Постановлении ЕСПЧ от 23 июля 2020 года по делу "M.K. и другие (M.K. and Others) против Польши" (жалоба N 40503/17 и другие жалобы).

В 2017 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницированы Польше.

По делу успешно рассмотрены жалобы на отказ в предоставлении убежища заявителям и во въезде в страну, их возвращение в Республику Беларусь, а также обжалуется то, что заявителям не были предоставлены эффективные гарантии, которые защитили бы их от реальной опасности подвергнуться бесчеловечному или унижающему достоинство обращению, а также пытке. По делу было допущено нарушение требований статьи 3 Конвенции о защите прав человека и основных свобод, а также нарушение требований статьи 4 Протокола N 4 к Конвенции.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявители являются гражданами Российской Федерации. Они чеченцы по национальности. В 2017 году они несколько раз были на пограничных контрольно-пропускных пунктах на польско-белорусской границе (Тересполь (Terespol) и Черемха-Половцы (Czeremca-Polowce)). Заявители утверждали, что каждый раз они хотели подать ходатайства о предоставлении убежища, но сотрудники пограничной службы отказывали им в этой возможности, а также во въезде в страну и возвращали их в Республику Беларусь, хотя заявители сообщили, что в Республике Беларусь у них не будет доступа к надлежащей процедуре предоставления убежища и что им могут грозить пытки или иные формы жестокого или унижающего достоинство обращения в случае возвращения в Российскую Федерацию (в Чеченскую Республику). Согласно письменным показаниям сотрудников пограничной службы, заявители не выражали намерения подать ходатайства о предоставлении убежища, но в многочисленных докладах правозащитных и неправительственных организаций Польши и средств массовой информации сообщалось, что сотрудники пограничной службы регулярно отказываются принимать ходатайства о предоставлении убежища. В отношении ходатайств Европейский Суд указал на применение обеспечительной меры согласно правилу 39 Регламента Европейского Суда. Тем не менее заявителей выслали в Республику Беларусь. В дальнейшем заявители несколько раз обращались на пограничные контрольно-пропускные пункты, но им снова отказывали в проходе. Ходатайства некоторых из заявителей о предоставлении убежища в итоге были получены властями Польши, и этих заявителей поместили в центр приема и размещения иностранных граждан.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 3 Конвенции. Решая вопрос о том, выражали ли заявители намерение обратиться за предоставлением убежища, когда они прибывали на пограничные контрольно-пропускные пункты, или нет, Европейский Суд придал большее значение версии событий в изложении заявителей, которая была подтверждена показаниями свидетелей. В докладах правозащитных организаций Польши указывалось на наличие системной практики искажения обращений лиц, ищущих убежища, в официальных документах, составляемых сотрудниками пограничной службы, работающих на границе между Польшей и Республикой Беларусь. Более того, нарушения в процедуре бесед с иностранцами, прибывавшими на польско-белорусскую границу в рассматриваемое время, включая отсутствие надлежащей проверки причин, по которой иностранные граждане хотели въехать в Польшу, были подтверждены Высшим административным судом Польши. Также эти недостатки подтверждались в ряде документов, представленных в Европейский Суд, особенно копиями ходатайств о предоставлении международной защиты, которые заявители приносили с собой на границу, многочисленными попытками заявителей пересечь границу и представлением их интересов адвокатами из Польши и Республики Беларусь. В любом случае власти Польши были уведомлены об опасениях заявителей относительно жестокого с ними обращения в случае возвращения, поскольку ходатайства о предоставлении убежища были направлены властям Польши в электронном виде как представителями заявителей, так и Европейским Судом, когда он указывал на применение обеспечительной меры согласно правилу 39 Регламента Европейского Суда. Следовательно, Европейский Суд не мог согласиться с доводами властей Польши о том, что заявители не представили каких-либо доказательств того, что они могли подвергнуться жестокому обращению.

Заявители представили подлежащие доказыванию жалобы на то, что отсутствовали гарантии серьезного рассмотрения властями Республики Беларусь их обращений, а также что их возвращение в Чеченскую Республику нарушит статью 3 Конвенции. Власти Польши должны были осуществить оценку данных утверждений. Более того, власти государства-ответчика были обязаны обеспечить безопасность заявителей, в частности, разрешив им остаться на территории, находящейся под юрисдикцией Польши, до тех пор, пока жалобы заявителей не были бы надлежащим образом рассмотрены компетентными властями Польши. Пределы этой обязанности не зависели от того, имели ли заявители при себе документы, дающие им право пересекать Государственную границу Польши, или были ли они законно допущены на территорию Польши по иным основаниям.

Власти Польши утверждали, что, отказывая заявителям во въезде на свою территорию, они действовали в соответствии с правовыми обязательствами Европейского союза. Однако право Европейского союза явно содержало принцип невысылки (запрещение высылки), гарантированный Конвенцией Организации Объединенных Наций "О статусе беженцев" (г. Женева, 28 июля 1951 г.), и также применялось к лицам, которые должны были пройти проверку на границе государства-члена прежде, чем получить доступ на территорию этого государства. Следовательно, принятые властями Польши и обжалуемые в настоящем деле меры находились за пределами строгих международных обязательств Польши.

В итоге заявителям не были предоставлены эффективные гарантии, которые защитили бы их от реальной опасности подвергнуться бесчеловечному или унижающему достоинство обращению, а также пытке. Отсутствие процедуры, в рамках которой могли бы быть рассмотрены ходатайства заявителей о предоставлении им международной защиты, может быть признано как нарушение статьи 3 Конвенции. Более того, учитывая ситуацию в соседних государствах, не разрешив заявителям остаться на своей территории до завершения рассмотрения их ходатайств, власти Польши умышленно подвергли заявителей серьезной опасности "принудительной высылки" и обращению, запрещенному статьей 3 Конвенции.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 3 Конвенции (принято единогласно).

По поводу соблюдения статьи 4 Протокола N 4 Конвенции. Если запрет на коллективную высылку иностранцев, содержащийся в статье 4 Протокола N 4 к Конвенции, можно считать применимым к действиям государства, имевшим целью препятствовать мигрантам достичь границ этого государства, тогда тем более очевидно, что данный запрет может быть применен в ситуации, когда иностранцы сами прибыли на границу государства, и их вернули оттуда на территорию прилегающего государства.

Во время нахождения заявителей на границе их ходатайства о намерении обратиться за международной защитой были проигнорированы, и, хотя в отношении каждого из заявителей было вынесено отдельное решение, в соответствующих документах об отказе не были указаны надлежащим образом причины, на которые ссылались заявители, когда утверждали, что они боятся преследований. Некоторым заявителям не разрешили про консультироваться с юристами и им отказали в доступе к юристам, даже когда последние находились на пограничном контрольно-пропускном пункте и требовали разрешить им встретиться со своими клиентами (заявителями).

Заявители пытались воспользоваться процедурой подачи ходатайств о предоставлении международной защиты, которая должна была быть им доступна согласно законодательству Польши. Они пытались пересечь границу на законных основаниях, прибыв на официальный пограничный контрольно-пропускной пункт и пройдя все пограничные проверки, требуемые соответствующими нормами права. Таким образом, тот факт, что власти Польши отказались рассмотреть доводы заявителей в пользу удовлетворения их ходатайств о предоставлении международной защиты, не мог быть обусловлен поведением самих заявителей.

Более того, в независимых докладах о положении на пограничных контрольно-пропускных пунктах отмечалось, что ситуации заявителей являлись примерами обширной практики властей Польши по отказу во въезде иностранцам из Республики Беларусь, независимо от того, являлись ли они мигрантами исключительно по экономическим причинам или они высказывали опасения относительно преследования в стране своего происхождения. В докладах указывалось на следующую сложившуюся практику: (1) проводились очень краткие беседы с въезжающими лицами, в ходе которых игнорировались доводы иностранцев в пользу удовлетворения их ходатайств о предоставлении международной защиты; (2) особое внимание уделялось доводам в пользу того, чтобы признать въезжающих экономическими мигрантами; (3) искажались доводы иностранцев и их изложения в очень кратких официальных документах, которые являлись единственным основанием для оформления дальнейших документов об отказе иностранцам во въезде в Польшу и их возвращении в Республику Беларусь, даже тогда, когда иностранцы прямо давали понять, что они хотят обратиться в Польше за международной защитой. Эти выводы также подтверждались некоторыми утверждениями властей, на которые ссылались заявители.

Принятые в деле заявителей решения об отказе во въезде в Польшу являлись коллективной высылкой иностранцев.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 4 Протокола N 4 к Конвенции (принято единогласно).

Европейский Суд также постановил единогласно, что имело место нарушение статьи 13 Конвенции, взятой во взаимосвязи со статьей 3 Конвенции и статьей 4 Протокола N 4 к Конвенции, вследствие отсутствия средства правовой защиты, которое имело бы автоматический приостанавливающий эффект, и что власти Польши не выполнили свои обязательства, предусмотренные статьей 34 Конвенции, поскольку они исполнили обеспечительную меру, указанную Европейским Судом в соответствии с правилом 39 Регламента Европейского Суда, только с большой задержкой, если вообще ее исполнили.

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил каждому из заявителей и каждой из двух семей заявителей по 34 000 евро в качестве компенсации морального вреда.

Judgment of the ECHR of 23 July 2020 in the case "M. K. and Others (M. K. and Others) v. Poland" (aplication No. 40503/17 and other aplications).

In 2017, the applicants were assisted in the preparation of aplications. The aplications were subsequently consolidated and communicated to Poland.

The case successfully examined aplications about the denial of asylum to the applicants and their entry into the country, their return to the Republic of Belarus, and also appeals that the applicants were not provided with effective guarantees that would protect them from the real risk of being subjected to inhuman or degrading treatment, as well as torture. The case involved a violation of the requirements of article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms, as well as a violation of the requirements of article 4 of Protocol No. 4 to the Convention.

 

CIRCUMSTANCES OF THE CASE

 

The applicants are citizens of the Russian Federation. They are Chechens by nationality. In 2017, they visited several border checkpoints on the Polish-Belarusian border (Terespol and Czeremca-Polowce). The applicants claimed that each time they wanted to apply for asylum, but the border guards denied them this opportunity, as well as entry into the country, and returned them to the Republic of Belarus, although the applicants reported that they would not have access to a proper asylum procedure in the Republic of Belarus and that they could face torture or other forms of cruel or degrading treatment if returned to the Russian Federation (the Chechen Republic). According to the written statements of the border guards, the applicants did not express any intention to apply for asylum, but numerous reports from Polish human rights and non-governmental organizations and the media reported that the border guards regularly refused to accept asylum applications. In respect of the applications, the Court referred to the application of an interim measure under rule 39 of the Rules of Court. Nevertheless, the applicants were sent to the Republic of Belarus. In the future, the applicants applied several times to the border checkpoints, but they were again denied passage. The applications of some of the applicants for asylum were eventually received by the Polish authorities, and these applicants were placed in a reception and accommodation center for foreign citizens.

 

LEGAL ISSUES

 

Regarding compliance with article 3 of the Convention. In deciding whether the applicants had expressed an intention to apply for asylum when they arrived at the border checkpoints or not, the Court attached greater importance to the applicants ' version of events, which was confirmed by the testimony of witnesses. The reports of Polish human rights organizations pointed to the existence of a systematic practice of misrepresenting the appeals of asylum seekers in official documents compiled by border guards working on the border between Poland and the Republic of Belarus. Moreover, violations in the procedure of interviews with foreigners arriving at the Polish-Belarusian border at the time under review, including the lack of proper verification of the reasons why foreign citizens wanted to enter Poland, were confirmed by the Supreme Administrative Court of Poland. Also, these deficiencies were confirmed in a number of documents submitted to the European Court, especially copies of applicants for international protection, which the applicants were brought to the border, numerous attempts applicants to cross the border and their interests lawyers from Poland and Belarus. In any event, the Polish authorities were informed of the applicants 'concerns about ill-treatment in the event of their return, since the asylum applications were sent to the Polish authorities electronically, both by the applicants' representatives and by the European Court of Justice, when it indicated the application of an interim measure under rule 39 of the Rules of Court. Consequently, the Court could not accept the Polish authorities ' argument that the applicants had failed to provide any evidence that they might have been subjected to ill-treatment.

The applicants submitted evidentiary complaints that there were no guarantees that the authorities of the Republic of Belarus would seriously consider their complaints, and that their return to the Chechen Republic would violate article 3 of the Convention. The Polish authorities had to evaluate these allegations. Moreover, the authorities of the respondent State had an obligation to ensure the applicants 'safety, in particular by allowing them to remain in the territory under Polish jurisdiction until the applicants' complaints had been properly examined by the competent Polish authorities. The limits of this obligation did not depend on whether the applicants had documents with them that gave them the right to cross the State border of Poland, or whether they were legally allowed to enter the territory of Poland on other grounds.

The Polish authorities argued that by denying the applicants entry into their territory, they were acting in accordance with the legal obligations of the European Union. However, the law of the European Union clearly contained the principle of non-refoulement (prohibition of expulsion), guaranteed by the United Nations Convention relating to the Status of Refugees (Geneva, 28 July 1951), and also applied to persons who had to pass a check at the border of a Member State before gaining access to the territory of that State. Consequently, the measures taken by the Polish authorities and appealed against in the present case were outside the strict international obligations of Poland.

As a result, the applicants were not provided with effective guarantees that would protect them from the real risk of being subjected to inhuman or degrading treatment, as well as torture. The absence of a procedure under which the applicants ' applications for international protection could be considered may be considered as a violation of article 3 of the Convention. Moreover, in view of the situation in neighbouring States, by not allowing the applicants to remain on their territory until their applications were considered, the Polish authorities deliberately exposed the applicants to a serious risk of "forced expulsion" and treatment prohibited by article 3 of the Convention.

 

RESOLUTION

 

The case involved a violation of the requirements of article 3 of the Convention (adopted unanimously).

Regarding compliance with Article 4 of Protocol No. 4 of the Convention. If the prohibition on the collective expulsion of aliens contained in Article 4 of Protocol No. 4 to the Convention can be considered applicable to the actions of a State intended to prevent migrants from reaching the borders of that State, then it is all the more obvious that this prohibition can be applied in a situation where foreigners themselves arrived at the border of a State and were returned from there to the territory of an adjacent State.

During the applicants ' stay at the border, their requests to seek international protection were ignored, and although a separate decision was made in respect of each of the applicants, the relevant refusal documents did not properly indicate the reasons cited by the applicants when they claimed that they were afraid of persecution. Some applicants were not allowed to consult with lawyers and were denied access to lawyers, even when the latter were at the border checkpoint and demanded to be allowed to meet with their clients (applicants).

The applicants tried to use the procedure for applying for international protection, which should have been available to them under Polish law. They tried to cross the border legally by arriving at an official border checkpoint and passing all the border checks required by the relevant law. Thus, the fact that the Polish authorities refused to consider the applicants 'arguments in favour of granting their applications for international protection could not have been due to the applicants' own conduct.

Moreover, independent reports on the situation at border checkpoints noted that the applicants ' situations were examples of the extensive practice of the Polish authorities in refusing entry to foreigners from the Republic of Belarus, regardless of whether they were migrants solely for economic reasons or whether they expressed concerns about persecution in their country of origin. The reports pointed to the following established practices: (1) very brief interviews were conducted with incoming persons, during which the arguments of foreigners in favor of granting their applications for international protection were ignored; (2) special attention was paid to the arguments in favor of recognizing the incoming economic migrants; (3) the arguments of foreigners and their statements in very brief official documents were distorted, which were the only grounds for issuing further documents on the refusal of foreigners to enter Poland and their return to the Republic of Belarus, even when the foreigners explicitly made it clear that they wanted to apply in Poland for international protection. These conclusions were also supported by some of the Authorities ' statements referred to by the applicants.

The decisions taken in the applicants ' case to refuse entry to Poland constituted a collective expulsion of foreigners.

 

RESOLUTION

 

The case involved a violation of the requirements of Article 4 of Protocol No. 4 to the Convention (adopted unanimously).

The Court also held unanimously that there had been a violation of Article 13 of the Convention, taken in conjunction with Article 3 of the Convention and Article 4 of Protocol No. 4 to the Convention, owing to the absence of a remedy that would have an automatic suspensive effect, and that the Polish authorities had failed to comply with their obligations under Article 34 of the Convention, since they had

 

COMPENSATION

 

In the application of article 41 of the Convention. The Court awarded each of the applicants and each of the two applicants ' families EUR 34,000 in respect of non-pecuniary damage.

Postanowieniem ETPC z dnia 23 lipca 2020 r.w sprawie "M. K. i inni (M. K. and Others) przeciwko Polsce" (skarga N 40503/17 i inne skargi).

W 2017 r. skarżący otrzymali pomoc w przygotowaniu skarg. Następnie skargi zostały połączone i komunikowane Polsce.

W sprawie z powodzeniem rozpatrywano skargi dotyczące odmowy azylu skarżącym i wjazdu do kraju, ich powrotu do Republiki Białoruś, a także odwołano się, że skarżący nie otrzymali skutecznych gwarancji, które chroniłyby ich przed realnym niebezpieczeństwem poddania się nieludzkiemu lub poniżającemu traktowaniu, a także torturom. W sprawie doszło do naruszenia wymogów artykułu 3 Konwencji o ochronie praw człowieka i Podstawowych Wolności oraz naruszenia wymogów artykułu 4 protokołu N 4 do Konwencji.

 

OKOLICZNOŚCI SPRAWY

 

Wnioskodawcy są obywatelami Federacji Rosyjskiej. Są Czeczeni narodowości. W 2017 roku kilkakrotnie przebywały na granicznych punktach kontrolnych na granicy polsko-białoruskiej (Terespol (Terespol) i Czeremcha-Połowce (Czeremcha-Polowce)). Skarżący twierdzili, że za każdym razem chcieli składać wnioski o azyl, ale funkcjonariusze Straży Granicznej odmówili im tej możliwości, a także wjazdu do kraju i powrotu do Republiki Białorusi, chociaż skarżący poinformowali, że w Republice Białorusi nie będą mieli dostępu do należytej procedury azylowej i że mogą grozić im tortury lub inne formy okrutnego lub poniżającego traktowania w przypadku powrotu do Federacji Rosyjskiej (Republiki Czeczeńskiej). Według pisemnych zeznań funkcjonariuszy Straży Granicznej wnioskodawcy nie wyrazili zamiaru składania wniosków o azyl, ale liczne raporty polskich organizacji praw człowieka i organizacji pozarządowych oraz mediów informowały, że funkcjonariusze Straży Granicznej regularnie odmawiają przyjmowania wniosków o azyl. W odniesieniu do wniosków Europejski Trybunał Sprawiedliwości wskazał na zastosowanie środka zabezpieczającego zgodnie z zasadą 39 Rozporządzenia Europejskiego Trybunału Sprawiedliwości. Niemniej jednak wnioskodawcy zostali wysłani do Republiki Białorusi. W przyszłości wnioskodawcy kilkakrotnie kontaktowali się z granicznymi punktami kontrolnymi, ale ponownie odmówiono im przejścia. Wnioski niektórych osób ubiegających się o azyl zostały ostatecznie odebrane przez władze RP, a wnioskodawców tych umieszczono w ośrodku przyjmowania i zakwaterowania cudzoziemców.

 

ZAGADNIENIA PRAWA

 

W sprawie przestrzegania artykułu 3 Konwencji. Decydując się na to, czy skarżący wyrazili zamiar ubiegania się o azyl po przybyciu na punkty kontroli granicznej, czy nie, Europejski Trybunał Sprawiedliwości przywiązał większą wagę do wersji wydarzeń w prezentacji skarżących, która została potwierdzona zeznaniami świadków. Raporty organizacji praw człowieka w Polsce wskazywały na istnienie systematycznej praktyki zniekształcania odwołań osób ubiegających się o azyl w oficjalnych dokumentach sporządzanych przez funkcjonariuszy Straży Granicznej pracujących na granicy między Polska A Republika Białorusi. Ponadto nieprawidłowości w procedurze rozmów z obcokrajowcami przybywającymi na granicę polsko-białoruską w omawianym czasie, w tym brak należytej weryfikacji przyczyn, dla których cudzoziemcy chcieli wjechać do Polski, zostały potwierdzone przez Naczelny Sąd Administracyjny w Polsce. Również te wady poparta w szeregu dokumentów, przedstawionych w Europejski Sąd, zwłaszcza kopiami wniosków o udzielenie ochrony międzynarodowej, które wnioskodawcy przynosili ze sobą na granicę, licznymi próbami wnioskodawców przekroczyć granicę i reprezentowaniem ich interesów prawnikami z Polski i Republiki Białoruś. W każdym przypadku władze polskie zostały powiadomione o obawach wnioskodawców dotyczących złego traktowania ich w przypadku powrotu, ponieważ wnioski o azyl zostały przesłane do władz polskich drogą elektroniczną zarówno przez przedstawicieli wnioskodawców, jak i przez Europejski Trybunał Sprawiedliwości, gdy wskazywał na zastosowanie środka zabezpieczającego zgodnie z regułą 39 Rozporządzenia Europejskiego Trybunału Sprawiedliwości. W związku z tym Europejski Trybunał Sprawiedliwości nie mógł zgodzić się z argumentami władz RP, że skarżący nie przedstawili żadnych dowodów na to, że mogli zostać znęcani.

Skarżący przedstawili skarżące, że nie było gwarancji poważnego rozpatrzenia przez władze Republiki Białorusi ich odwołań, a także że ich powrót do Republiki Czeczeńskiej narusza Artykuł 3 Konwencji. Władze Polski miały dokonać oceny tych zarzutów. Ponadto władze państwa pozwanego były zobowiązane do zapewnienia bezpieczeństwa skarżących, w szczególności poprzez zezwolenie im na pozostanie na terytorium podlegającym jurysdykcji Polski, dopóki skargi skarżących nie zostaną odpowiednio rozpatrzone przez właściwe władze RP. Granice tego obowiązku nie zależały od tego, czy wnioskodawcy posiadali przy sobie dokumenty uprawniające ich do przekraczania granicy państwowej Polski, czy też zostali legalnie dopuszczeni na terytorium Polski z innych przyczyn.

Władze Polski argumentowały, że odmawiając wnioskodawcom wjazdu na swoje terytorium, działały zgodnie z obowiązkami prawnymi Unii Europejskiej. Jednak prawo Unii Europejskiej wyraźnie zawierało zasadę braku wygnania (zakaz wydalenia) gwarantowaną przez Konwencję Narodów Zjednoczonych o statusie uchodźców (Genewa, 28 lipca 1951 r.), a także miało zastosowanie do osób, które musiały przejść kontrolę na granicy państwa członkowskiego przed uzyskaniem dostępu do terytorium tego państwa. W związku z tym podjęte przez władze RP i zaskarżone w niniejszej sprawie środki znajdowały się poza ścisłymi obowiązkami międzynarodowymi Polski.

W rezultacie wnioskodawcy nie otrzymali skutecznych gwarancji, które chroniłyby ich przed realnym niebezpieczeństwem poddania się nieludzkiemu lub poniżającemu traktowaniu, a także torturom. Brak procedury, w ramach której wnioski wnioskodawców o przyznanie im ochrony międzynarodowej mogłyby zostać uznane za naruszenie Artykułu 3 Konwencji. Ponadto, biorąc pod uwagę sytuację w sąsiednich państwach, nie zezwalając wnioskodawcom na pozostanie na ich terytorium do czasu zakończenia rozpatrywania ich wniosków, władze polskie celowo naraziły wnioskodawców na poważne niebezpieczeństwo "przymusowego wydalenia" i odwołania zabronionego w artykule 3 Konwencji.

 

UCHWAŁA

 

W sprawie doszło do naruszenia wymogów artykułu 3 Konwencji (przyjętej jednogłośnie).

W sprawie przestrzegania artykułu 4 protokołu N 4 Konwencji. Jeśli zakaz zbiorowego wydalenia cudzoziemców zawarty w artykule 4 protokołu N 4 Konwencji można uznać za mający zastosowanie do działań państwa mających na celu uniemożliwienie migrantom dotarcia do granic tego państwa, to tym bardziej oczywiste jest, że zakaz ten można zastosować w sytuacji, gdy cudzoziemcy sami przybyli na granicę państwa i zostali stamtąd sprowadzeni na terytorium sąsiedniego państwa.

Podczas pobytu skarżących na granicy ich wnioski o zamiary ubiegania się o ochronę międzynarodową zostały zignorowane i chociaż wydano odrębne orzeczenie przeciwko każdemu skarżącemu, odpowiednie dokumenty odmowy nie wskazywały odpowiednio powodów, dla których wnioskodawcy twierdzili, że obawiają się nękania. Niektórym wnioskodawcom nie wolno było konsultować się z prawnikami i odmawiano im dostępu do prawników, nawet gdy ci ostatni byli w punkcie kontroli granicznej i domagali się, aby mogli spotkać się ze swoimi klientami (wnioskodawcami).

Wnioskodawcy próbowali skorzystać z procedury składania wniosków o przyznanie ochrony międzynarodowej, która miała być dla nich dostępna zgodnie z prawem polskim. Próbowali legalnie przekroczyć granicę, przybywając do oficjalnego granicznego punktu kontrolnego i przechodząc wszystkie kontrole graniczne wymagane przez odpowiednie przepisy prawa. Tym samym fakt, że władze Polski odmówiły rozpatrzenia argumentów wnioskodawców na rzecz zaspokojenia ich wniosków o przyznanie ochrony międzynarodowej, nie mógł być uwarunkowany zachowaniem samych wnioskodawców.

Co więcej, w niezależnych raportach dotyczących sytuacji na granicznych punktach kontrolnych zauważono, że sytuacje wnioskodawców były przykładami szeroko zakrojonej praktyki władz polskich w zakresie odmowy wjazdu cudzoziemcom z Republiki Białorusi, niezależnie od tego, czy byli migrantami wyłącznie ze względów ekonomicznych, czy też wyrazili obawy dotyczące prześladowań w kraju pochodzenia. Raporty wskazywały na następujące istniejące praktyki: (1) przeprowadzono bardzo krótkie rozmowy z osobami przychodzącymi, podczas których zignorowano argumenty cudzoziemców na rzecz zaspokojenia ich wniosków o ochronę międzynarodową; (2) szczególną uwagę zwrócono na argumenty przemawiające za uznaniem przychodzących migrantów ekonomicznych; (3) wypaczono argumenty obcokrajowców i ich przedstawienia w bardzo krótkich oficjalnych dokumentach, które były jedyną podstawą do sporządzenia dalszych dokumentów dotyczących odmowy obcokrajowcom wjazdu do Polski i ich powrotu do Republiki Białorusi, nawet wtedy, gdy cudzoziemcy wyraźnie dali do zrozumienia, że chcą zwrócić się w Polsce o ochronę międzynarodową. Ustalenia te zostały również poparte niektórymi twierdzeniami władz, do których odwoływali się skarżący.

Podjęte w sprawie wnioskodawców decyzje o odmowie wjazdu do Polski były zbiorowym wydaleniem cudzoziemców.

 

UCHWAŁA

 

W sprawie doszło do naruszenia wymogów artykułu 4 protokołu N 4 do Konwencji (przyjętej jednogłośnie).

Europejski Trybunał Sprawiedliwości orzekł również jednomyślnie, że doszło do naruszenia artykułu 13 konwencji, w związku z artykułem 3 Konwencji i artykułem 4 protokołu N 4 Konwencji, z powodu braku środka prawnego, który miałby automatyczny efekt zawieszenia, oraz że władze polskie nie wywiązały się ze swoich zobowiązań określonych w artykule 34 konwencji, ponieważ zastosowały środek zabezpieczający określony przez Europejski Trybunał Sprawiedliwości zgodnie z regułą 39 Rozporządzenia Europejskiego Trybunału Sprawiedliwości, tylko z dużym opóźnieniem, jeśli w ogóle

 

ODSZKODOWANIE

 

W trybie stosowania artykułu 41 Konwencji. Europejski Trybunał Sprawiedliwości przyznał każdemu ze skarżących i każdej z dwóch rodzin skarżących 34 000 euro odszkodowania za szkody moralne.

Постановление ЕСПЧ от 10 июля 2020 года по делу "Мюжеманганго (Mugemangango) против Бельгии" (жалоба N 310/15).

 

В 2015 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Бельгии.

 

По делу успешно рассмотрена жалоба на рассмотрение жалобы заявителя на результаты выборов, в которой он требовал пересмотра избирательных бюллетеней, которые были объявлены незаполненными, испорченными или спорными, и пересчета голосов органом, который не обеспечивал достаточные гарантии беспристрастности. По делу допущено нарушение требований статьи 1 Протокола N 3 к Конвенции о защите прав человека и основных свобод, статьи 13 Конвенции о защите прав человека и основных свобод, рассмотренной во взаимосвязи со статьей 3 Протокола N 1 к Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Согласно праву Бельгии органы законодательной власти (парламенты) сами имеют право проверять жалобы на какие-либо нарушения в ходе выборов, исключая, таким образом, юрисдикцию какого-либо внешнего суда или иного органа. Участвуя в выборах в Парламент Валлонии (Валлонский регион) в Бельгии в 2014 году, заявитель проиграл выборы, не набрав до нужного количества всего 14 голосов. Не требуя признать выборы недействительными и провести новые выборы, заявитель потребовал пересмотра избирательных бюллетеней, которые были объявлены незаполненными, испорченными или спорными (более 20 000 бюллетеней), и пересчета голосов, поданных в избирательном округе (провинции) заявителя. Хотя комитет по проверке полномочий Парламента Валлонии (далее - комитет по проверке полномочий) признал жалобу заявителя обоснованной и предложил осуществить пересчет голосов, Парламент Валлонии, на тот момент еще не сформированный, решил не следовать этому решению и одобрил полномочия всех избранных кандидатов. Заявитель обжаловал процедуру рассмотрения его жалобы.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 3 Протокола N 1 к Конвенции. Если нарушения при подсчете голосов или в оформлении избирательных документов могли оказать влияние на результат выборов, наличие справедливой процедуры пересчета голосов является важной гарантией справедливости и успеха всего процесса выборов. Концепция свободных выборов подвергается опасности, только если имеются доказательства процессуальных нарушений, способных нарушить право людей на свободу выражения мнения, и если жалобы на подобные нарушения не рассматриваются эффективно властями соответствующего государства. В связи с этим Европейский Суд должен был, во-первых, убедиться в том, были ли жалобы заявителя достаточно серьезными и подлежали ли они доказыванию, и, во-вторых, были ли эти жалобы эффективно рассмотрены.

 

(a) Были ли жалобы заявителя достаточно серьезными и подлежали ли они доказыванию. Комитет по проверке полномочий Парламента Валлонии установил, что в нескольких рассмотренных сценариях распределение мест в парламенте по избирательному округу заявителя изменилось бы, если бы незаполненные, испорченные или спорные бюллетени были в итоге посчитаны как действительные. Это изменение, вероятно, повлияло бы на распределение мест от других округов провинции. Это было подтверждено на заседании Парламента Валлонии. В любом случае нельзя исключать, что после требуемого заявителем пересчета голосов его бы объявили избранным в Парламент Валлонии. Следовательно, невозможно утверждать, что предполагаемые нарушения не поставили под сомнение достоверность результатов выборов.

 

Заявитель представил серьезную и подлежащую доказыванию жалобу, которая могла привести к изменению распределения мест в Парламенте Валлонии. Однако это необязательно означает, что Парламент Валлонии должен был удовлетворить требование заявителя о пересчете голосов.

 

Хотя пересчет голосов - важная гарантия применительно к справедливости процесса выборов, задачей Европейского Суда не являлось точное определение того, какие действия власти должны были бы выполнить. Задача Европейского Суда заключалась в проверке того, чтобы право заявителя участвовать в выборах являлось эффективным. Это подразумевало, что доводы заявителя, которые были достаточно серьезными и подлежали доказыванию, должны были быть эффективно рассмотрены в соответствии с изложенными ниже требованиями.

 

(b) Являлось ли рассмотрение доводов заявителя эффективным. Чтобы рассмотрение жалоб по вопросам, касающимся избирательных прав, было эффективным, процесс принятия решений по жалобам на результаты выборов должен сопровождаться надлежащими и достаточными гарантиями, обеспечивающими, в частности, исключение какого-либо произвола. Данные гарантии предназначены для того, чтобы обеспечить соблюдение принципа верховенства права в ходе рассмотрения споров, связанных с выборами, и, соответственно, целостность выборного процесса, чтобы была гарантирована законность статуса парламента и он, таким образом, мог действовать, не опасаясь критики в адрес своего состава. Речь шла о сохранении уверенности избирателей в работе парламента. В этом отношении указанные гарантии обеспечивали надлежащее функционирование эффективной политической демократии и представляли собой предварительный шаг к парламентской автономии.

 

Действительно, нормы, касавшиеся внутренней работы парламента, включая состав его органов, как аспект парламентской автономии в принципе относятся к сфере свободы усмотрения Договаривающихся Государств. Тем не менее предоставленная властям свобода усмотрения должна соответствовать концепции "эффективной политической демократии" и принципу "верховенства права", на которые ссылается Преамбула к Конвенции. Следовательно, парламентская автономия может реально осуществляться только в соответствии с принципом верховенства права.

 

Дело заявителя касалось послевыборного спора о результатах выборов, то есть законности и правомерности состава вновь избранного парламента. Этим настоящее дело отличается от споров, которые могут возникнуть после законного избрания члена парламента, то есть споров в отношении полноправного члена парламента на момент одобрения состава законодательного органа в соответствии с процедурой, предусмотренной правовой системой государства. В тот момент, когда комитет по проверке полномочий и пленарный состав Парламента Валлонии вынесли свое решение по жалобе заявителя, обе эти организации состояли из членов парламента, получивших свои места по результатам выборов, чью действительность оспаривал заявитель.

 

Кроме того, когда Парламент Валлонии решил отклонить жалобу, полномочия его членов еще не были одобрены и они не принесли присягу. Таким образом, парламент еще только должен был быть сформирован. Данный фактор следовало принимать во внимание, когда Европейский Суд определял значимость парламентской автономии, рассматривая соблюдение прав, гарантированных статьей 3 Протокола N 1 к Конвенции.

 

Европейский Суд сосредоточился в своем рассмотрении на нижеследующих аспектах.

 

(i) Гарантии беспристрастности органа, принимающего решение. Статья 3 Протокола N 1 к Конвенции направлена на укрепление доверия жителей государства к парламенту, гарантируя его демократическую законность, и как таковые определенные требования также следуют из этой статьи применительно к беспристрастности органа, рассматривающего споры о выборах, и важности, которую в этом отношении могли иметь внешние проявления.

 

В контексте права на свободные выборы, предусмотренного статьей 3 Протокола N 1 к Конвенции, требуемые гарантии беспристрастности необходимы для обеспечения того, чтобы решение принималось исключительно на фактических и правовых основаниях, а не по политическим мотивам. Рассмотрение жалобы на результаты выборов не должно быть площадкой для политической борьбы между различными партиями. В этой связи члены парламента не могут быть по определению "политически нейтральными". Следовательно, в такой системе, которая существовала в Бельгии, когда парламент являлся единственным судьей в отношении споров об избрании его членов, особое внимание следовало уделить гарантиям беспристрастности, установленным законодательством Бельгии в отношении процедуры рассмотрения жалоб на результаты выборов.

 

Принимая во внимание стандарты, разработанные европейскими и международными органами и рекомендованные ими, возникает вопрос: предоставляла ли система, установленная правом Бельгии, как оно было применено в деле заявителя, достаточные гарантии беспристрастности?

 

Сначала жалоба заявителя была рассмотрена комитетом по проверке полномочий. В его состав входили семь человек, выбранных по жребию среди лиц, избранных в Парламент Валлонии. Комитет по проверке полномочий состоял исключительно из членов Парламента Валлонии и согласно закону не должен был представлять различные политические группы парламента. Два члена Парламента Валлонии, заседавшие в комитете по проверке полномочий, были избраны от того же избирательного округа, от которого баллотировался заявитель. В рассматриваемое время в Уставе Парламента Валлонии или ином нормативном акте отсутствовали положения об отводе от участия в рассмотрении жалобы соответствующих членов парламента, и в деле заявителя они добровольно отказались принимать участие в принятии решения по жалобе заявителя. Тем не менее из заключения комитета по проверке полномочий следовало, что указанные члены Парламента Валлонии все же присутствовали на заседании при рассмотрении жалобы заявителя и голосовали по вопросу передачи окончательного заключения, которое включало мнение членов комитета по существу дела, на пленарное заседание Парламента Валлонии. В любом случае заключение комитета по проверке полномочий затем было передано на пленарное заседание Парламента Валлонии, который не согласился с выводами данного комитета.

 

Члены Парламента Валлонии (и одновременно члены комитета по проверке полномочий), которые являлись прямыми оппонентами заявителя, также участвовали в голосовании и на пленарном заседании Парламента Валлонии. Следовательно, решение было принято органом, в который входили члены Парламента Валлонии, сам факт избрания которых был бы поставлен под сомнение, если бы жалоба заявителя была признана обоснованной, и чьи интересы прямо противоречили интересам заявителя. Решение по жалобе заявителя было принято простым большинством голосов. Правила подобного голосования позволяли предполагаемому большинству участников изложить свою точку зрения на проблему, даже если голоса при решении делились почти поровну (то есть меньшинство являлось значительным). Таким образом, вопреки рекомендациям Венецианской комиссии, правило принятия на голосовании решения простым большинством голосов было применено без изменений с учетом особенностей настоящего дела, и не смогло защитить заявителя, кандидата от политической партии, не представленной в Парламенте Валлонии до выборов 25 мая 2014 г., от предвзятого решения.

 

Следовательно, жалоба заявителя была рассмотрена органом, который не обеспечивал достаточные гарантии беспристрастности.

 

(ii) Предоставленная принимающему решение органу свобода усмотрения. Предоставленная органу, принимающему решение по связанным с выборами вопросам, свобода усмотрения не может быть чрезмерной, она должна быть ограничена, с достаточной степенью ясности, положениями внутригосударственного законодательства. Применимые нормы права должны быть четко сформулированными и точными.

 

В деле заявителя эти требования соблюдены не были. Законодательство Бельгии не предусматривало в соответствующий период процедуру рассмотрения таких жалоб, как поданная заявителем, и наделяло Парламент Валлонии исключительными полномочиями по рассмотрению вопросов о действительности избирательного процесса и о любых сомнениях относительно полномочий членов парламента. Критерии, которые Парламент Валлонии мог использовать при разрешении таких жалоб, не были изложены достаточно ясно в применимом праве Бельгии. Кроме того, законодательство Бельгии не уточняло последствия удовлетворения жалобы, аналогичной жалобе заявителя: в данном конкретном случае не уточнялись обстоятельства, при которых голоса должны были быть пересчитаны или выборы объявлены недействительными.

 

(iii) Гарантии вынесения справедливого, объективного и обоснованного решения. Процедура в сфере споров по связанным с выборами вопросам должна гарантировать справедливые, объективные и достаточно обоснованные решения. В частности, податели жалобы должны иметь возможность изложить свою точку зрения и представить любые доводы, которые они считают относящимися к защите их интересов, в письменном виде или, если это уместно, на устных слушаниях. Таким образом соблюдается право подающих жалобу лиц на состязательный процесс. Кроме того, из публичного оглашения обоснований того или иного решения со стороны компетентного органа должно быть понятно, что доводы заявителей были надлежащим образом рассмотрены и на них даны соответствующие ответы.

 

В деле заявителя ни Конституция Бельгии, ни законодательство Бельгии, ни Устав Парламента Валлонии, действовавшие в соответствующий период, не содержали обязанности обеспечить указанные выше гарантии в ходе процедуры проверки полномочий. Однако на практике заявителю были обеспечены некоторые процессуальные гарантии при рассмотрении его жалобы комитетом по проверке полномочий. И заявитель, и его адвокат выступили на публичном заседании, а комитет по проверке полномочий привел основания для своих решений. В решении Парламента Валлонии также были указаны его основания, и заявитель был о них уведомлен.

 

Тем не менее предоставленные заявителю процессуальные гарантии не являлись достаточными. В отсутствие процедуры, предусмотренной в применимых правовых инструментах, указанные гарантии были результатом ad hoc дискреционных решений комитета по проверке полномочий и решений пленарного состава Парламента Валлонии. Действительно, Парламент Валлонии вынес мотивированное решение. Однако он не объяснил, почему он решил не следовать выводам комитета по проверке полномочий, даже притом что комитет по проверке полномочий полагал, ссылаясь на те же основания, которые привел в своем решении Парламент Валлонии, что жалоба заявителя была приемлемой для рассмотрения по существу и обоснованной и что бюллетени от избирательного округа заявителя следовало пересчитать.

 

Следовательно, жалоба заявителя была рассмотрена органом, который не обеспечивал требуемых гарантий своей беспристрастности и чья свобода усмотрения не была определена достаточно ясно в законодательстве Бельгии. Предоставленные заявителю в ходе разбирательства процессуальные гарантии также не являлись достаточными, поскольку были предоставлены на дискреционной основе. Жалобы заявителя не были рассмотрены в рамках процедуры, предусматривающей надлежащие и достаточные гарантии защиты от произвола и обеспечивающей эффективное рассмотрение в соответствии с требованиями статьи 3 Протокола N 1 к Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 1 Протокола N 3 к Конвенции (принято единогласно).

 

По поводу соблюдения статьи 13 Конвенции, рассмотренной во взаимосвязи со статьей 3 Протокола N 1 к Конвенции. Согласно действовавшей в Бельгии системе не существовало иного средства правовой защиты, в суде или другом органе государственной власти, в связи с решением Парламента Валлонии. Фактически законодательство Бельгии предоставляло Парламенту Валлонии исключительные полномочия принимать решения относительно действительности выборов в члены Парламента Валлонии. В соответствии с действовавшими нормами суды Бельгии не обладали юрисдикцией по рассмотрению послевыборных споров.

 

Рассматривая жалобу на нарушение статьи 3 Протокола N 1 к Конвенции, Европейский Суд пришел к выводу, что процедура подачи жалоб в Парламент Валлонии не обеспечивала надлежащих и достаточных гарантий, обеспечивавших эффективное рассмотрение жалоб заявителя. Следовательно, в отсутствие таких гарантий средство правовой защиты также не могло считаться "эффективным" по смыслу статьи 13 Конвенции.

 

"Государственный орган", указанный в статье 13 Конвенции, необязательно должен являться судом в строгом смысле этого слова. Принимая во внимание принцип субсидиарности и многообразие избирательных систем, существующих в государствах Европы, в задачу Европейского Суда не входит определение того, какой вид правовой защиты должен был быть предоставлен для соблюдения требований Конвенции. Данный вопрос, тесно связанный с принципом разделения властей, относится к сфере свободы усмотрения Договаривающихся Государств, предоставленной им в вопросе организации своих избирательных систем. Судебное или судебного типа средство правовой защиты, либо в первой инстанции, либо после решения внесудебного органа, в принципе должно быть таковым, чтобы соответствовать требованиям статьи 3 Протокола N 1 к Конвенции.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 13 Конвенции, рассмотренной во взаимосвязи со статьей 3 Протокола N 1 к Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 2 000 евро в качестве компенсации морального вреда, требование о компенсации материального ущерба было отклонено.

In 2015, the applicant was assisted in the preparation of the aplication. The aplication was subsequently communicated to Belgium.

 

The case successfully dealt with the applicant's aplication against the election results, in which he requested a review of ballots that were declared blank, corrupted or disputed, and a recount by a body that did not provide sufficient guarantees of impartiality. The case violated the requirements of article 1 of Protocol No. 3 to the Convention for the Protection of Human Rights and Fundamental Freedoms, article 13 of the Convention for the Protection of Human Rights and Fundamental Freedoms, considered in conjunction with article 3 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

CIRCUMSTANCES OF THE CASE

 

 

 

Under Belgian law, the legislative authorities (parliaments) themselves have the right to examine complaints of electoral irregularities, thus excluding the jurisdiction of an external court or other body. Participating in the Walloon parliamentary elections in Belgium in 2014, the applicant lost the election by only 14 votes short of the required number. Without demanding that the election be declared invalid and a new election be held, the applicant requested a review of the ballots that were declared blank, corrupted or disputed (more than 20,000 ballots) and a recount of the votes cast in the applicant's electoral district (province). Although the Credentials Committee of the Walloon Parliament (hereinafter referred to as the Credentials Committee) found the applicant's complaint justified and proposed a recount, the Walloon Parliament, which was not yet formed at the time, decided not to follow this decision and approved the credentials of all the elected candidates. The applicant appealed against the procedure for examining his complaint.

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with Article 3 of Protocol No. 1 to the Convention. If irregularities in the counting of votes or in the processing of electoral documents could have an impact on the election result, the existence of a fair recount procedure is an important guarantee of the fairness and success of the entire election process. The concept of free elections is only jeopardized if there is evidence of procedural violations that could violate people's right to freedom of expression, and if complaints of such violations are not effectively dealt with by the authorities of the State concerned. In this regard, the Court had to first verify whether the applicant's complaints were sufficiently serious and could be proved, and, secondly, whether the complaints were effectively dealt with.

 

(a) Whether the applicant's complaints were sufficiently serious and could be proved. The Credentials Committee of the Walloon Parliament found that in several of the scenarios considered, the distribution of parliamentary seats by the applicant's constituency would have changed if the blank, corrupted or disputed ballots were eventually counted as valid. This change would probably affect the distribution of seats from other districts in the province. This was confirmed at a meeting of the Walloon Parliament. In any case, it cannot be excluded that after the recount required by the applicant, he would have been declared elected to the Walloon Parliament. It is therefore impossible to say that the alleged violations did not call into question the credibility of the election results.

 

The applicant submitted a serious and provable complaint that could have led to a change in the distribution of seats in the Walloon Parliament. However, this does not necessarily mean that the Walloon Parliament should have granted the applicant's request for a recount.

 

Although the recount of votes is an important guarantee in relation to the fairness of the election process, it was not the task of the European Court of Justice to determine exactly what actions the authorities should have taken. The Court's task was to verify that the applicant's right to participate in the elections was effective. This implied that the applicant's arguments, which were sufficiently serious and subject to proof, should have been effectively considered in accordance with the requirements set out below.

 

(b) Whether the examination of the applicant's arguments was effective. In order for complaints concerning electoral rights to be dealt with effectively, the decision-making process on complaints about election results must be accompanied by appropriate and sufficient safeguards to ensure, inter alia, that any arbitrariness is excluded. These guarantees are intended to ensure that the rule of law is respected in the handling of election-related disputes and, accordingly, the integrity of the electoral process, so that the legitimacy of the Parliament's status is guaranteed and it can thus act without fear of criticism of its composition. It was about maintaining the confidence of the voters in the work of the parliament. In this respect, these guarantees ensured the proper functioning of an effective political democracy and represented a preliminary step towards parliamentary autonomy.

 

Indeed, the rules concerning the internal workings of the Parliament, including the composition of its organs, as an aspect of parliamentary autonomy, in principle fall within the scope of the Contracting States ' discretion. Nevertheless, the discretion granted to the authorities must be consistent with the concept of "effective political democracy" and the principle of "rule of law", as referred to in the Preamble to the Convention. Consequently, parliamentary autonomy can only really be exercised in accordance with the principle of the rule of law.

 

The applicant's case concerned a post-election dispute over the election results, i.e. the legality and legitimacy of the composition of the newly elected Parliament. In this respect, the present case differs from disputes that may arise after the lawful election of a member of Parliament, that is, disputes concerning a full member of Parliament at the time of approval of the composition of the legislative body in accordance with the procedure provided for by the legal system of the State. At the time when the credentials committee and the plenary of the Walloon Parliament issued their decision on the applicant's complaint, both of these organizations were composed of members of Parliament who had won their seats as a result of the election, whose validity was disputed by the applicant.

 

In addition, when the Walloon Parliament decided to reject the complaint, the powers of its members had not yet been approved and they had not taken the oath. Thus, the parliament had yet to be formed. This factor should have been taken into account when the European Court of Justice determined the significance of parliamentary autonomy, considering the observance of the rights guaranteed by Article 3 of Protocol No. 1 to the Convention.

 

The Court has focused its consideration on the following aspects.

 

(i) Guarantees of the impartiality of the decision-making body. Article 3 of Protocol No. 1 to the Convention aims to strengthen the confidence of the inhabitants of the State in Parliament by guaranteeing its democratic legitimacy, and as such certain requirements also follow from this article with regard to the impartiality of the body dealing with electoral disputes and the importance that external manifestations may have had in this regard.

 

In the context of the right to free elections provided for in article 3 of Protocol No. 1 to the Convention, the required guarantees of impartiality are necessary to ensure that decisions are made solely on factual and legal grounds, and not on political grounds. Consideration of complaints about the election results should not be a platform for political struggle between different parties. In this regard, members of Parliament cannot be "politically neutral"by definition. Consequently, in the system that existed in Belgium, where the Parliament was the sole judge of disputes over the election of its members, special attention should have been paid to the guarantees of impartiality established by Belgian law regarding the procedure for dealing with complaints about election results.

 

Taking into account the standards developed and recommended by European and international bodies, the question arises: did the system established by Belgian law, as applied in the applicant's case, provide sufficient guarantees of impartiality?

 

The applicant's complaint was first examined by the credentials committee. It consisted of seven members, chosen by lot from among the persons elected to the Walloon Parliament. The Credentials Committee was composed exclusively of members of the Walloon Parliament and was not required by law to represent the various political groups in Parliament. Two members of the Walloon Parliament who sat on the credentials committee were elected from the same constituency as the applicant. At the time under review, there was no provision in the Statute of the Walloon Parliament or in any other regulation to exclude the relevant members of Parliament from taking part in the examination of the complaint, and in the applicant's case they voluntarily refused to take part in the decision on the applicant's complaint. Nevertheless, it appeared from the opinion of the Credentials Committee that the said members of the Walloon Parliament had nevertheless been present at the hearing of the applicant's complaint and had voted to refer the final opinion, which included the committee's views on the merits, to the plenary session of the Walloon Parliament. In any case, the opinion of the credentials committee was then referred to the plenary of the Walloon Parliament, which did not agree with the conclusions of this committee.

 

Members of the Walloon Parliament (and at the same time members of the credentials committee) who were direct opponents of the applicant also participated in the voting and in the plenary session of the Walloon Parliament. Consequently, the decision was taken by a body that included members of the Walloon Parliament, whose very election would have been called into question if the applicant's complaint had been found to be justified, and whose interests directly contradicted those of the applicant. The decision on the applicant's complaint was taken by a simple majority vote. The rules of such voting allowed the presumed majority of participants to state their point of view on the problem, even if the votes were almost equally divided (that is, the minority was significant). Thus, contrary to the recommendations of the Venice Commission, the rule of voting by a simple majority was applied unchanged, taking into account the specifics of the present case, and failed to protect the applicant, a candidate of a political party not represented in the Walloon Parliament before the elections of 25 May 2014, from a biased decision.

 

Consequently, the applicant's complaint was examined by a body that did not provide sufficient guarantees of impartiality.

 

(ii) The discretion granted to the decision-making body. The discretion granted to the decision-making body on election-related matters may not be excessive, but should be limited, with sufficient clarity, by the provisions of domestic law. The applicable law must be clearly defined and precise.

 

In the applicant's case, these requirements were not met. Belgian law did not provide for a complaint procedure such as that submitted by the applicant during the relevant period, and gave the Walloon Parliament exclusive authority to consider the validity of the electoral process and any doubts about the powers of members of Parliament. The criteria that the Walloon Parliament could use in resolving such complaints were not set out clearly enough in the applicable Belgian law. In addition, Belgian law did not specify the consequences of granting a complaint similar to the applicant's: in this particular case, it did not specify the circumstances in which the votes should have been recounted or the election declared invalid.

 

(iii) Guarantees of a fair, objective and reasoned decision. The procedure in the field of disputes on election-related issues should guarantee fair, objective and sufficiently justified decisions. In particular, complainants should be able to present their views and any arguments they consider relevant to the protection of their interests in writing or, if appropriate, at an oral hearing. In this way, the right of complainants to an adversarial process is respected. In addition, it should be clear from the public disclosure of the reasons for a decision by the competent authority that the applicants ' arguments have been properly considered and answered accordingly.

 

In the applicant's case, neither the Belgian Constitution, Belgian law, nor the Statute of the Walloon Parliament in force during the relevant period contained an obligation to provide the above-mentioned guarantees in the course of the credentials procedure. However, in practice, the applicant was provided with some procedural guarantees when his complaint was considered by the credentials committee. Both the applicant and his lawyer spoke at a public hearing, and the credentials committee gave reasons for its decisions. The decision of the Walloon Parliament also stated its grounds, and the applicant was notified of them.

 

Nevertheless, the procedural guarantees provided to the applicant were not sufficient. In the absence of the procedure provided for in the applicable legal instruments, these guarantees were the result of ad hoc discretionary decisions of the credentials committee and decisions of the plenary of the Walloon Parliament. Indeed, the Walloon Parliament made a reasoned decision. However, he did not explain why he had decided not to follow the findings of the credentials committee, even though the credentials committee had considered, on the same grounds as the Walloon Parliament had given in its decision, that the applicant's complaint was admissible on the merits and well-founded, and that the ballots from the applicant's constituency should have been counted.

 

Consequently, the applicant's complaint was examined by a body that did not provide the required guarantees of its impartiality and whose discretion was not sufficiently clearly defined in Belgian law. The procedural guarantees provided to the applicant during the proceedings were also not sufficient, as they were provided on a discretionary basis. The applicant's complaints were not considered under a procedure that provides for adequate and sufficient guarantees of protection against arbitrariness and ensures effective consideration in accordance with the requirements of article 3 of Protocol No. 1 to the Convention.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of Article 1 of Protocol No. 3 to the Convention (adopted unanimously).

 

Regarding compliance with Article 13 of the Convention, considered in conjunction with Article 3 of Protocol No. 1 to the Convention. Under the Belgian system, there was no other remedy, in a court or other public authority, for a decision of the Walloon Parliament. In fact, Belgian law gave the Walloon Parliament the exclusive power to decide on the validity of elections for members of the Walloon Parliament. In accordance with the existing rules, the Belgian courts did not have jurisdiction to consider post-election disputes.

 

In considering the complaint of a violation of Article 3 of Protocol No. 1 to the Convention, the Court concluded that the complaints procedure before the Walloon Parliament did not provide adequate and sufficient guarantees to ensure the effective consideration of the applicant's complaints. Consequently, in the absence of such guarantees, the remedy could also not be considered "effective" within the meaning of article 13 of the Convention.

 

The "public authority" referred to in article 13 of the Convention does not necessarily have to be a court in the strict sense of the word. Taking into account the principle of subsidiarity and the diversity of electoral systems in Europe, the European Court is not deciding what kind of remedy should have been provided to meet the requirements of the Convention. This issue, which is closely related to the principle of separation of powers, falls within the scope of the discretion of the Contracting States in the organization of their electoral systems. A judicial or judicial type of remedy, either at first instance or after a decision of an extra-judicial authority, should in principle be such as to comply with the requirements of article 3 of Protocol No. 1 to the Convention.

En 2015, le requérant a reçu une assistance pour préparer sa plainte. La plainte a ensuite été communiquée à la Belgique.

 

La plainte du requérant concernant les résultats des élections, dans laquelle il demandait la révision des bulletins de vote déclarés vides, corrompus ou controversés et le recomptage des voix par un organe qui n'offrait pas de garanties suffisantes d'impartialité, a été examinée avec succès. CIRCONSTANCES DE L'AFFAIRE

 

 

 

Selon le droit Belge pouvoir législatif (les parlements) eux-mêmes ont le droit de vérifier les plaintes sur les violations des élections, à l'exclusion, par conséquent, de la compétence d'une cour ou d'un autre organisme. Lors des élections Législatives wallonnes de 2014 en Belgique, le candidat a perdu les élections, ne recueillant que 14 voix. Bien que la Commission de vérification des pouvoirs du Parlement wallon (ci - après dénommée la Commission de vérification des pouvoirs) ait jugé la plainte du requérant fondée et proposé un recomptage des voix, le Parlement wallon, qui n & apos; était pas encore constitué, a décidé de ne pas suivre cette décision et a approuvé les pouvoirs de tous les candidats élus. Le requérant a fait appel de la procédure d'examen de sa plainte.

 

 

 

QUESTION DE DROIT

 

 

 

Concernant le respect de l'article 3 du Protocole No 1 à la Convention. Si des irrégularités dans le décompte des voix ou dans la présentation des documents électoraux ont pu avoir une incidence sur le résultat des élections, une procédure de recomptage équitable est une garantie importante de l'équité et du succès de l'ensemble du processus électoral. Le concept d'élections libres en danger, seulement si il existe des preuves d'irrégularités susceptibles de violer le droit des personnes à la liberté d'expression, et si les plaintes sur les violations analogues ne sont pas traités efficacement par les autorités de l'état concerné. À cet égard, la Cour européenne devait, premièrement, vérifier si les plaintes du requérant étaient suffisamment graves et recevables et, Deuxièmement, si ces plaintes avaient été effectivement examinées.

 

a) les plaintes du requérant étaient-elles suffisamment graves et recevables? La Commission de vérification des pouvoirs du Parlement wallon a constaté que, dans plusieurs scénarios examinés, la répartition des sièges au Parlement par circonscription électorale du requérant changerait si les bulletins de vote vides, entachés ou contestés étaient finalement considérés comme valides. Ce changement aurait probablement une incidence sur la répartition des sièges des autres districts de la province. Cela a été confirmé lors d'une réunion du Parlement wallon. En tout état de cause, on ne peut exclure qu'après le recomptage requis par le candidat, il soit déclaré élu au Parlement wallon. Il est donc impossible d & apos; affirmer que les violations présumées n & apos; ont pas mis en doute la crédibilité des résultats des élections.

 

Le requérant a déposé une plainte sérieuse et recevable qui pourrait avoir entraîné une modification de la répartition des sièges au Parlement wallon. Toutefois, cela ne signifie pas nécessairement que le Parlement wallon aurait dû satisfaire à la demande de recomptage du demandeur.

 

Bien que le recomptage des voix soit une garantie importante pour l'équité du processus électoral, la tâche de la Cour européenne de justice n'était pas de déterminer exactement ce que les autorités devaient faire. La tâche de la Cour européenne de justice était de vérifier que le droit du requérant de participer aux élections était effectif. Cela impliquait que les arguments du requérant, qui étaient suffisamment sérieux et devaient être prouvés, devaient être effectivement examinés conformément aux conditions énoncées ci-après.

 

b) si l'examen des arguments du requérant a été efficace. Pour que le traitement des plaintes relatives aux droits électoraux soit efficace, le processus de prise de décisions concernant les plaintes relatives aux résultats des élections doit être assorti de garanties adéquates et suffisantes, notamment pour éviter toute forme d & apos; arbitraire. Ces garanties visent à garantir le respect de l & apos; état de droit dans le traitement des différends électoraux et, partant, l & apos; intégrité du processus électoral, de sorte que la légitimité du statut du Parlement soit garantie et qu & apos; il puisse ainsi agir sans craindre de critiquer sa composition. Il s'agissait de maintenir la confiance des électeurs dans le travail du Parlement. À cet égard, ces garanties assuraient le bon fonctionnement d & apos; une démocratie politique efficace et constituaient une étape préliminaire vers l & apos; autonomie parlementaire.

 

En effet, les règles relatives au fonctionnement interne du Parlement, y compris la composition de ses organes, en tant qu'aspect de l'autonomie parlementaire relèvent en principe du pouvoir discrétionnaire des États contractants. Toutefois, le pouvoir discrétionnaire accordé aux autorités doit être conforme à la notion de "démocratie politique efficace" et au principe de "l'état de droit" invoqué dans le préambule de la Convention. Par conséquent, l'autonomie peut vraiment être réalisées uniquement en conformité avec le principe de la primauté du droit.

 

Le dossier de la requérante portait post-électorale de litige sur les résultats des élections, c'est de légalité et de légitimité de la composition du parlement nouvellement élu. Cette présente affaire est différente de conflits qui peuvent survenir après légal de l'élection d'un membre du parlement, c'est-litiges en matière de membre à part entière du parlement au moment de l'approbation de la composition de l'organe législatif conformément à la procédure prévue par le système juridique de l'état. Au moment où la Commission de vérification des pouvoirs et la plénière du Parlement wallon ont statué sur la plainte du requérant, ces deux organisations étaient composées de membres du Parlement ayant obtenu leur siège à l'issue des élections, dont la validité était contestée par le requérant.

 

En outre, lorsque le Parlement wallon a décidé de rejeter la plainte, les pouvoirs de ses membres n'avaient pas encore été approuvés et n'avaient pas prêté serment. Le Parlement devait donc encore être formé. Ce facteur aurait dû être pris en compte lorsque la Cour européenne a déterminé l'importance de l'autonomie parlementaire en examinant le respect des droits garantis par l'article 3 du Protocole n ° 1 à la Convention.

 

La cour européenne de Justice s'est concentrée sur les aspects suivants.

 

i) Garantir l'impartialité de l'organe de décision. L'article 3 du Protocole N ° 1 à la Convention vise à renforcer la confiance des habitants de l'état au parlement, en garantissant son la légalité démocratique, et en tant que tels à certaines exigences suivent à partir de cet article à l'égard de l'impartialité de l'organe de révision de la controverse à propos de l'élection, et de l'importance qu'à cet égard pourraient avoir des manifestations extérieures.

 

Dans le contexte du droit à des élections libres prévu à l & apos; article 3 du Protocole No 1 à la Convention, les garanties d & apos; impartialité requises sont nécessaires pour que la décision soit prise uniquement sur des bases factuelles et juridiques et non sur des motifs politiques. Par conséquent, dans le système qui existait en Belgique, où le Parlement était le seul juge des différends concernant l'élection de ses membres, une attention particulière aurait dû être accordée aux garanties d'impartialité établies par la législation belge en ce qui concerne la procédure de plainte contre les résultats des élections.

 

Compte tenu des normes élaborées et recommandées par les autorités européennes et internationales, la question se pose: le système établi par le droit belge tel qu'il a été appliqué dans l'affaire du requérant a-t-il fourni des garanties suffisantes d'impartialité?

 

La plainte du requérant a d'abord été examinée par la Commission de vérification des pouvoirs. Il était composé de sept personnes choisies au sort parmi les personnes élues au Parlement wallon. La Commission de vérification des pouvoirs était composée exclusivement de membres du Parlement wallon et, en vertu de la loi, ne devait pas représenter les différents groupes politiques du Parlement. Deux Députés Wallons siégeant à la Commission de vérification des pouvoirs ont été élus dans la même circonscription que le candidat. À l & apos; époque considérée, les statuts du Parlement wallon ou tout autre règlement n & apos; autorisaient pas les membres du Parlement concernés à prendre part à l & apos; examen de la plainte et, dans l & apos; affaire du requérant, ils avaient volontairement refusé de prendre part à la décision sur la plainte du requérant. Toutefois, il ressort de l'avis de la Commission de vérification des pouvoirs que les membres du Parlement wallon en question étaient toujours présents lors de l'examen de la requête du requérant et avaient voté sur la transmission de l'avis final, qui comprenait l'avis des membres du Comité sur le fond, à la plénière du Parlement wallon. En tout état de cause, l'avis de la Commission de vérification des pouvoirs a ensuite été transmis à la plénière du Parlement wallon, qui n'a pas souscrit aux conclusions de cette Commission.

 

Les membres du Parlement wallon (ainsi que les membres de la Commission de vérification des pouvoirs), qui étaient des opposants directs au requérant, ont également participé au vote en séance plénière du Parlement wallon. La décision a donc été prise par un organe composé de membres du Parlement wallon dont le fait même d & apos; être élu serait remis en cause si la plainte du requérant avait été jugée fondée et dont les intérêts étaient directement en contradiction avec ceux du requérant. La plainte du requérant a été tranchée à la majorité simple. Les règles de ce vote permettaient à la majorité présumée des participants d'exprimer leur point de vue sur le problème, même si les voix étaient presque égales (c'est-à-dire qu'une minorité était importante). Ainsi, contrairement aux recommandations de la Commission de Venise, la règle du vote à la majorité simple a été appliquée sans modification compte tenu des particularités de la présente affaire et n'a pas permis de protéger le candidat, candidat d'un parti politique non représenté au Parlement wallon avant les élections du 25 mai 2014, d'une décision partiale.

 

En conséquence, la plainte du requérant a été examinée par un organe qui n'a pas fourni de garanties suffisantes d'impartialité.

 

ii) le pouvoir discrétionnaire accordé à l'organe de décision. Le pouvoir discrétionnaire accordé à l & apos; organe de décision sur les questions électorales ne peut être excessif; il doit être limité, avec suffisamment de clarté, par les dispositions de la législation nationale. Les règles de droit applicables doivent être claires et précises.

 

En l'espèce, ces conditions n'étaient pas réunies. La législation belge n & apos; a pas prévu, pendant la période considérée, de procédure d & apos; examen des plaintes telles que celles déposées par le requérant et a conféré au Parlement wallon le pouvoir exclusif d & apos; examiner la validité du processus électoral et tout doute sur les pouvoirs des membres du Parlement. Les critères que le Parlement wallon pourrait utiliser pour régler de telles plaintes n'ont pas été clairement énoncés dans le droit belge applicable. En outre, la législation Belge n'est pas уточняло les conséquences de répondre à une plainte similaire à la plainte du demandeur: dans ce cas particulier, ne précisaient les circonstances dans lesquelles les voix devaient être convertis ou les élections déclarés nuls et non avenus.

 

iii) garanties D'une décision juste, objective et éclairée. Une procédure de contentieux électoral doit garantir des décisions justes, objectives et suffisamment éclairées. En particulier, les plaignants devraient avoir la possibilité d & apos; exprimer leur point de vue et de présenter tous les arguments qu & apos; ils jugent pertinents pour la défense de leurs intérêts, par écrit ou, le cas échéant, à l & apos; audience. Le droit des plaignants à une procédure contradictoire est ainsi respecté. En outre, la publication publique des motifs d'une décision par l'autorité compétente devrait indiquer clairement que les arguments des requérants ont été dûment examinés et que les réponses y ont été apportées.

 

Dans l'affaire du requérant ni la Constitution de la Belgique, ni la législation de la Belgique, ni la Charte du Parlement de la région Wallonne, en vigueur à la période correspondante de l', ne contenaient pas de son devoir d'assurer les garanties susmentionnées dans le cadre de la procédure de vérification des pouvoirs. Toutefois, dans la pratique, le requérant a bénéficié de certaines garanties procédurales lors de l & apos; examen de sa plainte par la Commission de vérification des pouvoirs. Le demandeur et son avocat ont sur le public de la séance, et la commission de vérification des pouvoirs a conduit les motifs de ses décisions. La décision du Parlement wallon indiquait également ses motifs et le requérant en avait été informé.

 

Toutefois, les garanties de procédure accordées au requérant n & apos; étaient pas suffisantes. En l & apos; absence de la procédure prévue dans les instruments juridiques applicables, ces garanties étaient le résultat ad hoc de décisions discrétionnaires de la Commission de vérification des pouvoirs et de décisions de la plénière du Parlement wallon. En effet, le Parlement wallon a rendu une décision motivée. Cependant, il n'a pas expliqué pourquoi il a décidé de ne pas suivre les conclusions du comité de vérification des pouvoirs, même si le comité de vérification des pouvoirs a cru, rappelant les mêmes motifs qui ont conduit à sa décision, le Parlement de la Wallonie, que la plainte du requérant a été acceptable pour l'examen sur le fond et sur la terre et que les bulletins de vote de la circonscription de la requérante aurait dû recalculer.

 

En conséquence, la plainte du requérant a été examinée par un organe qui n'a pas fourni les garanties d'impartialité requises et dont le pouvoir discrétionnaire n'a pas été suffisamment défini en droit belge. Les garanties de procédure fournies au requérant pendant la procédure n & apos; étaient pas non plus suffisantes, car elles étaient accordées sur une base discrétionnaire. Les plaintes du requérant n'ont pas été examinées dans le cadre d'une procédure prévoyant appropriées et des garanties suffisantes pour la protection contre l'arbitraire et efficace de l'examen en conformité avec les exigences de l'article 3 du Protocole N ° 1 à la Convention.

 

 

 

ORDONNANCE

 

 

 

En l & apos; espèce, il y a eu violation des dispositions de l & apos; article premier du Protocole No 3 à la Convention (adopté à l & apos; unanimité).

 

Concernant le respect de l'article 13 de la Convention, examiné en relation avec l'article 3 du Protocole No 1 à la Convention. Selon le système en vigueur en Belgique, il n'y avait pas d'autre recours, devant un tribunal ou une autre autorité publique, à la suite d'une décision du Parlement wallon. En effet, la législation belge donnait au Parlement wallon le pouvoir exclusif de décider de la validité des élections législatives wallonnes. Selon agissant des normes, les tribunaux de la Belgique n'est pas la compétence d'examen послевыборных des litiges.

 

En examinant la plainte pour violation de l & apos; article 3 du Protocole No 1 à la Convention, la Cour européenne de justice a conclu que la procédure de plainte devant le Parlement wallon n & apos; offrait pas les garanties adéquates et suffisantes pour que les plaintes du requérant soient effectivement traitées. En conséquence, en l'absence de telles garanties, le recours ne pouvait pas non plus être considéré comme "efficace" au sens de l'article 13 de la Convention.

 

L '"autorité publique" visée à l'article 13 de la Convention ne doit pas nécessairement être un tribunal au sens strict du terme. Compte tenu du principe de subsidiarité et de la diversité des systèmes électoraux en vigueur dans les États européens, il n'appartient pas à la Cour européenne de déterminer quel type de protection juridique aurait dû être accordé pour satisfaire aux exigences de la Convention. Cette question, étroitement liée au principe de la séparation des pouvoirs, relève du pouvoir discrétionnaire des États contractants quant à l'organisation de leurs systèmes électoraux. Le recours judiciaire ou judiciaire, en première instance ou après une décision d'une autorité extrajudiciaire, doit en principe être tel que les exigences de l'article 3 du Protocole No 1 à la Convention soient satisfaites.

 

 

 

ORDONNANCE

 

 

 

En l & apos; espèce, il y a eu violation des dispositions de l & apos; article 13 de la Convention, examiné en relation avec l & apos; article 3 du Protocole No 1 à la Convention (adopté à l & apos; unanimité).

 

 

 

COMPENSATION

 

 

 

Conformément à l'article 41 de la Convention. La Cour européenne de justice a accordé au requérant 2 000 euros de dommages-intérêts moraux et la demande d'indemnisation pour dommages matériels a été rejetée.
