Постановление ЕСПЧ от 20 октября 2020 года по делу "B. против Швейцарии (B. v. Switzerland)" (жалоба N 78630/12).

В 2012 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Швейцарии.

По делу успешно рассмотрена жалоба на прекращение выплаты по достижении ребенком совершеннолетия пенсии пережившему и обладающему полными родительскими правами родителю ребенка, поскольку этот родитель является мужчиной. По делу было допущено нарушение требований статьи 14 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

После смерти своей супруги заявитель уволился с работы, чтобы воспитывать двух их детей, и ему выплачивалась пенсия "в связи с потерей супруга" на основании Федерального закона о пенсионном возрасте и страховании переживших родственников. Согласно этому закону выплата пенсии заявителю прекратилась, когда его младшая дочь в 2010 году достигла возраста совершеннолетия. Заявитель обжаловал это основание для прекращения ему выплаты пенсии как дискриминационное, утверждая, что закон не содержал аналогичного ограничения, если пережившим родителем была женщина. В 2012 году Федеральный суд Швейцарии отклонил жалобу заявителя, установив, что, хотя разница в отношении не соответствовала принципу равенства, статья 14 Конвенции не была применима к делу заявителя ни в связи с правом на пользование имуществом, поскольку Швейцария не ратифицировала Протокол N 1 к Конвенции, ни в совокупности со статьей 8 Конвенции.

 

ВОПРОСЫ ПРАВА

 

По поводу соблюдения статьи 14 Конвенции. Применимость статьи 14 Конвенции. В целом пенсия в связи с утратой супруга предназначена для того, чтобы пережившему супругу не приходилось работать и чтобы он или она могли иметь время для заботы о своих детях. В связи с этим рассматриваемая пенсия связана с "семьей", поскольку она оказывает реальное воздействие на организацию своей семейной жизни пережившим супругом.

В настоящем деле пенсия в связи с утратой супруга имела очень важные последствия для заявителя: постоянно работая до смерти супруги, после этого он полностью посвятил свое время заботе о детях, не имея возможности заниматься своей карьерой на протяжении более чем 16 лет, по истечении которых заявитель достиг возраста, когда очень трудно вернуться на рынок труда (57 лет на момент прекращения выплаты пенсии, и 59 лет на дату отклонения последней жалобы заявителя).

При таких обстоятельствах Европейский Суд постановил, что пенсия в связи с утратой супруга влияла на то, каким образом заявитель организовывал и структурировал свою семейную жизнь.

 

ПОСТАНОВЛЕНИЕ

 

К делу применима статья 14 Конвенции, рассмотренная во взаимосвязи со статьей 8 Конвенции.

Существо жалобы. Заявитель находился в аналогичном положении, по сравнению с любой женщиной, в том, что касалось права на получение пенсии в связи с утратой супруга. Однако власти Швейцарии отказали ему в этой выплате на том основании, что заявитель являлся мужчиной (по-видимому, ни одна из каких-либо иных норм законодательства Швейцарии не была оценена как невыполненная).

Власти Швейцарии объяснили, что пенсия в связи с утратой супруга была основана на презумпции о том, что муж финансово поддерживал жену, особенно когда у них были дети. Хотя Европейский Суд был готов согласиться с тем, что упомянутая презумпция являлась "объективным" оправданием, он не счел такое оправдание "обоснованным". Европейский Суд ранее отмечал, что только очень веские основания могли заставить его считать разницу в отношении, основанную исключительно на половой принадлежности заинтересованных лиц, соответствующей Конвенции. Это правило применялось независимо от того, влияла ли предполагаемая дискриминация на женщин или, как в данном деле, на мужчин.

Действительно, нельзя было исключить, что установление пенсии в связи с утратой супруга для женщин, без соответствующей пенсии для мужчин, потерявших жену, могло быть оправдано ролью и статусом женщины в обществе в момент принятия соответствующего закона в 1948 году. Однако ссылок на традиции, общие предположения или превалирующие социальные отношения в конкретной стране сегодня недостаточно для того, чтобы оправдать расхождение в обращении с людьми по причине их половой принадлежности.

Что касается настоящего дела, Европейский Суд не смог установить, каким образом прекращение выплаты заявителю пенсии повлияло бы на него в меньшей степени, чем на женщину в аналогичной ситуации. В частности, сложно понять, почему заявитель предположительно столкнулся бы с меньшими трудностями при возвращении к трудовой деятельности в возрасте 57 лет, чем женщина, учитывая, что 16 лет заявитель не имел оплачиваемой работы.

Следовательно, отсутствовали "крайне веские обстоятельства", оправдывающие различие в обращении с людьми в настоящем деле. Европейский Суд подчеркнул, что этот вывод не должен быть истолкован как призыв к отмене или уменьшению размера соответствующей пенсии для женщин, чтобы устранить выявленное неравенство по отношению к разным получателям пенсии.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 14 Конвенции, рассмотренной во взаимосвязи со статьей 8 Конвенции (принято единогласно).

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 5 000 евро в качестве компенсации морального вреда, требование о компенсации материального ущерба было отклонено, так как имеется возможность добиться рассмотрения этого вопроса органами государственной власти Швейцарии.

Oktober 2020 im Fall "B. gegen die Schweiz (B. v. Switzerland)" (Beschwerde N 78630/12).

Im Jahr 2012 wurde der Beschwerdeführer bei der Vorbereitung der Beschwerde unterstützt. Anschließend wurde die Beschwerde an die Schweiz weitergeleitet.

Die Beschwerde über die Beendigung der Zahlung nach dem Erreichen des Kindes der Volljährigkeit der Rente dem Überlebenden und dem Elternteil des Kindes, da dieser Elternteil ein Mann ist, wurde erfolgreich in Betracht gezogen. SACHVERHALT

 

Nach dem Tod seiner Frau kündigte der Antragsteller seinen Job, um ihre beiden Kinder zu erziehen, und er erhielt eine Rente "im Zusammenhang mit dem Verlust des Ehepartners" auf der Grundlage des Bundesgesetzes über das Rentenalter und die Versicherung von überlebenden Verwandten. Nach diesem Gesetz wurde die Zahlung der Rente an den Antragsteller gestoppt, als seine jüngste Tochter im Jahr 2010 das Erwachsenenalter erreichte. Die Klägerin hatte diesen Grund für die Einstellung der Rentenzahlung als diskriminierend bezeichnet und argumentiert, das Gesetz enthalte keine ähnliche Einschränkung, wenn der überlebende Elternteil eine Frau sei. Im Jahr 2012 wies das Schweizer Bundesgericht die Beschwerde des Beschwerdeführers ab und stellte fest, dass Artikel 14 des Übereinkommens zwar nicht im Einklang mit dem Gleichheitsgrundsatz stand, aber weder im Zusammenhang mit dem Recht auf Eigentum auf den Beschwerdeführer anwendbar war, da die Schweiz das Protokoll N 1 zum Übereinkommen nicht ratifiziert hat, noch in Verbindung mit Artikel 8 des Übereinkommens.

 

RECHTSFRAGE

 

Über die Einhaltung von Artikel 14 des Übereinkommens. Anwendbarkeit von Artikel 14 des Übereinkommens. Im Allgemeinen ist die Rente im Zusammenhang mit dem Verlust eines Ehepartners so konzipiert, dass der überlebende Ehepartner nicht arbeiten muss und dass er oder sie Zeit haben kann, sich um seine Kinder zu kümmern. Die Rente, die mit dem Verlust des Ehegatten verbunden ist, hat für den Antragsteller sehr wichtige Auswirkungen: Er arbeitete ständig bis zum Tod des Ehegatten, danach widmete er sich voll und ganz der Kinderbetreuung, ohne seine Karriere für mehr als 16 Jahre zu betreiben, nach denen der Antragsteller ein Alter erreicht hat, in dem es sehr schwierig ist, auf den Arbeitsmarkt zurückzukehren (57 Jahre zum Zeitpunkt der Beendigung der Rente und 59 Jahre zum Zeitpunkt der Ablehnung der letzten Beschwerde des Antragstellers).

Unter diesen Umständen hat der Europäische Gerichtshof entschieden, dass die Rente im Zusammenhang mit dem Verlust des Ehegatten die Art und Weise beeinflusst hat, wie der Antragsteller sein Familienleben organisiert und strukturiert hat.

 

VERORDNUNG

 

Für den Fall gilt Artikel 14 des Übereinkommens, der im Zusammenhang mit Artikel 8 des Übereinkommens behandelt wird.

Das Wesen der Beschwerde. Die Klägerin befand sich im Vergleich zu jeder Frau in einer ähnlichen Position, was das Recht auf eine Rente im Zusammenhang mit dem Verlust des Ehegatten betraf. Die Schweizer Behörden lehnten ihn jedoch mit der Begründung ab, dass der Beschwerdeführer ein Mann war (offenbar wurde keine der anderen Bestimmungen der Schweizer Gesetzgebung als nicht erfüllt eingestuft).

Die Schweizer Behörden erklärten, dass die Rente im Zusammenhang mit dem Verlust des Ehepartners auf der Vermutung beruhte, dass der Ehemann die Frau finanziell unterstützte, besonders wenn sie Kinder hatten. Obwohl der Europäische Gerichtshof bereit war, zuzustimmen, dass die erwähnte Vermutung eine "objektive" Rechtfertigung war, hielt er eine solche Rechtfertigung nicht für "gerechtfertigt". Der Europäische Gerichtshof bereits erwähnt, dass nur sehr gewichtige Gründe konnten ihn glauben machen einen Unterschied in der Haltung, allein auf der Basis des Geschlechts der beteiligten, eine entsprechende Konvention. Diese Regel gilt unabhängig davon, ob die angebliche Diskriminierung Frauen oder, wie in diesem Fall, Männer beeinflusste.

Tatsächlich konnte nicht ausgeschlossen werden, dass die Einrichtung einer Rente für Frauen, ohne eine angemessene Rente für Männer, die eine Frau verloren haben, mit der Rolle und dem Status der Frau in der Gesellschaft zum Zeitpunkt der Verabschiedung des entsprechenden Gesetzes im Jahr 1948 gerechtfertigt sein könnte. Jedoch reichen die Verweise auf Traditionen, allgemeine Annahmen oder die vorherrschenden sozialen Beziehungen in einem bestimmten Land heute nicht aus, um die Diskrepanz im Umgang mit Menschen aufgrund ihrer Geschlechterzugehörigkeit zu rechtfertigen.

Was den vorliegenden Fall betrifft, konnte der Europäische Gerichtshof nicht feststellen, wie die Einstellung der Zahlung der Rente an den Antragsteller ihn in geringerem Ausmaß als eine Frau in einer ähnlichen Situation beeinflussen würde. Insbesondere ist es schwer zu verstehen, warum der Antragsteller vermutlich im Alter von 57 Jahren weniger Schwierigkeiten bei der Rückkehr in die Erwerbstätigkeit hätte als eine Frau, da der Antragsteller mit 16 Jahren keinen bezahlten Job hatte.

Folglich fehlten "äußerst gewichtige Umstände", die den Unterschied im Umgang mit Menschen im vorliegenden Fall rechtfertigen. Der Europäische Gerichtshof betonte, dass diese Schlussfolgerung nicht als Aufruf zur Aufhebung oder Verringerung der entsprechenden Rente für Frauen ausgelegt werden sollte, um die identifizierten Ungleichheiten gegenüber verschiedenen Rentenempfängern zu beseitigen.

 

VERORDNUNG

 

In dem Fall wurde ein Verstoß gegen die Anforderungen von Artikel 14 des Übereinkommens, der im Zusammenhang mit Artikel 8 des Übereinkommens behandelt wurde, zugelassen (einstimmig angenommen).

 

ENTSCHÄDIGUNG

 

Artikel 41 des Übereinkommens anzuwenden. Der Europäische Gerichtshof hat dem Beschwerdeführer 5 000 Euro als Entschädigung für den moralischen Schaden zugesprochen, der Anspruch auf Entschädigung für den materiellen Schaden wurde abgelehnt, da es möglich ist, die Prüfung dieser Frage durch die Schweizer Behörden zu erreichen.

THE CIRCUMSTANCES OF THE CASE

 

After the death of his wife, the applicant quit his job to raise their two children, and he was paid a pension "in connection with the loss of a spouse" on the basis of the Federal Law on Retirement Age and Insurance of Surviving Relatives. According to this law, the payment of the applicant's pension stopped when his youngest daughter reached the age of majority in 2010. The applicant appealed against this ground for the termination of his pension payment as discriminatory, arguing that the law did not contain a similar restriction if the surviving parent was a woman. In 2012, the Swiss Federal Court rejected the applicant's complaint, finding that, although the difference in treatment did not comply with the principle of equality, article 14 of the Convention was not applicable to the applicant's case either in connection with the right to use property, since Switzerland had not ratified Protocol No. 1 to the Convention, nor in conjunction with article 8 of the Convention.

 

LEGAL ISSUES

 

Regarding compliance with article 14 of the Convention. Applicability of article 14 of the Convention. In such circumstances, the Court held that the spouse's loss pension affected the way in which the applicant organized and structured his family life.

 

RESOLUTION

 

Article 14 of the Convention, considered in conjunction with article 8 of the Convention, is applicable to the case.

The substance of the complaint. The applicant was in a similar position, compared to any woman, with regard to the right to receive a pension in connection with the loss of a spouse. However, the Swiss authorities refused him this payment on the grounds that the applicant was a man (apparently, none of any other provisions of Swiss law was assessed as unfulfilled).

The Swiss authorities explained that the pension in connection with the loss of a spouse was based on the presumption that the husband financially supported his wife, especially when they had children. Although the European Court was ready to accept that the mentioned presumption was an "objective" justification, it did not consider such an excuse "justified". The European Court has previously noted that only very good reasons could make it consider a difference in attitude based solely on the gender of the persons concerned to be in accordance with the Convention. This rule was applied regardless of whether the alleged discrimination affected women or, as in this case, men.

Indeed, it could not be excluded that the establishment of a pension in connection with the loss of a spouse for women, without a corresponding pension for men who lost their wife, could be justified by the role and status of a woman in society at the time of the adoption of the relevant law in 1948. However, references to traditions, general assumptions or prevailing social relations in a particular country today are not enough to justify a discrepancy in the treatment of people because of their gender.

As regards the present case, the Court was unable to establish how the termination of the payment of the applicant's pension would have affected him to a lesser extent than a woman in a similar situation. In particular, it is difficult to understand why the applicant would presumably have faced less difficulties in returning to work at the age of 57 than a woman, given that the applicant had not had a paid job for 16 years.

Consequently, there were no "extremely compelling circumstances" justifying the difference in the treatment of people in the present case. The European Court stressed that this conclusion should not be interpreted as a call for the abolition or reduction of the amount of the corresponding pension for women in order to eliminate the revealed inequality in relation to different recipients of the pension.

 

RESOLUTION

 

The case involved a violation of the requirements of article 14 of the Convention, considered in conjunction with article 8 of the Convention (adopted unanimously).

 

COMPENSATION

 

In the application of article 41 of the Convention. The European Court awarded the applicant 5,000 euros in compensation for non-pecuniary damage, the claim for compensation for material damage was rejected, since it is possible to obtain consideration of this issue by the Swiss state authorities.

По делу успешно рассмотрена жалоба на отказ в удовлетворении иска о компенсации ущерба, поданного авторами публичного доклада против члена Парламента Турции за предположительно оскорбительные высказывания. По делу было допущено нарушение требований статьи 10 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

В 2004 году Консультативный совет по правам человека Турции публично огласил доклад о правах меньшинств и культурных правах, подготовленный заявителями. В ответ на этот доклад член Парламента Турции выступил с речью, которая, как утверждали заявители, была для них оскорбительной. Заявители безуспешно пытались добиться компенсации через гражданские суды Турции. Кроме того, в отношении заявителей было возбуждено уголовное дело.

 

В докладе в общих чертах говорилось о пользе перехода от гомогенной единокультурной нации к нации с более многокультурной, демократической, либеральной и плюралистической концепции общества, изображенной как модель современных европейских демократических обществ.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения статьи 8 Конвенции (право на частную жизнь). Обжалуемая речь, которая была озвучена в Меджлисе Турции (Национальном собрании Турции), касалась вопросов, представлявших общественный интерес, и текущей ситуации в стране. Ставя под сомнение добросовестность и непредвзятость заявителей, автор речи описал их как личностей, которые бесчувственно относятся к базовым ценностям государства и турецкой нации, обвинив заявителей в получении инструкций и денежных средств от западных государств. По мнению Европейского Суда, рассматриваемая речь являлась оценочным суждением. Хотя использованные в ней замечания были провокационными, полемичными и в некоторой степени оскорбительными по стилю и содержанию, они в целом не могли считаться как не имеющие достаточного фактического обоснования или как явно оскорбительные. В заключение, суды Турции установили надлежащий баланс при сопоставлении конкурирующих по делу интересов.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу не было допущено нарушения требований статьи 8 Конвенции (принято единогласно).

 

По поводу соблюдения статьи 10 Конвенции. На основании содержания подготовленного ими доклада заявители подверглись уголовному преследованию в соответствии с положениями Уголовного кодекса Турции по обвинению в "подстрекательстве к ненависти" и "в разрушении органов государственной власти".

 

Вмешательство. Действительно, заявители были признаны невиновными по первому пункту обвинения, а производство по второму пункту было прекращено, поскольку Министерство юстиции отказало в выдаче необходимой санкции на уголовное преследование. Более того, на этапе предварительного следствия прокурор вызывал заявителей только для дачи показаний. Заявителей ни разу не заключали под стражу и не применяли к ним иных мер пресечения.

 

Тем не менее производство по делу заявителей продолжалось значительный период времени (три года и четыре месяца) в дополнение к девяти месяцам предварительного следствия. В течение этого периода страх осуждения по уголовному обвинению неизбежно приводил к самоограничениям для заявителей. Таким образом, уголовное дело само по себе не только представляло гипотетическую опасность для заявителей, но и оказало незамедлительное демотивирующее воздействие на них и являлось эффективным средством сдерживания. Снятие одного обвинения и прекращение производства по другому, хотя и исключали риск осуждения заявителей, не умаляли тот факт, что производство по уголовному делу значительный период удерживало заявителей от публичных выступлений.

 

Необходимость в демократическом обществе. Составленный и опубликованный заявителями доклад критиковал политику, ранее проводимую властями Турции в соответствующих областях, и содержал предложения по улучшению положения меньшинств в стране. Суды Турции возбудили дело против заявителей на основании того, что данный доклад подрывал фундаментальные основы Турецкой Республики и вызывал негодование у общественности.

 

Однако суды Турции не провели надлежащего анализа содержания доклада или контекста его подготовки, а именно публичного спора по вопросам, представлявшим общественный интерес, в свете критериев, установленных и применяемых Европейским Судом по делам о свободе выражения мнения. Следовательно, возбуждение и рассмотрение в течение длительного времени уголовного дела против заявителей по серьезным обвинениям не отвечали настоятельной общественной необходимости и в любом случае не были пропорциональны преследуемой законной цели.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил каждому из заявителей по 2 000 евро в качестве компенсации морального вреда.

Başvuranların iyi niyetini ve yargısızlığını sorgulayan konuşma yazarı, onları devletin ve Türk milletinin temel değerlerine duyarsız davranan kişilikler olarak tanımladı ve başvuru sahiplerini Batı devletlerinden talimat ve para almakla suçladı. Avrupa Mahkemesine göre, söz konusu konuşma değer yargısıydı. Kullanılan sözler kışkırtıcı, polemik ve stil ve içerikte bir dereceye kadar saldırgan olsa da, genel olarak yeterli gerçek gerekçeye sahip olmadığı veya açıkça saldırgan olduğu düşünülmemiştir. Sonuç olarak, Türkiye Mahkemeleri davada rakip çıkarların eşleştirilmesinde uygun bir denge kurmuştur.

 

 

 

KARAR

 

 

 

Davada, Sözleşmenin 8. maddesinin (oybirliğiyle kabul edilen) ihlal edilmesine izin verilmedi.

 

Sözleşmenin 10. maddesine uymakla ilgili. Hazırladıkları raporun içeriğine dayanarak, başvuranlar "nefreti kışkırtmak" ve "kamu otoritelerinin tahrip edilmesi"suçlamasıyla Türkiye Ceza Kanunu hükümlerine uygun olarak cezai kovuşturmaya tabi tutuldu.

 

Müdahale. Gerçekten de, başvuranlar suçlamanın ilk noktasında masum bulundu ve Adalet Bakanlığı cezai kovuşturma için gerekli cezayı vermeyi reddettiği için ikinci nokta üzerindeki üretim durduruldu. Ayrıca, ön soruşturma aşamasında, savcı sadece ifade vermek için başvuranları çağırdı. Başvuranlar gözaltına alınmadı ve onlara başka önleyici tedbirler uygulanmadı.

 

Bununla birlikte, başvuru sahiplerinin davasında üretim, dokuz aylık ön soruşturmaya ek olarak önemli bir süre (üç yıl ve dört ay) sürdü. Bununla birlikte, Türkiye Mahkemeleri, Avrupa ifade özgürlüğü Mahkemesi tarafından belirlenen ve uygulanan kriterler ışığında, raporun içeriğinin veya hazırlığının bağlamının, yani kamu yararı konularındaki kamu anlaşmazlığının doğru bir analizini yapmamıştır. The decision of the ECHR of October 20, 2020 in the case "Kaboglu and Oran v. Turkey (N 2) (Kaboglu and Oran v. Turkey (N 2))" (aplication N 36944/07).

 

In 2007, the applicants were assisted in preparing the aplication. Subsequently, the aplication was communicated to Turkey.

 

In the case, an aplication was successfully considered against the refusal to satisfy a claim for compensation for damage filed by the authors of a public report against a member of the Turkish Parliament for allegedly offensive statements. The case involved a violation of the requirements of article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

THE CIRCUMSTANCES OF THE CASE

 

 

 

In 2004, the Turkish Human Rights Advisory Council publicly announced a report on minority rights and cultural rights prepared by the applicants. In response to this report, a member of the Turkish Parliament made a speech that, according to the applicants, was offensive to them. The applicants unsuccessfully tried to obtain compensation through the civil courts of Turkey. In addition, a criminal case was initiated against the applicants.

 

The report outlined the benefits of the transition from a homogeneous, one-cultural nation to a nation with a more multicultural, democratic, liberal and pluralistic concept of society, depicted as a model of modern European democratic societies.

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with article 8 of the Convention (right to privacy). The appealed speech, which was voiced in the Mejlis of Turkey (the National Assembly of Turkey), concerned issues of public interest and the current situation in the country. Questioning the integrity and impartiality of the applicants, the author of the speech described them as individuals who are insensitive to the basic values of the state and the Turkish nation, accusing the applicants of receiving instructions and funds from Western states. In the opinion of the European Court, the speech in question was a value judgment. Although the remarks used in it were provocative, polemical and to some extent offensive in style and content, they generally could not be considered as not having sufficient factual justification or as clearly offensive. In conclusion, the Turkish courts have established an appropriate balance when comparing competing interests in the case.

 

 

 

RESOLUTION

 

 

 

There was no violation of the requirements of article 8 of the Convention in the case (adopted unanimously).

 

Regarding compliance with article 10 of the Convention. Based on the content of the report prepared by them, the applicants were prosecuted under the provisions of the Turkish Criminal Code on charges of "incitement to hatred" and "destruction of State authorities".

 

Intervention. Indeed, the applicants were found not guilty on the first count of the charge, and the proceedings on the second count were discontinued because the Ministry of Justice refused to issue the necessary sanction for criminal prosecution. Moreover, at the stage of the preliminary investigation, the prosecutor called the applicants only to give evidence. The applicants were never taken into custody and no other preventive measures were applied to them.

 

Nevertheless, the applicants ' proceedings continued for a considerable period of time (three years and four months) in addition to the nine months of the preliminary investigation. During this period, the fear of being convicted on criminal charges inevitably led to self-restrictions for the applicants. Thus, the criminal case itself not only posed a hypothetical danger to the applicants, but also had an immediate demotivating effect on them and was an effective deterrent. The withdrawal of one charge and the termination of the proceedings on the other, although they excluded the risk of conviction of the applicants, did not detract from the fact that the criminal proceedings kept the applicants from public speaking for a significant period.

 

The need for a democratic society. The report compiled and published by the applicants criticized the policies previously implemented by the Turkish authorities in the relevant areas and contained proposals to improve the situation of minorities in the country. The Turkish courts initiated proceedings against the applicants on the grounds that this report undermined the fundamental foundations of the Turkish Republic and caused public indignation.

 

However, the Turkish courts did not properly analyze the content of the report or the context of its preparation, namely, a public dispute on issues of public interest, in the light of the criteria established and applied by the European Court of Freedom of Expression. Consequently, the initiation and consideration for a long time of criminal proceedings against the applicants on serious charges did not meet the urgent public need and in any case were not proportional to the legitimate goal pursued.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of article 10 of the Convention (adopted unanimously).

 

 

 

COMPENSATION

 

 

 

In the application of article 41 of the Convention. The European Court awarded each of the applicants 2,000 euros in compensation for non-pecuniary damage.

Постановление ЕСПЧ от 20 октября 2020 года по делу "Камелия Богдан против Румынии (Camelia Bogdan v. Romania)" (жалоба N 36889/18).

 

В 2018 году заявительнице была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Румынии.

 

По делу успешно рассмотрена жалоба на отсутствие у заявительницы возможности обжаловать автоматическое отстранение ее от служебных обязанностей судьи с приостановлением выплаты заработной платы до завершения рассмотрения ее жалобы на исключение из судейского магистрата. По делу допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявительница является профессиональной судьей. В феврале 2017 года Высший совет магистратуры применил к заявительнице дисциплинарное взыскание в виде исключения из судейского магистрата. В марте 2017 года заявительница обжаловала указанное решение. Высший совет магистратуры незамедлительно постановил отстранить заявительницу от выполнения ее служебных обязанностей (что означало прекращение выплаты заработной платы), и это постановление незамедлительно вступило в силу.

 

В декабре 2017 года Высокий кассационный суд правосудия Румынии частично удовлетворил жалобу заявительницы, постановив перевести ее на другую должность, а не исключить из магистрата. В июне 2018 года заявительница получила заработную плату за все время отстранения от работы.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения пункта 1 статьи 6 Конвенции. (i) Применимость статьи 6 Конвенции. Отстранение от выполнения обязанностей судьи, который подает жалобу на дисциплинарное решение об исключении его или ее из магистрата, относится к мерам, предусмотренным законодательством Румынии (пункт 2 статьи 651 Закона N 303/2004). Эта мера является временной и начинает действовать ex lege с даты осуществления права на обжалование и до завершения судебного разбирательства.

 

Ссылаясь на критерий, выработанный в деле "Вильхо Эскелинен и другие против Финляндии" (Vilho Eskelinen and Others v. Finland) (Постановление Большой Палаты Европейского Суда от 19 апреля 2007 г., жалоба N 63235/00), который применим ко всем спорам, касающимся судей (см. Постановление Европейского Суда по делу "Бака против Венгрии" (Baka v. Hungary) от 23 июня 2016 г., жалоба N 20261/12 (См.: Прецеденты Европейского Суда по правам человека. Специальный выпуск. 2017. N 10)), и отмечая, что рассматриваемая временная мера была принята в контексте основного дисциплинарного разбирательства (см. Постановление Большой Палаты Европейского Суда по делу "Микаллеф против Мальты" (Micallef v. Malta) от 15 октября 2009 г., жалоба N 17056/06 (См.: Прецеденты Европейского Суда по правам человека. Специальный выпуск. 2017. N 10)), Европейский Суд решил, что к отстранению заявительницы от должностных обязанностей в настоящем деле также применимы гарантии статьи 6 Конвенции.

 

(ii) Существо жалобы. Согласно законодательству Румынии, действовавшему в период, относившийся к обстоятельствам дела, которое впоследствии было изменено, очевидно, что отсутствовало доступное для заявительницы средство правовой защиты применительно к обжалованию факта ее отстранения от исполнения должностных обязанностей.

 

Предполагаемое наличие в Румынии судебно-прецедентной практики, которая позволила бы заявительнице тем не менее добиться эффективного рассмотрения судами Румынии примененной к ней меры, не подтверждалось каким-либо из примеров из уже рассмотренных дел, который бы привели власти Румынии.

 

Наоборот, в одном из первых примеров из судебной практики, на которую сослалась заявительница, Высокий кассационный суд правосудия Румынии ограничился только рассмотрением вопроса законности без изучения аспекта, касающегося необходимости или пропорциональности отстранения судьи от должности.

 

Следовательно, ни законодательство Румынии, ни внутригосударственная судебная практика в соответствующий период не содержали правила о том, чтобы применение такой меры, как в настоящем деле, исследовалось бы судом. Более того, тот факт, что решения об отстранении от должностных обязанностей, принятые по ходатайству судебных инспекторов, не были рассмотрены судами Румынии, был подтвержден и подвергнут критике Конституционным судом Румынии.

 

С учетом вышеизложенного можно сделать вывод о том, что заявительница была лишена доступа к суду (обычному или иному) вследствие отстранения ее от исполнения должностных обязанностей Высшим советом магистратуры, что на протяжении примерно девяти месяцев препятствовало ей выполнять свои обязанности судьи и получать заработную плату.

 

Власти Румынии не представили какого-либо убедительного объяснения отсутствию судебной защиты. Одно только то обстоятельство, что отстранение заявительницы от исполнения должностных обязанностей было обусловлено осуществлением ее права на подачу жалобы, не может являться для этого достаточным оправданием.

 

Таким образом, была нарушена сама суть права заявительницы на доступ к суду.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований пункта 1 статьи 6 Конвенции (принято единогласно).

 

 

 

КОМПЕНСАЦИЯ

 

 

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявительнице 6 000 евро в качестве компенсации морального вреда, требование о компенсации материального ущерба было отклонено.

Decizia CEDO din 20 octombrie 2020 în cauza "Camelia Bogdan c. România" (sesizarea nr. 36889/18).

 

În 2018, solicitantul a fost asistat în pregătirea plângerii. Ulterior, plângerea a fost comunicată României.

 

În acest caz, a fost examinată cu succes o plângere cu privire la lipsa de oportunitate a reclamantei de a face apel împotriva eliminării sale automate din funcțiile oficiale ale unui judecător, cu suspendarea plății salariului până la finalizarea examinării plângerii sale privind excluderea din magistratul judiciar. Cazul a implicat o încălcare a cerințelor articolului 6 alineatul (1) din Convenția pentru Apărarea Drepturilor Omului și a Libertăților Fundamentale.

 

 

 

CIRCUMSTANȚELE CAZULUI

 

 

 

Solicitantul este judecător profesionist. În februarie 2017, Consiliul Suprem al Magistraturii a aplicat reclamantului o sancțiune disciplinară sub forma unei excepții de la magistratul judiciar. În martie 2017, reclamantul a făcut apel împotriva acestei decizii. Consiliul Suprem al Magistraturii a decis imediat suspendarea reclamantei de la îndeplinirea atribuțiilor sale oficiale (ceea ce însemna încetarea plății salariilor), iar această decizie a intrat imediat în vigoare.

 

În decembrie 2017, Înalta Curte de Casație și Justiție a admis parțial plângerea reclamantei, hotărând să o transfere într-o altă funcție, în loc să o excludă din magistratură. În iunie 2018, solicitantul a primit un salariu pentru întreaga perioadă de suspendare de la locul de muncă.

 

 

 

ASPECTE JURIDICE

 

 

 

În ceea ce privește respectarea articolului 6 alineatul (1) din Convenție. (i) aplicabilitatea Art.6 din Convenție. Suspendarea din funcția de judecător care depune o plângere împotriva unui disciplinare decizia de a-l exclude sau a ei de magistrat se referă la măsurile prevăzute de legea română (art. 651, alin. 2, din Legea Nr. 303/2004). Această măsură este temporară și produce efecte ex lege de la data exercitării dreptului de a face apel până la sfârșitul procesului.

 

Referindu-se la criteriul dezvoltat în cazul "Vilho Eskelinen și Alții c. Finlandei" (Hotărârea pronunțată de Marea Cameră a Curții Europene de Justiție din aprilie 19, 2007, plângerea Nr 63235/00), care se aplică pentru toate litigiile referitoare la judecători (a se vedea Hotărârea Curții Europene în cazul "Baka v. Ungaria" din 23 iunie 2016, plângerea Nr 20261/12 (a se Vedea: Precedente ale Curții Europene a Drepturilor Omului. Problemă specială. 2017. N 10)) și constatând că măsura provizorie în cauză a fost luată în contextul procedurii disciplinare principale (a se vedea alin. Decizia marii camere a Curții Europene de Justiție în cazul "Micallef v. Malta" (Micallef v. Malta) din octombrie 15, 2009, plângerea Nr 17056/06 (a se Vedea: Precedente ale Curții Europene a Drepturilor Omului. Problemă specială. 2017. N 10)), Curtea Europeană a decis că garanțiile prevăzute la articolul 6 din Convenție se aplică și eliminării reclamantului din funcțiile oficiale în speță.

 

(ii) fondul plângerii. În conformitate cu legislația română în vigoare în perioada referitoare la circumstanțele cauzei, care a fost modificată ulterior, este evident că nu a existat nicio cale de atac la dispoziția reclamantei în legătură cu contestarea faptului suspendării acesteia din exercitarea atribuțiilor de serviciu.

 

Pretinsa existență a jurisprudenței judiciare în România, care i-ar permite totuși reclamantei să realizeze o analiză efectivă de către instanțele române a măsurii care i-a fost aplicată, nu a fost confirmată de niciunul dintre exemplele din cauzele deja examinate, pe care autoritățile române le-ar fi citat.

 

Dimpotrivă, într-unul din primele exemple din practica judiciară la care face referire reclamanta, Înalta Curte de Casație și Justiție a României s-a limitat doar la examinarea problemei legalității, fără a examina aspectul privind necesitatea sau proporționalitatea revocării unui judecător din funcție.

 

În consecință, nici legislația română, nici practica judiciară internă din perioada relevantă nu conțineau o regulă conform căreia aplicarea unei astfel de măsuri, ca în cazul de față, ar fi investigată de instanță. Mai mult, faptul că deciziile de revocare din funcție luate la cererea inspectorilor judiciari nu au fost luate în considerare de instanțele judecătorești din România a fost confirmat și criticat de Curtea Constituțională a României.

 

Având în vedere cele de mai sus, se poate concluziona că reclamanta a fost lipsită de acces la instanță (obișnuită sau de altă natură) ca urmare a suspendării sale din funcțiile sale oficiale de către Consiliul Suprem al Magistraturii, care timp de aproximativ nouă luni a împiedicat-o să-și îndeplinească îndatoririle de judecător și să primească salarii.

 

Autoritățile române nu au oferit nicio explicație convingătoare pentru lipsa protecției judiciare. Simplul fapt că eliminarea reclamantei din exercitarea atribuțiilor sale oficiale s-a datorat exercitării dreptului său de a depune o plângere nu poate constitui o justificare suficientă în acest sens.

 

Astfel, însăși esența dreptului reclamantului de a avea acces la instanță a fost încălcată.

 

 

 

Rezoluție

 

 

 

Cazul a implicat o încălcare a cerințelor articolului 6 alineatul (1) din Convenție (adoptat în unanimitate).

 

 

 

Compensații

 

 

 

În aplicarea articolului 41 din Convenție. Curtea Europeană i-a acordat reclamantei 6 000 EUR drept despăgubire pentru daune morale, cererea de despăgubire pentru daune materiale a fost respinsă.

THE CIRCUMSTANCES OF THE CASE

 

 

 

The applicant is a professional judge. In February 2017, the Supreme Council of the Magistracy applied a disciplinary penalty to the applicant in the form of an exception from the judicial magistrate. In March 2017, the applicant appealed against this decision. The Supreme Council of the Magistracy immediately decided to suspend the applicant from performing her official duties (which meant the termination of payment of wages), and this decision immediately entered into force.

 

In December 2017, the High Court of Cassation of Justice of Romania partially satisfied the applicant's complaint, deciding to transfer her to another position, rather than exclude her from the magistrate. In June 2018, the applicant received a salary for the entire period of suspension from work.

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with article 6, paragraph 1, of the Convention. (i) Applicability of article 6 of the Convention. The suspension from the duties of a judge who files a complaint against a disciplinary decision to exclude him or her from the magistrate refers to the measures provided for by Romanian law (paragraph 2 of article 651 of Law No. 303/2004). This measure is temporary and takes effect ex lege from the date of exercise of the right to appeal until the end of the trial.

 

Referring to the criterion developed in the case "Vilho Eskelinen and Others v. Finland" (Judgment of the Grand Chamber of the European Court of Justice of April 19, 2007, complaint No. 63235/00), which is applicable to all disputes concerning judges (see the Judgment of the European Court in the case "Baka v. Hungary" of June 23, 2016, complaint No. 20261/12 (See: Precedents of the European Court of Human Rights. Special issue. 2017. N 10)), and noting that the interim measure in question was taken in the context of the main disciplinary proceedings (see The decision of the Grand Chamber of the European Court of Justice in the case "Micallef v. Malta" (Micallef v. Malta) of October 15, 2009, complaint No. 17056/06 (See: Precedents of the European Court of Human Rights. Special Issue. 2017. N 10)), the European Court decided that the guarantees of Article 6 of the Convention also apply to the applicant's removal from official duties in the present case.

 

(ii) The substance of the complaint. According to the Romanian legislation in force during the period relating to the circumstances of the case, which was subsequently changed, it is obvious that there was no legal remedy available to the applicant in relation to appealing the fact of her suspension from the performance of official duties.

 

The alleged existence of judicial case-law in Romania, which would nevertheless allow the applicant to achieve an effective consideration by the Romanian courts of the measure applied to her, was not confirmed by any of the examples from the already considered cases that the Romanian authorities would have cited.

 

On the contrary, in one of the first examples from the judicial practice referred to by the applicant, the High Court of Cassation of Justice of Romania limited itself only to considering the issue of legality without examining the aspect concerning the necessity or proportionality of the removal of a judge from office.

 

Consequently, neither the Romanian legislation nor the domestic judicial practice in the relevant period contained a rule that the application of such a measure, as in the present case, would be investigated by the court. Moreover, the fact that decisions on dismissal from official duties taken at the request of judicial inspectors were not considered by the Romanian courts was confirmed and criticized by the Constitutional Court of Romania.

 

In view of the above, it can be concluded that the applicant was deprived of access to the court (ordinary or otherwise) as a result of her suspension from her official duties by the Supreme Council of the Magistracy, which for about nine months prevented her from performing her duties as a judge and receiving wages.

 

The Romanian authorities did not provide any convincing explanation for the lack of judicial protection. The mere fact that the applicant's removal from the performance of her official duties was due to the exercise of her right to file a complaint cannot be a sufficient justification for this.

 

Thus, the very essence of the applicant's right to access to the court was violated.
