for the exercise of his right to freedom of expression guaranteed by article 10 of the Convention.

According to the case-law of the European Court of justice, if Contracting States have not chosen to undertake to recognize in the Convention or its Protocols the right of access to public service, they are nevertheless obliged not to prevent this access on grounds that fall under the protection of the Convention, in accordance with article 1 of the Convention. In this regard, a parallel can be drawn with the case-law of the European Court of justice in the application of the concept of "personal life" to employment-related cases in the context of article 8 of the Convention, including restrictions on access to public service. In accordance with article 8 of the Convention, complaints concerning the exercise of professional duties were considered to fall within the concept of "personal life" when factors related to personal life were the criteria for obtaining the relevant position, and when the contested measure was based on considerations affecting the freedom of choice of an individual in the sphere of personal life.

The Court noted the following relevant elements: before the Minister refused to appoint the applicant as a forensic expert, the applicant successfully passed the relevant examination and was invited to take the oath, the Minister justified the decision solely by referring to the content of the applicant's blog and his emails, in which the latter expressed criticism that the swearing-in ceremony had been postponed. It follows that the main elements of the decision were related to the right to freedom of expression, even if its implementation was considered by the Ministry of justice as proof that the applicant was not a suitable candidate for the position of forensic expert. The court disagreed with the government's argument that, in refusing the applicant, the Minister had taken into account the applicant's right to freedom of expression only in order to determine whether he had met the requirements for the position of a forensic expert, since the damage caused to the applicant was directly related to the exercise of key elements of this right. The refusal also had a deterrent effect on the exercise of freedom of expression by those who wanted to become forensic experts. The question of whether the measure and its associated deterrent effect were justified had to be answered on the merits. Consequently, the measure complained of concerned mainly the right to freedom of expression, rather than access to public service. The refusal to appoint the applicant as a forensic expert constituted an interference with his exercise of the right to freedom of expression guaranteed by article 10 of the Convention.

The Minister justified the refusal to appoint the applicant as a forensic expert by referring to his blog and letters, which the Minister considered offensive. The Minister did not refer to a specific blog post or paragraph of the letter, nor did he specify in any other way which statements of the applicant in his blog or letters seemed offensive to him. The lack of such justification for the Minister's decision is particularly noteworthy, since only a few days earlier the Minister had considered that there were no obstacles to the applicant's appointment as a forensic expert.

The administrative court also did not comment on the applicant's right to freedom of expression and did not consider the latter's arguments in this regard, based solely on the reasons for the contested decision of the Minister. In particular, the administrative court did not compare the applicant's right to freedom of expression guaranteed by article 10 of the Convention with the public interest allegedly pursued by the contested decision. Having regard to the above and the considerations that led the court to conclude that there was a violation of article 6, paragraph 1, of the Convention, it considers that the interference in question with the applicant's exercise of his right to freedom of expression was not accompanied by an effective and adequate judicial review.

The conduct of the candidate for the position of forensic expert could give rise to reasonable doubts as to whether he would perform the expert's work thoroughly and impartially. However, in the absence of a detailed explanation in the decisions of the Minister and the Administrative court of the reasons why the applicant's exercise of his right to freedom of expression was offensive and as such incompatible with the work of the expert, the court could not accept the Slovenian authorities ' argument that the refusal to appoint the applicant as a forensic expert was necessary to protect the morals and reputation of the forensic experts, as well as to ensure the authority and impartiality of the judiciary.

The above considerations, in particular the fact that the Minister and the Administrative court did not make any assessment of the fair balance between the competing interests involved and that the court was therefore unable to effectively verify whether the authorities of the Respondent state had applied the standards set out in its case-law on the comparison of these interests, were sufficient for the court to conclude, that, in the circumstances of the applicant's case, interference with the exercise of his right to freedom of expression was not "necessary in a democratic society".

 

RESOLUTION

 

The case involved a violation of the requirements of article 10 of the Convention (adopted unanimously).

The European Court also unanimously held that there had been a violation of article 6, paragraph 1, of the Convention in connection with the failure to hold an oral hearing during the proceedings before the Administrative court.

 

COMPENSATION

 

In the application of article 41 of the Convention. The court awarded the applicant EUR 15,600 in respect of non-pecuniary damage, but the claim for pecuniary damage was rejected.

В 2013 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Испании.

 

По делу успешно рассмотрена жалоба на отсутствие у заявителя возможности обжаловать наложение таможенного штрафа, несоразмерного совершенному им правонарушению. По делу допущено нарушение требований статьи 2 Протокола N 7 к Конвенции о защите прав человека и основных свобод.

 

 

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В ходе таможенного досмотра на выезде из Испании в марте 2011 года у заявителя была обнаружена сумма в 154 800 евро, подлежавшая декларированию (более 10 000 евро), за что на него был наложен штраф в размере 153 800 евро, который практически равнялся найденной у заявителя сумме. Заявитель объяснил, что данная денежная сумма образовалась из тех сумм, которые он привозил из Аргентины и регулярно декларировал и которые за 10 лет составили 300 000 евро.

 

В октябре 2011 года заявитель обратился в суд в порядке административного судопроизводства. В 2013 году Высший суд г. Мадрида отклонил его иск, указав, что его постановление не может быть обжаловано в соответствии с изменениями, которые были внесены в закон и касались условий обращения в суд кассационной инстанции, связанных с суммой спора (за исключением специальных процедур по вопросам защиты основных прав): до этого сумма спора должна была составлять не менее 150 000 евро, а после внесения изменений - 600 000 евро. В соответствии с переходными положениями к делам, находившимся на рассмотрении кассационных судов, применялись ранее действовавшие процессуальные нормы до вынесения постановления соответствующей судебной инстанции.

 

Жалуясь, помимо прочего, на немедленное применение данного закона в его деле, заявитель обратился в Конституционный суд с жалобой amparo, которая была отклонена по причине отсутствия достаточного обоснования конституционного значения дела.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 2 Протокола N 7 к Конвенции. (1) Применимость: было ли наказание, назначенное заявителю, "уголовным"? В свете "критериев дела Энгеля" (Постановление Европейского Суда по делу "Энгель и другие против Нидерландов" (Engel and Others v. Netherlands) от 8 июня 1976 г., жалобы N 5100/71 - 5102/71, 5354/72 и 5370/72) Европейский Суд ответил на данный вопрос утвердительно.

 

Квалификация в законодательстве государства-ответчика (критерий, не имеющий решающего значения). Нарушение обязанности декларирования, предусмотренной законом о предупреждении отмывания капиталов и финансирования терроризма, являлось административным правонарушением.

 

Характер правонарушения. Соответствующее положение закона имело общий характер и применялось к любому лицу, физическому или юридическому, пересекавшему границу и осуществлявшему описанную деятельность в связи с оборотом капиталов. Назначение штрафа состояло не в том, чтобы защитить государство от потери капитала, а преследовало цель наказания и устрашения. Это соображение само по себе было достаточным. Настоящее дело отличается от некоторых рассмотренных ранее дел, в частности, от Решения Европейского Суда по делу "Иносенсио против Португалии" (Inocencio v. Portugal) от 11 января 2001 г., жалоба N 43862/98, которое касалось назначения наказания в размере всего лишь 2 500 евро за проведение работ без разрешения, и от Постановления Европейского Суда по делу "Батлер против Соединенного Королевства" (Butler v. United Kingdom) от 26 июня 2002 г., жалоба N 41661/98, касавшегося назначения наказания в большем размере, но в котором власти проверили соразмерность наказания и в котором имели место разумные признаки того, что заявитель, ранее судимый, занимался контрабандой.

 

Тяжесть наказания, которое могло быть назначено. В законодательстве Испании совершенное заявителем правонарушение квалифицировалось как "тяжкое" и наказывалось штрафом в размере от 600 до 1 200 евро.

 

2. Исключения из гарантированного права. Европейский Суд не согласился ни с одним из доводов властей Испании по поводу исключений, предусмотренных в пункте 2 статьи 2 Протокола N 7 к Конвенции. (a) Исключение, связанное с "незначительностью" правонарушения. (i) Принципы толкования. В соответствии с пояснительным докладом к Протоколу N 7 к Конвенции, чтобы решить, было ли правонарушение "незначительным", важным критерием является то, наказывалось ли оно лишением свободы или нет. В настоящем деле наказание, назначенное заявителю, в случае невыплаты штрафа не могло быть заменено лишением свободы. Однако данный элемент не является решающим. Необходимо принять во внимание другие критерии.

 

Очевидно, что в законодательстве государств - участников Конвенции наблюдается большое разнообразие в отношении таможенных санкций за недекларирование денежных сумм. Соблюдение принципа субсидиарности, а также предоставленные государствам пределы усмотрения в данной сфере приводят Европейский Суд к выводу о том, что относимость и значение каждого элемента должны оцениваться в зависимости от обстоятельств каждого дела.

 

Необходимо, чтобы спорная мера достигала определенного уровня тяжести, но органам власти государства-ответчика надлежит проверять ее соразмерность, а также наличие особенно серьезных последствий в зависимости от личной ситуации заявителя. Возможность назначения наказания в виде лишения свободы является важным фактором, который должен учитываться при оценке незначительности характера правонарушения, хотя этот фактор не является решающим.

 

Данное толкование соответствует общим правилам толкования международных договоров, предусмотренных Венской конвенцией о праве международных договоров.

 

(ii) Применение вышеизложенных принципов в настоящем деле. Строгость наказания. Заявителю был назначен штраф в размере 153 800 евро, и он мог быть вдвое больше. Данная сумма соответствовала размеру всех накоплений, которые заявитель, не имевший судимостей, смог сделать за время его периодических пребываний в Испании.

 

Поскольку не было доказано, что изъятые суммы были получены в результате деятельности, связанной с отмыванием капиталов, строгость наказания должна была соответствовать тяжести единственного установленного правонарушения, в настоящем деле это было отсутствие декларирования перевозимой суммы, а не тяжести возможного нарушения, которое не было установлено на этом этапе и которое могло состоять в совершении такого деликта, как отмывание денег или налоговое мошенничество.

 

Что касается поведения заявителя, необходимо отметить, что он выполнял обязанность по декларированию денежных средств каждый раз при пересечении Государственной границы Испании.

 

Процессуальные гарантии. В постановлении Высшего суда г. Мадрида не содержалось какого-либо анализа соразмерности оспариваемой меры, как того, однако, требовал закон. В постановлении не были приняты во внимание ни личное положение заявителя, ни представленные им документы и доказательства. Речь в настоящем деле шла о требовании, которое Европейский Суд уже имел возможность изучить при рассмотрении таможенных санкций с точки зрения статьи 1 Протокола N 1 к Конвенции. В остальном согласно действующему законодательству вывоз капитала, как правило, не подлежал декларированию и не требовал предварительного разрешения для проведения соответствующих проверок с целью предупреждения отмывания капиталов или финансирования терроризма.

 

Таким образом, исключение, касавшееся "незначительных" правонарушений, не было применимо в настоящем деле.

 

(b) Исключение, связанное с тем, что лицо уже было судимо в первой инстанции Верховным судом. В сфере административных дел Верховный суд является частью иерархии общих судов. В него можно обратиться после рассмотрения дела в вышестоящем суде, когда сумма спора достигает установленного законом предела (600 000 евро). Таким образом, Высший суд г. Мадрида нельзя было рассматривать как Верховный суд.

 

3. Соблюдение гарантированного права: было ли соблюдено право заявителя на обжалование приговоров по уголовным делам во второй инстанции? Судебная инстанция, которая должна была быть признана первой. Несмотря на то, что применение к заявителю ограничений, введенных законом, соответствовало переходным положениям данного закона, оно нарушало саму суть права, гарантированного статьей 2 Протокола N 7 к Конвенции, и не охватывалось пределами усмотрения властей государства-ответчика, предусмотренных им в сфере регламентации прав человека.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 2 Протокола N 7 к Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 9 600 евро в качестве компенсации морального вреда, требование о возмещении материального ущерба было отклонено.

Sentencia del Tribunal europeo de derechos humanos de 30 de junio de 2020 en el caso Saquetti Iglesias c. España (queja Nº 50514/13).

 

En 2013 se prestó asistencia a la autora en la preparación de la denuncia. Posteriormente, la denuncia fue comunicada a España.

 

En el caso se tramitó con éxito la denuncia de que el autor de la queja no tenía la posibilidad de apelar la imposición de una multa aduanera desproporcionada a la infracción que había cometido. En el caso se violó lo dispuesto en el artículo 2 del protocolo N 7 del Convenio para la protección de los derechos humanos y las libertades fundamentales.

 

 

 

CIRCUNSTANCIAS DEL CASO

 

 

 

En marzo de 2011, en una inspección aduanera a la salida de España, se encontró al autor una cantidad de 154.800 euros que debía declararse (más de 10.000 euros), por lo que se le impuso una multa de 153.800 euros, que equivalía prácticamente a la cantidad encontrada en el autor. El reclamante explicó que la suma se basaba en las cantidades que traía de la Argentina y declaraba regularmente, que en 10 años ascendían a 300.000 euros.

 

En octubre de 2011, el autor de la queja se presentó ante el Tribunal en un procedimiento administrativo. En 2013, el Tribunal superior de justicia de Madrid desestimó su demanda alegando que su fallo no podía ser recurrido en virtud de las modificaciones introducidas en la ley relativas a las condiciones de recurso de casación relacionadas con el importe de la controversia (con excepción de los procedimientos especiales de protección de los derechos fundamentales): antes de ello, el importe de la controversia debía ser de al menos 150.000 euros y, después de la modificación, de 600.000 euros. De conformidad con las disposiciones transitorias de las causas pendientes ante los tribunales de casación, se aplicaron las normas procesales anteriores antes de que se dictara la decisión de la instancia judicial correspondiente.

 

Quejándose, entre otras cosas, de la aplicación inmediata de la ley en su caso, el autor interpuso un recurso de amparo ante el Tribunal constitucional, que fue desestimado por falta de una justificación suficiente del valor constitucional del caso.

 

 

 

CUESTIONES JURÍDICAS

 

 

 

En relación con el cumplimiento del artículo 2 del protocolo N 7 de la convención. (1) Aplicabilidad: ¿la pena impuesta al autor fue "penal"? A la luz de los" criterios del caso Engel "(Fallo del Tribunal europeo en Engel and Others V. Netherlands, De 8 de junio de 1976, quejas n 5100/71 a 5102/71, 5354/72 y 5370/72), el Tribunal europeo respondió afirmativamente.

 

Calificación en la legislación del estado demandado (criterio no decisivo). La violación de la obligación de declaración prevista en la ley de prevención del blanqueo de capitales y financiación del terrorismo fue un delito administrativo.

 

Carácter del delito. La disposición correspondiente de la ley era de carácter general y se aplicaba a cualquier persona, física o jurídica, que cruzara la frontera y realizara las actividades descritas en relación con el tráfico de capitales. El propósito de la multa no era proteger al estado de la pérdida de capital, sino que tenía como objetivo el castigo y la intimidación. Esta consideración en sí misma fue suficiente. El presente caso difiere de algunos casos anteriores, en particular la decisión Del Tribunal europeo en Inocencio C. Portugal (Inocencio v. Portugal), de 11 de enero de 2001, queja Nº 43862/98, relativa a la imposición de una pena de sólo 2.500 euros por obras sin autorización, y de la Sentencia del Tribunal europeo en el caso Butler C. el Reino Unido, de 26 de junio de 2002, queja Nº 41661/98, relativa a la imposición de una pena mayor, pero en la que las autoridades verificaron la proporcionalidad de la pena y en la que había indicios razonables de que el autor había sido objeto de contrabando.

 

La gravedad de la pena que se pudo imponer. En la legislación española, la infracción cometida por el autor de la queja se consideraba "grave" y se castigaba con una multa de 600 a 1.200 euros.

 

2. Excepciones al derecho garantizado. El Tribunal europeo no estuvo de acuerdo con ninguno de los argumentos de las autoridades españolas sobre las excepciones previstas en el párrafo 2 del artículo 2 del protocolo N 7 del Convenio. a) una Excepción relacionada con la "insignificancia" del delito. I) Principios interpretativos. De acuerdo con el informe explicativo al Protocolo n 7 de la convención, para decidir si un delito fue "menor", un criterio importante es si se castigó con privación de libertad o no. En el presente caso, la pena impuesta al autor de la queja no podía sustituirse por la privación de libertad si no se pagaba la multa. Sin embargo, este elemento no es decisivo. Hay que tener en cuenta otros criterios.

 

Es evidente que la legislación de los Estados partes en la convención es muy diversa en lo que respecta a las sanciones aduaneras por no declarar cantidades de dinero. El respeto del principio de subsidiariedad, así como los límites de discreción otorgados a los Estados en esta esfera, llevan al Tribunal europeo a la conclusión de que la pertinencia y la importancia de cada elemento deben evaluarse en función de las circunstancias de cada caso.

 

Es necesario que la medida controvertida alcance cierto grado de gravedad, pero las autoridades del estado demandado deben verificar su proporcionalidad, así como las consecuencias particularmente graves, según la situación personal del demandante. La posibilidad de imponer una pena de privación de libertad es un factor importante que debe tenerse en cuenta al evaluar la insignificancia de la naturaleza del delito, aunque este factor no es decisivo.

 

Esta interpretación se ajusta a las normas generales de interpretación de los tratados de conformidad con la convención de Viena sobre el derecho de los tratados.

 

ii) la Aplicación de los principios anteriores en el presente caso. Severidad del castigo. Al denunciante se le impuso una multa de 153.800 euros y podría haber sido el doble. Esta cantidad correspondió al monto de todos los ahorros que el reclamante, que no tenía antecedentes penales, pudo hacer durante su estancia periódica en España.

 

Como no se ha demostrado que las cantidades incautadas se derivaran de actividades relacionadas con el blanqueo de capitales, la severidad de la pena debía corresponder a la gravedad del único delito tipificado, en el presente caso se trataba de la falta de declaración de la cantidad transportada y no de la gravedad de una posible infracción que no se había determinado en esa etapa y que podría consistir en un delito de blanqueo de dinero o fraude fiscal.

 

En cuanto a la conducta del solicitante, cabe señalar que cumplió con la obligación de declarar dinero en efectivo cada vez que cruzaba la frontera estatal española.

 

Garantía procesal. La sentencia del Tribunal superior de justicia de Madrid no contenía ningún análisis de la proporcionalidad de la medida impugnada, como exigía la ley. En el fallo no se tuvo en cuenta la situación personal del autor ni los documentos y pruebas que presentó. En el presente caso se trataba de un requisito que el Tribunal europeo ya había tenido la oportunidad de examinar al examinar las sanciones aduaneras en relación con el Artículo 1 del protocolo N 1 del Convenio. Por lo demás, de conformidad con la legislación vigente, las exportaciones de capital generalmente no estaban sujetas a declaración y no requerían autorización previa para llevar a cabo las inspecciones pertinentes para prevenir el blanqueo de capitales o la financiación del terrorismo.

 

Por consiguiente, la excepción relativa a los delitos "menores" no era aplicable en el presente caso.

 

b) la Excepción de que una persona ya ha sido juzgada en primera instancia por el Tribunal Supremo. En materia administrativa, el Tribunal Supremo forma parte de la jerarquía de los tribunales generales. Se puede recurrir después de que el caso se resuelva en un Tribunal superior cuando el monto de la disputa alcance el límite legal (600.000 euros). Por lo tanto, el Tribunal Superior de justicia de Madrid no podía ser considerado como el Tribunal Supremo.

 

3. Respeto del derecho garantizado: ¿se ha respetado el derecho del autor a recurrir en segunda instancia las sentencias penales? Una instancia judicial que debía ser reconocida en primer lugar. Según el informe Explicativo del Protocolo n 7 de la convención, las autoridades "que no sean tribunales en el sentido del artículo 6 de la convención" no pueden ser reconocidas como "instancias judiciales". En el presente caso, era el órgano encargado de imponer la multa, a saber, la dirección general de Hacienda y política financiera, que dependía directamente del Ministerio de economía. Así pues, la primera instancia en el caso del autor fue el Tribunal Superior.

 

El Tribunal constitucional no podía actuar como Tribunal de segunda instancia. De conformidad con el informe Explicativo del Protocolo n 7 de la convención, los tribunales de apelación o de casación pueden considerarse que cumplen los requisitos del Tribunal de "segunda instancia". Por el contrario, no dice nada sobre los tribunales constitucionales. A la luz de las facultades que el Tribunal constitucional español ha conferido en relación con los recursos de amparo que se describen a continuación, el Tribunal europeo ha llegado a la conclusión de que este Tribunal no era un Tribunal de "segunda instancia".

 

Según la legislación española, las facultades de verificación de la legalidad se otorgan a los tribunales que pertenecen al poder judicial (entre ellos los tribunales de apelación o de casación). En cuanto a los recursos de amparo interpuestos contra la sentencia, la ley Orgánica del Tribunal constitucional español limita las funciones de este último a evaluar si se han vulnerado los derechos del demandante y a proteger o restablecer esos derechos y libertades. La ley precisa que el Tribunal constitucional debe abstenerse de cualquier otra opinión relativa a la actuación del poder judicial. El propio Tribunal constitucional ha subrayado en su jurisprudencia que el recurso de amparo no puede equipararse a un recurso de casación en beneficio de la ley.

 

Si bien la aplicación de las restricciones impuestas por la ley al autor de la queja se ajustaba a las disposiciones transitorias de la ley, violaba la esencia misma del derecho garantizado por el artículo 2 del protocolo N 7 de la convención y no estaba comprendida en los límites de la discreción de las autoridades del estado demandado en lo que respecta a la reglamentación de los derechos humanos.

 

 

 

DECRETO

 

 

 

En el caso se violó el artículo 2 del Protocolo n 7 de la convención (aprobado por unanimidad).

 

 

 

COMPENSACIÓN

 

 

 

De conformidad con el artículo 41 de la convención. El Tribunal europeo concedió al autor 9.600 euros en concepto de indemnización por daños morales y se desestimó la reclamación por daños materiales.

CIRCUMSTANCES OF THE CASE

 

 

 

During the customs inspection at the exit from Spain in March 2011, the applicant was found to have an amount of 154,800 euros that was subject to Declaration (more than 10,000 euros), for which he was fined 153,800 euros, which was almost equal to the amount found in the applicant's possession. LEGAL ISSUES

 

 

 

Regarding compliance with article 2 of Protocol No. 7 to the Convention. (1) Applicability: was the sentence imposed on the applicant "criminal"? In the light of the" Engel criteria "(judgment of the European Court of justice in Engel and others V. Netherlands of 8 June 1976, complaints N 5100/71 - 5102/71, 5354/72 and 5370/72), the European Court answered this question in the affirmative.

 

Qualification in the legislation of the Respondent state (a criterion that is not decisive). Violation of the Declaration obligation provided for by the law on prevention of money laundering and financing of terrorism was an administrative offense.

 

The nature of the offense. The relevant provision of the law was of a General nature and applied to any person, natural or legal, who crossed the border and carried out the described activities in connection with the turnover of capital. The purpose of the fine was not to protect the state from the loss of capital, but to punish and intimidate. This consideration was sufficient in itself. The present case differs from some previous cases, in particular the decision Of the European Court of justice in the case of Inocencio V. Portugal. Portugal) of 11 January 2001, complaint No. 43862/98, which concerned the imposition of a penalty of only 2,500 euros for carrying out work without a permit, and from the Judgment of the European Court of justice in the case of Butler V. United Kingdom of 26 June 2002, complaint No. 41661/98, concerning the imposition of a higher penalty, but in which the authorities checked the proportionality of the punishment and in which there were reasonable indications that the applicant, previously convicted, was engaged in smuggling.

 

The severity of the punishment that could have been imposed. In Spanish law, the applicant's offence was classified as "serious" and was punishable by a fine of between 600 and 1,200 euros.

 

2. Exceptions to the guaranteed right. The court did not agree with any of the arguments of the Spanish authorities concerning the exceptions provided for in article 2, paragraph 2, of Protocol No. 7 to the Convention. (a) an Exception related to the" insignificance " of the offence. (i) principles of interpretation. According to the explanatory report to Protocol No. 7 to the Convention, in order to decide whether an offence was "minor", an important criterion is whether it was punishable by deprivation of liberty or not. In the present case, the penalty imposed on the applicant, in the event of non-payment of the fine, could not be replaced by imprisonment. However, this element is not decisive. Other criteria must be taken into account.

 

It is obvious that there is a great variety in the legislation of the States parties to the Convention with regard to customs sanctions for non - Declaration of monetary amounts. Compliance with the principle of subsidiarity, as well as the limits of discretion granted to States in this area, lead the court to conclude that the relevance and significance of each element should be assessed depending on the circumstances of each case.

 

It is necessary that the measure in question reaches a certain level of gravity, but the authorities of the Respondent state should check its proportionality, as well as the existence of particularly serious consequences, depending on the applicant's personal situation. The possibility of imposing a custodial sentence is an important factor that should be taken into account when assessing the insignificance of the nature of the offence, although this factor is not decisive.

 

This interpretation is consistent with the General rules for the interpretation of international treaties provided for in the Vienna Convention on the law of treaties.

 

(ii) the Application of the above principles in the present case. The severity of the punishment. The applicant was fined EUR 153,800 and could have been twice as much. This amount corresponded to the amount of all the savings that the applicant, who had no criminal record, was able to make during his periodic stays in Spain.

 

Because it was not proved that the seized amounts were received as a result of activities related to money laundering, the severity of the punishment was to be commensurate with the gravity only the specified offences in the present case, it was the absence of a Declaration of transported sums, and not the severity of possible violations, which has not been set at this stage and which could consist in the Commission of such offence as money laundering or tax fraud.

 

With regard to the applicant's conduct, it should be noted that he fulfilled the obligation to declare funds every time he crossed the state border of Spain.

 

Procedural guarantees. The decision of the superior court of Madrid did not contain any analysis of the proportionality of the contested measure, as, however, required by law. The decision did not take into account either the applicant's personal situation or the documents and evidence presented by him. The present case concerned a requirement that the court had already had the opportunity to examine when considering customs sanctions from the point of view of article 1 of Protocol No. 1 to the Convention. Otherwise, according to the current legislation, the export of capital, as a rule, was not subject to Declaration and did not require prior authorization to conduct appropriate checks in order to prevent money laundering or terrorist financing.

 

Thus, the exception concerning "minor" offences was not applicable in the present case.

 

(b) an Exception related to the fact that the person has already been tried in the first instance by the Supreme court. In administrative matters, the Supreme court is part of the hierarchy of General courts. You can apply to it after the case is considered in a higher court, when the amount of the dispute reaches the legal limit (600,000 euros). Thus, the Supreme court of Madrid could not be considered as the Supreme court.

 

3. Respect for the guaranteed right: has the applicant's right to appeal against criminal convictions in the second instance been respected? The court that should have been recognized first. According to the Explanatory report to Protocol No. 7 to the Convention, authorities "which are not courts within the meaning of article 6 of the Convention" cannot be recognized as "judicial instances". In the present case, it was the body authorized to impose the fine, namely the General Directorate of Treasury and financial policy, which was directly subordinate to the Ministry of economy. Thus, the first instance in the applicant's case was the Supreme court.

 

The constitutional court could not perform the role of a court of second instance. In accordance with the Explanatory report to Protocol No. 7 to the Convention, courts of appeal or cassation may be considered as meeting the requirements of a "second instance"court. On the contrary, it says nothing about the constitutional courts. In the light of the powers conferred on the Spanish constitutional court in dealing with the amparo complaints described below, the court concluded that the court was not a "second instance"court.

 

According to Spanish law, the power to verify the legality is granted to courts that belong to the judicial branch (among them the courts of appeal or cassation). With regard to amparo's complaints against the judgment, the Organic law on the Spanish constitutional court limits the latter's functions to assessing whether the applicant's rights have been violated and protecting or restoring those rights and freedoms. This law specifies that the constitutional court must refrain from any other opinions concerning the actions of the judiciary. The constitutional court itself has stressed in its case-law that the amparo complaint cannot be equated with a cassation appeal in the interests of the law.

 

Despite the fact that the application of the restrictions imposed by the law to the applicant was in accordance with the transitional provisions of this law, it violated the very essence of the right guaranteed by article 2 of Protocol No. 7 to the Convention, and was not covered by the limits of discretion of the Respondent state authorities provided for by it in the field of human rights regulation.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of article 2 of Protocol No. 7 to the Convention (adopted unanimously).

 

 

 

COMPENSATION

В 2016 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Швейцарии.

 

По делу успешно рассмотрена жалоба на непредотвращение сотрудниками полиции самоубийства, совершенного уязвимым лицом, оставленным в одиночной камере без надзора в течение 40 минут, а также отказ в возбуждении уголовного дела в отношении данных сотрудников полиции. По делу допущено нарушение требований статьи 2 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В 2014 году сын заявительницы D.F., будучи в состоянии алкогольного опьянения и под воздействием антидепрессантов, попал в аварию, управляя автомашиной своего работодателя.

 

Сотрудники полиции, прибывшие на место происшествия, R.B. и A.S., следовали стандартной процедуре, предусмотренной для данного вида дорожно-транспортного происшествия. Заявительница также прибыла на место аварии, ей позвонил сын, который высказывал мысли о самоубийстве. Затем два сотрудника полиции доставили D.F. в больницу для взятия у него образцов крови и мочи. ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 2 Конвенции (материально-правовой аспект). (a) Было ли властям известно об особой уязвимости D.F. и о риске совершения им самоубийства. На месте происшествия сотрудник полиции A.S. сразу же обсудил с заявительницей суицидальные намерения D.F., чтобы принять соответствующие меры. Сотрудник полиции C.R. на дорожном посту был уведомлен о риске совершения самоубийства до прибытия D.F.

 

Во время первого же контакта с полицией D.F. вел себя странно, проявлял эмоциональную зависимость от матери в ситуации, которая вызывала у него страх. В заключении по результатам вскрытия Институт судебной медицины (далее - IRMZ) указал, что заключение в одиночную камеру, "текущие" мысли о самоубийстве, попытки совершения самоубийства в прошлом и "проблемы с алкоголем" были факторами риска, связанными с совершением самоубийств под стражей, и что как минимум два из них имели место в случае D.F.

 

Власти знали или должны были знать в период, относившийся к обстоятельствам дела, о существовании риска того, что D.F. попытается совершить самоубийство и что речь шла о конкретном и непосредственном риске для его жизни. В распоряжении властей также было достаточно информации об особой уязвимости D.F. Следовательно, они должны были прийти к выводу, что за ним, без сомнения, требовалось пристальное наблюдение.

 

(b) Отсутствие необходимых мер для предотвращения риска совершения самоубийства. Сотрудники полиции приняли обычные меры предосторожности и безопасности в камере на дорожном посту, изъяв у D.F., помимо прочего, обувь, кожаный ремень и цепочку, чтобы у него больше не было предметов, с помощью которых он мог бы себя задушить или причинить себе телесные повреждения каким-либо иным способом. Однако D.F. совершил самоубийство необычным образом. В то же время на дорожном посту находились пять сотрудников полиции, и наблюдение за D.F. было бы возможно в присутствии заявительницы в офисе. Кроме того, сотрудники полиции до конца не проанализировали рассматривавшуюся ими возможность помещения D.F. в камеру, оснащенную системой видеонаблюдения.

 

Власти не могли оставить D.F. одного в камере без надзора в течение 40 минут, не нарушив его право на жизнь по смыслу статьи 2 Конвенции. Власти имели возможность, приложив разумные и не чрезмерные усилия, предупредить риск совершения D.F. самоубийства, о котором они знали или должны были знать. Ответственность властей следовала из того факта, что они обращались с D.F. как с лицом, способным справиться с испытываемым стрессом и давлением, не уделив надлежащего внимания его личной ситуации. Независимо от того, действовали ли сотрудники полиции с соблюдением всех применимых в данной ситуации норм, власти государства-ответчика должны нести ответственность за то, что они не признали D.F. лицом, требовавшим особого обращения.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 2 Конвенции (принято единогласно).

 

По поводу соблюдения статьи 2 Конвенции (процессуально-правовой аспект). По мнению Федерального суда Швейцарии, должны были быть "минимальные признаки" наказуемого поведения, чтобы Верховный суд кантона дал разрешение на проведение полномасштабного расследования в рамках уголовного дела. Выдача такого разрешения требовала наличия возможности привлечения к уголовной ответственности в меньшей степени, чем та, которая требуется для проведения следствия по делу. Это тем более верно в отношении совершения тяжких преступлений и, в частности, если приговор по делу касается случаев причинения смерти.

 

В ходе анализа в рамках материально-правового аспекта статьи 2 Конвенции Европейский Суд пришел к выводу, что власти государства-ответчика несут ответственность за нарушение права D.F. на жизнь.

 

Ни Верховный суд кантона, ни Федеральный суд Швейцарии не ссылались на составленное IRMZ заключение по результатам вскрытия, в котором были указаны факторы риска, связанные с совершением самоубийства под стражей, и, в частности, не приняли во внимание замечания по поводу двух критериев, имевших место в случае D.F.

 

IRMZ также указал, что лучшим вариантом было вызвать неотложную психиатрическую помощь, а не простого врача. Федеральный суд Швейцарии отклонил связанный с этим довод заявительницы и решил, что специализация врача не имела значения, поскольку последний прибыл на место уже после смерти D.F. Однако Европейский Суд счел достаточно убедительным довод заявительницы о том, что психиатр мог дать сотрудникам полиции точные инструкции по телефону с целью ограничить или даже исключить риск самоубийства. В этом отношении следует отметить, что Федеральный суд Швейцарии признал данный довод неуместным, поскольку сотрудники полиции и врач непосредственно не контактировали друг с другом. Вместе с тем Европейский Суд отметил, что Договаривающимся Государствам надлежит организовывать свои службы и обучать своих сотрудников таким образом, чтобы позволить им выполнять требования Конвенции.

 

Наконец, в протоколе заседания Государственного совета кантона от 2011 года рекомендуется размещать лиц, проявляющих суицидальные наклонности, в камеру, рассчитанную на двух человек, или в случае необходимости постоянно наблюдать за ними. Кроме того, как представляется, в нем отдается предпочтение вызову в неотложном порядке психиатра, хотя при некоторых обстоятельствах не исключается и вызов обычного врача "скорой помощи". В случае D.F. данные рекомендации не были выполнены.

 

Таким образом, Европейский Суд не убежден в том, что в настоящем деле отсутствовали "минимальные признаки" наказуемого поведения со стороны сотрудников полиции, принимавших участие в событиях, которые привели к смерти D.F. Соответственно, нельзя считать, что то, как система уголовного правосудия Швейцарии отреагировала на доказуемое утверждение о нарушении статьи 2 Конвенции в рассматриваемой в настоящем деле ситуации, когда лицо выражало ясные и повторяющиеся суицидальные намерения, позволило в полной мере привлечь к ответственности представителей государства в связи с той ролью, которую они сыграли в соответствующих событиях. Следовательно, существующая система не смогла обеспечить эффективного применения положений законодательства Швейцарии с целью защиты права на жизнь, в частности, реализации устрашающей функции уголовного права.

 

Таким образом, в ситуации особой уязвимости сына заявительницы отсутствовала адекватная защита со стороны "закона", способного защитить право на жизнь, а также предотвратить в будущем любые аналогичные действия, которые подвергают жизнь опасности.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 2 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявительнице 50 000 евро в качестве компенсации морального вреда и 5 796 евро в качестве возмещения материального ущерба.

Urteil des EGMR vom 30. Juni 2020 auf den Punkt: "S. F. (S. F.) gegen die Schweiz" (Beschwerde N 23405/16).

 

Im Jahr 2016 wurde die Klägerin bei der Vorbereitung der Beschwerde unterstützt. Anschließend wurde die Beschwerde an die Schweiz weitergeleitet.

 

Die Beschwerde über die Nichtverhinderung durch Polizisten des Selbstmords, der von der verletzlichen Person begangen ist, die in einer Einzelzelle ohne Aufsicht für 40 Minuten, sowie die Verweigerung in der Einleitung eines Strafverfahrens bezüglich Daten von Polizisten verlassen ist, wurde erfolgreich betrachtet. In dem Fall wurde ein Verstoß gegen die Anforderungen von Artikel 2 des übereinkommens zum Schutz der Menschenrechte und Grundfreiheiten zugelassen.

 

 

 

SACHVERHALT

 

 

 

Im Jahr 2014 Sohn D. F. des Anmelders, betrunken gewesen und unter dem Einfluss von Antidepressiva, in einen Unfall verwickelt, führen Sie beim Autofahren Ihren Arbeitgeber.

 

Die Polizisten, die an der Unfallstelle eintrafen, folgten dem für diese Art von Verkehrsunfall vorgesehenen Standardverfahren. Aus diesem Grund weigerte sich das oberste Gericht des Kantons 2015 auf Antrag der Staatsanwaltschaft, der Einleitung eines Strafverfahrens zuzustimmen. Das Schweizer Bundesgericht hat die Beschwerde der Klägerin gegen diese Ablehnung ohne Befriedigung zurückgewiesen.

 

 

 

RECHTSFRAGE

 

 

 

Hinsichtlich der Einhaltung von Artikel 2 des übereinkommens (logistischer Aspekt). (a) ob den Behörden die Besondere Verwundbarkeit von D. F. und das Risiko von Selbstmord bekannt war. Das Institut für Rechtsmedizin (im folgenden: IRMZ) wies in seinem Gutachten darauf hin, dass Einzelhaft, "aktuelle" Selbstmordgedanken, Selbstmordversuche in der Vergangenheit und "Alkoholprobleme" Risikofaktoren für Selbstmorde in der Haft waren und dass mindestens zwei von Ihnen im Fall von D. F. aufgetreten sind.

 

Die Behörden wussten oder hätten wissen müssen in der Zeit, als die Umstände des Falles, über die Existenz des Risikos, dass D. F. versucht, Selbstmord zu Begehen, und dass die Rede von einer konkreten und unmittelbaren Gefahr für sein Leben. Die Behörden hatten auch genügend Informationen über die Besondere Sicherheitslücke von D. F. Daher sollten Sie zu dem Schluss kommen, dass es ohne Zweifel eine genaue überwachung erforderte.

Die Behörden konnten D. F. nicht 40 Minuten lang ohne Aufsicht allein in der Zelle lassen, ohne sein Recht auf Leben im Sinne von Artikel 2 des übereinkommens zu verletzen. Die Behörden hatten die Möglichkeit, das Risiko eines Selbstmordes, von dem Sie wussten oder wissen sollten, durch angemessene und nicht übermäßige Anstrengungen zu warnen. Die Verantwortung der Behörden folgte aus der Tatsache, dass Sie behandelt wie D. VERORDNUNG

 

 

 

In dem Fall wurde ein Verstoß gegen die Anforderungen von Artikel 2 des übereinkommens (einstimmig angenommen) zugelassen.

 

Hinsichtlich der Einhaltung von Artikel 2 des übereinkommens (verfahrensrechtlicher Aspekt). Nach Ansicht des Schweizer Bundesgerichtshofs hätte es "minimale Anzeichen" für strafbares Verhalten geben müssen, damit das oberste Gericht des Kantons die Genehmigung für eine umfassende Untersuchung im Rahmen eines Strafverfahrens erteilt. Die Erteilung einer solchen Genehmigung erforderte die Verfügbarkeit der Möglichkeit der Strafbarkeit in geringerem Ausmaß als die, die für die Durchführung der Untersuchung des Falles erforderlich ist. Dies gilt umso mehr für die Begehung schwerer Straftaten und insbesondere, wenn sich das Urteil in dem Fall auf Todesfälle bezieht.

 

Im Verlauf der Analyse im Rahmen der materiell-rechtlichen Aspekten des Artikels 2 des übereinkommens der Europäische Gerichtshof kam zu dem Schluss, dass die Behörden des Beklagten Staates haften für die Verletzung der Rechte F. D. Leben.

 

Weder das oberste Gericht des Kantons, noch das Bundesgericht der Schweiz dürfen keinerlei strukturierte IRMZ Stellungnahme zu den Ergebnissen der Autopsie, in dem festgelegt wurden die Risikofaktoren im Zusammenhang mit der Begehung von Selbstmord in Haft, und insbesondere nicht berücksichtigt Bemerkungen über zwei Kriterien, die stattgefunden hat, im Falle D. F.

 

Die IRMZ wies auch darauf hin, dass die beste Option darin Bestand, einen psychiatrischen Notfall anstelle eines einfachen Arztes zu rufen. Das Schweizer Bundesgericht wies das damit verbundene argument der Klägerin zurück und entschied, dass die Spezialisierung des Arztes keine Rolle spielte, da die Letzte bereits nach dem Tod von D. Schließlich wird im Sitzungsprotokoll des kantonsrates von 2011 empfohlen, suizidgefährdete Personen in eine zwei-Personen-Zelle zu bringen oder Sie bei Bedarf ständig zu beobachten. Folglich konnte das bestehende System die wirksame Anwendung der Bestimmungen des Schweizer rechts nicht sicherstellen, um das Recht auf Leben zu schützen, insbesondere die einschüchternde Funktion des Strafrechts.

 

So fehlte in der Situation der besonderen Gefährdung des Sohnes der Klägerin ein adäquater Schutz durch ein "Gesetz", das das Recht auf Leben schützen und künftig ähnliche Handlungen verhindern könnte, die das Leben gefährden.

 

 

 

VERORDNUNG

 

 

 

In dem Fall wurde ein Verstoß gegen die Anforderungen von Artikel 2 des übereinkommens (einstimmig angenommen) zugelassen.

 

 

 

ENTSCHÄDIGUNG

 

 

 

Artikel 41 des übereinkommens anzuwenden. Der Europäische Gerichtshof hat der Klägerin 50.000 Euro als Schadensersatz und 5 796 Euro als Schadensersatz zugesprochen.

The case violated the requirements of article 2 of the Convention for the protection of human rights and fundamental freedoms.

 

 

 

CIRCUMSTANCES OF THE CASE

 

 

 

In 2014, the applicant's son D. F., while intoxicated and under the influence of antidepressants, was involved in an accident while driving his employer's car.

 

The police officers who arrived at the scene, R. B. and A. S., followed the standard procedure provided for this type of traffic accident. The applicant also arrived at the scene of the accident, she was called by her son, who expressed thoughts of suicide. Two police officers then took D. F. to the hospital for blood and urine samples. There D. F. again spoke of suicide. Police officers called the roadblock to warn of their arrival and call a doctor there. he was taken there in the presence of the applicant and was left in solitary confinement for 40 minutes without supervision. He committed suicide by hanging himself with his jeans tied to the ventilation grate.

 

The Prosecutor's office conducted a pre-investigation check. The relevant authorities concluded that there were no signs of crimes committed by police officers. For this reason, in 2015, at the request of the Prosecutor's office, the Supreme court of the Canton refused to give consent to the initiation of criminal proceedings. The Swiss Federal court dismissed the applicant's complaint against this refusal.

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with article 2 of the Convention (substantive aspect). (a) whether the authorities were aware of D. F.'s particular vulnerability and risk of suicide. At the scene, the A. S. police officer immediately discussed D. F.'s suicidal intentions with the applicant in order to take appropriate measures. A C. R. police officer at a roadblock was notified of the risk of committing suicide before D. F. arrived.

 

During his first contact with the police, D. F. behaved strangely, showing emotional dependence on his mother in a situation that caused him fear. He became guilty of a traffic accident under the influence of alcohol and medication. In addition, A. S. discussed with the applicant the possibility of D. F.'s hospitalization to assist him. Finally, at the roadblock, D. F. was placed in solitary confinement.

 

In an autopsy report, The Institute of forensic medicine (IRMZ) stated that solitary confinement, "current" thoughts of suicide, past suicide attempts, and "alcohol problems" were risk factors associated with suicide in custody, and that at least two of these occurred in the D. F. case.

 

The authorities knew, or should have known, at the time relevant to the circumstances of the case, that there was a risk that D. F. would attempt suicide and that there was a specific and immediate risk to his life. The authorities also had ample information about D. F.'s particular vulnerability, so they Must have concluded that he was undoubtedly required to be closely monitored.

 

(b) Lack of necessary measures to prevent the risk of suicide. The police officers took the usual precautions and security measures in the cell at the roadblock, seizing D. F.'s shoes, leather belt and chain, among other things, so that he would no longer have any objects with which he could strangle himself or otherwise injure himself. However, D. F. committed suicide in an unusual way. At the same time, there were five police officers at the roadblock, and surveillance of D. F. would have been possible in the applicant's presence in the office. In addition, the police officers did not fully analyze the possibility of placing D. F. in a cell equipped with a video surveillance system.

 

The authorities could not leave D. F. alone in the cell without supervision for 40 minutes without violating his right to life within the meaning of article 2 of the Convention. The authorities had the opportunity, with reasonable and not excessive efforts, to prevent the risk of D. F. committing suicide, of which they knew or should have known. The responsibility of the authorities followed from the fact that they treated D. F. as a person capable of coping with the stress and pressure experienced, without paying proper attention to his personal situation. Regardless of whether the police officers acted in compliance with all applicable standards in the given situation, the authorities of the Respondent state should be held responsible for the fact that they did not recognize D. F. as a person who required special treatment.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of article 2 of the Convention (adopted unanimously).

 

Regarding compliance with article 2 of the Convention (procedural and legal aspect). According to the Swiss Federal court, there had to be "minimal signs" of punishable conduct for the Canton's Supreme court to authorize a full-scale criminal investigation. The issuance of such a permit required the possibility of criminal prosecution to a lesser extent than that required for the investigation of the case. This is all the more true in relation to the Commission of serious crimes and, in particular, if the verdict in the case concerns cases of causing death.

 

In its analysis of the substantive aspect of article 2 of the Convention, the court concluded that the authorities of the Respondent state were responsible for the violation of D. F.'s right to life.

 

Neither the Supreme court of the Canton nor the Federal court of Switzerland referred to the IRMZ autopsy report, which identified the risk factors associated with suicide in custody, and in particular did not take into account the comments on the two criteria that occurred in the case of D. F.

 

IRMZ also pointed out that the best option was to call a psychiatric emergency rather than a simple doctor. The Swiss Federal court rejected the applicant's related argument and decided that the doctor's specialization was irrelevant, since the latter had arrived at the scene after D. F.'s death.However, the court found the applicant's argument that the psychiatrist could have given the police officers precise instructions over the phone in order to limit or even eliminate the risk of suicide sufficiently convincing. In this regard, it should be noted that the Swiss Federal court found this argument inappropriate, since the police officers and the doctor did not have direct contact with each other. However, the Court noted that Contracting States should organize their services and train their staff in such a way as to enable them to comply with the requirements of the Convention.

 

Finally, the minutes of the 2011 meeting of the state Council of the Canton recommend that persons with suicidal tendencies be placed in a cell designed for two people, or if necessary, constantly monitor them. It also appears to give preference to calling a psychiatrist as an emergency, although in some circumstances it does not exclude calling a regular ambulance doctor. In the case of D. F., these recommendations were not implemented.

 

Thus, the Court is not convinced that in the present case there were no "minimal signs" of punishable conduct on the part of the police officers who took part in the events that led to the death of D. F. Accordingly, it cannot be considered that the way in which the Swiss criminal justice system responded to the provable allegation of a violation of article 2 of the Convention in the situation under consideration in the present case, where the person expressed clear and repeated suicidal intentions, made it possible to fully hold state representatives accountable for the role they played in the relevant events. Consequently, the existing system has not been able to ensure the effective application of the provisions of Swiss law to protect the right to life, in particular the implementation of the intimidating function of criminal law.

 

Thus, in the situation of the special vulnerability of the applicant's son, there was no adequate protection from the " law " capable of protecting the right to life, as well as preventing in the future any similar actions that put life in danger.

The case involved a violation of the requirements of article 2 of the Convention (adopted unanimously).

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The court awarded the applicant EUR 50,000 in respect of non-pecuniary damage and EUR 5,796 in respect of pecuniary damage.
