Постановление ЕСПЧ от 06 октября 2020 года по делу "I.S. против Швейцарии (I.S. v. Switzerland)" (жалоба N 60202/15).

В 2015 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Швейцарии.

По делу успешно рассмотрена жалоба на превентивное содержание заявителя под стражей после вынесения оправдательного приговора. По делу допущено нарушение требований пункта 1 статьи 5 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

После того как сожительница заявителя подала уголовную жалобу, в которой сообщила о многочисленных эпизодах изнасилований и об иных преступлениях, заявителя поместили под стражу в качестве избранной ему меры пресечения с августа по декабрь 2014 года, а впоследствии - в рамках превентивного содержания под стражей, после представления прокурором обвинительного заключения. В праве некоторых зарубежных стран существует понятие "preventive detention", которое дословно переводится как "превентивное/сдерживающее содержание под стражей". Его основной отличительный признак состоит в том, что оно не предназначено для наказания правонарушителя. Его цель - предотвратить совершение противоправных деяний. Содержание под стражей в рамках избранной меры пресечения (pre-trail detention, remand) считается частным случаем "preventive detention".

В апреле 2015 года суд кантона Базель-Штадт Швейцарии оправдал заявителя по всем пунктам обвинения. Однако по ходатайству прокурора, который намеревался обжаловать приговор, суд кантона постановил продлить превентивное содержание заявителя под стражей, что было разрешено законодательством Швейцарии, пока приговор не вступил в силу, отметив, что имелись серьезные подозрения и опасность того, что заявитель может скрыться. Федеральный суд Швейцарии отклонил жалобу заявителя на соответствующее постановление суда кантона по следующим основаниям: (i) обжалование оправдательного приговора приостанавливало его последствия; (ii) обстоятельства дела (слово одной стороны против слова другой) означали, что с высокой степенью вероятности оправдательный приговор мог быть отменен; (iii) в материалах дела, наоборот, имелись веские доказательства, которые могли привести к пересмотру приговора; (iv) различные факторы подтверждали опасение того, что заявитель мог скрыться в страну своего происхождения.

Заявителя освободили из-под стражи в конце 2015 года, и впоследствии после пересмотра приговора судом второй инстанции заявитель был оправдан.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения пункта 1 статьи 5 Конвенции. По нижеуказанным причинам Европейский Суд пришел к выводу, что превентивное содержание заявителя под стражей после вынесения оправдательного приговора судом первой инстанции не попадало ни под одно из исключений, предусмотренных пунктом 1 статьи 5 Конвенции.

(i) Применимость подпункта "c" пункта 1 статьи 5 Конвенции. Подпункт "c" пункта 1 статьи 5 Конвенции не содержит каких-либо ограничений в отношении содержания лица в рамках избранной меры пресечения при рассмотрении его дела судом первой инстанции. Однако Европейский Суд имел возможность прояснить данный вопрос, в том числе на уровне Большой Палаты: содержание лица под стражей на основании подпункта "c" пункта 1 статьи 5 Конвенции завершается в момент вынесения оправдательного приговора, даже если и судом первой инстанции.

Этот подход также был применен и в настоящем деле. Рассмотрев имевшиеся факты в ходе состязательного процесса и проведя подробную оценку доказательств в процессе судебного разбирательства, суд первой инстанции на основании производства по делу в целом единогласно пришел к выводу, что заявитель не мог быть осужден за преступления, которые вменялись ему в вину в обвинительном заключении.

По мнению Европейского Суда, при таких обстоятельствах не имело значения то, что приговор был вынесен только в устной форме и еще не вступил в силу: после оправдания заявителя постановление о его содержании под стражей по смыслу подпункта "c" пункта 1 статьи 5 Конвенции утратило силу.

Более того, подобный подход применяется и в обратной ситуации (если лицо признается виновным судом первой инстанции и содержится под стражей, пока дело рассматривается судом второй инстанции): период содержания лица под стражей регулируется не подпунктом "c" пункта 1 статьи 5 Конвенции, а подпунктом "a" пункта 1 статьи 5 Конвенции, поскольку подсудимый считается находящимся под стражей после "осуждения компетентным судом", как только суд первой инстанции вынес приговор, даже если этот приговор еще не вступил в законную силу и может быть отменен вышестоящим судом (см., например, Постановление Европейского Суда по делу "Руслан Яковенко против Украины" (Ruslan Yakovenko v. Ukraine) от 4 июня 2015 г., жалоба N 5425/11).

Что касается вероятности "ошибочного" оправдания, Европейский Суд отметил, что такой упрек в адрес суда первой инстанции не озвучивался ни прямо, ни косвенно ни на одном из этапов рассмотрения дела заявителя. Наоборот, отсутствовали какие-либо сведения об ошибках в судебном процессе, что особенно важно, учитывая тот факт, что оправдательный приговор, веские основания для которого были изложены на 44 страницах этого документа, был вынесен единогласно.

Кроме того, чтобы гарантировать явку лица в суд второй инстанции, законодательство должно обеспечивать использование менее инвазивных мер, чем лишение лица свободы. Например, в настоящем деле достаточной альтернативной мерой являлось бы изъятие у заявителя документов, удостоверяющих личность, и иных официальных документов.

Что касается возможного риска совершения противоправных деяний во время пересмотра приговора судом второй инстанции, то очевидно, что, если существовали особые причины опасаться такой возможности, ничто не препятствовало органам уголовного судопроизводства Швейцарии вынести постановление о дальнейшем помещении под стражу на основании первой части подпункта "c" пункта 1 статьи 5 Конвенции.

Аналогичные рассуждения верны и в отношении второй части подпункта "c" пункта 1 статьи 5 Конвенции - предотвращение совершения лицом новых преступлений - особенно если имеет место неминуемый риск совершения конкретного и особого тяжкого преступления, которое может повлечь опасность для жизни или здоровья третьих лиц или серьезный материальный ущерб. Тем не менее содержание лица под стражей в качестве превентивной меры должно быть прекращено, как только указанный риск перестанет существовать, и это обстоятельство требует постоянного контроля, поскольку продолжительность содержания под стражей также имеет существенное значение.

(ii) Применимость подпункта "b" пункта 1 статьи 5 Конвенции. В свете устоявшейся прецедентной практики Европейского Суда вторая часть подпункта "b" пункта 1 статьи 5 Конвенции - заключение лица под стражу за неисполнение вынесенного в соответствии с законом решения суда или с целью обеспечения соблюдения любого обязательства, предписанного законом - также не могла служить оправданием для превентивного содержания заявителя под стражей на протяжении примерно 230 дней после его оправдания.

Власти Швейцарии ошибочно сослались на дело "Харкманн против Эстонии" (Harkmann v. Estonia) (Постановление Европейского Суда от 11 июля 2006 г., жалоба N 2192/03), поскольку в данном деле заявитель неоднократно нарушал предписания окружного суда о явке в судебное заседание по уголовному делу. Эта специфика означала, что ссылка на названное дело не может иметь отношения к настоящему делу.

Европейский Суд не смогли убедить одни лишь общие предположения о том, что заявитель мог совершить новые преступления во время рассмотрения его дела судом второй инстанции.

Обязанность не совершать уголовные преступления может считаться достаточно "точной и конкретной", только если явно указаны место и время совершения преступления в ближайшее время и его потенциальные жертвы, если соответствующее лицо осознает, какое именно конкретное действие он или она не должны совершать и если лицо отказывается воздержаться от совершения указанных действий (см. Постановление Большой Палаты Европейского Суда по делу "S., V. и A. против Дании" (S., V. and A. v. Denmark) от 22 октября 2018 г., жалоба N 35553/12 и другие жалобы). Другими словами, обязанность не совершать преступления в ближайшем будущем не может считаться достаточно "точной и конкретной", чтобы попадать в сферу действия подпункта "b" пункта 1 статьи 5 Конвенции, если только не назначены особые меры, которые не соблюдаются.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований пункта 1 статьи 5 Конвенции (принято единогласно).

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 25 000 евро в качестве компенсации морального вреда.

Oktober 2020 im Fall "I.S. gegen die Schweiz (I. S. v. Switzerland)" (Beschwerde N 60202/15).

Im Jahr 2015 wurde die Klägerin bei der Vorbereitung der Beschwerde unterstützt. Anschließend wurde die Beschwerde an die Schweiz weitergeleitet.

In dem Fall wurde die Beschwerde über die vorbeugende Inhaftierung des Antragstellers nach dem Freispruch erfolgreich geprüft. In dem Fall wurde ein Verstoß gegen die Anforderungen von Artikel 5 Absatz 1 des Übereinkommens zum Schutz der Menschenrechte und Grundfreiheiten.

 

SACHVERHALT

 

Nachdem der Mitbewohner des Antragstellers die kriminelle Beschwerde eingereicht hat, in der über zahlreiche Episoden von Vergewaltigungen und über andere Verbrechen berichtet hat, hat der Antragsteller in Haft als das Maß der Selbstbeherrschung von August bis Dezember 2014, und später - innerhalb der vorbeugenden Haft, nach der Darstellung durch den Ankläger der Anklage gestellt. Im Recht einiger Länder gibt es den Begriff "preventive detention", der wörtlich übersetzt "präventive/abschreckende Haft"bedeutet. Sein Hauptmerkmal ist, dass es nicht dazu gedacht ist, den Täter zu bestrafen. Sein Ziel ist es, illegale Handlungen zu verhindern. Inhaftierung im Rahmen der gewählten Maßnahme (pre-trail detention, remand) als Spezialfall "preventive detention".

Im April 2015 hatte ein Gericht des Kantons Basel-Stadt der Schweiz den Beschwerdeführer in allen Anklagepunkten freigesprochen. Auf Antrag des Anklägers, der das Urteil anfechten wollte, entschied das Kantonsgericht jedoch, die präventive Inhaftierung des Klägers zu verlängern, was durch Schweizer Recht erlaubt war, bis das Urteil in Kraft trat, und stellte fest, dass es einen ernsthaften Verdacht und die Gefahr gab, dass der Kläger entkommen könnte. Die Beschwerde des Klägers gegen die entsprechende Entscheidung des Kantonsgerichts lehnte der Schweizer Bundesgerichtshof aus folgenden Gründen ab: (i) Die Berufung auf den Freispruch hat seine Folgen ausgesetzt; (ii) die Umstände des Falles (das Wort einer Partei gegen das Wort der anderen) bedeuteten, dass der Freispruch mit hoher Wahrscheinlichkeit aufgehoben werden könnte; (iii) im Fallmaterial gab es hingegen starke Beweise, die zu einer Revision des Urteils führen könnten; (iv) Verschiedene Faktoren bestätigten die Befürchtung, dass der Beschwerdeführer in sein Herkunftsland fliehen könnte.

Der Kläger wurde Ende 2015 aus der Haft entlassen, und nach der Revision des Urteils durch das Gericht der zweiten Instanz wurde der Kläger freigesprochen.

 

RECHTSFRAGE

 

Über die Einhaltung von Artikel 5 Absatz 1 des Übereinkommens. Aus den folgenden Gründen kam der Europäische Gerichtshof zu dem Schluss, dass die vorbeugende Inhaftierung des Beschwerdeführers nach einem Freispruch durch ein Gericht erster Instanz nicht unter eine der in Artikel 5 Absatz 1 des Übereinkommens vorgesehenen Ausnahmen fiel.

i) Anwendbarkeit von Artikel 5 Absatz 1 Buchstabe c des Übereinkommens. Artikel 5 Absatz 1 c des Übereinkommens enthält keine Beschränkungen hinsichtlich des Inhalts einer Person im Rahmen der gewählten Maßnahme bei der Behandlung seines Falles durch ein Gericht erster Instanz. Der Europäische Gerichtshof konnte diese Frage jedoch auch auf der Ebene der Großen Kammer klären: Die Inhaftierung einer Person nach Artikel 5 Absatz 1 Buchstabe c des Übereinkommens endet mit dem Zeitpunkt des Freispruchs, auch wenn sie von einem Gericht erster Instanz verurteilt wird.

Dieser Ansatz wurde auch im vorliegenden Fall angewendet. Nachdem das Gericht der ersten Instanz die vorhandenen Tatsachen während des umstrittenen Prozesses betrachtet und eine detaillierte Bewertung der Beweise während des Prozesses durchgeführt hatte, kam es im Allgemeinen einstimmig zu dem Schluss, dass der Beschwerdeführer nicht wegen der ihm in der Anklageschrift vorgeworfenen Verbrechen verurteilt werden konnte.

Nach Ansicht des Europäischen Gerichtshofs spielte es unter solchen Umständen keine Rolle, dass das Urteil nur mündlich und noch nicht in Kraft getreten war: Nach der Rechtfertigung des Beschwerdeführers verlor die Entscheidung über seine Haft im Sinne von Artikel 5 Absatz 1 Buchstabe c des Übereinkommens ihre Gültigkeit.

Der Fall wird nicht durch Artikel 5 Absatz 1 c, sondern durch Artikel 5 Absatz 1 a geregelt, da der Angeklagte nach einer "Verurteilung durch das zuständige Gericht" als inhaftiert gilt, sobald das Gericht der ersten Instanz ein Urteil gefällt hat, auch wenn das Urteil noch nicht in Kraft getreten ist. Rechtskraft und kann von einem höheren Gericht aufgehoben werden (siehe zum Beispiel, Urteil des Europäischen Gerichtshofs im Fall "Ruslan Yakovenko gegen die Ukraine" (Ruslan Yakovenko v. Ukraine) vom 4.Juni 2015, Beschwerde Nr. 5425/11).

Bezüglich der Wahrscheinlichkeit einer" falschen " Rechtfertigung hat das Europäische Gericht bemerkt, dass solcher Vorwurf dem Gericht des ersten Beispiels weder direkt, noch indirekt auf einer von Stufen der Rücksicht des Falls des Bewerbers nicht erklingen lassen wurde. Im Gegenteil, es gab keine Informationen über Fehler im Prozess, was besonders wichtig ist, da der Freispruch, dessen Gründe auf 44 Seiten dieses Dokuments dargelegt wurden, einstimmig ausgesprochen wurde.

Um sicherzustellen, dass eine Person vor Gericht zweiter Instanz erscheint, muss die Gesetzgebung außerdem weniger invasive Maßnahmen zur Verfügung stellen als die Freiheitsentziehung. Zum Beispiel wäre in diesem Fall eine ausreichende alternative Maßnahme die Beschlagnahme von Identitätsdokumenten und anderen offiziellen Dokumenten durch den Antragsteller.

Was das mögliche Risiko von rechtswidrigen Handlungen während der Revision durch ein Gericht zweiter Instanz betrifft, so ist es offensichtlich, dass die Schweizer Strafverfahren, wenn es besondere Gründe gab, eine solche Möglichkeit zu befürchten, keine Entscheidung über die weitere Haftentlassung nach Artikel 5 Absatz 1 Buchstabe c des Übereinkommens getroffen haben.

Ähnliche Überlegungen gelten auch für den zweiten Teil von Artikel 5 Absatz 1 c des Übereinkommens, nämlich die Verhinderung neuer Straftaten, insbesondere wenn die Gefahr einer besonderen oder besonderen schweren Straftat besteht, die Lebens - oder Gesundheitsgefahren Dritter oder schwere Sachschäden zur Folge haben kann. Dennoch sollte die Inhaftierung als vorbeugende Maßnahme beendet werden, sobald das Risiko nicht mehr besteht, und dieser Umstand erfordert eine ständige Überwachung, da die Dauer der Inhaftierung ebenfalls von wesentlicher Bedeutung ist.

ii) Anwendbarkeit von Artikel 5 Absatz 1 Buchstabe b des Übereinkommens. Angesichts der etablierten Rechtsprechung des Europäischen Gerichtshofs konnte der zweite Teil von Artikel 5 Absatz 1 b des Übereinkommens - die Inhaftierung einer Person wegen Nichteinhaltung einer gesetzlich vorgeschriebenen Gerichtsentscheidung oder zur Durchsetzung einer gesetzlich vorgeschriebenen Verpflichtung - auch nicht als Rechtfertigung für die vorbeugende Inhaftierung des Beschwerdeführers für einen Zeitraum von etwa 230 Tagen nach seiner Freilassung dienen.

Juli 2006, Beschwerde Nr. 2192/03), weil der Beschwerdeführer in diesem Fall wiederholt gegen die Vorschriften des Amtsgerichts verstoßen hat, in einem Strafverfahren zu erscheinen. Diese Besonderheit bedeutete, dass der Verweis auf den genannten Fall für den vorliegenden Fall nicht relevant sein konnte.

Der Europäische Gerichtshof konnte nur die allgemeinen Annahmen nicht überzeugen, dass der Beschwerdeführer während der Rücksicht seines Falls durch das Gericht der zweiten Instanz neue Verbrechen begehen konnte.

Die Pflicht, keine Straftaten zu begehen, kann nur als "genau und konkret" angesehen werden, wenn der Ort und der Zeitpunkt der Tat in naher Zukunft und seine potenziellen Opfer ausdrücklich angegeben sind, wenn die betreffende Person erkennt, welche bestimmte Handlung er oder sie nicht ausführen soll und wenn die Person sich weigert, diese Handlungen zu unterlassen (S., V. und A. gegen Dänemark (S., V. und A. v. Mit anderen Worten, die Pflicht, in naher Zukunft keine Straftaten zu begehen, kann nicht als "genau und konkret" betrachtet werden, um in den Geltungsbereich von Artikel 5 Absatz 1 b des Übereinkommens zu fallen, es sei denn, besondere Maßnahmen sind vorgeschrieben, die nicht eingehalten werden.

 

VERORDNUNG

 

In dem Fall wurde ein Verstoß gegen die Anforderungen von Artikel 5 Absatz 1 des Übereinkommens (einstimmig angenommen) zugelassen.

 

ENTSCHÄDIGUNG

 

Artikel 41 des Übereinkommens anzuwenden. Der Europäische Gerichtshof hat der Klägerin 25.000 Euro als Entschädigung für den moralischen Schaden zugesprochen.

In 2015, the applicant was assisted in the preparation of the aplication. Subsequently, the aplication was communicated to Switzerland.

The aplication about the applicant's preventive detention after the acquittal was successfully considered in the case. The case involved a violation of the requirements of paragraph 1 of article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

THE CIRCUMSTANCES OF THE CASE

 

After the applicant's cohabitant filed a criminal complaint, in which she reported numerous episodes of rape and other crimes, the applicant was placed in custody as a preventive measure chosen for him from August to December 2014, and subsequently - as part of preventive detention, after the prosecutor submitted an indictment. In the law of some foreign countries, there is a concept of "preventive detention", which is literally translated as"preventive/deterrent detention". Its main distinguishing feature is that it is not intended to punish the offender. Its purpose is to prevent the commission of illegal acts. Detention under the chosen preventive measure (pre-trail detention, remand) is considered a special case of "preventive detention".

In April 2015, the court of the Canton of Basel-Stadt in Switzerland acquitted the applicant on all charges. However, at the request of the prosecutor, who intended to appeal the verdict, the canton court decided to extend the applicant's preventive detention, which was allowed by Swiss law, until the sentence entered into force, noting that there were serious suspicions and a risk that the applicant might abscond. The Swiss Federal Court rejected the applicant's complaint against the relevant decision of the canton court on the following grounds: (i) the appeal of the acquittal suspended its consequences; (ii) the circumstances of the case (the word of one party against the word of the other) meant that the acquittal could be overturned with a high degree of probability; (iii) on the contrary, there was strong evidence in the case file that could lead to a review of the sentence; (iv) various factors confirmed the fear that the applicant could have fled to his country of origin.

The applicant was released from custody at the end of 2015, and subsequently, after a review of the sentence by the court of second instance, the applicant was acquitted.

 

LEGAL ISSUES

 

Regarding compliance with article 5, paragraph 1, of the Convention. For the reasons set out below, the Court concluded that the applicant's preventive detention after the acquittal by the court of first instance did not fall under any of the exceptions provided for in Article 5, paragraph 1, of the Convention.

(i) The applicability of subparagraph " c " of paragraph 1 of Article 5 of the Convention. Subparagraph " c " of paragraph 1 of article 5 of the Convention does not contain any restrictions on the detention of a person within the framework of the chosen preventive measure when considering his case by the court of first instance. However, the European Court had the opportunity to clarify this issue, including at the level of the Grand Chamber: the detention of a person on the basis of subparagraph "c" of paragraph 1 of Article 5 of the Convention ends at the time of the acquittal, even if the court of first instance.

This approach was also applied in the present case. Having considered the available facts during the adversarial process and having conducted a detailed assessment of the evidence during the trial, the court of first instance, on the basis of the proceedings in the case as a whole, unanimously concluded that the applicant could not have been convicted of the crimes that were imputed to him in the indictment.

In the opinion of the European Court, in such circumstances it did not matter that the sentence was pronounced only orally and has not yet entered into force: after the acquittal of the applicant, the decision on his detention within the meaning of subparagraph "c" of paragraph 1 of Article 5 of the Convention became invalid.

Moreover, a similar approach is applied in the opposite situation (if the person is found guilty by the court of first instance and is held in custody while the case is being considered by the court of second instance): the period of detention of a person is regulated not by subparagraph " c "of paragraph 1 of article 5 of the Convention, but by subparagraph" a "of paragraph 1 of article 5 of the Convention, since the defendant is considered to be in custody after "conviction by a competent court" as soon as the court of first instance has pronounced a sentence, even if this sentence has not yet entered into legal force and can be overturned by a higher court (see, for example, The judgment of the European Court in the case of "Ruslan Yakovenko V. Ukraine" (Ruslan Yakovenko, V. Ukraine) on June 4, 2015, complaint N 5425/11).

With regard to the probability of erroneous justification, the Court noted that such a reproach to the court of first instance were not voiced either directly or indirectly on any stage of the proceedings the applicant. On the contrary, there was no information about errors in the trial, which is especially important, given the fact that the acquittal, the good reasons for which were set out on 44 pages of this document, was passed unanimously.

In addition, in order to guarantee the appearance of a person in the court of second instance, the legislation should ensure the use of less invasive measures than the deprivation of liberty of a person. For example, in the present case, a sufficient alternative measure would be the seizure of identity documents and other official documents from the applicant.

With regard to the possible risk of committing illegal acts during the review of the sentence by the court of second instance, it is obvious that, if there were special reasons to fear such a possibility, nothing prevented the Swiss criminal justice authorities from ordering further detention on the basis of the first part of article 5, paragraph 1 (c), of the Convention.

Similar reasoning is also true with respect to the second part of subparagraph "c" of paragraph 1 of article 5 of the Convention - prevention of the commission of new crimes by a person - especially if there is an imminent risk of committing a specific and special serious crime that may entail danger to the life or health of third parties or serious material damage. Nevertheless, the detention of a person as a preventive measure should be terminated as soon as the specified risk ceases to exist, and this circumstance requires constant monitoring, since the duration of detention is also essential.

(ii) Applicability of article 5, paragraph 1 (b), of the Convention. In the light of the established case - law of the European Court, the second part of subparagraph "b" of paragraph 1 of Article 5 of the Convention - the detention of a person for non-compliance with a court decision made in accordance with the law or for the purpose of ensuring compliance with any obligation prescribed by law-also could not serve as a justification for the preventive detention of the applicant for about 230 days after his acquittal.

The Swiss authorities mistakenly referred to the case "Harkmann v. The Court was not able to convince the general assumptions alone that the applicant could have committed new crimes during the consideration of his case by the second instance court.

The obligation not to commit criminal offences can be considered sufficiently "precise and specific" only if the place and time of the commission of the crime in the near future and its potential victims are clearly indicated, if the person concerned is aware of what specific action he or she should not commit and if the person refuses to refrain from committing these actions (see the Decision of the Grand Chamber of the European Court in the case " S., V. and A. v. По делу успешно рассмотрена жалоба на требование к журналисту сообщить личность торговца наркотиками после того, как журналист опубликовал статью об этом человеке, без сопоставления особых затронутых в деле интересов. По делу было допущено нарушение требований статьи 10 Конвенции.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявительница, которая была журналисткой, опубликовала в местной газете статью "Посещая дилера", в которой описала часовой визит в квартиру к торговцу наркотиками, в ходе которого трое наркоманов сделали покупки, и в которой также сообщалось, среди прочего, что дилер торговал каннабисом и гашишем 10 лет и зарабатывал на этом ежегодно более 10 000 евро.

 

Прокурор возбудил уголовное дело в отношении неизвестного лица или лиц и вынес постановление, согласно которому заявительница должна была дать показания, поскольку рассматриваемое преступление попадало в перечень установленных правом Швейцарии исключений из правила о защите журналистских источников информации. Заявительница обжаловала указанное постановление. Однако оценив обстоятельства дела, Федеральный суд Швейцарии решил, что не имелось достаточных оснований сомневаться в балансе конкурирующих интересов, который уже установили в своих актах органы законодательной власти Швейцарии

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 10 Конвенции. Законность и цель вмешательства. Вынесенное в отношении заявительницы постановление было предусмотрено законом. Не оспаривалось, что постановление преследовало законную цель "предотвращения преступления".

 

Необходимость в демократическом обществе. Действительно, заявительница являлась единственным человеком, который мог бы помочь стороне обвинения установить личность торговца наркотиками, который предоставил материалы для статьи заявительницы, и, несомненно, имелись предусмотренные законом основания для уголовного преследования торговца наркотиками. Бесспорно, эти рассуждения имели прямое отношение к делу.

 

Вместе с тем, чтобы установить - в целях "предотвращения преступления" - необходимость раскрытия личности источника информации, недостаточно было утверждать, что в отсутствие такого разглашения будет невозможно провести расследование по уголовному делу, следовало принять во внимание тяжесть преступлений, ставших объектом расследования.

 

Однако в настоящем деле, по-видимому, рассматриваемому преступлению не придавалось большого значения: Федеральный суд Швейцарии сослался на выбор органов законодательной власти Швейцарии, которые включили это преступление в перечень правонарушений, оправдывающих отступление от принципа защиты журналистских источников информации, при этом одновременно подвергая критике несогласованность систематизации этого перечня. Действительно, в своем постановлении Федеральный суд Швейцарии указал и другие факторы, которые он считал существенными для оценки тяжести преступления. В связи с этим Федеральный суд Швейцарии прежде всего подчеркнул коммерческий характер деятельности дилера и получаемую им прибыль, а не тот факт, что ввоз в страну "мягких" наркотиков представлял значительную угрозу для здоровья лиц, употребляющих эти вещества.

 

По мнению Европейского Суда, следовало также придать некоторое значение следующим факторам (в дополнение к меньшей степени общественной опасности рассматриваемого преступления - перевозка "мягких" наркотиков - применительно к различным исключениям, предусмотренным законодательством Швейцарии для принципа неразглашения журналистских источников информации): повышенный общественный интерес, который, вероятно, вызвала опубликованная статья (учитывая, что в статье освещались те факты, что наркоторговец смог активно работать в стране на протяжении многих лет и не был привлечен к ответственности); опасность для репутации газеты в глазах будущих потенциальных информаторов; заинтересованность членов общества в получении информации, распространяемой через анонимные источники.

 

Тем не менее заявительницу нельзя было упрекнуть в том, что она недостаточно критиковала предмет своей статьи, а также это обстоятельство не могло служить основанием для защиты источника информации, как, по-видимому, предполагал Федеральный суд Швейцарии.

 

Принимая во внимание важность защиты журналистских источников информации для свободы прессы, для осуществления вмешательства было недостаточно, чтобы рассматриваемое по делу преступление попадало в определенную категорию или чтобы на него распространялась правовая норма, сформулированная в общих выражениях. Вместо этого следовало проверить, что вмешательство было необходимо при конкретных обстоятельствах дела. Действительно, как представляется, именно данного подхода придерживался Федеральный суд Швейцарии в предыдущем деле (в котором он постановил, в частности, что требование дачи показаний было обоснованным только в том случае, если интерес в предъявлении обвинения превалировал над интересом журналиста в неразглашении своих источников информации).

 

Однако в настоящем деле после того, как Федеральный суд Швейцарии установил, что не было придано какого-либо особого значения ни вопросу об общественном интересе, ни интересам самой заявительницы, указанный суд сослался на баланс интересов, осуществленный органами законодательной власти Швейцарии в общих и абстрактных терминах. Таким образом, постановление Федерального суда Швейцарии не могло обусловить вывод о том, что постановление, вынесенное в отношении заявительницы, об обязательной даче ею показаний отвечало требованию превалирующего общественного интереса. Федеральный суд Швейцарии не указал достаточных причин для обоснования того, что обжалуемая мера соответствовала "настоятельной общественной необходимости".

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

Im Jahr 2014 wurde die Klägerin bei der Vorbereitung der Beschwerde unterstützt. Anschließend wurde die Beschwerde an die Schweiz weitergeleitet.

 

Die Beschwerde über die Forderung des Journalisten, die Identität des Drogenhändlers zu melden, nachdem der Journalist einen Artikel über diesen Mann veröffentlicht hatte, wurde erfolgreich in dem Fall geprüft, ohne die besonderen Interessen der Betroffenen zu vergleichen. In dem Fall wurde ein Verstoß gegen die Anforderungen des Artikels 10 des Übereinkommens zugelassen.

 

 

 

SACHVERHALT

 

 

 

Die Beschwerdeführerin, die Journalistin war, veröffentlichte in der Lokalzeitung den Artikel "Dealer besuchen", in dem sie einen einstündigen Besuch bei einem Drogendealer beschrieb, bei dem drei Drogenabhängige einkaufen gingen, und der unter anderem auch berichtete, dass der Dealer 10 Jahre lang mit Cannabis und Haschisch gehandelt habe und damit jährlich mehr als 10.000 Euro verdient habe.

 

Der Staatsanwalt ein Strafverfahren gegen eine unbekannte Person oder Personen und erließ ein Dekret, Wonach die Beschwerdeführerin musste auszusagen, da das Verbrechen in Frage geriet in der Liste der installierten Schweizer Recht Ausnahmen von Regeln über den Schutz von journalistischen Quellen. Die Klägerin hat gegen die angegebene Entschlossenheit Berufung eingelegt. Nach der Beurteilung der Umstände des Falles entschied das Schweizer Bundesgericht jedoch, dass es keinen ausreichenden Grund gab, an der Balance konkurrierender Interessen zu zweifeln, die die gesetzgebenden Behörden der Schweiz bereits in ihren Akten festgestellt haben

 

 

 

RECHTSFRAGE

 

 

 

Über die Einhaltung von Artikel 10 des Übereinkommens. Rechtmäßigkeit und Zweck der Intervention. Die gegen die Beschwerdeführerin erlassene Verordnung war gesetzlich vorgeschrieben. Es wurde nicht bestritten, dass das Urteil den legitimen Zweck der "Verbrechensverhütung"verfolgte.

 

Die Notwendigkeit einer demokratischen Gesellschaft. Wirklich, die Beschwerdeführerin war die einzige Person, die helfen könnte, die Partei der Anklage, die Identität Drogendealer, die zur Verfügung gestellt Materialien für Artikel des Anmelders, und zweifellos gab es die gesetzlich vorgesehenen Grund für die strafrechtliche Verfolgung Drogendealer. Zweifellos hatte diese Argumentation direkt mit der Sache zu tun.

In diesem Fall wurde dem betrachteten Verbrechen jedoch offenbar keine große Bedeutung beigemessen: Das Schweizer Bundesgericht verwies auf die Auswahl der Schweizer Gesetzgebungsbehörden, die dieses Verbrechen in die Liste der Straftaten aufgenommen hatten, die die Abweichung vom Prinzip des Schutzes journalistischer Informationsquellen rechtfertigten und gleichzeitig die Inkonsistenz der Systematisierung dieser Liste kritisierten. Tatsächlich hat das Schweizer Bundesgericht in seinem Urteil auch andere Faktoren angeführt, die er für wichtig hielt, um die Schwere der Straftat zu beurteilen. In diesem Zusammenhang betonte das Schweizer Bundesgericht vor allem den kommerziellen Charakter der Tätigkeit des Händlers und die daraus resultierenden Gewinne und nicht die Tatsache, dass die Einfuhr von "weichen" Drogen eine erhebliche Gefahr für die Gesundheit der Personen darstellte, die diese Substanzen konsumieren.

 

Der Europäische Gerichtshof sagte, dass die folgenden Faktoren (neben der geringeren öffentlichen Gefahr des betrachteten Verbrechens - der Transport von "weichen" Drogen - in Bezug auf die verschiedenen Ausnahmen, die durch das Schweizer Recht für das Prinzip der Geheimhaltung von journalistischen Quellen vorgesehen sind) eine gewisse Bedeutung haben sollten: das erhöhte öffentliche Interesse, das der veröffentlichte Artikel wahrscheinlich verursacht hat (angesichts der Tatsache, dass der Artikel die Tatsache, dass der Drogenhändler in dem Land über viele Jahre aktiv arbeiten konnte und nicht zur Rechenschaft gezogen wurde); Gefahr für den Ruf der Zeitung in den Augen der zukünftigen potentiellen Informanten; engagierte Mitglieder der Gesellschaft bei der Beschaffung von Informationen, die durch anonyme Quellen.

 

Dennoch konnte der Klägerin nicht vorgeworfen werden, den Gegenstand ihres Artikels nicht ausreichend kritisiert zu haben, und auch dieser Umstand konnte nicht als Grundlage für den Schutz der Informationsquelle dienen, wie das Schweizer Bundesgericht offenbar vermutete.

 

Angesichts der Bedeutung des Schutzes journalistischer Informationsquellen für die Pressefreiheit reicht es nicht aus, dass eine Intervention in eine bestimmte Kategorie fällt oder die in allgemeinen Ausdrücken festgelegte Gesetzesnorm auf sie entfällt. Stattdessen sollte überprüft werden, dass eine Intervention unter den konkreten Umständen des Falles notwendig war. Tatsächlich scheint der Schweizer Bundesgerichtshof in einem früheren Fall genau diesen Ansatz verfolgt zu haben (in dem er unter anderem entschied, dass die Aussage nur gerechtfertigt war, wenn das Interesse an der Anklage vor dem Interesse des Journalisten an der Geheimhaltung seiner Informationsquellen vorherrschte).

 

Doch nachdem das Schweizer Bundesgericht festgestellt hatte, dass weder der Frage des öffentlichen Interesses noch den Interessen der Klägerin selbst eine besondere Bedeutung beigemessen wurde, verwies das Gericht auf die von den Schweizer Gesetzgebungsorganen in allgemeiner und abstrakter Hinsicht ausgeübte Interessenausgleich. So konnte das Urteil des Schweizer Bundesgerichtshofs nicht zu dem Schluss führen, dass das Urteil gegen die Klägerin über die obligatorische Aussage der Klägerin der Forderung des überwiegenden öffentlichen Interesses entsprach. Das Schweizer Bundesgericht hat nicht genügend Gründe angegeben, um zu begründen, dass die angefochtene Maßnahme dem "dringenden öffentlichen Bedarf"entsprach.

 

 

 

VERORDNUNG

THE CIRCUMSTANCES OF THE CASE

 

 

 

The applicant, who was a journalist, published an article in the local newspaper "Visiting a Dealer", in which she described an hour-long visit to the apartment of a drug dealer, during which three drug addicts made purchases, and which also reported, among other things, that the dealer had been selling cannabis and hashish for 10 years and earned more than 10,000 euros annually from this.

 

The prosecutor opened a criminal case against an unknown person or persons and issued a decision according to which the applicant had to give evidence, since the crime in question fell into the list of exceptions established by Swiss law to the rule on the protection of journalistic sources of information. The applicant appealed against the said decision. However, after assessing the circumstances of the case, the Swiss Federal Court decided that there were no sufficient grounds to doubt the balance of competing interests that the Swiss legislative authorities had already established in their acts

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with article 10 of the Convention. Legality and purpose of the intervention. The decision made against the applicant was provided for by law. It was not disputed that the decree pursued the legitimate goal of "preventing a crime".

 

The need for a democratic society. Indeed, the applicant was the only person who could help the prosecution to identify the drug dealer who provided the materials for the applicant's article, and there were undoubtedly legal grounds for criminal prosecution of the drug dealer. Undoubtedly, these arguments were directly related to the case.

 

At the same time, in order to establish - in order to "prevent a crime" - the need to disclose the identity of the source of information, it was not enough to say that in the absence of such disclosure it would be impossible to conduct a criminal investigation, it was necessary to take into account the gravity of the crimes that became the object of investigation.

 

However, in the present case, it seems that the crime in question was not given much importance: the Swiss Federal Court referred to the choice of the Swiss legislative authorities, which included this crime in the list of offenses justifying a deviation from the principle of protecting journalistic sources of information, while at the same time criticizing the inconsistency of the systematization of this list. Indeed, in its ruling, the Swiss Federal Court indicated other factors that it considered essential for assessing the gravity of the crime. In this regard, the Swiss Federal Court first of all emphasized the commercial nature of the dealer's activities and the profit he received, and not the fact that the import of "soft" drugs into the country posed a significant threat to the health of those who use these substances.

 

In the opinion of the European Court, the following factors should also have been given some importance (in addition to the lesser degree of public danger of the crime in question-the transportation of "soft" drugs-in relation to the various exceptions provided for by Swiss law for the principle of non-disclosure of journalistic sources of information): increased public interest, which was probably caused by the published article (given that the article highlighted the facts that the drug dealer was able to work actively in the country for many years and was not brought to justice); the danger to the reputation of the newspaper in the eyes of future potential informants; the interest of members of the society in obtaining information disseminated through anonymous sources.

 

Nevertheless, the applicant could not be reproached for not criticizing the subject of her article sufficiently, nor could this circumstance serve as a basis for protecting the source of information, as the Swiss Federal Court apparently assumed.

 

Taking into account the importance of protecting journalistic sources of information for the freedom of the press, it was not enough for the intervention to be carried out if the crime under consideration in the case fell into a certain category or if it was subject to a legal norm formulated in general terms. Instead, it was necessary to check that the intervention was necessary in the specific circumstances of the case. Indeed, it seems that this approach was followed by the Swiss Federal Court in the previous case (in which it ruled, in particular, that the requirement to testify was justified only if the interest in bringing charges prevailed over the interest of the journalist in not disclosing his sources of information).

 

However, in the present case, after the Swiss Federal Court found that no special importance was attached to either the issue of the public interest or the interests of the applicant herself, the said court referred to the balance of interests carried out by the Swiss legislative authorities in general and abstract terms. Thus, the decision of the Swiss Federal Court could not lead to the conclusion that the decision made against the applicant on the mandatory testimony of her met the requirement of the prevailing public interest. The Swiss Federal Court did not indicate sufficient reasons to justify that the appealed measure corresponded to an "urgent public necessity".

Постановление ЕСПЧ от 06 октября 2020 года по делу "Карастелев и другие против Российской Федерации (Karastelev and Others v. Russia)" (жалоба N 16435/10).

 

В 2010 году заявителям была оказана помощь в подготовке жалоб. Впоследствии жалобы были объединены и коммуницирована Российской Федерации.

 

По делу успешно рассмотрены жалобы на неограниченную свободу усмотрения прокурора при вынесении предупреждений, предостережений и постановлений в соответствии с антиэкстремистским законодательством, которое не обеспечивало надлежащей предвидимости последствий и соответствующих гарантий. По делу было допущено нарушение требований статьи 10 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Первые два заявителя являлись заместителем директора и директором неправительственной организации, организации-заявительницы. Они организовали публичные акции протеста против Закона Краснодарского края от 21 июля 2008 г. N 1539-КЗ "О мерах по профилактике безнадзорности и правонарушений несовершеннолетних в Краснодарском крае", который заявители считали слишком ограничительным и неконституционным. На одном из таких мероприятий был публично продемонстрирован плакат с надписью "Свободу не дают, свободу берут". В другой раз к первым двум заявителям подошли двое несовершеннолетних и поговорили с ними.

 

Ссылаясь на Федеральный закон от 25 июля 2002 г. N 114-ФЗ "О противодействии экстремистской деятельности", прокуратура вынесла два отдельных предостережения в адрес первых двух заявителей как представителей неправительственной организации. Кроме того, через заявительницу было вынесено предупреждение в адрес неправительственной организации-заявительницы, в котором указывалось, что экстремистские действия могли повлечь за собой роспуск организации, а в постановлении отмечалось, что неправительственная организация и заявительница должны "принять меры для исправления нарушений закона и устранения причин и оснований для таких нарушений". Правовым основанием для применения указанных выше мер к заявителям была квалификация их действий как потенциально ведущих к "экстремистской активности" и заключавшихся в препятствии законным действиям представителей органов государственной власти. Заявители безуспешно обжаловали упомянутые акты.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 10 Конвенции. (a) Характер и пределы действия "вмешательства" и статус первых двух заявителей. Что касается письменных предостережений, хотя заявители не были признаны виновными в административном или уголовном преступлении согласно законодательству Российской Федерации, их поведение сочли незаконным в более широком смысле, как потенциально дающее повод для квалификации в качестве "экстремистской деятельности". Заявители были уведомлены об установлении упомянутого факта незаконности ситуации, и им было предъявлено требование действовать определенным образом под угрозой того, что отказ мог привести к привлечению ответственности за административное правонарушение. В дополнение к "вмешательству", связанному с прошлым поведением заявителей во время демонстрации, заявители также оказались перед дилеммой: либо выполнять предупреждение и, таким образом, воздерживаться от дальнейших протестов, либо отказаться следовать предупреждению, и тогда им грозило соответствующее разбирательство.

 

Предупреждение и постановление были адресованы неправительственной организации через ее директора, заявительницу. Именно ее экспрессивное поведение во время демонстраций послужило причиной вынесения упомянутых документов. Позднее заявительница уволилась со своей должности, чтобы обеспечить выполнение обжалуемого постановления и избежать роспуска неправительственной организации. Согласно законодательству Российской Федерации заявительница имела статус, позволявший обжаловать упомянутые акты в судах Российской Федерации. Таким образом, хотя заявительница не была лично признана виновной и ей не грозило какое-либо наказание, вынесение прокуратурой предупреждения и постановления являлись "вмешательством" в право заявительницы на свободу выражения своего мнения. Следовательно, она имела право подать жалобу на нарушение статьи 10 Конвенции.

 

(b) Было ли вмешательство "предусмотрено законом". (i) Рассмотрение дела прокуратурой. Важный вопрос заключался в том, знали ли заявители или могли ли они знать, действуя определенным образом, с надлежащей правовой помощью, при необходимости, что их действия могут привести к тому, что к ним применят положения антиэкстремистского законодательства, поскольку их экспрессивное поведение представляло собой угрозу совершения в будущим "экстремистских акций", заключавшихся в "препятствовании законным действиям публичных властей". В частности, термин "препятствование" был использован для того, чтобы охарактеризовать вид "экстремистской деятельности" исключительно в ситуациях "насилия или угрозы применения насилия". Однако толкование и применение данных понятий вызывает вопросы с точки зрения статьи 10 Конвенции.

 

Риск совершения "преступления", которое можно предотвратить, использовав предупреждение, должен был реальным и касаться конкретного преступления определенной степени тяжести. Он должен быть тесно связан с определенным лицом или лицами, а именно с тем (теми), кто "планирует" экстремистскую деятельность, которую необходимо предотвратить. Кроме того, следует установить, что риск был связан с утверждениями или поведением лица, в отношении которого вынесено предупреждение. Отсутствуют какие-либо данные о том, что законодательство Российской Федерации было сформулировано соответствующим образом. Хотя использование процедуры вынесения предупреждения нельзя сравнивать с полноценным уголовным расследованием, осталось неясным, применили ли власти Российской Федерации какие-либо подлежащие уточнению и предвидимые критерии для того, чтобы сделать из поведения заявителей вывод о препятствующих действиях.

 

В более широком смысле, оценивая особый пример "вмешательства" в свободу выражения мнения в подобного рода делах, следует принимать во внимание различные факторы, включая контекст, в котором были сделаны обжалуемые высказывания, характер этих высказываний и их текст, потенциальную способность данных высказываний привести к наносящим ущерб последствиям (таким, как препятствование с применением силы законным действиям публичных властей), были ли высказывания озвучены в напряженном политическом или социальном контексте, можно ли высказывания, справедливо истолкованные и рассмотренные в непосредственном или более широком контексте, считать прямым или косвенным призывом к насилию (или ненависти, или нетерпимости). Кроме того, необходимо учитывать способ, которым озвучены высказывания, а также способность высказываний, прямую или косвенную, привести к упомянутым наносящим ущерб последствиям. Европейский Суд также повторил, что протесты, включая действия, принимающие форму физического препятствования определенной активности, могут представлять собой выражение мнения по смыслу статьи 10 Конвенции. Не было доказано, что сотрудники прокуратуры в настоящем деле приняли во внимание вышеуказанные элементы, когда принимали решение о вынесении предупреждения в ответ на осуществление лицом его права на свободу выражения мнения. Европейскому Суду не были предоставлены положения, которыми руководствовались бы власти Российской Федерации при вынесении предупреждений или предостережений, а также примеры из внутригосударственной судебной практики.

 

В то же время не существовало четких критериев разграничения между "экстремистской деятельностью", включая призывы к такой деятельности, которая могла быть квалифицирована как уголовно наказуемое деяние, и деятельностью, которая не являлась указанным преступлением, но могла повлечь вынесение предупреждения, как произошло в случае с заявителями. По-видимому, возникают трудности с разграничением уголовно наказуемого призыва к препятствованию действиям органов государственной власти, сопряженные с насилием (угрозой насилия), лозунгом того же содержания, который может стать поводом для вынесения предупреждения, и лозунгом, содержание которого не повлечет какой-либо ответственности по антиэкстремистскому законодательству Российской Федерации. Сложившаяся ситуация неопределенности отрицательным образом сказалась на предвидимости последствий применения соответствующих законодательных норм, что могло оказать демотивирующее воздействие на осуществление права на свободу выражения мнения, и предоставило органам исполнительной власти слишком широкие пределы усмотрения. Законодательство Российской Федерации было сформулировано в общих выражениях, предоставляя органам прокуратуры чрезмерную свободу усмотрения и делая последствия применения закона непредсказуемыми.

 

В заключение, упомянутые выводы также применимы к процедуре вынесения предостережения и постановления. Не было предоставлено каких-либо объяснений относительно причин применения указанных процедур в ситуации, когда обжалуемые действия были прямо связаны с осуществлением лицом права на свободу выражения мнения, а не с деятельностью неправительственной организации.

 

(ii) Судебное рассмотрение. Применяемые post factum средства правовой защиты, предусмотренные законодательством Российской Федерации, не гарантировали защиту от произвола и использования несудебными органами власти неограниченных полномочий. Согласно применимой процедуре судебного рассмотрения суды Российской Федерации не имели права оценивать разумность действий властей или решений, принятых ими в пределах своих дискреционных полномочий, а также не могли применить тест пропорциональности в соответствии со стандартами Конвенции. Суды Российской Федерации не могли проверить, предоставляло ли применимое законодательство Российской Федерации надлежащие гарантии против произвола.

 

(iii) Поведение заявителей. Неразумно было делать вывод о риске насильственных препятствующих действий по отношению к властям Российской Федерации (или о какой-либо реальной угрозе насилия) из поведения заявителей. Не было продемонстрировано, что поведение заявителей могло прямо или косвенно привести к беспорядкам, например, в форме публичных волнений, препятствующих работе органов государственной власти. Также существование опасности совершения преступления не было доказано и не было связано с конкретным лицом или лицами.

 

В итоге законодательство Российской Федерации и правоприменительная практика не позволяли предвидеть последствия их применения и не обеспечивали надлежащую защиту от произвольного использования предупреждений, предостережений или вынесения постановлений. "Вмешательство" не было "предусмотрено законом".

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято единогласно).

 

Европейский Суд также постановил единогласно, что имело место нарушение пункта 1 статьи 6 Конвенции в связи с тем, что заявителю было отказано в доступе к суду применительно к предупреждению, вынесенному в отношении него лично.

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 3 000 евро в качестве компенсации морального вреда.

The decision of the ECHR of October 06, 2020 in the case "Karastelev and Others v. Russia" (Karastelev and Others v. Russia)" (aplications No. 16435/10).

THE CIRCUMSTANCES OF THE CASE

 

 

 

The first two applicants were the deputy director and the director of a non-governmental organization, the applicant organization. They organized public protests against the Law of the Krasnodar Territory of July 21, 2008 No. 1539-KZ "On measures for the prevention of neglect and juvenile delinquency in the Krasnodar Territory", which the applicants considered too restrictive and unconstitutional. At one of these events, a poster with the inscription "Freedom is not given, freedom is taken" was publicly displayed. On another occasion, two minors approached the first two applicants and talked to them.

 

Referring to Federal Law No. 114-FZ of 25 July 2002 "On Countering extremist activities", the prosecutor's office issued two separate warnings to the first two applicants as representatives of a non-governmental organization. In addition, a warning was issued through the applicant to the applicant's non-governmental organization, stating that extremist actions could lead to the dissolution of the organization, and the resolution noted that the non-governmental organization and the applicant should "take measures to correct violations of the law and eliminate the causes and grounds for such violations". The legal basis for applying the above measures to the applicants was the qualification of their actions as potentially leading to" extremist activity " and consisting in hindering the legitimate actions of representatives of state authorities. The applicants unsuccessfully appealed against these acts.

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with article 10 of the Convention. (a) The nature and scope of the "intervention" and the status of the first two applicants. As for the written warnings, although the applicants were not found guilty of an administrative or criminal offense under the legislation of the Russian Federation, their behavior was considered illegal in a broader sense, as potentially giving rise to qualification as "extremist activity". The applicants were notified of the establishment of the above-mentioned fact of the illegality of the situation, and they were required to act in a certain way under the threat that the refusal could lead to liability for an administrative offense. In addition to the "interference" related to the applicants ' past behavior during the demonstration, the applicants also faced a dilemma: either to comply with the warning and thus refrain from further protests, or to refuse to follow the warning, and then they faced appropriate proceedings.

 

The warning and the resolution were addressed to the non-governmental organization through its director, the applicant. It was her expressive behavior during the demonstrations that caused the issuance of these documents. The applicant later resigned from her position in order to ensure the implementation of the appealed decision and to avoid the dissolution of the non-governmental organization. According to the legislation of the Russian Federation, the applicant had a status that allowed her to appeal the mentioned acts in the courts of the Russian Federation. Thus, although the applicant was not personally found guilty and did not face any punishment, the issuance of a warning and a decision by the prosecutor's office was an "interference" with the applicant's right to freedom of expression. Consequently, she had the right to file a complaint about a violation of article 10 of the Convention.

 

(b) Whether the interference was "prescribed by law". (i) Consideration of the case by the Prosecutor's Office. An important question was whether the applicants knew or could have known, acting in a certain way, with appropriate legal assistance, if necessary, that their actions could lead to the provisions of anti-extremist legislation being applied to them, since their expressive behavior posed a threat of committing "extremist actions" in the future, consisting in "obstructing the legitimate actions of public authorities". In particular, the term " obstruction "was used to characterize the type of" extremist activity "exclusively in situations of"violence or threat of violence". However, the interpretation and application of these concepts raises questions from the point of view of article 10 of the Convention.

 

The risk of committing a "crime" that can be prevented by using a warning must have been real and related to a specific crime of a certain degree of severity. It should be closely associated with a certain person or persons, namely, those (those) who are "planning" extremist activities that need to be prevented. In addition, it should be established that the risk was associated with the statements or behavior of the person against whom the warning was issued. There is no evidence that the legislation of the Russian Federation has been formulated accordingly. Although the use of the warning procedure cannot be compared with a full-fledged criminal investigation, it remains unclear whether the authorities of the Russian Federation have applied any specified and predictable criteria in order to draw a conclusion about obstructive actions from the applicants ' behavior.

 

In a broader sense, when assessing a particular example of "interference" with freedom of expression in such cases, various factors should be taken into account, including the context in which the contested statements were made, the nature of these statements and their text, the potential ability of these statements to lead to harmful consequences (such as obstructing the lawful actions of public authorities with the use of force), whether the statements were voiced in a tense political or social context, whether the statements, fairly interpreted and considered in a direct or broader context, it is considered a direct or indirect call to violence (or hatred, or intolerance). In addition, it is necessary to take into account the way in which statements are voiced, as well as the ability of statements, directly or indirectly, to lead to the aforementioned damaging consequences. The Court also reiterated that protests, including actions taking the form of physical obstruction of certain activities, may constitute an expression of opinion within the meaning of Article 10 of the Convention. It has not been proved that the prosecutors in the present case took into account the above elements when they decided to issue a warning in response to the exercise of a person's right to freedom of expression. The European Court was not provided with provisions that would guide the authorities of the Russian Federation in issuing warnings or warnings, as well as examples from domestic judicial practice.

 

At the same time, there were no clear criteria for distinguishing between "extremist activities", including calls for such activities that could be qualified as a criminal offense, and activities that did not constitute the specified crime, but could lead to a warning, as happened in the case of the applicants. Apparently, there are difficulties with distinguishing between a criminally punishable call to obstruct the actions of state authorities involving violence (threat of violence), a slogan of the same content that can become a reason for issuing a warning, and a slogan whose content will not entail any responsibility under the anti-extremist legislation of the Russian Federation. The current situation of uncertainty negatively affected the predictability of the consequences of the application of the relevant legislative norms, which could have a demotivating effect on the exercise of the right to freedom of expression, and gave the executive authorities too wide a margin of discretion. The legislation of the Russian Federation was formulated in general terms, giving the prosecutor's office excessive discretion and making the consequences of applying the law unpredictable.

 

In conclusion, the above-mentioned conclusions are also applicable to the procedure for issuing a warning and ruling. No explanation was provided as to the reasons for the application of these procedures in a situation where the actions complained of were directly related to the exercise of the right to freedom of expression by a person, and not to the activities of a non-governmental organization.

 

(ii) Judicial review. The legal remedies applied post factum, provided for by the legislation of the Russian Federation, did not guarantee protection from arbitrariness and the use of unlimited powers by non-judicial authorities. According to the applicable judicial review procedure, the courts of the Russian Federation had no right to assess the reasonableness of the actions of the authorities or decisions taken by them within their discretionary powers, and also could not apply the proportionality test in accordance with the standards of the Convention. The courts of the Russian Federation could not verify whether the applicable legislation of the Russian Federation provided adequate guarantees against arbitrariness.

 

(iii) The conduct of the applicants. It was not reasonable to draw a conclusion about the risk of violent obstructive actions against the authorities of the Russian Federation (or about any real threat of violence) from the applicants ' behavior. It has not been demonstrated that the applicants ' behavior could directly or indirectly lead to unrest, for example, in the form of public unrest that interferes with the work of State authorities. Also, the existence of a danger of committing a crime was not proven and was not associated with a specific person or persons.

 

As a result, the legislation of the Russian Federation and law enforcement practice did not allow to foresee the consequences of their application and did not provide adequate protection against the arbitrary use of warnings, warnings or rulings. The "interference" was not "provided for by law".

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of article 10 of the Convention (adopted unanimously).

 

The Court also ruled unanimously that there had been a violation of Article 6, paragraph 1, of the Convention because the applicant had been denied access to the court in relation to a warning issued against him personally.

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The European Court awarded the applicant 3,000 euros in compensation for non-pecuniary damage.
