Постановление ЕСПЧ от 22 декабря 2020 года по делу "Селахаттин Демирташ против Турции (N 2) (Selahattin Demirtas v. Turkey) (N 2)" (жалоба N 14305/17).

В 2017 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Турции.

По делу успешно рассмотрена жалоба на непредвидимое аннулирование парламентской неприкосновенности и заключение лица под стражу по обвинению в терроризме за политические высказывания. По делу было допущено нарушение требований пунктов 1 и 3 статьи 5, статьи 10, статьи 18 (во взаимосвязи с пунктом 3 статьи 5) Конвенции о защите прав человека и основных свобод, статьи 3 Протокола N 1 к Конвенции о защите прав человека и основных свобод. По делу не допущено нарушение требований пункта 4 статьи 5 Конвенции о защите прав человека и основных свобод.

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

Заявитель являлся избранным членом Великого национального собрания Турции (далее также - Парламент Турции) и одним из сопредседателей Народно-демократической партии Турции, левой прокурдской политической партии. 20 мая 2016 г. в Конституцию Турции была внесена поправка, согласно которой парламентская неприкосновенность снималась с членов парламента Турции во всех случаях, когда запрос о снятии передавался в Великое национальное собрание Турции до даты принятия упомянутой поправки. Эта реформа, поддерживаемая Президентом Турции, была обусловлена столкновениями в Сирии между группировкой ИГИЛ (В соответствии с Решением Верховного Суда Российской Федерации от 29 декабря 2014 г. N АКПИ14-1424С организация запрещена в Российской Федерации) и силами организации, имеющей связи с РПК (PKK), серьезными актами насилия в Турции в 2014 и 2015 годах, накануне начала переговоров, направленных на разрешение "курдского вопроса". Заявитель, который в своих выступлениях и утверждениях высказывал активную позицию по отношению к упомянутым событиям, являлся одним из 154 парламентариев (включая 55 членов Народно-демократической партии Турции), которые пострадали от внесения рассматриваемой поправки в Конституцию Турции. В ноябре 2016 года заявитель был задержан по подозрению в членстве в вооруженной террористической организации и подстрекательстве к совершению уголовных преступлений. После проведения дополнительного расследования по факту упомянутых актов насилия в Турции заявитель оставался под стражей. Его парламентский мандат истек 24 июня 2018 г.

В Постановлении от 20 ноября 2018 г. Палата Европейского Суда решила, в частности, что имели место нарушения пункта 3 статьи 5 Конвенции и статьи 18 (рассмотренной во взаимосвязи с пунктом 3 статьи 5) Конвенции и нарушение статьи 3 Протокола N 1 к Конвенции. Палата Европейского Суда установила, что не было допущено нарушения пунктов 1 и 4 статьи 5 Конвенции, и не сочла необходимым рассматривать жалобу на нарушение статьи 10 Конвенции. По ходатайству обеих сторон жалоба была передана в Большую Палату Европейского Суда.

 

ВОПРОСЫ ПРАВА

 

(a) Предварительное возражение, заявленное на основании подпункта "b" пункта 2 статьи 35 Конвенции. Европейский Суд был вынужден в первый раз с момента вынесения Комиссией по правам человека Решения по делу "Луканов против Болгарии" (Lukanov v. Bulgaria) (от 12 января 1995 г., жалоба N 21915/93) рассмотреть вопрос о том, может ли жалоба в Комитет по правам человека парламентариев Межпарламентского союза (далее - Комитет) рассматриваться как "другая процедура международного расследования или урегулирования". Этот термин обозначает учреждения и процедуры, созданные государствами, исключая, таким образом, неправительственные организации. Однако даже если конкретный механизм не был создан неправительственной организацией, это автоматически не значит, что он мог считаться "другой процедурой". В этом контексте основной целью анализа Европейского Суда было определить, можно ли к разбирательству с помощью упомянутого механизма относиться с учетом процессуальных аспектов и потенциальных эффектов, как к праву на подачу индивидуальной жалобы согласно статье 34 Конвенции, и отвечает ли этот механизм нижеследующим критериям. Соответствующий механизм должен быть публичным, международным и судебным или квазисудебным. Последний критерий с необходимостью подразумевает, что проводимое в рамках такого механизма рассмотрение имеет четко установленные рамки и ограничено определенными правами и стандартами, основанными на правовом инструменте или "структуре", с помощью которого государства уполномочивают использующий механизм орган рассматривать поданные против государств жалобы и выносить по ним решения. Это особенно важно в контексте анализа сходства между таким механизмом и анализом Европейского Суда. В отсутствие правового инструмента, который надлежащим образом определяет границы полномочий соответствующего органа, Европейскому Суду будет сложнее установить характер и функции указанного органа и обязательства государств-членов. Рассматриваемый механизм также должен предоставлять институциональные и процессуальные гарантии, такие как гарантии независимости и беспристрастности в соответствии со статьей 6 Конвенции, а также обеспечивать состязательный процесс, предоставляющий каждой стороне спора возможность получать информацию о процессе и отвечать на доводы противоположной стороны. Стороны по делу также должны быть уведомлены о принятых мерах и вынесенных решениях. Уполномоченный орган должен уважать право сторон участвовать в процессе, например, посредством представления замечаний по делу. Кроме того, этот орган должен реагировать на индивидуальные жалобы путем опубликования своих решений и изложения их обоснований. Данный орган власти также должен иметь возможность устанавливать ответственность государства согласно правовому инструменту, на основании которого соответствующий орган осуществляет рассмотрение дела, и предоставлять юридическое возмещение, способное пресечь обжалуемое нарушение.

В функции Комитета не входило рассмотрение споров между физическим лицом и государством. В соответствии со своим уставом и процессуальными нормами Комитет не должен был рассматривать соблюдение государством своих обязательств в соответствии с особым правовым инструментом, а скорее, предотвращать возможные нарушения, пресекать уже установленные нарушения и/или способствовать действиям государства по предоставлению эффективного возмещения за нарушения путем обеспечения диалога с властями. В связи с этим нельзя считать, что Комитет осуществлял бы судебную или квазисудебную процедуру, аналогичную той, что предусмотрена Конвенцией.

 

ПОСТАНОВЛЕНИЕ

 

Предварительное возражение властей Турции, заявленное на основании подпункта "b" пункта 2 статьи 35 Конвенции, было отклонено.

(b) По поводу соблюдения статьи 10 Конвенции. Имело место вмешательство в право заявителя на свободу выражения мнения вследствие применения совокупности мер, а именно отмены парламентской неприкосновенности заявителя, заключения заявителя под стражу и продления срока его содержания под стражей, возбуждения уголовного дела против него на основании доказательств, включавших его политические выступления. Вмешательство также было основано на законе, который был доступен, а именно на поправке в Конституцию Турции и положениях Уголовного кодекса Турции, касавшихся преступлений, связанных с терроризмом. Вопрос заключался, в частности в том, было ли толкование и применение законодательства Турции предсказуемым в то время, когда заявитель выступал с высказываниями, ставшими основанием для предъявления ему обвинения.

(i) Парламентская неприкосновенность. Статья 83 Конституции Турции предусматривает два вида неприкосновенности для членов Парламента Турции: неподсудность и неприкосновенность. Неподсудность означает свободу выражения мнения членов Великого национального собрания Турции в том смысле, что они не могут быть подвергнуты судебному преследованию на основании своего голосования или мнений, высказанных в Великом национальном собрании Турции, или повторения или распространения этих мнений за пределами собрания, если только Великое национальное собрание Турции не решит иначе на заседании, созванном по предложению президиума Великого национального собрания Турции. Неподсудность является абсолютной, не допускающей исключений, не позволяющей осуществлять следственные действия, и она продолжает распространяться на членов Парламента Турции даже после того, как истек срок их полномочий. Повторение политических высказываний за пределами Парламента Турции не может толковаться как ограниченное только теми же словами, которые были использованы внутри Парламента Турции.

Обжалуемая конституционная поправка не изменила статью 83 Конституции Турции в той части, которая касалась неподсудности. Члены Парламента Турции, на которых распространялась поправка, продолжали пользоваться правовой защитой. В связи с этим задача властей Турции и, в частности внутригосударственных судов заключалась в определении того, распространялась ли парламентская неподсудность на политические высказывания заявителя. Заявитель придерживался именно такой позиции с самого начала следствия по его делу. Однако Европейский Суд поражен недостаточным рассмотрением соответствующих доводов заявителя судами Турции всех инстанций.

Даже если предположить, что на рассматриваемые политические высказывания заявителя не распространялась концепция неподсудности, конституционная поправка сама по себе затрагивала вопрос о предсказуемости правовых норм. Парламентская неприкосновенность защищала выбранных членов Парламента Турции от какого-либо задержания, заключения под стражу или предъявления обвинения в течение исполнения ими своих полномочий, без согласия Парламента Турции. Однако после внесения поправки политические высказывания членов Парламента Турции стали наказуемыми согласно уголовному праву Турции в отсутствие гарантий против обращений о снятии парламентской неприкосновенности, предоставленных статьями 83 и 85 Конституции Турции. В частности, Парламент Турции более не был обязан оценивать индивидуальную ситуацию каждого затронутого этим вопросом члена парламента. Хотя Парламент Турции сохранил режим парламентской неприкосновенности, он в то же время сделал его неприменимым к определенным членам парламента на основании текста, составленного в общих и неопределенных формулировках. В связи с этим Европейский Суд полностью согласился с однозначным выводом Венецианской комиссии о том, что эта разовая беспрецедентная ad homines поправка была направлена явно на конкретные высказывания членов Парламента Турции, особенно тех, которые принадлежали к оппозиции, и, таким образом, она являлась "злоупотреблением процедурой внесения поправок в Конституцию".

Член Парламента Турции не мог обоснованно ожидать, что данная процедура будет введена в период исполнения им своих полномочий, нарушая, таким образом, право членов Парламента Турции на свободу выражения мнения. Принимая во внимание формулировку статьи 83 Конституции Турции и ее толкование или его отсутствие судами Турции, вмешательство не было предсказуемым.

(ii) Преступления, связанные с терроризмом. Заявитель был заключен под стражу, а срок его содержания под стражей продлевался на основании высказываний заявителя за преступления, связанные с терроризмом, в частности за формирование или руководство вооруженной террористической организацией и членство в такой организации (статья 314 Уголовного кодекса Турции). Европейский Суд принял во внимание трудности, связанные с предотвращением терроризма и принятием антитеррористических законов. Государства-члены неизбежно прибегали к общим формулировкам, применение которых зависело от их практического толкования судебными властями. Толкуя законодательство в этом контексте, суды государства-ответчика должны были предоставлять физическим лицам надлежащую защиту от произвольного вмешательства.

Уголовный кодекс Турции не определял элементы состава преступления, которые были изложены в прецедентной практике Кассационного суда Турции. В настоящем деле суды Турции приняли широкое толкование рассматриваемых преступлений. Политические высказывания, в которых заявитель выразил свое несогласие с определенной политикой правительства или просто упомянул о том, что он являлся членом организации "Конгресс демократического общества" - законной организации, - являлись достаточными для того, чтобы представлять собой действия, способные установить активную связь между заявителем и вооруженной организацией. Суды Турции не приняли во внимание установленные Кассационным судом Турции требования, включая "длительность, разнообразие и интенсивность" действий заявителя или вопрос о том, совершил ли заявитель преступления в рамках иерархической структуры рассматриваемой террористической организации. Разнообразие действий, которые могли оправдать содержание заявителя под стражей в связи с рассматриваемыми тяжкими преступлениями, было таким большим, что состав преступлений, наказуемых согласно статье 314 Уголовного кодекса Турции, взятый в совокупности с толкованием, принятым судами Турции, не обеспечивал надлежащую защиту от произвольного вмешательства со стороны властей Турции. Подобное широкое толкование не могло быть оправдано, если оно влекло за собой приравнивание использования права на свободу выражения мнения к участию в вооруженной террористической организации, к ее созданию или руководству, в отсутствие каких-либо конкретных доказательств такой связи.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 10 Конвенции (принято 16 голосами "за" при одном - "против").

(c) По поводу соблюдения статьи 3 Протокола N 1 к Конвенции. (i) Общие принципы. Право на свободные выборы не ограничивается возможностью участвовать в парламентских выборах. Заинтересованное лицо также имеет право, как только его выберут, заседать в качестве члена парламента. Для этой гарантии ключевое значение имеет правило о парламентском иммунитете. Европейский Суд должен был вновь рассмотреть жалобу на нарушение статьи 3 Протокола N 1 к Конвенции относительно последствий содержания выигравшего выборы члена парламента под стражей в рамках избранной меры пресечения для осуществления указанным лицом его должностных полномочий. Применение меры, лишающей члена парламента или кандидата в члены парламента свободы, автоматически не означает нарушение статьи 3 Протокола N 1 к Конвенции. Тем не менее с учетом значимости для демократического общества права члена парламента на свободу и неприкосновенность суды государства-ответчика должны продемонстрировать, используя предоставленную им свободу усмотрения, что при вынесении постановления о заключении лица под стражу и/или продлении срока содержания лица под стражей они взвесили все относящиеся к делу интересы, включая свободу выражения политических мнений членами соответствующего парламента. Важным элементом в процессе установления баланса упомянутых интересов является вопрос о том, имеют ли обвинения политическую основу. Должно существовать средство правовой защиты, с помощью которого член парламента может эффективно обжаловать примененную меру и добиться рассмотрения своих жалоб по существу. В этом случае задачей Европейского Суда является рассмотрение решений судов государства-ответчика с точки зрения Конвенции, не заменяя своими выводами решения соответствующих органов государственной власти.

(ii) Применение вышеизложенных принципов в настоящем деле. В результате предварительного содержания под стражей заявитель не мог исполнять свои полномочия в органе законодательной власти Турции на протяжении более чем полутора лет. Хотя место в Парламенте Турции за ним сохранилось и он мог направлять вопросы в письменном виде, заявитель не мог беспрепятственно пользоваться правами, предоставленными статьей 3 Протокола N 1 к Конвенции.

Взаимосвязь между статьей 10 Конвенции и статьей 3 Протокола N 1 к Конвенции особо очевидна в делах, когда избранный в ходе демократических выборов представитель власти содержится под стражей за высказывание своих политических мнений. Очень важно защищать свободу представителей общества выражать свое мнение, особенно если это относится к представителям оппозиции. Европейский Суд всегда будет проводить тщательную проверку, чтобы убедиться в том, что не было допущено вмешательства в право на свободу выражения мнения, в то же время помня о возможных ограничениях этой свободы, а именно для предотвращения прямых или скрытых призывов к насилию. С этой точки зрения Европейский Суд решил, что если заключение члена парламента под стражу нельзя считать соответствующим статье 10 Конвенции, как в настоящем деле, то это процессуальное действие также будет нарушать и статью 3 Протокола N 1 к Конвенции. Более того, вывод Европейского Суда о том, что не существовало обоснованных подозрений в том, что заявитель совершил преступление, как этого требует пункт 1 статьи 5 Конвенции (см. ниже), также был важен и для целей статьи 3 Протокола N 1 к Конвенции. В то время как длительность предварительно содержания лица под стражей должна быть, как правило, насколько возможно непродолжительной, эти рассуждения применяются a fortiori к содержанию под стражей членов парламента, которые представляют своих избирателей, привлекают внимание к потребностям этих людей и защищают их интересы.

Если государство предоставляет парламентский иммунитет от обвинения и лишения свободы, внутригосударственные суды должны прежде всего проверить, что члены соответствующего парламента не имеют парламентской неприкосновенности в отношении действий, в совершении которых их обвиняют. Однако, как представляется, в настоящем деле суды Турции не провели такой проверки, чем нарушили свою процессуальную обязанность, предусмотренную статьей 3 Протокола N 1 к Конвенции. Также не было продемонстрировано, что внутригосударственные суды предприняли бы действия, направленные на достижение требуемого баланса, взвешивая все конкурирующие в деле интересы. Конституционный суд Турции не рассмотрел вопрос о том, были ли преступления, в совершении которых обвинялся заявитель, прямо связаны с его политической деятельностью. Органы судебной власти Турции не приняли во внимание тот факт, что заявитель являлся не только членом Парламента Турции, но и одним из лидеров политической оппозиции, и исполнение им своих парламентских полномочий требовало более высокого уровня защиты. Кроме того, не было объяснено, почему в деле заявителя недостаточно было применить альтернативную меру пресечения. То обстоятельство, что у заявителя отсутствовала возможность принимать участие в работе Парламента Турции, пока он содержался под стражей, являлось необоснованным вмешательством в право на свободное выражение мнения и в право заявителя быть избранным в парламент Турции и участвовать в его заседаниях. Таким образом, содержание заявителя под стражей в рамках избранной меры ему пресечения не соответствовало самой сути права, гарантированного статьей 3 Протокола N 1 к Конвенции.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 3 Протокола N 1 к Конвенции (принято единогласно).

(d) По поводу соблюдения статьи 18 Конвенции во взаимосвязи со статьей 5 Конвенции. Европейский Суд должен был рассмотреть вопрос о том, действительно ли заключение заявителя под стражу в порядке предварительного заключения, в отсутствие обоснованного подозрения и в нарушение статьи 5 Конвенции, преследовало скрытую цель. Европейский Суд отметил следующие факторы: меры по снятию парламентского иммунитета были приняты только после выборов, в результате которых правящая партия утратила свои лидирующие позиции в Великом национальном собрании Турции, и единственными, кто действительно попал под действие рассматриваемой конституционной поправки, были члены оппозиционных партий. Заключение заявителя под стражу не было единственным примером, а наоборот, по-видимому, осуществлялось в рамках сложившейся схемы. Период заключения заявителя под стражу означал, что он был лишен свободы, в частности, во время двух ключевых политических кампаний (референдума по проведению конституционной реформы и президентских выборов). Европейский Суд также принял во внимание обстоятельства повторного заключения заявителя под стражу, когда в день его освобождения было вынесено соответствующее постановление в рамках другого уголовного дела, а также выводы других органов Совета Европы относительно независимости судебной системы Турции и напряженного политического климата, который создал условия, способные повлиять на решения судов Турции - особенно в период чрезвычайного положения, когда сотни судей были уволены, в частности применительно к уголовным делам против представителей оппозиции. Эти факторы позволили Европейскому Суду сделать вывод о том, что озвученные властями Турции цели заключения заявителя под стражу являлись только прикрытием для истинного мотива, а именно для подавления плюрализма и ограничения свободы политических дебатов.

 

ПОСТАНОВЛЕНИЕ

 

По делу было допущено нарушение требований статьи 18 Конвенции во взаимосвязи со статьей 5 Конвенции (принято 16 голосами "за" при одном - "против").

Европейский Суд также постановил (15 голосами "за" при двух - "против" и 16 голосами "за" при одном - "против" соответственно), что было допущено нарушение пунктов 1 и 3 статьи 5 Конвенции в связи с отсутствием обоснованного подозрения в том, что заявитель совершил уголовное преступление, делающее необходимым его заключение под стражу в порядке избранной ему меры пресечения и продления указанного срока содержания под стражей. Кроме того, Европейский Суд счел, что иск о компенсации на основании пунктов "a" и "d" части первой статьи 141 Уголовно-процессуального кодекса Турции не мог считаться эффективным средством правовой защиты ни применительно к предполагаемому отсутствию обоснованного подозрения о том, что лицо совершило преступление, ни применительно к предполагаемому отсутствию относящихся к делу и достаточных оснований для оправдания содержания лица под стражей в целях пунктов 1 и 3 статьи 5 Конвенции. Европейский Суд также установил 16 голосами "за" при одном - "против", что отсутствовало нарушение пункта 4 статьи 5 Конвенции относительно вопроса о соблюдении Конституционным судом Турции требования "безотлагательности" согласно рассуждениям Палаты Европейского Суда и в свете особых обстоятельств дела.

По поводу применения статьи 46 Конвенции. Европейский Суд предписал властям Турции принять все необходимые меры для обеспечения незамедлительного освобождения заявителя из-под стражи.

 

КОМПЕНСАЦИЯ

 

В порядке применения статьи 41 Конвенции. Европейский Суд присудил заявителю 3 500 и 25 000 евро в качестве компенсации материального ущерба и морального вреда соответственно.

2017 yılında başvuru sahibine şikayetin hazırlanmasında yardımcı oldu. Daha sonra şikayet Türkiye tarafından komünize edildi.

Davada, Parlamento dokunulmazlığının öngörülemeyen bir şekilde iptal edilmesi ve siyasi ifadeler için terörizm suçlamasıyla gözaltına alınan bir kişinin tutuklanması şikayeti başarıyla ele alındı. Davada, insan hakları ve temel özgürlüklerin Korunmasına İlişkin Sözleşmenin 1 ve 3 maddesi 5, 10 maddesi, 18 maddesi (3 maddesi 5 maddesi ile bağlantılı olarak), insan hakları ve temel özgürlüklerin Korunmasına İlişkin Sözleşmeye N 1 protokolünün 3 maddesi ihlal edildi. Davada, insan hakları ve temel özgürlükler Sözleşmesi'nin 4. maddesinin 5. maddesinin ihlal edilmesine izin verilmedi.

 

DAVANIN KOŞULLARI

 

Başvuran, Türkiye Büyük Millet Meclisi'nin (bundan sonra Türkiye Parlamentosu) seçilmiş üyesi ve sol Kürt yanlısı siyasi parti olan Türkiye Demokratik Halk Partisi'nin eş başkanlarından biriydi. 20 Mayıs 2016 tarihinde, Türkiye anayasasında, söz konusu değişikliğin kabul edildiği tarihten önce, çekilme talebinin Türkiye Büyük Millet Meclisi'ne devredildiği her durumda, parlamenter dokunulmazlığın Türkiye Parlamentosu üyelerinden kaldırıldığı bir değişiklik yapılmıştır. Türkiye Cumhurbaşkanı tarafından desteklenen bu reform, (Aralık 29 2014 N AKPI14-1424C Örgütü Rusya Federasyonu yasaklandı Rusya Federasyonu Yüksek Mahkemesi kararına göre) lıh grubu arasındaki Suriye'deki çatışmalar nedeniyle ve PKK (PKK), 2014 ve 2015 yıllarında Türkiye'de şiddet ciddi eylemleri ile bağlantıları olan örgütün güçleri, "Kürt sorunu"çözmek için görüşmelerin başlamasından arifesinde. Konuşmalarında ve ifadelerinde söz konusu olaylara karşı aktif bir tutum sergileyen başvuru sahibi, söz konusu Anayasa değişikliğinin yapılmasından etkilenen 154 parlamenterden (Türkiye Demokratik Halk Partisi'nin 55 üyesi dahil) biriydi. Kasım 2016'da başvuru sahibi, silahlı terör örgütüne üyelik ve cezai suç işlemeye teşvik şüphesiyle gözaltına alındı. Türkiye'de söz konusu şiddet eylemlerine ilişkin daha fazla soruşturma yapıldıktan sonra başvuru sahibi gözaltına alındı. Parlamenter görev süresi 24 Haziran 2018 tarihinde sona ermiştir.

20 Kasım 2018 tarihli kararda, Avrupa Adalet Divanı, özellikle Sözleşmenin 5.maddesinin 3. maddesinin ve Sözleşmenin 18. maddesinin (5. maddenin 3. maddesi ile bağlantılı olarak incelenen) ve Sözleşmenin 1. maddesinin 3. maddesinin ihlal edildiğine karar vermiştir. Avrupa Adalet Divanı, Sözleşmenin 1. ve 4. maddesinin 5. maddesinin ihlal edilmesine izin verilmediğini ve Sözleşmenin 10. maddesinin ihlali şikayetini dikkate almanın gerekli olmadığını tespit etmiştir. Her iki tarafın dilekçesinde, şikayet Avrupa Adalet Divanı'nın büyük odasına iletildi.

 

HUKUK SORULARI

 

(a) Sözleşmenin 35.maddesinin 2. maddesinin "b" alt paragrafına dayanarak belirtilen geçici itiraz. Avrupa Mahkemesi, İnsan Hakları Komisyonu'nun "Lukanov V. Bulgaristan" (Lukanov V. Bulgaristan) davasında (12 Ocak 1995, şikayet n 21915/93) karar vermesinden bu yana ilk kez, parlamentolar arası birliğin parlamenterleri (bundan sonra Komite) İnsan Hakları Komitesine yapılan şikayetin "uluslararası soruşturma veya çözüm için başka bir prosedür"olarak kabul edilip edilemeyeceğini dikkate almak zorunda kalmıştır. (b) Sözleşmenin 10. maddesine uymakla ilgili. İtiraz edilen Anayasa değişikliği, Türkiye Anayasasının 83. maddesini, yargılanmayan kısımlarda değiştirmedi. Değişikliğin uzatıldığı Türkiye Parlamentosu üyeleri, yasal korumadan yararlanmaya devam etti. Bu bağlamda, Türk makamlarının ve özellikle iç mahkemelerin görevi, parlamenter adaletsizliğin başvuranın siyasi ifadelerine yayılıp yayılmadığını belirlemekti. Yasayı bu bağlamda yorumlayarak, davalı devletin Mahkemeleri, bireylere keyfi müdahaleye karşı uygun koruma sağlamak zorunda kalmıştır.

Türkiye Ceza Kanunu, Türkiye Temyiz Mahkemesinin içtihat uygulamasında belirtilen suçun unsurlarını tanımlamamıştır. Bu davada, Türkiye Mahkemeleri söz konusu suçların geniş bir yorumunu kabul etti. Başvuranın belirli bir hükümet politikasına karşı muhalefetini ifade ettiği ya da sadece Demokratik Toplum Kongresi'nin (meşru bir örgüt) bir üyesi olduğunu belirttiği siyasi ifadeler, başvuru sahibi ile silahlı örgüt arasında aktif bir bağlantı kurabilecek eylemleri temsil etmek için yeterliydi. Türkiye Mahkemeleri, başvuranın eylemlerinin "süresi, çeşitliliği ve yoğunluğu" ya da başvuranın söz konusu terör örgütünün hiyerarşik yapısı içinde suç işlediği sorusu da dahil olmak üzere, Türkiye Yargıtayının belirlediği şartları dikkate almamıştır. Davacının ağır suçlarla bağlantılı olarak gözaltında tutulmasını haklı çıkarabilecek çeşitli eylemler o kadar büyüktü ki, Türk Mahkemeleri tarafından kabul edilen yorumlarla birlikte alınan Türkiye Ceza Kanununun 314. maddesi uyarınca cezalandırılan suçların bileşimi, Türk makamlarının keyfi müdahalesine karşı uygun koruma sağlamadı. Bu tür geniş bir yorum, ifade özgürlüğü hakkının silahlı bir terör örgütüne katılma, bu tür bir bağlantının somut kanıtlarının yokluğunda, kurulması veya yönlendirilmesi ile eşitlenmesini gerektiriyorsa haklı çıkamazdı.

Davada, Sözleşmenin 10. maddesinin gerekliliklerinin ihlali kabul edildi (bir "karşı" için 16 oyu kabul edildi).

(c) Sözleşmeye N 1 protokolünün 3. maddesine uyulması üzerine. (i) genel ilkeler. Serbest seçim hakkı, Parlamento seçimlerine katılma fırsatıyla sınırlı değildir. İlgili kişi, seçildikten sonra Parlamento üyesi olarak oturma hakkına da sahiptir. Bu garanti için Parlamento dokunulmazlığı kuralı önemlidir. Bununla birlikte, demokratik toplum için Parlamento üyesinin özgürlük ve dokunulmazlık hakkının önemi göz önüne alındığında, davalı devletin Mahkemeleri, kendilerine verilen takdir yetkisini kullanarak, bir kişinin gözaltına alınmasına ve/veya kişinin gözaltında tutulma süresinin uzatılmasına karar verirken, ilgili parlamentonun üyeleri tarafından siyasi görüşlerin ifade özgürlüğü de dahil olmak üzere, konuyla ilgili tüm çıkarları tarttıklarını göstermelidir. Söz konusu çıkarların dengelenmesi sürecinde önemli bir unsur, suçlamaların politik bir temele sahip olup olmadığı sorusudur. Bir parlamento üyesinin uygulanan tedbire etkili bir şekilde itiraz edebileceği ve şikayetlerini esas olarak ele alabileceği bir çözüm bulunmalıdır. Bu durumda, Avrupa Adalet Divanı'nın görevi, davalı devlet mahkemelerinin kararlarını, ilgili devlet makamlarının kararlarıyla değiştirmeksizin Sözleşme açısından değerlendirmektir.

THE CIRCUMSTANCES OF THE CASE

 

The applicant was an elected member of the Grand National Assembly of Turkey (hereinafter also referred to as the Turkish Parliament) and one of the co - chairs of the People's Democratic Party of Turkey, a left-wing pro-Kurdish political party. On May 20, 2016, an amendment was made to the Turkish Constitution, according to which parliamentary immunity was removed from members of the Turkish Parliament in all cases when a request for removal was submitted to the Grand National Assembly of Turkey before the date of adoption of the said amendment. This reform, supported by the Turkish President, was caused by clashes in Syria between the ISIL group (In accordance with the Decision of the Supreme Court of the Russian Federation of December 29, 2014 N AKPI14-1424C the organization is banned in the Russian Federation) and the forces of the organization with ties to the PKK (PKK), serious acts of violence in Turkey in 2014 and 2015, on the eve of the start of negotiations aimed at resolving the "Kurdish issue". The applicant, who in his statements and statements expressed an active position in relation to the mentioned events, was one of the 154 parliamentarians (including 55 members of the People's Democratic Party of Turkey) who suffered from the amendment of the Turkish Constitution under consideration. In November 2016, the applicant was detained on suspicion of membership in an armed terrorist organization and incitement to commit criminal offenses. Following an additional investigation into the aforementioned acts of violence in Turkey, the applicant remained in custody. His parliamentary mandate expired on June 24, 2018.

In a Judgment of 20 November 2018, the Chamber of the European Court decided, in particular, that there had been violations of paragraph 3 of Article 5 of the Convention and Article 18 (considered in conjunction with paragraph 3 of Article 5) of the Convention and a violation of Article 3 of Protocol No. 1 to the Convention. The Chamber of the European Court found that there had been no violation of paragraphs 1 and 4 of Article 5 of the Convention, and did not consider it necessary to consider the complaint of a violation of Article 10 of the Convention. At the request of both parties, the complaint was transferred to the Grand Chamber of the European Court.

 

LEGAL ISSUES

 

(a) A preliminary objection filed under article 35, paragraph 2 (b), of the Convention. The European Court was forced, for the first time since the Decision of the Commission on Human Rights in the case "Lukanov v. Bulgaria" (of January 12, 1995, complaint No. 21915/93), to consider whether a complaint to the Human Rights Committee of Parliamentarians of the Inter-Parliamentary Union (hereinafter referred to as the Committee) can be considered as "another procedure of international investigation or settlement". This term refers to institutions and procedures established by States, thus excluding non-governmental organizations. However, even if a specific mechanism was not created by a non-governmental organization, this does not automatically mean that it could be considered a "different procedure". In this context, the main purpose of the European Court's analysis was to determine whether the proceedings through the mentioned mechanism can be treated, taking into account procedural aspects and potential effects, as a right to file an individual complaint under article 34 of the Convention, and whether this mechanism meets the following criteria. The relevant mechanism should be public, international and judicial or quasi-judicial. The latter criterion necessarily implies that the examination carried out within the framework of such a mechanism has a clearly defined framework and is limited to certain rights and standards based on a legal instrument or "structure" by which States authorize the body using the mechanism to consider complaints filed against States and make decisions on them. This is especially important in the context of analyzing the similarities between such a mechanism and the analysis of the European Court of Justice. In the absence of a legal instrument that properly defines the boundaries of the powers of the relevant body, it will be more difficult for the European Court of Justice to establish the nature and functions of the said body and the obligations of the Member States. The mechanism under consideration should also provide institutional and procedural guarantees, such as guarantees of independence and impartiality in accordance with article 6 of the Convention, as well as provide an adversarial process that gives each party to the dispute the opportunity to receive information about the process and respond to the arguments of the opposite party. The parties to the case must also be notified of the measures taken and the decisions made. The authorized body should respect the right of the parties to participate in the process, for example, by submitting comments on the case. In addition, this body should respond to individual complaints by publishing its decisions and presenting their justifications. This authority should also be able to establish the responsibility of the State in accordance with the legal instrument on the basis of which the relevant authority conducts the examination of the case, and provide legal compensation that can prevent the alleged violation.

The functions of the Committee did not include the consideration of disputes between an individual and the State. In accordance with its statute and procedural rules, the Committee was not supposed to examine the State's compliance with its obligations under a special legal instrument, but rather to prevent possible violations, to stop violations that have already been established and/or to facilitate the State's actions to provide effective compensation for violations by ensuring dialogue with the authorities. In this regard, it cannot be considered that the Committee would carry out a judicial or quasi-judicial procedure similar to that provided for by the Convention.

 

RESOLUTION

 

The preliminary objection of the Turkish authorities, submitted on the basis of subparagraph " b " of paragraph 2 of article 35 of the Convention, was rejected.

(b) Regarding compliance with article 10 of the Convention. There was interference with the applicant's right to freedom of expression due to the application of a set of measures, namely the abolition of the applicant's parliamentary immunity, the applicant's detention and extension of his detention, the initiation of criminal proceedings against him on the basis of evidence that included his political speeches. The intervention was also based on the law that was available, namely, the amendment to the Turkish Constitution and the provisions of the Turkish Criminal Code relating to terrorism-related crimes. The question was, in particular, whether the interpretation and application of Turkish law was predictable at the time when the applicant made statements that became the basis for charging him.

(i) Parliamentary immunity. Article 83 of the Turkish Constitution provides for two types of immunity for members of the Turkish Parliament: non-jurisdiction and inviolability. Non-jurisdiction means freedom of expression of the opinions of members of the Grand National Assembly of Turkey in the sense that they cannot be prosecuted on the basis of their vote or opinions expressed in the Grand National Assembly of Turkey, or the repetition or dissemination of these opinions outside the Assembly, unless the Grand National Assembly of Turkey decides otherwise at a meeting convened on the proposal of the Presidium of the Grand National Assembly of Turkey. The lack of jurisdiction is absolute, does not allow for exceptions, does not allow for investigative actions, and it continues to apply to members of the Turkish Parliament even after their term of office has expired. The repetition of political statements outside the Turkish Parliament cannot be interpreted as limited only to the same words that were used inside the Turkish Parliament.

The contested constitutional amendment did not change article 83 of the Turkish Constitution in the part concerning non-jurisdiction. Members of the Turkish Parliament who were subject to the amendment continued to enjoy legal protection. In this regard, the task of the Turkish authorities and, in particular, the domestic courts was to determine whether the parliamentary jurisdiction extended to the applicant's political statements. The applicant maintained this position from the very beginning of the investigation in his case. However, the European Court is struck by the insufficient consideration of the relevant arguments of the applicant by the Turkish courts of all instances.

Even assuming that the applicant's political statements in question were not subject to the concept of non-jurisdiction, the constitutional amendment itself raised the issue of the predictability of legal norms. Parliamentary immunity protected the elected members of the Turkish Parliament from any detention, detention or indictment during the exercise of their powers, without the consent of the Turkish Parliament. However, after the amendment, the political statements of members of the Turkish Parliament became punishable under Turkish criminal law in the absence of guarantees against appeals for the removal of parliamentary immunity provided by articles 83 and 85 of the Turkish Constitution. In particular, the Turkish Parliament was no longer obliged to assess the individual situation of each member of Parliament affected by this issue. Although the Turkish Parliament has preserved the regime of parliamentary immunity, it has at the same time made it inapplicable to certain members of Parliament on the basis of a text drawn up in general and vague formulations. In this regard, the European Court fully agreed with the unambiguous conclusion of the Venice Commission that this one-time unprecedented ad homines amendment was clearly aimed at specific statements of members of the Turkish Parliament, especially those who belonged to the opposition, and thus it was "an abuse of the procedure for amending the Constitution".

A member of the Turkish Parliament could not reasonably expect that this procedure would be introduced during the exercise of his powers, thus violating the right of members of the Turkish Parliament to freedom of expression. Taking into account the wording of article 83 of the Turkish Constitution and its interpretation or lack thereof by the Turkish courts, the intervention was not predictable.

(ii) Crimes related to terrorism. The applicant was taken into custody, and his detention was extended on the basis of the applicant's statements for crimes related to terrorism, in particular for forming or leading an armed terrorist organization and membership in such an organization (article 314 of the Turkish Criminal Code). The European Court took into account the difficulties associated with the prevention of terrorism and the adoption of anti-terrorist laws. Member States inevitably resorted to general formulations, the application of which depended on their practical interpretation by the judicial authorities. Interpreting the legislation in this context, the courts of the respondent State should have provided individuals with adequate protection against arbitrary interference.

The Turkish Criminal Code did not define the elements of the corpus delicti, which were set out in the case law of the Turkish Court of Cassation. In the present case, the Turkish courts have adopted a broad interpretation of the crimes under consideration. Political statements in which the applicant expressed his disagreement with certain Government policies or simply mentioned that he was a member of the Congress of Democratic Society, a legitimate organization, were sufficient to constitute actions capable of establishing an active link between the applicant and an armed organization. The Turkish courts did not take into account the requirements established by the Turkish Court of Cassation, including the "duration, variety and intensity" of the applicant's actions or the question of whether the applicant committed crimes within the hierarchical structure of the terrorist organization in question. The variety of actions that could justify the applicant's detention in connection with the serious crimes under consideration was so great that the composition of crimes punishable under article 314 of the Turkish Criminal Code, taken together with the interpretation adopted by the Turkish courts, did not provide adequate protection against arbitrary interference by the Turkish authorities. Such a broad interpretation could not be justified if it entailed equating the use of the right to freedom of expression with participation in an armed terrorist organization, its creation or leadership, in the absence of any concrete evidence of such a connection.

 

RESOLUTION

 

The case involved a violation of the requirements of article 10 of the Convention (adopted by 16 votes in favor, with one against).

(c) Regarding compliance with article 3 of Protocol No. 1 to the Convention. (i) General principles. The right to free elections is not limited to the opportunity to participate in parliamentary elections. The interested person also has the right, as soon as he is elected, to sit as a member of Parliament. The rule on parliamentary immunity is of key importance for this guarantee. The European Court had to re-examine the complaint about the violation of Article 3 of Protocol No. 1 to the Convention concerning the consequences of keeping a member of Parliament who won the election in custody as part of the chosen preventive measure for the exercise of his official powers by the specified person. The application of a measure that deprives a member of Parliament or a candidate for a member of Parliament of freedom does not automatically mean a violation of article 3 of Protocol No. 1 to the Convention. Nevertheless, taking into account the importance for a democratic society of the right of a member of Parliament to freedom and inviolability, the courts of the respondent State must demonstrate, using the discretion granted to them, that when making a decision on the detention of a person and/or extending the period of detention of a person, they weighed all relevant interests, including freedom of expression of political opinions by members of the relevant parliament. An important element in the process of establishing a balance of these interests is the question of whether the accusations have a political basis. There must be a remedy by which a member of Parliament can effectively appeal against the measure applied and achieve consideration of his complaints on the merits. In this case, the task of the European Court is to consider the decisions of the courts of the respondent State from the point of view of the Convention, without replacing the decisions of the relevant State authorities with its conclusions.

(ii) The application of the above principles in the present case. As a result of his pre-trial detention, the applicant was unable to exercise his powers in the Turkish legislative authority for more than a year and a half. Although he retained his seat in the Turkish Parliament and could submit questions in writing, the applicant could not freely enjoy the rights granted by article 3 of Protocol No. 1 to the Convention.

The relationship between article 10 of the Convention and article 3 of Protocol No. 1 to the Convention is particularly obvious in cases where a representative of the government elected during democratic elections is detained for expressing his political opinions. It is very important to protect the freedom of representatives of society to express their opinion, especially if this applies to representatives of the opposition. The European Court will always conduct a thorough check to make sure that there has been no interference with the right to freedom of expression, while at the same time being aware of possible restrictions on this freedom, namely, to prevent direct or hidden calls for violence. From this point of view, the European Court decided that if the detention of a member of Parliament cannot be considered in accordance with Article 10 of the Convention, as in the present case, then this procedural action will also violate Article 3 of Protocol No. 1 to the Convention. Moreover, the Court's conclusion that there was no reasonable suspicion that the applicant had committed a crime, as required by paragraph 1 of Article 5 of the Convention (see below), was also important for the purposes of Article 3 of Protocol No. 1 to the Convention. While the duration of pre-detention of a person should, as a rule, be as short as possible, these considerations apply a fortiori to the detention of members of Parliament who represent their constituents, draw attention to the needs of these people and protect their interests.

If the State grants parliamentary immunity from prosecution and deprivation of liberty, the domestic courts must first verify that the members of the relevant parliament do not have parliamentary immunity in relation to the actions of which they are accused. However, it appears that in the present case, the Turkish courts did not conduct such a check, thereby violating their procedural obligation under article 3 of Protocol No. 1 to the Convention. It was also not demonstrated that the domestic courts would have taken actions aimed at achieving the required balance, weighing all competing interests in the case. The Constitutional Court of Turkey did not consider whether the crimes of which the applicant was accused were directly related to his political activities. The Turkish judicial authorities did not take into account the fact that the applicant was not only a member of the Turkish Parliament, but also one of the leaders of the political opposition, and the exercise of his parliamentary powers required a higher level of protection. In addition, it was not explained why it was not enough to apply an alternative preventive measure in the applicant's case. The fact that the applicant did not have the opportunity to participate in the work of the Turkish Parliament while he was in custody was an unjustified interference with the right to freedom of expression and the applicant's right to be elected to the Turkish Parliament and to participate in its meetings. Thus, the applicant's detention under the chosen preventive measure did not correspond to the very essence of the right guaranteed by article 3 of Protocol No. 1 to the Convention.

 

RESOLUTION

 

The case involved a violation of the requirements of Article 3 of Protocol No. 1 to the Convention (adopted unanimously).

(d) Regarding compliance with article 18 of the Convention in relation to article 5 of the Convention. The Court had to consider whether the applicant's pre-trial detention, in the absence of a reasonable suspicion and in violation of Article 5 of the Convention, really had a hidden purpose. The European Court noted the following factors: measures to lift parliamentary immunity were taken only after the elections, as a result of which the ruling party lost its leading position in the Grand National Assembly of Turkey, and the only ones who really fell under the effect of the constitutional amendment under consideration were members of opposition parties. The applicant's detention was not the only example, but on the contrary, apparently, was carried out within the framework of the established scheme. The period of the applicant's detention meant that he was deprived of his liberty, in particular, during two key political campaigns (the referendum on constitutional reform and the presidential elections). The Court also took into account the circumstances of the applicant's remand in custody, when a corresponding decision was issued on the day of his release in another criminal case, as well as the conclusions of other Council of Europe bodies regarding the independence of the Turkish judicial system and the tense political climate that created conditions that could influence the decisions of Turkish courts - especially during the state of emergency, when hundreds of judges were dismissed, in particular with regard to criminal cases against opposition representatives. These factors allowed the European Court to conclude that the objectives of the applicant's detention announced by the Turkish authorities were only a cover for the true motive, namely, to suppress pluralism and restrict the freedom of political debate.

 

RESOLUTION

 

The case involved a violation of the requirements of article 18 of the Convention in connection with article 5 of the Convention (adopted by 16 votes in favor, with one against).

The European Court also ruled (by 15 votes in favor with two against and 16 votes in favor with one against, respectively) that there had been a violation of paragraphs 1 and 3 of Article 5 of the Convention due to the absence of a reasonable suspicion that the applicant had committed a criminal offense that made it necessary to detain him as a preventive measure chosen for him and to extend the specified period of detention. In addition, the Court considered that a claim for compensation under paragraphs "a" and " d " of part one of Article 141 of the Turkish Code of Criminal Procedure could not be considered an effective remedy either in relation to the alleged absence of a reasonable suspicion that a person has committed a crime, or in relation to the alleged absence of relevant and sufficient grounds to justify the detention of a person for the purposes of paragraphs 1 and 3 of Article 5 of the Convention. The European Court also found by 16 votes in favor, with one against, that there was no violation of paragraph 4 of Article 5 of the Convention regarding the issue of compliance by the Turkish Constitutional Court with the requirement of "urgency" according to the reasoning of the Chamber of the European Court and in the light of the special circumstances of the case.

Concerning the application of article 46 of the Convention. The European Court ordered the Turkish authorities to take all necessary measures to ensure the applicant's immediate release from custody.

 

COMPENSATION

 

In the application of article 41 of the Convention. The European Court awarded the applicant 3,500 and 25,000 euros in compensation for material damage and non-pecuniary damage, respectively.

В 2018 году заявителю была оказана помощь в подготовке жалобы. Впоследствии жалоба была коммуницирована Турции.

 

По делу успешно рассмотрена жалоба на ненадлежащее рассмотрение судом вопроса об увольнении сотрудника органа государственной власти на основании нормативного акта о чрезвычайном положении в связи с предполагаемыми связями увольняемого с террористической организацией. По делу было допущено нарушение требований пункта 1 статьи 6 Конвенции о защите прав человека и основных свобод.

 

 

 

ОБСТОЯТЕЛЬСТВА ДЕЛА

 

 

 

Заявитель был уволен с должности эксперта в Управлении агентства по сотрудничеству г. Анкары (Ankara Kalkinma Ajansi) (далее - Агентство) на основании Указа о чрезвычайном положении N 667 (далее - Указ). Заявитель был уволен вследствие его предполагаемых связей с террористической организацией, которая, как считали власти Турции, спровоцировала военный переворот 15 июля 2016 г.

 

Заявитель обжаловал факт своего увольнения, а также последовавшее за этим судебное разбирательство.

 

 

 

ВОПРОСЫ ПРАВА

 

 

 

По поводу соблюдения пункта 1 статьи 6 Конвенции. К настоящему делу статья 6 Конвенции применима в ее гражданско-правовом, а не уголовно-правовом аспекте.

 

(a) Процедура, касающаяся прекращения трудового договора. Трудовой договор заявителя был прекращен по инициативе работодателя, который сослался на Указ, а не на положения Трудового кодекса, регулирующие прекращение трудового договора по уважительным причинам, вследствие чего в настоящем деле не были соблюдены определенные процессуальные требования. Указ санкционировал увольнение государственных гражданских служащих и лиц, работающих в органах государственной власти по найму, по упрощенной процедуре, которая не требовала проведения состязательного процесса и не обеспечивала каких-либо особых процессуальных гарантий. Работодателю было достаточно считать, что его работник принадлежал, был аффилирован или связан с одной из запрещенных организаций, упомянутых в Указе, без необходимости приводить хоть сколько-нибудь персонализированные доводы.

 

(b) Судебное рассмотрение. (i) Пределы рассмотрения дела. Единственным вариантом для действий заявителя являлось обращение в суды Турции с ходатайством предоставить ему сведения о фактах или иных доказательствах, которые могли бы подтвердить мнение его работодателя, чтобы заявитель мог обжаловать вероятность, достоверность и надежность упомянутых доказательств. Следовательно, суды Турции были обязаны рассмотреть все фактические и юридические вопросы, связанные с переданным им на рассмотрение делом, чтобы обеспечить заявителю эффективное судебное разбирательство, касавшееся решения его работодателя.

 

(ii) Характеристика судебного разбирательства. В материалах дела ничто не указывало на то, что процесс принятия решения судами Турции не отвечал бы требованиям состязательности процесса и принципу равенства сторон.

 

(iii) Мотивировка судебных решений. Суды Турции отклонили жалобу заявителя на том основании, что прекращение действия его договора считалось законным согласно упомянутому выше Указу, и при этом суды не рассмотрели вопрос о "прекращении договора по уважительной причине" по смыслу Трудового кодекса Турции.

 

Кроме того, внутригосударственные суды рассмотрели только вопрос о том, было ли решение об увольнении заявителя принято компетентным органом и было ли обжалуемое заявителем решение основано на законе. Соответствующие суды Турции ни разу не предприняли попытку установить, было ли прекращение трудового договора с заявителем по причине его предполагаемых связей с незаконной организацией оправдано поведением заявителя либо иными относящимися к делу доказательствами или сведениями. Более того, основания жалобы заявителя не были надлежащим образом рассмотрены судами Турции. Тот факт, что Конституционный суд Турции вынес краткое решение о неприемлемости жалобы, доказывал, что данный суд не анализировал юридические вопросы и вопросы права.

 

Выводы судов Турции демонстрировали, что внутригосударственные суды не провели какого-либо глубокого, тщательного рассмотрения жалоб заявителя, что они не основывали свои выводы на представленных заявителем доказательствах и что они не привели уважительных причин для отклонения доводов заявителя. Отмеченные недостатки поставили заявителя в явно невыгодное положение vis-a-vis его оппонентам.

 

(c) Вывод. Несмотря на тот факт, что теоретически суды Турции обладали всей полнотой юрисдикции для разрешения спора между заявителем и государственными органами власти, они отказались рассматривать все фактические и юридические вопросы, относящиеся к переданному им на рассмотрение делу. Следовательно, суды Турции не выслушали заявителя надлежащим образом, что нарушило его право на справедливое судебное разбирательство.

 

Что касается статьи 15 Конвенции, то даже если процедуры, предусмотренные Указом, могли бы считаться обоснованными с учетом крайне специфических обстоятельств чрезвычайного положения, упомянутый Указ не ограничивал возможности проведения судебных разбирательств после прекращения трудовых договоров заинтересованных лиц. Принимая во внимание значимость затронутых вопросов для конвенционных прав истцов, если Указ о чрезвычайном положении не содержит ясных и точных положений, исключающих какую-либо возможность судебного рассмотрения мер, принятых в целях его исполнения, данная ситуация всегда должна толковаться как наделяющая суды государства-ответчика правом проводить разбирательство такого качества, которое достаточно для того, чтобы избежать произвола в отношении заинтересованных лиц. При обстоятельствах настоящего дела невыполнение требований, связанных со справедливым судебным разбирательством, не могло быть оправдано отступлением властей Турции от выполнения своих обязательств в соответствии с Конвенцией.

 

 

 

ПОСТАНОВЛЕНИЕ

 

 

 

По делу было допущено нарушение требований пункта 1 статьи 6 Конвенции (принято единогласно).

 

По поводу соблюдения статьи 8 Конвенции. (a) Применимость. В настоящем деле не было никаких доказательств, которые заставляли бы предположить, что прекращение трудового договора являлось бы предвидимым результатом собственных действий заявителя. Заявитель потерял работу, то есть источник дохода для получения средств к существованию. Европейский Суд особо отметил довод заявителя о том, что в обществе его назвали "террористом" и, таким образом, его "заклеймили": никто из других работодателей не осмеливался предложить заявителю работу, поскольку заявитель был уволен на основании Указа. Следовательно, имели место реальные последствия для возможности установления и поддержания заявителем отношений, включая профессиональные, а также серьезные негативные последствия для его профессиональной и социальной репутации. Следовательно, статья 8 Конвенции применима к настоящему делу.

 

(b) Существо жалобы. Решение о прекращении трудового договора с заявителем было принято не органом государственной власти, а местным подразделением Агентства. Несмотря на свой статус публично-правовой организации, Агентство не осуществляло властных полномочий. Кроме того, хотя трудовой договор с заявителем регулировался Трудовым кодексом Турции, он был уволен на основании подпункта "g" пункта 1 статьи 4 Указа, который требовал от работодателя прекратить трудовые отношения с работниками, в отношении которых имелись подозрения об их связи с незаконными организациями. Таким образом, увольнение в настоящем деле могло рассматриваться как предусмотренная Указом обязанность, далеко выходящая за рамки правовой базы, регулирующей трудовые отношения заявителя и его работодателя. Более того, власти Турции несли бы ответственность, если бы обжалуемые факты стали результатом неспособности властей гарантировать осуществление заявителем его права, предусмотренного статьей 8 Конвенции. При таких условиях увольнение заявителя по причине его предполагаемых связей с незаконной организацией могло рассматриваться как вмешательство в его право на уважение частной жизни. Вмешательство было предусмотрено законом и преследовало несколько законных целей, а именно защиту национальной безопасности и предотвращение беспорядков и преступлений.

 

Что касается вопроса о том, сопровождался ли процесс принятия решения об увольнении заявителя гарантиями против произвола, упомянутый процесс был проведен очень поверхностно. Единственным основанием для решения была указана ссылка на положения подпункта "g" пункта 1 статьи 4 Указа, касающегося увольнения работников, которых считают принадлежащими, аффилированными или связанными с незаконной организацией. Также при рассмотрении дела заявителю так ни разу и не было явно предъявлено обвинение.

 

В настоящем деле были применимы, mutatis mutandis, соображения относительно долга лояльности государственного должностного лица, принимая во внимание цель работы Агентств. Следуя своим изложенным выше выводам относительно статьи 6 Конвенции, Европейский Суд согласился с тем, что введенная Указом упрощенная процедура увольнения государственных должностных лиц и иных работников гражданской службы могла бы считаться обоснованной с учетом крайне специфических обстоятельств, сложившихся в стране после попытки военного переворота 15 июля 2016 г., принимая во внимание тот факт, что меры, принятые в рамках чрезвычайного положения, подлежали судебному контролю.

 

Что касается тщательности судебного рассмотрения обжалуемой меры, Европейский Суд был готов согласиться с тем, что членство в структурах, организованных по военному образцу или устанавливающих жесткие и нерушимые связи солидарности между своими членами, или иным образом следующих идеологии, противоречащей правилам демократии, которые являются основным компонентом "европейского публичного порядка", могли затронуть проблему, связанную с национальной безопасностью и предотвращением беспорядков, если членам упомянутых структур приходилось осуществлять публично-правовые функции.

 

Следовательно, органам государственной власти или иным органам в сфере государственной гражданской службы, естественно, важно определять потенциальные угрозы для национальной безопасности. Однако внутригосударственные суды должны иметь возможность применять наказание в тех случаях, когда ссылка на упомянутую концепцию не основана разумно на фактах или указывает на произвольное толкование ситуации.

 

В настоящем деле Европейский Суд не находился в том положении, чтобы принять решение относительно доводов властей Турции о причинах увольнения заявителя. Действительно, даже если увольнение заявителя было основано на его предполагаемых связях с незаконной организацией, решения судов Турции не прояснили то обстоятельство, какие критерии были использованы, чтобы оправдать оценку ситуации работодателем заявителя и определить точный характер предъявленных заявителю обвинений. Суды Турции признали, без проведения углубленного изучения оспариваемой меры, которая тем не менее имела важные последствия для права заявителя на уважение его частной жизни, что упомянутая оценка являлась действительной причиной для решения о прекращении трудовых отношений с заявителем. Başvuru sahibi, n 667 sayılı olağanüstü hal Kararnamesi (bundan böyle Kararname) gerekçesiyle Ankara Kalkınma Ajansı (bundan böyle Ajans olarak anılacaktır) Bürosunda uzman olarak görevden alındı. Başvuran, Türk makamlarının 15 Temmuz 2016'da askeri darbeyi tetiklediğine inandığı bir terör örgütü ile yaptığı iddia edilen ilişkiler nedeniyle görevden alındı.

HUKUK SORULARI

 

 

 

Sözleşmenin 6. maddesinin 1. maddesine uymakla ilgili. Bu durumda, Sözleşmenin 6. maddesi, cezai hukuki açıdan değil, medeni hukukunda geçerlidir.

 

(a) iş sözleşmesinin feshi ile ilgili prosedür. Başvuranın iş sözleşmesi, işverenin inisiyatifiyle sonlandırıldı; bu Kararname, iş sözleşmesinin iyi nedenlerle sona ermesini düzenleyen İş Kanunu hükümlerine değil, bu durumda belirli usul gerekliliklerine uyulmamasına neden oldu. Bu nedenle, Türkiye Mahkemeleri, başvuru sahibi ile iş sözleşmesinin feshi için gerçek bir neden belirtmemiştir. Bu nedenle, itiraz edilen tedbirin uygulanmasına ilişkin adli inceleme, bu davada uygun değildi.

The ECHR decision of December 15, 2020 in the case "Piskin v. Turkey" (aplication No. 33399/18).

 

In 2018, the applicant was assisted in preparing the aplication. Subsequently, the aplication was communicated to Turkey.

 

In the case, an aplication was successfully considered for improper consideration by the court of the issue of dismissal of an employee of a state authority on the basis of a regulatory act on a state of emergency in connection with the alleged links of the dismissed person with a terrorist organization. The case involved a violation of the requirements of paragraph 1 of article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

 

THE CIRCUMSTANCES OF THE CASE

 

 

 

The applicant was dismissed from the position of an expert in the Office of the Ankara Cooperation Agency (Ankara Kalkinma Ajansi) (hereinafter referred to as the Agency) on the basis of Decree on the State of Emergency No. 667 (hereinafter referred to as the Decree). The applicant was dismissed due to his alleged links with a terrorist organization, which, according to the Turkish authorities, provoked a military coup on July 15, 2016.

 

The applicant appealed the fact of his dismissal, as well as the subsequent court proceedings.

 

 

 

LEGAL ISSUES

 

 

 

Regarding compliance with article 6, paragraph 1, of the Convention. Article 6 of the Convention is applicable to the present case in its civil law, and not in its criminal law aspect.

 

(a) The procedure concerning the termination of the employment contract. The applicant's employment contract was terminated at the initiative of the employer, who referred to the Decree, and not to the provisions of the Labor Code regulating the termination of the employment contract for valid reasons, as a result of which certain procedural requirements were not met in the present case. The decree authorized the dismissal of State civil servants and persons working in State authorities for hire, according to a simplified procedure that did not require an adversarial process and did not provide any special procedural guarantees. It was enough for the employer to assume that his employee belonged to, was affiliated with or associated with one of the prohibited organizations mentioned in the Decree, without having to give at least some personalized arguments.

 

(b) Judicial review. (i) The limits of consideration of the case. The only option for the applicant's actions was to apply to the Turkish courts with a request to provide him with information about facts or other evidence that could confirm the opinion of his employer, so that the applicant could appeal against the probability, reliability and reliability of the mentioned evidence. Consequently, the Turkish courts were obliged to consider all the factual and legal issues related to the case referred to them in order to ensure that the applicant had an effective trial concerning the decision of his employer.

 

(ii) Characteristics of the trial. There was nothing in the case file to indicate that the decision-making process by the Turkish courts would not meet the requirements of the adversarial process and the principle of equality of the parties.

 

(iii) Reasons for court decisions. The Turkish courts rejected the applicant's complaint on the grounds that the termination of his contract was considered lawful under the above-mentioned Decree, and the courts did not consider the issue of "termination of the contract for a valid reason" within the meaning of the Turkish Labor Code.

 

In addition, the domestic courts considered only the question of whether the decision to dismiss the applicant was taken by the competent authority and whether the decision appealed by the applicant was based on the law. The relevant Turkish courts have never attempted to establish whether the termination of the employment contract with the applicant because of his alleged links with an illegal organization was justified by the applicant's behavior or other relevant evidence or information. Moreover, the grounds of the applicant's complaint were not properly considered by the Turkish courts. The fact that the Constitutional Court of Turkey issued a brief decision on the inadmissibility of the complaint proved that this court did not analyze legal and legal issues.

 

The findings of the Turkish courts demonstrated that the domestic courts did not conduct any in-depth, thorough examination of the applicant's complaints, that they did not base their conclusions on the evidence presented by the applicant and that they did not give valid reasons for rejecting the applicant's arguments. The shortcomings noted put the applicant at a clear disadvantage vis-a-vis to his opponents.

 

(c) Output. Despite the fact that, theoretically, the Turkish courts had full jurisdiction to resolve the dispute between the applicant and the State authorities, they refused to consider all the factual and legal issues related to the case submitted to them for consideration. Consequently, the Turkish courts did not properly listen to the applicant, which violated his right to a fair trial.

 

With regard to article 15 of the Convention, even if the procedures provided for by the Decree could be considered justified in view of the extremely specific circumstances of the state of emergency, the said Decree did not limit the possibility of conducting judicial proceedings after the termination of the employment contracts of the persons concerned. Taking into account the importance of the issues raised for the convention rights of the plaintiffs, if the Decree on the State of Emergency does not contain clear and precise provisions that exclude any possibility of judicial review of the measures taken for the purpose of its execution, this situation should always be interpreted as giving the courts of the respondent State the right to conduct proceedings of such quality that is sufficient to avoid arbitrariness against the interested persons. In the circumstances of the present case, the failure to comply with the requirements related to a fair trial could not be justified by the departure of the Turkish authorities from fulfilling their obligations under the Convention.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of paragraph 1 of Article 6 of the Convention (adopted unanimously).

 

Regarding compliance with article 8 of the Convention. (a) Applicability. In the present case, there was no evidence to suggest that the termination of the employment contract would have been a foreseeable result of the applicant's own actions. The applicant has lost his job, that is, a source of income for obtaining a livelihood. The Court particularly noted the applicant's argument that he was called a "terrorist" in society and thus "branded": none of the other employers dared to offer the applicant a job, since the applicant was dismissed on the basis of a decree. Consequently, there were real consequences for the applicant's ability to establish and maintain relationships, including professional ones, as well as serious negative consequences for his professional and social reputation. Consequently, article 8 of the Convention is applicable to the present case.

 

(b) The substance of the complaint. The decision to terminate the employment contract with the applicant was made not by a State authority, but by a local subdivision of the Agency. Despite its status as a public legal organization, the Agency did not exercise any authority. In addition, although the employment contract with the applicant was regulated by the Turkish Labour Code, he was dismissed on the basis of article 4, paragraph 1 (g), of the Decree, which required the employer to terminate employment relations with employees who were suspected of having links with illegal organizations. Thus, the dismissal in the present case could be considered as an obligation provided for by the Decree, far beyond the legal framework regulating the employment relations of the applicant and his employer. Moreover, the Turkish authorities would be liable if the facts complained of were the result of the authorities ' failure to guarantee the applicant's exercise of his right under article 8 of the Convention. Under such conditions, the dismissal of the applicant on the grounds of his alleged links with an illegal organization could be considered as an interference with his right to respect for private life. The intervention was provided for by law and pursued several legitimate goals, namely the protection of national security and the prevention of riots and crimes.

 

As for the question of whether the decision-making process to dismiss the applicant was accompanied by guarantees against arbitrariness, the mentioned process was conducted very superficially. The only reason for the decision was a reference to the provisions of subparagraph " g " of paragraph 1 of Article 4 of the Decree concerning the dismissal of employees who are considered to belong to, affiliated with or associated with an illegal organization. Also, during the consideration of the case, the applicant was never explicitly charged.

 

In the present case, considerations regarding the duty of loyalty of a public official were applicable, mutatis mutandis, taking into account the purpose of the work of the Agencies. Following its conclusions set out above regarding Article 6 of the Convention, the European Court agreed that the simplified procedure for the dismissal of State officials and other civil service employees introduced by the Decree could be considered justified taking into account the extremely specific circumstances that developed in the country after the military coup attempt on July 15, 2016, taking into account the fact that the measures taken under the state of emergency were subject to judicial control.

 

As for the thoroughness of the judicial review of the contested measure, the European Court was ready to agree that membership in structures organized according to the military model or establishing rigid and unbreakable ties of solidarity between their members, or otherwise following an ideology contrary to the rules of democracy, which are the main component of the "European public order", could affect the problem related to national security and the prevention of unrest, if the members of these structures had to perform public-legal functions.

 

Therefore, it is naturally important for state authorities or other bodies in the field of state civil service to identify potential threats to national security. However, domestic courts should be able to apply punishment in cases where the reference to the mentioned concept is not based reasonably on the facts or indicates an arbitrary interpretation of the situation.

 

In the present case, the European Court was not in a position to decide on the arguments of the Turkish authorities about the reasons for the applicant's dismissal. Indeed, even if the applicant's dismissal was based on his alleged links with an illegal organization, the decisions of the Turkish courts did not clarify what criteria were used to justify the assessment of the situation by the applicant's employer and to determine the exact nature of the charges against the applicant. The Turkish courts recognized, without conducting an in-depth study of the contested measure, which nevertheless had important consequences for the applicant's right to respect for his private life, that the mentioned assessment was a valid reason for the decision to terminate the employment relationship with the applicant. Thus, the Turkish courts did not indicate any real reasons for the termination of the employment contract with the applicant. Consequently, the judicial review of the application of the appealed measure was not appropriate in the present case.

 

The arguments presented by the Turkish authorities were relevant to the case, but were not sufficient to demonstrate that the alleged interference was "necessary in a democratic society". In particular, the applicant was not provided with the required minimum level of protection against arbitrariness.

 

 

 

RESOLUTION

 

 

 

The case involved a violation of the requirements of article 8 of the Convention (adopted unanimously).
